The name of the town is, legally, still Louis Trichardt until such time as the Minister of Arts and Culture, Mr Paul Mashatile, officially rejects the objections against the name change to Makhado. The Minister of Arts and Culture has acknowledged receipt of the objections of the Chairpersons Association (CA) against the second name change of the town Louis Trichardt to Makhado. The current “legal position” on the town’s name was explained by Mr André Naudé, attorney and CA Chairperson, on Tuesday. Naudé advised businesses and institutions to keep the name Louis Trichardt and not incur any expenditure to change the name at this stage. “The name change from Louis Trichardt to Makhado, Makhado to Louis Trichardt and now again to Makhado will cost more than R15 million, being fruitless expenses which could rather be spent on the improvement of the poor and lacking service delivery,” the CA states in its objection to the Minister. Minister Mashatile published the name Makhado in the Government Gazette on 14 October last year. The reason that the Minister gave to the Zoutpansberger for changing the town’s name was that “a request was received from Makhado Municipality to change the name and all necessary processes were followed in terms of the South African Geographical Names Council.” In its objection, the CA states that the

The objection by the CA to the name change was handed to the minister within the 30-days objection period. The objection comprises a 16-page letter, supported by more than 400 pages of documentation. The acting administrative secretary of the arts and culture ministry, Mr Jack Boitumelo, replied on 20 March that the CA’s letter would be “brought to the Minister’s attention, and a response will follow in due course.” Naudé said that another letter had been received, stating that the matter would be referred to the ministry’s legal section. The CA warns in its objection that the Minister might be embarrassed by all the information that would be brought to the attention of whoever the presiding judge or judges would be at the applicable forum. The CA quotes a councillor’s comment with a racial slur on the previous namechange court cases: “The municipality have won the case at the Pretoria Supreme Court because the presiding judge was black and ‘our comrade’ but unfortunately at Bloemfontein in the Appeal Court turned the Pretoria judgement down… they did this because all the presiding judges there were all white apartheid Afrikaners who are out of step with our new democracy and are still clinging to

The CA points out that those statements constitute an extreme attack on the independence of the judiciary. “The president of the Supreme Court of Appeal (SCA) was Judge Howie, Judge Farlum, as well as Judge Brand and the other senior appellant judges were Judges Jafta and Cachalia and could not be branded as white judges … this is an extreme insult to the appellate judges of this country,” states the objection letter. The CA objects that all the organs of state “were not at all transparent by hiding documentation and information from the CA and other stakeholders”. Among others, the CA requested copies of minutes, resolutions and recommendations of the Makhado Municipality, the Limpopo Provincial Geographical Names Committee and the South African Geographical Names Council. Adv Tommy Ntsewa of the SAGNC refused to send the documentation to the CA. Naudé said that, in the event of the Minister’s turning down their objection, the name would legally be Makhado until the court ordered the name change to be reviewed. Even in the event of the Minister’s not endorsing the objection, no changes from Louis Trichardt to Makhado should be made from an economic point of view until all court processes had been finalized. The CA emphasized once again that they would definitely go to court to have the name change reviewed if their objection was rejected.
