Makhado Municipality must pay woman R300 000 plus other costs after breaking leg in pothole

Council must pay up By Anton van Zyl

The High Court in Pretoria made a settlement agreement an Order of the Court on Tuesday, in terms whereof the Makhado Municipality has to pay a claimant R300 000 plus taxed costs plus the costs of two orthopaedic surgeons, who were called to testify at the insistence of the municipality. The municipality also has to pay its own legal team, all of which could add up to more than R500 000. The claim stems from injuries that Ms Tefu, a former candidate attorney with the State Attorney’s office, sustained whilst jogging with a friend in Cronjé Street in Makhado (Louis Trichardt) in March 2009. Whilst jogging, she and her friend decided to sprint. It was almost dark and the street lights weren’t working. As they started to sprint, a dog barked and Ms Tefu took evasive action to the middle of the road. She stepped into a pothole that she couldn’t see and fell down, breaking her leg just below the knee. She was treated by an orthopaedic surgeon of Polokwane and spent six weeks with her leg in plaster, plus a further two weeks in a brace. The local municipality denied all liability, arguing that the incident had never taken place, that there had been no pothole and that Ms Tefu had not broken her leg. They went so far as to state that they did not even have the duty to maintain the streets. According to Ms Tefu’s attorney, Dr Suwil Rudolph from Van Heerden & Rudolph attorneys, the municipality was invited on several occasions to discuss and settle the claim. The municipality, through its lawyers, refused point blank. Ms Tefu was sent to Dr Prins (another orthopaedic surgeon) for a medical legal report. The medical reports were

disclosed to the municipality, as well as summaries of the expert evidence to be led. The municipality failed to respond to any of the reports or to insist on the examination of Ms Tefu by their own medical experts. This being the case, Dr Rudolph addressed two letters to the municipal ity’s legal representatives, inviting them to admit the medical reports in order not to call the experts to court and, in so doing, to save thousands of rands in costs. Despite the invitation and not producing its own medical report(s) to contradict that of the plaintiff, the municipality insisted that the experts be called. Dr Rudolph reluctantly had to subpoena both doctors to court, at high cost. On the day of hearing, counsel for the plaintiff Adv J K Wessels indicated that he was ready to proceed with trial as all his witnesses were pres ent. Counsel for the municipality also indicated his readiness and the case was allocated to Judge Cyn thia Pretorius for hearing. Just after the counsellors had introduced themselves to the judge, counsel for the municipality indicated that he wanted to discuss a settlement. This came as a surprise at that late stage, in view of the municipality’s refusal to settle earlier in the process and its insistence that the plaintiff’s experts be present in court. “In so doing, the municipality did nothing other than to waste thousands of rands of the taxpayers’ money. Had the matter been settled earlier, most of the legal and medical costs could have been saved,” said Dr Rudolph. The municipality now has until 21 September to pay the capital amount and has to pay the legal costs after taxation. In the meantime, Cronjé Street is still riddled with potholes, not to mention other parts of town. Each pothole holds the risk of further claims against the municipality.

This more than one-and-a-half-metre-deep hole was dug by the municipality less than 100 metres away from Louis Trichardt High School in Stubbs Street. For weeks now, it’s been left unattended, with no warning signs anywhere. The newspaper knows of at least one pupil from the school who fell in the hole on his way back from an evening function at the school. Here, a couple of Grade 9 pupils demonstrate how deep the hole is, having to work hard to rescue their friend, Nadine van Wyk. Assisting her are Robert van Zyl (left) and CJ Slade and Keren du Preez (right).

CoAL pushes ahead with Soutpansberg Project after “no formal objections”

The driver of this sedan was lucky to escape alive after he collided head-on with a bus last Wednesday. The accident happened in the four-way intersection of Joubert and Kruger Street. According to information available, the accident was caused by both drivers, who had apparently failed to come to a complete stop at the four-way stop street. This accident was one of several in and around Makhado (Louis Trichardt) the past week.

Thus far, no formal objections towards Coal of Africa Limited’s (CoAL) Greater Soutpansberg Project have been registered. This according to the amended environmental management plan (EMP) documents that CoAL submitted to the Department of Mineral Resources (DMR) on 14 August. These documents were compiled after the public and other affected parties had from 25 June until 24 July to comment on the drafts. As part of their Soutpansberg Project, CoAL will start with a series of exploration drillings on 41 farms in the Limpopo Valley. Before CoAL can start drilling, however, they need a prospecting right from the DMR; hence the submission of the environmental plans. The exploration drilling, according to CoAL’s independent consultants, Naledi Development, is necessary “to understand the location, extent and quality of the scare coking coal resource.” CoAL expects to be finished with their exploration drill ing by the middle of next year. Only then will they be able to give an indication of whether the areas earmarked for mining in the project are feasible from an economic, social and environmental point of view. If they do find them to be feasible, CoAL will move towards the next step and apply for a new order mining right from the DMR. At the same time, a detailed environmental impact assessment will be done. The EMP documents have raised quite a number of eyebrows, particularly where they mention the availability of water in the region. Water sources which will be affected by the Soutpansberg Project will include the dry Sand and Mutamba River. According to the EMPs, the Limpopo province has limited surface and ground water resources. Large parts of the Soutpansberg project falls within areas that have been classified vulnerable to less vulnerable in terms of groundwater by the Water Research Commission of South Africa. In the meantime, what is not clear is how long the DMR will take to make a decision, based on

