Kidnappings suspect released after three admit to false report

A man arrested for kidnapping on Sunday has been released from jail after the victim and two witnesses recanted their statements to detectives. Charges have been dropped against Kaleb Bruce, 21, of Cut Off, and he was released Friday. Meanwhile, David Nelson Jr., 17, of Galliano and two juveniles now face charges for lying to detectives about the incident. Through the initial investigation, detectives learned two male juveniles, ages 12 and 15, were walking along West 163rd Street in Galliano during the early morning hours of Sunday, July 5, when Bruce pulled up alongside. According to statements, the boys told detectives that Bruce grabbed the 12-year-old and placed him in the rear seat of his vehicle. They also said Bruce placed a duffel bag over the boy’s face and tied his hands together. The 12-year-old claimed he was able to escape after about 15 minutes. The boys first ran to the home of David Nelson, Jr. who corroborated the boys’ statements about the incident. See Bruce Page 6-A

Parish taxing agencies share in BP settlement

Mathews, LA – Last Wednesday, the Lafourche Parish Council accepted an $8.1 million settlement from BP to cover economic losses suffered as a result of the 2010 Deepwater Horizon explosion and oil spill off of Louisiana’s coast. All taxing agencies in Lafourche Parish represented by the Leger & Shaw law firm shared in the $36.3 million Lafourche Parish economic settlement. “This economic settlement represents an economist’s best determination of how much the oil spill adversely affected the parish coffers,” said Lafourche Parish President Charlotte Randolph. “This sum only represents the economic damages. BP is settling with local governments in Louisiana and the state for about $1 billion.” The formula for this settlement and others is based upon the size of the budget of the governmental agency. For instance, the City of Thibo-

daux will receive over $1.5 million, while the Town of Golden Meadow will receive $65,000. “The Natural Resource Damage Assessment and the Clean Water Act fines are separate,” Randolph said. “Lafourche’s coastal restoration projects will benefit greatly from a large share of the $6.8 billion Louisiana is expected to receive from the global $18.7 billion settlement to five states and the federal government.” Lafourche Parish has already received over $150 million in early restoration dollars as part of the Caminada Headlands Restoration Project. The $1 billion economic settlement is not included in the larger settlement. These funds are not restricted to addressing oil-spill related damage and may be used by the parish in general fund-type projects that could have been completed had the parish not suffered the economic loss. This year, students at Nicholls State University will face the lowest tuition/fee increase among college students attending any University of Louisiana System institution. In an ongoing effort to stabilize student costs and ensure college affordability, Nicholls will not increase tuition and will only minimally increase fees for the 2015-16 academic year. While many universities are raising tuition and fees by 10 percent or more, most Nicholls students will see a modest 1.6 percent increase, due to minor changes in the energy surcharge and student self-assessed fees. This fall, as Louisianans consider paying for a college education, Nicholls will be making a deliberate shift from the third most expensive to the fourth least expensive option within the nine-university system. “The rising cost of tuition and fees at Nicholls has been a major concern of mine for the past year,” said Dr. Bruce Murphy, Nicholls president. “I have been very vocal about not wanting to raise tuition and only wanting to increase

fees if students can see the direct results of their money in terms of better classrooms, services and academic experiences. “Nicholls is committed to providing affordable, accessible public higher education, and our leadership team will continue to explore how we can keep growing a financially viable university without creating unreasonable cost burdens on our students.” Two program-specific fees will be added this fall to help expand two of the university’s growing programs. Nicholls will add an additional per-semester fee of $250 maximum for culinary arts students and $150 for petroleum engineering technology and safety management majors. Revenue generated from the two fees will go directly back into these programs in the form of additional faculty, facility improvements, and added instructional equipment and supplies. An additional new fee will be applied only to students who take 16 or more credit hours during a semester.

The next phase of construction on the new elevated portion of Louisiana Highway 1 (LA1) between Golden Meadow and Leeville is set to begin in the coming months now that funding for the project has been secured. According to Henri Boulet, Executive Director of the LA1 Coalition, a support group working for highway improvements in the area, $40 million has been pledged by the state to go along with some $6.6 million in matching funds from the private sector for the segment construction. The 3,400 foot long segment will run from near the Apache dock in Golden Meadow southward and cross over the ring levee and end after about another 300 feet. This will be the first of three construction segments that will eventually connect with the current elevated overpass in Leeville. Advertisements for construction proposals on the project are slated for December of this year. Bids on the project are expected to be taken in early 2016 with work likely beginning in late spring or early summer of next year. Construction time on the segment is expected to take approximately two years.

