Cut Off woman charged with felony theft
Age limit on Louisiana officials on hold for now
In late July of 2013, deputies responded to a theft complaint at a Cut Off business on West Main Street where a female business owner reported an employee had stolen Tanya Callais money. The owner told deputies she had been contacted by the Internal Revenue Service about unpaid business taxes dating back to 2010. The owner said she had questioned the former employee, identified as Tanya Callais, 44, of 245 Willow D Street in Larose, and that Callais had initially advised that all records should be up to date. The next day, Callais admitted to the owner that the taxes had not been paid but provided no explanation as to why the money was no longer in the account. She also informed the owner she was quitting. The owner later met with the IRS and discovered business taxes and employee taxes had not been filed since 2010, resulting in thousands of dollars owed in back taxes and penalties. BATON ROUGE, La. (AP) — Louisiana court officials who face new age restrictions that could oust them from office were allowed to sign up for re-election bids this past week. A Baton Rouge judge issued a temporary restraining order Monday against enforcing a law that prohibits anyone 70 or older from running for justice of the peace or constable. District Judge Tim Kelley granted the request from the Louisiana Justice of the Peace and Constables Association, which says in a lawsuit the restriction amounts to unconstitutional age discrimination. A law establishing the mandatory retirement age of 70 for the court officials has been on the books since 2006, but it exempted anyone elected before Aug. 15 of that year. See Age Limit Page 5-A

As we enter the most critical portion of hurricane season, work continues on a multitude of improvements on the ring levee surrounding south Lafourche. At the Leon Theriot lock south of Golden Meadow, a sheet pile wall is being put in place to a height of 16 feet. This wall will match the height of the gates that were also recently raised to that level. Work on the $3 million project is expected to be complete in a few months. On the west side of Bayou Lafourche, from the Leon Theriot lock north to near the Apache dock in Golden Meadow, construction is ongoing to raise this levee segment from a height of 12 feet to approximately 16 feet. This work is slated to be completed by the end of the year. From Oakridge Park in Golden Meadow north to the Cote Blanche Connection roadway in Cut Off is the district’s largest ongoing project. Having begun over a year and a half ago, work on this segment will raise the levee from a height of 16 feet on the southern end and 13 feet on the northern end. According to levee district general manager Windell Curole, this $9.6 million project is scheduled to be completed by the end of 2014. Work is also ongoing on the west side on the levee segment from the Cote Blanche Connection
Erny announces candidacy for judge
to Louisiana Highway 24 in Larose. The levee here is being raised to 13 feet above sea level from a current height of 11 feet. This segment work is slated to continue into next year. Work on the Larose floodgates will be completed by the end of the first quarter in 2015. This includes raising the gates from a height of eight feet to 13 feet. These improvements will complement the work being done on the Intracoastal Canal floodwall where sheet piles are currently being installed to bring the wall to a height of 13 feet above sea level from its current height of seven feet. This $13 million project is slated for completion in a few weeks. On the east side of Bayou Lafourche, from Holy Rosary School to the Intracoastal Canal, sheet piles will be placed on the bayou batture will bring the flood protection there from a current height of eight feet to a height of 13 feet once work is completed. Improvements are also taking place on the levee segment from the Delta Farms area to near Clovelly. Ongoing work here will raise and improve the levee from a height of 10 feet to approximately 13 feet. This work is scheduled to be completed by the end of the year.

HOPE for Animals ‘hopes’ benefit raises much-needed funds Marc C. Kimball Contributing Writer
Located just outside of Thibodaux exists a sanctuary that Jada calls home. This is a safe place where she can rest, eat, swim and play in the fenced-in yard without fear or worry. She can stay as long as it takes to find her a loving family and home. This unique doggy-Eden is a no-kill kennel established by the local animal rescue organization known as HOPE for Animals. Jada has been at the kennel for 11 years now. HOPE for Animals’ ‘no-kill’ policy provides an alternative over the government-funded shelter which euthanizes animals after just five short days. Jada is alive today thanks to HOPE’s relentless determination to rescue and save as many stray and homeless animals as possible. Lafourche Parish has a surplus of stray and abandoned pets with limited funds and resources to adequately deal
with the problem responsibly and effectively. In 1994, two sisters teamed up and began the Humane Organization for the Protection and Education for Animals. Sisters Ruth Chiasson and Kathy Labat grew up on their family farm in St. Helena Parish. Years later, they married Cajun and moved to Lafourche Parish. Kathy was Central Lafourche High School’s nurse for years until her recent retirement. The sibling’s passion for our area runs deep as does their love of animals they developed as children on the farm. “Thousands of animals are put down every year in Lafourche,” says Chiasson. “There are so many homeless animals in our area. We knew we had to do something to help rescue as many as we could from the streets and from being euthanized,” she added. “The government shelter charges a fee to relinquish your pet,” she says. “Many pet owners who can no longer care for, or no longer want their pet, forgo the fee and shelter option and merely release their unwanted dog or cat into the community,” she said. The problem is compounded when pet owners neglect a pet’s basic medical needs and population controls. “We don’t have any mandatory laws here with reference to spaying and neutering,” says

