Commentary Get Inspired, Get fit. Fitness usually refers to two different things, nutrition and exercise. Both of these are essential aspects to having a healthy life and when you are able to improve them, you will begin to feel better about yourself and others will begin to respect you more. Fitness is not just about looking great but more importantly it is about feeling great. Reach your fitness goals by planning backwards. Pick when you plan to complete your goals and then work back from there by listing what short-term goals you plan to achieve along the way. This method of thinking causes you to want to achieve those short-term goals because you are no longer viewing them as goals, but as deadlines. Improve your life by making fitness a priority. Plan your fitness strategy carefully, so that you can get on the road to a healthier, fitter you. Do not become too focused on any one aspect of getting fit; keep your eyes on the big picture and learn to love your body and treat it with respect. Consistency is the hallmark of ANY fitness routine. If you can maintain your plan, you will succeed. Remember, we only get one body; treat it right.

We are face-to-face with a situation that threatens to compromise not only the health and fitness of the planet, but that of our children, our children’s children and ourselves as well. If we continue on our present course of using more and more of the natural resources than we need, and destroying our oceans, lands, drinking water and air supply, the danger is clear, eminent and unavoidable. We can no longer disassociate ourselves from the world in which we live. We are all part of this living, breathing organism that we call Planet Earth. Things that we do to our environment will ultimately come back around to us. If we nurture our planet, it will in turn nurture us. However, if we take it for granted and abuse it (as we have done for the past century or more) it will surely return

to us in a negative fashion and we will all suffer the consequences.

cases is treating the symptoms. When we were boys growing up in the mid-west, our parents had home gardens that we helped tend as we got older. The bulk of our daily meals came from those gardens. We had a small compost area to return vital minerals and other nutrients back to the soil to become part of what we would be eating next harvest. Things are not like that anymore. One of the major concerns is the condition of the soil from which our basic food chain begins. Of primary importance is the mineral, or micronutrient, content. Plants such as vegetables, fruits and nuts absorb the minerals from the soil. Sunlight, clean air and water combine to facilitate the creation of vitamins, amino and fatty acids. But, they do not “make” minerals. Minerals must come from the soil.

What we eat, drink, breathe, use up, dispose of, change, add to, subtract from, and react to, is all connected. Break the chain and things start to fall apart. General Electric’s key word in its advertising program following World War II was “progress.” Thus the trademark that everyone knows: “Progress is our most important product.” Yet, unbridled progress has had a high price tag. It presents in the form of air and water pollution, increasing levels of daily stress, reduced nutritive value in foods we eat, and new diseases related to all of the above. New medical technologies cannot keep pace correcting all of the problems arising from the so-called progress we are currently experiencing. At best, all they can do in most

The soil however, can become depleted of vital minerals within five to ten years, unless properly tilled or “worked.” Fertilizers can be of value in supplying some minerals back to the soil. But sadly, for most of the last century commercial fertilizers have been used that provide only a few of the minerals required for good health. For at least the past sixty years only one type of fertilizer has been used extensively. NPK is the farming industry’s standard fertilizer. That stands for the minerals Nitrogen, Potassium and Phosphorous. These three minerals help grow substantial size crops, but do not address the problem of the missing or waning eighty-seven other essential minerals we need for good health and nutrition. As

far back as 1936 we have been aware of the seriousness of the soil’s ongoing mineral depletion and its effect on our health. The research and studies to testify to this were noted in U.S. Senate document 264, which stated that due to the decline of minerals in our farm soil, “foods are starving us From the world of Mason jars and sauerkraut crocks of the past, we’ve pleasantly evolved into the modern day of brightly colored frozen packages, microwaves, fast foods, and many added chemicals—err, additives. What, then, might we expect in the not too distant future? More exactly, what do we have to look forward to in our health future? Let’s see, tea leaves anyone?

alone as a result of preventable medical errors. That breaks down to roughly 268 people per day dying needlessly from totally preventable medical errors. That’s the equivalent of 13 nine-elevens per year! But, even right now in present time, where is the outrage? Shouldn’t it be at least 13 times the outrage we felt after 9-11? And, even aside for this tragic loss of human life, the preventable waste of healthcare dollars on preventable medical errors would easily be in the billions annually. But we never hear anything about how we need to fix this particular and needless waste of healthcare dollars from the congressional leaders whose constant mantra is to cut “waste.”

What do we do now? As Glenda said in the Wizard of Oz, “It’s always best to start at the beginning.” Obviously, the quality of the soil needs to be recharged. Twentieth Century concepts generally don’t work too well in the Twenty-First Century. Our politicians and business leaders have gone off in the direction of corporate wellness as opposed to wellness of the people. Basically, the order of the day has become “wealth over health.” Pesticides are killing the very bees that facilitate necessary pollination. These same chemicals are winding up inside of us to potentially create serious disorders and diseases of our bodies. This kind of madness MUST stop if we are to survive.

So, what’s in store for the future? That is, but isn’t, a simple question. The simple answer is to will a cultural commitment to attack environmental/biological pollution on many fronts. This means regulate emissions from everything--from cars to gasoline lawn blowers, to municipal water (we are being forcefully medicated with fluoride, even in many bottled varieties) to the food supply, to sometimes unnecessarily utilized CATscans (which the medical community has finally recognized in the light of escalating healthcare costs). Yes, that will sound like “big government” to some, but if you honestly look at the mass, persistent deregulation that has been going on for the last 30 years, and then look at the mess we’re in, it’s a nobrainer. Business has for the most part been left to police itself with the financial gutting

cover a wide variety of fruits and vegetables on a daily basis. Other plants that provide still more nutrients would include yams, sweet potatoes, rice and grains, sprouts, nuts and seeds. Go organic as much as possible for a number of reasons. Organic foods are those grown without the use of chemical pesticides. Often, organic produce is grown on smaller farms where the mineral content of the soil might be of greater value due to a higher stewardship of the land… and in our opinion, it tastes better too.

