‘n Plaasaanval in die Legkraal-omgewing (Bandelierkop) op Woensdagoggend het weereens die belangrikheid beklemtoon van mense in veral landelike gebiede om paraat te wees weens ‘n drastiese styging in misdaad te midde van die Covid-19 pandemie. Dié aanval is egter slegs een van talle misdade in die Soutpansberg streek die afgelope week. Die 62-jarige plaasboer en sy 58-jarige vrou is tussen 01:00 en 02:00 op 5 Augustus op hul plaas deur ‘n groep gewapende mans oorval. “Ons het omstreeks 01:40 die noodroep oor ons radio’s ontvang,” het mnr. Jan du Toit, veiligheidsvoorsitter van die Legkraal-omgewing, ure ná die aanval aan die Zoutpansberger gesê. Hy het die aard van die plaasboer se beserings as brutaal beskryf. Te midde van die trauma was daar darem ‘n bietjie goeie nuus gewees – die aanvallers is binne ure ná die aanval aangekeer. Volgens provinsiale polisiewoordvoerder Brigadier Motlafela Mojapelo is drie mans deur lede van die polisie se blitspatrollie aangekeer nadat hulle inligting ontvang het dat die verdagtes die egpaar se Nissan Navara bestuur wat tydens die aanval geroof is. Die voertuig is opgemerk op die Matlala-pad, wat gelei het tot ‘n jaagtog tussen die polisie en die verdagtes. Die verdagtes is uiteindelik in ‘n hoek gedryf op die N1 suid buite Polokwane. Twee verdagtes is op die toneel gearresteer, terwyl ‘n derde gevlug het. Dié is later gewond toe hy op die polisie begin skiet het en hulle teruggeskiet het. Teen druktyd was teenstrydige berigte gewees of die gewonde verdagte nog lewe of dood is. Volgens die polisieverklaring het hy

Sy kinderjare het hy op ‘n wynplaas in die Worcester-omgewing deurgebring. Met ‘n landboukwalifikasie in die hand het hy paaie gekruis met veeboerdery asook tamatieboerdery. Court declares security company director delinquent By Anton van Zyl In one of the first cases of its kind to be heard in the Limpopo High Court, a director of a well-known security company has been declared a delinquent director. This effectively means that the court found that the person is not fit to serve as a director of any company. The case stems from a dispute between the two directors of a security company, DRS Thohoyandou (Pty) Ltd. The company was started by Ronald Walter Sparrow (Ron) and Dion Svoboda and operated mainly in the Thohoyandou, Giyani, and Malamulele area. Svoboda seemingly provided the start-up capital, but Sparrow oversaw the operational part of the business. According to court papers, Sparrow extended the business to the Kremetart Residential Community in Giyani in July 2018, and 74 families signed on. Alarm systems were installed at the houses and the residents started paying their monthly fees. The only snag was that the money was not paid into the company’s bank account. Instead, Sparrow supplied his own personal bank account number where money was to be deposited. Residents also did not receive receipts from the company but were requested to send proof of payment to “an Indian spaza shop” (as is indicated in court papers).

When Svoboda found out about the arrangements, he was justifiably upset. Sparrow’s bank account was also used to pay for his personal expenses, and even his credit-card instalments and monthly loan repayments were deducted from this account. The company did not, however, transfer the money owed to Svoboda. In court, Sparrow argued that he had used his own bank account as a type of “trust account” and he had had the intention to pay any profits into the company’s bank account. He told the court that he had asked Svoboda on numerous occasions to buy vehicles and equipment for the business, but these requests “fell on deaf ears”. Sparrow tried to convince the court that the company was experiencing serious cashflow problems and he had to do something to ensure that the company met its obligations to its clients. One crucial error that Sparrow seemed to have made was to keep all this information from his business partner and co-director. “I know if I were to tell him of the ‘plan’ he would not have agreed to it,” he stated in his answering affidavit. When the facts eventually emerged, Sparrow was suspended by DRS Thohoyandou on 11 December 2018. The two were at loggerheads and the relationship of trust that should exist between directors was clearly gone. Svoboda then

turned to the court to have his former partner declared a delinquent director. More than a year went by before the case was heard, but in January this year, judge EM Makgoba ruled in favour of Svoboda and declared Sparrow a delinquent director. “(Sparrow’s) conduct falls short of the standard expected of a director … to such an extent that it amounts to wilful misconduct, breach of trust, and a gross abuse of his position as a director,” Makgoba said. The judge emphasized the responsibilities that the Companies Act places on directors. These responsibilities include that a director should always act in the best interests of the company and may not act in self-interest. Directors must communicate properly and may not withhold important information from co-directors. If a court finds that a director has grossly abused his position and takes personal advantage of information or opportunities in the company, such a director must be declared a delinquent director. Makgoba pointed out that Sparrow had knowingly acted without having the authority to do so. He regarded the action of Sparrow to have the money paid into his personal bank account as wilful misconduct and a breach of trust. Even though the relationship between the two directors was strained, Makgoba said Sparrow

