Liquidation shock By Andries van Zyl
News of the liquidation of the main contractor at the new Makhado Crossing Mall sent shockwaves through the local business community the past week. CMC Koch Konstruksie filed for voluntary liquidation during December, effectively leaving debts of several millions of rands in the local economy. The fear exists that many of the smaller sub-contractors and suppliers will not be able to recover from this loss and may also close their doors. CMC Koch Konstruksie belongs to two brothers, Carl Francois Koch (47) and Charles Martin Clemons Koch (50), originally from Polokwane. The company was appointed as the main contractor to extend the Makhado Crossing Mall. When the project was launched, the estimated development cost was almost R400 million. The developer of this new state-of-the-art mall is the Masingita Group of Companies, in partnership with Investec Properties. The holding company that was formed is Italite. Italite responded to media enquiries this week and said that news of CMC Koch’s liquidation had also come as a shock to them. They were, however, quick to point out that this would not affect the development project and that all nominated sub-contractors had been paid in full. “Under the selected sub-contract agreement, there is a contractual provision for when the main contractor fails to make payment to them that the employer and principal agent can make direct payment,” said Italite in their response.
When did things start going wrong? According to Italite, CMC Koch started showing signs that they were experiencing financial difficulties in May 2019. They explained that the main contractor could appoint sub-contractors to do specialist work on the project. In terms of the agreement, the selected or nominated sub-contractors are covered by a provision that allows the developer to pay them directly, should problems arise. (Contd on P2)

Jesus se liefde is selfopofferend. - Ds. Hannes Lee (Gereformeerde Kerk Messina)

about R5 million due to CMC Koch’s failure to pay,” said one supplier from Louis Trichardt, who was directly appointed by CMC Koch and did not get paid either. Another contractor the Zoutpansberger spoke to said that he estimated that several contractors from Polokwane also faced the same problem of not getting paid.
No comment from CMC Koch The Zoutpansberger tried to get comment from CMC Koch, asking them to explain to the sub-contractors and suppliers what had gone wrong? The questions were sent to the company’s attorney, Johan Snyman, who referred the questions to Van der Westhuizen, the company’s appointed liquidator. Van der Westhuizen, however, was of little help. “I am meeting with the directors of the insolvent estate this coming Friday and will commence my investigations and duties in terms of the act. At this juncture, and despite the fact that I will obtain certain information in the execution of my duties as provisional liquidator, I doubt whether or not I will be able to share this information with you for publication in the newspaper or in any other public sphere for that matter, prior to the conclusion of my investigations and institution of possible actions against identified parties in terms of the provisions of the Insolvency act and Companies Act. I am not prepared to litigate by way of public publications in newspapers…” Van der Westhuizen stated. Although Makhado Crossing officially reopened in November last year, some outstanding contracts are still to be finalized. These include the relocation of the squash court and gymnastics hall. Asked how their main contractor’s liquidation would affect the proposed relocation of these sporting facilities, Italite responded by saying: “It does not affect the work as this would be a separate contract still to be tendered and appointed for completion by September 2020.”

Busy festive season for local emergency services By Veruska van der Linde For many the 2019 festive season was a time of celebration with family and friends, but for some it was a time of great sadness with the loss of loved ones through vehicle accidents. The Zoutpansberger spoke to the head of the Makhado Fire Brigade, Mr Jack Ramalatso, last week to find out how busy the emergency services had been over the festive season from 1 to 31 December. Ramalatso said that they had attended a total of 24 motor vehicle accidents

during the period. Of these, three P4s were recorded. This falls under priority 4 - “code blue” - meaning that victims were declared dead on arrival because of critical and fatal injuries. In addition, the Makhado Fire Brigade attended to 64 P3s, which fall under “code green” for victims who experienced minor injuries or illness, as well as 21 P2s - “code yellow” - for victims with moderate to potentially serious injuries, such as fractures. Luckily, only one P1 - “code red” - was recorded for victims with life-threatening injuries or illness, such as internal injuries, heart
attacks, head injuries, severe burns and bleeding and breathing difficulties. Looking at these local statistic, one can clearly see that many people definitely did not enjoy their festive season. The main causes of these accidents, Ramalatso said, were speeding and dangerous overtaking. Most of these motor vehicle accidents also occurred on the busy N1 north and south. One fatality was recorded on the Madombidzha road. Sadly, the carnage on the country’s roads continued into January, bringing more grief to local communities. (See accompanying article).

Pa Dawie het in 1988 as Graad 1-leerling by die skool begin, terwyl oupa Dopper Kruger in 1961 as Standerd 4-leerling (Graad 6) by die skool aangekom het.

Ridgeway matriculants again impress School News
Ridgeway College’s top IEB student was Gundo Netshifhefhe, who attained five distinctions. Photo supplied.
Marco Marcos (four distinctions). Photo supplied.
Outstanding results were once again attained by Ridgeway College’s top achievers in the 2019 Cambridge AS and IEB exams. “This time of year is fraught with tension and excitement as matriculants around the country await the results of their examinations. Our Ridgeway pupils have been no different. We are proud of each and every one of them for the work they put in and for the rewards they have reaped. We hope that each of them has achieved the marks they needed for the courses of their choice and, as we celebrate their success, we thank every member of staff who played a part in that success and the parents for their support,” said the college. Didiza to lift this moratorium on non-affected areas and deal decisively with FMD outbreak as per the World Organization for Animal Health (OIE) guidelines. It is unfortunate that, amid a national drought, farmers are now being forced to go to court to ensure they can conduct ordinary business of trading livestock. Moreover, it is regrettable that Minister Didiza is not following the clear World Organization for Animal Health (OIE) guidelines on what exactly needs to be done with any outbreak of Foot and Mouth Disease,” said the DA in a press release. According to the DA, the department has, to date, failed to :disinfect all affected farms and vehicles in the affected regions; create visible policing that monitors all movements of livestock-carrying vehicles in the province to enforce quarantine; allocate a budget to fight the disease outbreak; conduct routine inoculation after the Vhembe District disease outbreak because of the lack of vaccines and similar strains are found in the region; and inform police authorities to take all steps to protect the spreading of the disease. “The severity of this outbreak cannot be downplayed as the last outbreak of FMD in January 2019 resulted in a brief ban on South African wool and meat exports, which cost the economy in excess of R10 billion. We again call on the Minister to take immediate action before it is too late,” said the DA.
