The ConCourt judges sent letters to the parties last week, directing them to comment on the request that the certificate of recognition of Toni Ramabulana as king of the Vhavenda be withdrawn, awaiting the outcome of the High Court case.

The parties must also make input as to the decision of the Supreme Court of Appeal (SAC) to not issue a cost order against Toni Ramabulana in the appeal case.

A battle of more than ten years.

The battle to determine who the leader of the Vhavenda nation should be, has been continuing for more than a decade. In July 2010, the Nhlapo Commission’s findings were announced. This commission found that the kingship/queenship of the Vhavenda was vested in the Mphephu-Ramabulana royal family.

In August 2010, the royal family (or council) identified Toni Mphephu-Ramabulana as the king of the Vhavenda. This decision was communicated to the relevant minister and premier and eventually led to then-President Zuma’s making the announcement.

On 21 September 2012, Zuma published a notice in the Government Gazette that recognised Toni Mphephu-Ramabulana as king. Three months later, Masindi’s legal team filed papers in the High Court, aimed at declaring the president’s decision unconstitutional and invalid.

The court gears slowly started moving, and in August 2015, the parties agreed to first deal with the “technical” matters. Masindi’s legal team raised 14 issues that they wanted the High Court to rule on. The issues raised included prescription periods and exactly who has jurisdiction during certain processes. It also required clarity as to what review processes were available as remedies.

The case was eventually heard in December 2016, but Judge Makgoba dismissed it.

He also did not feel the case had a chance of success if appealed and refused permission.

Masindi’s legal team proceeded to obtain permission to appeal directly to the SCA. When the case was eventually considered in April 2019, the SCA’s judges arrived at a surprising conclusion. The five judges of the SCA did not agree with Judge Makgoba and felt that Masindi had been discriminated against because of her gender. They set aside Zuma’s declaration that Toni was king, and the case was referred back to the Limpopo High Court. Even though the SCA set aside the appointment of Toni as king, the court allowed him to rule in an interim capacity.

In July 2020, 15 months after the SAC ruling, Toni Ramabulana’s legal team filed papers in the Constitutional Court, requesting this court to set aside the SAC ruling.

Masindi’s legal team followed up on this by filing a counterclaim at the ConCourt.

Masindi’s legal team have up to 26 March to file their submissions. Toni’s legal teams will then have to file their answers before Friday, 2 April 2021.

New political party launched in Vhembe

By Kaizer Nengovhela A new political party, called the Able Leadership (AL), was launched in Malamulele on Saturday, 27 February.

The party plans to participate in the 2021 local municipal elections.

According to AL chairperson Mr Tinyiko Khosa, the party has already registered with the Independent Electoral Commission (IEC) and it aims to rescue local municipalities around Vhembe and Mopani from a series of problems that the ANC government has failed

to rectify in its 26 years of governance.

“We want to lay the foundation for a democratic and open society in which government is based on the will of the people and every citizen is equally protected by law. We aim to protect and encourage industry and agriculture, along with the conservation and rational use of natural resources,” said Khosa.

The party was formed in 2019 and plans to convince Vhembe and Giyani residents to vote for them.

“We plan to govern with traditional leaders and involve them in every decision we

make right from the start, so that they become part of the outcomes and do not feel left out when it’s time for implementation,” he said.

He further said that people must understand that the AL is about taking action. “We don’t promise, we do it,” he said.

“To our supporters, we are still going to meet at many events to popularize the AL while we will be trying to get membership. After four weeks’ rest, we will be recruiting everywhere. Our target is to secure seats in the provincial and national legislature,” Khosa said.

he state of the nation address delivered by President Cyril Ramaphosa has confirmed again that we have a good and wise leader in need of more committed implementers of government programmes, policies and initiatives. As mentioned before from many quarters, our government has a multitude of good thinkers who can craft good policies, but seem to have a challenge of matching good implementers to its plans.

Perhaps it is time for policy and strategy formulators to become implementers or to work round the clock alongside implementers.

