The name of the town is, legally, still Louis Trichardt until such time as the Minister of Arts and Culture, Mr Paul Mashatile, officially rejects the objections against the name change to Makhado. The Minister of Arts and Culture has acknowledged receipt of the objections of the Chairpersons Association (CA) against the second name change of the town Louis Trichardt to Makhado. The current “legal position” on the town’s name was explained by Mr André Naudé, attorney and CA Chairperson, on Tuesday. Naudé advised businesses and institutions to keep the name Louis Trichardt and not incur any expenditure to change the name at this stage. “The name change from Louis Trichardt to Makhado, Makhado to Louis Trichardt and now again to Makhado will cost more than R15 million, being fruitless expenses which could rather be spent on the improvement of the poor and lacking service delivery,” the CA states in its objection to the Minister. Minister Mashatile published the name Makhado in the Government Gazette on 14 October last year. The reason that the Minister gave to the Zoutpansberger for changing the town’s name was that “a request was received from Makhado Municipality to change the name and all necessary processes were followed in terms of the South African Geographical Names Council.” In its objection, the CA states that the

The objection by the CA to the name change was handed to the minister within the 30-days objection period. The objection comprises a 16-page letter, supported by more than 400 pages of documentation. The acting administrative secretary of the arts and culture ministry, Mr Jack Boitumelo, replied on 20 March that the CA’s letter would be “brought to the Minister’s attention, and a response will follow in due course.” Naudé said that another letter had been received, stating that the matter would be referred to the ministry’s legal section. The CA warns in its objection that the Minister might be embarrassed by all the information that would be brought to the attention of whoever the presiding judge or judges would be at the applicable forum. The CA quotes a councillor’s comment with a racial slur on the previous namechange court cases: “The municipality have won the case at the Pretoria Supreme Court because the presiding judge was black and ‘our comrade’ but unfortunately at Bloemfontein in the Appeal Court turned the Pretoria judgement down… they did this because all the presiding judges there were all white apartheid Afrikaners who are out of step with our new democracy and are still clinging to

The CA points out that those statements constitute an extreme attack on the independence of the judiciary. “The president of the Supreme Court of Appeal (SCA) was Judge Howie, Judge Farlum, as well as Judge Brand and the other senior appellant judges were Judges Jafta and Cachalia and could not be branded as white judges … this is an extreme insult to the appellate judges of this country,” states the objection letter. The CA objects that all the organs of state “were not at all transparent by hiding documentation and information from the CA and other stakeholders”. Among others, the CA requested copies of minutes, resolutions and recommendations of the Makhado Municipality, the Limpopo Provincial Geographical Names Committee and the South African Geographical Names Council. Adv Tommy Ntsewa of the SAGNC refused to send the documentation to the CA. Naudé said that, in the event of the Minister’s turning down their objection, the name would legally be Makhado until the court ordered the name change to be reviewed. Even in the event of the Minister’s not endorsing the objection, no changes from Louis Trichardt to Makhado should be made from an economic point of view until all court processes had been finalized. The CA emphasized once again that they would definitely go to court to have the name change reviewed if their objection was rejected.

