NEW ORLEANS (AP) — BP wants a federal judge to order restitution — plus interest — of what it says are hundreds of millions of dollars in overpayments to some businesses that claimed losses due to the 2010 Gulf oil spill. In a Friday court filing, BP points to a revised policy for calculating losses that was approved by the court in May. The company says the court should order recalculation of awards paid prior to that change. Meanwhile, BP continues its legal fight on a related issue: whether businesses have to prove they were directly harmed by the spill to collect money. A district court and an appeals court have ruled that, under the settlement BP agreed to, proof of direct harm isn’t needed. BP has said it plans a Supreme Court appeal on that issue. While it has been unsuccessful so far on the causation issue, it did succeed in getting the method for calculating losses changed after arguing that the administrator of settlement claims wasn’t correctly matching business’s revenues and expenses. For instance, it cited a claim by a company that purchased inventory in early 2009 that wasn’t sold until months later. The claim, BP said, gave a false impression of inflated profits in those later months. See BP Page 5-A

COYC swim team honors one of their own tragically lost

Recreational swimming lasts only a few months a year – April through July. They practice and compete and they’re done. That hardly seems long enough time to form tight bonds and lasting friendships, but it happens. The Cut Off Youth Center Hurricane Swim Team formed these ever-lasting bonds of friendship and family because most have been swimming with the team their entire lives. The COYC Hurricanes are a family. It’s fully on display at each and every practice and meet. When Braxton Bourda, one of their veteran teammates was tragically lost on June 5, the group wanted to ensure he would not be forgotten this swim season, or ever. With only a week to go before their next swim meet, Holly Cheramie had an idea on how to memorialize Braxton and show the team’s unified support. “He [Braxton] was such a huge part of this team,” Cheramie said. “The kids looked up to him. We felt we had to honor him in some way.” Braxton was known for sporting his iconic yellow swim cap with a smiley face on it. He wore it at every practice and meet. It was his trademark. Cheramie’s idea was to outfit each COYC swimmer with “The Braxton Swim Cap”. It was an ambitious idea, one that Cheramie knew she could accomplish with help from her extended Hurricane family. She donated some money to the cause and asked other parents to do the same. Before long, the swim caps were paid for and ordered. “I asked the other parents if they wanted to

donate to the swim cap fund. It was something the coaches and the other parents believed in, so we made it happen”, said Cheramie. The team raised enough money to purchase 150 swim caps, one for every member of their team for the June 14 meet in Thibodaux. Fifty of the caps had the smiley face already printed on it. The remaining 100 were hand painted by Cheramie’s daughter and a few of her friends by hand. They arrived in Thibodaux for their first meet without Braxton, but each COYC member sporting his yellow, smiley-face swim caps. The Thibodaux team did the same thing! Andrea Cheramie-Stentz, a parent with the Thibodaux team, sprang into action and duplicated Cheramie’s idea. Thibodaux’s swim team had 88 plain yellow swim caps for each of their members – a sure sign of their support. Addie Eserman-Duet was amazed by the experience. “COYC and Thibodaux have an unspoken rivalry,” she said. “For these kids to come together for a cause is something to be celebrated,” she added. Erin Danos has been coaching the COYC Hurricanes since 2005 when Braxton was only 7 years old. “We are a family and are very close”, she says. “I watched him grow up. He was like a child to me…like one of my own kids,” adds Danos. “And to see the Thibodaux and Cut Off teams come together for support of Braxton like this is just great,” she added with a tearful smile. Scales for the rodeo open on Friday, July 4th, at 10:00 a.m. and close at 8:00 p.m. Food booths open at 11 a.m. On Saturday, scales open at 10:00 a.m. and close at 4:00 p.m. for the children’s division, at 5:00 p.m. for the scuba division, and at 6:00 p.m. for the hook and line and bow fishing divisions. Veterans tell La. lawmakers of health care delays MELINDA DESLATTE Associated Press

BATON ROUGE, La. (AP) — Louisiana’s veterans affairs secretary told state lawmakers Friday that he’s heard complaints for years about problems with veterans having trouble getting treatment in the federal VA hospitals and clinics around the state. David LaCerte said the state veterans department reported the complaints to the federal VA and its inspector general, but never saw any substantive response. “It seems as though we’ve come to a point in this country where those who have given the most are actually treated with the least amount of respect, and there’s something wrong with that,” said Rep. The new cutter is named for Cmdr. Raymond Evans, who was part of a rescue team that saved a group of Marines during fighting on the Pacific island of Guadalcanal in 1942. Evans, an apprentice seaman at the time, was awarded the Navy Cross. ___