We cannot argue the fact that it is not always an easy task to run government affairs successfully; however, I think if each government stakeholder can increase their commitment towards implementing government initiatives, we can, without a doubt, witness a strong rebound in our economy and realise inclusive growth. It sometimes feels and looks like the government is its own enemy, and once it stops fighting with unions we can progress faster than we think.

The Book of books advises that “every kingdom divided against itself is brought to desolation”. We need to remain united and focused in order to fulfil these plans. We should

stop creating problems, knowingly through our inaction and wrong action, just like we did with some of our state-owned entities.

The challenges we are facing have been here long before the arrival of the Covid-19 pandemic and are largely because of our own action. We have a rising debt currently standing at over 81% of Gross Domestic Product (GDP) or around R4 trillion, with nothing significant to show for what we did with the borrowed money. We must not forget the warning from the good book which says that “Borrower is servant to the Lender”. We need to seriously watch how we spend.

and spending on programs which do not contribute to the growth of our economy.

Lastly, I was very impressed when the president openly reiterated that both public and private sector should work together to take the country forward. Indeed, government alone cannot solve the problems of this country without greater and meaningful participation of the private sector.

It is the responsibility of every capable and willing South African to put shoulder to the wheel in a bid to fight unemployment, eradicate poverty, reduce inequality and provide further access to education and health care.

Woman accused of trying to have ex-husband killed

By Silas Nduvheni A local woman was arrested for allegedly plotting to kill her ex-husband, apparently after a dispute over child maintenance. The suspect appeared in the Thohoyandou Magistrate’s Court on Friday, 26 February.

According to Captain Matimba Maluleke of the Limpopo Hawks, 35-year-old Ms Elelwani Jane Nedzamba allegedly hired a hitman in November 2020 to kill her ex-husband, who is a police officer in the Vhembe District. The police did not want to disclose the name of her ex-husband or where the alleged offence took place as the investigations are still at a sensitive stage.

Maluleke said that the Hawks received a tip-off about the plot and kept Nedzamba under surveillance.

The hitman was allegedly promised R10 000 to kill the husband. Nedzamba was arrested on Wednesday (24 February) as she was allegedly withdrawing money to pay the man.

Nedzamba faces charges of conspiring to commit murder and will remain in custody until 14 April for further police investigation.

Upon enquiry of why the crocodile could not have been transferred to another location, rather than being shot, Kala explained: “Some wild animals are territorial. So, to merely transfer a dangerous wild animal from one habitat to another usually causes fights among the territorial animals within that habitat,” he said.

“Experience has taught us that the transferred animal soon breaks out again and continues to cover long distances on foot, endangering communities in search of another habitat.

Therefore, to transfer certain wildlife is not always a solution to ensuring community safety.”

“At first, I dismissed the dreams as meaningless, but later on I realised that no person could dream one thing over and over again. This was a purposeful dream,” she said.

“I am so happy now that I have risen above the dark cloud of the Covid-19 pandemic, which had submerged so many artists, leaving them broke and going for days without basic needs, such as food and electricity,” she said.

During the lockdown last year, she kept herself busy by teaching her son how to read and write, when crèches were not operating, and she said that she now has a new kind of respect for teachers.

“I learnt a lot from that experi-

ence; that teaching a child to read and write is not child’s play! So, I had come to look at teachers through new eyes. Teachers are doing such a great job for our children, and it seems that many parents are not really aware of this fact,” she said.

She is currently busy with the final touches to her upcoming full-length album, which is due this year. Other hit songs by this gifted artist include Samuyele, Lufuno, Philiphise, Mathada and Mitokela.

Tshindane is living out her dream Phalaphala FM’s newsreader, Ridokunda Tshindane, has had a long journey to get where she is today, but she is fast becoming the queen of the airwaves.

This young woman is a rising star and making waves of her own, especially on the news front.

Tshindane was born and grew up at Lutomboni village in the Nzhelele area. She started her school career at Gondolikhethwa Christian School and matriculated at the same school in 2010.