the amended EMPs. Interested parties can download all six docu ments from Naledi’s website at www.naledidev. co.za, under the Projects tab. Printed copies are also available from the public library, situated on the corner of Erasmus and Kruger Street in Makhado (Louis Trichardt).

New guest cottage at Bluegumspoort A new guest cottage opened its doors for business last week and tourists may find it to be a place that offers way more than just a comfortable bed. Lollipop Lane Guest Cot tage is situated not far from Makhado (Louis Trichardt) on the Bluegumspoort road, a couple of hundred metres from the N1 turnoff. Owners Bruce and Charmaine Murray converted a picturesque Hart beeshuisie into a selfcatering

guest cottage. “The house previously be longed to a wellknown cou ple, the late Ed and Cathelijne Eastwood,” says Bruce. Ed was known for his tremendous contribution in the field of palaeontology and, together with his wife, published sev eral articles and a book on South African rock art. “When Ed decided to rebuild the old house that used to be on the property, he based it on the exact dimensions of the

original settlers’ homes, more commonly known as Hartbees huisies,” says Bruce. Ed died in 2008 and Cathelijne in January this year. Bruce and Charmaine de cided to retain the historic char acter of the house. The decor includes artifacts and historic maps of the region. The cottage has three bed rooms, a bathroom, an open plan kitchen and a very cosy lounge. It is surrounded by indigenous trees against the backdrop of the Soutpansberg Mountain. “The location is also per fect for those people who are interested in exploring the Soutpansberg’s natural treasures,” says Bruce. These include birding and mountain bike routes. Bruce is also a very experienced offroad motorbike enthusiast and can introduce guests to a variety of 4x4 routes. Although the guest cottage caters mostly for tourists who want a selfcatering facility, meals can be arranged. Well-known police officer found dead at her home Makhado police are at present investigating the circumstances surrounding the death of one of their highly decorated police officers. The body of the 52-year-old Capt Erika Bezuidenhout was found at her flat in Makhado (Louis Trichardt) early on Tues day morning, about a week after she had gone on sick leave and five days after her birthday on 16 August. At the time of her death, she was living alone. As she was very well-known in the Soutpansberg area, her death came as a shock to many. Ru mours soon surfaced that she had committed suicide. The local po lice, however, were quick to say The late Capt Erika that residents should not jump Bezuidenhout (52). to any conclusions. “We do not

want to pre-empt our investiga tion by saying that it was suicide. We can, however, say that we do not suspect any foul play at this stage,” said police spokesperson Capt Maano Sadiki. Capt Bezuidenhout’s career in the police service stretched over a period of 33 years, with most of this time served within the Soutpansberg area. She held several senior positions, includ ing that of head of the local Child Protection Unit and as former district commander in Tzaneen. She also served in Polokwane and the Lephalale area. She was a decorated police officer, hav ing received the police’s medal

for 10 years’ faithful service, the 75-years commemorative police medal, the 10-year commemora tive medal (1995 to 2005) and both her 20- and 30-years loyal service medals. “She was a commissioned of ficer who did her job diligently. She was always a down-to-earth kind of person. It is always regret table to lose a member, especially someone who led from the front,” said Sadiki. At the time of our going to press, funeral arrangements for Capt Bezuidenhout had yet to be finalized. She is survived by two daughters, Marlene and Mario-Lese.

popostreek, mnr.

Sarah Venter of Makhado (Louis Trichardt) graduated with a PhD in Botany from the University of the Witwatersrand on 27 June. She did an interdisciplinary PhD that explored the interaction of the ecological and socio-economic implications of baobab fruit harvesting in northern Venda. Population dynamics, fruit production, phenology and recruitment were investigated, with the resultant data being incorporated into a matrix model. Commercialization of baobab fruit plays a critically important role in supporting the livelihoods of marginalized people. However, unabated environmental degradation and climate change threaten populations. During the course of the PhD, Sarah published three articles in international scientific journals and delivered one symposium paper. Another three manuscripts are awaiting publication. She also received an award for outstanding performance in the 2012 academic year. Photo supplied.

