Mom convicted of murder denied new trial
Benson relatives sue for control of Saints, Pelicans
A woman seeking to have her 2009 convictions for the killing of her two young children set aside has been denied relief by a Lafourche Parish judge. Amy Hebert Amy T. Hebert, who is currently serving two consecutive life sentences at the Louisiana Correctional Institution for Women in St. Gabriel, was seeking a new trial based on a number of allegations she made in a standard post-conviction relief application. The dismissal of those claims brings to a close her attempts to attack the convictions at the state trial court level. “We have fought these post-conviction claims with the same intensity that we prosecuted both the trial and appeal,” said District Attorney Camille A. Morvant, II. “It’s a reminder that not only is it important to the family of the victims to secure a conviction, but also it’s just as vital that we fight to maintain the validity of that verdict throughout the post-trial process.” Hebert was convicted of two counts of first degree murder in 2009 after a two-month trial, and her convictions were affirmed on appeal in 2011. Some of the defendant’s most recent allegations had been dismissed earlier in response to procedural objections lodged by the Lafourche Parish District Attorney’s Office. See Hebert Page 5-A

NEW ORLEANS (AP) — Relatives of New Orleans Saints and Pelicans owner Tom Benson have filed a lawsuit opposing their ouster from ownership positions on the teams. Benson’s daughter, Renee, and her two children allege in Thursday’s lawsuit that Tom Benson’s physical and mental health are failing — asserting that he recently answered “Ronald Reagan” when asked to identify the current U.S. president — and he’s being manipulated by his wife of 10 years. The lawsuit was filed in civil district court in Orleans Parish. It comes less than 24 hours after the 87year-old owner announced he has rewritten his will to give wife Gayle Benson control of the Saints and Pelicans upon his death. The Louisiana Department of Transportation and Development (DOTD) held two informational meetings on Tuesday to receive public input on various proposals to reduce the number of traffic accidents and fatalities on Louisiana Highway 3235, the 16-mile long four lane highway that runs the length of the 10th Ward from Larose south thru Golden Meadow. The meetings were held at the Golden Meadow Town Hall and the South Lafourche High School library. With ever increasing passenger and commercial traffic on that highway, due largely in part to the growth of Port Fourchon, accidents and fatalities, especially at key intersection on the roadway, have exceeded the state average in recent years. According to data compiled by DOTD, some 286 total vehicle crashes have occurred in the sixteen-mile stretch between 2010 and 2012. Eightfour have occurred at one of the four major intersections on the roadway and there have been seven fatalities in that time span. DOTD is proposing a number of alternatives
to help address the safety issues of the road, including either the placing of U-turn lanes at certain intersections or what is known as an RCUT or restricted crossing U-turn intersections at the major intersections of Highway 3235 and Highways 657, 3161, 3162 and Oakridge Lane in Golden Meadow. The major safety feature of an RCUT intersection is that it reduces left turn and rear end crashes, one of the most frequent types of crashes on the corridor. According to DOTD, the crash rate at the intersection of Highway 3162, (Walmart intersection in Galliano), is well above the state average with more than 50 percent of the crashes at this intersection involving southbound left turns. There have been two fatality accidents at this intersection in the last two years. The crash rate at the intersection at Highway 3151, (Royal Daiquiris on the corner in Cut Off), is also above the state average and there has been one fatality at this intersection in the last two years. Grand Isle man arrested for thousands in fraudulent charges
A Grand Isle man has been arrested for more than 70 counts each of theft and forgery after charging over $26,000 of fuel and tools to a former employer. Douglas Fir- Douglas Firmanty manty, 55, of Grand Isle was arrested Wednesday, January 21, on multiple outstanding warrants. Detectives began their investigation in 2014 after learning Firmanty was purchasing fuel, tools, and other items in the South Lafourche area by charging it to a company for which he was formerly employed for a period of approximately three years.

