partment owners and newspaper front pages don’t have the best relationship. Unfortunately, they tend meet under extreme circumstances such as five alarm fires, discrimination claims, allegations of safety violations and questionable preventative maintenance plans. Yes, most of our generous acts and positive qualities are reserved

for advertisements or paid editorial entries. Even still, I was shocked to read Jeff Collins’ late January piece in the Orange County Register entitled “Record Rents Pinch Tenants”. While the article did point out several truths on the affordability of housing or lack thereof in Orange County at present, it was far from objective. Instead, the front-page article served as a one-sided slant piece against apartment owners who were depicted

NAA Community Site & Online Resource Center Now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester. as unscrupulous moneygrubbers concerned more about lining their pockets with profits as opposed to caring for resident concerns. The resounding theme of the article was that in today’s economy, renters are forced to sacrifice cleanliness and safety for affordability and savings. Often times skipping out on extracurricular activities in order to pay rent while being forced to live with things like cockroaches and criminal activity. A suggestion that is more outrageous than the rents on the Irvine Company’s new development projects being quoted in the article as the going market for Orange County. Get $1,324 for a studio apartment in Placentia or La Habra lately? What about $2,200 for a two-bedroom unit in Anaheim or Fullerton? Didn’t think so. As someone who studies operating information and statistics for a living and reviews dozens of market surveys each month, I couldn’t help but wonder about these figures. Sure, there are more renters in the marketplace today as a result of the high barrier to entry in the for sale residential market, chronic homelessness being down 20% and millennials are becoming increasingly active in the marketplace (as are baby boomers), but absent a refinance or significant change in operation, I am not seeing this exorbitant increase in profit that is suggested by the sensational front page headlines. President — continued from page 4 owners, compared bottom line data and came to the conclusion that much of the increased revenue is getting swallowed up by more significantly increasing operating expenses. But just how much? You might be surprised. The National Apartment Association, National Multi-housing Council and the Institute of Real Estate Management collect operating data from apartment owners and managers each year. After digesting the information, they generate reports that are made available to members to compare and contrast to the operations of their own properties and portfolios. These reports are compiled from all property types (garden style, low-rise, high rise/ elevator), sizes and vintages. And contrary to the information included in the Register, these aren’t brokerage house statistics highlighting artificial rates that are being used to drive deals. This is actual operating data.

In looking at 1960s or newer garden style communities in Orange County, we see that from 2011 to 2014, rents increased by an average of $1.75 per square foot, roughly a 14% increase. Over the same time period, operating expenses grew from $6.13 to $10.30 per square foot, a $4.17 per square foot increase, which represents a whopping 68.03% increase in operating expenses. Could you imagine such an increase in your rental income or total collections? On average, this skewed separation caused a decline of Net Operating Income generated on a per square foot basis from $10.38 in 2011 to $9.33 in 2013, which means that owners actually had less money to pay their debt service and ultimately, less money to pay themselves. But my favorite statistic of all was that over the same time period owners increased their capital expenditure spending by 39% or 20 cents per square foot. Upgrades to the interior and exterior of their owned property became more of a priority in spite of

dwindling profits. So while Mr. Collins conjures up the image of the absentee slumlord promoting unhealthy living conditions, the numbers say otherwise. Unless you take the time to focus on operations and identify cost savings in the day-to-day management of your property and across your portfolio, you will fail to soften the impact of these rising operating expenses and you never know, you just might become a statistic. Sure, rents will continue to rise as will operating expenses, but apartment owners will still reinvest in their properties. Multifamily housing, by and large, is still the number one, undisputed source of quality, affordable housing in the Southern California area. property owner. Prior to Proposition 13, the average tax rate was 2.67 percent. Today, base property taxes are 1 percent of their assessed valuation. But that is all set to change, unless “We The People” again take the helm of our good ship of state. Recently, local elected officials were solicited by a San Francisco-based organization called “Evolve” looking to drum up support for an effort to change Proposition 13 by reducing and/or eliminating its protections for commercial properties.

