LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Sean is suffering from emotional and physical abuse from his partner in the home and is wondering what he can do about it. He feels it is also affecting his children. The Domestic Violence Act 2018 aims to prevent physical and psychological violence and intimidation in the home. This legislation is gender neutral and application can be made by a male or female person suffering from behaviour, which is affects their safety and welfare and puts them in fear. This act is aimed at providing protection for a spouse and children, dependent persons and persons in other domestic relationships whose safety or welfare requires it because of the conduct of another person in the relationship. The Dependent persons include anyone under 18, adopted or to whom an adult in the home is in loco parentis or someone over age and suffering from a mental and physical disability. It not only protects spouses, cohabiting partners, former partners who have a child together and parents of adult abusive children. The following are some of the Orders available to help people: SAFETY ORDER: This can be granted for up to five years renewable for a further five and protects the applicant or any dependent person from threats and intimidation without barring the offending person from the home. It is a type of warning. The order is that the person the subject matter of the order shall not use or threaten to use violence against, molest (i.e. annoy) or put in fear the Applicant or dependent children or if no longer living with Applicant will not watch or beset the place where the applicant resides. It stops them following or communicating (including by electronic means) the applicant or dependent person. BARRING ORDER: This is an order directing the spouse against whom the application is made if residing at the Family home to leave the family home and prohibiting him or her from entering the place in which the applicant resides. A Barring order may also prohibit that person from using, or threatening to us, violence, molest or pub in fear the applicant or dependent child or from attending at or in the vicinity of or watching or besetting a place in which the Applicant or any dependent child resides. It also prohibits following or communicating (including by electronic means) with the Applicant or a dependent person. Pending the obtaining of these orders emergency protection can be provided through a protection order or interim barring order. A Breach of one of these orders is a criminal offence up to €4000 fine and/or up to 12 months’ imprisonment. The act provides a new Criminal offence of coercive control where the perpetrator knowingly and persistently engages in behaviour that is controlling or coercive, it has a serious effect on the relevant person and a reasonable person would consider it likely to have a serious effect on a relevant person. It clarifies that a person’s behaviour has a serious effect on a relevant person if that behaviour causes the relevant person to fear that violence would be used against her/him or cause serious harm or distress that has a substantial adverse impact on that person’s day to day activities e.g. restricting movements, and independence, financial restrictions, stopping the person meeting family and friends. Grab your swim suits everybody because the Aqua Dome is back in business! After two long years of absence, Munster’s most exciting indoor water adventure park is finally reopening its doors and we can hardly wait. Circle March 15th on your calendar because that’s the day you’ll get to zoom down the Water Slide, float with the Lazy River and jump the crashing Rapids once again. “We are so thrilled to be reopening. We know how important the Aqua Dome is to the town and to the tourism industry in Kerry. Having the facility closed for so long was tough but we’re very excited now to be in a position to welcome visitors back. It’s huge relief,” CEO Kieran Ruttledge said.
The Aqua Dome first opened its doors in May 1994 and since then it has become a favourite family tourism destination. Where else can you get all the fun of the water without any of the rainy day blues? And it’s not just for kids. Adults can avail of the hot tubs, steam room and Vitality Spa, plus, with a mini gym on site, you can work on some cardio if you don’t fancy splashing around. Then there’s always the café if you just want to chill out while the kids let loose in the pool. During Covid restrictions, the Aqua Dom retained a core staff to ensure the place was kept in tip-top condition, but sadly, plans for a much anticipated new attraction have been shelved for now due to losses incurred by the shut-down. Excerpts from the Open Letter to the people of Tralee from The Rose Of Tralee Festival Chief Executive Anthony O Gara (read the full letter online) “Some misinformation has crept into the local public discourse, particularly online, in relation to our plans for Festival 2022. We want to politely intervene to reassure local people, and our Rose family further afield, that the Festival is blooming anew after a two-year hiatus, and we have very exciting plans for the 2022 event. Our plans for the 2022 Rose of Tralee International Festival include all the events that traditionally take place in town, the lights, parades, fireworks, family entertainment, street performances and much more. They also include, moving the dome, be it on a slightly smaller scale of 1000 square metres, to a site in the centre of town, for five nights of concerts and festivity. We made a decision in 2019/2020