During a checkup, the doctor tells them that they’re physically okay, but they might want to start writing things down to help them remember. Later that night, while watching TV, the old man gets up from his chair. “Want anything while I’m in the kitchen?” he asks. “Will you get me a bowl of ice cream?” “Sure.” “Don’t you think you should write it down so you can remember it?” she asks. “No, I can remember it.” “Well, I’d like some strawberries on top, too. Maybe you should write it down, so’s not to forget it?” He says, “I can remem-

ber that. You want a bowl of ice cream with strawberries.” “I’d also like whipped cream. I’m certain you’ll forget that, write it down,” she insists. Irritated, he says, “I don’t need to write it down, I can remember it! Ice cream with strawberries and whipped cream - I got it, for goodness sake!” Then he toddles into the kitchen. After about 20 minutes, the old man returns from the kitchen and hands his wife a plate of bacon and eggs. She stares at the plate for a moment and asks, “Where’s my toast?”

“In a Small Pond” By Leroy Martin

That day at Jenny’s Cafe Jim Swiler, an old friend from my KTIB days, died recently at age 76 on June 26. In 1967 he left Thibodaux to become news director at WTIX FM in New Orleans where I heard him covering the trial of Clay Shaw, (ref: JFK assassination), and the Howard Johnson’s hotel shooting rampage by Mark Essex that killed seven people. He was a Deacon in the Catholic Church and was instrumental in the creation of TV station WLAE. Jim and I had quite an

experience in the early 1960’s when he and I produced a record for his cousin Eddie Powers. I wrote two songs, hired a band, recorded at Cosimo’s studio and released it. He thanked us with a lawsuit and a restraining order that stopped the radio stations from playing the record. It had become an instant hit in New Orleans, but reaching legal age, Eddie had signed with another label without us knowing about it. Because he was Jim’s cousin we

never signed a contract and we had major labels calling to lease it. The record died with over 12,000 sales and consequently so did Eddie Power’s blossoming career. Jim and I lost the chance to own a national hit, which after Joe Barry’s “I’m A Fool to Care” and Barbara Lynn’s “You’ll Lose a Good Thing”, would have been my third one. We won our case because of the skills and efforts of our lawyer and friend Charles Leblanc, which links us to the following story: Jenny’s Café Jenny’s was a small café across the street from the courthouse where a good friend and I were eating on a day that, as President Franklin Roosevelt once said about Pearl Harbor, “would live in infamy”. My friend was future Thibodaux City Judge Charles Leblanc, father of the Honorably John E. Leblanc, Lafourche Parish District Judge, Division “A”, but all that’s too formal, we were just Charlie and Lee. Jenny, the proprietor, would sit at her counter playing pinochle with lawyers and customers until all her diners were in. She had already prepared lunch except for the main item, which she had bought that morning, either chops, hamburger steaks or whatever, and the card game went on until every diner was seated. If she had bought 12 units and 12 customers were seated, good, everyone got a chop. If 24 diners happen to come in, everyone got half a chop. If only 6 came in, expect the same menu the next day. business leaders were regular customers and sometimes played cards into late afternoon. We were ready to eat and only 8 were seated so we each got a chop. Suddenly Dave Robichaux, an oil lease broker, former Assessor and active politician, entered, went in the kitchen and turned the radio on. This was not unusual because at Jenny’s people came and went all the time and diners and card players rarely noticed or raised an eyebrow. Everyone was served and Jenny and her entourage were back at the card game. Robichaux turned up the radio volume, slammed his hand loudly on the counter and shouted: “Listen, listen … the President has just been shot in Dallas, Texas.” It was November 22, 1963, about 12:50 p.m. Stunned, everybody gathered around the radio and the news continued to get worse until Walter Cronkite, simulcasting, announced: “President John F. Kennedy died at 11:30 p.m. Dallas time, 12:30 Central Time.”

