In a competitive world, it pays to be ready for action and have the right expertise, argues property finder Robert Bailey

Competitive bids for the most desirable properties have become the norm. Both buying agents and unrepresented buyers are vying for the best homes, but the latter is almost always at a disadvantage. In such a cutthroat market, those not well versed in how to navigate the process are either overlooked or put under tremendous pressure. I’ve seen many instances where buyers have paid well over the odds. This may eliminate the competition - but at what cost? Securing the contract is of vital importance in these situations. Once the contract’s issued, if the vendor chooses to switch horses to another buyer, under Law Society rules the first person to whom the contract was sent has to be notified. Therefore, the buyer who’s in receipt of the initial contract is in a much stronger position. Generally, vendors’ solicitors are loathe to reissue the contract, so this buyer has a bit of breathing room in which to conduct due diligence. However, contracts aren’t always issued to the buyer with the highest bid, and this is where an experienced buying agent comes into his own. Often it’s the buyer who can gain the vendor’s confidence in his ability to complete quickly without any complications. We ensure our clients have a 10 per cent cash deposit at the ready and the remaining funds are available within 30 days. An experienced, fast-working conveyancing solicitor is briefed on the situation and ready to act. Once the contract’s secured, we then commission a structural survey. This is more for peace of mind and gives an estimate of any refurbishment costs. If the home is being sold by a developer, we always insist on a defect liability period to remedy any issues that may arise subsequent to the sale. Vendors have their roles to play too. Frequently selling agents are demanding a 48-hour exchange period, but their client is not prepared to act this quickly. It’ s down to the vendor’s solicitor to ensure that planning permission has been documented, building control certificates issued, a property information questionnaire completed and local authority searches have been conducted along with details of the tenure. Without this information, solicitors are going to be reluctant to exchange contracts. Too often people are advised to spruce up their house before putting it on the market, but that is only part of the equation. To be able to move rapidly in this market, both vendors and buyers must be organised, have their finances in order, good solicitors and the ability to negotiate in a clear and decisive fashion. La Dolce Vita London style Cheryl Markosky brings you the latest word on the streets If you love pasta, parmesan and Puccini, then the thought of Italians accounting for 8 per cent of foreign buyers in London since January (beating Russians to the top spot) might make you want to crack open the Prosecco. According to Knight Frank’s latest central London index, it’s la dolce vita in the capital, where prices have risen by 11.6 per cent and the volume of sales by 85 per cent in the year to February. Liam Bailey, Knight Frank’s head of residential research, says, “The rationale for the revival has been well-rehearsed: weak pound plus capital flight plus rising global wealth minus thin supply equals rampant price inflation. An examination of market data confirms that the process seems set to deliver further growth, at least in the short term.” Demand from new applicant registrations – Italian or otherwise – has risen by 15 per cent in the past year, while the £5 million-

plus segment has climbed by 26 per cent. But the most positive indicator is sales volumes, points out Bailey. Even after an additional 11 per cent price rise over the past year, strong purchaser demand has led to higher sales volumes feeding through to exchanges, which are up by 43 per cent year-on-year. A ‘spring bounce’ of 2.5 per cent means London asking prices are near a record high due to a shortage of supply, says Rightmove, which spots signs of continuing market confidence in the capital: 24 per cent of respondents say they feel the current market favours sellers – double the figure for the rest of the UK – and 54 per cent view property as a lower risk asset class in these uncertain times. Miles Shipside from Rightmove puts part of the bounce down to more ambitious pricing of property in the early months of the year, partly due to estate agents vying for new seller instructions. “With the ongoing shortage of new sellers, prices will rise where the local market or a particular agent is short of a type or style of stock.”

Olympic countdown Cluttons anticipates that the majority of the 2 to 3 per cent growth forecast in central London this year will be concentrated in the first half in the run-up to the Olympic Games. This presents a window of opportunity for homeowners to take advantage of above-average growth, at a time when prices elsewhere are subject to falls. Cluttons head of research Sue Foxley says that despite distressed sales due to unemployment outside the capital: “Prime central London continues to see robust demand and price growth, with an upturn in enquiries from buyers in Greece and Italy who are seeking the security of a London investment, which is worsening the supply drought.” She adds that London homeowners, who have been biding their time before making a move to the suburbs, “can benefit from perfect conditions over the next three months, when we anticipate the majority of this year’s London price growth will take place before the Olympics pushes the property market onto the backburner. Prime central London sellers can take advantage of prices close to, or in many cases slightly ahead of, the pre-recession peak and

strong demand to secure a quick sale, which combined with falling prices in the suburbs, will enable them to trade up to a much larger property.” Ed Mead from Douglas & Gordon concurs that there’s little doubt the market has potential, with the highest number of buyers registering in 12 months. He believes the domestic market’s picking up quickest with low-tomid-level flats selling at last. “The higher end is proving a little stickier in early 2012 as foreign buyers, driving prices north, pause for breath. Perhaps the fact that the properties actually selling are those with nominal price cuts shows prices are reaching their peak,” Mead adds.

