MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
The Assisted Decision-Making Act 2015 commenced on 26th April 2023. The act abolishes wardship from Irish Law for adults. Traditionally when an adult was taken into wardship it meant the President of the High Court was satisfied based on medical evidence that the person lacked legal capacity and was incapable of managing his or her own affairs. A committee was then appointed to make decisions on the wards behalf and furthermore consent had to be sought from the high court if that person was to leave the jurisdiction or have medical procedures. The new act recognizes that as far as possible all adults have the right to play an active role in all decisions that affect them and requires all wards to be discharged within 3 years of the commencement of the act and replaced by one of the new assisted decision-making provisions if necessary. The 2015 act offers 3 types of decision supporters for people who currently face challenges when making decisions:
1. Assisted Decision Maker: The role of an assisted decision maker is to assist the relevant person when making decisions by helping gather information and help analyse the consequences of each decision, it is not their role to make decisions for the person. A decision-making assistance agreement will be made, and it will state the decisions a person e.g., Eddie above will require help with.
2. Co- Decision Maker: The role of a Co- Decision Maker is to make decisions with the person, it is necessary that the relevant person’s values are taken into consideration, and they can help e.g., Eddie understand decisions which must be made and weigh up his options. It would give Charles legal recognition to access relevant information and records on behalf of Eddie, this may involve contacting his bank, local social welfare office and/or health care provider.
3. Decision Making Representative: The Circuit Court has the power to appoint a decision-making representative to act on a person’s behalf to make certain decisions for that person, it is usually someone the relevant person knows and trusts. The decisions they can make are set out in a decision-making representative order and must be made in good faith. They must make every effort to find out the person’s past and present wishes about a specific decision that may be needed.
Whichever order is most appropriate will depend on the level of support, which is required, the first two are usually appointed by the relevant person when they feel they lack the capacity or will do in the future. For any order to be made, the relevant person must lack the capacity to make decisions on their own accord. A relevant person will not be considered to lack capacity on the grounds it is likely they will make poor decisions. A person can make an application to the Circuit Court in relation to a person’s capacity if they can show a true interest in the welfare of the person and the court decides whether the person is suitable for the role.

SERA HUSKY ‘FAMILY FUN WEEKEND‘ IS BACK!
This vital Animal Rescue Organisation celebrates its 10th Anniversary with its ‘FUN’DRAISING SUNDAY MAY 28TH
A message from Maurice Enright , Mr ‘Sera Husky ‘ himself !
Our Family Day is a day for Animal lovers .....
2023 is our first Family Day since the pandemic and what a difference a couple of years makes! As an essential service we continued to work throughout the course of the pandemic and we saw a dramatic change in attitude towards animals and dogs in particular! Many dogs were bought /adopted with little thought and unfortunately as the restrictions were relaxed and people went back to work we saw a huge increase in the amount of dogs needing rescue space. This year has continued to see that trend increase with dozens of dogs/goats/horses needing help with many needing extensive veterinary care.
This time of year sees many young wild animals who never fail to amaze us with the pickles they get themselves into,! We’ve rehabbed many wild animals over the years but this year saw us having to hand rear a little fox kitt that was no more than a few days old ! ,”Jamie” thrived after a slow start,he has now moved on to the next stage of his rehab.
This year ,this Sunday coming , May 28th , at our Family Fun Day in Lisselton , we have the usual family treats for the kids and adults but we really want to meet families who are interested in adopting the unwanted, and unfortunately for them we have a lot to choose from.
They may not be the fanciest of dogs but they do have amazing personalities and will make the best companions,. We have added to the number of reptiles and we will be doing talks throughout the day and dispel some of the myths that surround snakes and reptiles in general. The day kicks off at 11am and will go on till 5pm,
We have so many great prizes to be won on the day , with two signed jerseys up for grabs, one Kerry shirt signed by the current All Ireland champions Kerry and one Manchester Utd shirt signed by the great(depending on who you
support) Roy Keane! Thank you for your continued support and hope to see you on Sunday.

Kerry FC fail to avenge against Bray!
KERRY FC 0–2 BRAY WANDERERS FC
Kerry FC faced Bray Wanderers in a home game at Mount Hawk Park, hoping to avenge their previous defeat. Bray sat in fourth place in the league and had won only one of their last six games. Kerry came into the match with newfound confidence after securing their first-ever win in the Senior League of Ireland first division against Athlone Town. The home crowd showed tremendous support, and Kerry aimed to deliver another victory.
The first half started cautiously, with both teams having equal possession but limited chances. Kerry began to settle into the game and created their first opportunity through a headed effort by Ryan Kelliher,
which was comfortably saved by Bray’s goalkeeper. Both sides had their moments, but Bray’s defensive line caught Kerry offside multiple times.
Bray had their best chance of the half when Dane Massey’s shot was well saved by Kerry’s goalkeeper. Towards the end of the half, Kerry had a couple of opportunities, with Sean McGrath’s shot sailing just over the goal and Kevin Williams missing the target from a corner.
The second half saw Bray take the lead with a goal from Harry Groome, which deflated Kerry’s momentum. Kerry struggled to create chances and were outperformed in midfield. Despite their efforts, they couldn’t
find an equalizer. Bray sealed the victory with a penalty, awarded for a handball by Ryan Kelliher. The decision was disputed, but Bray converted the penalty to secure a 2-0 win.
Although Kerry displayed confidence
from their previous win, their second-half performance fell short. They will need to address their issues and aim for a victory in their upcoming home game against Wexford to get back on track.
