So vertel mev.
“Martin het my by my werk geskakel en vir my gesê ek moet dadelik gereed maak, hy kom my nou haal,” het oom Ockert se skoondogter, Barbara, gesê.

In my opinie is niemand ‘n slegte mens nie.

More charges against “partying” ANC councillor after crash By Andries van Zyl The Makhado Municipality’s “partying” ANC councillor, Cllr Tebogo Mamorobela, was in the news again this week for all the wrong reasons. Once again, the main contributor to this prominent 39-year-old ANC member’s proverbial downfall appears to be alcohol. Residents of Louis Trichardt woke up to the news on Sunday that Mamorobela had been involved in a vehicle accident on the corner of Jeppe and Anderson Street. The accident occurred between 04:00 and 05:00. Apparently, Mamorobela had first crashed into another vehicle before smashing her luxury Ford Ranger bakkie through a resident’s prefab fence. Mamorobela apparently tried her utmost to avoid being charged and arrested. Her alleged attempt to avoid prosecution was, however, to no avail. She was arrested by members of the Makhado SAPS and charged with, among other things, driving under the influence of alcohol. In April this year, Mamorobela and two of her friends, Harold Muswobi (50) and Khathutshelo Matshusa (33), were arrested after a video of her partying with friends on her 39th birthday started circulating on social media. In the video, Mamorobela could be seen dancing with a bottle of liquor while mocking police minister Bheki Cele. Several other persons could also be seen in the video, socialising around a table filled with bottles of alcohol. This was amidst the Level 5 lockdown period, which prohibited all alcohol sales and gatherings such as birthday parties.
Following the damning video, Mamorobela and her two friends were arrested on charges of contravening the lockdown regulations. After their court appearance, they were released on R1 000 bail each. A resolution by the ANC of the Vhembe region was subsequently taken that Mamorobela should recuse herself from all activities of the municipality with immediate effect, until the matter was finalised by the court. She is still to appear in front of the municipality’s ethics committee. Apart from being an Makhado Exco member as Head of Corporate Services, Mamorobela has also performed duties as acting mayor of the Makhado Municipality in the past. Her political career started at the South African Youth Council (SAYC) and the South African Students Congress (SASCO). She served in the ANCYL Provincial Executive Committee of Limpopo as an executive member from 2012 to 2014. She has served as the deputy chairperson of the ANC Makhado sub-region since 2018 and is the convener of the ANCWL Young Woman Desk of Limpopo. The ANC clearly has big expectations of this young partying member whom they have obviously been grooming for bigger things. Her brushes with the law may prove to be problematic for the ruling party. Mamorobela, however, has been quite successful in clearing the first hurdle and last month the charge of contravening the lockdown regulations against her was provisionally withdrawn in the magistrate’s court. The prosecuting authority explained that this was done to “allow the investigating officers to finish
their investigation”. Should the case Mamorobela to the offense she has been pality and will request that Councillor proceed, her defence will reportedly be charged with. Court orders Makhado Municipality to provide documents on dodgy public park tender deal “The determination of whether there is or is not anything to report on is not something for the Respondent to decide. The Applicants will decide whether or not to publish a story and the public will decide whether or not they believe the story published.” Staff Reporter In what is widely considered a victory for transparency and accountability, a local magistrate has ruled that the Makhado Municipality must make documentation relating to tenders awarded for the sale of a public park available to the Zoutnet group of newspapers. The controversial sale of the park happened last year. The park was divided in two sites, which were offered for sale by public tender. The tenders were, however, not awarded to the highest bidders. One section of the property was, in fact, sold to the lowest bidder. The other section was sold to a bidder who offered R450 000 less than the highest bidder. In total, the municipality could have been paid R850 000 more for the two erven. At the time, the municipality refused to make specific information available about the transaction. Requesting information to find out who the successful bidders were, took weeks, and even then, the correct names of the companies were not supplied. The municipality also refused to give any reasons as to why the highest bids had not been accepted.
