Millions in increased fees, penalties levied by lawmakers
Last month, voters within the North Lafourche, Conservation Levee & Drainage District (NLLD) approved a quarter-cent sales tax solely dedicated to building critical levees and other priority flood protection projects from the northern end of the parish to the Intracoastal Waterway in Larose. The NLLD Board gave official approval to the ordinance at Tuesday’s meeting providing for the levy tax within the District to officially go into effect on July 1. The sales tax is estimated to generate approximately $2.2 million per year dedicated to construction and maintenance, and this sales tax revenue will also be leveraged to attract more state and federal money for the local levee projects. “The NLLD has developed a plan of priority levee, flood protection and drainage improvement projects that benefit residents throughout the District and will achieve a higher level of protection that our communities deserve. Revenue from the sales tax will now allow the NLLD to more quickly complete the levees and pump stations in this plan and provide residents with additional levee protection and better drainage sooner than it could have with previous funding alone,” said Dwayne Bourgeois, NLLD Executive Director. BATON ROUGE, La. (AP) — Car buyers, motorists seeking a copy of their driving records, florists, oyster fishermen and pawnbrokers across the state will pay higher fees to help balance Louisiana’s annual budget. While the focus of the Legislature’s recent financial debate was largely on taxes, lawmakers with little fanfare or attention also voted to raise at least $104 million annually from changes to licensing and application fees, permitting charges, rental rates, late fees and penalty fines. Most of the money raised was poured into the budget to help stop cuts to public colleges and health services in the fiscal year that begins July 1. Other dollars will stay with the agencies that oversee the individual programs subject to the higher fees and penalties, to help offset reduc-
tions to their general state financing. Gov. Bobby Jindal’s administration hasn’t shown any resistance to the fee hikes passed in the just-ended legislative session. The Republican governor has supported fee increases if agencies say they only cover the cost of providing the service for which a fee is charged. Lawmakers echoed similar sentiments as they approved the bills, saying many of the state’s fees haven’t been increased in decades. “We have historically provided services to the people of this state for much less than what it costs to do them. Now, we’re in a budget crunch,” said Sen. Danny Martiny, R-Kenner, during Senate debate on one of the largest fee hikes.
Plans continuing for new parish jail
Lafourche Parish Sheriff Craig Webre announced the latest developments regarding the construction of a new jail for Lafourche Parish. The new jail, to be called the Lafourche Parish Correctional Complex, is slated to open in 2017. “Our internal working group met weekly since NoSheriff Craig Webre vember 2013 to attempt to solve the issue of funding the new jail,” said Sheriff Webre. “Once the voters agreed to the new 0.2% sales tax, our group continued to meet weekly with a new goal - to plan and construct the new jail. They continue working toward that goal today, but we have also brought in many others to help contribute.” Webre said James “Jim” Rowenhorst was hired as a consultant to help guide the project. “Jim comes to us as recommended by the National Institute of Corrections, and he was already

familiar with the project having done a study for Lafourche Parish Government in 2009,” said Webre. “Jim is a former jail administrator and has worked as a consultant on more than 150 projects in 42 states. He will ensure we are covering every aspect in order to construct a world-class facility.” Webre said the working group quickly realized they wanted input from community leaders to help plan the facility - not just with regard to walls and beds, but also to discuss initiatives such as educational programs, mental health counseling, medical care, and family participation programs. “Building a jail is unlike any other project with which I’ve ever been involved,” said Webre. “You cannot just put up a bunch of walls to create this building. Fontana announces candidacy for Lafourche Parish Clerk of Court