Louisiana inshore shrimp season to close Thursday

BATON ROUGE, La. (AP) — State fisheries regulators say the 2014 spring inshore shrimp season in Louisiana will close at one-half hour after sunset on Thursday. The closure affects state inside waters extending from the Atchafalaya River Ship Channel at Eugene Island as delineated by the River Channel Buoy Line westward to the western shore of Freshwater Bayou Canal. Data collected by Department of Wildlife and Fisheries biologists indicate increased quantity, distribution and percentage of small, juvenile white shrimp taken in trawl samples within those waters. Child killed, others injured when truck hits house

GRAY, La. (AP) — State police say a 2-year-old girl was killed when a truck fleeing the scene of a hit-and-run accident crashed into her home in Gray last week. Trooper Evan Harrell says a pickup driven by 20year-old Tony Milligan, of Houma, was southbound on LA Hwy. 24 around 2:30 a.m. Friday when it ran into the back of a car. Harrell says investigators allege that Milligan drove down Hwy. 24, lost control and ran off the road — hitting a house and injuring three people inside. Harrell says the child, Taylor Strickland, was taken to a Thibodaux hospital where she later died. He says the child’s parents are in stable condition. Harrell says Milligan, who suffered minor injuries, was booked with vehicular homicide and other charges. ___

DWI Checkpoint scheduled for Thursday, July 3

Lafourche Parish Sheriff’s Office deputies will be conducting a DWI Checkpoint beginning during the evening hours of Thursday, July 3 in Lafourche Parish. During the DWI checkpoint, deputies will be looking for drivers who are possibly impaired while checking for other traffic safety issues. The checkpoint will begin Thursday night and end during the early morning hours of Friday, July 4. Motorists suspected of DWI who refuse to submit to a breathalyzer test will lose their driver’s license for one year (first offense). For a second offense, the penalty increases to two years. Anyone convicted of a DWI offense while their driver’s license is suspended because of another DWI offense will face automatic prison time. Lafourche Parish is also a “no refusal all the time” parish, meaning if a suspected drunk driver refuses a breathalyzer test, deputies will seek a search warrant to have that person’s blood tested.

Swim Team From 1-A

The Cut Off swim team is truly a family affair. At the SCSA Meet of Champions held on June 28 at the COYC, Braxton’s entire family, great-grandmother, grandmother and mother was at the pool volunteer-

ing and watching Braxton’s younger sister Quendon compete. They each wore Braxton’s trademark smiley face on a yellow t-shirt. Every member of the Hurricane family – swimmer, parent, grandparent and volunteer wore an identical t-shirt. It was another way the entire COYC Hurricane family was able to show their solidarity and support. Braxton’s great-grandmother Peggy Bagala understands the importance of family and swimming. She was on the first Board of Directors at the Cut Off Youth Center – they secured the funding to have the pool built. Bagala didn’t stop there and hasn’t slowed down since. She heads Les Reflection Du Bayou and last year started a free, week-long swimming class opened to anyone who wished to learn to swim. Bagala funds the program called “Gift of Life� solely through donations. “Many of our local kids graduate within a levee system and don’t know how to swim,� Bagala says. “Could you imagine if a school bus full of children went into the bayou? Each child on that bus should be able to swim.� The “Gift of Life� program was started last year with an idea that came through divine interven-

tion. “God kept telling me to do this. You can’t ignore God,â€? she added. This year’s program will take place July 28 and run the entire week. Participants receive instruction and education from swim instructors, the LA Department of Wildlife and Fisheries about boating and water safety, Windell Curole with the Levee District and much more. This year, participants will receive the trademark Braxton-smiley-face swim cap at the completion of the program. “Braxton loved the water and swimming. I just wanted to share that gift,â€? Bagala states. Braxton’s favorite event was the butterfly. His mother, Chelsie Hebert, could always be heard cheering her son on at every meet. “I would always yell ‘HURRY’ when he swam,â€? she said. While Braxton has a trademark swim cap, his mom has her trademark yell. “I would yell to him to hurry because he would never kick with his legs. He won his races using just his upper body,â€? she said with a chuckle. “He never used his legs, ever! And, he always won,â€? she added. On the back of everyone’s yellow t-shirt, ‘Fly High Braxton’ is emblazed referencing his love of the butterfly stroke. Assistant coach Meagan Danos never had a problem with his lack of leg kicking. “Inside these fences, in this pool, was a true representation of who he was as a person and as an athlete,â€? she said. “He always took swimming seriously.â€? On Sunday, June 29, the day after the Championship Meet, the Hurricane swim team partnered with New Life Counseling Center and offered a grief seminar at the COYC. Grief counseling isn’t all they do. The local non-profit funds itself through private donations and has been counseling residents and providing counseling resources to residents of South Lafourche for more than 15 years. Kristyn S. Carver, PhD, LCS, talked about the five stages of grief and how it affects people differently. “The hardest part about the grieving process is the uncertainty and changes in our normal routine,â€? she said. “It’s healthy for family members to talk together and know what each member is going through. Having a sense of community‌it helps with the grieving process.â€? The COYC Hurricanes certainly have that sense of community.