Chiasson. “Ninety-five percent of the animals we rescue have heart worms and most are not spayed or neutered. We have a large stray population of unhealthy, abandoned pets that are reproducing exponentially,” she added. Labat has been working diligently with nokill shelters in the Northeast. Most of the shelters in that part of the country are empty. So the demand for adoptable pets is high. “We are working really hard to find a suitable transport company,” says Labat. “This way we can get our pets up there and adopted into loving homes,” she said. The 54th Annual Grand Isle Redfish Rodeo will be held Labor Day weekend, August 29, 30 and 31 at the Bridgeside Marina. Lions Club to collect eyeglasses for needy

The Golden Meadow Lions Club is seeking applicants who are in need of eyeglasses but are unable to afford them. The lawsuit alleges that State Farm makes customers believe they can’t choose where they get their vehicles repaired and directs people to repair shops that have agreements with the insurer to fix the car as cheaply as possible. The company provides false information to customers about non-participating repair facilities and incorrectly claims that customers will be forced to pay out of pocket, Caldwell said. Attorney general sues State Farm over auto repairs
BATON ROUGE, La. (AP) — Attorney General Buddy Caldwell filed a lawsuit Tuesday against State Farm, alleging Louisiana’s largest auto insurer is illegally steering customers involved in car accidents to repair shops that use junkyard parts and choose cheap fixes over safety. The lawsuit, filed in state district court in Baton Rouge, accused the insurance company of violating Louisiana’s unfair trade practices act with a systematic effort to lower its costs at the expense of its customers. Caldwell said his office’s investigation started in March after receiving complaints from around the state about shoddy repair work. He said his office has found hundreds of violations. “We rely on our insurance companies to guide and direct us and hold our hands through the stressful process of an auto accident. ... But as our investigation has uncovered and our petition alleges, what happens next is often not in the best

Caldwell said his office found similar problems across multiple insurance companies in the state but targeted State Farm because it covers so much of the automobile insurance market in Louisiana. “Other companies have a tendency to follow the leader,” he said. For people who have gotten their cars repaired after an accident, deBlieux recommended they get a post-repair inspection at a different, independent auto repair shop to check the work.

Police: Masked home invader fatally shot
NEW ORLEANS (AP) — New Orleans police say a wouldbe home invader was shot and killed by a homeowner. Police said in a news release that a 28-year-old man and his 36-year-old wife were on their backyard patio around 10 p.m. Wednesday when a 25year-old gunman, his face covered in a mask, walked up and demanded they give him money. They say the gunman ordered the couple into their home where the couple’s three children - ages 6, 13 and 14 - were inside. Detectives say at some point the husband was able to retrieve his gun and fatally shot the gunman, who was pronounced dead at the scene. The fatal home invasion happened in the Algiers section of New Orleans Police have not release the gunman’s name. ___
Volunteer fireman gets 5 years for arson
BATON ROUGE, La. (AP) — The Louisiana Department of Agriculture and Forestry says a former volunteer firefighter from Longville has been sentenced to five years at hard labor for setting wildfires in woods near his home town. Court documents show that Brandon Lee Harris was sentenced to five years on each of three counts of
arson, but the sentences will be served at the same time and with credit for time served. A department news release Wednesday says four years could be suspended. Harris was arrested in February after a monthlong investigation by the department and the Beauregard Parish District Attorney’s Office. According to the news release, Harris told investigators he set the fires to be paid as a volunteer firefighter and for the excitement of fighting fires. ___
Family Dollar rejects Dollar General offer
Family Dollar has rejected a takeover bid from dollar-store competitor Dollar General, saying it would be too hard for the deal to pass antitrust regulators. Family Dollar’s board said it supports its existing deal to be acquired by Dollar Tree. Family Dollar Stores Inc. Chairman and CEO Howard Levine said in a statement Thursday that its board and advisers reviewed Dollar General Corp.’s offer and determined it wasn’t reasonably likely to be completed on the terms proposed. Dollar General Chairman and CEO Rick Dreiling said in a statement that the company was disappointed in Family Dollar’s decision, and that it had done an extensive antitrust analysis that confirmed its proposal could be completed. Dollar General said it was willing to share its analysis with Family Dollar and that it was still confident it could resolve any regulatory concerns about competition. Dollar General said is reviewing its options and still believes its offer is better than the Dollar Tree deal. ___