When the municipality was requested to provide its PAIA Manual, the spokesperson was unaware that such a document existed. After the newspaper pointed out that, by law, every municipality must have such a document and that it must be available on its website, a document was then forwarded. A PAIA application to request the information about the sale of the two sites was submitted on 14 October 2019. According to the Act, the municipality had 30 days in which to produce the documents or else to give reasons why the request was being refused. The municipality completely ignored this request. The next step, as prescribed by the Act, was to file an internal appeal to the Speaker of the municipality. This was done on 10 December, but the appeal was also ignored. Prior to October last year, the next step for anyone seeking information and being refused by an institution such as a municipality, would have been to approach the High Court. The regulations were changed, however, making it possible to bring such an application in a magistrate’s court. The advantage is that this is a quicker and cheaper way to try and ensure that legislation is adhered to. On 11 March this year, papers were served on the municipality, indicating that the magistrate’s court would be requested to order the municipality to make the documentation available. Even this process was initially ignored and the case was heading to court on 12 April for a default judgment. This date, however, happened to fall in the lockdown period and had to be postponed.
You are irritating and you waste our time
When notice was given to the municipality of a new date for a hearing, this step sparked some reaction. On 19 May, the municipality gave notice that it would defend the matter, which was set down for a hearing on 15 July. PAIA to the rescue On 2 July, the municipal manager of Makhado, Mr Freddy Tshivhengwa, filed an affidavit The newspaper was eventually forced to turn responding to the application. In his affidavit, to the Promotion of Access to Information Act Tshivhengwa tries to jusitfy the municipali(PAIA) to try and obtain information. Not so fast, says magistrate In what is possibly the first ruling by a magistrate in a PAIA case in South Africa, Magistrate Vanessa Grundlingh clearly spent a lot of time evaluating the arguments. She first addresses the two technical points raised by the municipality. The first one concerned the right of Zoutnet CC, publishers of Limpopo Mirror and Zoutpansberger, to be an applicant in the case. The PAIA application was brought in the name of Anton van Zyl, owner of the newspapers. Magistrate Grundlingh ruled that no ambiguity ever existed and the council knew exactly who had made the request. “When the prescribed forms were used, they did not detract from or alter that which had gone before. The forms should not be regarded in a vacuum,” she said. The magistrate also quotes sections of the Act where the municipality’s responsibilities are spelt out. “The Respondent has a duty to assist requesters if they did not submit the request in the manner required by Section 18(1) of PAIA,” she says. The municipality’s second concern was the fact that the successful bidders were not made party to the case. Grundlingh refers to various previous judgments that determined when an outside party should be joined in a case. “There are no facts supporting the contention that it was necessary to join the two entities as parties to these proceedings,” she says. The municipality’s argument that the newspaper was simply fishing for a newsworthy story, at the expense of hardworking officials, also was not accepted by the court. “The Respondent points to the Applicants simply looking for a news story, but that there is nothing there to report on. The determination of whether there is or is not anything to report on is not something for the Respondent to decide. The Applicants will decide whether or not to publish a story and the public will decide whether or not they believe the story published. If any member of the public then decides to lay a complaint, based on what they have learnt, they will be armed with the information gained. This is the purpose of the news media,” Grundlingh said, quoting a previous judgment by another court. The magistrate ruled that the applicants, “having complied with the procedural requirements for a request for access to a record held by a public body and having exhausted the internal appeal remedies available to it, is entitled to access to such record”. A cost order was also granted against the municipality.
symbolic because it has been achieved 11 days before the world commemorates the annual UNESCO International Day for Universal Access to Information. Civil society and the media around the globe recognise the importance of transparency and a culture of openness and accountability for participatory democracy.” In its statement, SANEF also mentions the Access to Information Network 2019 report that indicates that 66% of all requests made to municipalities or local government were ignored entirely. “Year after year, the Access to Information Network’s Shadow Report on the state of access to information in South Africa has demonstrated low levels of compliance with PAIA by government, state-owned entities (SOEs) and private companies. The case shows that compliance levels with PAIA remain dismal, and deliberately so, despite PAIA having been in operation for 19 years this year,” the statement said. Previous research also points to the difficulties that communities and community media have to use PAIA to get public and private institutions to release information. Compliance is generally very low. “SANEF believes that the right of access to information is fundamental to the proper functioning of democratic institutions which may be compromised when members of the public and media are unable to access it. Access to information enables more effective monitoring of state organs and private institutions, and the holding of those in power to account,” said SANEF.
