ew things in life are perfect and as my wife reminds me quite often, I certainly am not. But when it comes to predicting the performance of the multifamily markets of Orange and Los Angeles Counties, I’ve done pretty well forecasting the condi-
tions both of the for sale and for rent markets. No, really. Go back to 2009 where I made my first predictions in Apartment News and you will see that this Dunlap guy knows his stuff. Of course, I can’t handicap sporting events, pick the winning lottery numbers or even guess the weather (I often wear sweaters when short sleeves are more appropriate), but the economy and the real estate market happens to be my
sweet spot. In fact, you’ve made money whether you’ve listened to my predictions or not, but I’d like to think you’ve made more if you listened to me. A Trip Down Memory Lane Let’s look back in time to 2009 and what an ugly time that was. Rates were up, rents were down and what most of us didn’t realize was that the market was prime with investment opportunities.

I know a couple of colleagues here at AAOC who bought in 09 and their properties are performing well. 2010 was sort of a ho hum year and 2011 was right there with it. The tried and true property management strategies of improving your product, focusing on customer service and knowing the competition in your rental market (and sub-market) to precision price your units for quick occupancy and less vacancy loss were the difference between happy endings and Calgon moments. Not 2 or 3, But 4 Chances Then in 2012, things changed. Rates hit the 3% range and it was time to re-fi, reinvest or look for opportunity that was abound in the 2-4 unit or SFR markets. For most independent owners, the 16+ unit product was out of reach unless you were an exchange buyer or had cashed out your stock portfolio and were flush with cash. The key phrase here being “opportunity that was abound” because while the market has otherwise stayed the same, these opportunities were soon snapped up as frenzied buyers began to drive bidding wars. We’ve been here in a sort of holding pattern. I mean, I am getting older but the market is staying the same! Not really improving, although rents are on the rise, but take away the low rates and what do we have? We will soon see.

Political Influence on Market Conditions Aha, Ms. Yellen. That minimal increase will in fact curtail market activity. On the fence buyers will go the way of Humpty Dumpty, but don’t expect much more. We will see interest rates in the high 4% range by year’s end and we will see rent growth in a more normal 2% to 5% range (depending on the market) and with what could be a full 100 basis point increase in rates, I’d expect to see prices soften just a bit, but nothing too significant. We’ve got a Presidential election ahead and not much happens economically during an election year (at least it’s not supposed to). At the
State level, we will continue to have our hands full with policy issues and adverse legislation, but that’s what our AAOC Legislative committee lives for. Whatever 2016 may bring, you’ve already made the most important decision in running your business: renewing your AAOC membership. Home For the Holidays Thanks to AAOC! The holidays are a time to celebrate with family and friends, but for residents of an Anaheim apartment building that caught fire during the early hours of a cold November morning, those plans changed significantly. Fortunately, one family’s simple wish for a new home came true thanks to the quick response of AAOC members Nicholas Dunlap and Ray Maggi. After being contacted directly, by the Anaheim Fire Department’s public information office, Dunlap was able to work with a network of AAOC members to identify housing options that met the family’s needs. Quick to respond with a suitable option was none other than Director Emeritus Ray Maggi. A quick exchange of information, completion of the application process and the family took possession of their new home just in time for Thanksgiving. We are thankful for our members, their dedication to the public and also to the municipalities who through working together over time know and recognize the difference between an apartment owner and a member of the Apartment Association of Orange County.

s we approach a new legislative year with expected new challenges galore, we pause to remind ourselves it is time to comply with older mandates that kick into place on January 1, 2017. Here a couple of them. Minimum wages Pursuant to 2013 legislation (AB 10) and conforming IWC Wage Order

(MW-14) minimum hourly wages increase to $10 effective January 1. There also are concurrent increases in the available lodging credit: two-thirds (2/3) of the ordinary rental value, and in no event more than $564.81 per month or, when both are employed, $835.49 per month. Note that some local communities have adopted even higher wage rates and there are exceptions for higher wage earners.

Plumbing Fixtures On or before January 1, 2017, all noncompliant plumbing fixtures in any single-family residential real property built prior to 1994 must be replaced with water-conserving plumbing fixtures. For multifamily residential real property built prior to 1994, all noncompliant plumbing fixtures must be replaced with water-conserving plumbing fixtures on or before January 1, 2019.