Inbrake moontlik die werk van sindikaat

Geen rede om reg in eie hande te neem Al word ‘n misdaad vermoed, is dit steeds geen rede om die reg in eie hande te neem en mense aan te rand nie. Dit was die uitspraak van die Louis Trichardt Streekhof, nadat ‘n sakeman en sy me debeskuldigdes skuldig gepleit het op klagte van ontvoering, aanranding en aanranding met die opset om ernstig te beseer. Martinus Jacobus Oosthuyse (47) en vier van sy werkers, Rodger Chikadzi, Gift Machipisa, David Mapiye en Gilbert Sikhokho Muthelo, het Maandag weer hier in die hof verskyn. Hulle het in gevolge ‘n pleitooreenkoms met die Staat skuldig gepleit. Na verneem word het die Staat ingewillig tot die ooreenkoms weens ‘n gebrek aan bewyse.
Tydens hul arrestasie in September verlede jaar is al vyf mans ook aanvanklik aangekla van poging tot moord. Dié klag is ingevolge die pleitoor eenkoms teruggetrek. Die klagte hou verband met ‘n voorval waar die mans die reg in eie hande geneem het en vir Calvin Moyo (29) aangerand het. Destyds was daar ook sprake dat die vyf beskuldigdes vir Moyo en nog twee ander mans agter ‘n bakkie gesleep het en aan ‘n boom vasgebind en met pype aangerand het. Kort na hul arrestasie is Oosthuyse se seun, Tinus (25), ook in hegtenis geneem op dieselfde klagte. Alle aanklagte teen hom is egter later teruggetrek. Volgens die mans se verkla rings, wat voorgelees is in die
hof, was hulle oortuig dat Moyo buitebande gesteel het by Oosthuyse se onderneming, Eagle Tyres. Hulle het Moyo met “die oop hand geklap” in die hoop dat hy sal bieg oor die bande wat hy kwansuis sou gesteel het. Moyo het getuig dat die vyf hom aangerand het met ‘n waaierband en dat sy neus, sewe maande na die voorval, nog kronies aan die bloei gaan. Chikadzi is gevonnis tot ‘n boete van R1 000 of een jaar gevangenisstraf. Machipisa, Oosthuyse en Mapiye is elk gevonnis tot drie maande gevangenisstraf wat vir ‘n jaar opgeskort is. Muthelo is gevonnis tot ses maande gevangenisstraf, opgeskort vir ‘n tydperk van een jaar.
In die jongste voorvalle van inbrake by indus trieë in Louis Trichardt is springstof gebruik om slotte oop te kry nadat alarmstelsels verwoes is. By Danedie in Burgerstraat was ‘n stoorkamer, wat met ‘n ou polisieseldeur toegerus is, die inbre kers se teiken. Hulle het die slot en die staalplate waarmee die eerste deur van die stoorkamer bedek was, weggeblaas. Daar is ook goed gemik om die slot van die stewige seldeur weg te skiet. “Dit is nog ‘n ou seldeur wat my oorlede pa, Eddie Senekal, jare gelede present gekry het. Die slag was so erg dat dit een nabygeleë deur uit sy kosyn geruk het en ‘n ander deur se slotmeganisme uitgeskiet het. Die seldeur se tralies het egter nie meegegee nie en sodoende is die gasbottel van die sweismasjien binne in die stoorkamer beskerm. As daardie gasbottel ontplof het, was daar groter skade,” sê me. Anel van der Walt, suster van mnr. Pieter Senekal, wat die besigheid saam met sy ma, me. Madie Senekal, besit. Pieter sê dat die inbrekers presies geweet het wat hulle doen. Hulle het toegang deur die dak verkry regoor die alarmboks. Die alarmstelsel se drade is in die dak geknip. “Hulle het seker gedink die stoorkamer se dik staaldeur is die deur van ‘n inloopkluis,” sê Anel. Die inbrekers het tevergeefs die staalkas binne in die stoorkamer se slot ook afgeskiet. In die stoorkamer was toerusting, maar geen kontant nie. Die seldeur is juis aangebring om die toerus ting te beskerm, nadat die besigheid sowat twee jaar gelede van al hul toerusting beroof is. ‘n Jaar ná die voorval het die polisie al hul toerusting vir hulle teruggevind. “Hierdie keer was ons definitief een van die gelukkiges. Ons hou geen kontant op die perseel nie,” sê Anel. Tog beloop hul skade sowat R15 000. Die voorval moes tussen Sondagnag en Maandagoggend plaasgevind het. Dieselfde inbrekers het moontlik daarna by Steyn Staal op die aangrensende perseel ingebreek . Volgens mnr. Saki Nel van Steyn Staal het die inbrekers eers ‘n gat in die staal regoor die staalafdeling gemaak. “Daarna het hulle ‘n gat in die staal by die harde
ware kant gemaak, seker op die muur langs geloop en die alarmboks se drade uitgeruk. Hulle het die kas in die administratiewe kantoor oopgemaak en nie geld daar gekry nie. Die hele winkel het vol afgeskeurde omhulsels gelê soos wat hulle ons eie gereedskap gebruik het om slotte oop te maak,” sê Nel. Nadat hulle die deur van die vertrek waarin die kluis is, se slot met gereedskap oopgemaak het, het hulle die kluis se deur met springstof afgeskiet en die kluis het van die muur afgeval. “Hulle is weg met sowat R30 000. Ons het nog nie ‘n beraming van die koste van die herstel van die res van die skade nie,” het Nel gesê. Kaptein Maano Sadiki van die SAPD het in ‘n kort polisieverklaring gerapporteer dat die Makhado polisie die sake ondersoek. Hy het gemeld dat die beweerde gebruik van springstof ook ondersoek word. “Die georganiseerde misdaadeenheid van Polokwane was hier en dit lyk of hulle die saak gaan ondersoek omdat dit moontlik ‘n sindikaat se werk is,” sê Pieter. Daar is ook genoem dat dit die negende voorval van hierdie aard in die omgewing is.

