CRE Financing Still Available –If You Can Afford It

Credit Unions Show Higher Appetite for Loans than Banks

Local bankers and commercial real estate players say there’s clearly been a slowdown in commercial real estate lending in recent months, as higher interest rates and more cautious banks have discouraged developers and investors from proceeding with many new projects across the state.

But bankers, developers and CRE brokers say there’s still activity on the lending front in New Hampshire – especially for industrial and multifamily properties – as long as developers and investors can afford higher costs associated with rising interest rates and more expensive construction materials.

“The lending market has slowed down a bit,” said Ron Magoon, chief executive of Franklin Savings Bank in New Hampshire. “Everyone is being more cautious in terms of lending. It’s a normal thing at this point in a [business] cycle. I know we’re more cautious.”

Besides higher interest rates and escalating construction costs, the fear of a possible recession is also causing unease and hesitancy within the entire development sector in New Hampshire, Magoon said.

Chris Logan, CEO of the Bank of New Hampshire, agreed that the CRE lending market has “definitely softened” of late.

But Logan, whose bank has about $1.4 billion in commercial loans on its books, said his bank hasn’t gotten more cautious with its

lending standards. This puts it in a distinct minority among American banks according to the most recent Federal Reserve survey of senior loan officers that showed around 4 in 5 U.S. banks had tightened their commercial real estate lending standards to some degree.

The real problem is simply higher interest rates and inflation in general driving up the costs for new developments, major renovations and acquisitions, Logan said.

“We haven’t tightened or loosened our standards,” he said. “But costs have risen and

real estate is simply not as profitable.”

The overall lending slowdown isn’t the same for every CRE sector.

Financing for office properties, which have been hit hard by the rise of remote working, is more difficult to obtain.

On the surface, the office sector in New Hampshire is holding steady, with a vacancy rate of 10.7 percent across the state in the first quarter, the same level for the same period in 2022, according to data from Colliers.

How to Read The Real Estate Records

The information appearing in this newspaper is taken from deed and mortgage documents filed at each of the ten registries of deeds in the state. All property transfers with a sales price of at least $100 and all term-mortgage documents are collected.

Whenever possible, we combine the separate deed and mortgage documents so that we can present one complete record of the street address, purchase price, lender and mortgage amount. When we cannot link a deed with a mortgage (and vice versa) each transaction appears individually.

Real estate records are organized alphabetically by registry, then town, then by street name.

The amount appearing on the same line as the street address is the purchase price from the deed. We print “No Amt Given” when the amount did not appear on the document we review. “No Street Given” appears in place of the street address when it was not available. The volume, page of the deed and filing date appear for all sales.

The mortgage lender and the amount of the mortgage used to purchase the property are shown. Any second mortgage (Mtg2) filed at the same time as the deed will also appear here.

In communities where we have a file of all properties from the assessor’s office, we provide additional property details when available. This is done by exactly matching the address and seller name from the new sales record with the address and owner name found in the property file. No descriptive data appears whenever there is any doubt that the two records are the same property.

The “Use” is based on the code the assessor assigns to each building on a parcel. Whenever there is more than one use code or more than one building on a parcel, we flag these as “Multi-use” and “Multi-bldg” respectively.

These deeds transfer title to the lender after the mortgage is foreclosed (unless there is a higher bidder at the auction.) The amount in these transactions is usually the amount of the outstanding mortgage that was foreclosed.

Are Buyers with Good Credit Really Being Penalized?

No one should deny anyone an equal shot at the American dream. A leg up may even be warranted.

But should people who have worked hard to build decent credit and squirrel away funds for a down payment pay a little higher mortgage rate – all to help secure a lower rate for those who haven’t done the same?

That’s what some in the mortgage industry say will happen with the new government loan-level pricing adjustment requirements.

The new pricing structure has been partially in effect as of May 1, after having been postponed once before. Additional rules are set to take effect Aug. 1. But shifting deadlines haven’t stopped the issue from becoming something of a political football.

Two Republican lawmakers have introduced separate bills, one with more than 30 GOP co-sponsors, to cancel the new pricing structure. And fiscal officers from 27 state governments have asked President Joe Biden and Federal Housing Finance Agency Director Sandra Thompson to scrap it.