Water conserving plumbing fixtures include 1.28-gallon toilets and 2.2gallon-per-minute faucets and showerheads. Current CalGreen standards reduced these requirements for showerheads (2.0 gpm @ 80 psi) and differentiate bath (1.5 gpm @ 60 psi) and kitchen faucets (1.8 gpm @ 60 psi). Installation may be more difficult than expected. Replacing a faucet may involve replacing water supply lines and angle stops. Replacing a toilet may include replacing flooring because the toilet footprint may not match the old footprint. When purchasing a new faucet, ensure that the faucet matches the cover and openings in the sink. New Issue A number of owners and managers have received information about a decision of a federal district court concerning the constitutionality of a local government’s rental property inspection program. It has raised sufficient concern among the rental property community to cause a need for clarification. The following information provided by the California Political Consulting Group is intended to clear up any misunderstanding of the ruling. Analysis of the Federal Ohio Court Decision Striking Down an Inspection Ordinance On September 30, 2015, a federal district court in Ohio (Southern District of Ohio) struck down the City of Portsmouth’s local rental housing inspection ordinance as unconstitutional. The court followed precedent established in the 1967 United States Supreme Court case Camara v. Municipal Court of City and County of San Francisco, which held that an inspection ordinance allowing warrantless inspections of private dwellings without probable cause was unconstitutional under the Fourth Amendment right to be free from unreasonable government searches and seizures. A review of the Camara case shows that the U.S. Supreme Court was concerned about residential rental

inspection programs that allowed for warrantless inspections and criminal prosecutions of residents who did not consent to a search. It reasoned: “...when the inspector demands entry, the occupant has no way of knowing whether enforcement of the municipal code involved requires inspection of his premises, no way of knowing the lawful limits of the inspector’s power to search, and no way of knowing whether the inspector himself is acting
under proper authorization. These are questions which may be reviewed by a neutral magistrate without any reassessment of the basic agency decision to canvass an area. Yet, only by refusing entry and risking a criminal conviction can the occupant at present challenge the inspector’s decision to search. And even if the occupant possesses sufficient fortitude to take this risk, as appellant did here, he may never learn any more Smock/Kingston — continued on page 12

The practical effect of this system is to leave the occupant subject to the discretion of the official in the field. This is precisely the discretion to invade private property which we have consistently circumscribed by a requirement that a disinterested party warrant the need to search. [] We simply cannot say that the protections provided by the warrant procedure are not needed in this context; broad statutory safeguards are no substitute for individualized review, particularly when those safeguards may only be invoked at the risk of a criminal penalty.” (See Camara, 387 U.S. 523, 532-33 (1967).) The Camara court, however, also stated that where health and safety are at issue, “…the facts that would justify an inference of ‘probable cause’ to make an inspection are clearly different from those that would justify such an inference where a criminal investigation has been undertaken. Experience may show the need for periodic inspections of certain facilities without a further showing of cause to believe that substandard conditions dangerous to the public are being maintained. The passage of a certain period without inspection might of itself be sufficient in a given situation to justify the issuance of warrant.”
Ultimately, a judge’s decision to issue a warrant may be based on standards such as the passage of time, the nature of the building (e.g., a multifamily apartment house), the area’s age, or the condition of the entire area. Unlike in the criminal law context, however, the decision to issue a warrant does not necessarily need to “depend upon specific knowledge of the condition of the particular dwelling.” In the recent federal Ohio case, the inspection ordinance violated the Fourth Amendment because it authorized warrantless administrative inspections. Specifically, the ordinance afforded no warrant procedure or other mechanism for pre-compliance review. As such, the owners and tenants of rental properties in Portsmouth, Ohio were faced with the choice of consenting to the warrantless inspection or facing criminal charges, a result the Supreme Court in Camara has expressly disavowed under the Fourth Amendment. The Ohio case, therefore, does not establish new law, nor does it establish a novel way of attacking local inspection programs. The case merely serves as a reminder that local inspection programs can be unconstitutional if they allow for warrantless inspections or allow local governments to bring criminal charges against residents who do not give consent to inspect. In California, most local inspection programs do require code enforcement officers to seek a warrant in the event a resident does not give consent to
inspect. Moreover, California courts have upheld these local inspection programs, as long they are consistent with the guidelines set out in Camara. In Griffith v. City of Santa Cruz, for example, the court upheld an inspection ordinance because, consistent with Camara, the ordinance required inspectors to “obtain the consent of the landlord and the tenant” prior to inspecting, or seek a warrant. (See Griffith v. City of Santa Cruz, 207 Cal.App.4th 982 (2012).) The probable cause standard for issuing a warrant is not based on individualized suspicion, but instead can be based on the nature of the area, or simply the passage of time. It is enough for cities to argue that because dwellings can fall out of compliance with health and safety code standards over time and become a public or private health and safety issue, inspections are necessary. hat new laws should owners and managers of rental property be aware of for 2016?
The folks in Sacramento were quite busy last year, introducing over 2,770 assembly and senate bills for consideration, including over 160 that were intended to impact the ownership and management of residential income property.
Assembly Bill 418 expands a victim’s right to terminate a lease in the event of domestic violence under certain circumstances. Effective January 1, a victim of domestic violence may terminate a fixed term lease upon fourteen days’ notice. If there are other residents who will remain in the Premises, the landlord may retain the security deposit and is not obligated to return any prepaid rent. This bill shortened the time period for

