Study: Louisiana’s complex tax code, high tax rates make it less competitive
Louisiana is again revising its Industrial Tax Exemption Program W (ITEP) to clarify who grants exemptions and how much sway local governments should have in the process. But the whole nettlesome discussion underscores one of Louisiana’s biggest economic problems – a complex tax code aggravated by some of the nation’s highest tax rates, according to the Tax Foundation’s 2019 State Business Tax Climate Index. The Tax Foundation, an independent 81-yearold tax policy research organization based in Washington, D.C., ranked Louisiana’s business climate 44th among the 50 states for the third year in a row. The Lafourche Parish Council has gone against its usual actions and ratified the appointments of two new government members, one an administrative appointee. On Tuesday, October 9, the council voted to fill the vacancy of the Council District 5 seat formerly held by James Bourgeois with that of Nicholls Police Chief Craig Jaccuzzo. Bourgeois lost his seat in September after being convicted of filing false public records. According to his extensive resume, Jacuzzo is a native of Bayou Blue and has over 29 years of experience in law enforce-
ment. He has been Nicholls chief since 2004. “I promise I will give it my best. I will work as hard as I can. I know District 5 needs it. We need stability and representatives that are here,” said Jaccuzzo. Jaccuzzo was asked why he would prefer to serve in an interim appointee rather than waiting to run in 2019. “I think there are individuals who have probably committed to this (the election); there are individuals who want to do this. I will be able to provide the stability and insight for them, to help those individuals. For me to seek a public office, in my profession, I kind of just want to do my community service in this role. I’m not really concerned about election to it,” he said. See Council Page 3-A

Windell Curole, South Lafourche Levee District (SLLD) General Manager, is last year’s $3.1 million judgment against the levee district over appropriated land value. “That money, by the will and vote of the people, was supposed to be used for flood protection. Instead it went to pay for what two judges said was the value of their (landowner’s) land,” he said. What’s maddening, he continued, is the fact that $500,000 of the judgment was pocketed by lawyers who went back to New Orleans where they are protected by a levee which they didn’t have to pay a penny to live behind. “I stay awake nights thinking about that fact alone,” he said. Lately, Curole is fighting to avoid what he calls “wasting” tax money not only on legal battles but on other newfound struggles. SLLD is in the midst of a battle over what his board’s mandate is— flood protection as opposed to drainage protection. “When we first started, the parish would do drainage, and we would do flood protection,” said Curole. The Corps of Engineers built the levees and SLLD maintained them. But when the parish was not willing to build new pump stations, SLLD built them with the understanding that upon completion they would be turned over to the parish. See SLLD Page 6-A

6th annnual Savor the Flavor contest announced
The Bayou Lafourche Folklife and Heritage Museum will sponsor its 6th Annual Savor the Flavor contest which will pit area chefs against one another on Saturday, October 27, from 6:30–9:30 p.m. The event will be held at the St. Hilary Multipurpose Building at 333 Twin Oaks Drive, in Raceland. This is a new venue for the event. The contest will determine who among the chef contestants deserve bragging rights to the title of Best Chef of Savor the Flavor Cook Off 2018. Tickets are on sale now at the museum for $20 per ticket for general seating or $30 per ticket for reserved seating for tables of 6 or more. Shortly after 4:00 a.m. Wednesday morning, Troop C responded to a two-vehicle fatality crash on LA 1 near the Lefort Bypass Road. The crash took the life of 23year-old Brian Jones of Thibodaux. The preliminary investigation revealed Jones was traveling south on LA 1 in a 2002 Chevrolet Silverado, when for unknown reasons, he crossed the center line and struck a 2017 Dodge Journey that was traveling north on LA 1. The Journey was being driven by 25-yearold Brooke Ogwynne of Gheens. Jones was not wearing his seat belt and suffered fatal injuries as a result of the crash. He was pronounced deceased on scene by the Lafourche Parish Coroner’s Office. Ogwynne was wearing her seat belt and suffered critical injuries. She was transported to the Thibodaux Regional Medical Center by Acadian Ambulance Service and later was flown to University Medical Center in New Orleans by Acadian Ambulance Air Med. Impairment is unknown as a factor in this
crash. A standard toxicology report is pending on the part of Jones through the Lafourche Parish Coroner’s Office. A blood sample was obtained from Ogwynne and the toxicology results are pending through the Louisiana State Police Crime Lab.

