Candidate qualifying for November elections will take place this week, running from 8:30 a.m. until 4:30 p.m. Wednesday thru Friday. An array of federal, state and local offices are slated for the November 4 ballot, including numerous proposed amendments to the state’s Constitution. Offices up for electoral consideration include United States Senator and United States Representative. On a local level, the offices of District Attorney and the five district judgeships in the 17the Judicial District Court, which is made up of Lafourche Parish, will also be on the ballot. New festival hopes to pick up where old ones left off … and then some! Marc C. Kimball Contributing Writer
Remember the Sauce Piquante Fest? It ain’t around no more. La Vie Lafourchaise? Nope. It doesn’t exist anymore either. Raceland Fireman’s Fair? That one’s gone, too. The Oyster Festival? The Cajun Festival? Don’t look for those either. They’re all gone! Many of our beloved fairs and festivals have gone the way of typewriters, corded phones and ditto machines. One man has a vision to bring the excitement, flavor and grandeur of these now defunct festivals of days past to the present! And, he’s well on his way! Terry Arabie is the first Chairman of the first annual La Fetes Des Vieux Temp Festival – a Festival of Old Times – beginning Friday, October 3rd and running through Sunday, October 5th. “Over the years, all the festivals just seemed to keep disappearing and here we are today without any festivals in the central part of the parish,” says Arabie. “I have been thinking about this idea for years,” he added. “Finally! It’s coming to fruition”, he states excitedly…and with good rea-
son! Arabie fears that if the festivals can so easily go to the wayside, what about our identity? Culture? Language? Is it a matter of time before we lose everything that identifies us as…well, us? “This festival is all about preserving our community,” he says. “We wanted to preserve our culture while having our own festival in the central part of the parish that incorporates the best elements of the older festivals,” he added. This isn’t a solo-man’s festival. Arabie had some help in organizing and planning the weekend fest. Arabie is president of the Raceland Lion’s Club, but that’s just one group working on the festival. The Lockport Volunteer Fire Department and Lafourche Fire District #1 make up the other two groups working towards bringing the joy of the older festivals back to the Raceland area. At the August 11 South Lafourche Levee District (SLLD) public meeting in Galliano, General Manager Windell Curole referred to plans for elevating the unimproved sections of the Larose Floodwall along the Intracoastal Waterway in Larose as “pieces of a puzzle”. Because of numerous constraints, not the least of which is funding and U.S. Army Corps of Engineers (USACE) delays, SLLD has been forced to improve this weak link in the levee district’s domain by doing small sections as permitting and money become available. One “puzzle piece” involves the future path of a section of the floodwall which now goes around David Industries, a shipyard on the Intracoastal Waterway. “We had two routes to consider,” said Curole. “Closing off and buying out the shipyard, or going around it.” See SLLD Page 5-A
Councilman pushing for ‘dangerous’ animal ordinance Proposal to be debated further at next council meeting Buster Avera Contributing Writer
Parish Councilman John Arnold is not giving up his fight for a more stringent ”vicious and dangerous” animal ordinance in Lafourche. At last Tuesday’s parish council public meeting in Mathews, Arnold reintroduced a measure to amend the ordinance, one which he had unsuccessfully tried to pass in April. “Since the last time we proposed this, we’ve had four attacks by pit bulls in the parish,” he stated. “These animals are vicious animals, and their owners need to be responsible.” In an effort to garner more support for his measure, Arnold has tried to rework some of the things councilmen See Council Page 5-A
Pushing Paddles’ goal is finding a cure for MD
Unless you’ve experienced the loss of a child, it’s difficult to put into perspective the extent of unbearable grief that a parent feels when this happens. Tammy Colombel Guidry knows that pain all too well. When Tammy lost her son Dillion to Muscular Dystrophy she was determined to create a fundraiser that would help others with this debilitating disorder. Her son’s death brought about the ‘Pushing Paddles for a Cure’ (PPFAC) fundraiser on Bayou Lafourche to be held Sunday, September 7. The annual event was established in the name of Dillion Joseph Shicksnider. Dillion, or Dill-Pickle, as he was affectionately known, was diagnosed at a young age with Duchene’s Muscular Dystrophy (DMD) by the physicians at Children’s Hospital. Throughout his life he faced many challenges but still kept a positive attitude and strong will.
But at the age of 16, Dillion’s battle ended. But his compassion, determination, persistence, motivation and good spirit lives on. Tammy, along with her sister Kelly and brother, Don Jr., and with their parents’ support, Don and Priscilla Colombel of Larose, established the Pushing Paddles for a Cure event, now in its third year. PPFAC participants will gather to spend the day with family, friends and new friends as they paddle up the bayou on Sunday, September 7, where registration will begin at 7 a.m. near the Greater Lafourche Port Commission building on Hwy. 308 in Galliano. Participants are asked to sign in and must donate a minimum of $10. The parade of boats will consist of pirogues, canoes, kayaks, paddle boards, and basically anything else that floats. Paddling will begin near the Port Commission at around 8 a.m. and will end near