termination from thirty days to fourteen days and clarified the contractual rights affirming the joint and several liability of co-residents. Senate Bill 188 provides certain enforcement remedies for utility providers when a resident fails to pay his or her water bill when the utility bill is in the name of the resident. Landlords are not required to pay a resident’s delinquent bill when the utility service is in the name of the resident. Assembly Bills 1 and 1164 prohibit local governments from imposing fines or liens on property owners who have allowed their landscape to ‘brown out’ due to the enacted and/or threatened water restrictions and water use restrictions. Further, local governments are prohibited from imposing fines or liens on owners who installed synthetic or artificial turf on residential property. These bills addressed the very real catch 22 dilemma that many owners faced, responsibly reducing their use

of water while maintaining their curb appeal without incurring the wrath of local governments. Senate Bill 655 provides that the presence of visible mold in a dwelling may be considered a substandard housing condition. This is a very poorly drafted piece of legislation that despite our industry’s best efforts managed to pass. True to form, this bill will no doubt spawn countless lawsuits against property owners and managers, and will certainly be used to defend and/or delay many unlawful detainer actions. The lack of clarity and the absence of relevant science based standards, are sure to be abused by an opportunistic resident or advocate. Make sure your management practices include periodic inspections of all of your units. In the event a resident notifies you of the presence of mold, or any defect for that matter, ensure that you follow up and inspect as quickly as possible, identify the problem, cure it, and document your actions. Senate Bill 328 requires that landlords provide twenty four hours’ notice prior to applying pesticide inside a resident’s dwelling. There is certain required information that must be provided, make sure you use the proper form provided by your apartment association or your pest control vendor. There is a provision that a resident may waive the twenty four hour notice and allow immediate application. The bill also includes required notification of all adjoining residents if they might be affected by the application of pesticide or weed killer. Assembly Bill 1448 clarifies existing law regarding a tenant’s right to use a clothesline. A tenant may use a clothesline or a drying rack in the resident’s private area if: i) it will not interfere with the maintenance of the property, ii) it will not create a health or safety hazard, block doorways, or interfere with walkways or utility service equipment, iii) the resident seeks the landlord’s consent before affixing it to