to find an alternative to the Dome, which was costing us almost €250,000 annually. That financial burden was creating unsustainable pressure for the Festival, whilst swelling the coffers of suppliers from outside the county.That discussion was welcomed by our key partners, RTÉ, the Rose Hotel, and Kerry County Council along with the I.T.T. at the time, and we agreed that we would relocate to the brand new 2,000 square metre Kerry Sports Academy facility just built by the I.T.T.. Those discussions were ongoing when Covid closed us all down. We are so excited to have formed a new partnership with the local, four-star, family run, Meadowlands Hotel. Whereas the popular Johnny Franks bar will continue
to cater for the food and beverage requirements of regular customers, albeit with a Rosey tint added to their normal experience, the exclusive use of all the other facilities in the hotel will allow the Roses, RTÉ, our judges and our Rose team some quiet retreat. Sadly, the commercial arrangements offered by the Rose Hotel were no longer viable for the Festival. We leave as friends, with great memories, and look forward to a wonderful experience in the four-star Meadowlands Hotel. Finally, we are launching our Festival in Dublin on Friday next, the 11th of February. It is a very exciting time for us and whereas we have many challenges ahead, we are quietly engaging with business and civic authorities around the town and county to make

Tralee enjoyed what can only be called a bonanza weekend as the Dublin fans booked out Tralee in their droves and left their usual indelible mark on our town , both as football fans and as visitors Inclement weather kept everyone indoors for most of the weekend as crowds not seen in a long long time packed out our restaurants coffee stops Hotels and of course our local hostelories. Music filled the air between pubs on Saturday evening as patrons moved freely (if not drenched!) between pubs . Come back any time lads ye’re more than welcome!

PERFECT MEAL FOR TWO
With valentine’s day upon us, this is the perfect sharing joint, as you know I’m a porkaholic what better than a rack of pork.
ROAST RACK OF PORK WITH WILD GARLIC STUFFING INGREDIENTS •
• • • • • •
3kg rack of pork , chined , French trimmed (ask your butcher to give you the trim), skin scored, not tied 1 tbsp sea salt , ground to a powder For the stuffing 1 tbsp olive oil 1 onion , finely chopped 2 thyme sprigs , leaves picked slice of sourdough , crust removed, torn into little pieces

½ tsp fennel seeds ½ tsp coriander seeds ½ tsp chilli flakes The trim from the pork , minced (or use 400g pork mince) nutmeg , for grating zest ½ lemon 1 tbsp chopped flat-leaf parsley 70g wild garlic , chopped 1 egg
METHOD In the morning before you cook the pork, use a very sharp knife (or ask the butcher) to cut a deep flap under the skin and fat of the meat, all the way along the rack – be sure to leave at least 5cm connected. Rub the powdered sea salt all over the flesh (not the skin), then leave uncovered in the fridge for at least 2 hrs. Take out of the fridge 30 mins before you want to cook it, to come to room temperature. Heat oven to 240C/220C fan/gas 9. Meanwhile, make the stuffing. Heat the olive oil in a frying pan. Add the onion, a pinch of sea salt and black pepper, and the thyme leaves. Cook over a low heat, stirring, until the onion has softened, about 10 mins. Add the sourdough 2 mins before the end. Remove from the heat and transfer the mix to a bowl. In a dry frying pan, toast the fennel and coriander seeds and chilli flakes over a high heat for 1-2 mins. Allow to cool, then use a pestle and mortar to grind with a pinch of sea salt. Add the ground spices to the onion mixture and mix with the pork trim. Season again, grate in some nutmeg to taste, and add the lemon zest, parsley and wild garlic. Mix everything together with your hands to thoroughly combine, then add the egg and mix again. Press the stuffing into the flap in the pork and tie up with string all the way along to hold the stuffing in. Use foil to cover any exposed stuffing, as it will burn in the hot oven. Place the joint on a baking tray. Cook the pork for 20 mins per 450g . Start it off on 240C/220C fan/gas 9 for 20 mins, then reduce the heat to 200C/180C fan/gas 6 and cook . Turn it halfway through to ensure it’s cooking evenly and test it 10 mins before the end with a temperature probe. When the core reads 70C, it’s cooked. Wrap the pork in foil and leave to rest while you prepare your side dishes.