The comments came at a meeting of the House Special Committee on Military and Veterans Affairs, which was reviewing allegations that veterans in Louisiana, just like others around the nation, have faced long waits for health care services. Louisiana has three VA medical centers that provide inpatient care, in Alexandria, New Orleans and Shreveport, along with a dozen outpatient clinics around the state, for its more than 312,000 military veterans. Federal data released earlier this month showed the average wait for a new patient to get an appointment at one of Louisiana’s three major VA medical centers runs anywhere from 30 to 55 days. The average wait times were not the nation’s worst for new patients, but they exceeded the now-abandoned goal of 14 days set by the VA. LaCerte said 37 veterans died while lingering on a waiting list for care at the Overton Brooks VA Medical Center in Shreveport. “We have a system today that has forced veterans to quit or to give up,� said Douglas Ducote, who retired from the U.S. Army in 2004 and founded a group called Veterans United for Justice. VA officials refused to attend the state legislative meeting. At LaCerte’s urging, the committee agreed to seek to issue a subpoena to the federal veterans affairs officials, to try to compel their attendance at a future hearing. “VA has shown an unwillingness to honestly address the problems that’s plaguing our veterans and their health care system today,� said LaCerte. Rep. Nick Lorusso, RNew Orleans, chairman of the committee, said the logistics of how to send the subpoena remained to be worked out. He acknowledged it wasn’t certain to get anyone from the VA to testify. A call to the U.S. Department of Veterans Affairs wasn’t immediately returned Friday. The committee heard from veterans who described lengthy waits to book appointments, to get prescriptions filled and to see doctors. They talked of health conditions worsened because of delays and fellow veterans who contemplated suicide because of an inability to get treatment. “If you’re looking for care in this state, you’re not getting it. You’re getting the runaround,� said Richard O’Brien, a Baton Rouge vet-

eran with the Military Order of the Purple Heart of Louisiana. Lawmakers pushed LaCerte to offer ideas for ways the state could improve health care for its veterans. But LaCerte said the fix must come from federal officials because the VA is charged with veterans’ primary care. He urged pressure on federal officials.

Letting the awards stand would be unfair to other claimants whose awards were calculated at a different time, he said. Plaintiffs’ attorneys had a different view. “This is just another attempt by BP to back out of the commitment it made to the Gulf. cording to an independent trust agreement that BP coauthored and agreed to.� The Deepwater Horizon rig at BP’s Macondo well off the Louisiana coast blew out in April 2010, killing 11 workers and spewing oil into the Gulf for nearly three months. A settlement of business economic loss claims following the spill was hailed both sides when it reached in 2012, but BP later said the claims administrator was misinterpreting the agreement, leading to the disputes over what caused damages and how payments should be calculated.

Claws For Alarm

After a day fishing in the ocean a fisherman is walking from the pier carrying two lobsters in a bucket. He is approached by the Game Warden who asks him for his fishing license. The fisherman says to the warden, “I did not catch these lobsters, they are my pets. Everyday I come down to the water and whistle and these lobster jump out and I take them for a walk only to return them at the end of

the day.” The warden, not believing him, reminds him that it is illegal to fish without a license. The fisherman turns to the warden and says, “If you don’t believe me then watch,” as he throws the lobsters back into the water. The warden says, “Now whistle to your lobsters and show me that they will come out of the water.” The fisherman turns to the warden and says, “What lobsters?”

Sealed proposals will be received at Town of Grand Isle, P.O. Box 200, 170 Ludwig Lane, Grand Isle, Louisiana, by the Town of Grand Isle for cutting grass on Town of Grand Isle owned properties on a regular basis. Bids will be received until 3:00 p.m. local time at the Grand Isle Town Hall located at 170 Ludwig Lane, Grand Isle, Louisiana and opened on the same day at 6:00 p.m. at the Grand Isle Metroplex Center located at 3101 Louisiana Highway One on July 08, 2014 at which time the proposals will be publicly opened and read aloud. Any bids received after closing time will be returned unopened. Bid packets are on file and may be acquired at the Grand Isle Town Hall at 170 Ludwig Lane, Grand Isle, LA. Contractors are required to have a valid occupational license and to have adequate liability and workman compensation insurance. No bid may be withdrawn for at least 30 days after scheduled closing time for receipt of bids. The Town of Grand Isle reserves the right to accept or reject any and all bids, in whole or in part, and to waive informalities thereto. 6/18/14 6/25/14 7/2/14
