he increasing income and the growth of demand from both local and international investors has caused prices of villa rentals to rise remarkably in first quarter of this year in Phnom Penh. Most people highly value living in villas that have gardens, swimming pools, and entertainment areas. The villa is considered to be housing for wealthier families in Cambodia. Chailin Sear, CEO of CL Realty Co, said that the price and demand of rental villa in the first quarter of this year has grown significantly, par-
ticularly in the districts of Chamkarmon, Daun Penh and Toul Kork. This growth is due to Cambodia’s investment growth, which means new arrivals need houses for either staying in or for their offices. “The price of rental house at the first six months this year has climbed up about 20 to 30 per cent while the demand has stepped up as well,” said Sear. “The factor that causes to be accession is the growth of people here, as well as them looking for more business places or offices.” Chailin continued that a villa with four to five bedrooms now in the districts A villa in Toul Kok, Phnom Penh. In Chamkar Mon and Daun Penh district, a villa with four or five bedrooms rents for $2,000 to $4,000 per month, whereas in Tuol Kork the same is $2,000 to $3,000. He added that the villas in Tuol Kork can easily be found, unlike Chamkar Mon and Daun Penh, because in Tuol Kork the price is so cheap. Many villas are for rent and the villas with four to six rooms is rented at $1,000 to $4,000 per month. Today, there are not many villas built in Chamkar Mon and Daun Penh. whereas villas are mushrooming in Tuol Kork, where there is much empty space. Villas in Chamkar Mon and Daun Penh are decreasing, because investors are knocking down old villas to build apartments or condominiums. The construction of apartments or condos earns money easily, and is better than renting the villa to a family.

lthough the country’s latest election campaign has arrived, experts say the property market has not declined, unlike during previous elections. Political factors, knowledge and experience of the past have played an important role for buying and selling property in Cambodia. The property market is different showing different

The factors keeping the real
estate sales on the rise include three main reasons; first, the trust in political stability from people and the politicians’ maturity; secondly, capital investment increase from more local investors such as Vattanak, and Canadia banks, as well as the development of construction residences, boreys, warehouses and commercial hubs; third, the increase in foreign investors such as from Malaysia, the UK, China, and Korea, especially in 2013. Chailin Sear, CEO of CL Realty C. said “The stable political factor has played
an important role in helping promote the value of properties now. The upcoming elections do not make people worried about the political chaos; therefore, purchasing and selling are better,” he said. Although the elections in Cambodia are seemingly better, feelings are still somewhat precautionary in Cambodians’ minds, especially after the fourth parliamentary elections in 2008 when many property investors were in the red due to political deadlock and the effects of the global financial crisis.
Po Eavkong, managing director of Asia Real Estate Cambodia said the election process does not affect the sales of real estate; what affects the buying and selling now is the price, because most property owners now have set the price very high, making buyers hesitate, “In general, I observe that buying and selling the properties do not change because many consumers come to seek Asian Real Estate company services every day,” he said. “However, now those who want to buy a small number of properties also decide to
delay because they are worried about the document process as well,” Earvkong Kong said However Sorn Seap, general manager of KEY Real Estate disagreed, saying the buying of property during the election campaign this year seems quieter than normal. “Consumers seeking information from KEY Real Estate often look at the locations we show them, but when it comes to the purchase contract some of them seem hesitant, saying they have to wait and see the post-election situation first,” he said.