After she had obtained her BA degree in Communications from the University of Limpopo, Tshindane started working as a news anchor at Makhado FM from September 2015 to January 2018.

During her tenure with the community radio station, she also worked as current affairs producer, as well as presenting a talk show. During the same period, she was also writing articles for Pride News as a freelance journalist.

In 2018, she joined Vhembe FM as a news anchor; a position she held until she came to the SABC. “I learned a lot about the mechanisms of working with radio, as it was my childhood dream.”

When Phalaphala FM called her for an interview in 2019, and she passed the interview, she was over the moon. “I was so happy, I made a promise to myself that I would have to make them proud of me.

I had to excel and show them that they didn’t make a mistake by hiring me,” she said.

Tshindane describes herself as very energetic and flexible. “She is a brand in her own right and commands huge support,” the station said.

“When I am on air, I feel as if I am in a certain realm. I remember listening to radio DJs on a stereo with earphones plugged in my ears at an early age.

I knew that one day I would be behind the microphone,” said Tshindane.

She enjoys the opportunity to interact with listeners and said that radio journalism had taught her to always be prepared to learn. She is very thankful for the support she has received since she ventured into the broadcasting industry.

“I am what I am because of my listeners, and I will never forget to appreciate their continuous support. I love news, having grown up listening to Tshivenda news on radio, especially the former Phalaphala FM newsreader, Makhadzi Mphelo, who was broadcasting news, and I was inspired.”

To her, mixing with the other presenters is a privilege, as they motivate her a lot. She said that she was not yet fully satisfied with her success so far, as she planned on achieving even more in life. “I need more skills to improve my work environment.

Promising future for young double amputee

By Andries van Zyl Two-and-a-half years ago, a young double amputee, who was then a scholar at a special school in Thohoyandou, became the recipient of a prosthetic limb, courtesy of IsAbility, the Jumping Kids project and Harcourts. This year, the young amputee, Vhutuhawe Nemutandani, has been enrolled in one of the top schools in Limpopo, the Emmanuel Christian School outside Louis Trichardt.

This positive step towards inclusive education was driven by the local IsAbility Sports Club. Vhutu is part of the Jumping Kids Education project, which facilitates the placement of physically disabled children in suitable mainstream schools countrywide.

Education is a very real problem facing the parents of a child with any form of physical disability, whether it be visual, auditory, or physical. In the Limpopo Province, a number of primary schools for special-needs learners exist, but only ONE special-needs school caters for secondary (high school) learners.

“One needs to ask the question: Where do all the learners with disabilities go after Grade 7, because one secondary school can certainly not accommodate all the learners from the many primary special-needs schools? The fact is that most physically challenged learners are intellectually perfectly able to complete a full academic education in what is termed a “mainstream” school, but they are not afforded the opportunity. Tertiary education should also be as accessible to them as it is to those who are not physically challenged,” said IsAbility spokesperson Ms Sandy James.

Vhutuhawe was born with a condition called ‘tibial hemimelia’, where the tibia in the lower leg is defective. This resulted in the amputation of both his legs at a young age. After his mother passed away early in his life, Vhutu has been cared for by his guardian and family and has been in a special school for a number of years.

“The problem that has stood in the way of inclusive education for many years is that most mainstream schools feel they are inadequately equipped to care for physically disabled learn-

ers. However, there are schools that defy the odds. Emmanuel Christian School is one such pioneering school.

In fact, amongst its Grade 12 graduates, this school has had at least three wheelchair-bound learners successfully pass matric with bachelor passes and proceed to tertiary institutions over the years,” said James. She explained that Vhutuhawe’s guardians and family were extremely grateful for Emmanuel Christian School’s willingness to accommodate Vhutu, who is a bright young boy with excellent grades and the potential to excel, given the high-quality education offered by the school. They are also thankful to Jumping Kids for not only providing and adjusting Vhutu’s prosthetic limbs on an annual basis, but also for funding quality education which will take him to Grade 12 and beyond.