I am a very conscientious landlord. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. This month I received a letter from one of my tenants telling me that I had no right to enter his apartment to look around, that he would not let me in. What do I do? Can I force my way in to do the inspection?
Your policy of doing annual inspections is admirable, and is practiced by responsible landlords throughout California.
Most tenants welcome a responsible landlord’s actions in ensuring that all is well, and voluntarily cooperate in providing access upon the landlord’s reasonable request. It is clearly in the best interest of all to ensure that any maintenance issues are promptly addressed, and that a spirit of communication and co-operation exists between a landlord and his residents. Trouble is, your resident is right. There is no specific provision in California law requiring a resident to allow the landlord access to merely “inspect” the premises. California law states that a landlord can enter a rental unit only for certain reasons. Those reasons are in an emergency, when the tenant has moved out or abandoned the premises, to make necessary or agreed repairs, decorations, alterations, or other improvements, to show the unit to prospective purchasers, tenants, or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a pre move out
inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a landlord to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. This article is presented in a general nature to address typical landlord tenant legal issues. By the time you settle in to read my scribblings with a cup of eggnog or other festive beverage, the House and Senate will hopefully have closed the book on the first session of the 114th Congress. They have already successfully passed the first long-term highway bill in a decade and now have

only to knock out federal appropriations and tax extenders. No small feat to be sure, but apparently with Paul Ryan now Speaker of the House, the policy world is our oyster. The final weeks of debate on Federal appropriations spending are a valuable lesson in how large bills get done in our political system. The good news is that the starting premise is that no one — especially Republicans — wants to shut down the government. With that in mind, everyone is willing to negotiate and find the sweet spot on a comprehensive, “omnibus” federal appropriations bill. Republicans want to include policy “riders” to stop several environmental rules promulgated by the Administration as well as toughen vetting standards for Syrian refugees. Democrats want to

keep out any anti-Planned Parenthood provisions, fend off anti-immigrant proposals and preserve some of those very same proposed environmental regulations. A rider to stop EPA’s Waters of the United States (WOTUS) proposed rule is in the mix for inclusion in the omnibus. As you know, this rule would be very, very bad for the apartment industry and we have been working with a large coalition of real estate organizations and others to stop it. In the tax extenders bill, Democrats want extension, expansion and indexing of several refundable tax credits while Republicans want to make some of their favorite business tax provisions permanent. Moreover, Republicans want to end the 40-year-old ban on exports of domestic oil which Democrats are

happy to give them in exchange for extending renewable energy tax credits, more funding for conservation and a bigger child tax credit. Depending on the conclusion of the negotiations, the price tag for the final extenders legislation could be north of $500 billion over 10 years as opposed to $85-plus billion for a simple one-year extension of all of the expiring tax provisions. As I have reported to you before, there are several extenders in play that are of great interest to the apartment industry. These have to do with expensing, energy efficiency benefits and affordable housing. All look to be in good shape for inclusion in the final package, though the jury is still out on what the term of that extension will be. The issue of gun violence, mental health screening and stricter controls on gun ownership was put back in front of lawmakers by the recent terrorist acts in San Bernardino, California. Though there has been and will continue to be rigorous debate in Congress, it does not

appear that any new legislation will be considered before adjournment. There is relevancy to the apartment industry here as owners and operators grapple with how to handle conceal carry, open carry and other laws that allow individuals to possess and carry firearms on their person in public. National firms and local independent owners alike are attempting to strike a balance between respect for legal rights and the safety of their residents. Because Congress is very unlikely to pass any national standards in this area, owners with property across municipal and state boundaries will have to comply with myriad different rules. Remember to mark your calendars for the 2016 NAA Capitol Conference and Lobby Day which will take place in March in Washington, D.C. NAA has a new and ambitious goal for the event. We’re going to reach every one of the 535 Congressional offices — that’s 435 Representatives and 100 Senators — on Lobby Day on March 9. The Capitol

get rid of the rodents yourself. Keep in mind that rats and mice are smart and conservative. They are not risk takers. In the rat or mouse’s mind, a trap out in the middle of the floor is too risky to investigate. Rodents will run along walls, rafters and other low exposure areas. Put the traps along these routes about ten feet apart. A good bait to use is peanut butter. Patience is king when trying to trap a rat. Place all your baited traps, but do not set them for a day or two. Let the rat nibble at the bait danger free. This last part is the hardest to do. However, patience will win out. If you rush ahead and set the traps and the rat triggers one and is not caught; he will remember! Also, avoid using traps designed for mice; it will only annoy the rat and he will be smarter for it. The same goes for using rat traps to catch mice. The trap is too big and when sprung may miss the mouse. Using poison is another option. Anticoagulant poison is very popular. This poison causes the rat’s blood to thin. It will make him thirsty and when he drinks water, he will bleed internally. When using this option, be sure to leave a saucer of water near the poison. The poison normally comes in bars that can be broken up into pieces. Remember rodents hoard, so just because the poison is gone, does not mean they ate it. Put more until they stop taking it. The local hardware store should carry this product, but it is best to go to a farm supply store. They will have the best