When asked about any conflict between service on the Council and service as a state employee as Police Chief, Jaccuzzo said that the roles are different levels of government and he can participate in both levels. He listed his concerns going forward. He said Bayou Blue has developed massive subdivisions, causing traffic and drainage problems. Pumping stations are needed to move water from Hollywood Canal to the Company Canal and the Intracoastal Waterway, he said. Low water pressure is also a problem in the area, causing fire protection issues. “I think we can do more with less. When we do that, we become the practitioners of our profession,” he concluded. Jaccuzzo was appointed unanimously. The other appointee, Parish President Jimmy Cantrelle’s latest nominee for Finance Director, is longtime finance department employee Connie Duet. In her 41-year career with the parish, Duet has been everything from Purchasing Agent to Personnel Director to budget preparer. She has worked in Finance for the last 18 years, she said. Her resume lists expertise in Governmental Accounting, auditing and strategic budgeting. In light of her moving from a civil service position to an administrative position and the tentativeness of the Finance Director position, Duet said she has taken a leave of absence from civil service until the end of 2019. Councilman Daniel Lorraine asked Duet if
she worked on the latest budget. “Yes sir, it was me and Carol (Hymel) who completed the budget,” she said. Councilman Jerry Lafont said he would vote for Duet, despite believing that others control that office. Cantrelle said she is “unapproachable in her honesty. I really think she will do a great job.” The vote for her appointment was also unanimous.

The ten best states in this year’s Index are: Wyoming, Alaska, South Dakota, Florida, Montana, New Hampshire, Oregon, Utah, Nevada and Indiana. The ten lowestranked, or worst, states in this year’s Index are: Vermont, Ohio, Minnesota, Louisiana, Iowa, Arkansas, Connecticut, New York, California, New Jersey. These states “tend to have a number of afflictions in common: complex, non-neutral taxes with comparatively high rates,” according to the Tax Foundation. Louisiana ranked fourth in Unemployment Insurance tax rates, 32nd in individual and property tax rates, 36th in corporate tax rates and 50th in sales tax rates. Louisiana assured retaining its last place sales tax rating, despite being .01 less than Tennessee’s 9.46 rate, when the legislature agreed in June to extend .45 percent of an expiring penny sales tax to gen-
erate a projected $463 million in annual supplemental revenues necessary to balance its fiscal year 2019 budget. “While the state rate declined from 5 to 4.45 percent, Louisiana’s combined average state and local sales tax rate remains the second highest in the nation at 9.45 percent, and its exceedingly complex and uncompetitive sales tax structure is still ranked worst in the nation on the sales tax component of the Index,” the report states. Louisiana’s income tax structure, ranked 21st in 2016 and 2017, 22nd in 2018 and 32nd in 2019, dropped 10 places this year because other states have simplified individual tax codes while the state retains its three brackets: 2 percent for first $12,500; 4 percent for $12,500 to $50,000; 6 percent for $50,000 and over. The good news, the Tax Foundation maintains, is Louisiana does not have a “marriage penalty,” or impose taxes on capital income, on interest, dividends and capital gains. Louisiana’s corporate tax rate structure is ranked by the Tax Foundation as 36th for the third consecutive year. The state has five brackets: 4 percent for a business’s first $25,000 in income; 5 percent for $25,000 to $50,000; 6 percent for $50,000 to $100,000; 7 percent for $100,000 to $200,000; 8 percent for income above $200,000. Bracketed tax structures do not help a state’s economy, the Tax Foundation maintains, noting Louisiana is one of 21 states that do not have a single-rate system. “A corporate income tax system creates changes in behavior when the taxpayer’s income reaches the end of

one tax rate bracket and moves into a higher bracket,” the report states. “At such a break point, incentives change, and as a result, numerous rate changes are more economically harmful than a singlerate structure.” Louisiana offers an array of incentives for businesses, including job, research and development and investment credits, including the ITEP. The Tax Foundation has a dim view of such incentives, noting Louisiana is among states that use them to “cover for a bad business tax climate.” “Policymakers create these deals under the banner of job creation and economic development, but the truth is that if a state needs to offer such packages, it is most likely covering for a bad business tax climate,” the report states. “Economic development and job creation on tax credits complicate the tax system, narrow the tax base, drive up tax rates for companies that do not qualify, distort the free market, and often fail to achieve economic growth.” Louisiana’s ITEP was created “under the banner of job creation and economic development” in 1936 to encourage manufacturers

to expand or build facilities in the state. The property tax exemption is administered by the Louisiana Department of Economic Development (LED). Granted at the state level by the LED, recipients received 100-percent property tax exemptions on capital expenditures for 10 years. In 2016, Gov. John Bel Edwards issued two executive orders that made local approval a prerequisite to applying to the LED for an exemption, reduced the number of years and percentage of exemptions, and established a job creation component. This year, LED reinstated much of the old ITE program, restoring the exemptions’ 10-year span, but only at 80 percent of its property tax liability, and regaining initial approval authority. Local governments are provided an “up or down” vote on any LEDapproved project. The Louisiana Board of Commerce and Industry (LBCI) approved the first batch of ITEP exemptions under the new rules on Aug. 29. The Louisiana Tax Commission on Sept. 19 followed through by approving new rules for reporting exempt property under the revamped ITEP. LBCI’s new rules

