The Long and Winding Road of AAOC’s Legislative Advocacy

T

he area of AAOC involvement I’ve always been impressed with the most is the association’s efforts in legislative affairs both locally and statewide. However, it wasn’t until I joined the board that I saw the farreaching effects of AAOC and other associations’ efforts. Nor did I realize the almost Herculean effort it takes year in and year out by board members as well as our fine lobbyists to thwart potentially harmful legislation to our

industry. Though it hardly seems like 2017 (and I’m still writing 2016 on checks and correspondence), the Legislative activity is starting to heat up at all levels Every year the California legislature introduces hundreds of bills that directly or indirectly impact the rental housing industry. Last year 156 property-related bills were identified and tracked by our lobbying team. Overall, we successfully helped to defeat the worst bills and obtained significant amendments on all other bills of importance to our industry. Some bills were amended and traveled through the channels to become law (only one potentially harmful bill became law); many were defeated and dropped and may come back again while others simply will die. These efforts produced a really good result despite another year of legislative attacks on the rights of property owners. Since about 2011, AAOC has spearheaded the effort to form a state association comprised of many associations throughout the state, now called CalRHA (California Rental Housing Association). The purpose of Cal-RHA is to advocate legislatively in the best interests of its members while improving and enhancing the legal, legislative and business climate of the rental housing industry on behalf of its members. In 2009, AAOC became a charter member of NAA (National Apartment Association) to secure a national voice. Your AAOC membership covers your

inclusion and legislative representation at all levels! Moreover, I’ve only talked about state legislation! AAOC also fights on your behalf at city and county levels. A hot issue today concerns parking. How many parking spaces does your building have and how many tenant cars reside in and around your building? Off the top of my head, Anaheim, Orange and Stanton have or will adopt some type of parking ordinance. We have worked with these cities, but Stanton has been most receptive to our recommendations. Rent control continues to be an issue as four California cities including Long Beach have included it on their ballots. Every industry would be much different if not for similar efforts such as the aforementioned by people like you and me. Thirty years ago our rental industry was off the radar from legislators, regulators, and attorneys. Not today! My clarion call to you is please continue to help us by renewing your membership, and suggesting to your peers and heirs to sign up as members as well. After all; the stronger your association is, the louder your voice will be and the more effective we can be in our future legislative efforts to protect your rights as a property owner. that our industry voices are heard. So, as we move forward in this most important year for landlords and multifamily housing, I urge you to get involved with your political action, your energy and your checkbook. on a limited number of issues in the progressive agenda. Still, it will be an uphill battle fending off the various anti-property management bills coming this year. It is evident this year more than ever: Association members must be proactive in calling their respective legislators to voice their concerns about the impact of legislative proposals on their business. Section 8 Housing Bill: Last year’s awful Section 8 housing bill is coming back in 2017. As you may recall, the bill would force all residential rental property owners to participate in the Section 8 housing program. One of the adverse impacts of this proposal is to compel rental property owners to accept all Section 8 government-mandated lease terms and regulations, the manual of which is approximately 400 pages long. In the guise of preventing discrimination based on “source of income,” the bill creates a special class of residents with more rights and fewer responsibilities than other residents. The significant administrative burdens imposed on property owners who participate in the Section 8 program drive up costs and increase vacancies. The Section 8 program is a voluntary federal program and should remain voluntary as intended under federal law. The bill unfortunately transforms this voluntary federal program into a mandatory one for thousands of California property owners, many of whom have legitimate business reasons for not wanting to participate in the program.

Price Control Bill: For the third legislative session in a row, a housing price control bill will be introduced. Commonly referred to as “inclusionary housing,” the price control mandates prohibit owners from setting the initial and subsequent rates on a percentage of their units. The bill will also seek to overturn Palmer/Sixth Street Properties L.P. v. City of Los Angeles, the case which upheld the Costa-Hawkins Act exemption of newly constructed rental units from price controls. California’s muchpublicized “housing crisis” is beginning to be recognized (finally!) as caused by local and state government policies that stifle private capital investment. Immigration Bill: The Association will be co-sponsoring an immigrationrelated housing bill this legislative session. The bill would prohibit all government entities in all California jurisdictions from requiring rental property owners and managers from compiling, disclosing, reporting, providing, or otherwise taking any action based on the immigration or citizenship status of a tenant or prospective tenant. The bill would also restate existing law that prohibits rental property owners from independently performing any of these acts. The bill is an extension to a 2007 bill, also led by AACSC and AAOC, which barred cities and counties from requiring owners to take action against tenants based on their citizenship. That bill came about in response to antiimmigration ordinances that were being introduced and adopted by local

