When choosing a solicitor to handle my sale and purchase of a property, what factors should I take into consideration?

A

Making the right choice of solicitor for a sale or purchase is incredibly important: it really can make or break a deal. A good lawyer will know which rules can be bent and which should be absolutely adhered to. They look for solutions rather than problems, will always enjoy a challenge and will get stuck into your transaction with gusto. I have worked with a number of excellent lawyers who stand out from the crowd and I will always recommend two or three if a buyer or seller asks for advice. Once you’ve contacted them, I’d say go with the one who picks up the phone first and gets back to you. This is a pretty good sign that they’ll be proactive and not hide behind emails or letters. The latter is also something you want to look out for. Avoid the ‘old school’ lawyer who shuns the idea of email for paper and post. This can delay the process and, once the property is under offer, it is generally in all parties’ interest to proceed to exchange as quickly as possible. For this reason I’d also check the solicitor’s workload or holiday plans before you instruct them, as you want someone who can allow the time and will answer your calls when you need to speak to them. While your solicitor doesn’t need to be local, it can be handy if they’ve dealt with a property on the same street or even building, as they will be familiar with the council and managing agents and know how best to work with them. I would be cautious with online conveyancing companies. Some can genuinely be good, but many follow a call centre model and you can rarely get hold of the solicitor on your case. Also, I am personally nervous of noticeably cheap lawyers who lower their prices to get a better market share and higher workload. Apart from often having hidden costs, they are likely to give you less time and thus put your purchase or sale at a higher risk of falling through. Like with most things, you get what you pay for.

marketview Choose your agent wisely, says Rupert Collingwood, CEO of The London Search Company As 2016 gathers pace, many of you will be considering your next property move, whether it be trading up to accommodate the growing family, trading down to release equity for the children, or even renting out your London home to fund a new life in the countryside. Whichever option it is, an agent of some description will have to be engaged. The choices that we make in our lives not only affect ourselves but also those around us, and can have a greater impact that sometimes we don’t realise. That is why it is so important to choose the right agent to market your property, be it for sale or rental. Recently we have been involved in advising in one such case: an older couple looking to rent their London home in order to help generate an income to support their pension. Working with our clients, three reputable agents with solid track records were chosen and their fees and an asking price settled upon. A few weeks later, they added a fourth thanks to a previous connection. It was a surprise, therefore, to discover the same property listed with a fifth agent at the start of this year - an agent that, in all truth, has no business in this area of London, let alone a track record to suggest they would be a suitable agent to market such a property. To cut a long story short, it turns out that this agent had effectively door-stepped our clients having seen the property advertised online, and despite not being instructed and having only visited the property once, managed to take photographs and list the property on their own website and on the portals at the wrong price. The property industry does not, it can be said, have the best reputation when it comes to ethics, and some would say: “You can’t blame a man for trying.” However, it is precisely this type of spivvy behaviour that gives estate agents such a bad name. This agent, in my view, made the choice to hoodwink an elderly couple and to ‘secure’ an instruction via dubious means, clearly unable to secure instructions in the usual manner. This agent’s choices have only helped to enhance the already dented reputation of their fellow agents and more hard work will have to be done to undo the damage that such practices inflict upon our industry. So when it comes to choosing your agent, don’t make your choice solely based on fee or price, but consider if they are the type of agent who will hoodwink you – or indeed your buyer or tenant – to line their own pockets.

Rent and save Stamp duty reforms have boosted the ultra-prime rental market, according to latest research. Tunstall Property has found that those looking for a new home in London could rent, on average, for three years before covering the added cost of stamp duty. Comparing like-for-like rental and sales properties in Mayfair, Belgravia, Knightsbridge, Chelsea, Kensington, Notting Hill and Holland Park, the study found that where the sales market is struggling, the ultra-prime lettings market can prosper. Comparing average annual rent to average sales price, Tunstall has calculated the length of time a property in prime central London could be let for the equivalent stamp duty cost. The findings reveal that Belgravia offers the best rental value compared to added purchase costs. Comparing a twobedroom apartment in ‘The Eatons’ (Eaton Place, Square, and Mews), average sales price is £4,526,000 with a stamp duty charge of £456,870. Average annual rent for the same property type amounts to £95,576, which could be let for 4.8 years before the stamp duty cost would have been covered. Mayfair averages over 3.5 years of renting before covering the equivalent cost of stamp duty. Average sales price for a two-bed apartment in Mayfair is currently £2.7m, amounting to £238,125 due in stamp duty costs. Average annual rent for an equivalent ultra-prime property is £69,264, which would allow for a 3.5-year let before the equivalent stamp duty cost