This $6 billion tax increase will show itself in higher rents as building owners recoup the taxes from their tenants. Further, according to a recent study published by Pepperdine University, the so-called “split roll” will result in a loss of 390,000 California jobs initially and the continued loss of 100,000 jobs each year thereafter. Rest assured, if the tax hike folks from San Francisco are successful in splitting homeowners and commercial property owners now, they will be back in the future to raise taxes on

ast month’s report on legislative activity in Sacramento covered a healthy variety of old issues, including water, taxation, wages, and miscellaneous matters. This month saw a continuation of that activity in the form of a few more bills on the same general theme as well as striking out in new territory. Here is an update on several more bills of particular interest to owners and managers of residential rental properties. Senate Bill 47 (Hill) would require the Office of Environmental Health Hazard Assessment, by July 1, 2017, in consultation with the Department of Resources Recycling and Recovery, the State Department of Public Health, and the Department of Toxic Substances Control, to prepare and provide to the

Legislature and post on the office’s Internet Web site a study analyzing synthetic turf, as defined, for potential adverse health impacts. The bill would require the study to include certain information, including a hazard analysis of individual, synergistic, and cumulative exposures to the chemicals that may be found in synthetic turf, as provided. The bill would prohibit a public or private school or local government, until January 1, 2018, from installing, or contracting for the installation of, a new field or playground surface made from synthetic turf within the boundaries of a public or private school or public recreational park, as provided. Senate Bill 67 (Galgiani), a counterpart to the Assembly ADA legislative proposals, would except a small busi-

ness from statutory damage liability in connection with a construction-related accessibility claim, as described above, and would instead limit recovery to injunctive relief and reasonable attorney’s fees as deemed appropriate by the court. The bill would also extend the period for correcting constructionrelated violations that are the basis of a claim from 60 days to 120 days of being served with the complaint, for purposes of reducing a defendant’s minimum statutory damage liability to $1000. The bill would make conforming changes in a notice a plaintiff is required to serve on a defendant in an action that includes a constructionrelated accessibility claim. Senate Bill 140 (Leno) would change the Stop Tobacco Access to

Kids Enforcement (STAKE) Act definition of tobacco products to include electronic devices, such as electronic cigarettes, that deliver nicotine and make furnishing such a tobacco product to a minor a misdemeanor. This bill would change the location restrictions for smoking cigarettes and other tobacco products to include the STAKE Act’s new definition of tobacco products, and would make the use of electronic cigarettes in some of these restricted locations a violation punishable as an infraction. Assembly Bill 14 (Waldron) would create the Unmanned Aircraft Task Force. The task force would be responsible for formulating a comprehensive plan for state regulation of unmanned aircraft. The task force would be required to submit, among other things, a comprehensive policy draft and suggested legislation pertaining to unmanned aircraft to the Legislature and the Governor on or before January 1, 2018. The bill would provide that these provisions are repealed on January 1, 2022. Assembly Bill 37 (Campos) and Assembly Bill 56 (Quirk) would each generally prohibit public agencies from using unmanned aircraft systems, or contracting for the use of unmanned aircraft systems, as defined, with certain exceptions applicable to law enforcement agencies and in certain other cases,

including when the use or operation of the unmanned aircraft system achieves the core mission of the agency and the purpose is unrelated to the gathering of criminal intelligence, as defined. Assembly Bill 45 (Mullin) would express the Legislature’s intent to enact legislation that would establish curbside household hazardous waste collection programs, door-to-door household hazardous waste collection programs, and household hazardous waste residential pickup services as the principal means of collecting household hazardous waste and diverting it from California’s landfills and waterways. Assembly Bill 201 (Brough) would state that a local agency is not preempted by state law from enacting and enforcing an ordinance that restricts a registered sex offender from residing or being present at certain locations within the local agency’s jurisdiction. The bill would authorize a local agency to adopt ordinances, rules, or regulations that are more restrictive than state law relating to a registered sex offender’s ability to reside or be present at certain locations within the local agency’s jurisdiction. Assembly Bill 205 (Wood) would extend to the City of Eureka in the County of Humboldt, the City of Fairfield in the City of Solano, and the Counties of Humboldt and Lake special