Far East buyers beware in London property rush Brenda Goh

hen Hong K o n g businessman Mr He paid a $56,000 deposit on a four-bedroom apartment in Britain, he believed it was a 40-minute walk from central London, his lawyer says. In fact it was a 40-minute journey by high-speed train. The $550,000 pound home was in Lincolnshire, eastern England. He sued the developer for misrepresentation last year, getting his money back before the case got to court in what his lawyer told Reuters was an attempt by the developer to avoid its marketing material being splashed around a courtroom. His experience shows the potential pitfalls facing a growing number of Far Eastern people buying British homes unseen, as developers target places such as Hong Kong, Shanghai and Singapore because British buyers are struggling to get mortgages. “It is a matter of developers saying: ‘Here are some people who are likely to be interested. They probably do not know too much about the market, so why don’t we advertise there’,” said David Eldon, former chairman of HSBC’s Asia unit, who has witnessed the practice during two decades in Hong Kong. “I think they are being a little economical with the truth,” he told Reuters, saying properties could be sold for higher prices in the Far East. Major developers including Barratt, Taylor Wimpey and Berkeley have stepped up efforts to court cash-rich Far Eastern buyers since 2009 after the global financial crisis sapped demand at home. Developers do not all use exactly the same marketing methods. Berkeley said it had had many repeat purchases from Asian buyers over 20 years,

although it acknowledged a mistake in one of its press releases. Taylor Wimpey said it offered a high level of service to all customers. Barratt declined to comment. The number of Chinese and Pacific Asian buyers of the best quality newly built London homes jumped to 37 per cent in 2010 from four per cent in 2009, data from property consultancy Savills showed. The majority purchase for investment and are used to buying off-plan - before the home is built. Mr He was told his flat was 40 minutes from central London at a face-to-face meeting with the developer, said David Linklater, head of litigation at law firm Alan Broadhurst, who represented He. Broadhurst declined to give his client’s full name or the developer’s identity. “Lots of people go to the fairs in Hong Kong and get a sheet of paper with a picture of Big Ben. You think you are going to be the Queen’s neighbour when actually the Queen has a great big garden with a big wall around it,” said Linklater, who deals with 20-30 unhappy overseas buyers a year. Sold at exhibitions in plush hotels, many properties are not in the most desirable
London neighbourhoods despite the prominent pictures of Harrods or Buckingham Palace. Details of exact locations tend to be omitted rather than inaccurate. “There is a lot of embellishment going on working off the naivety of the Chinese buyer,” said James Moss, managing director of property consultancy Curzon Investment Property. A brochure advertising 375 Kensington High Street, a luxury London scheme marketed in the Far East and developed by a Berkeley joint venture alludes to the proximity of the High Street Kensington underground station in a brochure entitled “London’s most sought after new address”. The station, which is at the heart of one of London’s most popular shopping districts, is a 15-20 minute walk away while the flats are at the scruffier end of the same long street and closer to two other tube stations. In a press release issued in Hong Kong, the development was described as “a short walk from the luxury shopping available at Harrods”. The world-famous store is a 50-minute walk according to the Transport for London website. “To an unsuspecting buyer, you think wow, it is amazing,
but actually it is the wrong end of Kensington High Street, right next to Kensington Olympia,” said Camilla Dell, managing partner at Black Brick Property Solutions, which helps overseas buyers find London homes. A Berkeley spokesman said the “short walk” description was “an error”. “We have had a lot of customers from Asia over the last 20 years, many of whom are repeat purchasers,” he said. “It (the development) has excellent transport links and easy access to well-known shops; the distances to which are clearly marked in our brochure. In addition, by far the majority of buyers have or will visit our developments before buying.” Ingrid Skinner, managing director of Taylor Wimpey Central London, said: “Buyers need to be able to trust the company they are buying
from. At Taylor Wimpey we offer the same high level of service to all of our customers.” The ballrooms of Hong Kong’s luxury hotels hold property shows nearly every weekend. The city’s two Mandarin Oriental hotels are particularly popular. At one event attended by Reuters, prospective buyers were offered San Pellegrino bottled water, chocolate cupcakes and a choice of finger sandwiches. An HSBC banker was on hand to help with financing and a lawyer in case a purchaser was ready to sign. Buyers can feel the pressure. Judith, a native of Zhejiang in China who lives in London and declined to give her full name, said her father paid the deposit on six off-plan flats in Colindale, north London, at a Shanghai exhibition a year ago despite the fact she warned him about its remote location. “The moment my father sat
down, the agent wanted him to pay a reservation fee. Once he showed that he liked them, they said he had to pay the fee or someone else would snap them up,” she said. They are in a legal dispute with the agent in an attempt to recover $38,000, claiming they were sold the properties on the basis they could be converted into nine units, which they subsequently discovered was not possible. “The developer and agent are not obliged to educate the buyers, it is down to the buyers to educate themselves,” said Ken Xiao, president of Chinese Property Professionals Society in London. “Of course the agents will try to show the shiny side because they are trying to sell the property.” There may be little legal recourse. Those buying new homes as an investment are not protected under the National House Building Council’s consumer code as opposed to those looking to occupy them, a spokeswoman for the watchdog told Reuters. Estate agents said overseas buyers of property as an investment were at risk of getting lower-than-expected returns as the mass marketing of the homes at events meant many landlords would likely have to vie for tenants all at once, pushing rents down, Dell said. “I have yet to see a development where the rents have exceeded the advertised rent,” said Ashley Jones, managing director at London-based estate agent Barclay Residential. “I cannot see all of this having a happy ending.” REUTERS

