Forecasters adjust predictions, expect slower storm season

Fall shrimp season dates set

Thursday, the Louisiana Wildlife and Fisheries Commission set the 2014 fall inshore shrimp season opening dates. The season will open one-half hour before sunrise, Monday, August 18, along inside waters from the western shore of the Atchafalaya River westward to the Louisiana/Texas state line, and at 6 p.m., Monday, August 18 along state inside waters east of the Atchafalaya River. The Commission set the season based on recommendations presented by Louisiana Department of Wildlife and Fisheries biologists and comments from the public. However, certain areas are still closed to commercial fishing and certain recreational fishing activities due to the oil spill.

LOSGH breaks ground on new medical clinic

Lady of the Sea General Hospital broke ground July 1 on an 11,500 square foot modern medical clinic that will be located between the existing hospital building and the dialysis center in Galliano. The clinic became a reality when voters of the 10th Ward supported the concept by voting for a .2 mill increase on their ad valorem taxes. The tax was approved on May 4, 2013. Since then, plans have been drawn, bids have been received and opened and the construction job was awarded to B.E.T. Construction, Inc. from Thibodaux. The new facility will include a clinic pharmacy and will replace two of the hospital’s existing medical clinics by combining both the Cut Off location, now located on the third floor of the hospital, and the Golden Meadow location into one centrally located facility with easy access to medical testing. “We are excited to see the dream become reality right in front of our eyes,” said Karen Collins, RN, CEO of Lady of the Sea General Hospital. “We have been in the planning phase for over a year and are glad to see the construction begin on this state of the art clinic. We thank our community for their continued support in helping us meet the healthcare needs of the residents of South Lafourche.” The new clinic is expected to offer two family medicine physicians and up to six nurse practi-

tioners and physician assistants. The layout of the clinic incorporates the flow of patients to reduce wait time and create additional efficiencies in patient care. Now that construction is underway, the expected completion date on the building is May 2015. Follow the new facility’s progress at www.losgh.org.

MIAMI (AP) — The Atlantic hurricane season will continue to be even quieter than predicted, thanks to atmospheric and oceanic conditions suppressing storm formation, federal forecasters said Thursday. The National Oceanic and Atmospheric Administration still expects three to six hurricanes to form during the six-month season that peaks between mid-August and mid-October. Officials dropped the number of named storms to between seven and 12 in an updated hurricane season forecast issued Thursday. The forecast calls for zero to two of those hurricanes to be major storms with winds greater than 110 mph. “We are more confident that a below-normal season will occur because atmospheric and oceanic conditions that suppress cyclone formation have developed and will persist through the season.” said Gerry Bell, lead seasonal hurricane forecaster at NOAA’s Climate Prediction Center. Missouri couple charged in two recent shooting incidents

A couple from Missouri faces charges of attempted murder and property damage following two shooting incidents which occurred this past week. Justin Rice, 26, and Christina Higgins, 35, both of Jefferson City, Missouri, were arrested Tuesday, August 5th in Golden Meadow. The first incident occurred on the afternoon of Thursday, July 31. Just after 1:30 p.m., patrol deputies responded to a shooting on LA Hwy. 308 in Lockport. Deputies learned a woman was turning from the highway into a business parking lot when she heard something strike her vehicle. Deputies noticed a hole near the bottom of the driver’s side door, and recovered a bullet and a 9mm casing from the scene. Detectives initially determined the shot had likely been fired from a green sport-utility vehicle traveling behind the victim’s vehicle. See Shootings Page 5-A

State Obamacares its employees’ health insurance By John Kennedy State Treasurer

The state of Louisiana has “Obamacared” its own employees’ health insurance plan. Here’s how. One of the problems with the federal Affordable Care Act (called “Obamacare” by the President himself) is the way it’s paid for: with $700 billion of taxpayer money taken from Medicare. Many Louisiana officials, myself included, have criticized this. That’s why it’s so disappointing and more than a little ironic that the state has done the same thing to its own State Group Benefits (SGB) health insurance plan for 230,000 active and retired state employees, their spouses and children. According to a July 18 report by the nonpartisan Louisiana Legislative Fiscal Office (LFO), two years ago, OGB had built up a reserve fund, or savings account, of $540 million to pay its members’ health insurance claims. This money came from premiums paid by employees and employer contributions paid by the state. Then OGB, which is run by the state Division of Administration, began spending $16.1 million more per month to pay claims than it was collecting in premium revenue. If this continues, by the end of Fiscal Year 2015, the reserve fund will contain only $5.6 million, according to the LFO. What happened? Why

