Policeman killed in Maebane

A well-respected police officer from the Tshilwavhusiku SAPS station was shot dead on Friday, 26 March, during a confrontation with two suspects believed to be involved in several business robberies in the village of Maebane.

According to police spokesperson Col Brenda Muridili, Const Rabelani Netshivhambe (31) and his colleagues were responding to several reported robberies at businesses in Madombidzha, Madabani, Tshikwarani and Maebane, where two suspects had allegedly robbed spaza-shop owners.

While the police officers were searching for the suspects, they came across two men on foot in Maebane village. The officers

stopped to question the men as they matched the description of the robbery suspects. One of the men pulled out a gun and shot at the officers, before both men fled from the scene. Netshivhambe was wounded and rushed to hospital, where he died.

After the incident, a 72-hour activation plan was immediately implemented, mobilising all resources needed to investigate and trace the perpetrators. The suspects were apprehended in Maebane on Saturday night at the home of one of them. Traffic piled up at the scene and had to be redirected as the police barricaded the scene. Within a short time, a large number of residents had gathered around the scene and watched as the police searched the suspects and found the pistol with which

Netshivhambe had been shot.

During the arrests, the police recovered a 9 mm pistol and 15 rounds of ammunition. The two suspects, Victor Mushambo (43) and Collet Maduwa (32), appeared in the Tshilwavhusiku Magistrate’s Court on 29 March.

They were charged with murder, attempted murder, business robbery and possession of an unlicensed firearm and ammunition. They remain in custody until 9 April while investigations continue.

Each year, many police officers are killed in the line of duty or ambushed at their homes. In many cases, the men and women are killed merely for their firearms.

The National Commissioner of Police, General Khehla Sithole, has conveyed his sincere condolences, on behalf of the SAPS, to the family and friends of their fallen colleague. Sithole commended the Limpopo police for the swift arrest of the suspects.

She argued that the current situation was being abused, because while the case was dragging on, Toni was receiving a king’s salary and had no incentive to speed up the process.

The ConCourt judges sent letters to the parties directing them to comment on the request that the certificate of recognition of Toni as king of the Vhavenda be withdrawn immediately. The parties were also required to make input as to the decision of the SCA not to issue a cost order against Toni in the appeal case. Finally, the parties were required to respond to Masindi’s legal team’s request that the application for appeal to the Constitutional Court be dismissed with a punitive cost order. The cut-off date for submissions was set for 2 April.

Masindi’s arguments In Masindi’s submission, argument is presented that the appointment of Toni as interim ruler created an untenable

situation. “It incentivises delay tactics on the part of the applicants in the litigation, while affording the first applicant continued access to public resources to which he is not entitled, including to finance protracted litigation,” they argue.

They also posit that to remove Toni from the position he currently holds will not be prejudicial to the Vhavenda nation. Masindi’s team argue that Toni is already compromised “in that he has been found in a report of the Prudential Authority to have corruptly received large sums of money stolen from VBS bank”.

The stay order that allows Toni to reign, they argue, was never requested by any of the parties. The SCA also did not allow any of the parties concerned to make input on the matter. This step of the SCA was described as going against the principle of fairness that should be applied by courts.

“This requires affording the parties the opportunity to address the court on the appropriateness of the proposed remedy before it is granted, and especially so if they may be prejudicially affected by the order,” they argue.

On the issue of cost, Masin-

di’s legal team contend that the court should have awarded cost, according to the principles set in another case, often referred to as the Biowatch principle, which concerns litigation between a private party and organs of State. “The review application is, therefore, constitutional litigation against the State for the protection and enforcement of rights in the Bill of Rights,” they say.

The State respondents in the case sided with Toni and should be held liable for costs, they state.

However, the issue of punitive costs is where Masindi’s team pulled out the big guns.

They present the argument that Toni has a history of trying to obstruct justice and that the royal house has effectively lied to the court. In his replying affidavit, the spokesperson for the royal family, Mr David Mphephu, states that Toni “is not a suspect in any investigations or at risk of being arrested for the crimes committed against VBS”.

Masindi’s legal team has questioned this statement and asked for clarity from, among others, the Directorate of Priority Crime Investigations (DPCI) and the National Prosecuting Authority (NPA). “The

DPCI and NPA also denied the correctness of the statements made by the applicants,” states Masindi’s submission, along with the responses from the various law-enforcement bodies.