I can provide the consultation without charge, and when they use our service, they can sell at 50 to 100 per cent over their sale price. This service is new to Cambodia, so if we advertise it widely, those who want to sell their business will not incur loss. What is the fee for customers? We charge customers at lower rate
than the broker who charge 3 per cent. We charge only 1 per cent. Does VTrust Group have experts to do this job? The business evaluation relies on three main principles: The evaluation is comparative. For example, the company is in operation or not? The price of the company? So we compare the size, and then we will find the price. Another point is that we evaluate the income potential of the company. How much the company can earn? Another technique is the evaluation of net assets. So the evaluation will look at the company’s potentials such as land, building, and the business. How much they can sell and buy it according to the actual situation?
Different types of hard title certificates on immovable property
W
hat is a hard title certificate? A hard title certificate on immovable property refers to a title document, issued by a competent government authority (ie the Land Office), recognizing the lawful possession or ownership over an immovable property. How to recognize a hard title certificate? Actually, there are many forms of hard title certificates, which co-exist as of today. This is an evidence of evolution of the land law in Cambodia during the past
few decades and Cambodia’s continued effort to improve land rights and legal security for land use through comprehensive land planning and land reform programs. Since 1989, different forms of hard title certificates have been issued by the relevant authorities through different land registration systems, namely: (i) certificate of possession and use of land (known as chicken feather title certificate), (ii) certificate of possession on immovable property, (iii) certificate of owner of immovable property (old format), and (iv) certificate of owner of immov-
able property (new format or LMAP format). Besides the above certificates, there are more recent co-owned building-related certificates that identify ownership over common space of a co-owned building and the underlying land and ownership over private units in a coowned building. So what is the legal value of each hard title certificate? Interestingly, only the certificates of owner of immovable property both in old and new formats and co-owned building related certificates are evidence of ownership over an immovable property. The
certificate of possession and use of land and the certificate of possession on immovable property are only evidence of possession over an immovable property, yet duly registered in the land register. It is however worth noting that all the above formats of hard title certificates bear with more or less the same validity and reliability, even though the government, and, specifically, the Ministry of Land Management, Urban Planning and Construction, are working towards harmonizing all hard title certificates and ultimately to have only LMAP format title deeds through its
land reform program and its country-wide systemic land registration process. What information is contained in a hard title deed? Regardless of its format, a hard title certificate contains basic information on (i) identity of the immovable property (location, drawing shape, identification number of land plot, type of property and size), (ii) owners’ identity, such as name, date and place of birth and their parents’ identity), and (iii) other information, such as history and existing charges, encumbrances on the immovable property.