governments throughout the country. One such ordinance enacted by California’s own City of Escondido sought to ban rental property owners from renting to undocumented immigrants. Another ordinance, out of Hazeleton, Pennsylvania, sought to make it more difficult for undocumented immigrants to live and work in the city. The ordinances required anyone renting housing to obtain an occupancy permit for which only those lawfully present in the United States were eligible. The ordinances also prohibited property owners from renting to unauthorized immigrants and city businesses from hiring them. The 2017 bill will ensure all rental property owners and tenants are protected from these types of discriminatory policies. We expect the introduction of over 140 bills to be introduced this year that will affect property managers and owners. name. In the event that your rental agreement simply requires that the tenant “pay for all utilities,” and does not require that the utilities be placed in the resident’s name, then the resident is obligated to merely “pay for all utilities,” and does not necessarily require that they be placed in the resident’s name. Paying for utilities may be done by simply reimbursing the landlord for utilities. In that case, you would be required to provide keys and access to the unit and after you receive the billing statement for the utilities, you would provide a copy to the resident with your demand that he pay for the amount stated. Failure to pay the utilities as required, is a curable breach of the terms of the lease. You must then serve a three day notice to perform conditions or covenants or quit, and if payment is not forthcoming, you would then file an unlawful detainer action seeking to evict the resident. If your agreement is not clear as to the rights and responsibilities of the parties as to who is responsible for placing them in their name and who is responsible for payment, then many courts will interpret the agreement in favor of the resident. Note that it is much simpler to require the resident to secure their own utilities in their own name, and doing so will provide clarity and transparency to your residents as to all of the fees, taxes, charges and other inclusions that most cities and counties bury in the complex billing statements. Residents also seem to be a bit more inclined to conserve their water and electric usage when they actually see how expensive utilities are. After owning and managing my properties for many years, I’ve come to realize that the ‘challenges’ that come my way are directly proportional to the quality of the resident I’ve placed in my rentals. In short, the better qualified the resident, the fewer ‘challenges’ I have; the less qualified the resident, the more challenges and ‘drama’ that follow. Each and every lawsuit I’ve been

Can you please review the steps to properly screen tenants?

Sure, proper tenant screening keeps the bad guys out. The following addresses the realities of tenant screening; it describes the tools that really work in weeding out the ne’er do wells, and provides insight to some simple and extremely effective methods that every owner should consider implementing. Proper tenant screening starts with a completed application, not one you buy at the stationery store, but the one

provided by your apartment association. Identity theft has been a growing problem for years. Landlords have increasingly been victimized by prospects posing as someone else, using false or fraudulent information. Often, these thieves take advantage of a desperate landlord, eager to fill a vacancy, or a newbie landlord who hasn’t gone through the school of hard knocks yet. Completed and signed applications by all adults are a must. Verify the information provided. Personally inspect some form of U.S. government issued photo identification. Make a photo copy of the ID and keep it secured with your file. Verify that the social security or the tax ID number provided by the prospect is actually his number, and is valid. Contact your apartment association and request that they run a credit report and eviction history report. Understand that the data in these reports is not perfect, only about 60% of evictions in California are reported and appear on the standard eviction data reports.

Know that these are merely tools that you must utilize, just know their limitations. If practical, go outside to the prospect’s vehicle, and verify that the license number on the car he just drove matches the license number he just wrote down on the rental application. Many ‘hands on’ owners will actually visit the prospect’s current residence unannounced, prior to approval to ensure the prospect actually lives there, and doesn’t just sleep on the couch. You’d be amazed at what you’ll learn by a simple visit! A visit about dinner time is generally the most productive, you get to see the prospect with all his friends, family, buddies, a real snapshot of how he’ll act in your building. The car parked on the lawn will be parked on your lawn if he’s approved. If no one is home, talk to the neighbors, they will certainly share their opinions! Inform all prospective applicants that you have a policy of taking a picture of all residents. Follow through with this policy, and when you meet to sign the rental


