2015: No Crystal Ball Necessary “There are two kinds of forecasters: those who don’t know, and those who don’t know they don’t know.” — J.K. Galbraith A new year and a new economic outlook are upon us. Well, at least one of those items is true. While it is in fact 2015, the economy and its impact on the debt and equity markets will remain very much in line with 2013 and 2014. As the owners and operators of rental housing, this will have a favorable impact on our portfolios, regardless of the size or location. For those contemplating change, consider this your third chance to get it right. And while your decision to act or not to act will be dependent on your own goals, desire and timing, please allow me to repeat myself from years past: there has never been a better time than now. Maybe you have an idea of what you would like to do to see improvement in the financial returns generated by your real estate holdings, but you are not sure where to start. Follow these three simple steps to help make 2015 the year you kick your portfolio’s performance into overdrive. Raise Rents By now, you understand the relationship between a property’s gross income and the property’s market value based on a GRM. You are also likely familiar with the relationship between the net income and the property’s capitalization rate. Do your part in 4 1-15 Apt News.indd 4

maintaining your property’s value by staying abreast of rental activity in your property’s neighborhood and sub-market and set your rent rates realistically and competitively so that you will maximize your income and minimize your vacancy loss. By doing so, you will help to increase the gross revenue and also the net income that are used to help assign a market value to your properties. And if there is a significant gap between your current rents and the market, now is the time to facilitate the increase. Recent data published by MPF Research indicates that Orange County’s market occupancy rate is strong at 97%, revealing a mere 3% vacancy rate for the market. With rent growth for the fourth quarter of 2014 at 2.5%, OC achieved a nine year high. Today, renters are faced with limited inventory and rising prices. As an owner and as an investor, this is highly to your benefit. Re-invest In Your Portfolio With the new year, consider it a best practice to bid out or obtain updated cost estimates on the more significant repairs necessary across your portfolio. In doing so, you will be able to budget, plan and schedule the work accordingly so as to minimally impact your residents, your staff and your bottom line. Specifically, items like re-roofing, wood repair, asphalt and paving are better suited for historically dry months whereas a copper re-pipe

or other interior focused work can be completed at any time. If the season is not a concern to you, you may be able to obtain a more competitive cost from your vendors as they will most likely have downtime and an employee base to keep busy. Do not underestimate the importance of capital improvements as they pertain to your property’s value. Some of these perceivably small-ticket items can have a big-ticket impact not just on your curb appeal and the resident experience, but your property’s value as well. Although your rental rates are sub-market and property specific, let’s look take a look at some of the capital improvements to consider instituting on the inside of your apartment homes that can help to ensure your rental income and occupancy are optimized regardless of your property’s location. Most of the apartment complexes in Orange County were built between the early 1960’s and early 1980’s, so things like: popcorn ceiling removal, accent walls and two-tone paint, hard surface flooring with a faux wood appearance, updated façade treatments on true wood cabinetry, conversion of bathtub only units into shower/tub units, energy efficient appliances, dual-paned glass windows and countertop treatments on the high-end of granite slab or tile and on the low-end of dressing up a Formica countertop with a new glaze are just some of the ways you can President — continued on page 6 J A N U A R Y

For those who have avoided these repairs until now, to stay competitive with today’s renters you need to reinvest in the interiors of your apartment homes. Financing and You Whether you are looking to improve cash flow by decreasing your debt service, tap into your equity to acquire additional assets or just access your equity in order to fund capital expenditures or your lifestyle, the debt market is as attractive as it has ever been. For those of us who refinanced in 08–09 with a five year pre-pay, that time period is nearing an end. You might recall the rate you previously locked in was in the 5.8%–6.75% range.