quality supply. Be careful with placement, so other animals do not eat this poison. The hardware store or farm supply store carry approved bait dispensers designed for rats or mice. Again, patience is rewarded. Before using poison bait, use crunchy peanut butter to let the rats get used to the bait station for a few days. Then add the poison bait with a little bit of peanut butter. Glue traps are also a viable option. It is important to use large rat sized traps. Put the glue trap along a known rat runway, or along a ledge or rafter used by the rodents. It is important to nail or fasten the glue trap in place. Place a bit of peanut butter in the middle of the trap as an attractant. Happy hunting! Dear Maintenance Men: I doing some long term preventive maintenance with my building’s individual 30–40 gallon water heaters. Each unit has a water heater and I’m not sure of the age or condition of each unit. How long do most heaters last and what are some signs of imminent failure? Bryan Dear Bryan: The chances of a number of heaters failing all at once are very slim. The cost of replacement can be spread a over period of time. A sign the end may be near is: banging noises coming from the heater, short hot water supply and long heater cycle times producing lukewarm water. At this point you should start pricing a new heater. However, if you find water pooling at the base of the heater… replace it immediately, it has failed!! Dear Maintenance Men: One of my maintenance chores I do is caulking and sealing shower/tub fixture flanges and shower walls. My problem is getting the caulking to dry before a resident uses the shower. Any Suggestions? David Dear David: A lot of people will say: “Just tell the resident not to use the shower till the BUFFALO.AD.Resized:Layout 1 work 3/1/12 caulking is dry”. Well it doesn’t
and by the time you are driving away from the building, your resident is already taking a shower and your fresh caulking is washing down the drain. Your caulk should cure at least 24 hours before use. Water based latex caulking is easy to use, but very susceptible to water until it is cured. Try using a silicone or polyurethane based caulking for doing tubs, showers, toilets, sinks or other wet locations. It tends to set quickly and will repel water during its cure time. Another solution we have found works well with very busy showers is to remove all the fixtures, including the showerhead & arm, valve handles and tub spout, before caulking. (A bit extreme, but effective) We then plug the showerhead and tub spout with a capped pipe. Then caulk the tub/ shower. We come back 24 hours later and reinstall all the fixtures. One more thought; if you have sliding shower doors for your tub, 5:37 1 track. If it is loose, checkPMthePage bottom
do not caulk until the track is removed, cleaned and dried. Reinstall the track with new adhesive caulk to hold it down and caulk the edges to keep the water out. T
his Probably Never Happened to You, but… The applicants for #3 “looked” good. They were brother-andsister. They both had good jobs, and their incomes suggested that they could afford the rent. They both had fairly good credit scores (above 650). In the past, we would have rented to them. That was then, this is now. Now we can also run Criminal Background Checks. We now run such
checks on all applicants. It is inexpensive, and it is essential. This pair proved the point, dramatically. “She” had no criminal history. “He” did, and as amazing as this may sound, he had (12 years ago) been charged with murder, and was ultimately convicted of voluntary manslaughter. Yes, that really got our attention. But…as the rental agents said… “He looked like such a nice guy”. Here is the reality: suppose you could run a criminal history check, but
did not, because the applicant “looked good”. Suppose, for example, you could run a criminal history check but did not, because you didn’t want to spend the money. Now suppose, for example, that you rent to a violent criminal, you allow him (or her) to move into your property next to truly “nice” people. In the situation mentioned above, it was simple: there was no way we would ever rent to him. But there are lesser crimes, such as the kid who got “busted” for smoking marijuana back in college 15 years ago. Where we are now is that we simply will not rent to anyone who has been convicted of a crime involving
either physical or financial harm to a person or property. And, we will not rent to anyone with two or more misdemeanors (such as drunk driving), as this is a person who is both a lawbreaker, and someone with little regard for the safety of others. We want to rent to people who play by the rules. sure that you would be covered if you inadvertently rented to someone with a criminal background, and such person committed some form of harm to one of your other tenants. Some people have commented that somehow it’s “not right” to discriminate against someone who has “served his or her time”. In my quest to look out for all of my tenants, I must disagree. The criminal record is just half of the equation. We specifically ask all of our applicants (on the application form) if they have a Criminal Record. In every instance so far, where there was such a record, the applicant lied, and said that they did not have a Criminal Record. To avoid arguing over “why” we turned them down, we have simply told them that they were denied because they lied to us. This new diligence in our tenant research seems well worth the time, the effort, and the small expense. We would not do it any other way. Investing vs. Paying Off Debt BY JASON SHERR
T
he debt dilemma The process for eliminating debt is anything but an easy-tosolve financial equation. Many people wonder if they should pay off their debt as quickly as possible or invest their money, letting debt payments run their course. The answer depends on whom you ask. Theories about balancing investing with debt vary widely. Some financial experts say freedom from debt is the most important goal. Others say it’s more about the math: Your money should go toward investing if your investments earn a higher rate of return than your debts cost you. Still others focus on the emotional aspect: how comfortable are you with a certain level of debt? Neither one nor the other Better yet, perhaps, is a balanced approach to wealth management. If you’re like most people, you’ll need to manage finances for both present and future needs. That means paying off some debt today while simultaneously investing with an eye on the future. Although your decisions should take into account your own needs and circumstances, consider the following guidelines for handling debt in light of investing goals: Save for a rainy day. Before paying down debt (beyond required payments) or settling on an investment strategy, make it your first priority to put funds aside for an emergency reserve. We recommend six months or more of 3 4

