Shelbi Webb has always been a creative thinker. Now, the Vernal Middle School student is putting her talents to use by making the comic book called Sugar Glider. She turns 12 on Saturday, Oct. 21, 2017. “I started to write when I was in first or second grade,” Webb said. “I would start telling my friend who was a grade higher than me to spell things and write things out. It was always cartoon books and just informational stuff.” Webb wants Sugar Glider to send a message for children and parents for talking about certain issues. “I had anxiety and I was bul-

lied,” Webb said. “I’m just hoping I can use an outlet and ease into the conversation because I know that it can be real hard.” Father Jason Webb is handling the marketing and is the parental guide for Sugar Glider. “We feel that it’s a great way for kids to be able to identify they have bullying, self image challenges and all the things the teenagers go through,” Jason Webb said. “This way it gives them a platform in which to share with adults.” Right now, Shelbi Webb is taking donations for Sugar Glider at http://kck.st/2gC8kbj, which is part of a Kickstarter fundraiser link.

Webb said. “I’m excited about all the people who have donated so far. That is just so amazing.” There has been a positive reaction when the pair have been promoting Sugar Glider. “They all seem pretty excited about it,” Jason Webb said. “They all like the idea. It’s a different twist. Spider Man in Peter Parker went through those high school issues, but it really wasn’t presented the same way.” The final cost of Sugar Glider is $10,000. Kickstarter ends on Oct. 31. Jason Webb said the book has raised right under 2,500. “I couldn’t have been more prouder,” Jason Webb said. “She is amazing. She reads a mile a

Dave Davis, owner and operator of the Haunted Woods, remains open despite Uintah County revoking his business license. Davis said he has a business license through the Ute Tribe and operates in Ft. Duchesne, where the license is valid and will remain open until “a judge tells him he has to close.” In the beginning of September, Davis wrote a letter to Uintah County, explaining that the Haunted Woods is his only source of income and needs to stay open. “We propose to use only the trails and small buildings that have already been inspected by you many times and the large building will be closed down to the public, no access permitted. To address the septic systems on the property they are for a cabin in the back and night guard trailer and there is no access for the public, no contractor will sign

off and accept responsibility for them so I was forced to sign up and get my own license, which can’t take place until February 2018,” the letter states. Davis voiced to UB Media, frustration with the county’s inspection process. This is the 19th year Haunted Woods has been open and Davis will not settle for closing up. Davis said he feels as though his hands are tied because there is no contractor that will sign off on the septic systems. “I told them, with or without your permission, I’m running the Haunted Woods. We have human rights to earn income and right now that’s my only source of income,” Davis said. “I don’t care what they say, I’m running the Haunted Woods. I am not closed. My doors are open. I have a tribal business license that takes care of that. I’ve paid my state tax, so to me, until I have a judgement from a judge that says I am closed, I am open.”

On Sept. 29, 2017, Brehm Communications purchased Basin Nickel Ads and is adding it to UB Media, which is the current home of Vernal Express, Uintah Basin Standard and UB Shoppin, since 2007. According to Ryan Schuyler, vice president of operations for Brehm Communications, the cost of the purchase cannot be disclosed at this time. Schuyler said the Nickel Ads has been a staple in the community for 40 years and the company saw an opportunity when the business was put up for sale and the Caldwell family started looking toward retirement. Uintah Basin Healthcare is introducing an innovative program with the use of telemedicine for newborns requiring lung recruitment / resuscitation, a potentially lifesaving program that is expected to improve care and drastically lower the number of newborn transports due to respiratory issues. Affiliated with the Early Lung Recruitment (ELR) & Resuscitation Program developed by leading neonatologists, respiratory therapists and nurses in their field at Intermountain Healthcare’s Utah Valley Hospital, the program is showing undeniable success. The program is much more than a camera & TV with both live 2-way video and audio communication between skilled UBH staff and an off-site boardcertified neonatologist where the neonatologist can see the rise and fall of the infant’s chest and trained staff from both UVH and UBH combine as partners to

work together to provide superior care. That’s the simplified explanation of the technology, but the education goes much deeper than that. Uintah Basin Healthcare first met with some key individuals at Utah Valley starting two years ago. Stephen D. Minton, MD, Neonatologist; Gordon Lassen, BSc, RRT-NPS, Manager, Department of Respiratory Care; and Jody Stevenson, BSN, RN, C-EFM, Unit Education Consultant; were key players in providing insight as Uintah Basin Healthcare was looking to provide solutions to better care for newborns in respiratory distress. They quickly learned that their goals were aligned, to provide expertise to rural areas that have a need for a higher level of expertise when very sick newborns need advanced care, typically only available in a newborn intensive care unit provided by a neonatologist (a pediatrician with specialty training in the care of newborn infants). “Uintah Basin Healthcare is

fortunate to have people that are very progressive and recognize they want to be part of a system that can provide a higher level of care to their newborn patients, allowing them to stay closer to home. We spoke with administration, a pediatrician, family practice providers, the OB team and respiratory team – and together they all had the foresight to recognize the value of this program for their patients. UBH was able to create this partnership for the community, providing needed certified neonatal care in the Uintah Basin” stated Dr. Minton. The first two minutes of a newborn’s life are a critical process as the baby transitions to their post-natal life. Any injury to the lung during the first few hours of life can have a significant lifelong effect. The ELR/Resuscitation program being implemented has a very strong focus on the steps taken in the first thirty minutes of life to get an infant breathing well and on their own, without causing damage to the lung.