agreement, actually take a picture of all proposed occupants and keep the picture in your tenancy files. This is one of the simplest and most effective tools that keep the drug dealers, identity thieves and gang bangers out of your building. Bad guys don’t want their picture taken, and will not want to live in your building. They won’t even submit the application. When verifying employment and residency, ask for a description of the person, and compare the description with the person who filled out the application. Don’t trust the phone numbers provided by the applicant; independently verify them through the internet, or phone book. Ask for original bank statements, utility bills, electric, telephone, cell phone, cable, anything with the prospect’s name. Ensure that you establish minimum tenancy criteria, and apply your criteria consistently to all. Verifiable identity, verifiable and positive credit and tenancy history, sufficient and verifiable income to ensure that the prospect can

meet his future financial obligations should be required of all successful applicants. Contrary to the fair housing advocates, you don’t have to rent to undocumented persons, or others that don’t have verifiable identification or a verifiable social security or tax identification number. With the challenging housing market, it’s tempting to relax standards, to rent to those that really cannot be ‘properly screened.’ Many landlords have looked the other way, in favor of the quick rental, the cash payments, the full building, the reduced confrontation; many have taken the easy way out. Landlords have been wary of lawsuits claiming discrimination, and have believed the bullying taunts and threats from the tenant and immigrant rights activists, and have taken the easier and less confrontational course. We blame our government for not addressing the illegal immigration issue; one side of the aisle wanting cheap labor, the other wanting cheap votes. We blame employers for hiring, and our ‘welfare

state’ for creating the magnet that keeps drawing. Landlords are part of the problem as well. By succumbing to the short term temptation of the quick rental to the unverified, the undocumented, we are contributing to the problem we face here in California. Many landlords are now realizing that rather than just complaining, they can be a part of the solution. Landlords have absolutely no obligation whatsoever to rent to an individual who is unable to independently verify his identity, his past tenant history, and his ability to comply with the terms of the rental agreement, including his financial ability to pay the rent. Our system of society is built around a numeric social security or tax ID number. Our life history, good and bad, is reported more often than not, into a data base that is organized by, and sorted by the social security or a tax identification number. Names are common, but social security and tax

Q&A — continued from 13 identification numbers are unique. No two people should share the same number. Credit as well as criminal convictions are reported similarly. Once you’ve narrowed the field to a relatively few qualified prospects, select the ‘best’ prospect, not necessarily the first to apply, but the one who excels above the others. These very basic requirements should be applied uniformly to all applicants. It is just good business sense. With average rents over $1,200 a month, landlord investment of $175,000 or more per rental unit, and a litigation climate that is out of control, landlords must know who their residents really are. I just received a very strange letter. Seems my local police department has identified one of my residents as an undesirable; they say he’s suspected of being a gang banger and is dealing drugs and tagging the neighborhood. They say that if I don’t evict

him, the police will prosecute me for allowing a criminal to operate on my property. I may even lose my property! The family has been there for several years, other than a couple bounced checks they have been model tenants. This is the first I’ve heard of this, no one has ever complained before, no complaints, no drugs, no graffiti or tagging around my building, Help! I can’t afford a vacancy right now, and I think that the police might be wrong, what do I do?

In this upside down and crazy world we live in today, this actually is a growing trend in law enforcement. With a judicial system acting more like a ‘catch and release’ fishing excursion than one that metes out consequences for truly bad behavior, law enforcement is focusing on the easier prey, landlords, in controlling crime in their jurisdictions. Rather than prosecute the criminal, many law enforcement agencies are taking the lazy way out and threatening the law abiding landlord, forcing them to evict the resident. Rather than locking up the

bad guys, seems like the current trend is to simply shuffle them off to another community. If the police are certain he is dealing drugs and tagging, seems like the right thing to do would be to arrest him, prosecute him fully and send him off to the “gray bar hotel.” If the letter you received is inconsistent with your experience with your resident, follow up with the police department by asking for documentation supporting their claim. Ask them to provide specific incidents, dates and times of wrong-doing. Have there been arrests on the property? Have illegal drugs been found there? Ask the office to identify any witnesses that would be willing to testify in court, if necessary. Ask other residents in the building, gather independent information. If the information you gather supports your resident’s involvement in criminal activity, take action immediately. Consult your attorney to determine if you have enough facts to

The balance of the material can be removed with a flat razor, either along the old bead or perpendicular to the bead. After all the material is removed, use a damp rag to remove any loose bits. Before installing the new caulk, be sure the area is clean and dry. You can use a wet/dry vacuum to suck up any water left over from your cleaning.