But Thompson said their reading of the new pricing structure is off-base. In an unusual statement aimed at “setting the record straight,” the FHFA director said the notion that borrowers with higher credit scores will be charged more to subsidize those with lower scores is just plain wrong.

“Much of what has been reported advances a fundamental misunderstanding about the fees charged by the Enterprises, and why they were

updated,” Thompson said in her statement.

(“The Enterprises” are Fannie Mae and Freddie Mac, the two government-sponsored entities, or GSEs, that purchase mortgages from Main Street lenders.)

Thompson explained that the new pricing is intended to bolster the safety and soundness of Fannie and Freddie, which have been under conservatorship since they flirted with failure almost 15 years ago during the Great Recession. Noting GSE pricing hasn’t been updated for “many years,” she also said the new structure will “more accurately align” prices with the risks associated with the loans purchased by the entities.

But Thompson went further, adding that the new pricing will “better ensure the Enterprises fulfill their statutory missions.” That includes supporting low- and moderate-income families.

And that is where the misconceptions arise.

“Higher-credit-score borrowers are not being charged more so that lower-credit-score borrowers can pay less,” she said. She points out that lower upfront fees for borrowers with lower incomes – not lower credit scores – are supported primarily by higher fees on loans for second homes and refinances, not on conventional loans for the purchase of primary residences.

An ‘Outrage’?

But John Meussner of Mason-McDuffie Mortgage in Fair Oaks, California, is one lender who sees it differently. He thinks the new pricing structure is an “outrage.”

“Personally, I’m all for giving price breaks to people with lower credit and lower down payments,” McDuffie posted on the ActiveR-

ain real estate site. “My concern is that those ‘price breaks’ are being subsidized by charging those with excellent credit and money to put down additional fees.”

Dorie Dillard, a Coldwell Banker agent in Austin, Texas, also questioned the new fee schedule, calling it “absolutely unfair.” Instead of being rewarded for fiscal responsibly, she griped, some borrowers

“are [being] penalized!”

Rob Spinosa of Guaranteed Rate in Marin County, California, has a different view, though. While it will be less expensive for some borrowers and more expensive for others, he is certain that there will be “zero” chance that a bad-credit borrower will get a better rate than one with good credit.

Is New System Workable?

Others question the workability of the new pricing system. Mortgage Bankers Association President Robert Broeksmit said the change would be a nightmare for both lenders and their customers – creating operational and compliance challenges for lenders while leading to “a frustrating and confusing experience” for borrowers.

Say, for example, you apply for a loan at a certain rate and are approved by a lender. But before you reach the settlement table, your lender said your rate will have to increase a bit because the insurance premium on the house you’re buying came in higher than anticipated, which raised your debt-to-income ratio.

Or maybe your income took a bit of a hit when your employer cut you back from five days a week to four. You still earn enough to qualify, but because your DTI ratio is now higher, you’ll have to accept a higher rate than

you were originally quoted.

“A borrower’s income and expenses can change multiple times throughout the loan application and underwriting process,” Broeksmit warned. “The resulting fluctuations in DTI could result in multiple changes to a borrower’s loan pricing in the period between application and closing.”

Some Bewildered by Changes

Todd LaBorwit of Topaz Mortgage in the Washington, D.C., region said he’s bewildered by the new pricing – so much so that he hasn’t a clue how to advise his clients.

“I don’t know what to do,” he told me. “I’ve never seen anything like it in my life.”

Thompson of the FHFA said the new pricing framework does not encourage a borrower to make a lower down payment to benefit from lower fees. She also said some updated fees are higher and some are lower, but that they don’t represent pure decreases for high-risk borrowers or pure increases for low-risk borrowers. Many borrowers with high credit scores and/ or large down payments will see their fees decrease or remain flat, she promises.

David Stevens, a former Federal Housing Administration official and previous leader of the MBA, said that he’s opposed to the changes because he fears Fannie Mae and Freddie Mac are being politicized – “whipsawing” the GSEs based on whichever party is in power.

But in the end, Stevens believes, “borrowers really won’t know the difference in any significant way.”