was covered. Knightsbridge and Chelsea both produce similar results, averaging 3.2 years of renting for the equivalent stamp duty cost. Managing director Mark Tunstall said: “Following the recent reforms it would be possible to rent an ultra-prime property for between three and four years before the equivalent cost of the stamp duty on the purchase would be covered. Unless somebody is committed to London in the long term, there is a much more compelling case for renting. “We’ve had a number of queries from people on secondments or looking for a temporary London residence that perhaps last year would have been tempted to buy and sell on for a significant profit in two or three years time. The kitchen has long been the hub of the home, and now it is the epicentre of family life. Over the past 20 years the way families live and spend time together has evolved. Gone are the days of the mother cooking alone in a small kitchen, with children lost in the recesses of the house. Kitchens now play host to the entire family with homework or work emails assiduously attended to before a migration to the living space after dinner. This is the heart and soul of the household and, as our relationship with food has changed, kitchens have become bigger and smarter, where anyone can whip up a weeknight masterpiece. If you’re thinking about refurbishing or refreshing a kitchen, consider your choice carefully. The kitchen’s style should match the rest of the house – a Boffi or Poliform won’t suit a scruffy home. The chosen brand also says a great deal: Smallbone for the classic, Bulthaup for the efficient and Boffi for the super-high end. At the top of most buyers’ list, the

kitchen can make or break the sale. A shabby kitchen can cheapen the property in their eyes so investment is often well worth the return in value if you are considering selling in the near future. Two decades ago, a galley kitchen with basic appliances would be sufficient. Kitchens were functional and used for cooking only. Now the kitchens of 2016 are made to fit the entire family with sufficient storage to hide the evidence. Extensive islands are a must and most incorporate hidden workstations for adults and children alike. Beyond that, we expect them to double up as entertainment spaces with all the latest gadgets, from incorporated speakers and high definition televisions competing with the Quooker boiling water taps and wine fridges for our attention. Kitchens are now so much more than their original ancestors and should be equipped for every eventuality to slot into our busy lifestyles and to feed both body and mind.

Scaffolding and skips are the signs that households in a street near you are busy improving their property, but will the improvements add saleability or raise eyebrows for the wrong reasons? All too often the latest trend is next year’s dated look. Take halogen spotlights on the ceiling – as passé as the Seventies avocado bath suites. And thinking of bathrooms, what about those extra thin cabinets that don’t hold anything or those tiny washbasins too small for a large pair of hands – all of them shrieking yesteryear. It seems that anything that says ‘ultra modern’ or ‘on-trend’ will also say ‘out of date’ in a few years’ time. For example, people who installed a freestanding bath in the bedroom must now be wondering what possessed them. Unless you are running a house of ill repute, who doesn’t want a bit of privacy in the bath, and who doesn’t want to get out of the bath without drenching the bedroom carpet? Washing machines are starting to get moved out of the kitchen following a preference for an open-plan, modern kitchen space and as consumers become more environmentally conscious, we expect to see further interest in properties with improved EPC ratings and environmentally friendly schemes.”

Next month lenders have to adopt new regulation, the Mortgage Credit Directive (MCD). In the build-up, lenders are likely to rein back their pricing as they look to slow business down to ensure their new systems do not ‘fall over’. Once they are confident, expect some element of price competition to return. Whilst these new regulatory changes (and previous ones) have made remortgaging troublesome for certain market elements, all is not lost. Parent trap Parents or grandparents who want to help their children to buy their first home should beware of the government’s plan to impose stamp duty of 3 per cent on any additional home a couple buys. For example, if parents want to give a child a deposit to buy a house and then act as guarantors of the mortgage, they will not be liable for the additional tax. However, if they plan to buy the house in their own names for their child to live in, that will count as an ‘additional’ property, and therefore they will be liable for the extra stamp duty.

Confidence in the capital The world’s richest believe London is the top city, reports Duncan Farmer London is the most important city in the world to wealthy people, beating New York and Hong Kong to the top spot. It is also vitally important to the UK’s economy and a report by PWC, the accountant, predicts that economic growth in the capital this year will be about 3 per cent, compared with an average of between 1.6 and 2.4 per cent elsewhere in the country. Employers in the capital are also far more optimistic than businesses elsewhere in Britain, and Manpower’s Net Employment Outlook for London is +9 per cent, meaning that most firms expect to hire more people. In fact, Manpower says that the only problem facing employers is a skills shortage. “The London labour market is extremely busy, with employer confidence rising, and this is being reflected by increasing permanent hiring volumes,” says its report. “However, many employers are increasingly facing a talent shortage and this has seen a greater reliance placed on head-hunting to find individuals with the