I have two units that have back to back kitchen plumbing that drain into a single pipe. They are constantly blocking up. We snake them on a regular basis, but to no avail. How can I solve this problem? Julia

Dear Julia:

Unfortunately with two units draining into one drainpipe, you double the drain’s workload. This means the drain line has twice the grease, twice the soap

and twice the food etc. In this case we will assume that your waste plumbing system consists of galvanized & cast iron piping. These two types of metal drainpipe’s inner lining tends to corrode and become rough and flake. This allows solid waste to form on the rough surface. A solution to the problem is to instruct your residents on the proper use of the garbage disposal. The water must be running before you turn on the disposer and continue running after the disposer is turned off. This will insure that the waste has been washed all the way down the pipe. The garbage disposer must run a sufficient amount of time to insure the proper breakup of the waste. The residents should also be instructed to feed the disposer slower, and not to cram food down the drain. For persistent drain problems, we highly recommend getting the drain line Hydro Jetted and then have the line inspected with a camera. This will Maintenance — continued on page 18

I’m starting a rehab in my unit’s bathroom and thinking of replacing the shower curtain as part of the work. A shower curtain is a fast and easy job. What are the pros and cons of a shower door versus a shower curtain in

my rental unit’s bathtub? How do you install a shower door? I don’t want to poke holes in the bathtub. Bryan

Dear Bryan:

While appearing as a guest on “The Tonight Show” one evening many, many years ago, famed hotelier Conrad Hilton was asked by his host (Johnny Carson) whether he had a “message” for the American people. With great gravity, Hilton paused momentarily before turning to the camera. “Please,”

he pleaded, “put the shower curtain inside the tub!” Keeping with Mr. Hilton’s thoughts, we are big fans of shower doors as opposed to shower curtains, because residents also leave the shower curtain outside the tub. Shower door installations are a great do-it-yourself project, because it is easy to do and the results looks great. After removing the existing shower curtain, clean the tub and walls to remove any accumulated soap scum. Measure the tub ledge wall to wall and subtract 3/16th of an inch (to leave room for the wall channels) and transfer the measurement to the bottom rail track of the shower enclosure. After measuring twice and cutting once, temporally set the bottom track on the tub ledge and tape it in place. Next, set the wall channels in place, use a level to make sure it is plumb with the wall. Mark the mounting holes of the wall channel with your pencil. Do the same thing for the other side. Remove the channels and before drilling, center punch the hole mark to keep the drill bit centered. If drilling through tile, use a ceramic drill bit. Once you have made your holes, insert wall anchors. Now you are ready to set the bottom track. Use adhesive caulk and if you feel the track may be abused, also use some Liquid Nails adhesive at several spots under the track. Remove any excess caulk and then use duct tape to temporarily hold the track in place. Before fitting the side channels, run a bead of adhesive caulk on the backside of the channel. Install the channel, use the supplied screws and bumper to fasten the channel to the wall, repeat on the other side. Wipe away any excess caulk. To install the top rail channel, measure from wall to wall at the top of the wall channels. Subtract 1/16 of an inch and cut the top channel to that length. Again, measure twice. The top channel should fit snug between top of the wall channels. Lastly it is time to hang the doors and adjust the fit. Most doors come with good instrucMaintenance — continued on page 20

Amenities — continued from 24 Additional spaces that empower apartment residents to do what they traditionally haven’t been able to do at home include bike stations with tools to fix bikes, as well as washing pets in pet spas and outdoor theaters. That’s not to mention unique additions to existing spaces, such as fitness on demand systems that allow residents to participate in popular fitness courses virtually rather than with an instructor who hosts them onsite. “Some of it is wow factor and some of it is about basic needs,” says Maria Banks, Senior Vice President at AMLI Residential, a developer and operator of apartment communities throughout the United States. “There are a lot of different factors that go into our decisions on amenities.” One big factor is whether those amenities are going to be used by residents and for how long. Many of the amenities that were developed for communities some decades ago—

racquetball courts, theater rooms and even tennis courts—no longer are being used. New communities today are replacing those amenities with indoor game rooms, golf simulators and outdoor theaters. Despite the popularity of these newer amenities, some developers are asking about the return on investment (ROI). “When people ask me what’s the ROI on that amenity space, I sort of cringe,” Banks says. “I will not throw out a number. It’s just not possible to know what the return is.” Yet the amenities race continues and is going beyond just physical spaces to events and services that improve the resident and prospective resident experience. “We look at the amenity space and the building as a whole,” Banks says. “Part of what offsets the building shell is the people. What’s the customer service? That fits into the value equation.” Customer service is being expanded to include convenient services, such as helping new residents update their