living expenses; an absolute minimum is three months’ worth. These funds should be in traditional savings or very short-term, highly liquid, nonvolatile investments. Your future first. As a general rule, your long-term investment plan should take priority over applying extra amounts toward debt. Be careful as well not to let “lifestyle creep,” a tendency toward more expensive tastes and luxury consumption, impede your investment outlook. By contributing to a long-term investment plan as early as possible, you may set yourself up for a brighter future. If paying down debt is also a priority, you’ll want to examine your personal budget to decide how much to direct each month toward investing and how much toward debt repayment. Just remember, there are no magic numbers. In general, the best advice is to make sure your investment strategy fits your financial expectations for the future. Prioritize your debts. With an emergency fund in place and your investment strategy up and running, putting any extra money toward your debts is also a smart way to go. But how do you decide which debts to pay down first? One approach is to start with the smallest debts first to eliminate at least some of your debt burden and interest payments in a timely manner. It also makes sense to pay off high-interest debts like private student loans and credit card debt more quickly.

Federal student loans and mortgages might be lower priorities, because their rates are often lower and their terms are longer. Vehicle loans might fall somewhere in the middle. Tax considerations might also come into play. It’s personal. As you divide and conquer debt, don’t forget to consider the emotional side of your strategy. If paying off a certain debt will help you feel more secure, you might want to go with your gut feeling. You’ll enjoy a growing sense of financial freedom as you stay on course and get your debt under control. As it shrinks over time, you may find you have more funds available for enjoying the present and focusing on the future. Apartments in 2016…Context and Implications BY N IC K LI E BE R MAN
W
ith yet another strong year for the rental housing industry now in the books, AAOC members are focusing on the financial outlook for apartments in 2016. Let’s start with the obvious elephant in the room question, which goes something like this: Considering that there’s been a big run up in OC apartment prices and a sizeable decline in cap rates since the end of the 2008–2009 recession, is this powerful market about to run low on petrol? Using the post-recession time frame for context, let’s review the numbers… According to CoStar data, in third quarter 2009 the average price per unit in OC was $138K, versus $198K in Q3 2015, a 43% price increase over six years; in the same period, the average OC apartment sale cap rate has fallen from 6.93 in Q3 2009 to 4.62 in Q3 2015 (the adjacent Pulse on The Marketplace chart shows third quarter data from 2013 to 2015 only). To quantify what that cap rate differential really means to apartment valuations, $1 million in NOI at a 6.93 cap (the Q3 2009 cap rate) = $14.43 million in value, but at a 4.72 cap (the Q3 2015 cap rate) the same $1 million NOI now sells for $21.64 million! And, while the cap rate for OC apartments has dropped 218 basis points in six years, it is noteworthy that the benchmark ten year treasury yield over the same period has dropped