registration provisions applicable to vacant real property in the Cities of Palmdale and Lancaster in the County of Los Angeles or the City of Ukiah in the County of Mendocino. By expanding the scope of the crime of perjury and by imposing new duties on local law enforcement agencies, this bill would create a state-mandated local program. Assembly Bill 237 (Daly) would require, before the adoption of any new parcel tax, the legislative body of a local agency, as defined, to provide at least 90 days’ notice of the vote to enact the proposed parcel tax to the owner of each parcel affected by the tax. This bill would require the notice to include specified information and to be provided to the property owner in a specified manner. This bill would provide that the local agency may recover the reasonable costs of the notice from the proceeds of the parcel tax. With 10 new Senators and 37 new Assembly Members, one can reasonably expect much more to come before the late February legislative deadline for new bill introductions. Stay tuned. Jon D. ne of my long term residents wants to change apartments. He’s been a great tenant, no problems, always pays on time, I’m OK with his request but want to know the best way to handle it. What are my options?

There are a couple of ways to handle the transfer. The issues of surrender of possession of the existing unit, inspection of the condition of the existing unit,

transfer of and/or payment of security deposit for the new unit, assurances that the resident fully performs as agreed should be addressed. Typically, most lessors would treat the transfer as a separate and distinct transaction, requiring the preparation of a new tenancy agreement for the new soon to be created tenancy at the new Premises. The new rental agreement will identify the new Premises, and will state all of

the terms that you have agreed to. Prior to executing the new rental agreement, you should inspect the current Premises to ensure that there is no damage, that there are no unauthorized and unknown sub-tenants that might complicate the transfer, and that the existing security deposit will either be available for transfer and/or the resident is able to Q&A — continued on page 14

The termination of the existing tenancy should be conditioned upon the commencement of the new tenancy and the full and faithful performance of the agreed upon terms. The execution of a new tenancy agreement would serve to restart the clock, so that an existing tenant, who had resided in the former Premises for over a year, would only require service of a thirty day notice to terminate the tenancy for the new Premises up until he resides there for one year. Alternatively, many Lessors will simply prepare and execute a lease addendum whereby the Premises address is changed from the existing unit to the new unit. Unless the issues above are addressed in the addendum, this can be problematic for a variety of reasons, i.e. an unknown sub-tenant remains in the vacated unit, there is damage, or some other complication that arises during or after the effective date of the addendum. properly drafted, the resident may be entitled to sixty days’ notice of termination for the new unit even though he has not yet resided in the new unit for one year.

When I serve my three day notices to pay rent or quit, I know that I’m supposed to include some information directing the tenant where to pay and when. I heard that some judges are requiring additional information be put on the notice. Can you explain these requirements?

Of course. When preparing a three day notice to pay rent or quit be certain that you are using the most current forms provided by your apartment association. By statute, you are required to ‘state the amount of rent due, the name, telephone number, and address of the person to whom the rent payment shall be made, and if payment may be made personally, the usual days and hours that person will be available to receive the payment.’ Most judges interpret this requirement as allowing the name of an owner entity, i.e. an LLC or partnership name, to be stated as the “name of the person” to whom payment should be made rather than an individual person’s actual name. Recently some judges are interpreting this provision to require the actual name of a person, an individual, to deliver the rent to, rather than merely stating the name of the entity owner to whom the payment should be made payable. growing trend and a defense commonly raised by tenant advocates, it is best to anticipate the defense and include the name of the actual person that is authorized to accept the rent payment. Additionally, ensure that the address provided for payment is an actual physical address where the rent may be tendered rather than a PO Box or a drop box. If a physical address is not stated on the notice, then California law provides that the rent will be deemed received by you on the date of mailing if the tenant provides evidence of the mailing, whether or not you actually received it!