Well, now it is in the 3.79%–4.2% range. That differential will have a significant impact on your cash flow. Try a direct lender first and if you need a bit more help or a more customized product, then try a broker. Depending on how active you are in managing your assets, you may not be aware of the growth in equity across your portfolio. It could be quite possible to comfortably re-leverage your existing debt and acquire additional assets, effectively increasing your cash flow while growing your portfolio. And while we are unsure as to how the Fed will respond to economic activity and trends, we basically know that rates are expected to remain flat until mid-2015, when we will likely see an increase. Of course, the size of the increase and its impact on borrowing and the economy are speculative at best. Look for retail statistics and job growth data to underwhelm the experts and push

T

he concluding comment in last month’s article noted that 2014 lobbying activities in behalf of rental property owners and managers included more than watching the Legislature in action. Indeed, it is increasingly clear to anyone paying any attention at all to public discourse that governmental regulatory activity has a profound effect on the everyday lives of millions of California residents. The following comments pertain to a few items of special interest and some reminders of things that need to be done pursuant to prior legislation if not already accomplished Water Conservation On July 15th the State Water Resources Board adopted an emergency

regulation restricting water use for outside areas. Those regulations prohibit the use of outside potable water in a manner that results in runoff water on sidewalks, driveways, roadways and adjacent property. It also prohibits runoff from washing vehicles with a hose unless the hose is fitted with a shut-off nozzle, watering driveways and sidewalks, and using water in decorative fountains unless it has a recirculation feature. Violation of the regulations constitutes an infraction and may result in a fine up to $500 for each day the violation occurs. Many local water service agencies have adopted even more stringent rules relating to conserving water use. Property owners and managers are advised to review rental and lease

agreements to assure that tenants, guests and invitees: 1) comply with the state and any local regulation and; 2) are solely responsible to pay all fees and fines associated with violation of the regulations. Proposed Proposition 65 Reform Efforts Since 2013, the State has been trying to change the Proposition 65 (Prop. 65) hazardous chemical warning sign requirements. Last year, the Office of Environmental Health Hazard Assessment (OEHHA) attempted to make sweeping changes both in regulation and law. The business community impacted by the new changes formed a coalition to oppose the measures, and successfully defeated them. Your lobbying

team was part of that coalition. Earlier this last year, OEHHA renewed its attempt to make changes. Again, there was near unanimous opposition by the business community to the changes. Since then, the business coalition, led by the California Chamber of Commerce, has been in conversation with OEHHA on how to improve Prop. 65 without unnecessary burden and expense to businesses. Your lobbying team has been a vocal and active participant in the coalition and throughout the process. Discussions are ongoing, Proposed New Pool Safety Regulations New swimming pool safety and maintenance regulations will be going into effect January 1, 2015. The regulations apply to public pools, including those in apartments, condominiums, and homeowner associations. Exempted are private pools, defined as pools intended for use by occupants of not more than three residential units. Your lobbying team has been opposing the new regulations since they were first proposed last year. Although some favorable changes were made to the original proposal, the new regulations slated for approval are numerous and likely to be burdensome for some. New requirements include but are not limited to the following: •

Daily testing of disinfectant residual and pH, when pool is open for use.

Daily testing of water temperature in heated pools.

Properly calibrated automatic chemical monitoring and control systems may be used.

Keep all records at the pool site for at least two years.

Smock — continued from page 11 manage their pest problems. Some, however, take measures into their own hands by purchasing certain effective over-the-counter pesticides. For those “self-helpers,” a new regulation went into effect this past July which restricts the use of Second Generation Anticoagulant Rodenticides (SGARs), a popular and effective pesticide. SGARs are used to address rodent problems. They are strategically placed around a property, and later eaten by rodents. SGARs deliver a delayed lethal dose to the target rodent with the first feeding that does not kill the rodent immediately. When the rodent does eventually die, the SGAR poison remains in the rodent’s body. Nontarget wildlife, like birds or other land animals, then come into contact with this infected rodent by touching it or eating it. These animals eventually also die. The Department of Pesticide

Regulation (DPR) conducted an assessment of SGARs to evaluate of the potential and actual risk of SGARs on California’s wildlife. It concluded that the current use of SGARs presents a hazard related to persistent residues in target animals resulting in impacts to non-target wildlife. For these reasons, DPR has decided to restrict the use of SGARs permanently. Effective, July 1, 2014, SGARs can only be sold by licensed dealers and purchased by certified applicators. Restricting the sale of SGARs to certified applicators is expected to significantly mitigate exposure to, and protect, California’s non-target wildlife. Smoke Detectors Smoke detectors are to be installed in each bedroom on or before January 1, 2016. When installing the detectors before this date, the landlord or manager should:

smoke detectors in each bedroom and the type of detectors (AC vs. battery powered). Where devices exist, note its existence, the manufacturer, and the location of each detector in the rental unit file. For units without detectors in each bedroom, decide when compliance with the new law will be undertaken (must be before January 1, 2016), and note it in the rental unit file. b) Install the detectors on a specified schedule and note that schedule in the file of each rental unit. In the file, also note the date the detector was installed, location in the dwelling, and the serial number. c) All existing devices must be operable and located in compliance with the new state law at the time of a new hiring and when installing new devices.