only 125 basis points, from 3.31% in Q3 2009 to 2.06% in Q3 2015. So caps rates have fallen faster than interest rates. Thus, from multiple perspectives, it’s fair to say that investors are certainly digging deep these days to acquire Orange County multifamily assets. But, does this six year valuation expansion in multifamily necessarily suggest that we may be about to undergo a trend reversal, or, heaven forbid, a “bubble” subject to a sudden decline in prices? We all read the tea leaves in our own way, but, my own view is that neither of the two aforementioned outcomes are at all likely in 2016 or at any time in the foreseeable future. Let’s recall here the old maxim, which is still true and always will be true for real estate: Location, location, location. Is there any market in the US with a better combination of important rental housing considerations than Orange County? Consider our: (1) sturdy and sophistical government and business infrastructure in place (2) vibrant local economy (3) diversification within that local economy (4) affluence within the local population (5) low unemployment in the region (6) extensive cultural, educational and recreational opportunities within the region and (7) phenomenal weather; these factors feed consistent, long term rental housing demand in the area and buttress our rental housing marketplace. Not to mention that we sit smack in the middle of two other dynamic

economies in Los Angeles and San Diego counties and have miles of oceanfront. Triple A locations like Orange County are simply less vulnerable to demand reversal or bubble phenomena. Futhermore, one very important distinction between today’s sound real estate market versus the heady markets of the mid-2000’s that ultimately collapsed and ushered in the the great recession, there’s been a huge amount of deleveraging. Banks have (painfully) eliminated millions of “stated income” loans from their books — leaving us with a much healthier debt position within the overall economy. As to the supply of new units, has Orange County and nationwide apartment construction picked up? Sure has, and that’s a good thing. (It was almost non-existent between 2007 and 2011). But are new units coming onstream about to swamp inventory? Highly unlikely. RealFacts says that occupancy in OC in Q3 2015 was 94.9%. Yes, that’s down from 95.6 in Q3 2014, but still a very palatable number considering that Realfacts also reports that overall rents climbed 5.8% in Orange County in the past year. OC is such a desirable location that anything other than an avalanche of new apartment supply would be relatively quickly absorbed without significant market disruption. roperty owners and management companies know how hard it is to find and keep good tenants. If a tenant complains about suspected mold, it’s important to take it seriously. Having vendors in place, (mold consultants and remediation contractors), allows a property owner or management company to react quickly to a mold complaint. A quick reaction keeps the tenant satisfied and is essential in minimizing risks for potential liability concerns. Owners, property manage-
ment, and builders are being sued in record numbers over issues of mold. There are many avenues for managing microbial issues on a low-key and cost-effective basis that can provide solutions and reduce the potential for liability. This industry has a lot of hype. What is the right course of action? What you don’t know can cost you money! The California Department of Health Services describes mold as
“…simple, microscopic organisms found virtually everywhere, indoors and outdoors.” Therefore, there is no such thing as a residence being free of mold spores, as they are found indoors and outdoors. Mold spores can also be found in dairy products, beer, bread yeast and in many medicines, i.e., penicillin. In Southern California, we are used to associating allergies with the spring and fall Santa Ana wind conditions. The winds cause mold spores from grass, trees, shrubs, etc.,

