Editors Note... This is the time when talking to relatives back home you realise how lucky we are to have such beautiful weather all year round. It sometimes feels like England when I wake to take my son to school but by lunchtime you could easily hit the beach and sunbathe. Almost two seasons in one day. Meanwhile I talk to relatives who stay cosy at home as its too cold to venture outdoors. However, the great weather does nothing to solve the drought situation in which the reservoirs are currently at 30% of their capacity.

AXARQUIA SOLICITORS 5 Steps To Be Followed For Dealing With An Inheritance Of An Expat Or Non-resident In Spain

O

rganizing an inheritance in Spain is a difficult task for everyone, specially if you don't know the Spanish law. In this post we explain the basic steps to be followed when a nonresident or expat passes away owning assets in Spain. It is necessary to carry out a legal procedure to change ownership of assets of the deceased person into the name of the heirs. 1st Step: Get an original death certificate. This official document is normally provided by the funeral company and it can also be obtained from the Civil Registry. 2nd Step: Get original certificates of the last will (if any) signed by the deceased person, as well as the certificate of any life insurance policies in place. With these certificates we will confirm if the deceased person made a will in Spain. We can find

two situations: a) Existence of a will made inside or outside Spain. In this case the assets will be distributed according to the wishes of the deceased person. b Non-existence of a will. If the deceased person never made a will, the distribution of his assets will be made according to the laws of his nationality. 3rd Step: the heirs or relatives of the deceased person will have to sign an inheritance deed in front of a Spanish Public Notary in order to accept and distribute all the assets. Please, be aware that debts are also inherited so it is important to confirm that the value of the assests is higher than any possible debts. 4th Step: Filling Inheritance Tax Form 650 with the local Tax Office. For EU citizens there are allowances up to 1.000.000 euros

per heir (in case of direct relatives: spouse and children), so in most cases there won't be any inheritance tax to be paid. The inheritance taxes must be filled within 6 months from the date of the death. 5th Step: Take the inheritance title deeds to the Land Registry in case the deceased person owned a real state property or to banks /insurance companies in case the deceased person had funds, bank accounts or life insurance policies. We recommend hiring the professional services of a solicitor so this procedure can be done in a speedy and correct way. Three Kings parade and then kicks off their carnival season in February - there’s a prize for best costume and it’s great fun watching all the entries. Another big one is the Romeria (pilgrimage) of San Antonio which is celebrated with many traditional Andalusian sights such as flamenco, singing and horse racing. COMPETA MEDICAL CENTRE Is this The Year Of the New Medical Centre?

M

edical Centre 2022, is this the year of the new Medical Centre? Cynical old soul that I am but I have been through so many rumours that I will wait and see! Way back, about twelve years ago the sign for the new centre went up at the ‘knicker factory’, that sign eventually disintegrated over the years with no progress but a lot of hot air and a mended roof on the building, and now once more the building work has restarted under the car park. (Who remembers the idealized Architect drawing of future car park, with grass, a fountain in front and not a car in sight)! The last time the centre was going to be there, windows were put in and then taken out, and the talk at Miguel’s was, ‘hope the glass is more frosted than that, but it will be fun watching examinations when in the waiting room’, aka Bar Miguel. (On February 8th this year, it’s been opened for sixteen years)!

The ‘pre pre Covid’ surgery was fun to visit if you like noise and chaos. There were patients with small dogs, babies in prams inside the small waiting room, along with gran, maybe great gran and mum, and a receptionist working part of the morning trying to keep order. There were casual visitors seeing who had been ‘hatched and dispatched’, (it was more a meeting place than a surgery), and a regular visit from ‘ola Lola’, with a smile and an enquiry as to why you were there, then there would be a general discussion of everyone’s’ aches and pains. Aurelio visited for a daily sweet fix, (there was a bowl on the desk, he was diabetic), and ‘Fernando one toe’ and dog, popped in most days. Urine tests were always a source of speculation, if a young girl came from doctors’ room and asked the receptionist for a container, heads would bob with whispers of ‘embarazada’ (pregnant), a middle aged, just a knowing nod, and an old person, a sympathetic look. I loved it, all this Covid has changed it to a boring waiting