allow local taxing jurisdictions to begin collecting tax revenue immediately on projects granted tax exemptions. Previously, local governments saw no tax revenue until exemptions expired. The tax commission’s new rules also require parish tax assessors to track the estimated property tax revenues they would have received without the exemption. Now, the Louisiana Board of Commerce and Industry can hold companies accountable by tracking job and payroll creation or retention. ITEP supporters say the program is part of a state’s tool box in attracting manufacturers and industry to Louisiana. As the Tax Foundation report cites, the sheer complexity of the state’s “exceedingly complex and uncompetitive sales tax structure” is its biggest flaw, even with revisions such as those recently made with the ITEP. “The evidence shows that states with the best tax systems will be the most competitive at attracting new businesses and most effective at generating economic and employment growth,” the report states.

Woman sought for stealing over $5,000 in merchandise from local store
A reward is being offered for information leading to the arrest of a suspect wanted for stealing over $5,000 of merchandise from a Cut Off department store. Shortly after 1:30 p.m. on Monday, October 8, deputies responded to a department store in Cut Off in reference to a theft. In reviewing surveillance footage, deputies learned a woman had attempted to pay for over $5,000 of merchandise and a $300 gift card using a credit card which was denied. At one point, she distracted the cashier and left the store with the merchandise without paying for it. Deputies have also learned the woman later used the gift card at a Baton Rouge store location. Anyone who can identify the suspect, or anyone who may have any other information on this case, is asked to submit a tip anonymously through Crime Stoppers Bayou Region by phone at 1-800-7437433 or online at www.crimestoppersbr.or g. What a Life!
By: Rev. Wilmer L. Todd Knowing the 10 stages of grief will help us when we lose someone close to us
When we lose someone close to us, we experience various stages of grief. Dr. Elisabeth Kübler-Ross described five stages of grief. Today, knowledgeable hospice workers have expanded them to 10. We should not look upon these 10 stages as a series of steps to go through one at a time, but more like a spiral staircase that goes up and down. Here are the 10 stages: 1. Shock. A sense of numbness characterizes this stage. To protect ourselves from the overpowering painful experience, we may shut down our emotional responses. This gives us the time we need to process the pain so that we can learn to understand and ultimately accept it in smaller doses. A sense of disbelief or denial often accompanies this stage. 2. Emotional Release. After being emotionally detached, we may feel a flood of pentup emotions that we need to express and release once we begin to realize the full extent of our loss. These emotions are often extremely powerful. Fear, despair and anger are commonly associated with this stage. Being overly sensitive and venting our emotions are also typical reactions in this stage of the grieving process. 3. Depression and Isolation. The surge of emotions eventually flows into a deep depression and an overall feeling of loneliness, helplessness and isolation. People typically feel the need to be around

others for support while also wanting to be alone, which creates confusion. The confusion often triggers a despair that envelops the grieving person. People may become extremely withdrawn during this stage. 4. Physical Illness. Emotional pain puts excess stress on the body. This stress weakens the immune system that can lead to illness. People who are grieving may experience physical pain, nausea and fatigue. Normal sleep patterns may also be affected, resulting in insomnia or excessive sleeping due to exhaustion. 5. Panic and Anxiety. Feelings of anxiety often accompany upcoming social situations after a loss. Trying to make sense of the loss can cause stress. We may feel abandoned, and the anxiety can lead to feelings of instability. These feelings are a normal part of the grieving process. 6. Anger and Hostility. When we experience pain, we may want to lash out at the people around us. We might blame those around us for causing the pain, and we may feel guilty for these outbursts of rage. The best course of action is acknowledging the anger. 7. Guilt. We commonly experience guilt when grieving. Focusing on negative memories and how our personal flaws affected that relationship will not change the situation. We may feel better after telling someone else about these thoughts and experiences. 8. Difficulty Resuming Normal Routines. A difficult aspect of healing is returning to our everyday life. If we are grieving, a song or scent can bring back painful memories, triggering a potential relapse in the recovery cycle. It can take a long time to transition into a normal routine because we have changed because of the experiences we have gone through.