When my most recent resident moved in several months ago, he deducted one hundred dollars from his second month rent because he said he had to fix a few things in the unit. I didn’t say anything at the time, I needed the unit rented, and I didn’t want to upset my new tenant. Since then, he has been able to find something wrong each and every month, deducting a little bit each time. I told him I didn’t think that was right, but he did it again this month. He told me that California law says he can “repair and deduct” for anything wrong in his apartment. Is this true?

These limited circumstances require the tenant to give the landlord notice of the dilapidation before using the repair and deduct remedy. After giving notice, the landlord has a “reasonable time” to make the repairs, before entitling the resident to repair and deduct. Only defects that are serious, and render the premises uninhabitable will qualify for this remedy. Tenants may only invoke this remedy twice in any twelve-month period, and each time the remedy is utilized, the deduction cannot exceed one month’s rent. In your situation, it appears that the tenant is abusing a privilege that is reserved for tenants with serious dilapidations in their apartments. Without providing notice to you of the defect, and an opportunity for you to correct any serious defect, the tenant is not entitled to deduct anything from his

passed an extension of the Terrorism Risk Insurance Act (TRIA) less than a week into the new session. The President signed it shortly thereafter, taking off of the table an important issue for the apartment industry and many other business sectors. Rarely does this happen, but after the last-second fumble (I won’t say interception out of deference to our friends in the Pacific Northwest) by the Senate on TRIA, I think everyone felt obligated to move quickly. Not a bad way to start things off. And now cue the wet blanket. The next imminent issue will not result in such a kumbaya moment between the Congress and the White House— funding for the Department of Homeland Security. This one area

of the federal budget was short funded last year so that Congress could leave itself an opportunity to try and stop the President’s executive order on immigration. The House passed its bill, but the Senate was unable to get past the 60-vote threshold to take up the legislation so now Republicans must come up with a Plan B. If they allow the funding window to close, they could face blowback for shutting down a critical agency responsible for protecting the nation. If they drop the injurious language in order to draw Democrats and pass the legislation, Mitch McConnell (R-Ky.) faces cannon fire from the likes of Senators Cruz (R-Texas), Lee (R-Utah), Paul (R-Ky.) and Rubio (R-Fla.) inside the Senate not

to mention the legions of conservatives on the outside who demand the GOP do something to stop the President. This topic has helped to keep the overall issue of immigration reform on the front burner for the Congress and some action could still occur in the next two years. NAA is engaged with lawmakers as these conversations take place. Speaking of partisan hot buttons, the House Republicans voted for the 56th time this month to repeal the Affordable Care Act (ACA). While they know they lack the votes in the Senate to pass the legislation, leadership needed to give their new members the opportunity to go on record. Interestingly, for the first time since the law was passed, there were GOP defectors. Three Republican House members voted against the legislation on the grounds that without a fully cooked alternative to the ACA, it was irresponsible to repeal the law when that would result in thousands of Americans losing health care coverage. This narrative is gaining strength not only because of Congressional action but because of a looming decision by the Supreme Court of the United States (SCOTUS) in regards to subsidies provided through the ACA. In the case of King vs. Burwell, the SCOTUS is considering whether or not the ACA allows for tax credit subsidies for eligible enrolled participants in all states or just those states that have their own health care exchanges. Should the Court rule that it does not, then those individuals in states that use the federal exchange will immediately lose their subsidy and in theory their health care coverage. Estimates are this could be as many as 9 million people. Both sides of the debate agree that this ruling by the Court would be a deadly blow to the law, but they obviously disagree as to whether that is a good thing or a bad thing. It’s also worth noting that the issue could be remedied by impacted states if they simply started their own