“No such representations were ever made by the first applicant, let alone favourably considered. He remains the subject matter of ongoing investigations and has not been exonerated.”

In their submission, a lot of emphasis is placed on the context of the case. The Limpopo High Court found that Masindi had not adhered to the processes prescribed by the Traditional Leadership and Governance Framework Act when contesting the kingship.

When the case ended up in the SCA, this finding was not dismissed. The SCA ruling stated that “the high court was also correct in dismissing her allegation that she held a legitimate expectation that the leadership incumbency was under investigation by both commissions.”

The SCA found that Masindi’s claim to the title or a declaration of a leadership dispute had in fact expired, as it was out of date. “Having found the judgment of the High Court to be correct in the manner described above, the SCA should have dismissed the appeal,” Toni’s team argue.

On the issue of costs, they argue that the discretion used by the SCA was proper. “It is self-evident that this matter is of great importance to the Vhavenda people and their history that the issue of kingship/ queenship be resolved for now and for the future,” they claim.

In the submission, the argument is presented that nothing vexatious exists about the manner in which the applicants had conducted this litigation. “The resolution of the dispute is also a constitutional matter under chapter 12 of the Constitution … and an adverse cost order or a punitive one at that, would in principle, be wrong,” they say.

In response to the allegations that they had lied to the courts regarding the VBS matter, they simply state that “(the) VBS Mutual Bank issues are strictly irrelevant for the determination of this matter.

They have never served before the High Court nor the SCA”.

They further argue that Masindi’s request that she be recognised as the queen of the Vhavenda people would offend the separation of powers doctrine and the rule of law.

“By statute, the determination of kingship or queenship is a matter legislated by the Framework Act, as amended.

It would be most incongruent to have such an order which is inconsistent with the person nominated by (the) Makhadzi to be king according to the customs and traditions of (the) Vhavenda people,” they say.

“This has left a big void in our lives. Our sister was everything to us. She singlehandedly provided for her family and made sure that all her children got education and were well fed.”

The deceased, Ms Rosemary Netshikulwe, was employed at the SACM as a prison warden.

According to provincial police spokesperson Brig Motlafela Mojapelo, details of the events leading to her death are still sketchy, as she was with her son at the time. However, he has confirmed that she was stabbed several times all over her body.

“The police and emergency services were summoned to the scene, where the victim was certified dead,” he said. “The motive behind the incident is not clear yet.”

The police are still searching for Netshikulwe’s son, who is a suspect in the ongoing investigation at this stage.

He is said to be autistic and is still on the run after the incident.

Mojapelo said that the police were directing an earnest plea to couples who might be experiencing marital or relationship problems to consult a therapist or social worker for counselling, rather than resorting to killing each other.

The police requested Mr Leonard Mofo, also known as Rasta, to come forward as they believe that he might have information that can assist with the investigation.

Makhubela resigned early in 2018 to take up a position at the Greater Tzaneen Municipality, where she is still the CFO. The last investment was made on 20 July 2017, when the money was transferred, but the paperwork was only signed weeks later, on 14 August 2017.

The mayor at the time, Mildred Sinyosi, denied that investments were ever discussed with her and said that she had made no input into investment decisions. She also denied knowing that statutory processes had not been followed and background checks on the bank had not been done.

Makhado Municipality invested R 101 467 110,61 with VBS Mutual Bank. When the bank was liquidated, the amount still owed to them, with interest, stood at R53 532 889,39.

In the report that the premier referred to, a recommendation was made that the Makhado Municipality act against Mr I Mutshinyali, Mr N Kanwendo, Ms M Makhubela, Mr N Radzilani and Ms E Lubisi (Manager: Assets Management). Sinyosi was also found to have failed to comply with legislation and she had not performed the oversight role required of her.

Sinyosi was removed as mayor and is currently serving as an ordinary councillor in the Makhado Municipality. As far as the named officials, only Ms E Lubisi still appears to be employed by the municipality.

Questions were sent to the Makhado Municipality’s spokesperson, Mr Louis Bobodi, last week, asking what steps the municipality had taken in line with the reports, taking into consideration the assurances by the premier that action would be taken.