to feel strengthened and renewed because of our experiences. The process has revitalized our energy and our sense of self is restored after accepting our transformed identity.
$10 million later, the pumps were completed. $3 million of that came from SLLD; money which Curole says was taken away from protecting people from tidal flooding and used instead to improve drainage. “At that point, we would have then turned the pumps over to the parish. But people came to the levee district and said ‘Don’t do that, because it won’t be done right’.” At that time, the parish’s antiquated system of part-time pumpers and sometimes-manned pump stations during crises was the problem, said many constituents. So, SLLD kept the pumps and spent money hiring full time employees to run them, to maintain them and to control vegetation in the borrow canal. “That’s money that out taxpayers gave us. We have a legal right to spend it on these things, but that’s not what our goal or our main job is. It’s not drainage. The parish collects a tax for drainage. So we sat down and they agreed that at least since the parish pays fuel throughout the rest of the parish, at least continue to pay ours, and they continued to do that.” Golden Meadow councilman Daniel Lorraine explained it at a recent parish council meeting. “Lafourche residents throughout the parish pay 3.34 mills just for drainage. That equates to about $600,000 per mill. You do the math. And half of it comes from the lower half of the parish.”
Lorraine says that government paying for fuel has been a verbal agreement between the parish and the levee district “since the beginning“. “They should at least get their fair share, not half, but their fair share. It’s a sweet deal for the parish,” says Lorraine. Lorraine also noted that SLLD is in the midst of a pump upgrade and repair program which has cost an additional $2 million. SLLD consumes about 300,000 gallons of diesel fuel a year at six pump stations. In comparison, the parish spends about $60,000 in pumping costs above the Intracoastal Waterway per inch of rain. Curole pointed out how much money the parish is saving by having manned, state-ofthe-art pump stations in the south. “We did a study. Our pump stations outpumped the parish’s old pumps by 5 times. And we could pump out using between a third to a quarter of the fuel the parish used to pump out the levee system. We had water out in three days; they could do it in two weeks. We’re paying a ton of money for pump stations; at least they could pay the fuel.” Parish government pays not only for fuel but for the employees, equipment, construction and maintenance of the all pumps north of the Intracoastal Waterway. Recently, Parish President Jimmy Cantrelle wanted to replace the gentleman’s agreement about paying pump station fuel costs for SLLD with a written and signed Memorandum of Understanding between the levee dis-
trict and the parish. But one of the stipulations of the agreement was that the parish could withdraw from footing the bill for SLLD’s fuel anytime it wanted to do so. SLLD said “no” to that agreement. SLLD wants either the same deal that the North Lafourche Levee District gets or, at least, as long as a tax is collected parish wide for drainage, the parish should pay for fuel used at its pumps. To date the agreement has not been signed. The parish continues to pay for fuel. “Here’s the important thing to remember,” says Curole. “This fuel is not going to the levee district. It’s going to help the people. We as a district gain nothing. It’s not for us,” says Curole. “They want to get rid of the last little bit of involvement, but they still collect all the taxes for drainage.” Curole says the Yankee Canal Levee is another example of SLLD using levee district tax money to do the parish’s drainage work. “Because they didn’t do a good job of maintaining the Yankee Canal levee, one of their drainage levees, we took over Yankee Canal, because they were about to flood everybody else.” The parish did pay for the Yankee Canal levee repair, about $164,000, but now SLLD has adopted a “drainage” levee which is inside the hurricane protection system. Amid these “battles”, Lafourche Drainage District No.1 (DD1) stepped in to help, offering $100,000 to SLLD for maintenance, operations and repairs costs of the pumps and pump sta-
tions. Cantrelle says he was involved in DD1’s agreement to donate the money, but he says half that money should have been stipulated for fuel costs and the other half for maintenance. “We used the entire $100,000 on maintenance, but Jimmy says ‘no’, we were supposed to do $50,000 on fuel and $50,000 on maintenance,” says Curole. Curole says he has a different signed agreement with the DD1 allowing SLLD to use all the money for maintenance, which is not the same as the motion that DD1 passed designating the 50/50 split. “Nevertheless, we agree that the DD1 donation is 50/50. But I’m telling you, we are not going to take their money to pay for fuel,” says Curole. SLLD moved at their October 8th public meeting to return $50,000 to DD1. SLLD’s next battle will most likely be with the Coastal Protection and Restoration Association (CPRA), who promised a $5,000,000 grant for work around the Larose Floodgate. CPRA is now withholding that money because of Corps of Engineers’ interference and SLLD will be forced to significantly modify its plans. Curole compares the struggles of SLLD to someone “playing in a ballgame in which when you win, nobody knows the score. Nobody takes a picture of a guy cutting grass and says ‘look at the flood that didn’t happen.’ But when you lose, everybody knows and can’t stop talking about it and hates you for the rest of their lives.”