contact info with multiple service providers, discounts to local retailers and package management. “Think about the last time you moved,” says Ash Bell, Vice President and Executive Director of Updater, a service that updates contact information for new residents. “At first, you feel a little excitement because you’re moving into a new place. But then reality sets in and you have to update all of your information with your service providers. That’s painful and it creates a little nausea.” By removing pain points through customer service and third-party providers and implementing amenities that empower residents to do things they normally wouldn’t be able to do, the amenities arms race becomes a little easier to manage. A Break is a Break: California Supreme Court Rules That Rest Breaks Must Be Duty Free

D

ecember 22, 2016, the California Supreme Court ruled that employers must provide their workers with duty-free rest breaks or face potentially devastating financial consequences. Most California employers know that state law generally requires you to provide meal and rest breaks to non-exempt employees during their work day, and failure to do so could result in being forced to pay an additional one hour of pay at the employee’s regular rate of pay. As today’s California Supreme Court decision in Augustus v. ABM Security Services, Inc. illustrates, failure to comply with these often onerous requirements can lead to overwhelming financial liability. By resurrecting a $90 million award against the employer for failing to provide proper rest breaks to its security guards, today’s decision was not only an early Christmas present for the plaintiffs in this case, but for potential plaintiffs across California. The decision has important ramifications for employers in all industries, so you should familiarize yourself with the facts and the holding to avoid a similar

Court Concludes That Employer’s On-Call Rest Break Policy Violates California Law

ABM Security Services employs thousands of security guards at locations throughout California. For the past decade, it has battled a class action lawsuit brought by some of its former security guards alleging that the company failed to properly relieve them of all duties during their legally mandated rest breaks. ABM requires its guards to remain on call even while taking their rest breaks. This means the guards need to keep their cell phones or pagers on during their rest breaks in order to respond when certain needs arise (such as when a tenant wishes to be escorted to the parking lot, or an emergency situation occurs). According to ABM, however, guards are rarely interrupted to perform any of these tasks and are otherwise permitted to engage in various non-work activities during this time, including smoking, reading, making personal telephone calls, attending to personal business, and surfing the internet.

Late in 2014, the Court of Appeal found that this on-call rest break policy was permissible. On December 22, 2016, however, the California Supreme Court reversed the lower court and concluded that the policy violated California’s rest break law. The court held “state law prohibits on-duty and on-call rest periods” and “employers must relieve their employees of all duties and relinquish any control over how employees spend their break time.” Based on today’s ruling, the requirement to relieve employees of all duties now clearly applies to both meal and rest periods.

The Nature Of Rest Breaks Requires Employees Be Relieved Of All Duties

The concept of a “rest break” is not specifically defined in the Labor Code or Wage Orders. In the absence of a specific definition, the Supreme Court determined the reference to a rest period in Wage Order 4 evokes the ordinary meaning of rest, which one would consider as meaning “an interval of time free from labor, work, or any other Break — continued on page 30

Break — continued from 28 employment-related duties.” Further, in the court’s view, it makes sense that an employer’s responsibility to relieve employees of all duties during rest periods is par with the same responsibility for meal periods. The Court stated that an employer cannot satisfy its obligations under Wage Order 4 by requiring that employees remain on call. It explained that an on-call rest break is unworkable because employees simply could not use the 10 minutes to take care of other personal matters that require uninterrupted time. Therefore, it determined that requiring an employee to carry a pager or respond when the employer seeks contact with the employee is irreconcilable with the requirement of duty-free rest periods. Justice Kruger’s concurring and dissenting opinion complained that a requirement to carry a pager does not necessarily prevent an employee from taking brief walks, making phone calls, or otherwise using a rest break for their own personal purposes. Her pleas for a more common sense approach to the issue, however, were rejected by the majority opinion, which frowned upon a requirement to wear a pager during a rest break.

The Mere Possibility Of Being Called Back Does Not Invalidate Breaks

California employers should understand that even under the “relieved of all duty” standard, the mere possibility that an employee may be called back to work does not invalidate a meal or rest break. If your policy provides employees with rest breaks where they are relieved of all duties and occasionally these breaks are interrupted, then you must pay the one hour penalty pay on those rare occasions or provide the employee with another uninterrupted rest break. The court distinguished this scenario from policy in this case, which specifically required its guards to remain on-call during their rest breaks.