herry Sheng permitted herself one final splurge before joining China’s swelling ranks of homeowners: a 4,000 yuan ($642) black fur jacket. “I could never afford such a luxury after I start repaying my housing loans next month,” says the Shanghai policewoman. Servicing the two mortgages on the 1.1 million yuan one-bedroom Sheng bought on the city’s western outskirts will eat up about 70 per cent of her salary. Sheng is a fang nu, or housing slave, the popular name for a generation of middle-class Chinese who will need to work a lifetime to pay off their debts. A 1,076-square-foot apartment in one of China’s most affluent cities today costs about 40 years’ annual income, according to data supplied by the government and SouFun Holdings, a company that operates a popular real estate website. “The ‘housing slaves’ term is quite reasonable because it will put a lot of burden on home buyers if housing payments are more than half their incomes,” says Liu Li-Gang, an economist at Australia & New Zealand Banking Group.

Property prices on the mainland have almost tripled since China’s leadership began a push to encourage homeownership in 1998. That’s when Premier Zhu Rongji allowed residents in state-owned housing developments in urban centres to purchase their dwellings. The idea of buying a property with borrowed money didn’t become popular until several years later, when prices in major cities began to skyrocket. Sheng, 29, is better off than most. Her 540-
square-foot apartment cost only 16 times her annual salary. To buy it, she borrowed a combined 770,000 yuan, getting a 20-year mortgage from Agricultural Bank of China and a 15-year loan from a provident fund for city workers. Her parents helped with the 30 per cent down payment. Sheng’s monthly payments will add up to 4,000 yuan—exactly what she paid for her fur jacket. In the US on average slightly less than 9 per cent of a borrower’s monthly disposable
income goes toward mortgage payments, according to Federal Reserve data. In China the proportion is 30 per cent to 50 per cent, says Wu Hao, a manager at the loan brokerage division of Bacic & 5i5j Group, a Beijing realtor. The general guideline among Chinese banks is that a borrower’s monthly salary should be at least twice her monthly payment, she says; otherwise she’ll be asked to submit proof of assets (such as property, cars, or insurance) to prove her ability to service the debt. Mortgages have maturities of five to 30 years. The People’s Bank of China benchmark lending rate for loans longer than five years is now 6.55 per cent. Unlike the US, where millions of home borrowers fell behind on their payments or stopped paying their loans altogether when the economy slumped, mainland banks report no such problems. At China Construction Bank, the nation’s biggest housing lender, the bad-loan ratio on personal mortgages stood at 0.2 per cent as of June 30, unchanged from the end of 2011. That may be because Chinese buyers typically make large down payments and so are less likely to risk foreclosure. In Shanghai, Beijing, and Guangzhou, down payments average 50 per cent of a home’s value, according to Centaline Property Agency, China’s biggest real estate brokerage. BLOOMBERG

Japan’s $1 trillion pension fund mulls real estate spree-CBRE

apan’s public pension fund, the world’s largest, with a pool of $1.1 trillion, may start buying real estate to boost returns in a move that could involve tens of billions pouring into cities such as London and Paris, property consultant CBRE said. Any such plan by Japan’s Government Pension Investment Fund (GPIF) would come as the country’s government urges public funds to increase returns to help revive the economy, part of the game-changing economic
policies of Prime Minister Shinzo Abe. Earlier this month, the GPIF said it would shift away from bonds and into stocks to take on greater risk in the most significant shift in its asset allocation since 2006. Property typically offers a higher yield, or rental income as a percentage of a property’s value, than government bonds because it is seen as a riskier investment that takes longer to buy or sell and faces the risk of becoming empty. As central banks keep interest rates historically low, many government bond yields offer little or no return, prompting some investors to shift into real estate.
“It is striking just how much larger GPIF is than any of the word’s other pension funds ... Therefore, if it ultimately expands its remit to include international real estate, it could become a very significant player,” CBRE said. A typical real estate allocation for a fund entering the market would be 5 per cent, growing to 10 per cent, said Simon Barrowcliff at CBRE. That could mean up to $100 billion of deals in major global cities like London, Paris or New York. Overseas buyers from as far afield as Brazil and Azerbaijan spent 10.5 billion pounds ($16 billion) in the British capital last year, a 42 per cent