Ro-Duz Ranch, located at the end of W. 190th St. in Galliano, is looking for volunteers on Saturday, January 24, from 2 to 5 p.m. Much work goes into running this farm. This is a totally non-profit organization. Every penny the farm makes goes directly into the farm. The goal is to one day be able to sustain the farm on its on revenues. Americans need money, not Washington By Glenn Mollette Guest Columnist
American’s median income was $51,939 in 2013. In 2012 our median income was $51,759. In 1999, the pre-recession peak median American income was $56,436. Five years ago the United States Treasury took in 2.1 trillion dollars. Last year our federal government collected a record amount of taxes, just over 3 trillion dollars! (Wikipedia, Household Incomes in America) Struggling Americans sent more money to Washington than ever before in our nation’s history. As Americans’ incomes have struggled, stagnated and stalled good old Washington is rolling. What is wrong with this picture? Americans are poorer but Washington is richer. Washington is getting more of hard working Americans’ money so they can determine our lives. Washington now determines our health care, our retirement and care for all of the people who do not want to work. The average American could not survive in retirement without Social Security. Americans need more money, not Washington. Americans are spending their money on food, utilities, mortgages, rent, gasoline, car payments and health care. Granted, recent gasoline prices have helped. After these expenses, there is not much money left over for family excursions, clothes and saving for retirement. The American dream used to include owning a house, two cars, sending the kids to college and a two weeks vacation each year. By the age of 62 you retired to do what you wanted to do with your life. That’s not happening today because Americans don’t have enough money. Go to Walmart or McDonald’s and you’ll see lots of seniors working. People who are 75 years old and occasionally even 80 are working minimum wage, 30 hour a week jobs. A few do it because they need something to do. Most Americans are in those jobs because they need the money - desperately. Here are some stats: 19% of middle-class Americans have zero retirement savings. 34% are not currently saving for retirement.

41% of Americans between the ages of 50-59 are not currently saving for retirement. Based on the numbers, most retirees will be unable to even retire on 70% of their working income. The median savings across all age groups was only $20,000. Housing, healthcare, food and transportation make up about 65% of Americans’ spending. (Huffington Post: posted, 10/27/2014) Combine this with falling incomes over the last decade and you have a poorer America - but not Washington. What’s wrong with this picture? Americans could always cut out a few things to save money, but what? Some Americans polled by Daily Finance said they could curtail eating out and buying fewer clothes, taking fewer vacations, giving fewer gifts, buying fewer groceries and cutting back on entertainment. 12% of those polled said they would not make any cuts and are spending like there is no tomorrow. Americans need better jobs that pay more money. Working at fast food restaurants and retail has never provided us with comfortable incomes. We need progressive industry. We need to continue on our path to being the world’s energy provider. However, we must lead the world in clean energy. We can learn how to use fossil fuels cleaner but we are not there yet. We should learn how because we have a lot of oil and coal. However, we must become the world leaders in using wind and solar energy. We are on our way and this is not the time to stop. We must go back to making everything that China makes from clothes, to furniture, to electronics. The
auto industry exports our cars to other countries and then brings those earnings back to America. We have to go back to work in this country. We have to sell our products to the 95% of the world’s population who do not live in America. We have to stop penalizing people and corporations for being successful. It is time to cut the corporate tax rate to 15% and lower taxes for all
Americans. Washington does not need more money, Americans do.

3 cited for taking oysters from polluted area
BATON ROUGE, La. (AP) — State wildlife enforcement agents have cited three Golden Meadow residents for alleged oyster fishing violations near Bayou Blue in Lafourche Parish. The Department of Wildlife and Fisheries said Tuesday that senior agent Thomas Wolf spotted a vessel harvesting oysters from the unapproved area Saturday. Wolf cited 58-year-old Jeffrey L. Shepard, 50-year-old John Mejia and 34-year-old Talasha C. Nelson. He also seized and returned four sacks of oysters to the water and the dredges and vessel. Taking oysters from an unapproved polluted area brings up to a $950 fine and 120 days in jail. The subjects could also forfeit any seized equipment if convicted. ___

OPELOUSAS, La. (AP) — An Opelousas woman has been arrested after her 5-year-old son was treated for burns to his hand and torso that appeared to have been caused by a cigarette. The St. Landry Parish Sheriff’s Office says the child’s mother, identified as 26-year-old Jessica Deville, was booked with cruelty to a juvenile Saturday and released on $3,500 bond. If convicted, she faces up to 10 years in prison. The sheriff’s office, in a statement Tuesday, said the child is recovering and living with his father. ___