Judge OKs lawsuit, but blocks Jindal’s deposition MELINDA DESLATTE Associated Press
BATON ROUGE, La. (AP) — A state judge refused Wednesday to throw out any pieces of a lawsuit accusing Gov. Bobby Jindal of violating the state constitution in his efforts to undermine the Common Core education standards. District Judge Todd Hernandez rejected a Jindal administration argument that the parents and teachers who sued the Republican governor didn’t have the legal standing to make nearly all of the claims in their lawsuit. “The plaintiffs have a right and cause of action to seek judicial review and seek judicial restraint against the defendants in this matter,” the judge wrote in his decision. But while Hernandez ruled that the lawsuit could move forward, he decided that Jindal, his commissioner of administration and other administration officials can’t be questioned under oath by lawyers for the parents and teachers. The next hearing in the case is set for Monday. “The Jindal administra-
tion tried to shut us down on technicalities, but the judge ruled that this case warrants going forward,” Stephen Kupperman, a lawyer for the group that sued Jindal, said in a statement. Jimmy Faircloth, an attorney for the governor, said he wasn’t surprised that the judge let the case proceed intact, though he said he expects the Jindal administration to be successful in defeating the allegations raised by the lawsuit. “The plaintiffs have no clear claim that the governor has exceeded his statutory authority,” Faircloth said. Seven parents and two teachers, along with a charter school organization, sued Jindal after he suspended contracts the education department planned to use to buy testing material aligned with Common Core. The state education board joined in suing Jindal. They allege that the governor violated constitutional provisions that establish authority over education policy in the state. The Common Core
standards are math and English benchmarks that have been adopted by more than 40 states, describing what students should know after completing each grade. Jindal once supported the standards as improving student preparation for college and careers. But the governor, considering a 2016 presidential campaign, now opposes them as an Obama administration effort to meddle in state education policy. His partial suspension of the testing contracts has stalled standardized testing plans in public schools for third-grade through eighthgrade. Despite Jindal’s opposition to Common Core, state lawmakers and the Board of Elementary and Secondary Education have voted to keep the multi-state standards in Louisiana’s public schools. A separate lawsuit over the education standards has been filed by 17 state lawmakers who oppose Common Core and allege education leaders didn’t follow the law in enacting the standards. A hearing in that lawsuit was scheduled for Friday.

Louisiana Tax Amnesty program starts Oct. 15
BATON ROUGE, La. (AP) — The Louisiana Tax Amnesty program begins Oct. 15. The 2014 program offers noncompliant taxpayers the chance to settle their accounts with the state by paying 100 percent of delinquent taxes, with a waiver of all penalties and 50 percent of the interest owed. New to the program this year is the option for individual and business taxpayers to pay their overdue tax liabilities through installment payments over a sixmonth period. State lawmakers expect to collect $100 million from delinquent taxpayers, and they’ve already spent the anticipated money in this year’s budget to help pay for the Medicaid program that provides health care services to the poor, disabled and elderly. Taxpayers identified as noncompliant should receive notice before the program starts. Beginning at 12:01 a.m. on Oct. 15 through 11:59 p.m. on Nov. 14, eligible taxpayers can apply online at www.ldrtaxamnesty.com or call 866-782-9241 for more information. Louisiana offered a similar amnesty period last year and has one more planned for 2015, though next year’s will have less generous terms. Unlike in 2013, the revenue department won’t
accept tax credits as payment for back-owed taxes. At the conclusion of the 2015 amnesty period, there shall be no new amnesty program implemented by the Department of Revenue before Jan. 1, 2025. ___
Tugboat captain killed when crane hits bridge
NEW ORLEANS (AP) — The Coast Guard says a tugboat captain is dead after the arm of a crane struck a bridge and fell back onto the tug’s pilothouse. The accident happened early Thursday morning on the Industrial Canal north of the Mississippi River in New Orleans. Authorities say the tugboat was pushing a barge with a crane. The crane’s arm struck a drawbridge and fell back on the tug. Coast Guard spokesman Jonathan Lally says the drawbridge was open at the time of the accident. He says the state inspected the bridge and it was reopened to vehicle traffic. An investigation is underway to determine the cause of the accident. ___