of one regulatory agency after another, just as Wall Street was left to regulate itself before the financial crisis--about which we are all acutely aware. Thus, look around. Brakemen on top of railroad cars in the 19th century were frequently falling off and being maimed or killed, and the railroads refused to assume any responsibility or to install Mr. Westinghouse’s new invention, air-brakes, for railroad cars (citing prohibitive cost as the reason), until the government forced them to do so. Incidentally the ensuing costs of doing so did not seem to destroy the railroad industry. When you look at the real math, reasonable regulation always returns a higher yield for the total biological, financial and social health of the country. The toxic air and everything else that we take into our bodies has an ultimately huge price in human suffering and healthcare expense down the road. Think cumulatively. The healthcare industry is totally behind overall in being able to “fix” the higher and higher level of

general disease. The pharmaceutical houses haven’t kept pace in developing antibiotics to treat the newer strains of more and more antibiotic-resistant diseases, because the bulk of their research dollars has been going into developing other medications (with a higher total profit margin, because the patient will probably take/refill it for life). The future is already upon us, and positive changes need to be made...not just personally, but also culturally whether we sincerely want better health or not. The public will continue to be served more of the same and probably worse based on history, as long as its level of acceptance continues to be so high. It’s really our choice. We must decide individually and collectively on what we are willing to settle for regarding health, or the decisions will be made for us. The first line of defense against inadequate nutritional value can be selecting and eating

If enough people speak up, and advocate for better health with the prudent but powerful use of their consumer dollars wherever possible, we can affect positive changes. Making changes in the real world is similar to growing muscle. You must give it a reason to change. With muscle, it could be resistance, duration and a combination thereof. With social and business matters, (they are ultimately inseparable), it could be letters and emails demanding action for a state of better health and well-being of our nation. Remember, we have a very powerful advocacy tool in our wallets---targeted spending—which some say is the most powerful reason for nonresponsive business models to affect more positive changes. Fitness Trends Fitness Trends come and go, from the Vita Master (the belt that wrapped around your waist and shook you until you felt like bringing up your lunch) to the Thigh Master and the Inflatable Air Shorts. We’ve compiled a short list of several of the latest fitness trends that upon further scrutiny might be around a bit longer than some of the aforementioned crazes. Wellness Coaching Wellness coaching often uses a one-on-one approach similar to a personal trainer, with the coach providing support, guidance, and encouragement. The wellness coach focuses on the client’s values, needs, vision, and goals. According to this trend survey (and results from past surveys), it seems as though wellness coaching and its principled techniques of behavior change have been adopted by personal trainers and other health and fitness professionals. According to a recent survey by the American College of Sports Medicine (ACSM), “educated and experienced fitness professionals” now constitute the most important fitness trend in the world, having jumped from third to first place since last year. Through the supportive and self-empowering environment provided by a wellness coach, you can learn what kinds of things you may personally experience each time you undergo making changes in your life. Developing a history of success over time creates positivity towards change and thus gives you more incentive to continue making healthier decisions all on your own.

Circuit Training Circuit training is a group of 6 to 10 exercises performed one after another and in a predetermined sequence. One does each exercise for a specified number of repetitions or for a set period before having a quick rest and moving on to the next exercise. Circuit training is short bursts of resistance exercise using moderate weights and frequent repetitions, followed quickly by another burst of exercise targeting a different muscle group. Because the exerciser switches between muscle groups, there is no rest required between exercises. This gets the heart rate up, which usually doesn’t happen during resistance exercise. Boot Camp Boot camp is a high-intensity structured activity patterned after military-style training. Boot camp includes cardiovascular, strength, endurance, and flexibility drills and usually involves both indoor and outdoor exercises typically led by an enthusiastic instructor. Boot camps also can combine sport-type drills and calisthenics. The term “boot camp” is currently used in the fitness industry to describe group fitness classes that promote fat loss, camaraderie and team effort. They are designed to push people a little bit further than they would normally push themselves in the gym alone. The idea is that everyone involved works at their own pace as they team up and work towards one goal, either in pairs, small teams of three or four, or even two teams head on.

Outdoor Activities This is a trend for health and fitness professionals to offer more outdoor activities to their clients. Outdoor activities can be done with family and with friends, with a group or by yourself. Outdoor activities typically include hiking, canoeing, kayaking, and games or sports. Outdoor activities also can include highadventure programs such as overnight camping trips. Group Personal Training This trend allows the personal trainer to continue providing the personal service clients expect but now in a small group of two to four, offering potentially deep discounts to each member of the group. In these, continuing challenging economic times, personal trainers must be more creative in the way they package personal training sessions. Body Weight Training Body weight training did not appear as an option in previous surveys because it has only now become popular (as a defined trend) in gyms around the world, this is not to say that body weight training has not been used previously. On the contrary, people have been using their own body weights for centuries as a form of resistance training. Packaging it as an exercise program has now made it popular in all kinds of gyms. Body weight training often uses minimal equipment, which makes it an inexpensive way to exercise effectively. Body weight training may be a trend to watch as more people get “back to the basics.�

AMERICAN CANCER SOCIETY SEEKS LGBT COMMUNITY HELP FOR CANCER STUDY

What if you could personally make a difference in the fight against cancer in the LGBT community? The American Cancer Society is recruiting hundreds of adult men and women between the ages of 30 and 65 years with no personal history of cancer for a new research study, the Cancer Prevention Study-3 (CPS-3), with enrollment in the Coachella Valley at these locations: Eisenhower Medical Center: Tuesday, Nov. 12 from 1 p.m. to 5 p.m. Eisenhower Medical Center: Friday, Nov. 15 from 9 a.m. to 1p.m. Desert AIDS Project: Sat., Nov. 16 from 9 a.m. to 1 p.m. Desert Regional Medical Center: Tuesday, Nov. 19 from 11:30 a.m. to 3:30 p.m. Desert Regional Medical Center: Friday, Nov. 22 from 9 a.m. to 1 p.m.