BATON ROUGE, La. (AP) — Republican supporters of Gov. Bobby Jindal are creating a super PAC to back a possible 2016 presidential campaign by the Louisiana governor. Paperwork setting up the political action committee, called the Believe Again PAC, was to be filed Thursday with the Federal Election Commission, according to Brad Todd. Todd is a consultant for the new committee and co-founder of Jindal’s political advisers OnMessage Inc. The super PAC will be able to raise unlimited amounts of money to help Jindal, but won’t be able to coordinate with him directly. Former Louisiana U.S. Rep. Bob Livingston is PAC chairman. Rolfe McCollister, a Baton Rouge publisher who spearheaded other proJindal efforts, is serving as treasurer. Jindal’s second term as Louisiana’s governor ends next year. eral authorities say they seized 2,700 pounds of shrimp after boarding a vessel near Cameron that didn’t have a required device designed to avoid the snaring of endangered sea turtles. The Coast Guard said in a Thursday statement that a team was on a routine boarding assignment when they discovered the fishing vessel Kathleen Yvonne was not equipped with the legally required turtle excluder devices. The boarding team escorted the vessel to Cameron Fish House, where they were met by the National Marine Fisheries Service personnel to seize the catch. A turtle excluder device, or TED, is a specialized device that allows a captured sea turtle to escape when caught in a fisherman’s net. ___

What a Life!
By: Rev. Wilmer L. Todd Jesuit spirituality: we are loved, gifted, forgiven, called, invited and sent Pope Francis is the first Jesuit to head the Catholic Church. Since his election, people both within and outside the church have asked me these questions, “Who are the Jesuits?” and “Are you a Jesuit?” I will try to clarify any confusion. I am not a Jesuit. I am a diocesan priest, which means I minister within the diocese of Houma-Thibodaux under the local bishop’s guidance. Our
present bishop is Most Reverent Shelton Fabre. (I do have a brother who is a Jesuit Brother. He is presently stationed at Jesuit High School in New Orleans. My father taught at Jesuit High School and Loyola University and our family lived in a Jesuit church parish in New Orleans). Within the Catholic Church today there are literally thousands of different religious “orders”, “congregations”, “institutes”, “societies”, and other groups officially recognized by the church, not to mention many other local and/or unofficial communities of believers. Each group has a special emphasis or focus. The Jesuits concentrate on education, the missions and spirituality. The Society of Jesus (the official name of the Jesuits) was founded by the Basque nobleman, soldier and future saint, Ignatius of Loyola. He dreamed of being a Knight in shining armor

but was converted to a deep spirituality while he was recuperating from a French cannonball that mangled his leg in 1521. He had nothing else to read except the lives of the saints and the Bible. Despite attracting the interest of the inquisition, the Jesuits secured papal approval in 1540. St. Ignatius designed the Spiritual Exercises to help us come into contact with God. This would include a prayer, a meditation, a reflection that would dispose our hearts and set us free so we can find God’s will in our life. He hoped that people would receive spiritual knowledge, not just intellectual knowledge. Fr. Gerald Fagin, S.J., in his book “Discovering Your Dream: How Ignatian Spirituality Can Guide Your Life,” summarizes the graces received from the Spiritual Exercises in six sentences. We are loved. The most basic truth of Christianity is that we have a God who loves us unconditionally. We are loved at the moment of conception, at every second of existence, from now into eternity. We cannot win God’s love. We can only try to experience God’s love in our own life and try to return that love by living a life of love. We are gifted. Everything we have comes from the Giver who gives us life, health, family, talents, friends, opportunities and everything else out of love. Our response is to stand in awe and wonder at the beauty and sacredness of everything, a profound awareness of the presence of God in our lives and in our world. We are forgiven. God does not hold our past against us. We all have made a bad judgments and sinned. Only when we claim our sinfulness and stand before God in sorrow can we experience God’s mercy. God is willing to forgive us; we should be willing to forgive ourselves. We are called. The heart of the Gospel is a call to discipleship, to follow Jesus. Jesus’ call is for every Christian. We are called to live out the Gospel values in our lives as committed Christians in our families, our schools, our workplace, and in our community. We are invited. Ignatius
asks us to pray for these graces: to know Jesus more intimately, to love him more deeply, and to follow him more closely. If we do this,
we will hear his invitation to friendship. We are sent. Our baptism commissions us to carry on the ministry of