The second wave of Covid-19 infections has clearly passed and now the big questions is whether a third wave is on the way. According to the latest statistics provided by the Limpopo Department of Health, only 47 active cases were known in the Vhembe District on Tuesday, 2 March. If, by grace, I can train as a teacher, I would really want to come back to Musina and give back to the community,” said Nyasha, who has no desire to go back to Zimbabwe to live.

Though Nyasha passed matric, she cannot be accepted at any institute of higher learning. According to the CWM director, Jacob Matakanye, she must go back to Zimbabwe to get a passport in order for the CWM to assist her. *Nyasha and Taizivei are not their actual names

By Maanda Bele Following reports of heavy rains last week that caused damage to the main access road that links Dopeni, Shanzha and Tshivhilidulu villages, community members from these villages decided to take matters into their own hands. They hired a TLB and on Thursday, 25 February, started to open a new road that passes through Mutuwafhethu Primary School and Tshilogoni Secondary School.

One of the community members who had involved himself with this project, Mr Richard Thiba, told Limpopo Mirror that the communities had held a meeting and decided to fix the road themselves. “It was very painful to see our kids struggle to get to school. In some cases, parents had to carry their kids on their backs, so that they could help them cross the road. The community cannot not wait for the municipality,” he said. “We are opening this temporary road because it is close to the two schools.”

On Monday, 1 March, the mayor of Thulamela local municipality, Cllr Avhashoni Tshifhango, visited the damaged road in Tshivhilidulu. He said that he was proud of the communities for showing responsibility. “I am happy that you are not waiting on the municipality, but I also don’t recommend that communities build their own roads. If you build a road and it causes problems later on or someone gets injured, you will blame

the municipality.”

The mayor confirmed that plans for tarring the Tshivhilidulu Road were already in place, adding that they were just waiting to find funds to budget for it.

The community of Musina is calling on the municipality to find a lasting solution to its water woes. According to the community, a different section is without water nearly every week – almost like taking turns - which continues for days at a time.

They say that the biggest part of Musina town was without water for three days last week.

Residents complain that they have no money to buy water for their domestic use and therefore have to make use of any source of water within their reach every time their taps run dry.

On 22 February, Musina residents were requested, in a media release by the Vhembe District Municipality (VDM), to be patient after heavy rainfall had damaged the town’s

water infrastructure. According to Matodzi Ralushai, the VDM’s spokesperson, water pipelines were swept away, pump stations were damaged, and the electricity supply was cut off. He (Ralushai) said that water would be provided via trucks in the affected areas.

“If the municipality goes around with tankers, we never see them. So, we must find alternative means for water,” said a resident who wished to remain anonymous.

Thompson Mbedzi from Matswale told Limpopo Mirror: “Any nearby place where water is stagnant, is a good source, regardless of how dirty the water is. This really affects me, since I have several tenants here. I have to make sure the tenants have water for the baths and toilets.”

In situations like these, Mbedzi has to buy water for drinking and preparing meals,

but he cannot afford to buy water for his tenants too.

Another resident, Jane Vuledzani, said that she and several others had to rush to ditches up the hill, where a new road was being constructed, to fetch water.

Limpopo Mirror visited these ditches, which are near the Matswale area, on Saturday (27 February). A lot of footprints could be found around the ditches.

“I cannot afford to buy water for toilet use and washing.

A contractor was appointed on 25 February to restore the water infrastructure.

“This should enable us, working together with the institution of traditional leadership, to resolve issues that may be outstanding, especially in the duration of acting,” he said.

“In an effort to deepen democracy and ensure a sound working relationship with the institution of traditional leaders, especially on the issue of land, we also implore the legislature to finalise the development of the provincial version of the SPLUMA legislation.”

The executive mayor of the Vhembe District Municipality, Cllr Dowelani Nenguda, who represented the MEC for CoGHSTA, Basikopo Makamu, said that during Premier Mathabatha’s opening address of the Sixth Limpopo Provincial Legislature in 2019, he had called for the provision of offices for traditional authorities, so

that they could discharge their duties in comfort and with dignity. In December last year, the Tshivhase tribal offices were opened.