NEW ORLEANS (AP) — A 12.4 percent jump in July winnings at Louisiana’s land casino kept the 21casino total about even with July 2013. Casinos took in about $213 million statewide, just $384,300 more than a year earlier. But the land casino’s winnings rose from $25.4 million to $28.5 million. Riverboat winnings fell 1.3 percent to $151.6 million and race track slots casinos fell 2.2 percent to $32.9 million. Revenues rose at four of the 14 riverboats. The Belle of Baton Rouge had the biggest increase: 10.7 percent, to $5.4 million. Revenues fell in Shreveport, Morgan City and Opelousas while rising in Lake Charles, New Orleans and Baton Rouge. Lake Charles’ total rose 4 percent to $64.4 million, including $34.9 million from L’Auberge Lake Charles. L’Auberge had 400,430 customers to the land casino’s 451,510. ___

SHREVEPORT, La. (AP) — Shreveport police say a 91year-old man was injured by two muggers who took some of his casino winnings, but the World War II veteran injured one of his attackers. Cpl. Marcus Hines tells KSLA-TV the attack took place shortly after midnight Wednesday, after the men followed the veteran into a restroom at the Eldorado

Judge rules against Jindal in Common Core lawsuit BATON ROUGE, La. (AP) — Gov. Bobby Jindal’s effort to derail Louisiana’s use of the Common Core education standards was halted Tuesday by a state judge who said the governor’s actions were harmful to parents, teachers and students. Judge Todd Hernandez lifted Jindal’s suspension of contracts the education department planned to use to buy testing material aligned with the multistate standards. The decision allows Education Superintendent John White to move ahead with Common Core-tied testing plans for public school students, until a full trial is held later over the legality of Jindal’s executive orders against the standards. In his written ruling, Hernandez said the Jindal administration didn’t produce any evidence to support the governor’s claims that White and the Board of Elementary and Secondary Education, or BESE, violated state contracting law. The contract suspension stalled standardized testing plans for students in third through eighth grade. Hernandez noted that fourth-grade students must pass a standardized test in order to be promoted to the next grade. “The loss of time is irreparable. With each passing day teachers and parents lose time preparing students for high stake testing, and there is a lot riding on the student’s successful performance on

It had received the faith in Roman times but since then, the pagan Anglo-Saxons had invaded and driven out most of the natives and the faith went with them. At this time, one of the radiant Christian centers was on Iona, a small island off the west coast of Scotland. It was from Iona that the Irish monk Cormac came to evangelize the English. He preached among them for some time without success and returned demoralized, saying that they were “a stubborn, uncivilized people.” Next, Iona sent Aidan, an apostle with a vision of a land transformed in Christ. From his torch of faith, England caught fire. Within

In Aidan time only people with money rode a horse. Aidan used to travel on foot so whenever he passed someone on the road he could turn and speak to them about the faith. One day King Oswin of Northumbria gave him an excellent horse. Soon afterward Aidan met a man begging for alms. He dismounted and gave the horse, complete with its royal trappings, to the beggar. He was given a chance to be a cut above the people, but he did not take advantage of it for very long. Maybe we need to follow Aidan’s example: climb off our high horses and get down to the level of the people so we can do the Lord’s work. Still, who among us can have faith for a whole nation as Aidan had? When our land is shrouded in darkness, what are we to do? Perhaps the prophet Habakkuk has the answer: “Then the Lord answered me and said: ‘Write the vi-