A particularly important feature of CPS-3 is that for the first time the American Cancer Society will ask enrollees to identify as straight, gay, lesbian or bisexual in a major study, which may lead to valuable insights about cancer in those specific communities. “There is a lot of room for more understanding about cancer risks in the LGBT community, and the first step is taking part in CPS-3,” said Russ Russell, a member of the LGBT community, and chair of the Society’s Desert Palms Community Leadership Council. “The study is an unprecedented opportunity to enroll in a study that could provide us with this valuable information and possibly open the door to more sexual minority-specific cancer research.” Troubling is the fact that research shows smoking causes 80 percent of all lung cancers. Current evidence suggests lesbians and gay men are more likely to smoke than heterosexual men and women. Several studies also suggest that lesbian and bisexual women get less routine care than other women, including breast and cervical cancer screening. Economic data shows that much of the gay and lesbian community is “medically underserved,” which increases the risk of developing and dying of cancer. Enrollment in CPS-3 is a simple, two-phase process, one phase at home and one phase at a local enrollment venue. Individuals will be asked to read and sign an informed consent form; complete a brief

Enroll in Cancer Prevention Study-3. Members of the LGBT community are at greater risk for certain types of cancer. By enrolling in the American Cancer Society’s Cancer Prevention Study (CPS-3), you can help us understand how to prevent cancer, which will save lives and create a world with more birthdays for everyone.

To enroll you need to: • Be between 30 and 65 years old • Have never been diagnosed with cancer • Be willing to make a long-term commitment to the study which simply involves completing a mailed or emailed follow-up questionnaire every few years

Enrollment locations: Eisenhower Medical Center written survey; provide waist measurement and give a small blood sample (similar to a doctor’s visit). A trained, certified phlebotomist will draw the sample. While the study is expected to last for years and yield lifesaving results, initial enrollment will take just 30 minutes. For the next 20 or more years, the Society will “follow” CPS-3 participants to study factors that are associated with cancer occurrence or prevention. For the enrollees, this will mean completing mailed questionnaires every two years (questionnaire information is kept strictly confidential and used for medical and statistical purposes only). Researchers will stay in touch with all CPS-3 participants through a variety of mechanisms, including newsletters and emails. FRANCIS TOUMBAKARIS CRAFTS HIS OWN STAGE

HGTV’s newest renovation stud, Francis Toumbakaris, is as comfortable in a pair of tights and slippers as he is in boots and overalls. Trained in classical ballet since he was twelve, Toumbakaris has high kicked his way onto the national tours of Fosse and Dirty Rotten Scoundrels and on Broadway in the revival of Fiddler on the Roof starring Alfred Molina and later Harvey Fierstein and Rosie O’Donnell. Other theatrical career highlights include the award winning Susan Stroman dance musical Contact, and Candid at The New York City Opera. “Drama is in my blood,” he says. “I am Greek, after all. Drama was born in my country.” His animation shines in Brother Vs. Brother, HGTV’s latest competition show where renovators are split into two teams – Team Drew and Team Jonathan – to compete for a $50,000 cash prize. “I’m out and loud,” he continues. “I’m not afraid to get dirty and I thrive on making decisions on the fly. “I want to think I am a likable character, but it’s a show where even within our own teams, we are pitted against one another. The show is filled with conflict.” Conflict is nothing new to Francis Toumbakaris. “My whole professional career has been an uphill battle.” Francis Toumbakaris has been financially independent since he

was 15, when he left his Athens home on scholarship to attend the prestigious Rudra Béjart dance school in Switzerland. The same year Toumbakaris entered high school; he signed a lease on his own studio apartment. “It was a bit scary,” he remembers. “I was a boy living in a very grown-up world.” To make the tiny studio a home away from home, he painted, decorated and, with the help of his stepfather, constructed customized furniture for it. “I designed a dual purpose kitchen island that would allow me extra counter space and storage. What 15-year-old thinks of that?” he laughs. “But I loved it. I felt the same thrill handling tools as I did pointing my toes and trying to leap higher than anyone else in my ballet class.” In 2000, on a tourist visa, he set out for New York City. He had only $2000 in his pocket, money he had saved from being a backup dancer for a pop singer in Greece. But he was young, driven and ambitious. He would land the occasional theatre and film job. In addition to his stage work, Toumbakaris appeared on the big screen, with speaking parts in two major motion pictures: Joaquin Phoenix’s We own the Night and Tim Robbins’ Noise. But he needed another job

watch to see him through the lean months in-between show biz gigs. after returning from touring with scoundrels, he placed an ad on the internet looking for small painting projects, repair work and other odd jobs. “I would ride around the city on my bicycle and a backpack full of tools,” he laughs. The big surprise was when his survival job began to take on a life of it’s own. One satisfied client referred another, which led to another and so on. within a year, Toumbakaris went from completing simple jobs to doing full-scale renovations in manhattan apartments. He hired an assistant, filed for insurance and in 2007, his contracting and design company, greek & handy was established. Toumbakaris believes his years as a dancer helped prepare him for design. The stage taught him to be fearless, to perform under tremendous stress and to make the job work even when all appears to be going wrong. It taught him to trust his gut instinct and most importantly, dance taught him about the art of space. “Dancers learn to appreciate how bodies and objects flow through space. I bring that philosophy into my renovations, striving to find the perfect balance in a room through smart design and efficient layout.” according to Toumbakaris, good design is not simply about pretty colors, fabrics and accessories. It is an art that requires

precise and intricate problem solving. “I am constantly calculating new ways to improve my clients work and living environments.” Toumbakaris describes his style as comfortable luxury with a classic urban feel. “I like to think of myself as the orchestra conductor. although I may not play all the instruments, I direct all the moving pieces to create one beautiful harmony.” his theatrical training even helped to land brother Vs. brother. “I auditioned three times for the network, hoping to compete on season four of hgTV’s design star.” however, producers felt Toumbakaris’ background in home construction was better suited for drew and Jonathan’s new show. he’s excited that brother Vs. brother is giving him the opportunity to combine his love of show biz with his passion for renovation. “I never thought wearing a tool belt would give me the chance to perform on a new stage,” he says. “but why not? I’m an artist. I’m always looking to create something new.” his ambition extends beyond the show. a greek & handy line of tools, paints and home goods is in the works. Toumbakaris also aims to find a husband and build a family. Yes, the dancer-turnedhandyman-turned-interior renovator admits he is anxious for his next big role, that of “daddy”.