BATON ROUGE, La. (AP) — A new law preventing anyone 70 or older from running for constable or justice of the peace in Louisiana is facing stiff opposition — especially among the officials who are about to be banned from re-election because of their age. The mandatory retirement provision was signed into law in June with little fanfare. Now, however, the law is drawing fire as the deadline for filing to run in the November election approaches next week. Some of the court officials affected by the new law say they intend to run anyway, even though it says they are too old. “I’m 77 years of age, but I feel that I’m more qualified and capable of being a justice of the peace at this age than I was when I was elected 42 years ago,� said Lynwood Broussard, who represents a ward in Lafayette Parish in southcentral Louisiana. “I feel that the people in my district should decide if I’m capable or too old to represent them.� A law that sets a mandatory retirement age of 70 for constables and justices of the peace has been on the books since 2006. The law excluded anyone

Guillory says he sponsored the law on behalf of a constituent who said he represented the Louisiana Justice of the Peace and Constables Association. Guillory said the man raised concerns that the local officials are allowed to carry weapons under state law, while “in wheelchairs, some on oxygen tanks.� “That sounded pretty reasonable,� Guillory said. But the association denies any involvement in the bill. “Absolutely not. Put that in big huge bold letters and bold quotes. We did not ask for this and in no way wanted this,� said Connie Moore, a St. Tammany Parish justice of the peace and president of the association. The story gets murkier from there. Guillory said he doesn’t know the name of the person who requested the bill and can’t track him down because the man used a disposable phone to make the call. And while Moore said her association didn’t support the bill, no one from the organization raised
public objections as the measure was moving through the Legislature over the course of a month. Only one state lawmaker voted against the bill. But lawmakers now hit with criticism from local elected officials about to be ousted say they didn’t realize what the bill did, though its implications were explained during committee and floor hearings. Moore said several officials have said they intend to defy the law and run for re-election. “I’ve told them they really need to think carefully about that,� Moore said. One of those officials planning to sign up for reelection during the threeday qualifying period next week is Broussard, who hasn’t faced an opponent since 1979. “If they bring me to district court, I’m going to prove that that law that they passed is unconstitu-
tional. You cannot discriminate against us because of age,� he said. Guillory said he’ll introduce a bill next year to reverse the age restriction. But that will be too late for those pushed out of office. Others will be settling into their sixyear terms by that time. Even Guillory, who turned 70 about six weeks ago, doesn’t see a need for mandatory retirement ages. He said he thought he was doing a favor for the justice of the peace and constables association. Louisiana has a restriction in its state constitution that requires judges to retire after reaching age 70 and finishing their current terms, but that has been criticized as discriminatory. Voters in November will be considering whether to repeal that provision — during the same election that will dislodge scores of justices of the peace and constables at or older than 70.

