S

ummer is well under way. Seems to pass so quickly these days. I’d like to thank all of our members that have donated time and money so far for our new office. We are planning a couple of dates to do work over there, August 23 & 24 and then again September 6 & 7. If you can come help please call the office to let us know. I’d like everyone to welcome back District 2 in Colorado Springs! We have a group of folks that volunteered to be Officers to get that District up and running. Thanks to those that stepped up! As Stump has mentions in his article, we are in the process of contacting candidates to assemble our voter’s guide. Once again, I urge you to please get out and work campaigns. Help get biker friendly legislators elected. Not much news to report on the MOST Advisory Board yet. Recommendations from vendors were submitted to CDOT at the May meeting. Already 2 of the recommendations were passed over. We will probably hear that it was not enough time to implement or even research them. Well, we asked that the subsidy be allotted appropriately with more expensive classes versus less expensive classes. Actually, with our new MOST contracts, effective December 31, 2014, vendors (trainers) will no longer get the subsidy, it will be sent directly to the student. That is not an issue other than the fact they will look at hiring a company to accomplish this task. So how much is the student going to get reimbursed? Doubtful it will be the current $35 because a company will charge to render this service. The second recommendation was that all classes receive the subsidy, not just licensing classes. Contracts are still the same as they were last year. We all know the intent of CDOT is to do away with the subsidy entirely. Personal note, that’s fine, but I am not going to pay the additional fee for you to run a motorcycle safety program. Find the money elsewhere. OK off that soap box. On to another soapbox. I’d like to address some issues we have had within some of our Districts without naming them. We all need to quit acting like children! We joined this organization to further the mission of ABATE….a reminder

“ABATE of Colorado exists to preserve freedom of the road, to unite motorcyclists, to promote fair legislation, safety, and rider education and to provide a network for communication on issues affecting motorcyclists.” I don’t see the words “I have to like you”, I don’t like the way you did that”, “but we’ve always done”, “why did you call it that”, “why did you do it that way”. Do you?? Everyone accomplishes things in a different manner; does it make it right or wrong? As long as the results are positive and no Bylaw was broken, it’s not wrong….who cares??? I am really tired of grown adults being so petty. I have always said, I do not have to like you, I don’t have to party with you, but I do have to spend some amount of time with you in order to further our mission and goals. We have lost members and District Officers because of petty personality issues. And after reading this, we may lose some more. When you have folks in a District that choose not to support an event of their own District, it’s pretty sad. Then you have members that do not attend meetings, but represent to others that their District is behind an effort. It and the active attending members have no clue what is going on. This is not about Terry’s agenda or the Secretary’s agenda….nor anyone else’s.

IT IS ABATE’S AGENDA!!! Stop acting like children, put your differences away and be an active member.

“A house divided against itself cannot stand.” Abraham Lincoln

We have several events going on this month. Get out and enjoy them while supporting ABATE. Ride safe until next time…. Terry Howard

Attractive Nuisance Doctrine Regarding Children’s Injuries Clarified Earlier this year, the Colorado Supreme Court clarified the attractive nuisance doctrine as it relates to children receiving compensation for injuries caused by negligence. The attractive nuisance doctrine is the concept that children cannot be expected to exercise the same judgment as adults when something looks fun but may be dangerous. The case involved a young boy who was seriously injured when the giant inflatable structure he was playing on was carried up into the air by a gust of wind. The trial court dismissed the parents’ case on summary judgment finding that the attractive nuisance doctrine only applied if the child is a trespasser. The Court of Appeals upheld the decision of the trial court. The Colorado Supreme Court reversed and found that whether a child is a trespasser or an invited guest is irrelevant. It held that the attractive nuisance doctrine does not depend upon the child’s legal status under the premises liability statute. It reiterated the central concept that the attractive nuisance doctrine involves the idea that children, due to their youth and impulsive behavior, are instinctively drawn to certain things and are more prone to placing themselves in danger. All of us who have children know this to be the case. The clarification in the law is intended to improve the safety and welfare of children in our state. What this means to homeowners is that things or conditions on your property that may attract children, such as a large pile of dirt or rocks you plan to use for a landscaping project, an inflatable pool, a trampoline, all may subject you to liability for injuries to children if you do not take reasonable measures to safeguard your property. Angela McGraw is an attorney at Fleishman & Shapiro P.C. She represents people who have been injured by negligence and can be reached at 303-861-1000 or amcgraw@colorado-law.net. How to increase your chances of getting your photos published in the ABATE Spokesman and maybe even on the cover.