Thelma houston’s honeyed voice drips from the phone like warm maple syrup on a winter’s morning — sweet and comforting. her openness invites familiarity, like catching up with an old friend. recognizing the desert area code, the motown recording star greeted me with a welcoming hello. “I have several friends who live in Palm springs,” she says. “but enough about me, how are you doing?” we laugh, knowing this call is all about houston and her upcoming appearance at the aIds assistance Program’s disco Tea dance september 29 at the saguaro hotel in Palm springs. “we’re very excited about you coming,” I say. “I’m excited too,” she replies with tangible enthusiasm. “when they said the theme was a tea dance, it reminded me of way, way back in the days of disco. you would have the disco dances at night in the clubs, usually very late, and then the tea dances would be on sunday, kind of putting the cap on the weekend — the weekend is officially over,” she adds with a laugh. I ask whether those tea dances were mellow wind-down events, because in 21st century gay society these events can be rather raucous. she chuckles. “It sounds like it would be like an unplugged kind of thing, where you’d sit with maybe a piano and just kind of chill out, right? nah. not so.” decades after her grammy award-winning hit “don’t leave me this way,” the disco legend still brings people to their feet with her infectious energy, which is precisely her plan for the aaP fundraiser later this month. “I’m going to bring back the fun of those tea dances,” says. “whenever I perform, I love to see people have a good time, people dancing to my music. I like for them to participate, because that’s what the afternoon is about.”

fun and, of course, fundraising. houston’s dedication to charitable causes is widely known. In 2003, west hollywood proclaimed January 29 as “Thelma houston day. she has donated her talents to numerous nonprofits, including Devine Design for Project Angel Food, AIDS Project los angeles, and the minority aIds Project, to which she donated her $20,000 winnings from the TV show hit me baby. she is also very active in the beverly hills/hollywood branch of the naacP. her humanitarian involvement, she believes, comes with the star package. “I feel that part of the responsibility of being given a talent, which for me is singing, is giving back,” she explains. “That’s just what I think you should do. Period. but in my heart, I do it because it’s something I’ve been doing for a very long time.” houston has rallied behind aIds and hIV issues before they were acronyms. “before we had a name for what aIds was, we had friends who were getting sick and we had to try to do whatever we could,” she remembers. “somebody might need a dog walked or have a bill paid or might need help getting to the doctor. People just came together.” while she acknowledges the progress that has been made over the years in the treatment of hIV and aIds, she recognizes that we are not out of the woods yet. “I’m still involved in, because it still needs to be done, unfortunately,” she says. “and I say unfortunately, because we haven’t found a cure and that’s what we’re striving for. and we need to educate people. not just here in the united states, but in countries like africa, where they don’t have access to medicine. There’s still so much work to be done.” work for houston is a four-letter word that brings experience and insight. Time spent on this planet has only served to fuel houston, both as an artist and an activist. almost 45 years after the mississippi native began performing gospel music with the art reynolds singers in the late ’60s, she is releasing a new album that, she says, cannot be defined by genre. “It’s not definite R&B. It’s not definite dance — but you can dance to it. It’s not alternative, although there are some approaches that could be considered alternative,” she says of her latest work, a conglomeration of fresh songs called Thelma houston and Janitor: fortytwo, which she created with gabe noel, or Janitor as he is professionally known, who is 42 years her junior (hence the album title). she met noel at a fundraising gig for an animal shelter, where he was playing bass. They clicked. “I had some ideas for some new kind of music — I didn’t know exactly what kind of music —and gabe said he wanted to work on

something, so we started writing together,” Houston recalls. “Even with the difference in our age, there are certain things we agree on about life, about love, about how we treat each other — things that don’t have to do with age, but about being respectful, loving, and creative. “When someone my age is still able to have a career in the music industry, it’s kind of rare, you know what I mean?” she continues. “It’s rare in that people tend to think that after a certain age you’re done, and you don’t have anything left to say. That’s how our society is. We value the young — we think the young know everything and we want to stay looking young for as long as we can. We don’t want to embrace wisdom, and wisdom comes from living. It comes from experiences. And, at the same time, we don’t know everything. And young people ARE smart, and they DO have another way of looking at things.” Houston hopes that her collaboration with Janitor — the marriage of youth and knowledge — may spill out to other areas as well. “If we can do it on this level, it can expand beyond the music industry to life period,” she explains. “That no matter our ages, we can still exchange ideas and we can still be creative. And we can be creative together when we’re respectful of each other and what we bring to the table.” Houston has brought much to the table over the years — a veritable smorgasbord of talent and tenacity. The disco diva signed with Capitol Records in 1967 and had her first hit song called “Baby Mine.” Soon after, record labels clamored for her and she signed with ABC/Dunhill, where she recorded and released her first solo album called Sunshower written, arranged, and produced by the legendary Jimmy Webb. Although critically acclaimed, the album did not shoot Houston to the top of the heap. That didn’t happen until she signed with Motown Records. It was at Motown that Houston claimed the top of the Pop, R&B and Dance charts with her highpowered rendition of “Don’t Leave Me This Way,” which went gold so fast that it spun Houston right into the distinction of being the first

solo female artist at Motown to win the Grammy Award for Best R&B Female Vocal Performance. Since then, Houston’s influence on music has spanned generations, genres, and mediums. Singing competition shows such as America’s Got Talent and American Idol — both in which she participated — have reshaped the search for stardom in today’s music industry. Houston agrees that these programs have provided unprecedented exposure for emerging artists, but also notes the skewed perception that if you’re not on any of these shows, you must not be any good. And if you do make the cut, you are expected to hit the road running and many young artists just aren’t prepared. Exceptions, she says, are AI’s Adam Lambert and Jennifer Hudson — both of whom performed like seasoned artists right from the get-go. “I think it puts a lot of pressure on people,” she observes. “If that was going on back in the day when I made the decision that that music was the career I wanted to have, I would’ve been left out, because I never would have gone down there, or up there, or wherever it is you have to go to stand in those long lines, you know? And if I did go, I might have been rejected.” Houston did make it, of course, the old-school way by performing in cover bands in Downy and hustling her talent whenever and wherever she could until she rose like sweet cream to the top. And she continues to rise. In addition to Fortytwo, Houston recently covered the Donna Summer epic “Last Dance” on the album Disco Tribute to Donna Summer. “She was a wonderful person,” Houston says about Summer. “I was, of course, devastated —as everyone was — because nobody even knew that Donna was ill. I wanted to record “Last Dance” in a way that would pay homage and not to try to copy her and the way she did it, but hopefully in a way that she would like and enjoy.” Houston sees much promise in today’s artists. “I listen a lot of newer stations on Sirius radio because I have grandkids, and I listen to a lot of the music they listen to,” she admits. “But as for music I have personally bought … let me see. Adele and Beyoncé — I think she’s a very good entertainer — and I like Jessie J and Alicia Keys. The ones I think are going to have longevity.”

Same-Sex Couples Recognized Under New Tax Guidelines

The U.S. Department of the Treasury announced last week that when it comes to taxes, it would recognize same-sex couples’ marriages even if they live in a state that does not. The decision, which was prompted by the U.S. Supreme Court’s ruling to overturn the Defense of Marriage Act, marks the latest political progress for the lesbian, gay, bisexual and transgender community. Prior to this spring, the Internal Revenue Service did not recognize samesex married couples pursuant to section 3 of DOMA. Once DOMA was overturned in June, the question became; What about samesex married couples who moved to a state that didn’t recognize their marriage (a couple married in Massachusetts who moved to Arkansas, for example)? Last week’s ruling by Treasury Secretary Jacob Lew provides a uniform policy for the IRS; the state of celebration -- where the wedding took place -- now trumps the state of residency when it comes to federal tax status for same-sex married couples. “Today’s ruling provides certainty and clear, coherent tax filing guidance for all legally married same-sex couples nationwide. It provides access to benefits, responsibilities and protections under federal tax law that all Americans deserve,” Lew said in a statement. “This ruling also assures legally married same-sex couples that they can move freely throughout the country knowing that their federal filing status will not change.” The new policy, which was first shared by Lew in a conference call that included LGBT advocates, holds a bit of political significance. It was the burden of federal tax law on same-sex couples, after all, that prompted the legal challenge to DOMA in the first place.

Edie Windsor, the plaintiff in the DOMA case, sued the government after being forced to pay estate taxes following the death of her wife, Thea Spyer. Had they been a heterosexual couple, Windsor’s tax burden would have been zero. After DOMA was overturned, it was reported that the IRS owed Windsor $363,053. Under the new Treasury policy, all federal tax provisions where marriage is a factor, including filing status, employee benefits, IRA contributions, earned income, child tax credits, and income, gift and estate taxes, will apply to same sex couples regardless of where they live. On the other side, gay couples also will now be subjected to the so-called marriage penalty, in which some (usually uppermiddle class) joint filers incur a higher tax burden than they would if they filed as single people. The policy only applies to married couples, and not those in domestic partnerships or same-sex unions. “With today’s ruling, committed and loving gay and lesbian married couples will now be treated equally under our nation’s federal tax laws, regardless of what state they call home,” said Human Rights Campaign President Chad Griffin. “These families finally have access to crucial tax benefits and protections previously denied to them under the discriminatory Defense of Marriage Act.” The Treasury’s actions on Thursday are just the latest in a set of LGBT policies offered by agencies within the Obama administration following the DOMA ruling. The Federal Election Commission, and Departments of Health and Human Services and Homeland Security, also extended federal benefits to gay couples in states that don’t recognize their marriages.

Questions For The Marriage-Go-Round By Christopher Heritage

We have been partners and shared everything for many years. Is our relationship a Common-law Marriage?

The relationship must meet very specific requirements, which vary by jurisdiction: - Length of time - Cohabitation - Couple must present themselves as a married couple (with documentation) - Each person must be free to marry

California does not validate common-law marriage, so no matter the length of time or the circumstances of your personal or financial relationship, if you resided in this state during that time, you are not in a common-law marriage. However, such marriages are valid for residents in nine other states and the District of Columbia. Only four of those jurisdictions permit same-sex marriage and have ruled, or could find, that same-sex common-law marriages of their residents are legal: Iowa, Rhode Island, Washington D.C., and New Hampshire (for inheritance purposes only).

California and all other states do recognize common-law marriage if it was legal in the state where it occurred. This means that you can’t move from a state where it was valid, to another state not validating such marriages, and just have it go away. Like all traditional married couples, common-law marriages have to be dissolved under state divorce laws. If you are in a common-law marriage which was valid in Washington D.C. and you move to Los Angeles, you are legally married under California law, and you must file for a dissolution here if you want to end the relationship.

Since the U.S. Supreme Court DOMA decision, and return of same-sex marriage to California, I have been bombarded with questions from couples who are in a marrying mood. Here are two common queries:

We are getting married next month. We heard we should have a Pre-marital Agreement because California is a Community Property state. What does Community Property mean? When you marry and establish residence in California (or one of the other eight community property states in the U.S.), generally all property acquired during marriage that is not established to be separate property belongs to both spouses. Each spouse acquires an automatic half interest. Community property includes: - Salary, wages, compensation for work performed during the marriage - Assets from labor and skills of each spouse; income from community property assets, and any separate property that has been changed into community property - Anything that can be bought or sold, such as a house, cars, furniture - Bank accounts, cash, pension plans, stocks, a business, life insurance - Any other assets (and debts) that are not a gift or an inheritance Separate property is anything you have that you owned before you were married, and that you have kept separately after the marriage. Commingling community and separate property will change the separate into community property, unless the separate component can be clearly traced. For example, a person was working and vested in a retirement fund before he married. Once married, his continued work and contributions to the fund are community property. The amount earned in the fund before marriage remains as his separate property. The amount earned after marriage belongs half to his spouse. If you have been partners for many years, do you want to maintain your established financial arrangements after marriage? Are there assets you want to keep separate? Have you commingled your separate assets over the years? A Pre-marital Agreement can sort out your finances and keep your property where it works best for you. Already married? Post-marital Agreements can provide the same legal protection and security. hey doc! What Vitamins and Supplements Should I Be Taking? By Jeffrey S. Dunham, M.D. This is one of the most frequently asked questions I hear in my practice. About one-half of all Americans take some type of vitamin, mineral or supplement – an estimated 30 billion dollars worth in 2011! But are they healthier because of it, or are they just wasting their money? Could some of those supplements even be harmful? I always ask my patients to bring me a list of all the supplements that they’re taking. Most are taking a multivitamin, but some bring me a list two or even three pages long. What I’ve found is that many patients are taking a lot of unnecessary supplements, and usually not a high enough dose of the ones they actually need. I only recommend the supplements that have shown to be beneficial in studies published in highly regarded medical journals. I continually update my list when new, well-designed studies are released. Here’s my current list (in order of importance): 1. Vitamin D3, 5000 units per day. Vitamin D has been shown to kill precancerous cells and lower the risk of colon, skin and prostate cancer. It’s necessary for the absorption of calcium to maintain strong bones, and can prevent osteoporosis and bone fracture. Most doctors now recommend 1000 units per day, but I’ve found that most patients don’t achieve optimal levels at this dose. I usually recommend 5000 units, and will even recommend up to 10,000 units for patients with a strong family history of colon cancer or patients taking HIV medications (who typically have very low levels of vitamin D). 2. Low-Dose Aspirin (81 mg), 2 tablets/day. Aspirin not only lowers risk of heart attack and stroke, but also can lower risk of cancer. 3. Selenium, 200 mcg per day. Selenium lowers risk of prostate cancer and probably other cancers as well. 4. Vitamin B6 (100 mg per day), Vitamin B12 (300 mcg per day) and Folic Acid (1600 mg per day). I’ve grouped these vitamins because taken together they will lower homocysteine levels (an important risk factor for heart disease). Most multivitamins will contain the appropriate amounts of vitamin B6 and vitamin B12, but not enough folic acid (usually only 400 mcg), so you’ll usually need to take an additional folic acid supplement.

5. Vitamin C, 1000 mg per day. One of the best antioxidants, vitamin C can supercharge your white bloods cells to prevent infections. 6. Coffee. You’re probably asking, “Coffee? Really?” If you don’t have high blood pressure, coffee is actually good for you! Multiple studies have shown the same effect: drinking coffee lowers mortality rates for all causes except cancer. The more you drink the better. And surprisingly, it doesn’t matter if it’s regular or decaf! There are about 1000 active ingredients in coffee, but so far, researchers haven’t figured out which ones provide the benefit. 7. Coenzyme Q10 (200 mcg per day). Also known as, ubiquinone, this vitamin is a key player in generating energy in all cells. It’s especially important if you’re taking statin-type, cholesterollowering medications (like Lipitor), because statins inhibit your body’s own production of this critical vitamin. I no longer recommend Fish Oil or Vitamin E. Recent studies have shown that both may increase the incidence of prostate cancer, so the risk of taking these supplements may outweigh the benefit for some patients. Recommending supplements can sometimes be a hard sell. You’ll never know if that vitamin, mineral or supplement actually prevented you from having a heart attack or getting cancer. My patients on testosterone replacement often thank me for their increased energy, libido and erectile functioning, but no one has ever thanked me for not getting a disease. That one extra heart attack per 1000 patients followed in a study doesn’t mean much, unless, of course, that one extra heart attack is yours.

For most, the thought of the working out and dieting doesn’t sound like Fun! Nevertheless, it can be, you just have to look at it differently. It becomes a lifestyle change, instead of I can’t have this or that, and working-out is so hard, think of the flip side, the results… fabulous at 50 or sexy at 60. I get asked often about diets, can I recommend one to lose 10 pounds. I say sure, but what is your goal? To attend a wedding, high school reunion, or some other special event. OK, just as long as you know you’re going to gain the weight back shortly thereafter. People have to know that the (diet) is everything you eat; your diet is the food you consume. We have to stop looking at a diet as restricting. Many fitness trainers, nutritionist, and doctors, will say no dairy, no carbs, no bread, no, no, no, no, and unless there is a medical reason, it doesn’t have to be no. It’s more about moderation and healthier choices. In moderate terms, you put bad gas in the car, good luck! Good gas, oil changes, etc…you get a smooth, clean running machine. For some, the no theory is very helpful, especially in the beginning; it shocks your system into change. And yes, you do lose the initial weight. But how many times have you heard or said, “I have tried every diet in the world and to no avail”. So, going back to the initial question 10 pounds short-term or changing your diet for a happier healthier you. A healthy diet consists of smart carbs, protein, fruits and vegetables and a good fitness program. Now of course, there are some restrictions…like that overpriced, double mocha latte that is screaming healthy. But don’t look at it as no, think of it as a treat, instead of it being a daily have, go for once a week. Your wallet and body will thank you. For fitness, go to the experts. Tell them what you want to accomplish, and ask questions…and that’s just what I did.

MIX IT UP, “Your body can easily adapt to a weekly workout routine, not to mention you can get bored and loose interest. Mix it up with some classes, cross training, Olympic lifting or a game with friends in the park. Goals are key: whether it’s a personal best in the gym, training for the AIDS Life Cycle or a mud covered obstacle course with friends it will give you a reason to keep training on days you just want to give up. …don’t kill yourself for unattainable goals. Being healthy and confident is much more sexy . . . it’s also more attainable & sustainable.” As Eli says, Mix it up…that’s where the fun comes in. Set goals, workout with a partner, listen to your favorite music. As for your diet, remember it can also be fun. Think of new ways to do healthy. Question: Angelina Jolie has been in the news lately following her brave decision to have a bilateral mastectomy. It seems very radical to have both breasts removed. My girlfriend and I BOTH have a family history of female –related cancer. Should we consider something this radical? Jane, Palm Springs, CA Answer: That is a tough question, Jane. I definitely recommend yearly mammograms and a frank discussion with you and your partner’s gynecologists as part of your yearly physical evaluation. In the case of Ms. Jolie, she had her DNA analyzed after she lost her Mom and Grandmother to ovarian cancer. She has a positive genetic marker, BRCA1, for the development of breast or ovarian cancer possibly in her future. She runs an 87% risk of breast CA and a 54% risk of ovarian cancer. She, fortunately, has the means to be extremely smart and proactive in support of her future health and welfare. There is a website called 23andme.com where you can order DNA testing kits and find out if you have any genetic markers placing you at increased risk of the known markers for cancer and other chronic debilitating diseases. This is extremely beneficial information that can prompt testing of your children, if applicable. Question: I have a question about the safety of BOTOX. It is hard to find anyone who hasn’t had an injection in his or her face. I am turning 50 and would love to ‘get rid of my wrinkles. Is it safe to inject this toxin into your face, really? Lois, Rancho Mirage, CA Answer: BOTOX is pharmaceutical,

very dilute botulinum toxin. It also is available as Dysport as well. BOTOX is the original solution that has been used for a variety of purposes including lessening or eliminating migraine headaches, and relaxing facial tics. It is extremely effective at relaxing the smooth facial muscles of the face, thus smoothing your deep and superficial wrinkles. Like all pharmaceuticals, it has some potential negative side effects. More and more, there are neurological contraindications to using this injectable in the face including Guillain-Barre syndrome, and several others. It also is temporary and has to be repeated every 3 to 6 months. If you like the effect, you may become psychologically addicted and ‘need’ your injection when the effects start to wear off. Ultimately, you have to inform yourself fully and weigh the potential desired result against the negative contraindications. Question: I have a follow-up question regarding high blood pressure from last month’s issue. My doctor told me that I have high blood pressure, but when I check my pressure in the morning at home, as you suggested, it is normal. He wants me to take HCTZ, a diuretic. What is your advice? Jason H., Palm Springs, CA Answer: First, you need to tell your physician that your blood pressure is normal when you are not in his office if you haven’t already. Historically, blood pressure is lowest first thing in the morning. In addition, there is a well-documented symptom called White Coat Syndrome, which can cause your blood pressure to rise when you are anxious, like

waiting to see the doctor or using excessive caffeine in the morning. There are many causes of elevated blood pressure so make sure that you are fully worked up by your physician to see what the real cause of your ‘transient’ elevated blood pressure is.

For Activists, Gay Gets Complicated By Steve Bolerjack

You found the conviction (and some testosterone or estrogen, as the case may be) to come out, already. (Again, I stress the good fortune involved here: if you did all this and somehow avoided estrangement, banishment, substance abuse, exploitation, depression or suicidal contemplation, you were indeed lucky or maybe just stronger than you thought.)

For those of us in a certain age bracket, it used to be fairly straightforward (if you were lucky): you survived the silent anxiety of your confused adolescent sexuality, fumbled around experimenting here and there, worried, maybe found some kindred spirits at college or anyplace away from home, worried some more, furtively educated yourself, learned about Stonewall, finally had a meaningful same-sex experience and gained a little confidence. You realized that gay people are indeed part of society and deserve the same rights as everyone else. There’s nothing wrong with you after all!

If you were especially assertive, passionate or really liked to talk, activism probably appealed to you. From there it was a clear path. Gay liberation movements and pride parades were active on both coasts in the 1970s and it was immensely satisfying to march and dance and shout with newfound colleagues, even if it tended toward stuff like “we’re here, we’re queer” and “hey, hey, ho, ho, homophobia’s got to go.” Early gay rights efforts could certainly have used some better writers but the message was simple: “it’s perfectly alright to be gay, we’re just as good as you so stop persecuting us about it.” Well, there is obviously still a need for even that plain message to be constantly reiterated. But it’s now only one of many. “Gay liberation” has evolved from simple, heart-felt and probably


view naïve grass-roots activism into an unwieldy directory of LGBTQ “communities” with various messages, objectives, spokespersons, audiences and grudges. Sometimes their efforts are in sync, but sometimes, there is disagreement if not outright conflict. The latest row has been between groups working on two major gay issues: marriage equality and HIV/AIDS. Some in the latter group feel that media focus, funds and volunteerism have been overly shifted toward the marriage issue, to the detriment and decline of interest and resources to fight the disease. A serious rupture? I don’t think so, but illustrative of how complex gay-related public policy issues have become since the early days. Yet at closer glance, they remain truly interrelated. Marriage equality has repercussions for those living with HIV/AIDS in terms of longtime support, shared insurance, medical benefits and survivorship rights, while the option of actually being legally married may help reduce risk of new HIV infections. Were I a freshly out, energetic, activist-minded (and much younger) man, I’d be somewhat nonplussed as I tried to figure out where I might fit in today’s multi-faceted world of LGBTQ-HIV/AIDS (and whatever other abbreviations I can’t remember) activism. The menu is quite lengthy—in addition to marriage equality and AIDS,

it includes immigration rights, adoption, passage of the Employment Non-Discrimination Act (ENDA), ending gay-bashing and worse violence, fighting religious prejudices, addressing substance abuse, preventing suicides, rescuing runaway, homeless teens, working to elect pro-LGBT candidates and helping transgendered people overcome tremendous bias. And as if that weren’t enough, we now must add Vladimir Putin, his ominous anti-gay persecutions in Russia and the 2014 Winter Olympics to boot. It’s rather like choosing electives on your college syllabus--which courses shall I take? Or more realistically, which issues do I have the time, energy and passion to work on? The point is, if you have the slightest outrage or concern about addressing anything on the above lists, don’t hesitate to become an activist. In fact, please do. It’s an item on your resume you’ll never regret. Despite some successes, saying that much needs to be done among all gay communities is a vast understatement--they all need any help you can give. I concur with ACT UP founder Peter Staley, who has dedicated his life to AIDS activism: “No one is asking to give up the fight for marriage equality. We are a strong community. We are capable of doing more than one thing at a time.”

Thinking Happy Thoughts for Andie

Golf Tournament at The Classic Club On August 10, 2013, Andie Jaeger’s life changed in an instant. Andie suffered a seizure while out with her husband and 2 of her 3 children. She was rushed to Eisenhower Medical Center in Rancho Mirage, where she remained for 18 days. During her first few days of care, Andie had 3 MRI’s, an EEG, a CAT scan, and lots of blood drawn. When the first of the MRI results came back, they revealed a mass nearly one inch in size on the left side of her brain, and a smaller mass on the right side of her brain. After two spinal taps, two more MRI’s, and a biopsy, on August 23, 2013, the doctors confirmed the worst, and Andie was diagnosed with Grade 4 Glioblastoma, the most common and most aggressive malignant primary brain tumor in humans. Her treatment protocol is still being decided but will likely include surgery, radiation and chemotherapy. Please support this family and help them through this challenging time.

Coachella Valley’s Pride Organization By Ron deHarte Pride 2013 might be a distant memory for many across the country but for us in Coachella Valley we are just getting started. In just a few weeks, our community will host the largest celebration of equality and diversity it has ever seen and I thought it would be a good time to share some of the fundamentals of Palm Springs Pride. I’ve had the pleasure of serving on the board of directors of Greater Palm Springs Pride and managing operations for the organization for four seasons. As a 501(c)(3) nonprofit organization, Pride serves as a catalyst for celebrating the strength, equality, dignity and self-determination of the LGBT community. Formed in 1986, Palm Springs Pride produced its first Pride Festival in Palm Springs to celebrate the 1969 Stonewall Rebellion on New York City’s Christopher Street. We work year round to bring together the skills, talents and vision of our diverse community to produce the Coachella Valley’s Pride parade and two-day festival, which last year attracted 70,000 participants to downtown Palm Springs and Sunrise Park. Programs of the organization have included the Pride Parade and Pride Festival, Pride Honors Awards, and the unique Arenas Block Party. We also serve as the lead collaborator with Equality California to host the Harvey Milk Diversity Breakfast Coalition. We are raising awareness and drawing our community together with new programs that include the free Stonewall Equality Concert, the free OUT PSP Block Party, hosting free same-sex wedding ceremonies in the Pride Wedding Garden at Forever Marilyn, and presenting a Parade VIP Party. We will also host High Tea with the beloved Bear DJ and producer John LePage. As an organization, we are focused on four core areas of activism, awareness, community service and youth engagement. We support LGBT civil rights activism and mentorship of other Pride organizations around the world and promote awareness of Lesbian, Gay, Bisexual and Transgender individuals. Locally the Pride Parade is the largest equal rights celebration to be held in the Coachella Valley. The Pride Festival provides an inclusive and diverse celebration in an affirming and safe environment for all ages. We help raise awareness and educate a new generation with the Harvey Milk Diversity Breakfast. Palm Springs Pride is the fiscal sponsor of this annual coalition building effort. The event seeks to bring together all who support equality and justice to celebrate the memory of this influential civil rights activist.

Palm Springs Pride recognizes the importance of the Pride movement worldwide. We provide support to other organizations through mentorship, providing financial support and by sharing our experience and skills. Documenting the history of Coachella Valley’s LGBT movement is critical and Palm Springs Pride is the lead organizer of the Landmark Monument Wall of Honor Campaign to preserve and highlight the history of the local LGBT movement for future generations. The landmark monument will honor and remember important local LGBT community members and allies who have had a significant and positive impact on the LGBT community. The monument will be a visible and lasting reminder of our rich history of courage, spirit, achievement, and activism. Our community service is supported by grant funding, providing direct support and through partnerships. Palm Springs Pride provides grants to organizations that directly affect the LGBT communities in the region. Various fundraising vehicles are used to raise and earmark donations to the Pride Fund. This year, special emphasis is placed on supporting Coachella Valley Gay-Straight Alliance organizations at the region’s high schools. From time to time, we directly support community organizations by purchasing tickets, making charitable contributions, and sponsoring various events. In addition to donating event tickets, the Pride organization also subsidizes thousands of dollars annually for parade and festival entry fees. We also create partnerships with organizations enabling them to raise funds in exchange for their involvement in Pride events. Our fourth core focus is on youth engagement. Incorporating youth in the activities of Pride is a key priority for us and we are constantly looking for ways to create safe and affirming opportunities for youth to participate with the organization. As you make plans to participate in Pride events this year, please keep in mind that your support is important to make a statement and to help sustain the operations of the organization that works year round fostering pride in and respect for the LGBT community locally and globally.