Commander´s outrage “out of context”

On 13 August, this drill was seen in the open space on the corner of Ruh and President Street. By Linda van der Westhuizen

Six new boreholes to alleviate crisis Six new boreholes have been drilled by the Makhado Municipality in an effort to alleviate Makhado’s (Louis Trichardt) on-going water crisis. The Vhembe District Munici pality (VDM), the water author ity for the area, described the new boreholes as “an interven tion to improve water services in Makhado Town.” The water service provider, namely the Makhado Munici pality, said that it was too early to say how the new boreholes would improve the water situ ation. “This can only be con firmed after the tests. We are hopeful that the boreholes will relieve the pressure for water in town,” said Makhado com munication officer Mr Peter Muthambi. The borehole inside the mu nicipal lapa’s premises, across

from Bridge Motors, has a blow yield of 30 litres per sec ond. The blow yield gives an indication of the rate at which groundwater can be extracted from a borehole. At the municipal caravan park, another new borehole has a blow yield of 20 litres per second. The one at the cor ner of Krogh and Jeppe Street has a blow yield of 13 litres per second and the borehole in Pretorius Street has one of 0.831 litres per second. “At the borehole on the cor ner of Ruh and President Street, blow yield tests could not be conducted because there is a lot of water. At the borehole on the corner of De la Rey and President Steyn Street, visual inspection shows that there is a lot of water. However, odexing (a borehole casing system) still needs to be done because the

soil there is too loose,” said Muthambi. Three contractors were appointed to provide the services and each drilled two boreholes. Muthambi said that a service provider would be appointed before the end of the week to conduct yield tests and water quality tests that will determine whether the water is fit for hu man consumption. “None of the boreholes is near a sewage spillage,” Muthambi said. He added that the water from the boreholes would initially be pumped directly into the water supply system. DA councillor Brian du Plooy confirmed this, saying that, at the moment, most of the water in the different areas was being pumped directly into the reticulation system because the reservoirs did not fill up fast enough.

The Makhado SAPS said this week that the reference to its ‘outraged commander’ in an article in last week’s Zoutpansberger was drawn out of context. The article highlighted the conduct of the local police com mander, Col Francois Ramovha, towards two members of the public, following an accident in Krogh Street. “Your indication around the socalled ‘outraged Command er’ was drawn out of context, because whilst the two parties called at the Station Command er’s Office, the attitude as por trayed in your newspaper lacks substance,” was the response from local police spokesperson Capt Maano Sadike in ‘n media statement. The statement refers to the incident where two motorists collided in Krogh Street, an ac cident apparently caused by an illegally parked police vehicle. When those involved met with Col Ramovha, they were al legedly treated by him in an aggressive way. Sadike said that any person who was not satisfied with the service or conduct of any SAPS member, even the commander, was at liberty to raise the con cern. “In this case, the com plainant chose to come through

the media, which is his right as well. Had he had the guts to raise this matter accordingly, he would have been clarified,” Sadike said. According to Sadike, the two motorists involved gave differ ent contexts, but this would not detract the police from doing their normal duties. “The indication given to you by driver A and driver B dif fers, because as the two parties were in the station commander’s office, discussing the matter, driver A, the complainant in this case, suddenly stood up, blaming the police and left im mediately,” reads the statement. Regarding the accident, Sa dike states that “the accident or collision was not caused by the police or the commander. This office cannot preempt the cause as the matter could be prejudiced and in this regard, investigations are underway.” Following the accident on 31 July, one of the motor ists took a picture of a police vehicle parked on a loading zone, allegedly obscuring the view of the motorist turning into Krogh Street, and sent it to the Zoutpansberger. Regard ing the photo caption, Sadike says that it was “incorrect and misleading the public to say parked ‘illegally on a loading

zone’ because the police was offloading a fridge as part of an exhibit, meant to be registered in the Community Service Centre.” Sadike says that the vehicle was parked just for a while “and you never bothered to enquire from the relevant authority after tak ing the picture.” The SAPS Makhado share parking with other departments and businesses. “The inconvenience cannot be blamed entirely on the police or commander because it is normal that they will park vehicles next to the police station,” reads the statement. Sadike says that members of the public who call at the police station need to acknowledge that the police will always share the parking space surrounding the police station. Sadike makes it clear that the SAPS can never condone illegal parking or reckless driving by members of the SAPS, irrespec tive of the rank they hold. “Police are not above the law and are custodians in respect thereof. Each time the issue of misbehaviour in terms of parking or driving was raised, members were sensitized by the Station Commander and management in a very vocal way that whoever does that puts his behaviour or discipline at risk,” reads the statement.

Poor visibility and wet roads contributed to several vehicle accidents in and around Makhado (Louis Trichardt) last Friday. An increase in vehicle accidents in poor weather conditions is not uncommon to the Soutpansberg area. This accident occurred Friday morning near the N1/Elim turn-off when the driver of this vehicle collided with a light delivery truck. As far as could be determined, there were no serious injuries.