Annette Fontana, a Thibodaux native and Lafourche Parish prosecutor, announced her candidacy for the office of Lafourche Parish Clerk of Court Tuesday. Annette Fontana Fontana seeks to replace the Hon. Vernon Rodrigue in the October 24th election. Rodrigue announced last week that he was not seeking re-election. “Vernon Rodrigue has served the people of Lafourche well for many years,” Fontana said. “But the practice of law has changed dramatically over the last few years, and the next clerk of court will need to have the vision to see how the clerk’s role in the administration of justice has changed with it. Planning a wedding on a budget Jason Alderman Financial Columnist Should a dream wedding mean delaying a down payment on a home? That’s a tradeoff many couples make these days. The Knot, a wedding planning and publishing company, recently released its Real Weddings Study of average wedding costs for 2014, announcing a national average price tag of $31,213 (not including the honeymoon). The average cost of a wedding is a good point of comparison against other major financial goals in a new marriage. Considering that the average price of a new home in America is now $200,000, that wedding estimate would cover the majority of a 20 percent down payment ($40,000). Despite getting married to my wife at family home 15 years ago, I still remember the sticker shock for all the wedding costs — a whopping $10,000 for the entire event from tux, dress, flowers, food and honeymoon. Here are a few suggestions to plan a wedding that won’t break the bank: Marry in the off-season. The most popular wedding months are now June and October, with longtime leader June losing a bit of ground. The most popular day to get married is Saturday and nighttime is the most competitive time slot for receptions. Consider a January wedding when the post-holiday rush is over – cold weather wedding venues are generally empty and priced to move. Weekday weddings have the potential added bonus of guests drinking less on a work night and weekend brunch weddings can be served buffet-style with more reasonably priced menu choices. Find alternative venues. Farms, barns, warehouses, art galleries and of course, family property can be cheaper venues for a wedding, but make sure such spaces are properly insured for alcohol, food or other party-related risks. Also, in many communities, party venues must be properly licensed and/or zoned to avoid fines or legal action. DIY if possible. Couples with a flair for party planning, decorating and cooking might be able to slash costs planning and executing their own event with minimal dependence on hired or volunteer help.

Louisiana spring shrimp season closed Friday
BATON ROUGE, La. (AP) — Louisiana wildlife and fisheries regulators say the spring inshore shrimp season will close at 6 p.m. Friday, from the Mississippi/Louisiana state line westward to the western shore of the Freshwater Bayou canal. The state Department of Wildlife and Fisheries said Tuesday that the closure does not affect: —Lake Pontchartrain, Rigolets Pass, Chef Menteur Pass, that part of Lake Borgne seaward of a line extending one-half mile from the shoreline, —the open waters of Breton and Chandeleur Sounds as described by the double-rig line —a portion of the Mississippi Sound For more information visit www.wlf.louisiana.gov. High court grants reprieve to Louisiana death-row inmate
WASHINGTON (AP) — The Supreme Court has barred Louisiana from executing a convicted killer, saying his mental disability precludes capital punishment. The ruling comes in a 54 decision Thursday. Kevan Brumfield was convicted in the shooting death of off-duty Baton Rouge police Cpl. Betty Smothers in 1993. A federal judge ruled that Brumfield was mentally disabled and therefore was protected from execution under a Supreme Court decision in 2002. But the federal appeals court in New Orleans reversed the judge’s ruling. Brumfield and Henri Broadway of Baton Rouge were convicted and sentenced to death for ambushing Smothers on Jan. 7, 1993 as she was driving a grocery store manager to make a bank deposit. The 36-year-old Smothers was working as an offduty security officer at the time. ___
Judge rules Saints, Pelicans owner Benson is competent