David joins Olympians as Athlete of the Year David Kenny and his club Farranfore-Maine Valley received a major boost last weekend with the announcement of David as joint U23 Athlete of the Year at the prestigious Athletics Ireland Awards. Other winners included Olympians Thomas Barr and Phil Healy. David initially took up the sport representing Firies in the Kerry Community games. Under the watchful eye of club mentors Michael O’Connor and Jerm Crowley, he became a dedicated athlete winning numerous TRALEE ADVERTISER
National titles at underage level. David was awarded a scholarship to the Munster Technological University in 2019. He joined the Athletics Ireland high performance race walking team coached by former World Champion and Olympic medallist Rob Heffernan. 2021 was a breakthrough year for David coming 2nd in the European U23 Athletics Championships in Estonia. On the basis of the magnificent achievement David was selected to compete in the Tokyo Olympics finishing in 29th
position. Considering race walkers do not reach their prime until their early 30’s this was a tremendous performance. David continued this form into 2021 winning the Irish universities championships last week. He has his sights firmly set on the World Student Games in China and the European Championship’s in Munich later in the year. In his acceptance speech David paid tribute to his family and all those that helped him throughout his career. The future is bright for this

OF THE YEAR ANOTHER BIG WEEKEND OF GAMES: Following on from the excitement of last weekend and Kerry’s great win over Dublin, set up with a devastating first half display, there are some more big games this weekend. Having lost away to Westmeath in their opening National Hurling League Division 2A game the Kerry hurlers return home to face Kildare on Sunday in Tralee. The Kerry Ladies begin their Lidl Ladies National Football League Division 2 campaign this Sunday when they welcome Tipperary to the Fitzgerald Stadium on Sunday with a 2pm throwin. Tipperary have come down from Division 1 so will be a tough test for the Kerry girls who according to their joint manager Darragh Long have prepared very well since the squad got together before Christmas despite all the Covid challenges. The Kerry Ladies have a number of new players going into this clash. On the colleges Tralee CBS make the trip to Fitzgerald Stadium to face St Brendan’s Sem Killarney in the final of the TUS Corn Ui Mhuiri Final throwing in at 1pm on Saturday. The Tralee school had expected that the game would be on in Austin Stack Park but the ground was not made available for the big college’s game. They travel to Killarney in very good form but won’t get anything easy from the Sem (my old alma mater) so those who attend, and both schools are asking their supporters to turn out in numbers, could be treated to a cracker. Hard Luck but a huge well done: There was no joy for Kilmoyley, and indeed Gneeveguilla, last weekend in Croke Park but both clubs had wonderful journeys over the last few months and did the whole county proud. There Kerry camogie team went into their Littlewoods Ireland Camogie League opener against Armagh missing up to 16 of the panel, including the Clanmaurice players who were rested ahead of their All Ireland club semi-final in two weeks, and giving 8 players starting debuts. Antrim fielded ten of their All Ireland Intermediate winning side. While it was not the outcome the girls or manager Ian Brick wanted the girls that made their debut should be proud that they have worn the green of Kerry and all the players who were on duty will have much better days. In midweek the MTU Kerry soccer side took on TUD City Campus in Mounthawk Park in the CUFL League semi-final but it was the Dublin side that took the narrowest of wins 1-0. The college’s camogie side put in a very good effort in the CCAO Fr Meaghair Cup semi-final before going down 2-08 to 4-05 to UCD 2.