Federal Focus — continued from page 19 exchange. This of course costs money and takes a lot of time but would allow their residents to receive tax credit subsidies again. This will be the most significant development in regards to the ACA since the SCOTUS ruling on the individual mandate. Four years since its passage, the ACA is still a touchstone for Republicans in Congress. There has been somewhat of a shift from simple repeal to repeal and replace. There are even some, especially in the Senate, who want to move on to other priorities. Still, saying you hate the ACA and voting to repeal it are check-the-box exercises which every Republican must do in order to stave off primary challenges. The good news is that the President has given the GOP lots of new targets to fire at— immigration, the war with ISIS, the federal budget and tax policy. In other news, Senate Majority Leader McConnell and the President

each got an early valentine from Senate Democrats this month. McConnell got the votes he needed to pass legislation approving the Keystone Pipeline project. This legislation will pass the House and then go to the President before the end of the month. The President will now— assuming he sticks with his threat on the bill—be able to veto his first bill of the 114th Congress. That will mean a 50 percent increase in vetoed bills since the start of his presidency (he has only vetoed two bills since taking office in 2009). Meanwhile, McConnell will have evidence that he can govern in a divided Senate, even with less than 60 votes. Time will tell if he can replicate this success in other substantive areas and whether those additional successes will also result in a Presidential veto. ear Maintenance Men: My residents are complaining about their electric hot water heater. They say they are only getting about five minutes of hot water while in the shower. How can I fix this issue? Jerome

Dear Jerome: The most likely problem is a faulty lower heating element. If the hot water

was a long time in coming, the issue would be in the upper element. The lower element typically goes out first as it works harder because the cold water enters the tank at the bottom. The job can be as simple as shutting down the electrical breaker to the heater and replacing the lower element and you are back in business. However, if the lower element is buried in sediment, that means the tank is full of calcium

deposits and a new element will only short out if replaced. If the tank if full of sediment, it is time to replace the tank, as there are no clean-outs on a residential electric water heater. A long term solution for your new water is to flush out the tank at least once a year to keep sediments from building up in the bottom of the tank. Maintenance — continued on page 24

Maintenance — continued from page 22 Dear Maintenance Men: The rental office at my building has a pond. It needs constant attention to keep the water clear. We want to stop putting in chemicals so fish and plants can live in the pond. What can we do to keep the water clear without chlorine? Greg Dear Greg: We have the perfect solution for you. It is called a bio-filter. A bio or biological filter is a natural filter that never or very rarely needs to be cleaned. They are easy to construct from a Rubbermaid stock tank, a large flower pot or even a plastic trash can. The size of the filter tank will depend on the size of the pond. As an example a 2000 gallon pond will need a 70 gallon filter tank. How a bio-filter works is through a bacteria process in the filter that scrubs the pond water clean. Pond water is pumped into the bottom of the filter

tank and percolates through a filter medium and flows out the top of the filter tank through a pipe system. (The filter tank is not pressurized.) A number of items can be used as filter medium such as a mixture of threaded pvc elbows, cut up green scrub pads or cut up commercial floor scrubber pads. Put all the filter medium in mesh bags to keep them together and stuff as much as you can into the filter tank. A dead water area with a drain valve at the bottom of the tank is important to release any sludge build up. Set up a dead water area with a grate or inverted mesh basket to keep the filter media a few inches above the bottom and to give the incoming pond water a chance to swirl into the filter tank. As stated above, these filter pads and pvc parts will never need to be cleaned and the dirtier they get the better they work. A bio filter takes time to work as nature needs to breed the bacteria that will become the heart of the filter. Expect a six to eight week time period for the

filter to fully develop and after that you will never think about it again! As a bit of camouflage, there is nothing wrong with growing water lilies in your tank! After my new residents moved in, they said the gas burner on the stove would not light. The pilot light is ok, but the burner will just not light automatically. I’m pretty sure the stove worked just fine when the old resident moved out. What could have changed in such a short period of time? Sally Dear Sally: No doubt you had a cleaning crew in the unit between the old and new residents. Sometimes the cleaning crew does too well of a job and the burner might be too clean!! Luckily this is an easy fix. Locate the pilot flame or electronic ignition point and follow the pilot tube