A Limited Exemption Process For On-Duty Rest Breaks

The Supreme Court did note that employers can seek relief through a Division of Labor Standards Enforcement (DLSE) exemption process. If you can demonstrate that relieving employees of all duties during rest breaks would pose an undue hardship and will not materially affect the welfare or comfort of the employees, you could be relieved of your standard obligations. However, applying for the exemption from the Labor Commissioner may trigger an investigation of your break practices, so it is a risky proposition. Also, the

exemption is not retroactive and would only apply prospectively from the date it is granted.

Action Items For California Employers

In light of the Supreme Court’s decision in this case, you should make sure your rest break policy does not contain any on-call requirements such as remaining reachable by pager, phone, or by other similar means. In rare circumstances, it may make sense for you to apply for an exemption from duty-free rest breaks. However, you should seek legal counsel to help evaluate whether it makes sense to apply to the DLSE for an exemption. It is equally important to consider having counsel review your meal and rest break policy and practices. This will help you assess your organization’s risk of a potential crushing financial liability resulting from a relatively technical violation of California’s strict break requirements. Follow Up Tips BY MINDY WILLIAMS

tudies have shown the more you follow up, the more you’re apt to make the sale. Always, always ask for permission to follow up, as well as for the best method to follow up (phone, text, email, etc.). If you make an appointment with a prospect, follow up and confirm the appointment. It is perfectly acceptable to follow up on the morning of the appointment as a reminder. “Hi Joe! I’m looking forward to seeing you today at 1 pm. Our first stop will be the 2BR overlooking the pool I mentioned yesterday. I’ve included directions to our community. See you at 1 pm.” What do you do if you’ve done everything “right” by following up, seen interest from the prospect, sent back up information to the prospect and she still hasn’t gotten back to you? People get busy. There are a zillion different reasons (including analysis paralysis) to not hear back from someone. The trick is staying in contact without being annoying. Keep an arsenal of moving

tips/neighborhood tips/coupons, etc. that you can that are valuable to the prospect and an easy way to stay in touch. Very few people are going to get mad at you for sending a $3 off coupon to the local Starbucks...or buy-one, getone sandwich at the local deli...(all deals you can work out with local businesses).

Make Your Follow Up Memorable

To help your community (and you) stand out, make your follow up interesting or fun or useful. Include moving tips, places to get free moving boxes or discounted trucks, or even something inexpensive like a lollipop. As an offshoot — test sending your follow up messages at different times of day to see if you get a better response during a certain time. For instance, studies show most people will read an email sent at the beginning of the work day (9 am) but not at lunch time (12 noon–2 pm). See what times work best for you in getting a reply. Agent Representation from Cash In on the Myths of Real Estate

S

electing the right real estate agent as your representative can be a critical component not only in terms of protecting your interests from a legal standpoint, but also in meeting your long-term, wealth-building goals. All too often, investors ignore the important advisory role that a good

real estate agent can and should play. Many think that agents exist simply to provide them with those great “inhouse” deals and to handle the paperwork. There is a lot more involved and a lot more at stake. In my book, Cash In on the Myths of Real Estate, I have included separate

chapters devoted to the fundamentals of buying and selling residential income properties. Both of these chapters include the same myth, but from two different perspectives. Each relates to the relationship formed between agents and their clients. The key lies with you, not with the broker or the agent.

Popular Belief: Sellers pay the commission, so their agents are going to act in their best interest. Bill’s Truth: There are many great agents who put their clients’ needs first. However, a listing agent is hired specifically to sell a property and, sometimes, he or she becomes overly focused on concluding the transaction rather than upon achieving what might be the best outcome the seller. First and foremost, do not be pressured into any deal — be it an initial offer or a requested concession. You and your agent should be ready to walk away from any transaction at any point in time. Also be wary of dual agency situations. For many reasons, agents are encouraged to keep both sides of a transaction in-house. An agent who represents both the buyer and the seller can double-end the transaction and receive nearly twice the commission. Even if another agent from the same office is involved, the broker of record not only makes more money, the office gains the added benefit better transaction numbers. Having presented this disclaimer, double-ending the transaction may be advantageous to all involved. Transaction fees, escrow compliancy, and timing are often more easily controlled when all parties are represented in-house. Also, the agent has the comfort of working with people that he or she knows and by having the same broker overseeing everything.