Red means stop, green means go and orange means go like hell! The problematic Songozwi and Grobler Street junction in Makhado (Louis Trichardt) was once again the scene of an accident, due to a motorist’s failure to adhere to the traffic lights. Even though another vehicle was already in the crossing and in the process of turning, the driver of this vehicle chose to speed through the crossing when the light turned orange. Fortunately, no one was seriously injured in the accident, although both vehicles sustained extensive damage. The accident occurred last Thursday afternoon.

Is dorp se munisipale tariewe wettig?

Enige

The Zoutpansberger’s website (www.zoutpansberger.co.za) offers readers a calendar entry service on their Events Page. Visitors to the website can now list their calendar entries for upcoming events on the Events Page themselves. It is as easy as merely logging in on the Events Page through your existing Google, Facebook or Twitter accounts and uploading your entry. The entry will, however, not appear immediately as it has to go through a moderation process first. In addition, sport club administrators (and

for that matter church and school administrators) can contact us to directly submit events on the Events Page without a moderations process. If an administrator is listed as a user on the site, their calendar entries will show immediately. This function allows administrators to update events through the year on a platform used by ten others publications throughout the province as part of both a local and provincial calendar. For more information, phone Andries van Zyl at Tel 015 516 4996/7.

In the front, from left to right, are Ms Grace Neluvhola, principal of Tshiawelo Secondary School, and Ms Hilda Ramusetha, organiser of the blood drive at the school, Ms Stienie Fourie of Louis Trichardt Primary School and Mr Brian Kalshoven of Musina. Local blood donors rewarded Local blood donors do their part, said the South African National Blood Service (SANBS), although a shortage in the O-group still exists. “Blood is like a parachute. If you don’t have it when you need it, you most probably won’t need it again,” said sister Marilda van Wyk of the SANBS’s Pretoria office during an SANBS donor-awards ceremony held on August 18 at Avocavale Country Inn outside Makhado (Louis Trichardt). The SANBS collects 780 000 units of blood annually, with 2700 units of blood collected daily, and 768 250 units blood and blood components are issued annually. Despite the fact that enough units are collected overall, the demand for O-blood outstrips the collection. A total of 47% of the population is in the O-blood group, but the demand is 55%. The SANBS thanked all the donors of the area for their act of generosity to ensure that there is a blood supply for those in need of blood or blood products. During the awards ceremony, local donors received

awards for reaching blood-donor milestones. Mr Abraham Swanepoel and Mr Andries Viljoen, both of Musina, received special medals for having donated 175 and 125 units respectively. Messrs Dirk Coetzee and Willie van Staden of Makhado (Louis Trichardt) and Mr Albertus Swiegers of Musina each received a medal and a Parker pen for having reached 100 units. Several others received awards for 75, 50 and 20 units (for those under 26 years). Together with Gauteng, Limpopo forms Zone 1 of seven zones. In Gauteng, there are nearly 71 donors per square kilometre who are eligible to donate blood, whereas Limpopo has only two donors per km2 with the potential to donate blood. In the year 2011/12, Zone 1 donated 27 242. Locally, 4 841 units were collected, with 2 945 donated by men and 1 896 by women. “Makhado (Louis Trichardt) and Musina do make a huge difference,” said Ms Dotty Pinn, the SANBS public relations practitioner in Polokwane.

Mr Andries Viljoen (right) of Musina received the Anton Heyns medal for donating 125 units of blood. The medal was awarded by Sr Riana Viviers of the SANBS in Makhado (Louis Trichardt) at a donor awards function hosted on 18 August at the Avocavale Country Inn.

Police and Spar personnel deserve a special mention for their efforts

W

e would like to thank the Makhado SAPS, and more specifically Constable Madima and his colleague, for the excellent service we received from them. We would also like to thank Victor from Spar for his assistance. On 9 August, thieves made a copy of my husband’s cheque account card details and used it to buy groceries at the store in Makhado (Louis Trichardt). As soon as we received notification that the card had been used to buy groceries, we

immediately went to Spar and the manager, Victor, immediately notified the police. They arrived within ten minutes of his call. Victor, in the meantime, looked at the security camera footage and was able to identify the thief. Shortly afterwards, police made an arrest. With a police force like this the town can only win.

Thanks for the help with the fire

I

wish to thank all the men who came to help fight the fire on Riverlands on Thursday, 9 August, in the afternoon, through to 19:30. They gave me a feeling of confidence and also great pride in my neighbours, friends, and unknown helpers. Seeing everyone put their all into the fight made me think of

the Springboks pulling together in a rugby match. They came out tops as usual. Dankie manne! Julle was uitstekend en ek waardeur julle vriendskap en hulp. - Dennis Ball (Makhado, Louis Trichardt)

Die Weg, die Waarheid en die Lewe

I

Lees Jesaja 40:31. - 079 5168303