Moving up sideways Not everyone wants to go up in the world, with some buyers preferring the option of edging sideways to enjoy living laterally in two adjoining homes running over two buildings. Four-bedroom lateral Cedar House in Marloes Road, Kensington (through Knight Frank 020 7938 4311), is one example. Benefitting from plenty of natural light and high ceilings, the apartment has been refurbished to a high standard, while holding onto several original features, such as stained-glass windows in the front door. As there’s an airy open plan reception and dining room, the second reception room could be used as a fifth bedroom. Lateral living doesn’t come cheap and can be as sky high as dwelling in a tower. Sky-high prices for homes in tall towers Residential tower developments carry an average price premium of 36 per cent over their local new-build rivals, says a new study from CBRE. And the higher you go, the more you pay, with apartment prices increasing by an average of 1.5 per cent per floor. Strata in Elephant and Castle recorded the biggest premium of 68.4 per cent above the local value, followed by Pan Peninsula in Canary Wharf at 57.1 per cent. However, the uplift in Pan Peninsula is arguably more impressive given the larger number of comparable schemes in the vicinity. The biggest floor price premium was at Altitude 25 in Croydon, with the smallest difference seen at The Land Mark and Discovery Dock, both in Canary Wharf.

On the whole, floor price premiums varied within a fairly narrow range from 1.3 to 2.2 per cent. Jennet Siebrits, head of Residential Research at CBRE, says: “Unlike the high rise blocks of the 1960s, tower developments now symbolize luxury living and can add substantial value. They have been designed by famous architects to be provocative and iconic in a way that enhances their brand.” She believes the resurgence over the last decade has recently accelerated, because demand from South East Asian investors has become a driving force in the market. “Attributes like view, aspect, privacy and exclusivity are all enhanced by storey height, and as result, pricing increases from floor to floor.”

General rate rise looks unlikely Lenders not expected to follow Halifax, reports Duncan Farmer

New mortgage for self-employed Kent Reliance building society has launched a mortgage for self-employed borrowers that requires them to provide just 12 months’ business accounts rather than the typical three years. The loan, which has a two-year discount rate of 5.49 per cent for borrowers with a 25 per cent deposit or 5.99 per cent for borrowers with 20 per cent, is available under the Brightstar Financial brand. Kent Reliance and Brightstar look at accountants’ projections for at least the second year, six months’ personal and business bank accounts, and ensure that each applicant has a realistic plan to be able to pay their mortgage. There is a fee of two per cent, which can be added to the loan, and there are no early repayment charges. Andy Golding, chief executive of Kent Reliance’s parent One Savings Bank, said: “Where big banks still seem to be reluctant to lend to small and medium enterprises, we’re prepared to help entrepreneurs by taking an experienced and responsible look at their business potential. We recognise the huge contribution of UK entrepreneurs and small business owners to getting the economy moving and are delighted to make it easier for them to buy property.”

ever since it was introduced. Halifax last changed its cap in September 2008, but the move was beset with problems and it was forced by the Financial Services Authority to write to many of its SVR customers, and also pay compensation. This time around it will have been ultra careful to make sure everything has been done by the book. But does this move mean that Halifax believes the cost of borrowing is about to start climbing? No, says Boulger, although he is puzzled at the timing. “Because Halifax is in this unique position of having a cap it can change, I don’t expect this move to result in any significant SVR contagion,” he says, citing a fall in threemonth Libor rate (the rate at which banks lend to one another) and an increase in lending at low rates to eurozone banks. “If there was going to be a general increase in SVRs, it would have been more logical for it to have happened over the past six months as a result of the increased cost of funds during that time. Now that trend is being reversed, albeit only slightly, there would be less logic in an increase at this stage. Therefore a general upward movement in SVRs is unlikely until the bank rate changes, which looks to be at least two years away.” This change in the rate cap from Halifax certainly puts a whole new meaning to its catch phrase as ‘the bank that gives you extra’. Extra is not always good.