Smock — continued from page 12 d) New smoke alarms purchased must comply with the new law and be approved by the State Fire Marshal in order for the alarms to be sold in the state. The new devices must be tamper proof, and contain both a hush button feature and a 10-year battery life (AC powered smoke detectors and operable battery devices are not required to be replaced). Keep in mind the following: 1) Smoke alarms connected to a panel or connected to a wireless communication signal are exempt from the new law; 2) the law does not apply to installing or replacing smoke detectors in common stairwells; and 3) because certain cities have adopted more restrictive smoke detector ordinances, landlords and managers are advised to comply with both these new requirements and local laws.

Carbon Monoxide Detectors (CO Device) Every owner of a “dwelling unit intended for human occupancy” must install an approved CO device in each existing dwelling unit having a fossil fuel burning heater or appliance, fireplace, or an attached garage. Qualifying units must have at least one CO device per floor, and if there are bedrooms on the floor, the CO device must be placed adjacent to the bedrooms. Also, you may follow the manufacturers instructions that come with each device. Singlefamily dwelling units were required to be incompliance on or before July 1, 2011. All other existing dwelling units were required to be incompliance on or before Jan. 1, 2013. Plumbing Fixture Mandate On or before January 1, 2017, all noncompliant plumbing fixtures in any single-family residential real property built prior to 1994 must be replaced with water-conserving plumbing fixtures.

For multifamily residential real property built prior to 1994, all noncompliant plumbing fixtures must be replaced with water-conserving plumbing fixtures on or before January 1, 2019. Water conserving plumbing fixtures includes 1.28-gallon toilets and 2.2-gallon-perminute faucets and showerheads. Installation may be more difficult than expected. Replacing a faucet may involve replacing water supply lines and angle stops. Replacing a toilet may include replacing flooring because the toilet footprint may not match the old footprint. When purchasing a new faucet, ensure that the faucet matches the cover and openings in the sink. Absolutely not. This is a pretty common scam that would enable this person to drain your bank account. Never provide personal information, including banking information, to a stranger over the internet. Rather, stick to your original request; get a completed application, a ‘certified’ copy of his passport, and an international money order to pay for the credit screening. Certified copies of passports are available through the local embassies. I just closed escrow on a four-unit apartment building. All of the tenants are longterm residents, the most recent moved in about six years ago. They are all monthto-month tenancies and the property is not in a rent controlled jurisdiction. The rents are pretty close to market rents, but the security deposits are minimal, ranging from $250 to $300 per unit. I’d like to keep all of the residents, they all are well qualified and seem to be taking care of the place. Can I increase the security deposits? And if so, how do I do it?

ing the additional security deposit to be paid. Keep in mind the two-month limitation for unfurnished units, three months if furnished. You may require an extra half month if the resident has a waterbed. You may wish to reconsider though. Considering your residents are long-term quality tenants, having been there six years or more, you may want to raise the rent a bit, rather than requiring payment of additional security deposit. The increased rent is yours to keep, but the increased security deposit is just yours to hold for the residents benefit. Residents will typically prefer a $25 or a $50 monthly rent increase, as opposed to an increase in security deposit of $500 or more. Remember rents and security deposits are inversely proportional. With all else being equal, if you require low security deposits, you can typically demand slightly over market rent. Conversely, higher than market security deposits will limit your tenant pool and will lead to lower than market rent. As a general rule, for existing residents, usually better to raise rents than raise security deposits.

She spared me the details, but she sounded afraid of him. The neighbors told me some stories about the guy, sounds like we’re all better off if he isn’t around. She asked if she could change the locks and not let him in. I’m not sure what to do, if he’s locked out, won’t he just come to me and ask for a key? What do I tell her? What do I tell him if he asks for a key?