“With the recognition of the institution of traditional leadership in line with Chapter 12 of the Constitution of the Republic of South Africa, the function is to support them, and we can never run away from this duty and recognition of our being African people by ensuring that traditional leaders are catered for adequately,” said Nenguda.

“For some years, traditional leadership has raised concern about the need for enabling tools of trade for the effective and efficient functioning of this important institution, and, to date, CoGHSTA has constructed and completed numerous traditional council offices,” he said.

Don’t press panic button yet, says Leopards coach

By Frank Mavhungu Black Leopards wasted no time after their disastrous game against Maritzburg United on Tuesday afternoon.

Instead they boarded a bus and drove back to Polokwane to start with the preparations for their coming DStv Premiership fixture.

Leopards lost 0-1 to United. The Thohoyandou side dropped to the bottom of the log following the defeat.

Lidoda duvha will host Lamontville Golden Arrows at the Thohoyandou Stadium on Sunday afternoon. Leopards and Arrows will be meeting for the second time within a space of two weeks. Leopards beat Arrows 2-1 in their first-round league match at the Sugar Ray Xulu Stadium in Durban on Tuesday last week (23 February).

Leopards’ head coach, Mr Lehlohonolo Seema, is adamant that the pride of Vhembe will make a comeback in their remaining league fixtures. He appealed to the supporters not to press the panic button, saying they still had 13 league matches to play before the end

TTM are still celebrating their 6-5 victory over Swallows in their Nedbank Cup last-16round match at the Peter Mokaba Stadium in Polokwane last Friday. The defeat was the first for Moroka Swallows this season. Swallows shamed Vhadau vha Damani when they crushed them 2-0 in their first-round league match at the Thohoyandou Stadium five months ago.

day. The Beautiful Birds, as they are affectionately called, are one of the close contenders for the league title. Swallows are perched in the third position on the log standings with 30 points accumulated from the 16 matches they had played to date. On the other hand, TTM must win the match at all cost to enhance their chances of escaping the relegation axe at the end of the season. Vhadau are currently lying in the third-last spot on the log.

Asked about their level of readiness for the game, TTM’s head coach, Mr Dylan Kerr, revealed that they were leaving no stone unturned in their preparations for the game.

“As you know, Moroka Swallows are still to lose a league match this season, (but) we are going for a kill,” said Mr Kerr.

Swallows, however, did suffer their first defeat earlier this week when the team lost 1-2 against TS Galaxy.

Mr Kerr further stated that he knew Swallows’ weak- and strongpoints, having learnt from last Friday’s Nedbank Cup game.

The Swallows’ defenders, Sifiso Hlanti and Vuyo Mere, must keep an eye on TTM’s strikers, Rhulani Manzini, Thabo Rakhale and Joseph Molongoane, or else they will be humiliated.

When asked about the team’s level of readiness for the new season, Mikhado’s general manager, Mr Tovhowani Musandiwa, revealed that they had assembled the best squad ever. When asked to comment about the fixture, the assistant coach of Black Leopards, Mr Morgan Shivambu, was quick to mention that they were ready to face any opposition.

He revealed that he was aware of the fact that TTM were in top form of late.

Mr Shivambu’s counterpart from the TTM camp, Mr David Mathebula, stated that they were expecting the toughest game ever, adding that the Thohoyandou side would enjoy the home-ground advantage.

Chippa United will host Richards Bay FC. Richards Bay’s way to the quarter-final stage went via TS Sporting, whom they beat 2-1. Cape Town All Stars will entertain Pretoria Callies.

Orlando Pirates will know who their opponents are next Wednesday. They will play against the winner of the match between Mamelodi Sundowns and Polokwane City that will be played at the Lucas Moripe Stadium on Wednesday evening.

According to a statement from the league, the dates and venues for the matches will be made known towards the end of next week.