But it’s not yet the end On Friday, the Makhado Municipality filed a notice of intent to appeal. According to the filing notice the municipality is of the opinion that the magistrate had erred in her findings and should not have granted the application. The case will now have to make its way to the Limpopo High Court Makhado Municipality’s spokesperson, Louis Bobodi, told SABC news that they felt that they had a strong case. He said, according to their interpretation, the Act gave them the right not to disclose confidential information about clients to the public. “We did refuse to divulge confidential and commercial information of third parties for public consumption, because we could be sue-able for that,” he told the SABC. Zoutnet, publisher of the two newspapers, indicated that it would contest the appeal. “We will fight for the right to gain access to information,” said Anton van Zyl, owner/manager of the publications. He said that the only sad part was that a small community newspaper with extremely limited resources must take on municipalities to enforce a Constitutional right. “We believe the municipality has no chance of success in any court. They have blatantly disregarded the law and now, when taken to task, suddenly want to try and escape the consequences. They are trying to buy time, and all this at the expense of taxpayers whose money they are using to try and cover up irregularities,” said Van Zyl.

incomplete, as it should not have only included the name of the applicant, but also that of the company which owns the paper. He also argues that the successful bidders should also have been included in the application, because they could be affected by the outcome. Tshivhengwa seemingly believes that not everyone has the right to information and that such a right must first be established. He also feels that such PAIA requests place an unnecessary burden on officials working at the municipality “I submit that this application is an unreasonable diversion of the resources of the municipality in that the officials of the municipality should leave their important posts and attend to vexatious queries of the applicants,” Tshivhengwa argues.
The ruling of Magistrate Grundlingh was widely applauded, with many describing it as a significant victory for constitutional rights. The SA National Editors Forum (SANEF) issued a statement in which it welcomes the ruling. “SANEF notes that this victory is particularly

Two escape injury after tree crushes vehicle
“It was frightening because I did not see it coming” there were branches all over us,” said Allen. Because of the damage, Allen had to kick open his door. After getting out, he also pulled his friend from the vehicle through the driver’s side. Once out of the vehicle, they realised how lucky they were. Allen is convinced that if his friend had climbed out just a few seconds earlier, the friend would definitely have been killed by the falling tree. The freak accident scared Allen, who described the incident as extremely frightening. “I was not even worried about the car. I was just worried about us being all right … I have been in accidents before. It was frightening because I did not see it coming. Normally, you can see an accident coming … that tree could have snapped our necks!” said Allen. Allen is grateful that they are alive and miraculously walked away without injury. His guardian angel was probably working overtime. “You know what, at work I have been involved in three vehicle accidents. Privately, I have been involved in two accidents. But in all the accidents, I was not driving. I was a passenger. This is the first time I was driving. So, this is now my sixth accident … But this is the first time that something like this has happened – something unexpected,” said Allen. Fortunately, Allen has insurance on his vehicle. “You know, I nearly cancelled my insurance about two months ago, because I have been driving the vehicle for 10 years and have never had an accident. I never expected something like this to happen. You always think that, if you are a good driver, you will not get into an accident. Then something freaky like this happens! Luckily, I did not cancel my insurance,” said Allen. Despite having insurance, Allen is sad about his vehicle. “It is a 2011 model, but it is well looked after. I look after my vehicles … unless a tree falls on it,” said Allen.