The remainders of the defendant’s claims were dismissed without a hearing by the Hon. Jerome J. Barbera, III on December 29, 2014. Barbera retired from the bench at the end of 2014. “The fact that the trial judge felt there was no need for a hearing on any of these issues reinforces our view that none of the defendant’s claims had any merit,” said Morvant. “I’ve said it before, but this trial was well litigated by both sides, so after the jury returned its verdict, there weren’t going to be very many mistakes to review.” The defendant’s claims centered on the alleged ineffectiveness of her trial and appeal counsel. Barbera disagreed, noting that, “defense counsel used their experience and training in the most skillful manner to properly defend the petitioner against the charge.” Hebert may seek to have the trial court’s ruling reviewed by the First Circuit of Appeal.

tion, detectives obtained warrants for 74 counts of felony theft and 72 counts of Forgery. Firmanty also had outstanding warrants for contempt of court stemming from traffic violations. When detectives made contact with Firmanty on Wednesday, he admitted to his involvement in the crimes, was arrested per the outstanding warrants and transported to the Lafourche Parish Detention Center in Thibodaux where he was booked accordingly. He is being held in lieu of $218,000 bond as set by Judge Walter I. Lanier III, and has been ordered to pay $873 in fines and costs related to the contempt warrants.

In a statement posted on the Saints’ website Thursday night, Benson said he is “extremely disappointed by the lawsuit” and adds that the “allegations regarding my mental health are completely meritless and their allegations against my wife equally unfounded.” He adds that he will “vigorously defend” his decisions and businesses. “Make no mistake, I will be back in the office tomorrow morning working hard, as I do every day, to ensure that the Saints and Pelicans are positioned for long-term success,” Benson said. “This state, city and our great fans deserve that. I have instructed my staff to have no comment on this lawsuit moving forward.” The lawsuit asks a judge to block Tom Benson’s new succession plan, order Benson to be evaluated by an independent, board-certified psychiatrist, and restore the plaintiffs to their positions in Benson family businesses, which include auto dealerships and real estate holdings. “Sadly, the Benson family was forced to take this action in the best interests of Tom Benson and his legacy, the customers of Benson family automobile dealerships, the employees of all of the family enterprises and the multitude of Pelicans and Saints fans,” said the plaintiffs’ attorney, Randall Smith. In another written statement released Thursday morning, Tom Benson stated that his decision to install Gayle as an owner and oust previously designated heirs to the teams will ensure the long-term stability of the franchises in New Orleans. Benson said the
move would promote continuity among top management of the organizations, led by Denis Lauscha, the president of both clubs, and Mickey Loomis, the executive vice president of the teams and general manager of the Saints. “This is based solely on doing what is right,” Benson said in his statement, adding that his wife’s “love for New Orleans and giving back to the community she loves is unmatched.” The lawsuit, however, claims that Gayle Benson has conspired with Lauscha, Loomis and a select few others to systematically isolate Tom Benson and “to prevent him from his usual interaction with family, friends and advisors.” The lawsuit describes the photos of family members, once prominently displayed in Tom Benson’s office, being removed. It alleges that Gayle Benson monitors all of her husband’s emails and phone calls and controls access to him. It further alleges that Gayle Benson has prevented her husband from attending traditional family gatherings at Thanksgiving and Christmas. It also describes a more recent “bizarre” pattern of behavior and decision-making by Tom Benson — particularly in regard to control of his assets — that are allegedly inconsistent with intentions he had clearly laid out during much of the past decade. Such instances in-
cluded a Dec. 27 email in which Benson stated he “never wants to see Renee, Rita or Ryan again” and that he intended to ban them from the Saints and Pelicans games, as well as facilities of both teams and other New Orleans properties. Locally, we have a Knights of Columbus Council in Matthews, Lockport, Larose, Cut Off/Galliano and Golden Meadow. Each Council follows the four founding principles – Charity, Unity, Fraternity and Patriotism – which guides and drives the Knights of Columbus in everything they do. Charity is a big principle for the Knights. In Larose, the Knights of Columbus Father Charles Tessier Council #8898 takes this principle to heart by conducting numerous community outreach programs yearly. Some of these you might know, like the weekly, Lenten lunch-time fish fry with proceeds benefiting numerous local charities and church ministries. Or, their “bucket shakes” held at various local bridges benefiting MDF (mental disability fund). They host poster contests, alcohol and drug abuse awareness campaigns, participate in the Catholic Youth Leadership Award Program which awards scholarships to seniors and hosts periodic Sunday lunches to raise money for seminarians and other church ministries. The Knights in Larose are housed behind Our Lady of the Rosary Catholic Church in a 100-year old former family home/grocery store. “Although we support Our Lady of the Rosary Catholic Church, we are not directed by the church or the diocease,” says John Guidry, the Grand Knight of the Larose Council. “We are a group of Catholic men joining together to help our church and community.” One of the fundraisers planned this year is the KC BBQ Cook Off held during May at the Larose Civic Center. “Statewide all councils are encouraged to partner with Special Olympics,” says Guidry. “We are hosting our BBQ Cook Off in order to benefit Special Olympics and are very excited to partner with them.” Service is a large part of Council #8898’s 190 members which range in age from early 20’s to mid-90’s. “We provide millions of hours to worthy causes nationally and hundreds-ofthousands of hours within our community,” he added. One of Council #8898’s fundraisers seemed to be a one-time event in 2007 under the direction of Dr. Roland Thomassie. They would collect family stories and photographs from the parishioners of Our Lady of the Rosary Catholic Church and compile them into a book, We are What We Remember: A Story of Larose and Its People. The book’s purpose was two-fold – to help pay off the church’s flood of debt and to release a flood of memories