(AP) — State lawmakers said Thursday they’re getting hit with complaints about wait times at Office of Motor Vehicles locations around Louisiana, and they’re asking for more details about the cause. Members of the Legislature’s joint budget committee want leaders of the agency to return at an upcoming meeting to explain why waits have spiked when people are getting driver’s licenses or dealing with vehicle titles and registrations. A report issued earlier this year by the nonpartisan Legislative Fiscal Office said wait times have shot up to as much as an hour and a half in some OMV locations as Gov. Bobby Jindal’s administration dropped staffing levels amid continuing budget cuts. Sen. Ed Murray, D-New Orleans, said he waited nearly four hours for service at his local motor vehicles office. “What is the problem?� Murray asked Staci Hoyt, OMV deputy assistant secretary, at the meeting on an unrelated budget matter. Hoyt said she’d have to look at the day Murray referenced to determine the problem, but Murray said people told him they faced similar wait times on other days. Rep. Kenny Havard, RJackson, said he’s gotten repeated phone calls about lengthy delays in his rural district. Hoyt said the agency moves staff around to alleviate lengthy waits at individual locations. We celebrate the Feast of Mary’s Assumption into heaven on August 15. This important feast supports the unity and wholeness of the human person. Sometimes we place Mary on a different, higher level of humanity than we enjoy. It is possible that we can think of her as living a more blessed kind of humanity. This is far from the reality. The truth is that every gift has a corresponding obligation. Do we have the gift of health? Then, we are the

strong who must help the weak. Did God give us a good mind? Then we need to develop our mental capacities to better our world. Did God give us the ability to be a good listener, to share the pain of others? We desperately need people with this gift. So it is with Mary. Everything she had was a gift from God. She did not have an easier life. God “arrayed her in gold” only in heaven, not on earth. Her holiness tells us that she worked hard at developing her gifts. The Assumption is God’s way of rewarding her perseverance for responding to the Divine Word and being generous and kind to others. Mary’s Assumption is also a promise that our bodies are destined for resurrection and life eternal. Heavenly happiness will be for her and for us a human happiness. This feast is an opportunity for us to examine our relationship to our bodies. We need to make sure that they are part of our personalities. Our bodies are a personal expression of our unique selves. They manifest who we are with all their peculiarities and problems. Bodies are good, not bad. Flesh is not evil. Sometimes in the Bible we get the impression that the flesh is evil and weak, but this is a misunderstanding. Generally the word “flesh” in Scripture refers to the unredeemed person. When Paul contrasts flesh and spirit, he is opposing

the life of the unredeemed with the life of the redeemed. The resurrection of Mary’s body and its consequent assumption into heaven is the Church’s affirmation that our bodies are good. This feast is a time to restate not only the need for respect for the human body, but also for the wholeness of the human person. “Holiness is wholeness,” says the great catechist and psychiatrist, Josef Goldbrunner. We are always trying to split the human person into parts. This may be fine for analysis, but we need to see the human person as one whole unit. To become more human, whole, holy, we must integrate our bodies into our spirituality. We must be sensuous. I distinguish sensuous from sensual. Sensual is primitive, instinctual, aggressive, possessive and domineering. Sensuous is sensitive, responsive, open, available, feeling, inclusive, caring. Mary was sensuous. She could hear God’s voice in a breeze, feel God’s love in Joseph’s embrace, smell God’s goodness in steaming bread. Like us Mary experienced pain and disappointment, simple joys and ecstatic moments, stillness and the busy noise of being the center of a family. Through all this, her flexible body completely expressed her purified soul. They were completely at one with each other, meant for each other for all eternity. We will be united, body and soul, in God’s family forever. In Mary’s Assumption, we see how God saves us. God saves people with bodies and souls. So bodies are to be respected. This demands that we take care of our bodies with enough sleep, exercise and healthy food. Mary’s Assumption is another proof of the love that God has for Mary and for all her children. Mary’s Assumption, body and soul, shows us God’s love and respect for human life and human bodies. Let us have that same respect for ourselves and others.