An eerie silence and gloom filled the room. Charlie and I got up and started back to the courthouse. I felt a tear but Charlie was crying as he loudly said: “Them SOB’s. They did it. They finally did it!” Who he had in mind, I’ll never know, and the rest of the day was a blur, but it made me realize what I already knew, that my friend

Charles Leblanc was a kind, gentle and caring person. I was fortunate to have had him as a friend. Next week I’ll write about how Charlie and I tried, unsuccessfully, to become a Cajun version of Rogers and Hammerstein, but we did write a couple of political campaign songs. BYE NOW!

Outdoor enthusiasts advised to beware of open wounds near water Baton Rouge, La. - If you live in Louisiana, you probably either fish or know someone who does. It is important to spread the word to family and friends about the dangers of fishing, kayaking or participating in other water-based activities with open wounds. “In most cases, swimming, fishing and other water activities are safe as long as you take the proper precautions,” said Louisiana Department of Health and Hospitals Secretary Kathy Kliebert. “We don’t want to scare people away from enjoying Louisiana’s outdoors.” The main culprit to keep in mind when you have an open wound is Vibrio vulnificus, otherwise known as “flesh-eating bacteria,” according to State Health Officer Dr. Jimmy Guidry. “Vibrio vulnificus is more abundant in the summer. It normally lives in warm seawater or brackish water, and exposure is particularly harmful to individuals with chronic liver disease or weakened immune systems,” said Guidry. “If you experience symptoms of infection after exposure to seawater or brackish water, seek medical care immediately.” Symptoms of infection include fever, chills, decreased blood pressure, blistering skin legions, vomiting, diarrhea, abdominal pain and fever. The bacteria invades the bloodstream and may cause severe, potentially life-threatening illness. In addition to seawater, you can also contract Vibrio vulnificus by eating contaminated raw shellfish. DHH offers the following tips for reducing your risk. - If you have open wounds, do not get in seawater, brackish water or other salty water. - Check children for open wounds before allowing them to get in the water. - If you experience chronic illness of the liver, kidney failure, other immune disorders, or have ever been through chemotherapy, used steroids for an extended period of time or use antacids, eat shellfish fully cooked. - Avoid cross contaminating raw shellfish and its juices with other food. - If you have an open wound, take care when handling shellfish. While temperatures are rising in July, it is also one of the hottest months for vehicle theft in the United States. The National Insurance Crime Bureau (NICB) reports 1,750 cars were stolen in the United States on Independence Day in 2013 and the Bureau has designated July as National Vehicle Theft Prevention Month. The National Highway Traffic Safety Administration reports the top two months for vehicle thefts are July and August. The Louisiana Department of Insurance (LDI) and the Louisiana Automobile Theft and Insurance Fraud Prevention Authority (LATIFPA) are raising public awareness about the prevalence of vehicle theft and its many consequences, as well as offering motorists guidance on how to avoid becoming a victim. the briefest moment. - Close and lock all of your doors and windows. - Park in well-lit areas and in garages when possible. - Never leave valuables such as electronics in your vehicle, especially not in plain sight. Judge F. Hugh Larose set his bond at $100,000. Then on Thursday, July 9, detectives re-opened the investigation after obtaining information that the kidnapping story had been fabricated. Detectives made contact with the two boys, as well as Nelson, and all three admitted to their involvement in helping fabricate the kidnapping story. All three were charged with criminal mischief for filing a false police report. The 12-year-old, who detectives say spurred the fabricated story, was taken into custody and placed at the Lafourche Parish Juvenile Detention Center in Thibodaux. The 15-year-old was charged as a juvenile and released to the custody of his parents, and Nelson was issued a criminal summons. Charges on Kaleb Bruce were subsequently dropped, and he was released from the Detention Center at around 5:30 p.m. on Friday.