room, with the receptionist, in a white coat, demanding silence. Years ago, Fernando had been a sugarcane cutter, then agricultural worker and would come back from work, ‘under the weather’, holding the tail of his donkey, (known to some as Donkey Man). The animal would bring him to the centre of the village by Vendimia, and both would wander up the narrow street to home, sometimes together, sometimes individually, and there were even postcards on sale in Marco Polo of this sight. He lived on his own, got diabetes, had a toe removed and eventually a leg and finally died, sadly Lola did too, but not Aurelio, he’s about, cheerfully sitting outside the bank or the church, now that the Ocio next to the Consultorio has not reopened. For the past fourteen or so years the surgery’s medical team has greatly improved, with a twentyfour-hour ambulance service and helpful staff. The days of going to the hospital for minor blood tests

or ECGs are long gone. There is an efficient computer system which when first introduced showed up all the people who had been wrongly put on the system and some who had not, but in time everything got sorted. The appointment system improved, no more remembering the time, and fighting with another person at the surgery door saying, ‘it’s my turn’. At first, we all sat about clutching our paper appointments asking, ‘what time are you?’ which helped the very old generation, who couldn’t read very well. (Some of you may be wondering why reading an appointment is difficult, but historically for that very old generation only basic schooling was for the men, and the ladies learned other skills). The signs on the doors of ‘do not disturb’, for years were largely ignored by all ages, and it was not uncommon for one to be with the nurse and have someone barge in with a cheery wave, even if you were at deaths door! I expect the new place will be

sterile, modern, silent and no fun. Still, it may have a toilet that boasts soap and paper towels, something that is lacking in the present surgery and indeed has been for years, or I have been unlucky using it when it’s just run out. I used to use the Ocio, when working over the road for Caritas, that always had soap and towels, a spotless loo and 80c coffee. (Noticed in January that the Caritas building is no more). The Ocios on the coast are all open, but I think the reason ours hasn’t is because it is a bit small for social distancing, having said that the men all sit close to each other on the benches in the Plaza and at tables in the bars anyway! I miss it and so do the men, who are chucked out of the home after breakfast (floors to be swilled, men get in the way)! The previous Ocio (means leisure) was over the Unicaja bank up the stairs, not a good venue for limpy-legged pensioners and then a replacement was opened to quite a fanfare, with computers and a large TV lounge, but the

men preferred sitting at tables concentrating on banging dominoes about. The ladies hardly ever used it but some of us Brits did, especially after a doctor’s visit, finding it friendly, warm, with a well-stocked bar and decent coffee including a small cake, here’s hoping it opens soon. If you are a pensioner and fancy a visit to a local Ocio, don’t mention that you are from another village. Having said that I’ve visited a couple in other areas and never been challenged, even though I looked like an exhausted tourist when I visited Cordoba! The one by the Torre bus station has a lovely large garden, with clean loos. I’m not criticising the Ayuntamiento, my tongue as usual is firmly in my cheek! Josephine Drew

here do I start? Is the first question I ask, the second question is, “Where does it all come from?” Moving house is a huge undertaking at any time but moving from somewhere you have lived for 10 years and downsizing quite considerably is even more of a challenge. The “stuff" I seem to have accumulated is extraordinary. And so the clear out begins.... as it turns out my “stuff" is not bad and some of it is hardly used and there's even things that are still new, but what will I do with it all? I decide that I quite fancy having

a little sale and look around for flea markets or local Boot Sales. The only ones available are on the coast and the prospect of carting my wares all the way down there on a Sunday morning at the crack of a sparrows fart is not overly appealing if I'm being honest. It is with all this in mind that the idea of the Competa Car Boot sale is formed. Maria from the Hotel Balcon here in the village, has agreed that we can use their car park on Saturday 5th March from 11am to 3pm, which I think are quite sociable hours! (Stall holders can access from 10am and all cars must book in advance) Each person taking

MORINGA SPAIN

A New Super Food Grown In Malaga

A

mong the Axarchic crops of avocados and mangoes, a new member has crept in, the moringa. Considered a superfood, this tree product `Sabor a Málaga´ from India has been growing in the Malaga region for 5 years. Salvador Rodríguez was a businessman far from the agricultural world who decided to believe in this plant, betting on sustainable and ecological cultivation .