He spelt out for them what being dead to sin means. Let us examine ourselves by his standards: (Col. 3:5 - 4:5) You must kill everything in you that is earthly: sexual vice, impurity, uncontrolled passion, evil desires. You must especially kill greed, which is the same thing as worshiping a false God. You must give up excessive anger, hot temper, malice, abusive language and dirty talk. You must not lie to each other. You are to be clothed in heartfelt compassion, in generosity and humility, gentleness and patience. You are to bear with one another; forgive each other if one of you has a complaint against another. You are to let the Word of Christ, in all its richness, find a home with you. You are to have gratitude in your hearts as you join with the Church in the worship of God. Husbands and wives, you are to love one another and not be sharp with each other. Children, you are to be obedient to your parents always, because that is what will please the Lord. Parents, you are not to irritate your children, but encourage them or they will lose heart. Employers, you are to make sure that you give those who work for you what is fair and upright. Whatever your work is, you are to put your heart into it as done for the Lord. You are to be persevering in your prayers and be thankful always.

Detectives began investigating the case, and through investigation, they discovered evidence of multiple discrepancies in the records Callais had kept. Despite several thousand dollars missing from the business account, five checks were never paid to the IRS. After obtaining the evidence, detectives obtained a warrant for Callais’ arrest on five counts of felony theft. On Wednesday, August 20, Callais turned herself in at the Lafourche Parish Detention Center in Thibodaux. She was booked on the aforementioned warrants and subsequently released after posting $25,000 bond as had been set by Judge F. Hugh Larose. This investigation into the matter is continuing.

Work in the Clovelly area on that portion of levee was recently completed and consisted of raising that levee segment to 13 feet as well. One of the first completed projects on this round of improvements occurred on the east side section of levee between the Clovelly area and Breton Canal in Galliano. The levee here was raised from a height of 9 feet to a current height of 13 feet some two years ago. Approximately a year and a half of work remains on levee improvements on the section between Breton Canal and the Louisiana Land and Exploration (LL&E) area on the east side. This $4.6 million project will raise the segment of levee from 11 feet to 14 feet once completed. Legislation this year removed that exemption, a change that was slated to affect about 160 elected officials. Kelley’s order allowed anyone who was previously exempted to sign up for reelection during the Wednesday through Friday qualifying period for the Nov. 4 ballot. The judge also set an Aug. 29 hearing in the lawsuit to determine whether to continue a prohibition against enforcing the age restriction. The mandatory retirement provision, sponsored by state Sen. Elbert Guillory, breezed to easy passage with Louisiana lawmakers and was signed into law in June with little attention, but it’s unclear who was behind it. Guillory, a Republican from Opelousas, said he sponsored the measure for a constituent who said the justices of the peace and constables association wanted it. Guillory said the man raised concerns that the local officials are allowed to carry weapons under state law, while “in wheelchairs, some on oxygen tanks.” But the association denies any involvement in the bill and now is challenging it in court. Connie Moore, a St. Tammany Parish justice of the peace and president of the association, said her organization did not file the lawsuit just to prove it wasn’t involved in the legislation. “I’m assuming that people will see that we filed it, and I guess the ones that were skeptical might change their minds, but that’s not why we filed it,” she said Tuesday. “We filed it just to help out the JPs and the constables who were affected by it. Plus, we felt the timing was kind of poor, so close to the election.” Before the restraining order was issued, some of the court officials affected
by the law had said they intended to run for new sixyear terms anyway, even though they are too old to meet the law’s requirements. Since the age restriction has ballooned into a controversy, Guillory said he’ll introduce a bill next year to undo the mandatory retirement provision.

