Fionn is looking at his garden summer growth and it has grown to the extent that it has affected the light coming into his house and his neighbours. He is wondering what he needs to do.
Tree, vegetation and shrub management is a huge issue between neighbours particularly in the urban garden. While greenery can add beauty and appeal to a locality it needs to be managed in the best way possible for oneself and one’s neighbours. While one’s house is not going to grow next door a tree, shrub or creeper will. Moreover, neighbours vary in their attitude to rampant greenery some love it and will miss it if it goes valuing the noise barrier and the privacy while others want the greenery manicured and shaped. So, it is all a question of balance and tuning into one’s neighbours in relation to the greenery. Firstly, there is the boundary greenery this is a on a joint party- party shared boundary usually and any work on the boundary and its greenery should be in consultation with neighbours. If a boundary falls, it is important to consult with the neighbour in relation to reinstatement and ideally both parties share the cost. Similarly, if shrubs or trees are cut down on a boundary it should only be done by agreement with both parties. If it is not it could result in the neighbour taking a district court case to get a works order to reinstate the boundaries with damages and costs. Likewise, if after consultation with one’s neighbour they are not co-operating in relation to a boundary then one can go to the District Court to get a court order in relation to works that need to be done and a direction in relation to the costs. These types of cases are a last resort however and show the importance of maintaining good relations with one’s neighbour so that there can be co-operation on boundaries and vegetation that may affect each other. Moreover, the court remedy relates to boundary disputes mainly. If a neighbour has branches of a shrub or tree overhanding one’s garden one does have a right to abate the nuisance. This involves cutting the branches and leaving them back to the neighbour as they belong to him/her. This abatement is risky without consultation as it may upset the neighbour unnecessarily if one takes unilateral action and due to the risk to the life and health of the shrub/tree. Again, consultation in advance is best in this situation. Awareness of the issues around neighbours and vegetation has resulted in a bill which is currently going through the Dail called the Neighbours Disputes (Vegetation Bill) 2017. It is now at committee stage in the Dail. It envisages mediation being available through the local authorities for these kinds of neighbour disputes. This is available in the England now. Interestingly the bill will aim to address neighbour disputes where vegetation causes a nuisance including the obstruction of sunlight which is a new departure. there is generally no right to light in Irish Law and the only remedy at present is related to shading of light through windows which must be reducing light through the window to a definite degree but is no help with the general light coming into one’s property. It is interesting to see this new development as just a noise pollution can affect humans negatively so can lack of or reduction of sunlight.

Kerry FC fell 0-2 to Cobh Ramblers in their return to Mounthawk Park after nearly a month away. The game marked their second meeting in four matches, with Kerry having previously secured a 2-0 win over Cobh in the FAI Cup on July 19th. With a crucial FAI Cup tie against Bohemian FC approaching, Kerry hoped to regain momentum but faced a tough challenge.
First Half - Cobh had the first chance of the match when Luka Le Bervet broke through on the left, but Finn Barrett’s last-minute block kept the game scoreless. Kerry’s Oran Crowe created two of the best opportunities, including a long-range deflected shot that just missed the
goal and a powerful strike that was well saved by Cobh’s goalkeeper, Darragh Burke. Despite Kerry’s dominant play, it was Cobh who broke the deadlock. Jack Larkin’s volley, deflected off Andy Spain, wrong-footed Aaron O’Sullivan, giving the Ramblers a 1-0 lead at halftime.
Second Half - The second half offered few highlights, with Kerry struggling to break through Cobh’s defense. Kerry’s best opportunity came in the 64th minute when Burke was caught out of position, but Crowe’s header was cleared off the line. Finn Barrett, impressive in only his third start, rattled the crossbar with a long-range effort,

Minister for Education and Kerry TD Norma Foley has welcomed the expansion of pharmacists’ role to enhance community services.
Minister for Health Stephen Donnelly has today published the final report of the Expert Taskforce to Support the Expansion of the Role of Pharmacy. The report lists eight common conditions that community pharmacists, after undergoing training, can offer advice and supply medicines for. Minister Foley said: “In government, we are working to make healthcare accessible and affordable to all and the expansion of the role of community pharmacists is key to this.
“As outlined by this expert report, pharmacists will be given the opportunity to undertake training so they can offer self-care advice,
supply over the counter (OTC) and prescribe prescription medicines for a variety of ailments. This list of conditions can be extended over time as the service evolves.
“Community pharmacists already provide advice to people every day on their medication and this expansion is an extension of what
they are already doing.
“Expanding the role of community pharmacists increases the range of options available to people.”