VOLUNTEERS DESERVE GREAT PRAISE: While it was a great night for all those involved with the Kerry team and indeed for the supporters who are delighted to be back watching sport live it’s the volunteers who were on duty in Austin Stacks Park, and indeed at all other games in all sports last weekend, deserve great praise especially with the weather. The grounds-staff at Austin Stacks Park also deserve great praise for the condition of the pitch. Without these people games would not go ahead. On occasions we hear of stewards getting abuse – sadly there were some reports of this at the Galway Rally last weekend where marshals were verbally abused as they tried to stop people leaving a stage early down an escape road. Every sports depends on volunteers to stand at gates, steward areas the need stewards and do many more tasks and without them it would be a totally different sporting world. So we should thank them and never abuse them even if they are asking us to do something we don’t want to do! CAR PARK CLOSED BUT STILL PACKED: If you have any interest in cars then the Brandon Car Park is the place to visit on Sunday when the Kerry Motor Club’s fundraising static car show will see nearly 300 cars in the car park. The collection will include past and present rally cars, vintage, classic and sports cars as well as motorbikes that Kerry riders are competing on at the moment. The monies raised, you can donate on the day, is going to help former KMC member James Quinlan who is on his own tough medical journey in New York. Members of the public are asked to note that the Brandon Car Park will be closed from 9.30am and any cars left overnight must be out by then. TRALEE TOWN BOARD FIXTURES: In the Tralee Town Board Senior League, sponsored by Lee Strand, there are two games in the Group B with Churchill taking on Na Gaeil and Kerins O’Rahillys welcoming Ardfert. Both games throw in at 12.30pm. There are fixtures in Round 2 of the Lee Strand U17 League in both Division 1 and 2. All games kick off at 3pm. In Division 1 Ballymac take on Ardfert while in Division 2 its Na Gaeil up against Kerins O’Rahillys. STACKS JUVENILE NEWS: The whole club is delighted to see Joe O’Connor being named as the Kerry Senior Captain for 2022. Fans of the GAA talent competition Scor will be delighted at it is coming back after its Covid break. It is expected that the Tralee area Scor na nOg competition will take place shortly and Stacks want to be represented in as many competitions as possible. These are Singing (one song), quiz, recitation or story, Ballad Group (2 songs), music group (two tunes), Nuachleas (Sketch), Figure Dancing and Set Dancing. A full list of the rules is on the kerrygaa.ie website. The Kerry finals of Scor na nOg are scheduled for Saturday March 19th with the venue to be announced. Once again there was a great turn-out for the underage players in the Academy and they will train again this weekend. The u11 boys trained on The Green CBS Astro and will be there again this Sunday. There County League is set to get underway in mid-April. For the next three Fridays (February 11th, 18th and 25th) the u13’s will train between 6pm and 7pm in the Kerry Sports Academy Hall at the MTU. The 13’s County League is set to get underway on March 22nd. Training for the 15’s will take place on Sunday in the Bishop’s Field from 2.30pm and on Thursdays on the MTU Astro from 7.30pm. The County League is set to begin on March 30th. The minors have a challenge game this Sunday at 2pm when Bishopstown from Cork come to Connolly Park. The club wishes its players on the CBS The Green team all the best for the big game on Saturday. It’s a big night for the club as they celebrate their recent victories with a big celebration at the Ballygarry House Hotel. Lotto: There was no winner of the Lotto from the numbers drawn 2, 22,25 and 31 and the next jackpot will be e3,900. PARNELLS NEWS: Membership of the club is now open via the Clubforce app or through the website. Details of the costs from the nursery (u7’s and u8’s e30) to family members of e200 for 3 or more juvenile players and non-playing adults from the same family are available from the club. The club has announced details of its age groups, managers and training times from the u7 hurling to the u15’s and these are available from club officers. New players are always welcome to come and try it out; playing equipment is available to borrow. Cost is €2 per session to cover the cost of renting the facilities and details are available from David on 085 1355566. KERINS O’RAHILLYS NOTES: There was a great turn-out at all the underage groups as preparations continue ahead of the County Leagues that will begin over the next few months. The girl’s underage teams are also training hard while the minor and senior ladies training will begin in coming weeks. Competitive action continues this weekend with Tralee Town Board action. Lotto: There was no winner of the Lotto from the numbers drawn 21,26,28, 31 with the next jackpot being e3800.