NEW ORLEANS (AP) — A judge has ruled that New Orleans Saints and Pelicans owner Tom Benson remains competent to run his business empire. The ruling legally upholds Benson’s decision nearly six months ago to place his third wife, Gayle, first in line to inherit control of his NFL and NBA teams instead of recently disowned
heirs who had been groomed to take over. Benson’s daughter, Renee Benson, and her children, Rita and Ryan LeBlanc, sued in January, asking Reese to rule that their patriarch was mentally unsound and being unduly manipulated by his wife when he changed his succession plan. Benson has stated through his lawyers that his estranged heirs have failed to prove themselves worthy of taking over his businesses. Reese’s ruling could be appealed. ___
Green Berets, SEALs, and now Raiders: Marine Corps resurrects name of legendary elite units
RALEIGH, N.C. (AP) — The Army has the Green Berets, while the Navy is known for the SEALs. Now, an elite branch of the U.S. Marine Corps will officially be known as Raiders. The Marines will rename several special operations units as Marine Raiders at a ceremony Friday, resurrecting a moniker made famous by World War II units that carried out risky amphibious and guerrilla operations. The exploits of the original Marine Raiders — who pioneered tactics used by present-day special forces — were captured in books and movies including “Gung Ho!� in 1943 and “Marine Raiders� in 1944. The name will give a unique identity to the Marines’ branch of U.S. Special Operations Command, which includes special forces from the U.S. Army, Navy, Air Force and Marines. The Marines’ Special Operations Command, known as MARSOC, was formed more than a decade ago as part of the global fight against terrorism. “Whereas most people in the American public probably wouldn’t have been able to tell you what MARSOC stood for, ‘Raider’ will jump off the page,� said Ben Connable, a military and intelligence analyst at the nonprofit research agency RAND Corporation. Jindal loses appeal on Common Core lawsuit in state court
BATON ROUGE, La. (AP) — A Louisiana appeals court Wednesday upheld a judge’s ruling that barred Gov. Bobby Jindal from suspending testing contracts tied to Louisiana’s use of the Common Core education standards. A three-judge panel of the 1st Circuit Court of Appeal said Jindal’s attempt to halt the testing contracts was an “unconstitutional interference� with the education department and the state Board of Elementary and Secondary Education, known as BESE. A year ago, Jindal suspended the contracts, saying the education department and BESE didn’t properly follow Louisiana’s procurement law in the contract award. Parents, teachers and a charter school organization sued, and the state education board joined in the suit. In August, District court Judge Todd Hernandez lifted Jindal’s contract suspension and said the Jindal administration didn’t provide any evidence to support the governor’s claims that contracting law was violated. Common Core standardized testing for students in third through eighth grade continued as planned in the spring. Hernandez’s decision was upheld Wednesday by the appeals court. Rather than prohibit use of Common Core, the Legislature recently required a review of the standards with public meetings, legislative oversight and an up-or-down vote from Louisiana’s next governor. The review panels must present final recommendations on what changes they want made to the standards by March 2016.
Teachers from 13 Louisiana parishes are participating this week in the 2015 WETSHOP hosted by the Louisiana Department of Wildlife and Fisheries (LDWF) and their partners. WETSHOP is a coastal awareness workshop for science, history and social studies teachers held at the LDWF’s Grand Isle Fisheries Research Lab. The workshop is funded by a grant from the Barataria-Terrebonne National Estuary Program (BTNEP) with the purpose of training Louisiana teachers on wetland issues. The workshop has the added benefit of potentially impacting 40,000 students when the teachers return home to their schools and communities. Parishes being represented by teachers include: Lafourche, St. Landry, Lafayette, Acadia, Richland, Caddo, East Feliciana, Rapides, Jefferson, Calcasieu, LaSalle, East Baton Rouge and Iberville.