AND Guidelines for submitting photos for publication in the ABATE Spokesman Remember that space in the Spoke is very limited, especially in the summer months. Printing is very expensive, therefore we add pages only when absolutely necessary. •

Send high quality photos, otherwise they cannot be enlarged or printed. Although they may look fine on your computer screen, print requires high quality photos.

Don’t send lots of pictures of the same people – Choose your best or photos and send those.

Make it interesting - Who likes to look at people sitting around at a meeting? I don’t know of a single person who would tell you their favorite photo would be a bunch of people sitting around at a meeting.

Don’t send 30, 40, 50 pictures. First of all, if they are sent in a single email, they are very low quality. Second, that is way too many to look through. Choose 4-6 of those that are most important and make sure they are good shots and high quality photos. Send those.

Descriptions are good, but caption only significant or “key” photos. If you want to include descriptions, put them all in a Word document, i.e. photo 123 – At this place with these people at this event

Most improtantly, Remember is to “make it interesting” If the information is imbedded in numerous emails from various sources, it is easily missed and won’t get published. What kinds of pictures draw you in when you are looking through any book or publication?

NORTHEAST

REGIONAL REPORT “Freedom Isn’t Free!!” We have all heard or seen this at one time or another. A bit of information from Wikipedia: “Freedom Is Not Free” was first coined by retired U.S. Air Force Colonel, Walter Hitchcock, of New Mexico Military Institute. The idiom expresses gratitude for the service of members of the military, implicitly stating that the freedoms enjoyed by many citizens in many democracies are only possible through the risks taken and sacrifices made by those in the military, drafted or not. The saying is often used to convey respect specifically to those who gave their lives in defense of freedom. “Freedom Is Not Free” is engraved into one wall at the Korean War Veterans Memorial, Washington, D.C..

While this generally refers to thanking those in the military, freedom at all levels comes with a price. For instance, one of the rights and freedoms we all enjoy is the right to keep and bear arms. How many times have we seen efforts to limit or do away with that freedom? What about the food we eat, the drinks we consume, the health insurance we are forced to buy, the equipment we have to wear while riding a motorcycle in certain states, and many other examples?

Issue # 08-14

August 2014

Our freedoms are under assault in this country on a daily basis and we each have a responsibility to do our part to help preserve them. There are many freedom based organizations available to belong to such as NRA, RMGO, ABATE of CO, the MRF, and others. How are you working to preserve your freedoms? Do you belong to organizations that believe as you do? Do you vote? Do you encourage others to belong or to vote? Do you support the causes you believe in financially? Or, are you a member of our military, the ultimate preservation of freedom? If you are not doing anything, how can you say you are working to preserve your freedoms? For those of you reading this article, I am guessing that it is pretty much a given that you do work to preserve the valuable freedoms we all enjoy if no other way than being an ABATE of Colorado member. Thank you for that. For those that really don’t work to protect their freedoms, we need to keep encouraging them to belong, particularly as motorcyclists, to ABATE of CO and the MRF. One thing that ABATE of CO has an immediate need for is to reduce expenses at the State Office. Our rent has gone higher and, with a very tight budget, the ABATE state board has decided to pursue moving the office to a building that Larry Montgomery has graciously offered to let us use. The primary expenses we will have is preparing the building and grounds to be occupied and getting the utilities hooked up. Habitat for ABATE is a way that each one of us can contribute to this project. Cash donations work well but so do donations of time, effort and material. Information will be coming out soon to let you know how to participate in this project. Get involved! As Americans and motorcyclists, we have much to be thankful for. There are so many things we take for granted. Please take a look at what you can do to be involved in the cause of freedom. Be safe! Don Enninga Assistant State and NE Regional Coordinator

We will always remember. We will always be proud. We will always be prepared, So we will always be free. Ronald Reagan 16 www.abateofcolo.org

Terry, Deb, and I have been working on a voter’s guide. (Thanks to Terry & Deb for their help – actually for doing most of the work!) We finalized a questionnaire and so far have sent out 130 (e-mail & “snail” mail). There are still 36 candidates for whom we could not find an address. Note the names listed above with a question mark after their names. These are the candidates we didn’t have any contact information on. Maybe these candidates are a personal friend or relative, or even a friend of a friend, and you can supply an address so we can mail them a questionnaire. If so, please contact the State Office asap.