This fee was implemented to allow the university to more efficiently allocate faculty resources and remain fiscally responsible. With tuition capped at the 12-hour level, Nicholls has determined that students enrolled in more than a million dollars’ worth of overload courses each year for which they were not being charged. The additional faculty costs associated with overload courses amounted to over $700,000 annually. Because most degree programs require students to enroll in 15 credit hours per semester to graduate in four years, additional fees will not kick in until a student registers for 16 hours. Those undergraduate students will pay $205.10 per additional credit hour, and graduate students will pay $236.90 per additional credit hour. Retirees urging a veto session for pension increase bill MELINDA DESLATTE Associated Press

BATON ROUGE, La. (AP) — Retired state workers and public school teachers are trying to salvage a small increase in their pension checks. They are urging state lawmakers to hold a veto session, to override Gov. Bobby Jindal’s rejection of the retirement hike. But the idea is a longshot. Lawmakers have never held a veto session under the current constitution, and it only takes a majority vote of either the House or Senate to scrap the session. Jindal cited national credit rating agency concerns about retirement systems’ debt when he rejected the 1.5 percent cost-of-living adjustment bill. Steamboat could return to rivers if OK’d by Congress CINCINNATI (AP) — The historic Delta Queen steamboat could once again carry passengers on overnight river trips if Congress approves legislation recently introduced by Ohio’s two U.S. senators and a representative from the state. Senators Sherrod Brown and Rob Portman introduced a bill last week that would clear the way for the wooden steamboat to return to the Ohio and Mis-

sissippi rivers. Ohio Congressman Steve Chabot introduced companion legislation in the U.S. House of Representatives. The 1966 Safety at Sea law prohibits wooden ships of a certain size from carrying passengers on overnight trips. The proposed legislation would require new safety requirements and grant a 15-year exemption to that rule, according to releases from Brown and Portman.

“The Delta Queen is an important landmark with a storied history of navigating the Ohio River,” Brown said. He said restoring the Delta Queen to river traffic would pump money into Ohio River towns. Portman said the steamboat is especially important to Cincinnati. “The Delta Queen is a true Ohio treasure and an important part of the Queen City’s history,” Portman said. Brown and Portman say granting exemptions was a standard practice until 2008. An attempt last year to get Congress to exempt the Delta Queen failed. The paddlewheel riverboat, which has been designated a National Historic Landmark, was owned by a Cincinnati company from 1946 to 1985 and later docked as a floating hotel in Chattanooga, Tennessee. It’s now being renovated in Houma, Louisiana. A private company that purchased the boat this year also is pushing for the

exemption. The boat’s owners have said there has been interest in several cities about becoming the Delta Queen’s home port. The say some of those cities include Cincinnati, St. Louis and New Orleans. The steamboat went into service in 1927 carrying overnight passengers between Sacramento and San Francisco and was used as a U.S. Navy transport ship in World War II.

NEW ORLEANS (AP) — Two Louisiana men were among 46 inmates nationwide whose prison sentences for non-violent drug offenses were commuted by President Barack Obama. On Monday, Obama cut the sentences of Brian Nickles, a 46-year-old man from New Orleans, and James Nathan Walton, a 42-yearold man from Thibodaux.

Both men are black and were serving 20-year sentences for drug offenses and were due to be released in 2021, according to federal records. Nickles is locked up at a federal prison in Beaumont, Texas, and Walton in a federal prison in Pollock, Louisiana. Obama said “their punishments didn’t fit the crime.”

Carver Meet Norman Davaine

Norman Davaine of Mathews has been carving for 11 years. His preferred method is working decoys but he has dabbled in other styles as well. Norman’s favorite bird to carve is the American Coot, known locally as a Pouldeau. Their dark bodies and white faces are common sights across the country; but while they can often be spotted in duck ponds, they aren’t ducks. “As a carver, I am always learning. It’s great having a group to get feedback from and share ideas with,” said Norman. Norman is part of a group of

carvers that promotes Cajun heritage, decoys, carving and keeping the age-old tradition thriving. The group also sponsors the Cajun Heritage Festival, which is entering its 40th year. Norman is excited to see younger people taking up the hobby and joining the organization. “It’s a very relaxing hobby that is suitable for all ages. Visitation was held on Sunday, July 12 at Samart-Mothe Funeral Home from 5:00 p.m. until 10:00 p.m. and on Monday, July 13th at Christian Fellowship Church from 9:00 a.m. until funeral time. NEW ORLEANS (AP) — The Louisiana High School Officials Association and the Louisiana High School Athletic Association have come to a tentative agreement over pay issues that arose in meetings between the two organizations in May. Multiple news outlets report it is not known whether the officials received any increase for their pay schedule.