Under the name `Moringa Spain´, Rodríguez markets in Spain and exports to Europe the product extracted from the tree of life. The cultivation extends over five hectares distributed by different farms in Rincón de la Victoria. A dark green leaf that grows on trees that can reach up to 15 meters in height. Typical of tropical climates, resistant to drought, but which requires ordinary amounts of water to offer a quality product. It contains more

than 90 nutrients and is rich in Vitamin A, C and E, calcium and antioxidants. In addition, three grams of the product is equivalent to the recommended amount of vegetable protein per day . This is Moringa Oleifera . A food that can be consumed in infusions, capsules, powder or seeds and that the FAO (Food and Agriculture Organization of the United Nations) and the WHO (World Health Organization) described as the discovery of the century .

"I opted for a quality moringa, to differentiate myself from the competition even though my prices are slightly high," Rodríguez argues. This position was responsible for Salvador choosing to grow moringa trees . "It can be extracted through forage cultivation, but the quality is lower. Analysis indicats that with the cultivation of the trees we extract a product that contains 32% of the vegetable protein, while through the forage 20% is extracted", he indicates. In Moringa Spain' they carry out 5 o 6 cuts a year, beginning the season when the heat arrives at the end of May or beginning of June and ending it in November. In addition, they dry the leaves by hand in the shade.

CHECK YOUR PASSPORT Travelling to Spain

I

f you have friends and family from the UK coming to visit you in Spain, do make sure that they are aware of the rules on passport validity. Check your passport and travel documents before you travel. If you are travelling to Spain for work, read the guidance on visas and permits as the rules have changed since 1 January 2021.

Passport validity If you are planning to travel to an EU country (except Ireland), or Switzerland, Norway, Iceland, Liechtenstein, Andorra, Monaco, San Marino or Vatican City, you must meet the Schengen area rules. Today, the Schengen Area encompasses most EU countries, except for Bulgaria, Croatia,

Cyprus, Ireland and Romania. However, Bulgaria, Croatia and Romania are currently in the process of joining the Schengen Area and already applying the Schengen acquis to a large extent. Additionally, also the nonEU States Iceland, Norway, Switzerland and Liechtenstein have joined the Schengen Area. Your passport must meet 2

requirements. It must be: less than 10 years old on the day you enter (check the ‘date of issue’) valid for at least 3 months after the day you plan to leave (check the ‘expiry date’) Check both the issue date and the expiry date in your passport. If you renewed your passport early, extra months may have been added to its expiry date. This could affect the requirement for your passport to be less than 10 years old. Contact your travel provider or embassy of the country you are visiting if you think that your passport does not meet both these requirements. Renew your passport if you need to. Visas The rules for travelling or working in European countries changed on 1 January 2021: You can travel to countries in the Schengen area for up to 90 days in any 180-day period without a visa. This applies if you travel as a tourist, to visit family or friends, to attend business meetings, cultural or sports events, or for short-term studies or training if you are travelling to Spain and other Schengen countries without a visa, make sure your whole visit is within the 90-day limit. Visits to Schengen countries within the previous 180 days before you travel count towards your 90 days to stay longer, to work or study, for business travel or for other reasons, you will need to meet the Spanish government’s entry requirements. You should check with the Spanish consulate in the UK prior to travel regarding what type of visa and/or work permit you may need. If you are unable to return to the UK before the expiry of your visa/permit or visafree limit due to C-19 restrictions,