We’ll tally up the replies from the questionnaires and publish a “Voter’s Guide” in our Spokesman. We’ll also ask for volunteers to help work campaigns of “BikerFriendly Candidates” once we get the replies from our questionnaire. I’ll try to keep all ABATE members up to date on these candidates and the “HOT” races through updates to our LegTeam members (District Reps & LAOs) so if you have any questions, you can contact them or me. Hey Everyone,

There still is not much activity in D.C. regarding the 5 bills we are watching pertaining to motorcycles. We need to keep contacting our legislators and encourage them to sign on to the bills. As far as states go, Indiana and Washington have passed red light bills. Delaware has passed a bill regarding black boxes. Missouri can’t get a helmet modification bill passed but they did get a bill passed allowing sales of bikes on Sunday. If you happen to be going to Australia, New South Wales just passed a lane splitting bill. If you have been following the local news at all, the Center For Disease Control (CDC), who considers motorcyclists a disease, have had breaches in their security systems that have allowed some of the germs that they study to escape and endanger some of their researchers. At least the germs aren’t major--Swine Flu and Anthrax!!!!! Maybe they should concentrate on their own work and leave us bikers alone. Enjoy the rest of the summer out on our highways and byways. If you get a hankering’, the MRF’s Meeting OF The Minds is in September (25--28) in Kansas City, MO. Come and join us, and tell you friends and neighbors to support and join the MRF.

D10 had a great 500-mile ride through the mountains of Colorado on July 12th. Thank you to those who helped & rode.

Well, greetings again folks: We all know that as an organization, ABATE is always about freedom of choice and freedom of movement in our great country, not stoppage of passage. So, with that in mind, I have decided to write out our ABATE Mission Statement as a reminder of our purpose: ABATE of Colorado exists to preserve Freedom of the Road to unite motorcyclists, to promote fair legislation, safety, and rider education and to provide a network for communication issues affecting motorcyclists. Now, as a reminder, officer nominations are needed for District 5 (and all districts for that matter) to set up statewide elections at our September SBOD meeting. We are also needing to fill the Metro Rep position, and we can use the help. You are more than welcome to make a nomination by writing, calling, emailing, texting, or even attending the meeting on the the second Thursday of August, which would be August 14th, at 7:30pm for the meeting, earlier for food & drinks at Mickey’s Top Sirloin on Broadway at 70th. Now, the next item:

The Colorado Spokesman

ABATE of Colorado - www.abateofcolo.org

It has been decided that as an organization, we will have a presence at the September Colorado Motorcycle Expo with an ABATE Booth. And, since that is also the September ABATE SBOD Meeting, we will need help manning the booth on Saturday. Since this will be a 3 day show, concentrating mostly on NEW motorcycles, manufacturers and dealers, and designed to have a Family Atmosphere, it should be an easy watch. Mostly all you need to do is look pretty (?!?) and maybe answer a question or two, give out some Rider Ed materials or sell some goodies. AND, since I brought up the goodies, ABATE now has in stock our newly revised ABATE of CO membership patch with the updated eagle, AND we have ABATE Rider Bells for the Bikes. I will have the patch and the bell to peruse and take orders for at the next D-5 meeting Now, as I wrap this up, remember to tell your elected officials to “Let Those who Ride Decide”, working to maintain our Freedom of choice, that was once so prevalent in our land. And if you are still with me, how about bringing a friend or even an enemy into the membership of ABATE of Colorado? If we all sought to bring in one new member, we could probably double our numbers. And that could be a huge help in the future... Well, I think that this would be about enough for this session. Now REMEMBER: ALWAYS - be careful when yer out playing in traffic... Best, Rev. G.

ABATE is putting on a major push to get a house fixed up in Aurora so the state office can be moved there. If you are so inclined to give your organization a helping hand, whether it be physically (manual labor), as an organizer, or throwing a few extra bucks the state’s way, or helping find and haul supplies, it will all be appreciated. This job needs to get done a.s.a.p. so call the state office to see how you can help--and thanks!!! Do your best to support our districts as they have their events.

Jerry “Mac” McFarland District Representative PO Box 5661 Frisco, CO 80443-5661 970.418.0341 JerryMcfarland@Centura.org