is OGB suddenly living off its reserve fund? According to the LFO, the state has “indirectly utilize[d] OGB’s fund balance to support the FY13 and FY14 operating budgets.” (LFO Report, p.3). The state did this by reducing premiums, which helped employees financially but which helped the state even more by reducing the amount of the state’s legally-required employer contribution to OGB, which in turn freed up money to spend elsewhere in the budget. In other words, the state in effect took the money from the OGB reserve account to pay for the state’s operating budgets in 2013 and 2014, just like Congress took the money from Medicare to pay for Obamacare. The OGB reserve account is not the only trust fund the state has drained recently. The Louisiana Medicaid Trust Fund for the Elderly was established with federal dollars in 2000 to provide a permanent source of money for health care for our elderly. We were supposed to invest the money, spend the interest and leave the principal in tact.

In 2012 the trust fund contained $519.2 million. At the end of this fiscal year, it will contain zero. The state has spent the interest and the principal. Similarly, in 2011, the state capped the amount of the Millennium Trust Fund (better known as the Tobacco Settlement Trust Fund), whose earnings are used to pay for health care, education and the TOPS college scholarship fund, and redirected the tobacco settlement monies flowing into the trust fund to the operating budget to pay for TOPS, which frees up money to spend elsewhere. This maneuver thus effectively uses the trust fund money to pay for balancing the budget. Louisiana state government finances must be stabilized. The way to do it is not especially complicated: 1) stop draining the state’s savings accounts and trust funds; 2) stop spending more money than we take in; and 3) when we do spend money, spend it on things citizens need, not things politicians want.

Landrieu agrees to 4 Louisiana Senate race debates

BATON ROUGE, La. (AP) — U.S. Sen. Mary Landrieu has agreed to four TV debates leading up to the Nov. 4 election. The Democratic incumbent is in a tight race, seeking a fourth term against two Republican challengers. Landrieu’s campaign announced Tuesday she’ll participate in an Oct. 2 New Orleans debate hosted by WDSU-TV, an Oct. 27 New Orleans debate hosted by WWL-TV and an Oct. 29 Baton Rouge debate hosted by Raycom Media, LSU’s journalism school and WRKF. The senator also agreed to a Monroe debate with KNOE-TV and KALB-TV, but a final date hasn’t been set. Landrieu’s closest competitor, U.S. Rep. Bill Cassidy, hasn’t announced what debates he’ll attend. Tea party favorite Rob Maness has said he’s participating in the first three and is expected to agree to the Monroe date as well. ___

Cassidy won’t decide debates until qualifying ends

BATON ROUGE, La. (AP) — U.S. Rep. Bill Cassidy, the chief Republican contender in Louisiana’s U.S. Senate race, hasn’t yet agreed to any debates against Democratic incumbent Sen. Mary Landrieu. Landrieu, seeking a fourth term in office, announced this week that she’s accepted invitations to four TV debates leading up to the Nov. 4 election: two debates in New Orleans, one in Baton Rouge and another in Monroe. GOP candidate and tea party favorite Rob Maness also has agreed to partici-

pate in those forums. But Cassidy campaign manager Joel DiGrado says the congressman’s campaign won’t evaluate debate requests until the end of the candidate sign-up period, which runs from Aug. 20-22. DiGrado said in a statement Thursday that until the qualifying period is over, the Senate race doesn’t have a formal field of candidates. ___

Education department compiles high school guide

BATON ROUGE, La. (AP) — Louisiana’s education department has published a guide for high school student planning, to highlight state policies and programs for counselors, teachers and parents. Education Superintendent John White said the guidebook, released Tuesday, will help make sure students are on track for a college degree or professional career after graduation. The 28-page booklet includes information about planning for struggling students, the state’s accountability system, counseling programs for students and ways to receive skills training and advanced college credit. The education department is holding a series of webinars each Thursday this month for superintendents, principals, teachers and counselors about the information contained in the guide. Oil boom and housing bust alter US spending trends

WASHINGTON (AP) — Consumer spending has soared since the Great Recession ended five years ago in U.S. states with oil and gas drilling booms and has lagged in states hit especially hard by the housing bust.