you should contact your local immigration office (Extranjería) for advice. You can also call 060 from a Spanish phone line. If you are visiting Spain and need to extend your visa-free stay for exceptional reasons, such as a medical emergency, you must apply to the immigration authorities (Extranjería) to do so. If you stay in Spain with a residence permit or long-stay visa, this does not count towards your 90-day visa-free limit. Check your passport is stamped if you enter or exit the Schengen area through Spain as a visitor. Border guards will use passport stamps to check you’re complying with the 90-day visafree limit for short stays in the Schengen area. If relevant entry or exit stamps are not in your passport, border guards will presume that you have overstayed your visa-free limit. You can show evidence of when and where you entered or exited the Schengen area, and ask the border guards to add this date and location in your passport. Examples of acceptable evidence include boarding passes and tickets. At Spanish border control, you may need to: Queue in separate lanes from EU, EEA and Swiss citizens show a return or onward ticket show you have enough money for your stayShow proof of accommodation for your stay, for example, a hotel booking confirmation, proof of address if visiting your own property (e.g. second home), or an invitation from your host or proof of their address if staying with a third party, friends or family. The Spanish government has clarified that the “carta de invitation” is one of the options available to prove that you have accommodation if staying with friends or family. More information is available from the

Spanish Ministry of Interior. UK Emergency Travel Documents UK ETDs are accepted for entry, airside transit and exit from Spain. If you are a UK National living in Spain and covered by the Withdrawal Agreement, you do not need any extra months on your passport to enter or exit EU countries. Residents of Spain If you are resident in Spain your passport should not be stamped. You should proactively show your proof of residence - such as the ‘TIE’ (la tarjeta de identidad de extranjero) - as well as your valid passport at Spanish border control. If you have been living in Spain legally since before 1 January 2021, you and your family members have rights under the Withdrawal Agreement. You must ensure you are correctly registered as a resident. Your children must also be registered with their own residency documents. If you are registering for the first time, you will be issued with a biometric residence card called a Tarjeta de Identidad de Extranjero (TIE). This card shows that you have rights under the Withdrawal Agreement. If you registered as a resident before 6 July 2020, you will have a green A4 certificate or credit card-sized piece of paper from Extranjeria or the police. This is still a valid residency document. HEALTHCARE IN SPAIN Understanding The System As A UK National

A

ll residents in Spain need to register to access healthcare.Once registered for healthcare, basic state services are free, but there are some things that patients need to pay for. For example, you usually have to pay something towards prescriptions – either a reduced price or the full price. UK nationals usually access the Spanish national health system in one of these ways: Through entitlement to healthcare if they’re employed or selfemployed and make social security contributions in Spain registering a UK-issued S1 form with the social security office (see ‘UK-funded healthcare: getting and using an S1 form in Spain’ below). Through entitlement to healthcare as a permanent resident if they’ve lived in Spain for 5 years Paying directly into the public health insurance scheme (Convenio Especial). Using a European Health Insurance Card (EHIC) or Global Health Insurance Card (GHIC) for temporary stays when studying, or as a posted (detached) worker

You must show proof of healthcare cover: Before you can register as a resident when you apply for a visa This will usually be through social security contributions as an employee, private insurance or paying voluntary contributions (the ‘Convenio Especial’).

You may be entitled to a Spanish EHIC for travel, including visits to the UK. If you are not working and not entitled to an S1 form If you’ve been a resident in Spain for 5 years or more, you can apply for permanent residency. This will give you access to state healthcare on the same basis as a Spanish citizen. Once you’re a permanent resident, you need to register for healthcare at your local INSS office.

If you’re working or self-employed in Spain, you’re entitled to state healthcare on the same basis as a Spanish worker. Your dependants are also entitled (see ‘If you’re a dependant of someone living or working in Spain’ below).

You’ll need to show a ‘legislation letter’ (‘documento de no exportación’ in Spanish) stating that you are not covered by the UK for healthcare. You can request this by calling NHS Overseas Healthcare Services.

