Lasting Powers of Attorney for Property & Financial Affairs
Clients often ask me whether they need Powers of Attorney and if so which type. Carrying on with last month’s theme I thought I would use the next two of editions of the Pinfold to Hannah Elizabeth Bell LLB Director explore what the different Photo: Powder & Paint Photography types of Powers of Attorney are and how they can benefit you. The first type of Power of Attorney- for Property & Financial Affairs- is a must for everyone but particularly for those of us who are more senior in years. Creating this type of Power of Attorney allows you to appoint your chosen representative(s) to manage your property and financial affairs for you, both when you retain the ability to do this yourself but also when you loose mental capacity.
Most take comfort in the fact that their Attorney(s) will be able to manage things for them when they are no longer able to do so but some are uncomfortable that their Attorney(s) may be able to ‘take over’ before they are ready. To alleviate this fear you can place a restriction in your Power of Attorney to prevent your Attorney(s) from acting until you have lost mental capacity but this needs careful consideration.
Once an Attorney is appointed under a Property & Financial Affairs Power of Attorney, unless the provisions of the Power of Attorney restrict them, they can start acting straight away. That means that they can manage your bank accounts, make investments and sell your property with immediate effect. However, Attorney(s) cannot simply do what they like they must comply with the Mental Capacity Act 2005. This means that before acting they have to consult with you and follow your instructions while you are still able to make decisions yourself. Similarly, when you are no longer able to make decisions for yourself your Attorney(s) are under a duty to act in your best interests when making decisions. Restricting when your Attorney(s) can act for you can reduce flexibility- the classic example being hospitalisation. If you retain mental capacity but are immobilised and cannot get to the bank to pay the
bills, with an unrestricted Power of Attorney your Attorney(s) can stand in your shoes and manage your finances for you. When Attorney(s) are restricted and cannot act unless you lose mental capacity they would not be able to manage your finances for you when you are physically unable to do so.
Having a flexible Power of Attorney is preferable but enabling flexibility is dependent upon individual circumstances and importantly whom you are appointing as your Attorney(s). Essentially appointing creating a Power of Attorney requires a deep level of trust between the person making the Power of Attorney and their appointed Attorney(s).

Well the one thing I can never be sure to guarantee when I arrange your holiday, is sunshine. But I knew the chances of blue skies were pretty high when I jetted off last month to the United Arab Emirates which boasts year round sunshine. Just over seven hours flying time from the UK, the glittering Middle Eastern Emirate of Dubai is culturally diverse where age old influences merge with the ultramodern in this cosmopolitan metropolis. From here we took a swift taxi transfer to Abu Dhabi which found us in our hotel, and more importantly glorious temperatures, less than 10 hours later. We stayed just outside of the city as it allowed us to be by the beach. Taxis are inexpensive and plentiful here in the UAE, so our first day was all about settling in. Rather than spending a full day taking a hop on – hop off style tour we decided to view the sights independently as we only had two nights there. First stop was the simply stunning Grand Mosque. Ladies must be covered head to toe so the Mosque provides a complimentary Abaya for you to change into to go inside the Mosque. For the children, we swung by the beach before heading to the Heritage Village - an open museum providing an insight into the Emirate’s past. Here craftsman showcase their skills such as pottery, wood carving and
glass blowing.Also a must see was the nearby Corniche area which is a fabulous place to stroll or from which to dip your toe in the warm waters of the Arabian Gulf. Plus, if you have young children, there are play parks and green areas frequently dotted around too. We then take an hour’s transfer back to the beach area of Dubai and Jumeirah Beach Walk – an up market promenade of restaurants and shops set back from the beach – a perfect spot to sit and watch the world go by as you recharge your batteries before choosing your next activity. For beach lovers this is the place to stay, it’s easy to get around here by taxi and the metro is exceptionally clean and efficient to downtown Dubai for more shopping, restaurants and the Burj Kalifa standing 828 meters tall – the highest in the World. You can dine here and enjoy a huge range of International cuisine at a very reasonable price as you view the exceptional water fountain display. During our stay, we also managed to enjoy a desert safari, ice skating plus spent a full day at the water park and still feel we could go back and fill a week with things we didn’t experience. Dubai offers something for everyone and makes a great destination for a family holiday. See you next month,

Saturday 20th July… Originally in my diary as the date I was setting off on holiday, but after a phone call with Louise (the bride’s mum) and then meeting up with her to find out more about Katie & James’s Wedding I pushed it back a day! It was definitely worth it! After listening to Louise describe the wedding that Katie & James were planning I was instantly excited. They were getting married at Woodland Church just a few miles away from their family home. Then onto the reception also know as “Katie’s Barn” which was just a short walk across the fields. Everything was carefully planned by Katie & her Mum in the months that followed . With just a few weeks to go until the wedding I met Katie & James and we did a Pre Wedding Shoot in the family garden and barn. It was a red hot sunny afternoon and we hoped that the weather would last a few more weeks! Saturday 20th July crept up fast and with the sun still bright in the sky I met James at the Church. As Katie & James went to sign the register two of their friends sang to all the guests. It was beautiful and as I looked around everyone was mesmerised. Welcome to Katie’s Barn….and the perfect wedding reception! Doesn’t it look impressive! Inside the barn was magical, with so many little details and touches!

With fields and stunning views all around the barn we weren’t short of space to take some family & friend photos! I remember when I met up with Katie & James for their Pre Wedding shoot and to talk about their photographs and they both said they didn’t really like having their photograph taken…. Well I hope your photos have made you change your mind! I’m so glad I was able to photograph Katie & James Day. ‘Appy Ever After
Apps are helping more and more people to plan their weddings. Smartphones and tablets have revolutionised how we do things and see things, and apps drive the trend. Over 102 billion were downloaded worldwide last year, more than doubling the 2012 figure. If you are between 16 and 34 in the UK, then over 80% of you own a smartphone and use apps. There are lots of apps out there that can help in your wedding planning. Pinterest is a great app that helps you bring all the things you like in one place - you can create a wedding “board” and “pin” web pages, pictures and even places to it to help formulate your wedding plans. A pretty cool app that I have seen lately is Appy Couple. They charge a small one-off fee to register, and then you can create your own wedding app to share with each other, your bridal party and guests.You can put your story

on there with biographies of your bridesmaids and best man; send invitations; share information and directions; share pictures, wedding gift lists, and lots more. Going local, there is the Cumbria & North Lancs Wedding Guide. It is an app that gives you really useful resources including checklists, music and vows in addition to a definitive guide. It includes all the local venues, upcoming local wedding events (fairs etc.), the best local suppliers and lots of offers. Use your technology to make your special day the best it can be.