in-demand skills and experience that they require.” As a result of this positive economic growth, inflation is likely to rise from its present low levels. What all this points to is the suggestion that the Bank of England’s monetary policy committee will have to increase interest rates. As PWC says: “The Monetary Policy Committee may start to raise interest rates gradually during the first half of the year. Businesses and households should still plan for rates to be back to 3 to 3.5 per cent by 2020.” So far, however, banks and building societies have yet to factor this into their mortgage rates and there remain excellent fixed-rate deals on the market. The Post Office, for example, has a two-year fixed rate loan with an interest rate of 1.18 per cent for buyers with a 40 per cent deposit. For borrowers looking to fix for five years, by which time the Bank of England’s base rate could be at about 3.5 per cent, Royal Bank of Scotland has a fixed-rate loan of 2.53 per cent, again for buyers who have a 40 per cent deposit. The more likely it becomes that rates will rise then the harder it will be for borrowers, especially those looking to remortgage, to get such good deals.

REVIEW Crowd-funding campaign A campaign by private landlords to overturn the chancellor’s move to tax income from buyto-let investments raised £42,000 towards its £50,000 target in just six days. Chris Cooper and Steve Bolton started the crowd-funding appeal in the hope that a judicial review would overturn the controversial Clause 24 of the 2015 Finance Bill, in which the government introduced plans to prevent landlords offsetting mortgage interest costs against rental profits before calculating tax. They say that George Osborne’s proposal flouts “a long-established principle of taxation that expenses incurred wholly and exclusively for the purposes of the business are deductible when calculating the taxable profits”. The judicial review needs to be submitted by February 17.

Mayfair is outperforming its golden neighbours, reports Harvey Cyzer, head of Knight Frank Mayfair and St James’s Mayfair has outperformed other prime central London property markets against the backdrop of cooling demand over the last year. The primary cause of the slowdown in demand was a rise in stamp duty for properties worth more than £1.1m, which has curbed transaction levels and dampened price growth. The result was a 19.5 per cent decline in prime central London sales volumes in the first half of 2015 compared to 2014. However, transactions in Mayfair only fell by 0.9 per cent over the same period, which was less than a decline of 27 per cent in Knightsbridge, 37 per cent in Chelsea and 6 per cent in Marylebone and Kensington. There are several reasons for this relatively stronger performance, including the global cachet of the Mayfair name, the high-quality of the area’s development pipeline and the fact price growth has recently started to catch up with London’s other ‘golden postcodes’. Indeed, price growth in Mayfair has outperformed most other prime central London districts over the last year. An increase of 2.9 per cent in the year to September compares to 1.3 per cent growth across the whole of prime central London, while prices were flat in Belgravia and there were declines of 3.6 per cent in Knightsbridge and 1.6 per cent in Chelsea. Mayfair has been the strongest performing prime central London market in the 40 years since the Knight Frank prime central London index was established in 1976. A house bought in Mayfair for £250,000 in June 1976 was worth £18.1m in September 2015. However, that outperformance has eased since the financial crisis. Prices grew 57.5 per cent between the last low point in March 2009 and September 2015, which is less than 76 per cent in Kensington, 75 per cent in Knightsbridge and 63 per cent in Chelsea. This has provided potential for growth that, combined with a premium development pipeline, means Mayfair is accelerating faster than its central London neighbours.

Top secret location Sir Mansfield Cumming, a mystical figure who led Britain’s spy network in the First World War, was commemorated last year with an English Heritage blue plaque near his office at Whitehall Court. Legendary stories of his exploits include a report that he hacked off his own leg with a penknife after becoming trapped in a car accident. Grand conversions Many substantial country houses were demolished between the First and Second World Wars as they were considered too large or expensive to maintain. The rate of demolition increased dramatically after 1945 and by the time of the Destruction of the English Country House exhibition in 1974, up to 10,000 great houses were lost. Urgent action was needed to save a significant proportion of England’s built heritage. Properties at risk needed new uses as there was a limit to the number of houses English Heritage or the National Trust could rescue. Punitive taxation exacerbated the problem and capital transfer tax, later to become inheritance tax, made it increasingly difficult for estates to pass from one generation to the next. Income from farming even a sizeable acreage was generally insufficient to support large houses, and the general focus on employment had firmly switched from the countryside to London and the major cities. One solution in the late 1970s and early 1980s was converting large country houses into flats. The opportunity to own part of a wonderful house in beautiful grounds quickly caught on. It gave those who wanted to downsize the opportunity of having fewer rooms but still accommodate much of their existing furniture. Others liked the idea of living in the countryside without being on their own. For those keen to travel it proved the perfect lock-up-and-leave, particularly as many of the schemes had communal gardens

maintained for the residents. Northamptonshire has a significant number of historic houses. Several have been successfully converted into apartments and their outbuildings given a new lease of life. This was New Zealand’s first recorded gold discovery and gold rush. Coromandel goldfields yielded 16 million tonnes of gold ore between 1862 and 1952. NATURE AND WILDLIFE Unique New Zealand wildlife inhabits the Coromandel’s coastland and rainforests. Several conservation projects for kauri, kiwi and other birds originated on the