Hope rescues roughly 200 animals yearly. Their kennel can accommodate 25 or so dogs at a time. The remaining 175 is expertly cared for by foster families throughout the parish. “All of our rescues are fixed, de-wormed, micro chipped and get regular vet visits,” says Chiasson. And the medical costs can add up quickly! “Our expenses typically run between $8000 to $10000 monthly,” she said. Last month saw an abundance of heartworm treatments. “We had our most expensive month ever – $16,000,” says Chiasson. Hope for Animals is a not-for-profit 501(c)3 organization and is solely funded through donations, grants and fundraisers. Hope’s annual Bone Appetite fundraiser always gives the group’s bottom line a much-needed boost. The Bill signed into law by Governor Jindal addresses the issue of out-of-state physicians traveling with their sports teams. House Bill 1074, authored by Representative Lenar Whitney from Houma, will create an exemption from licensure for those individuals who are licensed to practice medicine in another state or country and allow them to attend to the acute care needs of the official traveling party of athletes and staff of an athletic team while the team is competing in Louisiana. This measure was spearheaded by the Louisiana Orthopaedic Association and had the support of the Louisiana State Board of Medical Examiners. House Bill 1074 was and is now designated as Act 535. Approximately 20 states have adopted this similar exemption. CLYDE ORGERON Clyde A. Orgeron, 85, a native of Clovelly Farms and longtime resident of Galliano passed away August 17, 2014. Visitation took place on Thursday, August 21, at Falgout Funeral Home in Galliano from 5:00 p.m. till 9:00 p.m. and on Friday August 22, at St. Joseph Catholic Church in Galliano from 9:00 a.m. till funeral time. Funeral Mass began at 11:00 a.m. at St. Joseph Catholic Church with burial at Holy Rosary Cemetery. Mr. Clyde is survived by his four daughters, Theresa Duet (Jonathan), Celeste Daigle (Mike), Mary Howard (Curtis), and Anne Dantin (Ched); grandchildren, Jace Duet (Aimee), Jennifer Duet, Michael, Chris, and Sam Daigle, Alexandra and Matthew Howard, Samantha, Zachary, and Claire Dantin, and great grandchildren, Olivia and Victoria Duet. He was preceded in death by his wife of 56 years Patsy Orgeron; parents, Augustin and Nola B. Orgeron; brothers, J.D. Orgeron and Lloyd “Buzzy” Orgeron, and sister, Noella Charitat. Mr. Clyde graduated from Cut Off High School then went on to graduate from Southwestern College with a degree in English. He then enlisted in the U.S. Army at Ft. Polk and attained the rank of Lieutenant where he met his beloved wife Patsy Davis. He was a teacher at LCO High School. He received his Master of Education from LSU and later became principal of Galliano Jr. High. He went on to become Assistant Superintendent in Lafourche Parish where he retired.

Mary Landrieu and her main Republican challenger, Congressman Bill Cassidy, traded jabs over leadership and effectiveness as they officially signed up on the opening day of qualifying for Louisiana’s November election. Landrieu, a Democrat deemed among the nation’s most vulnerable incumbents, talked Wednesday of her 18 years of seniority and her leadership of the Senate energy committee, saying Louisiana voters shouldn’t relinquish that clout. “It’s Louisiana’s clout. Let’s not give it up. It took us a long time to get to this point,� the three-term senator from New Orleans said, repeating the central theme of her campaign. Cassidy, a Baton Rouge doctor, described his effort as crucial to returning the U.S. Senate to GOP control, which he said more closely represents Louisiana’s views. He repeatedly linked Landrieu to President Barack Obama, who is highly unpopular in Louisiana. Cassidy also took a shot at Landrieu’s seniority, saying that hasn’t helped advance the Keystone XL pipeline, which Landrieu and Cassidy both support. “You can speak of clout, but frankly, you she should ask: Why haven’t you been effective?� Cassidy said after registering for the election at the Secretary of State’s Office. While Landrieu signed up, the Republican Party of Louisiana showed up with “Air Mary� signs, a dig at the scrutiny Landrieu has faced for billing private chartered planes to her Senate office when she used the flights to attend campaign fundraisers.

