As Lawmakers Eye Statewide Housing Solutions, Local Control a Barrier

Many Bills Look to Override Municipal Zoning

The goal behind the bill is bold: Allow any property owner to build residential housing units in a commercial zone –whether the zone allows for it already or not.

Proponents of the legislation, House Bill 1053, argue it is a way to fast-track the creation of “mixed-use” housing in New Hampshire, allowing developers to increase the number of housing units in the state by opening new areas.

“We need to loosen zoning restrictions to make it easier to build new housing or to allow people to occupy existing structures,” said Rep. Eric Gallager, a Concord Democrat, speaking to his fellow members of the House Municipal and County Affairs Committee March 11. “If you’ve got a business leaving, fine. That’s just more room for housing. We need housing more than we need businesses right now.”

But critics rooted their opposition in a handful of words that would give property owners much more power over cities and towns: “as a matter of right.”

Legislation Under Consideration

“Any time I see a bill that says ‘as a matter of right,’ that compels top-down zoning, I’m against,” said Rep. Len Turcotte, a Barrington Republican and chairman of the committee. “It’s just something I’m not willing to do.”

The exchange underscored a tension at the heart of New Hampshire’s push for more

housing: How much should towns and cities get a say?

This year, a number of bills would override certain town and city zoning codes, with an aim to expand housing construction by skirting local barriers. Housing advocates say that approach is the only one to address what has become an entrenched problem. Others see a move to undermine local control. And they argue that any growth in housing in New Hampshire should happen with town officials’ direct approval.

HB 1053 will likely not survive: At the start of this month, the committee recommended, 15-2, the bill be killed, and the full House will take up that vote in the next few weeks. But there are other bills that attempt to give homeowners and developers similar rights. House Bill 1400 would prohibit city and town zoning and planning committees from requiring more than one parking space per unit. Some towns require higher numbers, which advocates say can discourage development.

How to Read The Real Estate Records

documents are collected.

Whenever possible, we combine the separate deed and mortgage documents so that we can present one complete record of the street address, purchase price, lender and mortgage amount. When we cannot link a deed with a mortgage (and vice versa) each transaction appears individually.

Real estate records are organized alphabetically by registry, then town, then by street name.

The amount appearing on the same line as the street address is the purchase price from the deed. We print “No Amt Given” when the amount did not appear on the document we review. “No Street Given” appears in place of the street address when it was not available. The volume, page of the deed and filing date appear for all sales.

The mortgage lender and the amount of the mortgage used to purchase the property are shown. Any second mortgage (Mtg2) filed at the same time as the deed will also appear here.

In communities where we have a file of all properties from the assessor’s office, we provide additional property details when available. This is done by exactly matching the address and seller name from the new sales record with the address and owner name found in the property file. No descriptive data appears whenever there is any doubt that the two records are the same property. The “Use” is based on the code the assessor assigns to each building on a parcel. Whenever there is more than one use code or more than one building on a parcel, we flag these as “Multi-use” and “Multi-bldg” respectively.

These deeds transfer title to the lender after the mortgage is foreclosed (unless there is a higher bidder at the auction.) The amount in these transactions is usually the amount of the outstanding mortgage that was foreclosed.

• The first two buyer (B) names and seller (S)

listed on the deed are shown.

• Prior sale data appears only when the address of the new sale matches exactly with the address of the older sale in our database.

• “Use” distinguishes residential homes from land sales and commercial sales.

• For residential homes, the number of bedrooms and house style appear when available

• The lot size (Lot) is shown in square feet.

• The prior sale shows the original price paid for the property.

You Know Curb Appeal. What About Smell Appeal?

Homebuyers are easily turned off for any number of reasons.

Maybe the place looks like the home of a candidate for hoarder of the year. Or perhaps the windows are so dirty you can’t see outside.

But other than curb appeal, or the lack thereof, nothing turns up buyers’ noses faster than a smelly house. They walk in, stop, take a whiff and are ready to turn around and leave. Some won’t even go beyond the front door.

Your sellers might not notice the smell. After all, they live with the offending odors day in and day out, so they are used to them. So used to them that they don’t even register on their olfactory scale. But they sure do with visitors.

Buyers use all five senses when looking at houses, says Joe Jackson, an agent with Keller Williams Capital Partners Realty in Worthington, Ohio, who offers this advice: “A house must smell exceptionally clean and inviting for a buyer to fully appreciate the entire house.”

Odors can emanate from practically anywhere. Most frequently, they’re from pets

or what pets leave behind. But it can be the smell that lingers when someone is smoking in the house.

Cooking emits odors, too, especially dishes heavy with herbs and spices.