Hulle is bereid om enige werk te doen, hoe groot of klein die projek ookal mag wees. “Wat ons uniek maak, is dat ons 99% van die tyd op terrein is. Baie mense kla dat kontrakteurs net hul werkers kom aflaai en dan weer ry.
Dan sien mens eers heelwat later die foute. Ons het altyd ‘n toesighouer op die terrein – dit is ons beleid,” sê die Hattinghs. F.A.S Civil se dienste sluit ondermeer ook in die seël van dakke. “Ons sal selfs vir jou ‘n huis kan bou, as jy die nodige goedgekeurde planne het. CoAL wants to leave legacy at Vele A mine and a plant nursery – two apparently contradictory concepts – have been brought together at the Vele Colliery of Coal of Africa (CoAL). Last week, just two weeks before the official opening of the Vele Colliery, the Zoutpansberger was invited to visit the Vele Colliery. Long before the gaping hole of the mine’s central pit becomes visible, visitors to the mine will pass CoAL’s temporary nursery filled with indigenous plants. Even around the “dune-coloured” coal plant itself, mopani bush can be seen – trees that were not in the way were left standing. Additionally, the plant tower was also built a bit lower for “aesthetic reasons”. Together with a road, lined with natural bushveldt, the gigantic opening of the central coal pit comes as somewhat of a surprise. In just five months’ time, 55 000 ton of coal have already been exhumed from the pit. Yet in accordance with the law, CoAL general manager Ben Nolan said that they were determined to leave a legacy and become trendsetters in the mining industry. They are after all, he said, the first mine in South Africa that is operating with the approval of three different state departments and their laws. As part of the legacy they want to leave after the mine is closed, the central pit is mined according to a “rollover open-cast mine methodology”. This means that before another pit is opened up, the first one will be rehabilitated. Plants and trees that have been removed will be replanted. This is why a nursery had to be built. All the plants - mopani, baobab and aloe - were removed carefully during the ground-clearance phase and are being taken care of until such time that regrowth will be started. Nolan further confirmed that Vele is currently not using all the water allocated to them in their water licence. Water is precious to them, and every drop is saved by means of closed-tank systems. Currently, the mine is using salt water that is unfit for human
or animal use, which is being stored and recycled afterwards. The water is also closely monitored, at the mine as well as on the surrounding farms. Another important asset to CoAL is their employees and their safety. They are currently employing close to 500 people, most of them from the Vhembe region. “Vele is for Limpopo,” remarked Nolan. As part of their employment strategy, CoAL has established the King Mphephu Bursary Fund for Vhembe students interested in disciplines such as engineering, surveying, geological and environmental sciences. The fund was started in 2009, and Vele currently has absorbed three students that have completed their studies. “We want to mine in a sustainable manner, with

particular emphasis on the environment, but also on the people of the region,” explained CoAL’s investor relations manager. Deur Isabel Venter