Well, in 2014 the fundraiser was back with We Are What We Remember – More Stories of Larose and Its People – Volume II, and was released in November. Again, parishioners were asked to submit stories and photos, but unlike the first book, this one added a few new features and sections. “There are 115 veteran stories in this book, a few of which are told in first person like Mr. George St. Pierre’s story or Suzanne Robichaux’s mother who was an army nurse working in tents on the front lines in Dachau,” said Tommy Robichaux who worked on the layout and editing of the second book. “There are 41 family trees in graphical format, an index 12-pages long boasting some 1,800 names as well as 116 ‘school days’ photos displayed in yearbook fashion,” he added. “I learned so many relationships in Larose that I never knew before,” he said. “We opened submissions in February and collected information until June 30th. Just four short months, but we far exceeded the information collected for the first book.” The first book was some 57 chapters and 360 pages. Robichaux and the committee worked on typing the hand-written family stories collected a few hours each morning and each afternoon and finished with a 480-page book which offers some new features not found in the first book. This
walked up to the old man and asked, “What are you doing, my friend?” “Fishin’, sir.” “Fishin’, eh. Well how would you like to come have a drink with me?” The old man stood up, put his rod away and followed the kind stranger to the corner bar. He ordered a large glass of vodka and a fine cigar. His host, the kind fellow, felt good about helping the old man, and asked, “Tell me, old friend, how many did you catch today?” The old fellow took a long drag on the cigar, blew a careful smoke ring and replied, “You are the sixth today, sir!”
sequel seems better than the original! “It was quite an enormous project,” says Robichaux. He’s modest when it comes to discussing the amount of brainpower and hours he contributed to collect, complete and finalize the book for printing. “We had a great committee that helped to proof and edit the book. We also had those great people that worked on the first book. And, we had the first book to use as a guide and example to show people what we wanted and what our new book would look like,” he added. During the production of the second book, people
realized a first book existed and gobbled the remaining volumes up. “There were 300 volumes left from the first book and we sold 250 of them while working on this book,” says Robichaux. “That leaves 50 or so remaining out of an original printing of 1,500 from the first book.” “We decided on producing a second edition of We Are What We Remember – More Stories of Larose and Its People – Volume II to help benefit the church again and to preserve our great stories in Larose,” says Guidry. “We really were interested in our veterans … we don’t want to lose those great stories.” This sentiment is also
echoed by Robichaux. “We are really proud of this book. We get to tell these great stories. Especially our veterans! We don’t know their stories and when they pass on, we are going to lose their stories forever,” he added. “If we can record and preserve these stories, these people can live on in our memories.