The one-year lease agreement provides each of the three occupants the right to occupy and use the premises for the entire term of the lease, or until terminated. No one tenant has greater rights than any other. Any action, absent a court order, by one or both of the girls to deny the third roommate entry would be improper and would be actionable. If the remaining two roommates are truly afraid of the third, and have sufficient evidence to convince a court, they should immediately seek a restraining order barring him from coming near the townhouse. The restraining order, if done properly, will bar him from returning to the Premises, and will allow you to refuse to provide him with a key to the changed locks. Make sure that you are provided a copy of the signed and entered restraining order for your records. Look to ensure that the box requiring him to “stay away” from the Premises, and not just the other two roommates, is checked. Have your attorney review the Order if you are not sure. He will, however, still be contractually obligated to perform the obligations, but the restraining order will prevent him from living in or visiting the unit. The 114th Congress: What Lies Ahead?

B

y the time you read this, all of the midterm elections will have been decided and the playing field will be set for the 114th Congress. When members return in January, the GOP will be in firm control of both the House and Senate. Last month I looked back at some of the key factors that contributed to the Republican victory. Now it’s time to look forward to what the new management in Congress could mean for the apartment industry in 2015 and 2016. While party control did not change in the House of Representatives, there is one big change to highlight. Rep. Paul Ryan (R-Wis.) leaves his current post as Chairman of the Budget Committee to take the helm of the Ways and Means Committee, a post he has long sought.

He succeeds retiring Rep. Dave Camp (R-Mich.) who led the Committee for the past four years. A wonk’s politician, Mr. Ryan enjoys diving deep into complicated policy subjects and has signaled that he would like to slay the dragon that is tax reform during his tenure. That is a steep hill to climb anytime, but could be especially challenging in a presidential election cycle. On tax reform, outgoing Chairman Camp was not afraid to take on established constituencies in the tax code which was reflected in the bold reform proposal he released in 2013. As previously discussed in this column, that proposal had both positive and negative elements for real estate and almost every other sector of the economy. As a result, it proceeded no further and

was not even considered in Committee. What the draft did do, however, is lay on the table a number of proposals for raising revenue that remain as options for future tax reform deliberations. It’s difficult to tell at this point if Mr. Ryan will want to be as aggressive as his predecessor, but we do know that he too is unafraid of taking on the tough issues (see his budget reform proposal from 2012). Entitlement reform is also a priority for him, so it will be interesting to see if he tries to work in some of those elements as well. On the Senate side a familiar face returns to the throne of the Banking Committee. Sen. Richard Shelby (R-Ala.) is Chairman once again after Federal Focus — continued on page 22

Federal Focus — continued from page 20 a hiatus for several years. Importantly for apartment industry concerns, Mr. Shelby is a veteran of the GSE wars of a decade ago. That reform effort was unsuccessful and made essentially moot in 2008 when both enterprises were placed in conservatorship by the federal government. Still, reform remains a priority for many in Congress not only to address Fannie Mae and Freddie Mac, but also the future role overall of the federal government in the housing finance system. Mr. Shelby’s opposite on the House Financial Services Committee, Rep. Jeb Hensarling (R-Texas), is committed to a total wind-down of the entities and an exit for the federal government from the housing market. You will recall that his bill to achieve that end, the Protecting American Taxpayers and Homeowners (or PATH) Act, made it out of committee but generated so much concern that it stalled and never

received a vote of the full House. While Mr. Shelby was a strong critic of the GSEs during previous reform deliberations, it’s uncertain if he is in the same place as Mr. Hensarling on eliminating the federal role in housing finance altogether. Regardless, with Republicans leading both committees of jurisdiction on this issue, the negotiating dynamic will be much different than in the current Congress. Finally, there is a change in leadership on the Senate Environment and Public Works or EPW Committee. This is significant in light of the many environmental proposals coming out of the Administration, specifically from the Environmental Protection Agency (EPA). Senator Jim Inhofe (R-Okla.) will take over from Senator Barbara Boxer (D-Calif.) a staunch environmental advocate. To say Mr. Inhofe is skeptical of environmental regulation is an understatement. It’s safe to say that EPA representatives should plan to spend a lot of time in front of the EPW Com-

mittee to answer questions about proposed regulations in a whole host of areas. To the extent those proposals add to the regulatory burden of the apartment industry, the bright light of hearings could be impactful. Lest we forget, despite the changes above, the President still holds the veto pen and has an entire federal bureaucracy at his disposal. As evidenced by his recent actions on immigration, he will use that power to move policy on his own if he does not view Congress as a willing partner. Apartment industry advocacy could turn more sharply towards regulations than in the past. Time will tell on that score and on how more willing the President is to negotiate with Republicans in Congress. I close with an opportunity for your input. ear Maintenance Men: I have just received a code enforcement violation letter for some problems I was not aware of at my building. I typically keep my property in good order, but a few maintenance items may have slipped by. The violation letter has me very upset, as the problems mentioned are minor. How do I make this all go away? What do I do first? Bill