This Sunday is Father’s Day. I would like to dedicate this column to all the wonderful fathers, father figures, and male mentors who have touched the lives of people in so many ways. You have influenced your own kids, others’ kids, your family, people you have monitored, people you’ve coached, and the world at large. Thank you for sharing yourselves with us. One of the Ten Commandments is “Honor your father and mother.” This is the only commandment that ends with a promise. If you honor your father and mother, “you will live a long life, full of blessing.” The following are quotations from people worldwide who honor their fathers. “My father gave two most precious things for my whole life. One was love with sacrifice; the second was education with spirituality.” “My father has taught me the importance of hard work and sacrifice not by only his words but through his examples. At Tuesday’s meeting, The NLLD also approved an interim vice-president, Daniel Clement. His nomination and approval was given as a result of the previous vice-president, George Broussard, Sr., resigning from the board in May. The vice-presidency along with other office positions will be up for re-election in October. Levee District board members serve at the pleasure of the seated Governor. Commissioners are nominated by the legislators, parish president and Thibodaux and Lockport mayors, then are appointed by the Governor from the list of nominations. The Governor appoints a person to serve on the board during his term. When a new governor is elected, he can choose to keep the same people if they are renominated by the Parish leaders. Reports were given during the meeting regarding the Lockport to Larose project area. “We have been working for quite some time on a project where we’re re-sectioning a levee from Parr Pump Station working towards the Larose Pump Station. We have been working this project through a cooperative endeavor agreement with the Parish in which we supply major equipment, engineering and field support and the Parish provides additional equipment, operators and fuel,” said Bourgeois. This project, from the Parr Pump Station to Valentine Bridge area is nearly completed. Neil Angelette, of Angelette Picciola, LLC, has been meeting with several land owners and getting right-of-way paperwork completed for approval of the Lockport-Larose Valentine Area “Reach C” Levee project which includes “Reaches C4, C5, & D1”. “The NLLD is trying to continue our alignment along the existing levee going south but what we found is that the engineers had grave concerns because of the lack of strength of the soil in that area. We realized we would have to shift the alignment so we had to get a new, modified permit and needed right of ways from property owners in that area (From Philip Plaisance to behind North Bayou Estates). Neil is working on getting right of ways from landowners living between the Philip Plaisance property to the Edgar Guidry Pump Station so we can proceed,” said Bourgeois. Neil Angelette also reported on an interim repair emergency project, which is a little further south (in Reach D1). The old levee is still there but parts of that levee sloughed off into the reservoir canal and are starting to fail. The NLLD and Angelette as consulting engineers have found that best emergency repair that can be done is to take material donated from a land owner and get a contractor to put these materials into the borrow canal and backfill it to stabilize the levee section in that area before storm season is in full effect. The NLLD has the right of ways to do the emergency repairs and is undergoing the project at this time. The Lockport to Larose East levee, emergency authorization project is running according to plan at this point. The project as stabilized the first 1500 feet under an Emergency Authorization from the Corps; but, Bourgeois states [it] “will take the long road” to complete the rest of the 5500 feet of this project. At the end of Hamilton Street on LA Hwy. 308 is the T-Bois Pump Station. Adjacent to that station was once a crawfish pond (approximately 1500 feet) that no longer exists. The removal of the pond has caused the levee to slough and fail in some areas near this pump station. “It’s good for the levee that the crawfish pond is no longer there but there are some concerns that now need to be addressed. Fortunately, the land owner gave us the right of way to go in and make repairs to