To solve the issue SLLD has recently negotiated a buyout with David Industries for $850,000, pending agreement of SLLD’s commissioners and a signed agreement between the shipyard owner and the levee district. At last Monday’s meeting, the SLLD board of commissioners agreed unanimously to its executive committee’s recommendation to buyout, voting 8-0 in favor. Lula Auenson was absent. The negotiated price is a “cheaper and better deal for the public” which will allow the wall to be run straight across instead of following the old path around the shipyard property, stated Curole. SLLD is also in the process of improving the area from the west end of the floodwall to the floodgate in Bayou Lafourche. An earthen levee has been installed at the intersection of Bayou Lafourche and the Intracoastal Waterway to a height of 13 feet. Hesco baskets will be used to connect the earthen levee and the floodwall to a 12-foot height. SLLD is in negotiation to buy and/or remove an abandoned building along the bayou side near Holy Rosary Catholic Church. “We are going to get an estimate of value of the building before moving forward,” said Curole. Next, sheet piles will be installed along the bayou to the floodgates, also to a 13foot height, he said. The final “puzzle piece” involves the Larose floodgates, which Curole says will be taken out, refurbished, and lengthened to a 13-foot height as well. Curole also mentioned that the Corps of Engineers has agreed to go ahead with raising the floodwall at the Mercer property where the wall crosses Delta Farms Road. USACE had halted the project about one year ago on advice of their attorneys, saying that going to a 13 foot elevation would change the scope of the project.

found wrong with the original amendment. “We took away some of the fees and penalties in the April proposal,” said Arnold. “We took out some things which other councilmen wanted out.” His earlier proposal called for vicious and dangerous animals to be annually licensed, with a yearly fee of $25, for any animal three months of age or older. That part of the amendment has been removed. But his amendment still calls for no owner to be allowed to breed any dangerous or vicious animal unless it has been registered and a permit obtained from Lafourche Parish Government. The permit fee is still $200 in Arnold’s latest proposal. Additionally, he wants all dangerous and vicious animals to have microchip identification and all tattoo numbers and chip identification numbers to be registered with police agencies in the parish. He also proposes that the ordinance should include defining a “dangerous animal” as any animal “which was previously declared dangerous by a court or complaint jurisdiction”, and any animal “which when unprovoked has killed, seriously bitten or otherwise caused severe injury to any human or animal on or off the property of the animal.” While Arnold was the only councilman to vote yes on his April amendment (Gouaux and Caillouet were absent), some councilmen who had expressed dissatisfaction with what they called vague wording and oppressive permit requirements may now be in favor of his measure. “We have no place in the world for vicious dogs. I truly believe that people need to be more responsible for their animals,” Phillip Gouaux is quoted as saying in a recent Daily Comet article. Lindell Toups also showed favor for the amendment.

Election day is November 4 and early voting is slated for October 21 through October 28, excluding Sunday. The three groups banded together and formed an organization and a board to manage the monumental task. “We all decide together,” says Arabie. “We really are a very cooperative group,” he adds. Every vote that has come before them… ”they have all been unanimous across the board, no matter what we we’re voting on,” he said with a keen sense of pride. Danny Mayet is a member of the board and agrees with Arabie. “Yup. All the votes have been unanimous…all of them,” Mayet states emphatically. “This is our premier fest and so far, things have gone smoothly as far as planning, decisions and cooperation amongst the board,” he added. La Fetes Des Vieux Temps will be held at the Tourist Center in Raceland at the junction of LA 1 and Highway 90. More than 25 craft booths will line the entrance to the existing pavilion already on the site, housing both bands and food booths. Arabie and his team secured a 100 x 60 foot tent to be erected parallel to the pavilion to hold additional food booths and tables for seating and eating. And boy, will there be plenty to eat! “We wanted to bring back all the great foods from our area’s festivals… the ones we all remembered and love,” Arabie says. “Fresh, made-at-the-fest cracklings, white beans and alligator sauce piquant,” he adds as he gazes upwards going over the list in his head before continuing, “shrimp, seafood of all kinds really…” Beverages will be plenty with beer and soft drinks surely on the list. One thing people from the Raceland area may be wondering about is the Fireman’s Punch Daiquiri served years ago at the Fireman’s Festival. “We got the recipe and we tried it out with a twogallon batch,” Arabie states. “After we all had a glass of the daiquiri, we knew we had to add it to