CoAL beplan om in twee fases vir hul Makhadoprojek se waterlisensie aansoek te doen. Die mynmaatskappy het dié aankondiging gemaak tydens ‘n watervergadering in Louis Trichardt verlede Woensdag. Die Makhado-myn is noord van die Soutpansberg, sowat 65km suidwes van Musina, in ‘n sensitiewe biosfeer wat bekend is vir sy beperkte waterbronne. Dié projek is tans nog in sy prospekteringsfase, maar CoAL het reeds aansoek gedoen vir ‘n mynregtelisensie. Lede van die gemeenskapsorgansisasies Makhado Aksiegroep (MaKaG), Dzomo la Mupo en die Ndima-gemeenskap het die vergadering bygewoon. Gemoedere het by tye hoog geloop toe lede van
Dzomo la Mupo prontuit vir CoAL se verteenwoordigers gesê het dat hulle onwelkom is in die streek. “Ons soek julle nie hier nie, CoAL!” het Mphatheleni Makaulule van Dzomo la Mupo gesê. “Ons sal nog baie meer dinge doen om julle te stop! Ons soek julle nie hier nie!” CoAL se bestuurder van die Makhado-projek, mnr. Eugene O’Brien, het voor die tyd bevestig dat die betrokke vergadering addisioneel gereël is om geaffekteerde partye ekstra kans te gee om hul griewe te lug. Hierdie griewe is noukeurig aangeteken en sal in oorweging geneem word alvorens CoAL se waterlisensie toegestaan word. “Ons hou hierdie deel van die land in ons hande; daarom moet ons verantwoordelik gehou word vir dit wat ons sê en doen,” het O’ Brien gesê. Die Makhado-projek sal in die eerste lewens-
fase van die myn die ondergrondse waterbronne gebruik. Volgens O’Brien het die Departement van Waterwese reeds goedkeuring hiervoor gegee. Die water sal die myn tot ongeveer 2016 hou, waarna hulle vir ‘n grootmaatwaterlisensie sal moet aansoek doen om addisionele water te bekom. CoAL het bevestig dat hulle na die Nzheleledam en –pyplyn kyk vir die ekstra water. Indien hulle nie goedkeuring kry om water uit die dam te gebruik nie, het hulle reeds na ander moontlikhede gekyk. Een so ‘n moontlikheid is om water uit die Limpoporivier na Makhado te pomp. Mense en ander organisasies wat ook wil protes aanteken teen CoAL se waterlisensie het 60 dae om hul griewe in te handig by die departement of by CoAL.

Aanvanklik is berig dat die taxi ‘n voetganger getref het, maar die polisie kon dit nie bevestig nie.

Oom Helgard Cronjé se stem word stil ‘n Bekende oud-inwoner van Louis Trichardt, oom Helgard Cronjé, is Sondagoggend in die ouderdom van 81 jaar oorlede. Oom Helgard was tot sowat nege jaar gelede woonagtig in Louis Trichardt, waar inwoners hom sal onthou vir sy betrokkenheid as kerkraadslid by die NG Kerk Louis Trichardt-gemeente. Vir bykans vyf dekades het hy op die plaas Buffelspoort langs die Sandrivier geboer, derhalwe was hy ‘n bekende ook in boerderykringe en die plaaslike sakegemeenskap. Die laaste paar jaar voor sy vertrek na sy dogter, Ronel, in Rustenburg (later na Kemptonpark), het hy hoofsaaklik met katoen geboer. “Ons sal hom onthou vir sy uitsonderlike liefde vir die natuur en veral voëlsoorte en die besker ming van aasvoëls en roofvoëls,” sê seun Pieter. Oom Helgard is oorlede ná drie onlangse operasies. Sy liggaam het gesukkel om te herstel. ‘n Roudiens vir wyle oom Helgard word om 10:30 op Donderdag, 19 April, in Pretoria gehou. Vir meer besonderhede hieroor, kan Pieter geskakel word by tel 082 551 1962. Wyle oom Helgard word oorleef deur sy susters tannie Martie Eloff, Kotie Malan en Alet Harrington, seun Pieter en dogter Ronel en kleinkinders André, Carel, Helgard, Roché en Esteé. Pieter en Ronel het alle mense wat naby hom geleef het en gereeld navraag oor hom gedoen het opreg bedank. “Ons waardeer al die belangstelling,” sê hulle.