“In terms of the VBS saga, the matter is still before the curatorship, and as the municipality we are still awaiting for the curatorship to finalize the process,” said Bobodi this week. The municipality did not want to comment further as “the matter is before the law enforcement agencies.”

What also became apparent later was that the acting CFO at the time, Ms Nembudani, was concerned about the legality of the investment and wrote to, among others, the SA Reserve Bank, asking for clarity.

Despite the CFO’s refusal to recommend the investment at VBS, the municipal manager, Mr H Maluleke, approved it and the funds were transferred. The money was invested for a period of three months, after which the funds were paid back, with interest of just over R682 000.

Several months before this investment was made, VBS started to woo the municipality. In August 2016, VBS made a presentation to Thulamela, which clearly indicates that pressure was mounting on the municipality to channel funds to the mutual bank.

The mayor, Avhashoni Tshifhango, admitted that he knew the bank’s chairperson, Tshifhiwa Matodzi, as they had studied together in 1997.

He described the discussions as mere “conversations between friends”.

In December 2016, the same month that Thulamela made the investment, Mayor Tshifhango obtained vehicle finance from VBS, which he used to purchase a Jeep. The vehicle was later returned, and the mayor did not appear to have any outstanding debt with the bank.

The political pressure exerted on politicians and officials to invest in VBS also surfaced in the investigation into Thulamela. VBS had apparently obtained inside information about Thulamela’s finances. Matodzi apparently knew that VBS was offering higher rates than the other banks asked to supply quotes. VBS had also sent a quote to the municipality after the closing date specified for submissions of quotes, but this quote was nevertheless accepted.

Johannes Kanwendo, the MM in place when most of the investments were made, later became the “scapegoat” for the fiasco, He was suspended in November 2018 for his role in the saga. Kanwendo told forensic investigators that he had been instructed by the mayor at the time, Sinyosi, to invest with VBS. Musina residents reach out to help migrants at CWM’s shelters

By Bernard Chiguvare The situation of 41 migrants living at shelters run by the Christian Women Ministries (CWM) in Musina is getting worse by the day as the organisation is struggling to provide for them.

According to a GroundUp report, CWM erected the shelters in 2008 after they realised an influx of unaccompanied children on the

streets of Musina was taking place. Most of the migrants are from Zimbabwe. The shelters are in Nancefield and Matswale.

The shelter at Nancefield houses 18 migrant ladies, while 23 boys are accommodated at Matswale.

The Department of Social Development (DSD) stopped funding the shelters in 2019 when its registration expired as a result of non-compliance issues.

In GroundUp’s report, Ja-

cob Matakanye, the director of the shelters, blames the DSD for not releasing money in time, so that the shelters could be maintained and made compliant.

Last week, Musina residents delivered firewood to the Nancefield shelter.

Matakanye said he was very grateful to the community for their support and assistance.

One of the migrants said: “Realising that the shelter is not funded and that we have very little electricity left, we

decided to approach the community for assistance. The community brought a bakkie full of firewood, which we now use for cooking meals.

The remaining electricity is only for lights.”

Grace Kgalamadi, a local resident, decided to invite a few migrant ladies from the shelter to her home on a regular basis for a meal, just to chat with them about problems they might be faced with.

Musina residents have taken it upon themselves to help migrants housed at the Christian Women Ministries (CWM) shelters. The Department of Social Development (DSD) stopped funding the shelters in 2019, and providing for everyone is getting harder by the day for the CWM.

The executive mayor of the Vhembe District Municipality, Cllr Dowelani Nenguda (right), received a memorandum with some grievances from Mr Bonaventure Mashau, a community leader from Mashau, after Nenguda’s visit to the area to address service delivery in local communities. During the visit, community members also complained about the poor state of the roads.

During 2013, a makeshift bridge in Makuleke village outside Malamulele was swept away by heavy rains, leaving people around Makuleke without a proper bridge. On Friday, 12 March, the executive mayor of Vhembe, Cllr Dowelani Nenguda (left, holding a pick) and Nduna Sampson Mbvunwani (right, holding a spade), marked the start of the construction of a new bridge in Makuleke. Vhangeno is from Mudimeli village in the Nzhelele area.