Less frequent but sometimes just as repugnant are odors coming from a garbage disposal, dirty kitchen trash can, mold hidden beneath a carpet where a spill was not cleaned up properly or from a damp basement. Even a pair of old work boots stashed in the closet can be the culprit.

First Things First

Your first step is to locate the source. Then, eradicate it. You may be able to do the job all by your lonesome. A dehumidifier can help get rid of musty basement odors, and shampooing a carpeting can help remove a lot of smells. You may even have to toss the rug under the litter box or dog food bowl or perhaps even your buyer’s favorite work boots.

But if the “aroma” is too bad, you might have to ring up a pro. Professional cleaners can diagnose the problem and recommend how to fix it. They use specially formulated solutions to break down the cause and eradicate it.

Either way, though, just about the worst thing you can do is try to hide the stink, because cover-ups are often even more offending.

“Unless you eliminate the odor,” said

Patricia Feager of DFW Fine Properties in Fort Worth, Texas, “it isn’t really ever going to fully go away.”

Fortunately, there are several ways to create pleasant olfactory experiences, both natural and artificial. Each has its proponents.

The tried-and-true method is to bake bread or cookies just before a prospect is set to show up for a look-see. Bringing in a bouquet of fresh flowers also is popular among real estate agents, as is burning scented candles or cooking a pot of potpourri.

Natural scents like these “are more subtle and realistic,” said Lew Corcoran of Better Living Real Estate in Foxborough, Massachusetts, and a member of the Real Estate Staging Association.

Some Steps Have Problems

Those steps could become expensive, though, especially if your home is on the market for more than a few days and visitors are scheduled at all different times. That’s why other agents suggest less costly air fresheners and air sanitizers, but ones with a light scent that are either fruity or floral.

It sells more than 50 different fragrances, including a mix of crisp pine and fresh cut cedar, a combination of bitter orange, cypress and star anise, and a blend of bourbon, tonka and vanilla.

Whatever way you choose – natural or artificial – Corcoran, the Massachusetts agent, warns not to use too many scents at one time, or too many strong ones. Rather, he suggests just one or two complementary ones. He also advises not to use scents that are personal or specific, opting instead for those that are neutral and have a wider appeal.

NAR Settles Commission Lawsuits

The National Association of Realtors abruptly reversed course Friday morning, announcing it was settling all lawsuits against it over real estate commissions for a substantially smaller sum than it would have paid under a preliminary verdict announced last year.

NAR will pay $418 million to plaintiffs over the next four years and put in place a new rule on multiple listings services owned by its local Realtor associations that would ban offers of buyer’s agent compensation from being communicated via those MLSs. The rule would not prohibit the parties in a transaction from working out commission details on their own as part of the normal negotiations around a home sale.

In addition, Realtor association-owned MLSs representing homebuyers would require participants to enter into representation agreements with their clients.

The new rules will go into effect in midJuly, the association said, although it appears that any settlement still requires the approval of judges in the various lawsuits. NAR said that it continues to deny any wrongdoing in the settlements.

“Ultimately, continuing to litigate would have hurt members and their small businesses,” Nykia Wright, interim CEO of NAR, said in a statement. “While there could be no perfect outcome, this agreement is the best outcome we could achieve in the circumstances. It provides a path forward for our industry, which makes up nearly one fifth of the American economy, and NAR. For over a century, NAR has protected and advanced the right to real property ownership in this country, and we remain focused on delivering on that core mission.”

NAR lost the first of several high-profile federal class-action anti-trust lawsuits against its commissions policy in Missouri in October. The jury in that case awarded plaintiffs $1.78 billion in damages, a sum most observers contend NAR had no ability to pay and which would force it to settle rather than appeal.

In its announcement of the settlement, NAR claimed it would absolve all Realtor-led brokerages in the country with $2 billion or less in sales volume in 2022 of all lawsuits related to agent commissions.

Anywhere Real Estate, parent company of Coldwell Banker and Sotheby’s International Realty, along with Keller Williams and RE/ MAX had all previously settled.

NAR’s announcement said it “fought to include all members in the release” but specifically was unable to get the plaintiffs to agree to include HomeServices of America and its related companies in the deal. HomeServices is the last corporate defendant in the Missouri case that hasn’t yet settled.

“NAR exists to serve our members and American consumers, and while the settlement comes at a significant cost, we believe the benefits it will provide to our industry are worth that cost,” 2024 NAR President Kevin Sears, broker of Springfield-based Sears Real Estate, said in a statement. “NAR is focused firmly on the future and on leading this industry forward. We are committed to innovation and defining the next steps that will allow us to continue providing unmatched value to members and American consumers. This will be a time of adjustment, but the fundamentals will remain: buyers and sellers will continue to have many choices when deciding to buy or sell a home, and NAR members will continue to use their skill, care, and diligence to protect the interests of their clients.”