Dear Bill: It is always a bit upsetting to have someone else tell you what to do with your property. The first thing to understand about a code violation letter is that it is not a personal attack. Look at the violation letter as an opportunity. The city is giving you a heads up to potential problems at your building. You may have a drug or gang issue you were not aware of or landscaping

issues, or even deferred maintenance issues. Essentially, it is a wakeup call to pay closer attention to your building and neighborhood. The first thing to do when you get a code enforcement violation letter is to call the city and speak to the code enforcement department. Make the call with an open mind and calmly get the facts. The purpose of the call is to let the code enforcement department

know you are aware of the situation; you are cooperative and willing to resolve the issue. Keeping the lines of communication open with the city is essential to solving your current issue. Should you need more time to compete the corrections, contact the officer in charge of your case and ask for an extension. The violation will not go away if you ignore it! Take before and after pictures of the repairs or issues. Upon correction of the violations, call the code enforcement department and let them know the work is complete. The faster they sign off on the violation letter the better.

When requesting a bid from a roofing contractor, always ask for a cost to repair the existing roof and a cost to replace the roof. When having multiple bids, always use the same scope of work for each roofer. A deviation in scope will make it harder to determine which

Dear Ed: Determining if a roof actually needs replacement or should be repaired is sometimes more of an art than a science. An old roof in good condition that has roof leaks may be as simple to solve as an inspection of the roof flashing system. The roof flashing is where the roof meets a different material or changes course. For example roof flashing is found around the chimney, in valleys, where the roof transitions to vertical a wall or around vent pipes. Any roof transition area is a potential roof leak. Keeping the roof flashings in good order is the first line of defense. However, should your roof be experiencing leaks in several different areas, missing granules (bald spots) and pooling; might be an indication of a roof past its prime and ready for replacement. In the case of a shingle roof, the telltale signs are more obvious. For example a shingle roof may exhibit curling edges, loss of granules and material brittleness. This roof may be beyond repairs and should be replaced. Tile roofs may present different issues as they may look great on the outside,

Maintenance — continued from page 25 Dear Bill: A number of things may be at work here. Unit overcrowding is generally the main reason for moisture and mildew build-up in an apartment unit. Because of the overcrowding, the residents, take more showers and baths, throughout the day and evening. Often to hide the excess people in the unit, the resident will keep all the window covers closed and the widows shut, effectively keeping

the moisture from escaping. Add a windowless bathroom into the mix and the problem is compounded. Mechanically, we suggest you inspect the vent fans in the bathrooms. Make sure they are not clogged with lint or dust. If the fan is operating properly, check the CFM or Cubic Feet per minute of air movement. The minimum number should be 50 CFM. If the bathroom is getting more than the average amount of use, you may want to replace the existing fan with one that

has a higher CFM rating. We recommend using at least a 120-CFM fan. Equally important, many bathrooms have two wall switches; one for the light and the other for the fan. If this is the case, we recommend combining the two switches into one. That way when the resident switches on the light the fan will come on automatically. t can be hard to believe that it has been almost 5 years since the EPA’s Renovation Repair and Painting (RRP) rule took effect. This regulation took effect in April of 2010 requiring all contractors, maintenance workers, painters, carpenters, plumbers, landlords or anyone who disturbs paint in a home, apartment, condo or child occupied facility built before 1978 to become “EPA Certified” and use lead safe work practices while conducting work that disturbs interior and/or

exterior paint. As one of the very first training providers accredited by the EPA to teach the RRP course, National Econ Corporation (NEC) has taught over 16,000 RRP students nationwide to include the U.S. Territory of Guam in the western pacific. One interesting and, I might add, unexpected advantage to having taught so many students was the opportunity to see, meet, and hear a wide variety of students in every field and trade imaginable from California to New Jersey and beyond. Our students