Register at your local health centre with your social security number. You can get a social security number from your local National Social Security Institute (TGSS) office in Spain.

for example through an S1 form, you cannot register for healthcare as a permanent resident. If you are not a permanent resident and you are not working If you’ve lived in Spain for over one year, you can apply to join the public health insurance scheme. This is called the Convenio Especial. You pay a monthly fee to join the scheme, which gives you access to the Spanish health system. You can apply if you’ve been registered on the ‘padrón’ (at your local town hall) for at least one year. If you’ve lived in Spain for less than one year and cannot get healthcare cover, you’ll need to buy private health insurance. If the UK pays for your healthcare, for example through an S1, you cannot join the Convenio Especial. You may have the right to apply for a UK S1 if you start drawing a UK State Pension. If you’re a dependant of someone living or working in Spain Dependants and family members are classified differently in Spain than the UK. If you classify as a dependant of someone entitled to state healthcare in Spain (because they’re either working in Spain, a permanent resident or receiving Spanish benefits) you’ll need to apply at your local INSS office. How to access healthcare services Once you’re registered for healthcare, you’ll get a health insurance card. Take it with you whenever you visit a doctor, hospital or pharmacy. How much you’ll pay Once registered for healthcare, basic state services are free.

There are some things that you may need to pay a percentage of the cost for, such as orthopaedic services.

Overseas Healthcare Services. You must register this form with the INSS to ensure continuation of healthcare cover.

Spain uses a co-payment system where residents usually pay between 10% and 60% of the cost of prescription medication. How much you pay depends on your circumstances.

You are responsible for informing NHS Overseas Healthcare Services if you change your address or your circumstances change.

If you’re paying into the Convenio Especial, you’ll pay the full cost for prescription medication. You’ll also pay for: non-urgent transportation orthopaedic supplies prostheses dietary supplies Some basic dental treatment is available under the state system, but most people use private dentists. Many private insurance companies have specific dental policies. UK-funded healthcare: getting and using an S1 form in Spain You may be entitled to state healthcare paid for by the UK if you’re a resident in Spain and receive a UK State Pension or an exportable benefit. Not all UK benefits that can be claimed while abroad entitle you to UK-funded healthcare. When you get your S1 form, you must register it with the INSS.This will mean you and your dependants will be entitled to state healthcare on the same basis as a Spanish citizen. You’ll also get: a UK-issued EHIC or GHIC for travel planned treatments in other EU countries. If you’re entitled to an S1 form as a dependant of a State Pensioner, your health cover will be cancelled once you begin claiming your UK state pension. You will be sent a new S1 form to your registered address from NHS

Getting treatment in the UK Because the NHS is a residencybased system, under NHS rules UK nationals who move abroad on a permanent basis may lose their entitlement to free NHS healthcare.

for his mother as he had never been apart from her so the decision was made to pair him up with Patch who has become his surrogate older sister. Snoopy has now settled into life in the kennels where he is regularly fed, handled by people every day and he has been treated for worms, fleas and ticks.

Snoopy

Snoopy is an affectionate young lad who loves his cuddles and playing with others. His mother was a Podenco but his father was something black and white like a Bodeguero and he has inherited his colouring. Snoopy will be three months old this Februrary and will be chipped, vaccinated and ready for adoption.

CAS NEWS Can You Adopt A Puppy?.

olly and Star are 12 week-old pups who were found in the riverbed of the Rio Chillar on Christmas Day by a Swedish woman who was staying in Nerja for the holidays. This Good Samaritan contacted the Costa Animal Society (CAS) straight away However it was impossible to find a foster place for them over Christmas, which can be challenging even in the best of times, and the pups were taken to the local kennels. The pups were actually very clean and in good condition, so they were probably dumped only hours before they were found. In fact, they were well looked after up to that point making it all the more difficult to understand how someone could leave them in the riverbed to fend for themselves at such a tender age. Holly and Star are sweet and playful girls who will be large dogs when they grow up but we think gentle ones. Both pups love food and treats so they will be easily trained and each will make a wonderful addition to any family.