The figures come from a new annual government report that for the first time reveals consumer spending on a state-by-state basis. They point to substantial shifts in the economy since the recession. Spending jumped 28 percent in North Dakota, the largest gain nationwide, from 2010 through 2012. It surged nearly 16 percent in Oklahoma. By contrast, spending rose a scant 3.5 percent in Nevada, the weakest for any state and far below the 10.7 percent national average. Arizona’s 6.2 percent increase was next-weakest. Home values plummeted in both states when the housing bust hit in 2006. ___

Memories stirred 35 years after Jonestown massacre

DOVER, Del. (AP) — Thirtyfive years ago, funeral directors in Delaware struggled to quickly bury and cremate the remains of more than 900 people who died in a suicide-murder in Jonestown, Guyana, many of them Peoples Temple followers who drank cyanidelaced punch. Some bodies that arrived back in the U.S. at Dover Air Force Base in 1978 were claimed by families. Some were cremated. Others were buried in a mass grave in California. On Thursday, officials revealed that not all had been brought to a final resting place. The cremated remains of nine Jonestown victims were discovered in a decrepit, now-shuttered funeral home in Dover, officials said. The discovery reopened wounds.

The “Seal of Confession” is questioned by La. Supreme Court

An interesting court case that went all the way up to the Louisiana Supreme Court involved the “Seal of Confession.” A 14-year-old girl said she went to confession to Fr. Jeff Bayhi from the Diocese of Baton Rouge in 2008. She told Fr. Bayhi that she had been sexually abused. Now this 20-year-old plaintiff attempted to have the court compel testimony from Fr. Bayhi about whether or not there were confessions and, if so, what were the contents of those confessions. The Diocese of Baton Rouge put out the following statement: “The case in question does not involve any charges against any clergy, religious or a paid staff member of the diocese. The Church has great compassion for those who have experienced such egregious misconduct. “The issue before the District Court, the First Circuit Court of Appeals and the Louisiana Supreme Court assaults the heart of a fundamental doctrine of the Catholic faith as relating to the absolute seal of sacred communications (Confession/Sacrament of Reconciliation). “The Court of Appeals for the First Circuit ruled that the seal of confession preempted the Civil Court from ordering the priest to testify about whether or not there was a confession and, if so, what was the content. The Court of Appeals for the First Circuit dismissed the case against both Fr. Bayhi and the Catholic Church of the Diocese of Baton Rouge. “The Supreme Court of Louisiana reversed all the First Circuit Court of Appeals judgment, reinstated the judgment of the trial court, and sent back for further proceedings in the District Court a hearing concerning whether or not there was a ‘confession.’ We contend that this is a clear violation of the Establishment Clause of the U. S. Constitution. The Supreme Court of Louisiana cannot order the District Court to do that which no civil court possibly can – determine what constitutes the Sacrament of Reconciliation in the Catholic Church. “A foundational doctrine of the Roman Catholic Church for thousands of years mandates that the seal of confession be absolute and inviolable. A priest takes an oath never to break that seal. Neither is a priest allowed to admit that someone went to confession to him. If necessary, the priest would have to suffer a finding of contempt in a civil court and suffer imprisonment rather than violate his sacred duty and violate the seal of confession and his duty to the penitent. “A priest/confessor who violates the seal of confession incurs an automatic excommunication reserved for forgiveness by

the Apostolic See in Vatican City. In this case, the priest acted appropriately and would not testify about the alleged confessions. Church law does not allow either the plaintiff (penitent) or anyone else to waive the seal of confession.” Alfred Hitchcock directed a 1953 movie with a similar theme. It’s called “I Confess” starring Montgomery Clift as Fr. Michael Logan, a priest in Ste. Marie Church in Quebec City. He employs German immigrants Otto Keller and his wife Alma as caretaker and housekeeper. Otto also works part-time as a gardener for a shady lawyer called Villette. The priest is seen walk-

ing away from Villette’s house, where Villette lies dead on the floor. Shortly afterward, in the church confessional, Keller confesses to Father Logan that he accidentally killed Villette while trying to rob him. When the trial comes up, the priest is accused of the murder but cannot defend himself because of the Seal of Confession. He is willing to go to jail and suffer the consequences of being falsely accused though he knows from the confessional who the real killer is. These situations do not happen often but every priest realizes the possibility of going to jail. It comes with the territory.