He has been in the entertainment industry since 2012 and soon discovered that music adds more value to his work as an MC. “I used to organise and facilitate events such as Educational Day, Mudimeli Day and other important local celebrations, and that’s where I noticed my prowess as an entertainer,” he said.

Vhangeno believes that everyone has a gift and talent which, through motivation and support, can be moulded into whatever they wish to become. He has a knack for promoting and supporting local artists, and today actively promotes many of them in the Vhembe District. He also

Reggae artist Ishmael Mudau’s voice conveys a serious tone as he delivers an urgent message to his nation this Easter via his most recently released single, called Arrive Alive.

“This is a timeless song that I felt should be released now, so that people will remember to travel safely over the Easter weekend,” he said. “We do not want to witness more road carnages because, honestly speaking, we all know that most road accidents can be prevented by caution.”

Mudau, who released a fulllength album earlier this year, titled A longo lala, sings about social issues. For example, A longo lala suggests that peace does not exist in the land. “My songs are somehow interrelated, like A longo lala and Arrive Alive,” he said. “If we really want harmony on our roads, we need to adhere to all road signs, including the speed limits. I have come to realise that most of the disorder on our

His home is at Lwamondo-Zwavhavhili, but he travels to and from Gauteng all the time to deliver his music to his people.

“I am often at home to connect with my roots,” he said.

Lutendo Munyai, the guitar maestro also known as CJ, has just released an album that

will endear him to the hearts of many music lovers in the country.

The album, titled Gi Mi Credit, contains outstanding tracks such as Beautiful dread, Mufunwa, Good God, It's been a long time, Love, Vision in the dark, Conscious mind, The Native and Musadzi wa vho Rasta.

Munyai resides at Miluwani Tshitangwe village. He matriculated from Mphaphuli High School and is a singer, songwriter, and guitarist of note today. “I used to sing in high school during casual days, karaoke shows and in church assemblies,” he said.

His music found its roots in a Tshikona traditional music ensemble around 2000, where he was an active flutist in the school. The ensemble went on to perform as far afield as the National Arts Festival in Grahamstown (now Makhanda).

“Those were the good old days, and they formed the basis of the artist in me. So, even now when I look back, I am able to see where I come from,” he said.

Munyai bought his first acoustic guitar in 2006, with a guidebook and DVD, and started to teach himself how to play the instrument. He would put records on from his uncle’s collection

and strum his guitar while he sang along to the likes of Dobie Gray.

However, his current style of producing music is influenced by different genres, mainly from popular western music, such as Westlife, Backstreet Boys, Bryan Adams and Prince. His reggae music is influenced by Jamaican legends such as Bob Marley and the Wailers, Dennis Brown, Third World and Burning Spear.

“After matriculating, I went to a college in Pretoria. That was when I seriously started to write pop- and Reggae songs,” he said. “I penned songs down such as Musadzi wav ho Rasta, Let me in and So well goodbye.”

He met up with some other singers, and together they started a small group called Street Rockers. They performed at train stations and leisure parks.

In 2012, Munyai was part of the Makhado Annual Show, where he opened the stage for artists such as Colbert Mukwevho, Donald, David Mmbi and Mizo Phyll. “There’s no looking back. I am here to make some serious quality music,” he said.

Skoonplaas mother braves smoke and fire to rescue her daughter

Special Olympic ambassador visits Fhulufhelo Special School

By Silas Nduvheni The ambassador for the Special Olympics in Vhembe, Rofhiwa Manwadu, donated sanitary pads and toothpaste to pupils of the Fhulufhelo Special School in Thohoyandou.

Manwadu, who is employed by the Thulamela Local Municipality in the office of the mayor’s special programme, said that being disabled did mean one could not reach for the sky. “We have to give support to people with disabilities, because they

didn’t choose to be the way they are. When giving support to disabled people, we also encourage them to take education seriously and forget about their disabilities and poor backgrounds,” Manwadu said.

Thulamela Mayor Avhashoni Tshifhango accompanied him on Thursday, 25 March, on the visit to Fhulufhelo Special School. Tshifhango also used the opportunity to donate shoes to disabled learners of the school.

He urged parents with disabled children to place them in special schools such

as Fhulufhelo. He said that some of these children were more talented than children born without disabilities. He used Manwadu as an example of someone who lives with a disability, but who became an ambassador for the Special Olympics in the region.