was nevertheless legally bound as a director “to discharge his duties in the same manner had the relationship between them been normal”. He said even if Svoboda had also acted in dereliction of his duties (which was denied), this did not absolve Sparrow from carrying out his duties. “The effect of a declaration of a person as a delinquent director is that he is thereupon disqualified, for so long as the declaration remains in force, from being a director of any company,” Makgoba explained. Sparrow’s attempt to fight back and file a counter-application to have the company liquidated did not work either. The judge reckoned the solution would not be to wind up the company; he was of the opinion the individual wrongdoers should be acted against. “The effective remedy in the circumstances is therefore a delinquency order and not a winding-up order,” he said. Sparrow was ordered to pay the cost of the application on a scale as between attorney and client. The order of Judge Makgoba went on appeal but was first denied by the Limpopo High Court on 11 February 2020. Sparrow’s legal team then appealed directly to the Supreme Court of Appeal, but this appeal was also turned down on 14 July.

passion, and great leadership. He had by then already served, intermittently, many years in the Buys Management Committee (BMC). Aided by his wife, he was a horticulturist by which he could earn an income. I knew him to be up and about at 03:00,” said life-long friend Alexander Smail. Smail said he had served under Oom Simeon (as he was affectionately known) as vice-chairperson of the BMC from July 2002 until December 2009. “This was a trying time for the committee, with all the problems left behind by the outgoing committee. There were no funds to work with, land claims were coming in, division in the community, and many other problems. This was indeed a time when we needed strong leadership. We HAD SIMEON as our leader; what a leader! what leadership! He put us on a course of hard and

difficult work, of which I bore the brunt! What a slave driver! The man was indefatigable,” said Smail. Hy was daar toe God deur die magtige Woord net gespreek het om alles te skape.

Hy wat Is, die mensgeworde Woord, het gekom, soos ons al weet, om tussen ons, in die gestalte van ‘n mens op die aarde te kom woon. Hy is die Woord, die Lewe. In Hom was daar lewe. Dié versameling voorwaar ‘n skatkis van unieke kosbaarhede Deur Pétria de Vaal Die Zoutpansberger het nog ‘n klompie skatte in die besit van ‘n familie in ons omgewing ontdek. Die familie wil hulle identiteit stil hou, om verstaanbare redes, aangesien hulle versa­ meling uit ‘n klompie rare en uiters kosbare artikels bestaan. Met items wat oor eeue strek, is hierdie voorwaar ‘n besondere versameling. ‘n Unieke porseleinbak dateer uit die tydperk van die Ming-dinastie wat vir byna drie eeue (1368–1644) oor China regeer het. Sommige van hulle is uitgeplaas om op plase te werk. Hulle is deurgaans baie goed deur die plaaseienaars behandel en het deel van die families geword. Vier van hierdie Italianers het op ‘n groottante se plaas in die Rustenburg-distrik beland. Hulle was ui­ters hardwerkend. Ná die oorlog kon hulle terugkeer na Italië. Uit dankbaarheid het sy onder meer die kis as geskenk ontvang, asook ‘n ronde tafel met ses

stoele en ‘n “opsitbank”. Laasgenoem­de is ‘n S-vormige bankie waarop verliefdes kon kuier onder die wakende oog van ouers. Op hierdie bankie het die dame eenkant toe gekyk en die vryersklong anderkant toe! Die tante was getroud met ‘n tandarts uit Noorweë en was kinderloos. Haar suster se kleinkind (die groottante se naamgenoot) het die kis geërf. Jare later het die eienaar die res van die meubels toevallig by iemand plaaslik raakgeloop, wie se vermoënde familie dit aangekoop het en dit later na ‘n familielid in Engeland verskeep het. ‘n Stel kookpotte wat van egte silwer gemaak is, vang die oog. Hierdie kookpotte lyk meer na opskepbakke, so mooi is dit. Die potte is afkomstig uit Parys, Frankryk. Die silwer is met rooikoper oorgeblaas en die handvatsels is gemaak uit geelkoper. Hierdie stel is waarskynlik deel van ‘n spesifieke reeks, aangesien dit genommer is. Dit het saam met Europese familielede na Suid-Afrika gekom. ‘n Duitse wynfles het ‘n interessante storie: Die eienares het as klein dogtertjie in ‘n boom gesit en gesien hoe hulle bure oppak om te trek. Die bure was Duitsers wat van Duitsland via die ou Suidwes-Afrika na Suid-Afrika gekom en so ‘n entjie buite Rustenburg gebly het. Die sout-geglasuurde tipe keramiek is oorspronklik in die omgewing van Keulen in Duitsland gedurende die 16de en 17de eeu vervaardig. Tydens ‘n besoek aan ‘n museum in Duitsland is die familie ingelig dat die een op uitstalling die enigste oorblywende van sy soort is. Dit verskaf ‘n gevoel van genoegdoening wanneer skatte se stories afge­stof word en laat ‘n mens opnuut voel of jy êrens “behoort”.

