Property

insurance is an issue which constantly arises when discussing Vir-

gin Islands real estate. More often than not a financial institution which has provided a loan facility will require that a property owner maintain some form of property insurance over their property. However, even outside of that or similar situations, property owners often recognise the risk of ownership and the fact that disaster can strike at anytime, accordingly, many property owners often seek to purchase some form of property insurance. Property insurance is a type of insurance policy that combines various forms of personal insurance protections, which can include losses occurring in relation to one’s property, its contents, loss of use or loss of other personal possessions of the property owner, as well as liability insurance for accidents that may happen at the property. For property owners in the Virgin Islands, losses arising from hurricane, earthquake, flood and fire are the primary risk factors and are the areas for which property owners usually seek coverage. Liability insurance for accidents occurring on the property is also becoming increasingly popular. Some policies are referred to as a multiple-line insurance policies, meaning that it includes both property insurance and liability coverage, with an indivisible premium, meaning that a single premium is paid for all risks. The cost of the property owner's insurance often depends on what it would cost to replace the property and what additional endorsements or riders are attached to the policy. The insurance policy is a legal contract between the insurance company and the named insured (s). It is a contract of indemnity and will put the insured back into the state he or she was prior to the loss. Typically, there will be certain exclusions (for example, damage caused by termites may be excluded). Accordingly, a homeowner should always check their policy carefully and understand the exclusions which may be applicable. Special insurance can be purchased for certain general exclusions.

FEATURED ARTICLE A property insurance policy is usually for a specified term, usually one year, and the payment the insured makes to the insurer is called the premium. The insured must pay the insurer the premium each term. Most insurers will charge a lower premium if it appears less likely the property will be damaged, for example, if it is equipped with fire sprinklers and fire alarms; if the property exhibits wind mitigation measures, such as hurricane shutters; or if the property has a security system etc. The insurance rates are usually adjusted each term to reflect the cost of replacement, usually upon application of an inflation factor or a cost index. Insurance business in the Virgin Islands is regulated by the Insurance Division of the BVI Financial Services Commission. They are responsible for the prudential regulation of insurance business conducted in and from within the Virgin Islands. This includes, but is not limited to ensuring that prospective Licensees, which would include Insurers – Domestic or Captive, Insurance Managers, Insurance Intermediaries - Insurance Agents or Insurance Brokers and Loss Adjusters meet the required standards to be licensed in accordance with the Insurance Act, 2008, the Insurance Regulations, 2009, the Regulatory Code, 2009, the Financial Services Commission Act, 2001 and related legislation.

The Division monitors Licensees against relevant legislation, which was written taking into account the Insurance Core Principles of the International Association of Insurance Supervisors, the international standard setting body for insurance. Monitoring includes review of financial status, compliance with regulatory standards, compliance with AML/CFT legislation and corporate governance. For most people, owning their own home or business is their largest financial investment and therefore securing it with the appropriate type of insurance is in the property owner’s best interest. There are several well known and reputable insurance com-