NAR Economist Blasts Fed’s Latest Rate Hike

The Federal Reserve reinforced its fight against high inflation Wednesday by raising its key interest rate by a quarter-point to the highest level in 16 years. But the Fed also signaled that it may now pause the streak of 10 rate hikes that have made borrowing for consumers and businesses steadily more expensive.

In a statement after its latest policy meeting, the Fed said that while the banking system is “sound and resilient,” the upheaval in the financial system could slow borrowing, spending and growth. It reiterated that the impact of pullback in bank lending “remains uncertain.”

The Fed’s rate increases over the past 14 months have more than doubled mortgage rates, elevated the costs of auto loans, credit card borrowing and business loans and heightened the risk of a recession. Home sales have plunged as a result. The Fed’s latest move, which raised its benchmark rate to roughly 5.1 percent, could further increase borrowing costs.

Yet the Fed’s efforts have only partly succeeded in taming the worst inflation bout in four decades, and the surge in rates has contributed to the collapse of three large banks and turmoil in the banking industry. All three failed banks had bought long-term bonds that paid low rates and then rapidly lost value as the Fed sent rates higher.

panies they backed, many of which rushed to pull millions in deposits from SVB overnight.

that a cutback in lending by banks, to shore up their finances, could act as the equivalent of a quarter-point rate hike in slowing the economy.

Fed economists have estimated that tighter credit resulting from the bank failures will contribute to a “mild recession” later this year, thereby raising the pressure on the central bank to suspend its rate hikes.

The Fed is now also grappling with the threat of a prolonged standoff around the nation’s borrowing limit, which caps how much debt the government can issue. Congressional Republicans are demanding steep spending cuts as the price of agreeing to lift the nation’s borrowing cap.

Lawrence Yun, chief economist at the National Association of Realtors, criticized the Fed’s move, citing data that showed year-overyear inflation has cooled substantially.

“The latest interest rate hike by the Federal Reserve is unnecessary and harmful. Consumer price inflation has been decelerating and will continue this trend” Yun said. “In addition, there is significant additional monetary policy tightening already occurring. The fast rate hikes by the Fed have upended the balance sheets of many small regional banks. They are becoming zombie-like banks, unable to lend even to good businesses as they are more concerned with balance sheet shuffling for survival. This situation will worsen with each additional rate hike by the Federal Reserve. Only by stopping the rate hikes or even a reversal later in the year after verifying much calmer inflation rates will the small banks have a better chance of survival against the big banks.”

The FDIC says it should be given the ability to insure some bank account balances above its standard $250,000 cap in order to preserve financial stability in the future.

The cap, which Congress has raised multiple times from the $2,500 level first set when the FDIC was created in 1933, applies to all accounts but in a statement issued Monday afternoon, FDIC Chairman Martin Gruenberg argued that it needs to be raised “significantly higher” for business payment accounts.

“The recent failures of Silicon Valley Bank and Signature Bank, and the decision to approve Systemic Risk Exceptions to protect the uninsured depositors at those institutions, raised fundamental questions about the role of deposit insurance in the United States banking system,” Gruenberg said.

While 99 percent of the nation’s bank accounts remain below the $250,000 threshold, a large chunk of the dollars on deposit at America’s banks are currently uninsured. The share peaked in 2021 at 47 percent, Gruenberg said, higher than at any time since 1949. On top of that, he said, uninsured deposits represent a significant share of the largest banks’ funding, creating the potential for bank runs that threaten financial stability – a risk made worse by the speed at which fears of a bank’s solvency now travel.

Meanwhile, office rents were also up 3.5 percent year-over-year in the first quarter, according to Colliers data.

But the net office absorption rate across the state was down by about 160,000 square feet year-to-date in the first quarter, compared to the same period in 2022.

That and other warning bells about the future of office properties have prompted Brady Sullivan to propose conversions of office space into apartments at the old Cigna building in Hooksett and at 1230 Elm St. in Manchester.

Brady Sullivan executives couldn’t be reached for comment on how the firm plans to finance the two conversion projects.

But CRE brokers say the conversions of office properties to multifamily housing is indicative of where the lending market is headed.

“The office sector has taken it on the chin,” said Thomas Farrelly, executive director at Cushman & Wakefield of New Hampshire.

“For office REITs and other investors, there’s

more concerns about office properties.”

Farrelly and others stress: There haven’t been any major defaults on office loans in New Hampshire, and some question if there ever will be.