“We have to motivate and encourage disabled children not to be discouraged by their status. They are important in our societies, despite their disability. As a local municipality, we have formed a partnership with Manwadu to support his vision,” said Tshifhango.

Sibanda expressed her appreciation to the Musina residents who helped them in their hour of need. “I really thank everyone for their prompt action.

Besides putting out the fire, some residents went on to clear the rooms and clean the walls,” she said gratefully.

Musina municipality promised to assist with food parcels and to replace the electricity box, while many residents are donating money to assist the family. Sibanda and her family said that they could not thank them enough for all their help and support.

Residents from the Skoonplaas neighbourhood in Musina showed their spirit of ubuntu, or working together, after a family’s house caught fire last week. Neighbours showed up in great numbers to help in any way they could.

After the fire was put out, some even helped the family to clean the house.

Cassey Sibanda’s house is situated a few metres from Musina mall. Her brother, Peter Jack Mokgoli, and his six-yearold boy live with Sibanda and her nine-year-old daughter.

She told Limpopo Mirror that she did not know what had caused the fire, as she and the two children had still been sleeping at around 08:00 on the morning of Wednesday, 24 March, when they realized that the house was on fire.

“My brother had already left for work, so it was only me and the children in the house, asleep. When the boy come out of the bathroom, he noticed sparks coming out of the main electricity box and he alerted me. All I could do was to call neighbours for help. Later on, I realised that my daughter was still in bed,” said Sibanda.

The house was filled with smoke and flames and neighbours were trying to put the fire out with buckets of water.

New TOPS at SPAR opens with plans for a KWIKSPAR in place

By Andries van Zyl Amidst tough economic conditions because of the negative impact of the worldwide Covid-19 pandemic, Louis Trichardt businessman Mr Luke Enslin is not cutting back like many businesses are doing. No, he is continuously looking at investing in and expanding his business interests.

Last week, Enslin opened his third TOPS at SPAR liquor store in the Da Silva complex opposite BB Mount Fuji Motors in Krogh Street. His vision, however, also includes the opening of a KWIKSPAR in the same complex. “If people see development, they see hope,” said Enslin.

For the past couple of months, a flurry of construction activity has been going on at the complex. Most notably was the upgrading of the TOPS liquor store. The store was previously known as LiquorZone, which Enslin bought from the well-known Van Rensburg couple, oom Hennie and tannie Rita, mid2020.

The newly revamped TOPS at SPAR (Loerie) officially opened last week. The revamp included bringing the branding up to TOPS standards and expanding the floor space

from 160 m² to 244 m ². The number of pay points was increased from two to four, with the addition of extra walk-in fridges. Enslin is particularly proud of his new chilled wine cellar. “It keeps our wide variety of well-known wines at just about a cool 10°C. We also created a ‘braai’ section where you can buy anything you would need for a braai – from wood to a cooler box,” said Enslin.

Enslin now owns three TOPS at SPAR stores in Louis Trichardt. He also recently purchased a TOPS at SPAR in Pretoria. In addition, he also owns Soutpansberg Spar and the Louis Trichardt SUPERSPAR. At this stage, most of the available parking is taken up by tenants of the second-and third-storey apartments. “I have negotiated with the landlord and he will create parking space for the tenants behind the apartment complex. By the time the Kwikspar opens, no tenant will be allowed to park in front of the complex anymore,” said Enslin. Having said this, parking space at the complex remains limited.

“That is why the store will have five pay points. The idea is not to let customers stand in queues but rather to get them in and out of the store as soon as possible,” said Enslin.

Enslin said that he was pushing to open his 450m² KWIKSPAR in June this year.

“It will be a state-of-the-art shop when we open,” said Enslin.

Makhadzi will fondly be remembered

Mr Shumani Mushavhanamadi, a close related family member described her death as a terrible blow for the Musha­ vhanamadi clan, where she was born and bred, and also for the Mathelemusa family and community at large.

According to Mushavhanamadi, Mathelemusa was one of the only two clan members left from that generation. He said that she was the one who had the final say in matters within the clan, and that they usually received good advice from her.

“When we started the burial society of Mushavhanamadi, she was the one who steered us in the right direction, as she was one of the oldest people in the clan. We used to get traditional foods for free from her table, as she treated us as

her own her children,” said Mushavhanamadi.