that levee,” said Bourgeois. The NLLD was only able to do 1500 feet of repairs to the total 5500 feet of levee that is in need of repairs because it was limited by the Corps of Engineers’ emergency authorization approval. “The Corps really limited us in what we could do. So we got equipment and a contractor and worked on first 1500 feet but the entire project is slow going because of the Corps’ requirements. We went according to what we could do so now the first 1500 feet pretty much done,” said Bourgeois. To complete the entire 5500-foot stretch, the NLLD will have to go through a full permit process with Corps and that process will take a bit longer. The Mathews Canal project and Clotilda Pump Station levee work is going as planned with expected approval from Louisiana Dept. of Natural Resources; but, is also currently waiting on the Corps of Engineers approval. In other NLLD news: In the Thibodaux – West project area, St. Louis Canal improvements will begin the middle of next month around July 5th. Acadia Woods drainage project bid proposals will be solicited next week in hopes of beginning work in early July. The St. Charles By-Pass Backwater flood protection permit has been submitted. Leonard Chauvin, an engineer from LCI briefed the board on issues pertaining to the Thibodaux, Audubon Avenue drainage improvements, a project that recently replaced mismatched culverts and catch basins. “We expected to encounter some conflicts with some gas lines right at a tie in point at Menard Street, which we required some extra work but we did not and are recommending an adjustment,” Chauvin said. The project also encountered other issues that were an addition; but in total this change order brings the cost of the project down by about $8,000 to $122,954.89. The 80 Arpent Canal clearing, Caldwell to Laurel Valley project should be advertised for bidding by the end of this month. Inspection on the Chackbay South levee heading towards Grand Bayou has sloughing off making the levee too steep as a result from pumping too frequently and too deep. All levees in this area are in need of maintenance. NLLD is in process of completing some levee rehabs. There is a continued discussion about spraying versus dredging and what would be best for the levees and most cost efficient. Of the dollars generated, about $60 million annually will come from a $50 fee increase on car buyers and sellers. Another $22 million a year is estimated to come from raising the price tag for getting an official state driving record from $6 to $16. The car-buying fee drew the most debate. The fee hike, tucked into a bill by Rep. Sherman Mack, R-Livingston, will increase from $18.50 to $68.50 the title fee paid when a person buys a new or used car and the salvage title fee when a wrecked vehicle is deemed a total loss and either disassembled or sold. It also will bump from $15 to $65 the permit to sell that allows a towing company or repair facility to sell vehicles abandoned by their owners. The changes take effect July 1. Supporters said the increase will keep the state and other taxpayers from bankrolling the processing of those vehicle title regis-
trations and transfers. “We are not charging the true cost of things. We’re subsidizing on the backs of other people,” said Sen. Conrad Appel, RMetairie. Bill opponent Sen. Karen Carter Peterson, DNew Orleans, objected to filling budget gaps “on the backs of the poor people of the state.” “We have raided funds and reserves from all these different agencies and then we come back and tax them, and we’re doing it on the backs of people and we think they’re not paying attention,” Peterson said. Other bills backed by the House and Senate will increase the state licensing fees for florists and nurseries and allow the state seed commission to double its seed dealer licensing fees. In the Office of Financial Institutions, renewal fees will increase for money transmitters; application and licensing fees for businesses that want to make consumer loans or mortgage loans will cost more; and pawnbrokers will have to pay higher annual license renewal fees. Rental rates paid to the Wildlife and Fisheries Commission for oyster leases on state property will cost $3 per acre starting in 2016, up from $2 currently. The state will charge increased pipeline, application and regulatory fees for oil and gas drilling activity. Penalties and late fees that can be charged across certain agencies also were boosted higher, with millions expected for the Department of Revenue from such cost hikes, along with increased charges for searching and copying certain tax records.