are painters, carpenters, electricians, plumbers, maintenance workers, homeowners, property managers, landlords, insurance adjusters, and the list goes on. Even more diverse than the trades that attended the 8 hour initial course was their varying reasons for attending. RRP Rule — continued from page 28 employer made attendance compulsory. Some were happy to attend, others… not so happy. Happy or not, each student left the course with a better understanding of what lead-based paint is and how detrimental lead poisoning can be, especially to children. As an instructor, one of the biggest issues brought to my attention by at least several students in almost every class I taught was an unfortunate truth: despite the multitudes of students attending this mandatory certification course there would always be that group that simply did not bother with those “pesky EPA regulations”. My students argued vehemently that in some cases they simply could not compete with competitors that operate outside the law, did not spend the time and money to become trained and certified, did not purchase or use a HEPA vacuum or any of the plastic sheeting or supplies needed to comply with the RRP rule. Mathematically, companies that do not

comply with the RRP rule can do the job cheaper. In many ways these students were right. As an instructor my response was, and still is, usually something like this: “There has always been and probably will always be ‘an illegal element’, for the lack of a better term, in the construction industry. During this class you have learned what lead based paint is and the effects that lead poisoning can have on the human body. You have learned how doing something as seemingly innocent as power sanding a window sill, or scraping loose and flaking paint without using lead-safe work practices can poison children as well as adults with debilitating and often permanent effects. You have also learned that failing to comply with this regulation can result in tens of thousands of dollars in fines and even imprisonment in some cases. Knowing what you now know, are you willing to take that chance? Are you willing to risk your own health and safety and the health and safety of your workers, and your

customers for the sake of being the lowest bidder? Every student in this classroom needs to ask his or herself that question. There is really no such thing as somewhat compliant. You’re either in compliance or you’re not.” For the competitive bidder, strict enforcement from the EPA is the only effective way to level the playing field. Early on, enforcement was rare if not nonexistent. That has dramatically changed. Recent enforcement actions taken by the EPA against companies found to be non-compliant have resulted in harsh fines. Some recent enforcement actions include: •

February 2014 — 35 home renovation contractors as well as training providers received hundreds of thousands of dollars in fines; 17 of which were violations for failing to obtain the required RRP certification, 21 violations were issued for failure to follow the required lead safe work practices, and 3 violations were issued to general contractors

who failed to ensure their subcontractors followed the RRP standards. •

April 2014 — Lowe’s was fined $500,000 for failing to ensure that contractors it hires comply with the RRP rule. October 2014 — EPA announced enforcement actions against 9 companies in California that were not EPA certified before working in pre-1978 homes and schools.

Make sure your contractor can clearly explain the details of the job and how the firm will minimize lead hazards during the work process.

Ask what lead-safe methods will be used to set up and perform the job on your property.

Ask for references from at least three recent jobs involving buildings built before 1978 and speak to each personally.

Always make sure the contract is clear about how the work will be set up, performed and cleaned.

You can verify that a contractor is EPA certified by checking the EPA website at www.epa.gov/getleadsafe or by calling the National Lead Information Center at 1-800-424-LEAD (5323). For those that are currently RRP RRP Rule — continued on page 32

In June of 2014 our own RRP training program in Anaheim was unexpectedly audited by not one, but two EPA enforcement officers. It is only safe to assume that the unofficial grace period is over and EPA is significantly stepping up regulation enforcement. Another indicator of active enforcement in the southern California area is the ever increasing request for lead-based paint inspections NEC has received from property owners and property management firms currently undergoing EPA audits. It would be a safe assumption that there are likely dozens of enforcement actions currently underway that have yet to be published. Owners as well as managers of rental properties should realize that the EPA considers it their responsibility to ensure that the RRP rule is followed not only by their in-house maintenance staff, but the contractors they hire to do work that disturbs paint on their pre-1978 rental properties. Property owners and managers should realize that hiring a non certified contractor to work on their pre-1978 rental property for the sake of saving a few bucks is akin to “inviting the devil to dinner”. The amount of regulatory and civil liability this incurs as well as the potential for tens of thousands of dollars in fines, not to mention the physical harm that could be caused to tenants from lead exposure is just simply not worth it. For property owners and managers, finding the right contractor to work on their pre-1978 rental properties can be a challenge. The EPA offers a few helpful tips: A P A R T M E N T