The issue of land demarcation was contentious as Makhado again reiterated

that “all land was that of Ramabulana.” Historians like Nemudzhivhadi explain this by pointing out that the Vhavenda king does not own any land, as it belongs to his mahosi. The king rules over the various chiefs and as such “all” land belongs to him as representative of the people. Makhado, however, was very concerned about the encroachment on the area in the valley below the mountain: “Nu weet ik zelf niet want vroeger was het geheele land Ramapoelanie zijn, maar een ding is zeker, ik wil niet onderste veld nich verliezen.” (Now I don’t know, because earlier all land was Ramabulana’s. One thing I know is that I don’t want to lose the fields below.) Following this meeting, Joubert came under more pressure not to allow Makhado’s request that such a vast area be demarcated for the Vhavenda. In Boer circles it was felt that Makhado’s behaviour was sending the wrong signal to other indigenous groups and they feared a rebellion. Joubert’s compromise was to strengthen the Boer forces’ area by establishing movable steel forts. One of these was established at Muananzhele, on a farm called Boschkopjes. The fort was named after Joubert’s wife, Hendrina. During the Anglo Boer War period and a few years after, this fort was situated at the current Fort Edward and was also

called the same. The fort was later moved and today still stands next to the municipal library in Louis Trichardt. At the same time, however, Makhado had to deal with much more dissent from within his own ranks and some of the mahosi under Makhado asked Joubert for protection against the thovhele. Makhado, always an excellent strategist, realised that he was running out of options if he wanted to avoid a full-scale war. He used several delaying tactics, such as asking Albasini to first demarcate Tshivhase and Mphaphuli’s territories. Seeing that this article concerns Piet Joubert, we’ll have to jump past the events that occurred between 1887 and 1897. Several very important things happened during this period, including the death of Makhado in 1895, but we may touch on them in other articles. One event that cannot be omitted, is the visit of the Chief Native Commissioner from Matabeleland, Captain HJ Taylor, in 1889. This direct contact between the British and Makhado did not go down well with the Boer forces, who were growing more and more suspicious of the intentions of the British Empire. The subtle interference of the British continued during the reign of Mphephu. Perhaps to conclude the story of Piet Joubert, we should move to the last battle of the ZAR before the start of the Anglo Boer War, namely the war against Mphephu. This conflict was aptly described by the German missionary, R. Wessmann, when he said it was a short war that “to many Europeans has hitherto been a puzzle …” When an ageing Piet Joubert was asked to travel north to the Soutpansberg in September 1898 to deal with the matter, he was clearly not enthusiastic about the trip. He left Pretoria on 6 October 1898 and a day later he stopped over in Potgietersrus (Mokopane) where he was joined by 200 burghers from Standerton. eventually transpired that he had fled northwards, where he found refuge in the then Rhodesia. The British South African police met Mphephu and roughly 2 400 of his followers at the river on the border and stopped the Boer forces from pursuing them any further. Mphephu rather naively believed that the British forces would assist him in his fight against the Boer forces, but they (British) conveniently waited for it all to unfold from a safe distance. On 8 December, the commandant-general made his way back to Pretoria. During a banquet held in his honour, Joubert expressed the wish that a town be established at the foot of the Soutpansberg mountains. On 22 February 1899, the government published a proclamation stating that the new town would be called “Louis Trichardt”. Joubert was a very religious man and, prior to the battle against Mphephu, he conducted nightly sermons. The night before the battle he made a vow that a church would be built on the terrain where the main laager had been situated. It was eventually left to his wife, Drienie, to make good on this promise, as the Anglo Boer War and his own death denied him this opportunity. Drienie paid over 280 pounds to the Louis Trichardt congregation of the Nederduitse Hervormde of Gereformeerde Kerk. After her death, another thousand pounds were left for this purpose. The first, affordable church building was erected in 1906. The building of the bigger, more majestic church, designed by well-known architect Gerard Moer­dijk, was eventually opened in 1926. The first church building served as hall and also a school hostel later on, until a tornado demolished the building in December 1948. The town thus has a “living monument” to a rather remarkable, albeit often controversial, man. Up to his last battle, he seemed to have held out for as long as he could, believing that the good in men would eventually triumph. This is not always the case and in some cases battles are necessary, and of course, a general to lead. As far as the Milwaukee Journal’s claim that he was an American soldier is concerned – it is not only unlikely, but practically impossible. Is it a case of mistaken identity, or war propaganda? Perhaps the Milwaukee Journal should publish a retraction, albeit

Die wedvlug is gewen deur RWJ & Mike Coetzee van die Hangklip Posduifklub (HPK), nadat hul wenduif die afstand voltooi het met ‘n spoed van 1309.06 meter per minuut. Eerskomende naweek vlieg die onderskeie klubs in die Noord-streek vanaf Wolmaransstad oor ‘n afstand van sowat 600 km. Tans beklee Mieke en Mike Coetzee ‘n eerste plek op die streekkampioen punteleer met 761 punte. Nico Bezuidenhout is tweede met 754 punte, gevolg deur RWJ en Mike Coetzee in die derde plek met 732 punte.