Eight arrested in weekend clamp-down Eight suspects were arrested by the Makhado Police over the past weekend. In the first incident, two suspects between the ages of 31 and 44 were caught for the possession of dagga. Another three suspects, aged 24, 29 and 31 respectively, were
locked up in connection with two different charges of the possession of suspected stolen property. One 29-year-old suspect was arrested for drunk driving, while a 38-year-old suspect was arrested on a charge of fraud. One 32-year-old suspect was arrested in connection with domestic vio-
lence. All suspects were to appear in court by the time of going to press. Following the weekend’s arrests, police have warned future criminals that “no stone will be left unturned in pursuance of all criminal activities in town and other areas policed by the Makhado Police.”

Brilliant young mind scoops up awards Attiya Ismail Moosa from Louis Trichardt was one of several students to receive an LLB (law) degree during the autumn graduation ceremony of the University of Pretoria on 29 March. What set Attiya apart from the many other students was not only that she received her degree cum laude, but also that she walked away with several of the university’s top awards as best student. Attiya also received, among others, the Sasol prize for the LLB student with the best performance in law of damages or law of intellectual property. The prize goes to the students in both the English and Afrikaans class with the highest average. Attiya’s average was 85%. The university’s D&T Trust prize also went to Attiya. This prize is awarded to the best student in insolvency practice, with Attiya scoring an 84% average. Apart from these two prizes, Attiya also scooped up the Private Law prize, as well as a merit certificate in Law of Damages and Alternative Dispute Resolution. Since 2009 up until 2011 she was also on the dean’s merit list for overall academic percentage of higher than 75%. In 2010, she also received a Golden Key Certificate for being in the top 15% of the law faculty. As for her future plans, Attiya is to continue with her master’s degree in corporate law on a part-time basis and will start with her articles at a Johannesburg-based company next year.

Although the Makhado FM station manager, Mr Takalani Khomola, had promised the radio station’s employees that they would receive their salaries last month, the workers are still waiting to get paid. “It is not good that we are not being paid. We are not happy about it and are tired of empty promises,” said some of the presenters who commented, on condition of remaining anonymous. They added that Khomola had promised the presenters a salary of R6 000, while newsreaders would get R4 000. This apparently never happened. They further indicated how difficult it was for them to go on air on empty stomachs. “We thought things would be fine when Khomola first came to the station, but they are even worse than before,” said presenters. Takalani Khomola, however, still claims everything is fine, even though he failed to act on his promises. Presenters protested outside the station last Friday, accusing Khomola of favouritism. Some said that they were not happy with Khomola’s management style. “It was only after the CEO (Ramovha) intervened that the presenters returned to work. He promised that he would fork out money from his (own) pocket to pay the workers,” they said. When contacted for comment, the CEO, Mr Junior Ramovha, said that the board had not raised enough funds in time and that was why the presenters had not been paid yet. “However,
when money is available at the station, we will pay them,” he said. Ramovha added that the station was still committed to paying the presenters but could not promise when this would happen because currently there is no money. It is also alleged that one of the presenters, Mulalo “Cat” Masikhwa, had resigned due to the fact that she was not paid. When contacted for comment, Masikhwa confirmed her resignation but did not want to say why she had resigned. She only said that things were not well at the station.