Once your certification expires you are no longer eligible to take the 4 hour refresher course. Instead EPA will require you to re-take the initial 8 hour course over again. Accredited training providers have been given strict guidance from EPA on this issue and will require that you submit a copy of your current unexpired RRP certificate to the training provider before you will be allowed to attend the 4 hour refresher

training. If you do not have your RRP certificate or have misplaced it contact the accredited training provider you took your initial course from because all EPA accredited training providers are required to maintain student training records for at least 5 years. Additionally, there is no need to wait until the day before your certificate expires to get your refresher training done. There is no penalty for early refresher training. Statistic Apartment Owners Will Like BY N IC K LI E BE R MAN

N

otice anything striking on the accompanying chart? For me, one category nearly jumps off the page: Gross Rent Multiplier. Just look at the stunning moves in apartment GRMs that have occurred during the third quarters from 2012 to 2014. In Orange County we leap from a 10.90 GRM in Q3 2012 to 12.04 in Q3 2013 to an eye popping 14.33 in Q3 2014. That’s a sizzling 31% increase in the GRM over a 24 month period! To clarify, a “gross rent multiplier” is defined as purchase price divided by current annual gross scheduled rents (with vacancies counted at market rent). The GRM figures used in our Pulse on the MarketPlace chart are provided by CoStar, a nationally recognized data research firm. Now, one might initially question whether the Orange County figures could be somehow skewed within our marketplace or aberrant in some way and not fully or purely reflective of actual market conditions. But look at the GRM numbers for the nation as a whole. They demonstrate a similar if not quite so dramatic pattern. In the nationwide context, which reflects eighty-three times as many transactions as occurred in OC, the GRMs run 9.87 to 10.62 to 11.74 for the third quarters from 2012 through 2014, respectively, a 19% jump in the multiplier over this period. Not quite as startling as Orange County, but nevertheless a can’t be ignored robust GRM progression. A P A R T M E N T

What accounts for this phenomenon? Why are investors so aggressively pursuing apartment ownership and stepping up to these higher GRMs? Here’s a list of various market conditions that, in combination, make apartment properties so desirable at this time: •

Shifting demographics within the general population that are reducing the percentage of home ownership households while increasing renter household percentages;

A supply / demand tilt in multifamily: apartment construction slowed substantially after the 2008 financial crisis, with new inventory simply not matching the growth in rental housing demand since;

In terms of social “status”, being a tenant has become more appealing and carries less stigma than in the past;

Inflation hedge — if inflation eventually accelerates causing apartment expenses to rise rapidly, higher apartments rents are expected increase apace, thus mitigating the impact of inflation;

Stability as an asset class within volatile markets — rental housing is considered a bedrock industry that will always stay in relative demand regardless of economic cycles (like bread, shoes and toilet paper);

Low returns on CDs and other short term investments continue to incentivize investors to deploy cash into higher yielding assets, and apartments are one of the attractive asset classes for capital seeking a long term home;

Unemployment continues to decline according to the Bureau of Labor Statistics, which in turn boosts the supply of qualified tenants;

One may argue with the relative strengths of these considerations, but the perception that most if not all are legitimate factors contributes to the overall allure of apartment investment. And of course it’s more that GRMs underlying a strong apartment market. RealFacts indicates that rents are up 6.2% nationwide and 3.4% in OC the past year, while occupancy has risen to 94.5% nationally and 95.6% in OC. Naturally, at some point the economic landscape will evolve and apartments will lose some luster as part of the natural ebb and flow of a free market environment. For now though, pricing metrics in the multifamily arena, specifically GRMs, are showing major muscle, with no sign of pullback in the offing.

he most expensive item when measured in our busy world today is time. Yes, time. Why? It’s priceless, difficult to pinpoint value that fluctuates from person to person. One conclusion is pretty much the same, however: every potential customer that calls in to your rental office needs to be enticed in a unique way so that they decide to pay a visit to your property. and give up some of that precious time. To accomplish this, you’ve got to make

a lasting impression to convince that person that you’re worth the investment of time. Let’s face it: if a customer calls the property looking for an apartment, they are already interested. The difficult part is turning that call into a visit. You need to captivate, stimulate and motivate the customer to get up off his or her off their feet, start up the car, and drive to your property. You need to stimulate interest visually — paint a picture with words, send floor plans, e-mail pictures

you’re looking for in your apartment home?” “What things are most important to you in an apartment?” or “Why are you moving from where you are living now?”