American Civil Liberties Union, and civic organizations were invited to participate in the “Jail Advisory Group”. This group met on several occasions, working to formulate a mission statement for the facility and discuss aspects of programs and the facilities. “The members of the Jail Advisory Group were essential to helping plan the direction and focus of this facility,” said Webre. The group also reviewed presentations by the firms vying to be hired to provide architectural services for the project, aiding in the final selection process. “We are currently in the final stages of negotiations to hire an architect,” said Webre. “While waiting for that process to conclude, though, we conducted several day-long programming workshops with specialized groups of employees to fur-
ther pinpoint the architectural needs around the functions of the facility.” Webre added these workshops produced information essential for the architect to begin design work. Property for the new jail has not yet been purchased, but Webre said they are currently only looking at property in the Thibodaux area to remain in close proximity to the courthouse. “While we were initially open to the possibility of locating the jail in another area of the parish, we always knew that having the jail remain in the Thibodaux area would be the most cost-effective and logistically-feasible option. The Barataria-Terrebonne National Estuary Program (BTNEP) is now offering its latest poster publication entitled Waterfowl of Louisiana; Species Identification. This free 24” x 36,” fullcolored, glossy poster features 23 different waterfowl species including pictures, common and scientific names of all the species. Illustrations of the birds were done by Stephanie Donaldson, owner of Purple Penguin Art Company in Thibodaux. “I was honored to be involved in this project,” said Donaldson. “To be able to use art to show the beauty that we do often take for granted in our diverse landscape was truly a pleasure.” The goal of the poster is to provide an educational guide in order to identify mi-
gratory waterfowl species, which utilize Louisiana’s diverse ecosystem. The poster can be used by a wide variety of user groups. Hunters can use the poster to teach youth about various species, whereas, wood carvers may find the images useful for creating works of art. Teachers of all educational programs will find the poster colorful and scientifically correct. The poster will also help people understand the value of our wetlands to these beautiful waterfowl. NEW ORLEANS (AP) — The public was given a first look Wednesday inside a sprawling medical center built in large part with federal money Louisiana got after Hurricane Katrina to replace its old flooded downtown public hospital. Building the $1.1 billion medical complex — which in places feels more akin to a modern art museum than a hospital — has come about despite a yearslong debate over the extent of hurricane damage to the city’s old Charity Hospital, fights over razing a neighborhood where the new hospital now spans 2.2 million square feet, and the objections of residents, medical professionals and advocates. Administrators who gave the news media tours of the facility Wednesday touted its optimistic pastel colors, calming water features, courtyards, naturallight-filled corridors and art-decorated clinics. The hospital also features hightech operating rooms and state-of-the-art-technology throughout, officials said. The hospital has been constructed with future hurricanes in mind too: Its ground level is raised and critical services, such as emergency and operating rooms, are located on higher floors. Mackenzie Skene of Seattle-based NBBJ, the architecture firm that designed the complex, said the idea was to bring about an “experience of calm, natural light” to anyone who visits. “It should be a hospital that doesn’t feel like a hospital,” he added. Officials also envision the complex being the centerpiece of a burgeoning biomedical district that will attract investment to an area of the city that has suffered from blight and lack of investment.
The complex, which will function as both a teaching hospital and health care center, is called the University Medical Center New Orleans and it is expected to open to patients Aug. 1. “We will transform the health care landscape in New Orleans,” said Cindy Nuesslein, the president and CEO of the new hospital. “This is a medical mecca now.” But there are persistent doubts. “Now the big question is who will actually go there,” said James Moises, an emergency room surgeon who opposed the closing of Charity. He worked at Charity when Katrina struck in August 2005 and argued that it was fit to be reopened shortly after the hurricane. He said the concern is that the state has spent so much money on the construction of the complex, with no guarantee it will be able to attract the number of patients needed to keep it solvent. The new center is being run by LCMC Health, a private not-for-profit health care system that includes Children’s Hospital, Touro and New Orleans East Hospital. Greg C. Feirn, the CEO of LCMC Health, said the new facility is expected to cost $465 million a year to operate. The hospital will accept Medicaid and under-insured patients, who now make up about 70 percent of the patients seen at an interim hospital that has served the poor and as a trauma center since Charity was closed. Feirn said the new hospital expects to see the daily patient load increase from about 220 patients today to about 350 a day in five years. The hospital will employ about 2,000 nurses, doctors and other staff. Old Charity remains closed and unused. It is a

where the most critical cases — such as gunshot and car accident victims — were taken. But Katrina’s floodwaters swamped the basement and lower parts of Charity, prompting state officials to close it and say it was beyond repair. The new complex includes many nods to old Charity. Art Deco art work featured at Charity is replicated in the new building’s entry lobby and a statue of the Rev. Avery C. Alexander welcomes visitors, as does the civil rights leader’s name on the front of the new hospital. Old Charity also carried the name of the civic leader, a New Orleans legislator, who was a strong supporter of the hospital.