On the opposite side of the sky, two constellations that are galaxy-packed, Leo and Virgo, have made their appearance, as have the galaxies within them, which are well placed for observation. Favourite targets for small telescopes are M95 in Leo, that was host to a recent nova a few weeks ago and the Sombrero Galaxy (M104) in Virgo. Tough weekend for team Elegant Fuel The second round of the Toyota Dealer 400 Copco 400 in KwaZulu-Natal on May 18 and 19. Championship in Mpumalanga turned out to (Information supplied by Motorite Raching Team be a tough test for the Elegant Fuel/Sullwald – Offroad). team over the past weekend. Elegant Fuel, a petroleum company based in Louis Trichardt, has been sponsoring father-andson team Kallie and Quintin Sullwald since 2010. This year, reigning special-vehicle champions Hermann and Wichard Sullwald also became part of the Elegant Fuel team for the 2012 season. They won the championship with their Porter last year. This season, Hermann and Wichard will once again go out in their Porter, while Kallie and Quintin will campaign in a BAT. Saturday’s race started in almost windless conditions on the Lydenburg track. Dry and dusty conditions made overtaking difficult, with the rocky terrain proving to be a major hazard to drivers. A couple of vicious mud holes also took a heavy toll. Among these casualties were Quintin and Kallie. In only the second round of the race they found themselves stranded in a mud hole. They had to call it quits for the day after calling in the support team to pull the BAT out. Herman and Wichard were able to finish the race, despite a bit of drama with race officials afterwards. They were hit with penalties for deviating from the route on the first of two 175 kilometre loops that made up the race. This saw the Sullwalds relegated to fifth place behind former SA champion Evan Hutchison and Danie Stassen in their BAT Venom. After the team protested, they went to the top of the leader board, ahead of the Alberts and Du Plessis teams. The final scoring saw Herman and Wichard finish almost two seconds ahead of the Alberts team and three seconds ahead of the Du Plessis team. The next round of the championship is the Atlas

Hierdie eer val die Triegie rugbyspelers te beurt, nadat twee van hul spanne, die O/16’s en O/15’s, na afloop van die finaal as algehele wenners aangewys is. Triegies se eerste rugbyspan en Hoërskool Louis Trichart tree vir die derde agtereenvolgende jaar as algehele wenners van die die O/14’s eindig beide tweede Super 16 rugby uit die stryd. Hier is die O/16-rugbyspan, met afrigters Theo Muller (links) en in die reeks. Die O/16-span, met afrigters Coenie de Lange. Following a weekend of cycling, the P&L Cycling Club expressed their gratitude towards Cycle Centre for sponsoring the event, as well as Johan van Dijkhorst and Mark Archer, who worked tirelessly to plan and prepare the route.

Two wins for Gordon during Cycle Centre Challenge Tzaneen cyclist Alan Gordon made a clean sweep the past weekend, winning both the Cycle Centre 70km road race on Saturday and the gruelling 30km mountain bike race on Sunday. For many, the Cycle Centre road and mountain bike races, held in conjunction with the P&L Cycling Club, served as prelude to the upcoming Kremetart weekend from 8 to 10 June. Gordon won the 70km Cycle Centre Challenge in a quick time of 02:04:28. He
was, however, given a run for his money by Louis Trichardt cyclists Bas Rennings and CP van Wyk in a sprint for the finish line. Rennings cycled home a second later in second place, with Van Wyk (02:04:31) in third place. Rennings was also the first sub-veteran male and Van Wyk the first junior. Van Wyk showed that he will be a force to be reckoned with in future, taking third place in his first ever road race. More familiar with mountain biking, Van
Wyk only got his road bike the day before. Other category winners in the men’s 70km race were Richard Lambrecht (first veteran), Cassie Mattheus (first master) and Malcolm Tucker (first grandmaster). The 70km women’s race was dominated by the local riders. Renata Joubert was not only the overall winner of the women’s category, but also the first veteran in a time of 02:15:51. (Contd on P17)