to become airborne along with other pollutants such as dust. For individuals who are susceptible to allergies, this is a ripe environment for varying types of reactions. Mold has been around for a very long time; early references can be found in the Bible. Many wonder why mold has become more publicized than ever before. In recent years, testing methods have become more sophisticated, diagnostic capabilities have improved, and the general public has more access to information. Changes in building materials utilized since the 1970â&#x20AC;&#x2122;s are more susceptible to mold growth. An example is the former use of lath and plaster walls compared to the current, less expensive use of drywall. Drywall contains a paper backing and lath and plaster does not. Whenever sufficient moisture is present, the paper backing on drywall may promote the growth of mold. Many potential moisture intrusion sources exist in single and multi-family residences such as bathrooms (sinks, tub, shower enclosures, toilets), kitchens (sinks, dishwashers, icemakers), laundry rooms, and various types of plumbing throughout the structure. There are outside sources that can also affect the interior including, sprinklers (over watering), poor drainage, plugged exterior ground drains, and flowerbeds raised above concrete slab. Of course roof leaks can also impact the structure. Mold cannot grow without a moisture intrusion source (i.e., a water leak) and a porous material, (i.e., drywall, carpeting, wood). Mold will usually be embedded in the affected material and cannot be easily wiped off. To remediate mold, it may be necessary to cut out and conduct remediation activities in the affected area(s). During cold weather, doors and windows tend to be kept closed and a lack of ventilation can become an issue leading to mildew that can often be mistaken for mold. Mold or Mildew — continued from page 39 plains regarding mold growth in bathrooms, bedrooms, and around windows. The most common complaint is mold growth on bathroom ceilings, walls and grout in the shower. We have all seen how fast a bathroom mirror will fog up from the steam (humidity) of a hot shower. The longer the shower, the more steam (humidity) is produced which will condense on cool surfaces (mirror, ceiling, windows and walls). Without adequate ventilation the humidity will remain on the various surfaces and not adequately dry. This may form a surface fungal growth, which is usually mildew. In addition, without adequate ventilation the humidity will escape into adjoining rooms once the bathroom door has been opened. Again, the humidity will condense on cooler surfaces such as the interior of outside walls and windows. This condition is more prevalent in rooms located on the north sides of

buildings where direct sunlight does not have an opportunity to warm the interior of an exterior wall or window. A fuzzy type of fungal growth, caused by humidity condensation and lack of ventilation, can also form where there is dust on walls behind dressers, dirt and grime in the corners of windows and window casings. In closets, this fuzzy type of mold may be found on shoes, clothes, etc. Numerous studies have shown the relationship of elevated humidity levels, cool surfaces, and the effects of mildew growth. Is it mold or mildew? Is your tenant’s complaint real or is it a housekeeping issue? Many times after investigating affected areas, we have found some of the following conditions: • No water leak; • Elevated humidity levels were due to inadequate ventilation in bathrooms; • Limited usage of heating system

to reduce humidity and to warm wall surfaces; • Inadequate housekeeping in showers, around windows, etc.; • Dirt & grime on metal window casings and the window track; • Dirt & grime along a wall causing furniture / bedding limited air circulation. An easy way to tell if the microbial growth is on the surface vs. embedded in the substrate is to gently rub the surface with tissue. If the growth is easily wiped off, usually it will be a type of mildew. A general cleaning of all surfaces utilizing wet-wiping with an anti-microbial solution can remove excess dust and residual microbial spores. Once the cleaning has been completed, it will be necessary to find a solution to the elevated humidity levels to prevent a return of the microbial Mold or Mildew — continued on page 42

Mold or Mildew — continued from page 40 growth. As an example, humidity levels can be reduced in bathrooms through either opening the window or installing a higher efficiency exhaust fan. For bedrooms, it may be necessary to utilize a portable dehumidifier during the winter months. Through increased housekeeping of walls, windows, closets, furniture, and bathrooms, most microbial growth can be prevented. The key can be as simple as air movement, keeping surfaces clean, and reducing humidity. As mentioned above, mold will usually be embedded in the substrate and will need to be cut out to remove it. Mildew is usually a surface growth and many times can be removed through scrubbing the surface. Regardless of the microbial growth, it is highly recommended that maintenance personnel, on-site management, or property owners respond promptly to tenant concerns. This includes all
reports of mold, mildew, moisture intrusion, overflows, non-working heating and air conditioning systems, bathroom exhaust fans, bathroom ventilation windows, kitchen fans, kitchen vent systems, and laundry room exhausts. Each complaint should be investigated and documented including any appropriate responses for repairs and/or remediation activities. Many times the tenant’s complaints can be easily solved without the need of an outside vendor. However, there will be times when an expert may be needed. Remember — what you don’t know can cost you money!