The unit honored Iris Robichaux by electing her honorary board member. Because of her health Rosalie Benoit has to relin-

quish her chairmanship of community service and historian. She has won many district and national awards for her reports. The unit awarded her a certification of appreciation and a gift. The unit gave a “Christmas in July” party for the veterans at the Reserve Veterans Home. The unit donated $100 for the bingo prizes and members donated the food served. Members also prepared a bag of goodies for each veteran. The unit held a bingo party for the residents at the Raceland Manor. Membership chairman, Iris Robichaux, reported

that she is now collecting dues for this year. The unit sent a birthday card and a check to Anne Comeaux, our Gold Star Mother.

Shootings From 1-A

Two days later, at around 9:30 p.m. on Saturday, August 2, deputies responded to a shooting on Settlement Lane in Golden Meadow. They learned a man and woman in a green SUV were spotted near the storage units at the back of the street. As a nearby resident approached them to see if they needed assistance, the man pulled out a gun and began firing at the resident who was still inside his vehicle. The two subjects began driving away in the SUV, but they stopped at one point and fired additional rounds at the victim in his vehicle. Detectives investigated this incident and were able to obtain a description of the subjects and learned the vehicle had a Missouri license plate. A notice was sent out to area law enforcement to be on the lookout for the subjects. At around 5:15 p.m. on Tuesday, August 5, patrol deputies spotted the suspects in the SUV traveling along LA 1 in Golden Meadow and conducted a traffic stop. Upon making contact with the suspects, deputies immediately noticed 9mm shell casings inside the vehicle. They identified the woman as Christina Higgins and the man as Justin Rice. They found Rice to have an active warrant for probation and parole in the state of Missouri. Through investigation, detectives discovered evidence linking the suspects to both shooting incidents on July 31 and August 2 and that Rice had allegedly fired the gun in both incidents. Both Rice and Higgins were placed under arrest. Rice was charged with attempted second-degree murder and two counts of aggravated criminal damage to property, and Higgins was charged as a principle to all three charges. They were booked into the Lafourche Parish Detention Center in Thibodaux. Rice is being held in lieu of $100,000 bond as set by Judge John LeBlanc and will eventually be extradited to the state of Missouri for Probation and Parole. Higgins is being held in lieu of $40,000 bond as set by Judge LeBlanc.

BATON ROUGE, La. (AP) — Gov. Bobby Jindal asked a judge Wednesday to prohibit state education leaders from using testing material tied to the Common Core standards in Louisiana’s public school classrooms. Jindal filed a petition seeking an injunction that would keep the state Board of Elementary and Secondary Education and the education department from administering any standardized tests developed through a testing consortium aligned with Common Core. The injunction request, filed in district court, is part of the Republican governor’s countersuit, after he was sued by parents and teachers who support Common Core and who accuse Jindal of violating the state constitution in actions he’s taken against the standards. Jindal argues that Louisiana’s agreement with the testing consortium called the Partnership for Assessment of Readiness for College and Careers, or PARCC, is an attempt to federalize education in the state. His lawyer, Jimmy Faircloth, says that violates federal laws that prohibit such micromanagement. “Common Core began as an effort to simply raise standards for students, but it has morphed into a scheme to drive education curriculum from Washington, D.C. ... PARCC is a federal agent for co-opting our school’s curriculum,” Jindal said in a statement. In the new court filing, the governor wants to have the state barred from using tests or test questions developed through PARCC, along with the invalidation of Louisiana’s participation in the consortium. Common Core is a set of English and math standards that have been adopted by more than 40 states, describing what students should know after completing each grade. Supporters say the standards will better prepare students for college and careers. Critics say the

standards are untested and damage state autonomy. Jindal once supported the multistate standards, but now opposes them as an Obama administration effort to meddle in state education policy. However, a majority of members of the state education board, known as BESE, support Common Core, along with Education Superintendent John White. State lawmakers also refused to end Louisiana’s use of the standards earlier this year. BESE has joined the lawsuit accusing Jindal of violating the Louisiana Constitution in his actions against Common Core. Board President Chas Roemer said Jindal’s actions are designed to bolster the governor’s likely 2016 presidential campaign, rather than to improve education. The governor agreed to Louisiana’s participation in PARCC and signed the con-

sortium agreement in 2010, but he has since changed his mind. Now, he’s arguing the agreement violates state sovereignty by having a private, non-Louisiana entity set education policy. “PARCC is the implementation platform for a carefully orchestrated federal scheme to supervise, direct and control educational curriculum, programs of instruction and instructional material in direct violation of federal law,” Faircloth writes in the injunction request. Jindal’s also taken executive action against the testing material, suspending contracts to keep the state education department from using consortium-developed questions in standardized tests this year. He’s accused BESE and the department of not following state procurement law. The action has stalled testing plans for third through eighth grades.