Feds look at La. dentists for ACT analysis: Scores same or slightly lower in La. kids on Medicaid JANET McCONNAUGHEY Associated Press
NEW ORLEANS (AP) — About 5 percent of the Louisiana dentists treating children under Medicaid may be padding their numbers, overcharging, providing unnecessary treatments or even harming children, according to a federal study released Wednesday. Auditors for the Department of Health and Human Services checked 512 dentists and 41 oral surgeons. Twenty-six dentists and one oral surgeon — paid a total of $12.4 million for pediatric dental work in 2012 — billed for extremely high numbers of children or amounts of money or showed other possible excesses, according to the report from department inspector general’s office. Some of the bills may be legitimate but they warrant scrutiny, said a copy of the report provided to The Associated Press before its general release. “Some of these cases are pretty alarming,� said Calder Lynch, chief of staff for Louisiana’s Department of Health and Hospitals. He cited doctors with high numbers of fillings and “baby root canals,� or pulpotomies. According to the report, one dentist billed for 31 procedures, including 13 pulpotomies, four fillings and 10 stainless steel crowns on one 3-year-old — all during the same visit. Lynch said he believes many of the dentists described in the audit are among more than 20 his department is already investigating. It recently hired a second dental technician to go over records and will check all 27 people as soon as the federal department sends their names, he said. Raudenbush, spokeswoman for the Office of Inspector General, said in an email. State Medicaid Director Ruth Kennedy wrote in a July 24 response included with the report that, as a result of the study, DHH hired Managed Care of North America on July 1. The company will manage dental benefits under Medicaid and the state’s Bayou Health program — an insurance-based model that covers 900,000 of Louisiana’s 1.4 million Medicaid recipients, mostly pregnant women and children. The report said the 512 dentists averaged $264 per child, but six billed for more than $663 per child. “These dentists received more than $2,000 per child for a total of 237 children,� and one was paid $8,000 for work done on one child over three visits, the report said. “Extremely high payments raise concerns about whether these dentists are billing for unnecessary services or services that they did not provide,� the auditors wrote. Overall, the dentists averaged 27 procedures such as cleaning, extraction or Xrays per day, but three billed Medicaid for 146 or more per day. One billed for 376 services in one day, the report said. “If this dentist spent only 5 minutes performing each service, it would have taken over 31 hours to complete all these services,� the auditors noted. The auditors also checked on specific procedures, such as extractions, fillings, stainless steel crowns and pulpotomies. On the average, the dentists pulled out teeth from 11 percent of the children they saw, but six dentists extracted teeth from at least 40 percent of the children and one did so on 70 percent of the children he treated. Dentists who filled teeth did so for one-third of the children, but one did so for 92 percent. The audit looked at Louisiana dentists and oral surgeons who billed Medicaid for at least 50 children in 2012. One-third of the dentists worked for two dental chains, it said. The report did not identify the chains. The DHHS report is the second in a series of state reports; the first found similar patterns in 23 of 719 dentists in New York State. That’s about 3.1 percent. The state reports are not being done in any particular order, Raudenbush wrote.

NEW ORLEANS (AP) — Average composite ACT scores for students in Louisiana were the same or slightly down from 2013 to 2014, depending on the way they were calculated, state officials said Wednesday, while also noting that more students are taking the college preparatory test and more are scoring well enough to qualify for state TOPS awards. Louisiana began requiring all public high school students to take the ACT test last year, regardless of whether they planned to attend college. ACT scores are now used in figuring accountability ratings for schools and school districts. The education department notes in its analysis that students can take the test more than once. When students’ best scores are considered, the state average score is 19.1, unchanged from 2013; when the “most recent� scores are averaged, the average is 19.2 for 2014, down from 19.5 in 2013. The department said it uses all public school seniors’ highest ACT scores in figuring school performance ratings. follows figures released earlier this year showing that more students are earning high- enough ACT scores to qualify for at least the minimum scholarship from the state TOPS program. The Department of Education said 26,805 earned at least a 17 on the ACT, compared to 25,073 in 2013. A 17 is the minimum score to qualify for a TOPS Tech award, which covers tuition at community and technical colleges. The number of students qualifying for various, more lucrative TOPS awards increased as well. For instance, 3,116 did well enough to qualify for TOPS Honors, a program paying tuition and fees plus $800 at any Louisiana public university. In 2013, the number qualifying for TOPS Honors was 2,938. Education Superintendent John White said providing all students access to the ACT free of charge has created new college and career training opportunities for students. â&#x20AC;&#x153;In providing all students access to these opportunities, we stopped cherry-picking students to take the ACT,â&#x20AC;? White said in an emailed statement. â&#x20AC;&#x153;At the same time, our studentsâ&#x20AC;&#x2122; readiness for the challenges of universities and community colleges is not at the level it needs to be, especially in mathematics. Our state needs to keep raising its expectations if we expect to compete.â&#x20AC;?