Latest Tuscan Village Apartments Completed

The latest addition to Salem’s resident mega-development: a new apartment complex called Caro Tuscan Village.

The 260-unit, 5-story project opened earlier this month according to an announcement from the developer, The Dolben Co., and the architect, HDS Architecture.

“True to the HDS philosophy, we have created a distinctive building that enhances the community within the Tuscan Village development,” Hans Strauch, president of HDS Architecture, said in a statement. “Working closely with Dolben and our partners, we successfully created a unique architectural identity for Caro Tuscan Village, connecting it to the vibrant and diverse offerings that Tuscan Village has to offer. Residents will truly enjoy living here.”

The development was on one of several sites around the periphery Tuscan Village that master developer Joe Faro has brought in other developers to build as part of the overall project.

Caro, for example, was Dolben’s second residential development at the site after Corsa Tuscan Village, a 256-unit, fourbuilding community and clubhouse next to Caro.

“We are thrilled to deliver our second residential community in Tuscan Village in collaboration with HDS Architecture. At Dolben, we are proud to provide renters with luxury housing options in desirable live-work-play lifestyle centers,” Dolben Executive Vice President Andrew K. Dolben said in a statement.

House Bill 1361 would require municipalities to provide “reasonable and realistic” opportunities for new manufactured housing parks and would block zoning codes that effectively bar housing parks in those towns.

Lawmakers are also entertaining House Bill 1281, which would prevent cities and towns from requiring that tenants be family members in order to live together. The bill would block any ordinance that prohibits unmarried cohabitants, such as roommates, and would strike down any zoning code that restricts rental occupants to one per bedroom.

And the House is considering a bill that would expand the number of accessory dwelling units that property owners would be allowed to build by right. That bill, House Bill

1291, is considered by some housing advocates as the best chance for broad zoning reform this year, but some have opposed it as unwarranted state intrusion.

Production Barriers Have Basis

To those looking to spur housing development, the bills address what has been seen by advocates and researchers as a key problem in New Hampshire: tight local zoning codes that prevent the homes that are necessary to meet the state’s high demand. The state’s rental vacancy rate has hovered below 1 percent for years – far below the 5 percent target set by housing researchers. And new homes for sale are scarce and expensive, with the median house still priced at $475,000, according to the New Hampshire Association of Realtors.

“By allowing homeowners to build either an attached or detached ADU on their property, and removing burdensome regulations, we can diversify our housing supply with more affordable housing options tailored to individuals at different stages of life,” testified Matthew Mooshian, advocacy and engagement director for 603 Forward, a progressive advocacy group.

Still, some local planning officials have pushed back. In testimony, Timothy Harned, the former chairman of the North Hampton Planning Board, argued that allowing additional ADUs “by right” could lead to overcrowding and a burden on municipal septic systems.

Glenn Horner, chairman of the Epsom Zoning Board of Adjustment, agreed.

“All of these large developments have really gone in a very similar path where they have really innovative proposals, and they usually don’t fit entirely within local zoning, but they get buy-in from the community,” he said.

Advocates Seek Bigger Change

The New Hampshire Municipal Association, which represents town and city select boards, also opposes the top-down approach. In testimony to the House, Natch Greyes, the association’s government affairs counsel, called it an “unnecessary intrusion on local control.”

In an interview, Greyes argued that some cities and towns are already taking advantage of the existing environment to change their zoning codes to allow more housing. Keene, Enfield, Manchester, and Newmarket have all taken steps recently to increase the number of accessory dwelling units, Greyes noted.

Lawmakers are also advancing bills that would give towns more tools to expand workforce housing in their zoning codes – a strategy that empowers them, rather than overrides them. Senate Bill 538, known as the “HOMEnibus,” includes a number of those tools, including new tax incentives towns could choose to offer developers to convert commercial space to residential space, and the creation of “inclusionary zoning districts” that towns could deploy to mandate affordable housing construction.

But advocates say the state’s deficit of units is simply too large to be solved by towns alone.

“I don’t think it’s going to be enough,” said Elissa Margolin, director of Housing Action NH, a coalition advocacy group. “We need a variety of tools. This is a very severe crisis.”

“If we only do a town-by-town approach, we’re going to end up with a really uneven landscape,” Margolin added. “So it’s OK to make sure that we’re putting policy out there that provides different kinds of tools.”