FLORAL COMES OUT SMELLING OF ROSES: There was Kerry success at the National Coursing Meeting in Clonmel when Liam Dowling’s Ballymac Floral won the Horse and Jockey Oaks 2021. WOMEN’S SOCIAL SOCCER: On Friday February 17th a 6 week women’s social soccer programme will begin at the Tralee Regional Sports & Leisure Centre run by the FAI’s RDO in Kerry Chelsea Noonan. The programme is aimed to introduce women to the sport of soccer through fun and sociable sessions while focusing on fun and fitness in a supported environment. If you are new to soccer, or if you have played in the past and want to reignite your love of the game, then this programme is for you with all levels welcome. HUGE WEEKEND FOR THE WARRIORS: While the fans of Garvey’s Tralee Warriors enjoyed getting their pictures taken with the Cup last Saturday night for the team it was back to the bread and butter of the League. And they put Moycullen to the sword 90-49 as thoughts now turn to securing a play-off place. They face a huge double header this weekend when they play the unbeaten League leaders Tradehouse Central Ballincollig, at home on Saturday afternoon in the Sports Complex from 5pm before crossing the border to take them on in the Community Centre from 3pm on Sunday afternoon. ELAINE SECOND IN THE WORLD: Well done to Elaine Burrows Dillane who has been named in second place at the WOWSA – World Open Water Swimming Association – awards in the Women of the Year category. KENNY NAMED IN A1 AWARDS: Farranfore Maine Valley race walker David Kenny has been named as the Joint u23 Athlete of the Year at the Athletics Ireland Awards. ONE THE GREENS: At the Tralee Golf Club the 9 hole Scotch Foursome competition for the ladies was won by Mary Savage and Kathleen Houlihan on 25 points. Just behind were Gorretti O’Connor and Sandra O’Sullivan on 24 points. TRALEE AT NUMBER 8 IN TOP 100 COURSES: Irish Golfer magazine has printed its list of top Irish golf course and Tralee comes in at number 8, one place behind Ballybunion’s Old Course. The magazine said that “Tralee upgraded three holes in 2021 – holes 6,7 and 8 and the changes to the par three 7th and the par four 8th in particular are a resounding success. It also means that the front nine’s improvements narrow the gap between the two nines. Add in the inspiring location and impressive breadth of facilities and upgrades and Tralee’s overall golf package carries serious weight. Changes are on-going at a club that shines ever brighter. The Kingdom’s cathedral of dunes remains worthy of worship

Waiving of fees for 2022 Exams
The Minister for Education Norma Foley TD has confirmed the waiving of the fees for the 2022 Leaving Certificate and Junior Cycle examinations. Students will not have to pay the fees which would usually be €116 and €109 for the Leaving Certificate and Junior Cycle examinations respectively. Minister Foley said: “We have sought to bring clarity and certainty for students this week by confirming the arrangements for the 2022 examinations and I am pleased to confirm today that fees for this year’s State examinations are being waived.” The timetables for the State examinations will be available at examinations.ie in the coming days. Schools will be supported and given clear guidance on the arrangements for the examination this year which will be guided by the Public Health advice. Information on the changes to the Leaving Certificate examinations will be available on gov.ie/LeavingCertificate and at examinations.ie next week. Information on the Junior Cycle examinations will be available on gov.ie/juniorcycle.