ANN ARBOR, Mich. - Expiration date labeling on food products is a source of confusion for consumers according to a new survey from NSF International, a global public health and safety organization. The survey found that people are confused about how to interpret dates on food packaging such as expiration, “best used by� and “sell by� dates, causing many to keep some food dangerously long or prematurely throw away good food. In fact, the survey indicated that one in four (27 percent) Americans don’t throw away food by the expiration date, putting themselves, family or friends at risk of foodborne pathogens such as Salmonella, Listeria and E. coli. Additionally, half of Americans surveyed said they throw out food based on the “best used by� and “sell by� dates (51 percent and 36 percent, respectively), wasting both their food and money. Perhaps because of this confusion, a majority of the respondents (64 percent) said they rely on the decidedly unscientific and incorrect approach of using their senses to decide when to throw out food. Nearly half (47 percent) use visual cues such as mold or a change in texture or color as an indicator of food’s freshness. An additional 17 percent said they will throw away fresh foods based on smell. Consumers should check to make sure this date has not passed before purchasing food. “Best used by� dates have nothing to do with safety. Instead they refer to the last date when the food will be at peak quality and freshness. Other findings from NSF International’s food expiration dates survey include: - Uncooked meats, dairy products and produce pose the greatest food safety threat when kept too long, yet some still ignore the dates on these products. One in four (27 percent) said they keep uncooked meat past the date on the label and 22 percent said they keep dairy products such as milk and sour cream past the date on the label. Thirty-seven percent don’t throw away produce after the expiration date. - Behavior varies according to age. Those under age 34 were more likely to throw out foods regardless of the type of date posted on the package. Conversely, Americans over age 55 were the most likely to hold onto food past any date on the label, which is concerning if they are preparing meals for young children, pregnant women or immune-compromised family and friends. Consumers older than 65 may also be more susceptible to germs which cause foodborne illness.

- Americans sometimes avoid eating at other people’s homes due to food safety concerns. According to the survey, 39 percent of respondents have avoided eating something at a friend’s or family member’s house because they didn’t trust the safety or quality of the food. The level of concern rises for middle-aged respondents. Nearly half (48 percent) of those aged 45-54 will say “no thanks� to food when they are a guest, while 35 percent of younger Americans aged 18-34 will decline food. - Men and women tend to throw out food for the same reasons. Overall, men and women have similar behavior when it comes to throwing away food. However, women tend to be slightly more cautious when it comes to throwing out specific foods that are past the label date (e.g. uncooked meat, canned goods, prewashed vegetables, etc.). Both acknowledge relying more on changes in appearance, color or texture rather than the date on the food package. “Food expiration dates

are meant to offer guidance to consumers,� added Luptowski. “Confusion about these dates can result in many people either keeping food long past the dates on the product or throwing away food prematurely. Knowing what the dates mean can help keep you healthy, avoid food wastes and save money.� The survey was conducted by CARAVAN (Braun Research) from April 24-27, 2014. It polled 1,006 adults, 489 men and 517 women, 18 years of age and older, living in the continental United States. The margin of error is +/- 3.1 percent.

Outsmarting a lawyer

A lawyer runs a stop sign and gets pulled over by a sheriff. He thinks he’s smarter being a big shot lawyer from New York and has a better education than a sheriff from West Virginia. The sheriff asks for license and registration. The lawyer asks, “What for?� The sheriff responds, “You didn’t come to a complete stop at the stop sign.� The lawyer says, “I slowed down and no one was coming.� “You still didn’t come to a complete stop. License

The lawyer says, “If you can show me the legal difference between slow down and stop, I’ll give you my license and registration and you can give me the ticket. If not, you let me go and don’t give me the ticket.� The sheriff says, “That sounds fair, please exit your vehicle.� The lawyer steps out and the sheriff takes out his nightstick and starts beating the lawyer with it. The sheriff says, “Now tell me, do you want me to stop or just slow down?�
