ingle-family home sales dipped again last month, falling to their lowest level since 2015, as the statewide median sale price shot up another 17 percent according to The Warren Group, publisher of The Registry Review. That year-over-year gain put the statewide median sale price at $375,000 for the month of January.

NHAR President Adam Gaudet said in a statement that the inventory shortage was the primary driver of price increases. “Demand isn’t slowing down,” said Gaudet, broker-owner of 603 Birch Realty in Concord. “If New Hampshire is going to tackle the affordability and availability crisis in a meaningful way, it means increasing that inventory.” Numbers of new condominium listings were only down 8.6 percent year-over-year, to 320. But NHAR reported 25.3 percent fewer single-family listings in January, for a total of only 706. That figure is only slightly elevated from December’s 692 when the state often

On the condominium market, the state saw 8 percent fewer sales, for a total of 244 last month. That’s the lowest number of sales in any January since 2014, when 234 were sold. The median condo sale price was $272,967, a 16 percent increase since January 2021. The New Hampshire Association of Realtors reported that there were only 931 singlefamily homes and 269 condominiums for sale last month. That’s the lowest number of listings of either property type since at least 2005, the earliest data available. The single-family listings tally was 35.4 percent lower than January 2021, while the condominium tally was 36.3 percent down over the same period.

A

mid a white-hot housing market, the National Association of Realtors hit its highest membership count ever last year at nearly 1.6 million. No doubt, some of the 101,000 folks who joined up are experienced agents and brokers who hadn’t previously seen the need to associate with the giant trade group. But many of them are probably rookies who decided to cash in on an “easy money” market in which buyers were bidding against each other for the sparsest number of houses for sale in ages. If you are considering listing your house with a new agent, though, you might want to think twice, even if she’s your favorite relative. Yes, new agents have to start somewhere. But St. Paul, Minnesota, broker Teresa Boardman warns that having a real estate license “has nothing to do with selling a home.” “It’s quite possible to take the 90 hours of instruction and pass the test without having a clue as to how to write a purchase agreement or what to do with a listing contract,” Bordman said in a column she wrote for Inman. Buyers, meanwhile, have to be careful whom they engage to help obtain financing. Regulators in 42 states have come down hard on 441 mortgage brokers who lied about completing their federally mandated continuing education courses. The guilty loan officers will pay about $1,000 in fines for each state in which they are licensed as punishment for skipping the required eight-hour classes, meant to enhance consumer protection and reduce fraud. They also must sur-

render their licenses for three months and take additional educational programs.

Florida the Worst Offender? In Florida, both buyers and sellers should have their antennae up. The Sunshine State is one of 15 states where transactional brokerage is practiced, but it is the only one where that form of nonrepresentation is not disclosed. As a result, sellers are overpaying billions of dollars in commissions, a new Consumer Federation of America report maintains. Transaction brokers are nothing more than facilitators with no obligation to either the seller or the buyer. It’s not the dominant relationship between agents and consumers in the other 14 states, but it is in Florida. Naples agent Chris Carter, who writes a blog about Florida real estate, calls transaction brokerage “the best-kept secret” in his state. And the CFA report said most real estate consumers doing business there don’t question their agents’ allegiance. They simply assume their agent is loyal to their interests. Unless a savvy consumer asks exactly what the agent’s role will be and opts for some other form of representation that cements the agent’s role as a fiduciary who works only on their behalf, they are overpaying big-time, said CFA Senior Fellow Stephen Brobeck. Not only that, but they are exposed to significant risk related to the quality and price of the property. Neither party to a sale in Florida can expect any advice from a transaction agent, Brobeck warns. Should such an agent help one or the other get a better deal, such as negotiating a bet-

ter price, he or she would be breaking the law because those kinds of things are banned by state law. Brobeck is calling on Florida lawmakers to require early and effective disclosure of all forms of representation and give consumers a choice. In the meantime, he advises consumers to demand much lower commissions because their agents have fewer legal responsibilities and less liability when they act as facilitators rather than fiduciaries.

Not Just Buyers: Renters, Too Renters need to be on their toes, too. Like airlines and hotels that quote a low price online and then toss in junk fees when you go to check out, some apartment owners are doing the same. Not to pick on Florida, but here’s an example from Tampa: An apartment’s rent is listed at one price, but when you sign up, you discover you’re also obligated to pay for pest control, cable, trash and even gate access. Because many companies use junk fees to boost their bottom lines, the Consumer Financial Protection Bureau is starting to look into them. In the mortgage space, the federal watchdog agency said add-ons not only cost borrowers thousands in application fees and closing costs, but also can act as a barrier to ownership. Beyond that, the CFPB said that borrowers are sometimes “forced to pay fees for making payments over the phone or online, or even for the servicer’s bill pay service.” And those who struggle to make their house payments often find it tough to catch up “due to the snowballing of a plethora of fees” related to their delinquencies.

If you are considering listing your house with a new agent, though, you might want to think twice.

Still, undisclosed charges like these don’t rise to the despicable level of the unethical landlords who took money under the Paycheck Protection Program and then evicted hundreds of tenants. The program was designed to allow companies to keep workers employed when their revenues were slammed during the pandemic – like apartment owners, who took a big hit because their tenants couldn’t make rent. Unlike the CARES Act, which called for a higher level of protection for tenants in properties receiving a range of federal subsidies, PPP did not bar landlords from filing evictions. But from a broad perspective, it is rather contradictory that it supported companies that engaged in behavior that is at odds with federal humanitarian policies, say Elizabeth Strom and Denise Ghartey. Writing in a recent edition of community development publication Shelterforce, Strom and Ghartey – a University of South Florida professor and an attorney with the Community Justice Project, respectively – said they found 95 landlords in three urban Florida counties (MiamiDade, Hillsborough and Orange) who received some form of federal aid but still filed hundreds of evictions while state or federal moratoriums were in effect. “Even when tenants filed court answers noting the protections of the CDC moratorium, the landlords featured here were likely to push ahead,” they wrote. These very same landlords took millions in federal emergency aid.

Fed Officials Agree on Rate Hike, Little Else BY CHRISTOPHER RUGABER THE ASSOCIATED PRESS

A

worsening inflation picture has touched off a range of opinions from the Federal Reserve’s policymakers about just how fast they should raise interest rates beginning at their next meeting in March. James Bullard, president of the Federal Reserve Bank of St. Louis, recently reiterated his call for the Fed to take the aggressive step of raising its benchmark short-term rate by a full percentage point by July 1 saying the central bank’s “credibility is on the line.” Esther George, president of the Kansas City Fed, expressed support for a more “gradual” approach. And Mary Daly of the San Francisco Fed declined to commit herself to more than a modest rate hike next month. Their comments followed a report that inflation jumped 7.5 percent in January from a year ago, the fastest increase in four decades. Prices also rose 0.6 percent from December to January, the same as the previous month, suggesting that price gains still aren’t slowing, as many economists and Fed officials have hoped. The Fed typically responds to high inflation by making borrowing more expensive, which slows spending and the pace of price increases. The most recent report on consumer inflation prompted a sharp increase in expectations for rate increases by the Fed this year. Some economists now forecast as many as six or seven quarter-point hikes. That’s much higher than the Fed’s projections in December of just three rate increases for 2022. In addition to ordinary American’s budgets, inflation is also squeezing all manner of commercial construction projects. But rate hikes intended to cool this inflation could put some out of work, especially among the nation’s lowest-paid, and are expected to push mortgages out of reach of many, particularly among the least well-off homebuyers.

Divergent Views on Fed’s Course In their remarks, Bullard and another policymaker, Thomas Barkin, head of the Richmond Fed, noted how the acceleration of prices has broadened beyond autos and other pandemic-affected industries. Even inflation measures that exclude such categories have shown sharp price rises. Still, the two officials expressed differing views of how the Fed should respond. “Inflation is very high,” Barkin said in an interview on SiriusXM. “And the more recent readings suggest it’s broader and more persistent. I think it’s timely to get started and steadily move back toward pre-pandemic levels.”

Barkin’s use of the term “steadily” suggested that he favors moving at a more measured pace than Bullard, who said last week that the Fed might even decide to raise rates before its next regularly scheduled meeting in mid-March. In an interview on CNBC, Bullard did not repeat that suggestion. But he said “inflation is broadening and possibly accelerating.” And he stood by his call for a full percentage point increase in the Fed’s key rate by July 1. An increase that large would mean rate hikes at the Fed’s March, May, and June meetings, with one of those hikes amounting to a half-point. “We need to front-load more” of the rate increases, Bullard said. “We’ve been surprised to the upside on inflation. ... Our credibility is on the line here.”

Most Officials Push Smaller Hikes No other Fed officials have publicly endorsed a half-point rate hike at an upcoming meeting, though on Monday investors were pricing in a 60 percent likelihood of such a step in March. On Sunday, Daly said on CBS’ “Face the Nation” that an increase that large could hurt the economy by potentially slowing spending too quickly. “History tells us Fed policy that abrupt and aggressive ... can actually have a destabilizing effect on the very growth and price stability we’re trying to achieve,” Daly said. Daly expressed support for a rate hike in March but stopped short of backing Barkin’s call for ongoing increases. “I see March as an appropriate time to raise the interest rate, and then we have to take in all of the information ... and make the right decision at the right time for the economy,” she said.

Another Option? Earlier this month, George weighed in on another option under consideration by Fed policy makers. She said in an interview with the Wall Street Journal that the Fed should consider selling some of the Treasurys and mortgage-backed securities that make up its nearly $9 trillion balance sheet. The Fed said after its most recent policy meeting last month that it would reduce the size of its balance sheet by letting its investments mature and not reinvesting the proceeds. Going further and actually selling some of those bonds would accelerate the process of reducing the Fed’s holdings and would likely send longer-term rates higher. Fed Chair Jerome Powell has not commented publicly since the most recent jobs and inflation reports have shown strong hiring and wage growth along with rapid price gains.

Zillow Plans Better Mortgage Offerings in ‘Housing Super App’ BY JAMES SANNA REGISTRY REVIEW STAFF

istings portal site Zillow is telling investors it plans to build a “housing super app” with the ambition to become “the central integrator” for buyers’ and sellers’ housing journeys. The prize could be big. In an investor letter the company filed with the Securities and Exchange Commission this month, Zillow CEO Rich Barton wrote that the company thinks the moves, if successful, could generate $5 billion additional revenue and a 45 percent increase in earnings by the end of 2025. Barton outlined a strategy that counts on better integrating the services the company currently offers into its listings and attracting some of the nation’s 6.1 million sellers to its platform. The company estimates around 67 percent of the nation’s homebuyers visited Zillow’s websites and apps last year, 1.4 million people – mostly buyers – initiated the process of connecting with a Zillow Premier Agent and 360,000 actually sold their home using an agent they found this way, putting the company’s buy-side market share at 5 percent nation-wide, it said. First, the company wants to beef up its listings and make them even more engaging, adding more and more 3D tours, interactive floorplans and other “personalized, immersive content.” The company also plans to

“improve” its Zestimate home valuation tool, which some commentators said showed its failings during the company’s iBuyer debacle last year. The company wound up over-paying for so many homes amid cooling demand in the fall that it was forced to shutter its iBuyer operation, called Zillow Offers. Next, Barton said, the company wants to make it easier for prospective buyers to go through Zillow’s website to buy a house by using the ShowingTime service, which it bought last year, to “make it easier” for buyers to set up tours. The company also wants to push more “intuitive and digitized mortgage offerings” to the millions of home-shoppers who browse its listings every year. Much of this may rely on integrating the company’s Zillow Home Loans service with its current listings, Barton said, which will help the company “keep customers engaged in our funnel.” And, amid a record shortage of new listings, Zillow wants to offer more products and services get more sellers into its fold. Part of this, Barton wrote, will involve using things it learned from its failed Zillow Offers experience “to stand up new, more asset-light services.” “We see expanded seller services and closing services as critical to the integration we expect to provide, and are hard at work testing and innovating on what is next,” Barton wrote.

Construction Materials Costs Soared 20 Percent in One Year

t now costs about 20 percent more to build a commercial building in the United States than it did a year ago, according to an analysis of government data by a major construction trade group. The Associated General Contractors of America analyzed data from the Bureau of Labor Statistics’ Producer Price Index to determine that the overall cost of a basket of materials commonly used in nonresidential construction jumped by 20.3 percent from January 2021 to January 2022. That increase includes a 2.6 percent increase from December 2021 to January 2022, alone. “Unfortunately, there has been no letup early this year in the extreme cost runup that contractors endured in 2021,” AGC chief economist Ken Simonson said in a statement. “They are apparently passing on more of those costs but will have a continuing challenge in getting timely deliveries and finding enough workers.” The Producer Price Index data covers several different commodities, many of which saw big jumps in money factories, distributors and trucking firms charge contractors over the last 12 months: • Steel mill products up 112 percent • Plastic construction products up 35 percent. • Diesel fuel up 56.5 percent. • Aluminum mill shapes up 32.7 percent. • Copper and brass mill shapes up 24.8 percent over the year.

• “Architectural coatings” (includes paint) up 24.3 percent. • Lumber and plywood up 21.1 percent. • Insulation up 19.2 percent. • Trucking up 18.3 percent • Construction equipment up 11.4 percent. Subcontractors’ prices are up for nonresidential work nation-wide, too. Concrete contractors’ prices are up 18.8 percent year-overyear in January, roofing contractors’ up 13.9 percent, electrical contractors’ up 11.4 percent and plumbing contractors up 9.9 percent. One bright spot may be the price of concrete: A separate index reported by the Federal Reserve Bank of St. Louis that also uses Producer Price Index data shows the price of ready-mix concrete is only up 4.5 percent in the Northeast Census region, which covers New England, New York, New Jersey and Pennsylvania. “Spiking materials prices are making it challenging for most firms to profit from any increases in demand for new construction projects,” AGC CEO Stephen E. Sandherr said in a statement. “Left unabated, these price increases will undermine the economic case for many development projects and limit the positive impacts of the new infrastructure bill.” So far, though, AGC’s research shows contractors aren’t passing all these costs onto developers and other clients, although the gap between bid prices and input costs reported by AGC has narrowed significantly since summer 2021.

This January’s total is also 33.8 percent down from January 2020, before the COVID19 pandemic struck, and one of the lowest numbers of new listings in any January since 2005. In total, the shortage of properties for sale pushed the number of months’ supply of inventory down to 0.6 for both condos and single-families, lower than what was seen in Jan-

uary 2021 and the lowest of any month during the frenzied pandemic real estate market. Gaudet said in his statement that the association saw the inventory shortage everywhere in the state, and said it is directly threatening the state’s economy. “This isn’t a local issue but a statewide one. Lack of housing is constraining job growth and making New Hampshire unaffordable for too many workers,” he said. “Our economy depends on a healthy housing inventory.”