By Andries van Zyl Judging by the number of unusual events occurring in Louis Trichardt over the past few weeks, one might mistake the events as coming out of an episode of the popular Netflix series Stranger Things. In July this year, the Zoutpansberger reported on how Ms Linda Oosthuizen’s car was written off after a tree had fallen on it while parked in front of Our Home Old Age Home. At the time, Linda was standing just a couple of metres away of her vehicle when the tree crashed down on it and was lucky to escape unscathed. Then, in August, the newspaper reported on a stray bullet that struck the generator room at the Zoutpansberg Private Hospital. Once again, nobody was injured. Now, for the second time in a few months, another vehicle was crushed by a tree. The latest freak accident occurred amidst the violent windstorm on Monday evening around 19:00. The 42-year-old Mr Allen Kennedy of Louis Trichardt was driving in a southerly direction in Munnik Street and stopped in the street between Jeppe and Vorster Street to drop off a friend. “Even before my friend could exit, we just heard this loud noise!” said Allen. The noise they heard was made by a massive tree that had fallen over, crashing onto Allen’s vehicle sideways, crushing the vehicle from the passenger side’s windshield pillar to the rear pillar on the driver’s side. The tree was so big, it completely covered the entire road, with its branches touching the high-voltage power lines across the street “We did not know what it was that hit us. I had looked in my rear-view mirror before we stopped and there was no car coming. I am always careful. Whenever I stop, I always check my rear-view mirror. After the shock, I realised

South Africa does need development, but not “another white elephant” The following letter was sent in by Ms Peta Jones in response to the Zoutpansberger’s front-page article of 18 September (Yea or Nay for SEZ?):
T
he meeting at Mulambwane attended by Mr Wally Schultz was also attended by me, and his account is mostly accurate. What he does not say, and what the participants in the meeting mostly failed to hear – because they did not want to – were a couple of significant points. I make some here but enlarge on them from my own reading of the massive ‘Draft Environmental Report’, made available by Limpopo Economic Development Agency (LEDET) only days before. This report was much more thorough and competent than the one produced in August last year, about which I complained, but still suffers from relying on information which it admits to be out of date. Significantly, the information about weather and water availability, among other things, predates a lot of what we now know to be effects of climate change when wind belts started shifting in response to the melting of the Antarctic icecap. Residents of the Limpopo Valley, especially in the Bokmakierie area, can testify that there is no longer ANY surface water available, and ground water has nearly disappeared. There is no reason to suppose that the situation is any different on the other side of the Limpopo, from which MMSEZ is proposing to get water. So, resource availability is under
question. Also under question is the atmospheric impact of the proposed thermal power plant and eight or so processing plants for the refinement of different minerals useful to South African industry. According to the maps in the report, the whole of Mopane village, its station, shops and boarding school will be subjected to very high levels of various poisons in the atmosphere, implying serious risks to child and adult health. LEDET maintains that it will require certain conditions to be met before approval is given, but it has not said what these conditions are. At the very least, for both residences and industry they would have to be (1) close to zero water use and full recycling, and (2) zero atmospheric emission and full recycling of wastes.
It is possible, or will soon be possible, and adherence to such conditions could ensure that, instead of becoming a huge blot on the landscape, endangering even those travelling south on the N1, it could attract tourists and others keen to see how South Africa is dealing with its challenges. The Chinese are well ahead with such technologies, but if South Africa wants to provide jobs for its youth, it too must get involved with such technical developments. It was clear at the Mulambwane meeting that the young people of South Africa have not fully taken on board the current realities of job creation: they must create their own and be equipped to do so. The heavy Chinese investment in the project could have such a result, but the history of Chinese investment rather suggests that (a) they will employ their own people during the ‘construction phase’, estimated in this case to occupy 9 years, and (b) if they cannot meet the set conditions, or if the climate change has even further limited their access to resources, at some stage they will simply pull out, abandoning everything half done and unreconstructed, provide yet another example of South Africa’s unique animal: the white elephant. Many born during the apartheid era are still to be seen around. (Mulambwane itself is another, slightly postdating apartheid.) The shouting youths were pacified by the announcement that the project would begin by December this year, but few people seemed to stop and think just what would be beginning so soon. South Africa certainly does need to be processing its own minerals, certainly does need to provide employment opportunities in Limpopo, and the situation of Bokmakierie in some ways (mainly communications) make it the ideal choice. Not for another white elephant, however. I hope that you are also able to arrange for discussion of this in the Limpopo Mirror. Let there be no more cries of “We don’t care about health and the environment, just give us jobs!” and instead “Teach us what jobs we can do to improve our environments and mitigate climate change”.