He said she went for a checkup on Tuesday, 23 March at the Tshilidzini hospital, but succumbed from an illness shortly afterwards.

One of the women who was employed by Mathelemusa, Ms Sophia Mamatsharaga, said that her life will never be the same without the old woman.

She (Mamatsharaga) has also lost her job, as there is no one else who sells traditional food.

“She was my bread and butter.

I started working for her in 2013 and never regretted it.

Makhadzi cared about the needy and poor people and even helped people with transport fees,” she said.

Mathelemusa was buried on Sunday, 28 March, at the Mbaleni cemetery.

Once the harvest season came, they sold the produce to the local communities and used the proceeds to purchase at least five goats. “The goats soon multiplied to 14,” Makhubele said. “We were left disheartened when 10 of our goats got stolen. We then moved the goats from the mountain to our new place, belonging to a fellow community member who offered us the space as part of a partnership.”

Damboni’s treasurer, Mr Nhlanhla Mangezi, said that they were looking forward to creating more ceramics, planting more vegetables, and rearing more animals to ensure that the project reaches its objective

of adding value to the local communities.

“We sell some of our products in the public spaces along the R578 road, and motorists stop and buy,” he said. “We would also like to buy more goats and a few sheep, for we have great, fresh pastures in our areas, and as a result, our animals multiply easily.”

Damboni Project’s chairperson, Mr Herman Molewa, said that the love and respect for one another were what kept them together. “We assign duties to each one of us and then make sure that no one moves around idly. If we let ourselves talk too much and do less work, we might end up in chaos,” he said.

Damboni Project might still be new, but it is geared for growth.

Members have vowed to work harder to ensure that the project does not die along the way.

Disabled encouraged to know their human rights

By Bernard Chiguvare As a way of celebrating Human Rights Month, some 70 disabled people gathered at their new office building next to the Lesley Manyathela Stadium in Musina on Friday, 26 March.

Yunsa Mbewe, secretary-general of the Vhembe branch of Disabled People SA, said the purpose of the meeting was to educate people who lived with disabilities about their rights as human beings. Human rights lawyers were invited to the meeting for this purpose.

“We often note that people living with disabilities are looked down on. At hospitals, we sometimes we find disabled people being sent home without any treatment. Hospital staff tell the disabled that their files are missing, just because they

don’t want to bother with them. In shops, cashiers let disabled people wait in long queues, until they leave without buying whatever they intended to buy, because they can’t stand for such a long time,” said Mbewe.

He encouraged disabled people to request the assistance of managers, should they feel that their rights have been infringed in any way.

On another note, Mbewe is advocating for disabled people to be allowed to be employed with any community work, as this will also help them sustain themselves.

“Though people living with disabilities get a monthly disability grant, it’s not enough and it’s not a salary.

To deny the disabled employment is a violation of their right to work,” Mbewe said.

Desiring to take the initiative further, the three SABC Limpopo radio stations felt they wanted to go a step further and formulated what then became known as the SABC Limpopo Combo, with the late Mr Victor Ravhuanzwo as the president.

“This concept, which became a very powerful tool used by Munghana Lonene, Phalaphala FM and Thobela FM to unite not only these stations but also its listeners and stakeholders, is for me the ultimate highlight of my days and time at the SABC,” said Netshitangani.

Netshitangani is also an ordained pastor with a bachelor’s degree in theology from the Team Impact Christian University. He has been shepherding the Living Word Christian Church since 2011.

All eyes will be on the match between Chippas United Ladies FC and Lacoste Morning Stars to be played at the Makhuvha Stadium tomorrow afternoon. The managing director of Chippas, Mr Robson Magoro, said he was happy about the fact that they were commencing the new season with a derby.

He stated that the game against Morning Stars would assist them in measuring their level of readiness for the new season.

Mr Magoro revealed that they had played a few friendly

matches and tournaments over the past months in a bid to keep the players fit. According to him, their last friendly match was against a squad from Tsha­ mutshedzi village at the Tsha­ mutshedzi Grounds last Sunday.

“Judging from the team’s performance against the Tshamutshedzi squad, we are convinced that the team is ready for the new season” said Mr Magoro.