the festival’s offerings…that was another unanimous board decision,” he added with a chuckle. “We are going to call it ‘Bayou Water’ after we make it a little brown in color,” he says. The culture component isn’t lost amongst the multitudes of food and beverage offerings. “We will have a cane syrup machine, powered by a mule, and actually be making cane syrup over the 3-day festival,” says Arabie. “We will be milling and actually boiling the can juice right there next to the pavilion,” says Arabie as he points to the spot imagining the donkey-driven machine spinning and spinning. “We have nearly 800 jars ready to be filled and sold right here with fresh cane syrup that you can watch being made,” adds Mayet. Wooden boat building is a huge part of our community, culture and history. The Center for Traditional Louisiana Boat Building will be at the festival with various wooden boats, presentations and demonstrations. Members with the Bayou Lafourche Area Convention and Visitor’s Bureau will also be on hand to educate and assist with the culture component. The festival is literally being held in their backyard – you know all things Lafourche will be well represented! One thing the organiz-

ers are extremely proud of is the mass that will be held on Sunday, October 5th under the pavilion at 9 a.m. “We are thrilled about mass Sunday morning,” says Mayet. “We have a letter from the Bishop approving it,” adds Arabie. “Rain or shine, we are planning on having a great festival and a beautiful mass.” Planning and organizing a festival is a momentous task to say the least. Setting up the week prior, manning the booths and volunteering to tear down the week after is a whole other challenge. “Volunteers, auction items, setting up the booths, tearing down...we can always use more help,” says Arabie. “We are not doing this for monetary gain or to get rich by any means,” he says. “So any help is greatly appreciated.” “We want people to come out and enjoy all that we have here as we remember our past festivals and traditions and create some new ones,” he added. “We want everyone to come out and have a great time, from around here as well as from everywhere.” To get involved, volunteer, donate auction items or support the festival with a monetary donation, please call Terry Arabie at 985665-5005.

Whether you’re out in a boat, near a bayou, at the beach, or just hanging around the backyard ... when those summer thunderstorms come drifting along, it’s important to pay attention and to stay safe. Nearly 1,800 thunderstorms are going on at any given time somewhere around the world. That adds up to over 16 million a year! All thunderstorms generate lightning. And with that, each year, just in the U.S., about 400 people are struck by lightning. As a result of those incidents, an average of over 60 people are actually killed by lightning annually and many others are seriously injured, many being left with permanent disabilities. A flash of lightning can contain over a billion volts of electricity. This charged bolt of lightning is really hot, over 50,000 degrees F, more than five times hotter than the sun’s surface! The super-heated air surrounding a lightning bolt expands and contracts so rapidly that it creates the sound waves we hear as thunder. Some danger signs to look for that indicate a potential lightning-filled thunderstorm is approaching include dark, towering or threatening clouds, increasing wind, and distant lightning and thunder. As a thunderstorm approaches prepare to stay safe by: - Going inside a building or vehicle and closing the windows. - Staying away from water, plumbing, and anything connected to power, phone, and cable lines. - Staying low if you can’t find shelter; away from tall trees and open areas. - Squatting down in a low place with your hands over your ears; not lying down. - Staying away from water and metal or anything else that conducts electricity. - If in a boat, heading ashore, avoiding the thunderstorm if possible. (Boats unable to seek safety ashore should be properly grounded.) Here are a few “Myth Busters” concerning lightning compiled by NOAA and Sea Grant. MYTH: If it is not raining, then there is no danger from lightning. FACT: Lightning often strikes outside of heavy rain and may occur as far as 10 miles away from any rainfall. MYTH: The rubber soles of shoes or rubber tires on a car will protect you from being struck by lightning. FACT: Rubber-soled shoes and rubber tires provide NO protection from lightning. a hard-topped vehicle provides increased protection if you are not touching metal. MYTH: People struck by lightning carry an electrical charge and should not be touched. FACT: Victims of a lightning strike carry no electrical charge and should be attended to immediately. Apply first aid procedures if you are qualified to do so. Call 911 or send for help immediately.
MYTH: Lightning never strikes the same place twice. FACT: Lightning will strike several times in the same place in the course of one discharge. Remember ... when thunder roars, go indoors! The safest place to go is inside large enclosed buildings. Picnic shelters, sheds, and other smaller shelters don’t provide adequate protection from lightning
strikes. If there are no enclosed buildings around, the second best places to go are enclosed metal vehicles such cars, trucks, and vans — but not convertibles, softtops, and bikes. After the storm has passed, you should wait at least 30 minutes following the last thunder crack before going back out into the open.