A scene very typical of the early Zoutpansberg: White ivory being carried by “black ivory”. to severe abuse. Duvenhage was willing to trade the children for six head of cattle. “When the man spoke to me about the journey, I became extremely angry and told him that his trading practice was one of the reasons why the Lord held back his blessing on the land; it was enough to bring a curse on the Republic,” wrote Murray. During October 1867, three months after the Vhavenda had torched Schoemansdal, Stephanus Schoeman and his 43 volunteers from the Pretoria Rifle Corps, plus 241 black allies under chief August Zebediela, attacked the female chief Modjadji to extract tribute from her by force. The Volunteer Commando killed 16 adults and they captured 74 children. They later returned 19 children, aged three years and younger, to their mothers. All in all, 55 children were distributed among the volunteers from Pretoria. The offences were brought to the attention of the ZAR in many cases and President court cases and hearings followed. In one such case, the ZAR High Court charged FH Geyser, SM Venter and Joao Albasini with “illegal actions and child stealing”. They were later discharged on a technicality. Albasini may have continued with this trade for quite some time. On 17 July 1870, Dr BG Arnoldi, a medical doctor from Pretoria, complained in a letter to Joao Albasini that two of his apprenticed girls, Kaatje and Dammio, had found their way back to Zoutpansberg. Dr Arnoldi demanded four heifers as compensation for the loss of the two little girls. Perhaps the true extent of what had happened is best described by one of the victims, a girl simply known as Adela, who had been captured
in the Zoutpansberg in 1865. In an affidavit she described her ordeal: “The country in which we lived before our people were scattered by the Dutch is near Zoutpansberg. I remember when I was taken, although very young at the time. There were others taken besides myself, some older, some younger. The Dutch surrounded our kraal while it was yet day, and set fire to the huts. The noise of the fire awoke us, and we ran out just as we were. The grown-up people who attempted to run out of the kraal were shot down, and the rest huddled together, surrounded by the Dutch on horseback. The children were then put together in one place, while the rest were made to go into the cattle kraal, which was built of stone, and were there shot at, till they fell down dead and dying. The Dutch then took us to their wagons, M.W. Pretorius. and we were divided amongst them. I fell to the lot of Mr van Zweel. My master often lived in town, and while there I used to see children brought down from Zoutpansberg and sold for money or cattle. They did not use to hawk children about in the same way when I was taken: this practice has taken place since, but one would sell to another, as occasion required. When I was about fourteen years of age my master sold me to a Natal … wagon-driver for thirty pounds. I came down here with him, and have lived with him ever since. He was at that time, and still is, wagon-driver to Messrs Barrett of this city.” And so, after a very long detour, the story returns to the protagonist, President MW Pretorius, who clearly lived in a time of turmoil and change. It was a time of exploration and a time where value systems changed. He was born in a period where slave trading was part of the economy, but he died when the last traces of it started disappearing from the continent. He compiled the ZAR’s constitution, which, among others, states in Art 10: “Het volk wil geen slavenhandel, noch slavernij in deze Republiek dulden.” (The nation will not tolerate any slave trading or slavery in the Republic.) Interestingly enough, the same constitution also guaranteed press freedom. Sources: * Boeyens, J.C.A. This week we continue our exploration of the history surrounding President Street, presumably named after the first president of the ZAR, MW Pretorius. He was the son of the famous Voortrekker leader, Andries Pretorius and was born on 17 September 1819 in Graaff-Reinett in the Cape Colony. At the age of 19 he joined his parents when the families embarked on the Great Trek to the north. President MW Pretorius was no stranger to the people of the Zoutpansberg. He visited the area on at least two occasions and he was very involved in processes to try and diffuse the animosity between the settlers at Schoemansdal and the Vhavenda. In last week’s article we took a closer look at these visits and the battles between, among others, Chief Madzhie and the Boer forces. The ZAR president was, however, also accused of taking part in the dubious “inboekstelsel”, often described as another form of child

Zoutpansberger

Nee.