An un-recruited lung that is constantly opening and closing causes damage to the lung. The repetitive motion of opening and closing can tear the lung and create pneumothorax. In order to prevent lung damage, we recruit the lung using a pressurized air delivery system that goes over the infant’s face. The mask is placed on the patient and appropriate pressures are delivered based on the neonatal resuscitation 7th guidelines and the guidelines developed by Dr. Stephen Minton and his group. In summary, this program is when a baby that is struggling to breath immediately after birth has a timely intervention by the newborn staff where controlled pressure is applied directly to the lung to help open up wet and collapsed lung tissue. The results is an infant that returns back to mom without any problems. “One in ten babies born typically needs help breathing. We have traveled all over the world, and what’s interesting is how many facilities aren’t taking advantage of “the golden minute” when there is a high propensity for children to have fluids or problems breathing leading to long term consequences or higher mortality rates if they have not been managed effectively. Simple intervention changes the outcome. We have the data to prove it” stated Dr. Shaun Odell, Neonatologist at Utah Valley Hospital. “The golden minute” isn’t taken lightly at UBH. UBH took a year to develop the partnership with the ELR program, and UBH staff have been doing mock trainings for a year. The Neonatal Resuscitation Program (NRP) is required for all skilled personnel who attend deliveries at Uintah Basin Medical Center including doctors, nurses and the respiratory therapy team – and now with more depth and

more frequency than ever. It is now understood that taking the NRP course once every 2 years (as required by the American Academy of Pediatrics) was not sufficient to retain the needed knowledge for effective newborn resuscitation. Within a month of taking the course, the majority of skills learned were forgotten and the welfare of the infant could potentially be at risk. The new program requires intensive training on a monthly basis. The training comes in the form of mock codes with a state-of-theart “simulation baby”. The sim baby can realistically simulate a resuscitation on an infant. We train in simulation so when a mistake is made, we can educate the staff without risking a patient’s well-being. Real-time vitals such as heart rate, respiratory rate and oxygen saturation are seen on the baby and the monitor. The staff are trained by simulation on what it’s like to be in these situations and how to respond. Repetition leads to retention of knowledge and an increase in the skills needed to resuscitate. Staff members put in three or more hours per month mastering these skills. “Training has led to a drastic reduction in the number of newborns with respiratory complications being transported to other facilities for additional services. In the first six months, newborn transports decreased from 12 to 3 transports – a 75% reduction. Keeping baby healthy and here with the parents, and avoiding unnecessary transport costs is tremendous. This is another example of our medical providers and staff working together to ensure that our community is receiving the best in healthcare, right at home” stated James Marshall, President & CEO of UBH.

United States, the Tenth Circuit decided that because the United States has already published its intent to repeal costly fracking rules which the United States published in March 2015, the Tenth Circuit would dismiss the appeals and the underlying district court suit related to those rules. Wyoming v. United States. The Ute Indian Tribe was the only tribe which participated in that District Court case and then in the appeal. The Ute Indian Tribe, four states, and attorneys for oil industry groups obtained a preliminary injunction barring implementation of the March 2015 rules and then a permanent injunction. Those orders prevented BLM from imposing its new and costly rules on Indian lands and on federal lands. The Tenth Circuit’s September 21 decision provides an unusual situation by which the federal regulations that existed before March 2015 will remain in effect while the United States completes the procedural steps to formally repeal those same rules. The only Court which has reviewed the March 2015 rules and the administrative record upon which BLM attempted to justify the rules issued a preliminary injunction barring the rules because the BLM had violated its statutory obligation to consult with tribes in good faith. That same court also held that even if BLM had complied with its statutory duty to consult with tribes, BLM would still have lost because it did not have lawful authority to adopt the rules. The Court subsequently permanently enjoined the rules, stating it did not even need to determine whether BLM had properly consulted with tribes because BLM did not have authority to adopt the rules. On appeal, the Tribe provided a thorough legal analysis of why BLM did not have rulemaking authority on tribal lands. And, as Judge Hartz noted in his separate partially concurring and partially dissenting opinion, even though he agreed with the other two judges with regard to the complex procedural decision as it related to federal lands, the

Court should have ruled in favor of the Tribe on the separate issue of Indian lands because the United States did not even attempt to respond to the Tribe’s correct legal analysis that BLM lacked rule-making authority over tribal trust lands. The other two judges appeared at oral argument to be in agreement with the substance of the Tribe’s arguments, but decided it would be a better use of judicial resources to simply dismiss the appeal on the complex procedural question without issuing any ruling on the Tribe’s substantive argument. One of the judges disagreed, and in a partial dissent, Judge Hartz indicated that he thought the Tenth Circuit should reach this issue, stating: The Tribe has adequately raised the issues specific to it both in district court and in this court…” “Yet the other parties have failed to challenge the Tribe’s reasoning. I would treat that failure as a waiver and affirm judgment for the Tribe with respect to Indian lands. Resolving that matter would entail no waste of judicial resources.” Although it appears the current BLM Administration has taken the position the March 2015 rules will not be implemented on the Uintah and Ouray Reservation, the Ute Indian Tribe intends to request that the Tenth Circuit reconsider its September 21, 2017 decision. The Tribe will ask the Court to adopt Judge Hartz’ position, and decide on the merits that BLM does not have rulemaking authority regarding fracking on tribal lands. The Tribal Business Committee issued the following statement regarding the decision in this case: The Tribe is confident that its legal analysis is correct, that BLM does not have rulemaking authority over fracking on tribal lands, and that the Tribe will eventually prevail on that issue. The Tribe is tired of these ongoing practices to treat and regulate Tribal lands as public lands. The United States could not even come up with a response to the Tribe’s thorough and careful legal analysis on the issue. We hope that the Tenth Circuit will take this opportunity to decide this important issue of federal Indian law now, instead of allowing BLM to continue to violate both tribal sovereignty and federal law.
