Assignment: National Consulting Firm to Undertake Review and Impact Assessment of NTMs in Lao PDR Reference No. CQS/TDF-2/A2.4 The Second Trade Development Facility (TDF-2) is a multi-donor program financed by Australia, the European Union, Germany, Ireland, USAID and the World Bank focusing on improving trade and private sector development in Lao PDR. The development objective of the TDF-2, which is implemented by the Ministry of Industry and Commerce, is to support the implementation of government’s trade and integration priorities outlined in the 2012 Diagnostic Trade Integration Study (DTIS) Roadmap, and in particular to contribute to improved competitiveness and diversification, focusing outside the natural resource sectors. As part of this initiative, DIMEX has conducted Impact Assessments for importing licensing measures/products such as Vehicle and Petroleum. The results has led to DIMEX eliminating licenses which were duplicates with other MOIC department, and streamlining overlapping back-office procedures. To continue implementation of NTM component. DIMEX has selected four key authorities to undertake Impact Assessments as following: (i) Department of Agriculture, Ministry of Agriculture and Forestry; (ii) Department of Livestock and Fisheries; (iii) Department of Food and Drug, Ministry of Health; and (iv) Department of Standard and Methodology, Mistry of Science and Technology. This objective of the assignment is to conduct Impact Assessments for NTMs/products selected by four regulatory authorities. This will include identifying the rationale, cost and benefit of NTMs, as well as their operational procedures in order to make recommendations on how to streamline or eliminate unnecessary requirements and / complexity. The above authorities will assign their respective officials to work closely with the National NTM Consultant., while DIMEX provides technical and financial assistance. The selected Consultant shall conduct this assignment and have experience in conducting similar assessment in Laos and neighboring countries. The estimated duration of this assignment is six 06 months, with an expected commencement date of November 2017. The Consultant may allocate as many resources as are deemed necessary to complete the assignment in the prescribed duration. It is expected that the Consultant will work alongside officials assigned by responsible authorities. The NIU now invites eligible consulting firms or institutions (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. For a qualifying firm, it is envisaged that the appointed firm will meet the following qualification requirements and experience: • Have at least 5 years of experience in providing consulting or advisory services to private companies or public authorities regarding regulation of trade or trade related services; • Experience conducting Time and Release studies in Cross Border Trade, with an emphasis on Time and Release studies in either Customs Administrations or International Trade an advantage; • Have good appreciation of the legal framework of Lao PDR especially with regard to trade related regulations; • Demonstrated experience of applying a methodological approach to market analysis or sectoral studies preferably through similar projects conducted in Lao PDR or in South East Asia; • Experience or knowledge of the regulatory trade landscape in Lao PDR’s major trading partners (e.g. Thailand, Vietnam, China).