News that Halifax is to raise the rate on its standard-variablerate mortgage to 3.99 per cent led many borrowers to fear that it signalled the beginning of a wider move upwards for interest rates. But this may not be the case, according to Ray Boulger of broker John Charcol, who says that all Halifax was doing was bringing it into line with other lenders. “Halifax is in a unique situation as far as its old SVR is concerned,” he says. “It is the only major lender with an SVR cap which its mortgage conditions allow to be changed. It can do this by giving one month’s notice and allowing those borrowers the opportunity to redeem their mortgage within three months without paying any early repayment charges. “The other major lenders who had an SVR cap, Nationwide and Lloyds TSB and Cheltenham & Gloucester, whose cap is two per cent above the base rate, had no wiggle room in their contracts and so no opportunity to increase the cap.” This is why such a large proportion of borrowers with these lenders are now staying on their SVR of 2.5 per cent. It is also why these lenders introduced a new SVR for both new borrowers and existing customers taking a product transfer from 2009 and 2010 respectively; this new revert-to rate has been at 3.99 per cent

A tip for the Treasury

Mutual lenders grant faster

New mortgages approved for house buyers in January rose to 58,728, making it the highest monthly figure since December 2009 and up 30 per cent on January 2011. These figures are reflected in Land Registry data showing that average house prices rose by 1.1 per cent in January, with London prices climbing even higher. According to data from the Bank of England, gross mortgage lending increased 32 per cent in January to £1.9 billion, up from £1.4 billion the previous year. Meanwhile, the number of mortgage approvals jumped by more than half, with £1.7 billion mortgages being approved compared to £1.1 billion in January 2011. Another interesting statistic to come out of figures is that mutual lenders have been granting loans at a far faster rate than previously. “New lending and approvals for house purchase picked up across the market in January, perhaps in part due to first-time buyers taking advantage of the stamp duty holiday before it ends in March,” says Adrian Coles, director general of the Building Societies Association. “Lending activity by mutuals was up significantly in January compared to the same month last year, continuing the trend of increased lending by the mutual sector seen throughout 2011.”

It’s risky writing an article that goes to print just before Budget Day, but I suspect that what I’m proposing will not have been in the Budget. I have a suggestion for the Treasury that will be tax neutral but will help free up the sclerotic London property market and improve the movement of labour, while at the same time raising extra revenue from many individuals and companies who do not pay their fair share of tax. A UK resident, quite rightly, pays no capital gains tax (CGT) when selling their primary residence. But when they come to sell any property which is not their first home, they pay 28 per cent CGT on any uplift in the value. While not as high as it has been, this tax is a real inhibitor to investors selling and re-buying. ‘Non–residents’ who own and sell property in the UK pay no CGT at all. This is virtually unique in the world. Quite apart from being ridiculously unfair to UK property investors, landlords and second homeowners, this omission is a loss of significant potential revenue to the Treasury. Property Purchase Tax, masquerading under the misnomer Stamp Duty Land Tax, is currently paid at 3, 4 or 5 per cent on the vast majority of property purchases in London. This is a further huge inhibitor to sales transactions in the capital. So my suggestion is that the Treasury could, with the greatest of ease, impose CGT on non-residents when they sell any residential property in the UK. I have checked, and legislatively this is very simple to achieve. Clearly, we do not want to put off our friendly non-resident investors, so the CGT rate should be internationally competitive: 28 per cent is way too high. Perhaps 10 or 15 per cent is more appropriate. Being realistic, this is not a tax that will bring in an instant flood of revenue, but over time it will build and could be significant. My view is that any revenue raised in this way should be put directly into gradually reducing Property Purchase Tax (sorry, SDLT). This will definitely help to free up transactions in London while taxing those who are distorting the market and contributing very little at the moment.

INCREASING THE RENT With London rents rising at more than ten per cent a year, landlords should make sure the rent they are charging tenants is keeping pace with increases in the market. Landlords are often reluctant to put rents up by too much in order to encourage tenants to stay on, and while this is admirable in some ways, it does not make financial sense. This extra profit can be used either to clear the mortgage or provide a sinking fund for repairs and maintenance, and once a tenant has become used to a low rent for three or four years, it becomes harder to raise the rent to a market level. As the tenancy comes up for renewal, it is worth checking exactly what the market rent should be, and if the tenant is unhappy to pay much more there are – at present anyway – a queue of applicants willing to take their place.