They have been examined by our vet, received worming treatment and vaccinations, and will be chipped with a passport in early February when they will be ready for adoption. Holly is a bit more adventurous than her sister but Star loves her cuddles and both are very affectionate. The pups keep coming and it's not even spring yet. Snoopy was also rescued from the Rio Chillar last month when he was living rough with his mother and another pup amongst a thick thatch of cane in front of a cortijo. His mother and sibling were very wary of people and kept their distance in the canes and even had their pathways in and out of the cortijo fence making it impossible to catch them. Snoopy though has a much more trusting and inquisitive nature. CAS was able to scoop him up from the river road, thereby, saving him from a campo life of exposure to diseases, parasites and growing up with little human contact. Again no foster place was available in mid January and Snoopy was placed into a local kennels.

*Buzz is a young Bordie Collie dog who was found on the San Juan de Capistrano urbanisation in Nerja at the end of 2021 after wandering the streets near the tower for several days. Unfortunately, no owner was found despite extensive advertising on social media and in local magazines, thus Buzz is ready for a new forever home. He is an 18 month-old male who has the coat, colouring and size of a smooth Collie with the temperament and good nature to match. Buzz is a sweet boy who loves to please people and he gets along well with other dogs. He would make a wonderful companion for a single person or a family of two or more and he will be easily trained. e're all talking about water conservation at the moment – no wonder as we're heading into the driest year known since records began! But that doesn't mean that you can't garden – just choose your plants with care and remember that you're creating havens for wildlife too, something that is absolutely vital. The succulent world is huge, beautiful and very varied and sedums, also known as stonecrops, are incredibly useful plantings. The 500 or so varieties come in a myriad, of sizes, shapes and colours, and are basically divided into two groups – upright and creeping/trailing.

Clear falling leaves off them as these can cause rot in wet weather – when we get it! The upright types can be pinched to encourage bushiness though, in tough conditions, even this isn´t essential. Groundcover types can be trimmed back if they are spreading outside of their boundaries and those cuttings will root easily to increase your plant stock. Every few years, the upright types are best divided into wedges, making sure to get budding areas within each section and replant them around your garden.

Upright sedums generally behave like perennials, growing to between 30cm and 60cm high with dense, domed heads of flowers. The tightly-packed flower buds Sedums are vigorous, carefree and irrepressible plants with a long look like heads of broccoli, slowing and lovely flowering season. Sedum acre the common golden stonecrop or uvas de gato, is a tiny carpet-forming succulent which spreads like moss to form a dense and interesting groundcover. Native to Europe, North Africa and Western Asia where it is often seen growing wild in crevices in limestone rocks and scrub areas. The stems are thickly clothed with blunt pale-green leaves overlapping like scales on a snake. The star-shaped yellow flowers are carried in flat heads just above the foliage. Sedum burrito has an enigmatic history as no-one knows where it really comes from! Common enough in cultivation, it has never been seen in the wild. It is assumed to be a hybrid of the very similar sedum morganianum which is native to Veracruz in Mexico and forms long cascading stems of glaucous blue-green leaves. There are so many lovely sedums that it's easy to fall in love with them. And we aren't the only ones that can't resist them; bees and butterflies are attracted like magnets. CAS NEEDS YOU! The Costa Animal Society (CAS) is seeking animal-loving, energetic, social media savvy persons to come on board. If you're a compassionate person who respects the lives of unfortunate animals who live a treacherous life in the wild, hop aboard. There is an occasional heartache, but the rewards in homing animals and receiving videos of these rescue dogs and cats romping about in their forever homes is something to behold. We are a small, voluntary charity organization that has been successfully rehoming and assisting abandoned animals in the Nerja, Frigiliana and Maro for over 30 years. We are presently looking for enthusiastic people to join our committee, continuing the work started by the sitting committee, some of whom have recently stepped down after many, many (some, decades) of years of service.