Tangiaro Kiwi Retreat is nestled in the heart of the Moehau kiwi sanctuary - one of New Zealand’s first kiwi sanctuaries. Visitors can sit on the deck of a luxurious bush hut at night and listen to kiwi call. Te Whanganui a Hei marine reserve is a communityled project off the Hahei coastline and iconic Cathedral Cove. This area has been a no-take zone for 20 years and marine life is thriving. Glass bottom boats reveal many types of marine life including fish, seals, crayfish (lobster), stingrays, blue penguins, dolphins and orca. ADVENTURE/OUTDOORS Coromandel outdoor adventures include scuba diving, sea kayaking and fishing, short and long forest treks, and the incredible Sleeping God canyoning adventure. Many walking tracks are steeped in local mining and logging history. The ‘Windows’ walkway in the Karangahake Gorge follows the old Paeroa - Waihi railway line, exploring gold mining relics and river scenery. The ‘Pinnacles’ overnight walkway through the Kauaeranga valley was originally constructed for horses carrying supplies to kauri loggers, gum diggers and gold miners in the early 1900s. Walkers stay in a DOC hut where an early morning rise reveals the sun’s first rays on the Pacific Ocean and 360-degree panoramic views. Cathedral Cove’s iconic limestone archway and pristine golden beach featured in The Chronicles of Narnia: Prince Caspian. To get to the cove, there’s the option of a two-hour return walk, or a guided kayaking trip. The cove is an idyllic location for swimming, snorkelling, picnics and relaxing under pohutukawa trees.

At Hot Water beach, where underground thermal activity supplies bubbling hot water, visitors can create a personal natural jacuzzi in the wet sand during low tide. SEASONAL HIGHLIGHTS A sunny climate and laid-back lifestyle make the Coromandel a year-round holiday destination for visitors. In summer, Kiwis flock to the region to stay in baches (holiday homes) and camping grounds but throughout the year there are also regular events and festivals that offer visitors a chance to indulge in the Coromandel way of life and environment. Coromandel Pohutukawa Festival is a celebration of New Zealand’s native ‘Christmas’ tree and its symbolic ties to New Zealand beach culture. Held in late spring to coincide with the trees’ flowering, the region-wide month-long festival hosts art exhibitions, café crawls, dive events and open-air concerts. In winter, Coromandel celebrates the scallop harvest at the Whitianga Scallop festival. This large outdoor food festival combines local food, wine, entertainment and family activities. Foodies consume around 100,000 scallops in one day at the Whitianga Scallop Festival. Lettings Lowdown Companies are becoming more cautious with their relocation budgets, reports Rahim Najak, lettings manager for Knight Frank Mayfair Mayfair continues to draw applicants from all over the world, with 32 per cent of applicants coming from Italy, the US, Russia and China. Our core market (up to £1000 per week) remains strong with 51 per cent of our applicants looking to rent at this level. Interestingly, 40 per cent of the properties we are launching to the market are set within this price bracket. For the last three years, Mayfair has been a popular location for employers to house relocating employees. As Knight Frank handles a large number of these corporate relocations, we know that what these applicants want is contemporary neutral spaces, clean lines and a sense of the turnkey finish about them. Our market and the central London lettings market have been affected recently by a falling demand in the financial services sector. Companies are more hesitant about recruiting and are more conservative with relocation budgets, which has dampened demand in the prime

central London market (£1000 to £5000 per week). Demand in 2015 was strongest in the core market. In 2014 the composition of new tenancies agreed in Mayfair was split at 38 per cent under £1000 per week and 62 per cent over £1000 per week. Since April 2015, Mayfair has seen a change with 66 per cent of new tenancies agreed being under £1000 per week, reinforcing how the corporate demand and reduced company housing budgets have affected the rental market. In short, we are seeing fewer applicants with large budgets at the moment. Landlords across central London are having to be extremely competitive with pricing and take on board our advice to market their properties at a realistic and, therefore, achievable rental figure. It is also imperative that landlords ensure their properties present as best they can against the competition to attract as wide an audience of applicants as possible.