Looking forward, the Olympics are likely to delay the return of strong corporate demand until September, creating a competitive supply environment in the back half of 2012. • Mayfair and St James is beginning to reassert itself as a preeminent residential location, and in particular the west side of Mayfair. There are two main reasons behind this: Commercial occupiers in inefficient Mayfair offices are able to access more suitable accommodation elsewhere in the West End. Hannah creates a model home on Beatles square The generous walk-in dressing room and storage space at a two-bedroom lateral apartment on Montagu Square is big enough for the wardrobe collection of a busy fashion model. Hannah Strafford-Taylor, who modelled for fashion brands such as Net-a-Porter and Alexander McQueen, lives at the Marylebone address with husband Ian and their daughter Soleil. Hannah totally refurbished the apartment using influences from her favourite modelling locations. Japan especially. “The greatest influence was Asia. I modelled and lived in Japan for four years so I got the opportunity to see a lot of amazing apartments. All seemed to effortlessly combine functionality and incredible style, often with limited space,” said Hannah, who has hung up her high heels for interior design. “In London – like in Tokyo – space is at a premium and I wanted to create something that maximised what we had to its full potential,” she said. “I wanted something that flowed, worked well and

had space for everything – for example, a walk-in closet for my enormous wardrobe collected over the years of modelling.” Hannah had renovated properties before, but in more minimalist style, and this was her first family home project. She flew to Bali to find an artist to hand-carve a stone mural, which took 16 weeks to complete, and had pebbles shipped to the UK for the two en suite bathrooms, dressing room and patio garden floors. New York style at home of Gold Medal winner The RIBA Royal Gold Medal for Architecture was last year awarded to Sir David Chipperfield, who founded his architects’ business in 1985, in recognition of his lifetime’s work. A tale of two markets Report by Cheryl Markosky NICK IS PROMOTED IN KNIGHTSBRIDGE Nick Hubbard has been promoted to manager of Benham & Reeves Residential Lettings in Knightsbridge. ARLA qualified, Nick has worked in the lettings industry for 14 years and joined the agency six years ago as a senior lettings negotiator. Among the properties currently on his books is a refurbished raised ground floor flat in Lennox Gardens, midway between Sloane Square and the V&A. The double reception has views over the garden square, the kitchen is highspec, and period features include high ceilings and an elegant fireplace. It’s a tale of two markets, with flats from £300 to £1200 a week faring well while fewer families hunt for homes above £2000. Claire de Wolff from Marsh & Parsons Holland Park reports lots of competition for homes at the low to midlevel and they’re going swiftly. “I had three competing bids for a two-bedroom flat with a garden on Holland Park Avenue that went for the asking price of £650 a week.” At the top end, things are different, which means landlords need to listen to the market and readjust their expectations. “If a landlord insists on holding on for £1800 a week when the property’s now worth £1500, digging their heels in could mean an unwanted void.” De Wolff notes more long-term renters entering the fray, signing longer two to three-year lets. “Some ask for a relocation clause that releases them from the contract if they’re sent somewhere else to work by their employers.” Her colleague Verity Barrett at Marsh & Parsons Kensington tips best-kept-secret schemes, such as Vicarage Court, off Kensington Church Street, as havens for single women. “Studio flats hovering around the

£300 mark go really quickly, as the girls love the building. It’s central – not far from Kensington High Street and Notting Hill Gate tubes ­and there’s a friendly porter.” A new trend is to gravitate towards Gloucester Road. “You won’t find as many City workers here, as they like to be near the Central Line, but the self-employed are happy to be here getting more for their money.” Another popular spot is Highgate Village, just behind Notting Hill Gate. “It’s good value in a prime location,” says Barrett, “with a three-bedroom terrace from £950 to £1150 a week.”

Going bonkers over the Olympics With reports of some London properties being advertised at £40,000 for the Olympics, is anyone paying such inflated prices? Zoe Rose, head of lettings at Strutt & Parker, thinks it’s unlikely, and that with some agents suggesting people will pay an Olympian five times normal value, she thinks everyone’s gone bonkers. “There’s a relatively small market for short lets and those wanting to let out their home for the Olympics mustn’t get carried away.” Rose says she’s creating a back-up list with properties that owners are happy to rent if there’s demand. Meanwhile, she’s concerned some greedy agents and landlords are trying to create a false bubble. “You’re almost better off going the other way and renting in Kent,” she suggests, but if keen overseas short-term tenants arrive at the 11th hour, at least she’s prepared with her list of available property. Lucinda Richardson from Winkworth Notting Hill reports demand from some Olympics fans who might need somewhere to stay, but she also cautions landlords that they need to adhere to shortlet regulations.

“Five boroughs, including Westminster, Kensington & Chelsea and Camden, are sending out letters reminding agents and landlords of the current laws. Westminster, for instance, doesn’t allow any lets for fewer than 90 days and emphasises it’s a criminal act to rent a property for a short period,” she says. Annaliese Griffiss, head of lettings at Henry & James, says the rules are not clear and advice from local authorities can be contrary. “Depending on who you ring, some say it’s okay to rent your home for the Olympics, some don’t know, and others say, no it isn’t.”