I recently returned from a long motorcycle ride. It took me through Colorado Utah, Nevada, California, and Arizona with Denny Parkinson and Greg McFadden, two of my D-14 brothers, (best dudes ever) by my side. Denny and I were on a mission to deliver Greg and his new Road King from Oceanside, CA safely back to Summit County. We experienced some awesome country. We rode mountain passes, river canyons, the dessert, and the L.A. freeways!!!! Man, we rode it all! From the “Loneliest “ highway in America, US 50 to the 101 in Ventura, CA (not a big fan of lane splitting, perhaps you get used to it), we blasted three 3 abreast 22 www.abateofcolo.org

through the scorching 120 degree dessert on I-10, a breast, phat grins on each of us. SAG wagon While we rode hard, we loved every minute. The downtime was just as good; camping, staying with friends and family and a couple of motels along the way. We were treated like rock stars. We felt like it anyway. Shout out , When in Ouray, CO you have to stop by the biker friendly Antlers Motel. Say Hi to Bruce McFarland the Inn Keeper. Tell him District 14 “sent ya”. He could hook you up with the Marilyn Monroe suite. He did for us. Along the way we built some lifelong bonds. Don’t get me wrong; there were points in the trip where all confidence was lost. Heck, Denny wound up with a bloody nose in Bishop, CA the night he became “One with the Ball”. The restoration of confidence, that’s what’s cool. It comes back stronger brother. Kirstie Taylor our secretary, she wanted to be on the bike as bad as Greg, maybe more. Bless her heart. She had to drive the SAG wagon with two teenage girls that quickly grew tired of our antics, men acting like boys outside the air conditioned cab of the SAG. Kirstie was a big part of trip as well, double, triple, quadruple dolphin! Who does that? Yeah. We did it. The teenagers, Mystic and her friend Amber ☺ were very patient with us. I personally had the honor of delivering Greg’s Road King to Murphy’s. In a word, the trip was “Perfect!” This ride stirred my passion, my passion to ride. So much so, that I thought I’d share it with you here, in the Spokesman. Much of this

may or may not make any sense to you (probably not) ……….You didn’t think I was gonna share everything did you? Upon my return, I took all 3 of our bikes, Suzanne’s dusty sportster (she’s pissed), the V-ROD and my King, and traded them for a 2014 Ultra. Yup, cause that’s what I like to do, I like to ride and I’m going to do it more. Thank you my Brothers and Sisters of ABATE of Colorado and all states, as well as the MRF for proactively helping protect my passion; riding motorcycles. I’m getting excited for our D-14 poker run next week. We have a great route planned and right now as I write this, the weather looks clear. I hope the Bruiser’s ready. I’ll be writing about it next, in the, not so consistent, “D-14 Newsletter” If you have any ideas or content you’d like me to share in this forum, just ask, I’d be happy to include it. Let’s Ride, Jerry “Mac” McFarland, District 14 Rep

Hello D-16,

Hey D-17

Thanks to the 5 members who attended our July D-16 Meeting. Weather and other obligations kept us from having our usual 10 – 12 members at our meeting, so I’ll quickly summarize what was discussed. D-16 Poker Run results: 24 attended; everyone got a door prize; we made a profit of $216.

I hope you all are having a great and enjoyable summer. Riding season is in full swing and the weather is starting to warm up and dry out nicely.

BOTW Summary: 100 attendees from 24 different states; Keynote Speaker – Rep. Lori Saine; MRF announced this was their last Regional Conference. Moving the Office – see the flyer in the Spokesman. (Supplies, labor, and cash donations needed. Date TBD). Upcoming events:

I believe learning is a life long pursuit, hopefully you think so too. Maybe the level of intensity drops as we mature, but, we should remain teachable through out our entire life. There have been times when I was sure I knew what to do. Then some circumstance or person would show me otherwise and I would have to rethink my options. My point is all of us have made decisions based on insufficient or inaccurate information. My intension is to encourage each and every one who reads

this to ask yourself “Am I the best rider I can be”? I know in all honesty that I am not and at this point in my life my skill will continue to decline. So, I need to make a concerted effort to keep myself in good physical and mental condition. I can also enroll in one of the rider ed courses so I have someone to point out the bad habits I have acquired and teach me to be a better rider. I have heard that Don Gunn’s Mountain Riding course should be available this summer. So do yourself a huge favor and invest some time and money on a tuneup of your riding skills. Myself and everyone I know that has participated in any continuing motorcycle rider training will tell you it was very beneficial. Well, I hope to see you all at the next District meeting, third Tuesday; 7:30 at the Shack; Mineral & Broadway. Please, do not let your membership lapse, we need all of us. Until then, Ride Well, Mike

Sun. 8/10 – D17’s Dart Poker Run; Fri. 8/15 to Sun. 8/17 – D-1’s Rally on the Plains; Sat. 8/23 – MRA BBQ in Byers. Not much else to report. Next meeting, Sun. August 10th, 9:00 a.m. at the Bear Creek Restaurant in Kittredge. Hope to see you there. Try it – you just might have some fun!!! Stump