Turn a Call — continued from page 39 this, the leasing professional must know how to take control of the phone call. In most cases, the caller’s list of questions is short: Do you have any (size) apartments? How much? Once you answer those questions, the conversation is pretty much over unless you take control and determine the caller’s needs. 2. The goal is to convince the caller that your community is worth the time for an in-person visit. 3. The best way to ensure that your caller will want to visit your community is to focus your phone presentation directly on his or her particular needs and wants. Leasing professionals must rise to all challenges and deliver the specific information that matters most to the customer. Ask the caller permission to ask questions, for example, “If you’ll give me just a few moments of your time to ask some questions, I’ll be able to find the perfect apartment home that meets your needs.” This explains to the caller what you are doing and why. If the caller perceives that you are genuinely trying to help them by meeting their exact needs, they will be much more likely to cooperate. 4. Once you’ve gotten permission to ask some questions, start asking! Strive for open-ended questions that invite longer, more detailed answers. (The open-ended question invites the caller to elaborate, whereas the closed question can be answered briefly, in one or two words.) 5. 6. Another important technique involves using assumptive questions. In an assumptive question, you use phrasing that assumes the caller will become a resident of your community. For example, instead of asking, “When do you need an apartment,” you might ask, “When are you planning on moving to our community?” This type of phrasing is an invitation to be a part of the community. 7. As the caller starts to respond to your questions, pay attention. They are giving you precious information that you can use to tailor your presentation. Have they indicated that there is a lot of furniture? If so, talk about the ample square footage of your living rooms. Do they work from home? If so, emphasize how “wired” your units are. Do they love to cook? If so, talk about your new, state-of-the-art appliances. If he or she mentions sports or outdoor recreation, point out your proximity to the park. In short, show them how your community is ideal to meet their particular lifestyle needs. 8. As you describe your community’s features, use colorful, inviting words such as bright, cozy, spacious, airy, comfortable, and warm. If this doesn’t come naturally to you, practice it! Work on “talking” your way through each of your community’s floor plans, painting a picture of each room as you go. Instead of saying, “The bedroom is down the hall to the right,” say, “At the end of the n

hallway, if you turn to your right, you’ll enter the first bedroom suite, which is large enough to easily accommodate a full bedroom collection, complete with a king bed. The windows in this room are oversized, so you get a terrific sense of light and spaciousness, not to mention a great view.” 9. Write these “talking notes” down if you need to. Next, go through them a few times and look for ways to make them more descriptive. Once you’ve mastered each floor plan, work on your community’s amenities such as the pool, fitness center, and the clubhouse. You might even want to practice describing the surrounding area. Tips for success — Getting the Appointment • Set an appointment (each team member needs an appointment book/calendar that the entire rental team can access) • Ask the caller if they need directions. Make sure to have concise written directions, a clear directional map to email to the caller, or a link to online directions such as Google Maps. Describe the beautiful scenery that will be seen as they drive and the close proximity of wonderful shopping and entertainment. • The goal is to have each call result in an appointment for the caller to come and visit the property. If you’ve done a good job of tailoring your presentation and painting a picture of the community’s features, an appointment should be an easy sell. You could close the call with something similar to, “I really think you’ll love this apartment and this community. o you have a business succession plan? Life-changing events or retirement can bring on some tough choices. It’s not unusual for business owners to find a majority of their wealth tied up in their company. This is often a major provider for them and their families. But when the time comes to sell their businesses, many owners often have not thought about how they would replace that important chunk of income. Business succession can be an emotional, financial, and timing issue for business owners. If you own your own business and are considering a business succession plan, there are five questions you should address with your Financial Advisor. Together you will want to ensure you have a plan in place to help reduce the risks associated with one of your most

important assets. What other assets have you set aside to help fund your retirement? Should you rely on your business alone to fund retirement? Just as your investments should be diversified, so should your assets. Though it may be difficult to do in a business climate, as a business owner, you should save and build your retirement savings plan away from the business to work toward your retirement goals. Have you considered whether your business is an asset you can sell? Whether or not you can find a buyer for your business depends on a variety of factors.