Consider your agent to be your real estate doctor. You need to be able to rely upon his good judgment and trust that he has your best interests at heart. Cash In: Take the time to get to know and trust your real estate agent.

The Cash In for this myth says it all. You and your real estate representative need to be on the same page regarding what you are seeking to accomplish. Although this understanding is often shared on a transaction-by-transaction basis, the true value lies when the two have you have spent enough time together so that the representative fully understands and supports your longterm objectives. Ideally the two of you have worked out a plan of action and you regularly review how your portfolio is performing and the progress being made toward achieving the goals that you have set for each of your investments. With this information in hand, evaluating the merits of a particular offer or even setting the price for a sale becomes a much easier process. In an upcoming article for the AAOC’s 2017 Resource & Legislative Guide, I am focusing on what types of questions to ask when selecting an agent. None of these have anything to do with evaluating a particular transaction. They all focus on finding that representative and creating a professional consultancy relationship. A real estate agent with the experience and professional knowledge that melds with your needs is a resource that you should call upon often and frequently. Just as a footnote. Throughout this article and my book, I use the term “agent” as the individual representing a buyer or seller and that of “broker” as the person who serves as the Broker of Record, overseeing all transactions conducted within an office. In many instances, real estate agents have completed the additional coursework and testing to function as licensed brokers. However, there is only one Broker of Record for any given office. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office. Debunking the Myths About Seismic Retrofits B y A li V ahdani The team at Optimum Seismic has been retrofitting buildings, bridges and other structures since the 1980s. We have completed more than 1,700 seismic retrofits and are well-versed in the science behind the engineering and construction process. As a part of our corporate mission, we strive to set the record straight about retrofit construction. People frequently ask, “How much is it going to cost me?” “Will my tenants have to relocate?” “Why should I do it now?” It’s time to clear the air about these issues and debunk the myths.

Myth No. 1: It is too expensive.

Researchers at Caltech recently determined that for every dollar spent in retrofitting soft-story structures, property owners could expect to save up to seven dollars, and that study didn’t factor in loss to contents, alternate living expenses or deaths and injuries — all of which would have significantly increased the cost-to-benefit ratios. The cost of an earthquake retrofit varies depending on the size, design and construction material used in a building. Many cities are offering special low-cost loan programs and allowing apartment owners to recoup some of the cost through rent increases.

Myth No. 2: My tenants must be relocated

In most instances, earthquake retrofit construction can take place without having to relocate any tenants. It’s important to look for a seismic engineering and construction company that can accommodate tenants while doing the work. Much of that entails their construction schedule, whether they cover and clean up their work to avoid disrupting tenants during non-business hours, and if they have experience in completing retrofits on time, on budget and without any complications in Tenant Habitability Plan (THP) process.

Myth No. 3: I will lose parking spaces if I get the work done

Many apartment owners worry that a seismic retrofit will permanently consume parking spaces due to the installation of steel moment frames, or that parking spaces will be closed during construction. It’s true that seismic retrofits of softstory structures generally focus on stabilizing the building at the ground-floor level where the parking is located. But that

doesn’t mean that spaces need to be lost. Be sure to look for experienced seismic retrofit engineering and construction companies to do the work so you don’t lose those spaces.

Myth No. 4: I have plenty of time

Many of our clients are motivated by protecting their investment and the safety of their tenants. They also know that as the deadline draws nearer, costs for the retrofit work will increase and construction timelines will be far more complicated and uncertain. Case law has now set a precedent that puts the responsibility for death, injury or property damage in the hands of the property owner. A recent case out of Paso Robles found property owners liable for the deaths of two people during the San Simeon earthquake of 2003. A jury awarded the families of the victims $2 million, concluding that the property owners were negligent for not making the building safer even though the ordinance gave them several years to complete the work. A state appeals court upheld the verdict in 2010.

Myth No. 5: I’ll be Covered by FEMA and/or Insurance

Assistance from the Federal Emergency Management Agency (FEMA) usually comes in the form of a low-interest loan, which would need to be paid off along with a building’s existing mortgage. FEMA awards grants only to people who cannot qualify for those loans, and most of those awards are relatively modest — averaging approximately $5,000 to provide money for families to find temporary housing. Earthquake insurance, depending on the terms of the policy, can be very helpful in addressing not only losses to the structure, but also loss of income when tenants have to move. This is particularly important when apartment owners have a lot of equity in their buildings, or for those who are dependent on the revenue stream from their properties to pay their mortgage or fund their retirement.