But office properties are clearly seen as riskier investments – and riskier loan prospects -- these days, industry observers say.

One popular investment and lending sector remains industrial properties, particularly warehouses serving booming e-commerce firms that need strategically located fulfillment centers for business and home deliveries.

In the first quarter of 2023, the vacancy rate for New Hampshire industrial properties was 2.9 percent, down from 3.3 percent in the same period in 2022, according to Colliers. Rental asking prices, meanwhile, were up 33 percent in the first quarter compared to 2022.

According to Colliers, the 94,000-square-

foot warehouse/distribution building at 16 Swamscott St. in Newfields sold for $5.15 million, or $55 per square foot, to a Massachusetts-based investor in the first quarter.

The 44,000-square-foot warehouse/distribution facility at 340 Commerce Way in Pembroke was purchased by a local investor, Ben Kelley, for $2.9 million or $66 per square foot in January, Colliers reports.

Meanwhile, the 60,000-square-foot flex building at 1 Hampshire Drive in Milford changed hands in January, selling for $2.9 million – $49 per square foot – to a New York-based investor.

“Industrial is still No. 1,” said David Eaton, managing director of Colliers in New Hampshire. “Industrial properties remain strong. I don’t see that changing.”

CUs Show More Interest

As for CRE lending in general, Eaton said credit unions appear to have a “larger appetite” for lending than commercial banks.

He said a recently floated CRE deal attracted strong competitive bids from credit unions – and four “less competitive” bids from commercial banks.

Eaton said he doesn’t quite know why banks seem to be more cautious than credit unions, but it might be due to recent bank failures and increased regulatory scrutiny of banks compared to CUs.

As for the potential for CRE defaults in New Hampshire, Eaton said there’s always the potential for major defaults, but he said he’s not sure it’s a big concern.

The reason: The state’s CRE market never got overheated in recent years, thus minimizing the chances of major defaults on outsized loan resets, he said.

Bank of New Hampshire’s Chris Logan agreed that loan defaults appear to be more of

Gruenberg’s statement accompanied a report analyzing three options: keeping the current uniform cap structure, providing unlimited coverage for all accounts or raising it in a “targeted” fashion to cover accounts businesses use to pay regular operating expenses like salaries or vendor invoices.

“While acknowledging that deposit insurance can create moral hazard by providing an incentive for banks to take on greater risk, the report underscores that regulation, supervision, and deposit insurance pricing are essential for helping the deposit insurance system meet its financial stability and depositor protection objectives while constraining moral hazard,” Gruenberg said.

The report and the statement do not represent a formal proposal to change the deposit insurance structure, but instead are intended to kick off “an informed public discussion” on whether and how the deposit insurance system should change in the wake of the March banking crisis, Gruenberg said.

In a press release announcing the report and Gruenberg’s statement, the FDIC said that some level of congressional action would be needed to implement any of three changes the report outlines, but added that some aspects could be implemented using the agency’s existing powers.

The current deposit insurance system doesn’t define what a business payment account is or isn’t, and the FDIC’s report acknowledges that setting up that structure would be core to the overhaul it describes.

“Delinquencies are still at historically low levels,” he said of CRE loans in general across New Hampshire.

Tuscan Village Developers ‘Comfortable’

Glenn Verrette, executive managing director of Tuscan Brands Real Estate, sees no problem in securing financing for his firm’s ongoing redevelopment of the old Rockingham Park racetrack site in Salem.

The firm has already developed and opened 1.4 million square feet of mixed-use space at Tuscan Village, with plans to develop and open an additional 2.6 million square feet in coming years.

Boston-based Berkshire Bank has been the lead lender of the Tuscan project to date, with other New Hampshire and Massachusetts banks also involved in financing as well, Verrette said.

“Any real estate company, including ours, is sensitive to the lending environment,” he said.

“The higher interest rates have increased our costs. But we’re comfortable moving forward. We go through a very rigorous financial review process before proceeding [with construction]. We have parcels ready for development.”

Sal Lupoli, owner and CEO of The Lupoli Cos., said he’s currently eyeing possible mixed-use developments in the Manchester and Concord regions – and doesn’t see any problems lining up financing for the largely multifamily projects.