All Content Needs Good Design It may come as no surprise to most that valuable and engaging content is still the main ingredient in any social media strategy recipe. Possibly the best rule to live by when designing your website or social post is No Dead Ends for your visitors, meaning always providing a “next step” for the user to further engage with your content. A good example of this would be easy-to-use social sharing buttons that allow users to engage with and promote your content for you. Property Owners and Managers Are Needed to House OC Veterans BY KAREN ROPER

T

here are at least 446 veterans who are homeless on any given night in Orange County according to the 2013 Orange County “Point in Time Homeless Count”. In addition, to this number, there are more than 2,000 veterans with incomes below 50% of the County’s median income applied on the Orange County Housing Authority waiting list for housing assistance during a two-week period in February 2012. This demonstrates the immediate needs of local veterans

for basic shelter and for long term decent, safe and affordable housing. The 2013 Annual Homeless Assessment Report (AHAR) to Congress stated that many homeless veterans need supportive services and case management to successfully transition from homelessness to permanent housing. In addition, these veterans typically do not have the financial resources to pay rent. They may also face barriers such as poor credit, prior evictions or lack of funds for a security

deposit or other move-in expenses. To help address the needs of homeless veterans, the Orange County Housing Authority (OCHA) has applied for and received HUD Veterans Affairs Supportive Housing (VASH) vouchers. These Vouchers are reserved exclusively for homeless U.S. Veterans receiving services from the Veterans Affairs (VA) Medical Center in Long Beach. OC Veterans — continued from page 39 ment from the VA and also receive support from the Orange County Veterans Service Office, in combination with housing assistance provided by OCHA. This collaboration has proven successful in housing over 400 VASH veterans since the first allocation of 70 VASH Vouchers was awarded in 2009. OCHA recently received its 6th annual VASH Voucher award and can now assist up to a total of 580 homeless veterans. Approximately 70% of the currently assisted VASH veterans are single persons and the remaining 30% are families. Veterans who receive a VASH Voucher are able to shop for a rental unit of their choice and pay approximately 30% of their household income for their share of rent. OCHA pays the balance of rent directly to participating property owners and managers. In addition to providing monthly housing assistance payments, OCHA has also

secured other funding to help eligible VASH veterans with move-in costs such as security deposits. In addition to VASH veterans, OCHA is also issuing regular Housing Choice Vouchers to other Veterans who received priority placement on the Housing Choice Voucher Program waiting list. As a result, there are a record number of veterans with Housing Vouchers currently seeking rentals at this time and OCHA is reaching out to rental property owners and managers who can help our veterans find housing in Orange County. Those who are interested can list available rental units at no cost on OCHA’s referral listings by calling: 714/480-2866 or visiting OCHA’s website at OChousing.org. In addition to the OCHA programs, the VA has a program called Supportive Services for Veteran Families (SSVF) which is administered by various service providers in Orange County. SSVF is a housing-stability program, primarily

designed to help homeless Veterans and their households. Services may include payment of the move-in deposit and for non-VASH Veterans or payment of their rent for a short period of time. lower your monthly premiums. Since losing health coverage is considered a “qualifying life event,” you may sign up for insurance through the marketplace outside of the annual enrollment period. You normally have 60 days from the qualifying event to do so. To learn more about the Affordable Care Act and your insurance options, visit healthcare.gov. Another option: COBRA COBRA is a federal law that requires most employers to offer former employees group health insurance for 18 months after termination of employment or retirement. Although your insurance coverage may be continued at group rates, your monthly premiums may skyrocket since your employer will no longer subsidize them. In most cases, COBRA coverage is considerably more expensive than purchasing a new plan through the health insurance marketplace. If you elect to continue your group

health insurance coverage under COBRA, you should obtain other coverage as soon as possible after COBRA coverage ends. You’ll qualify for a special enrollment period for the health insurance marketplace when your COBRA coverage ends. If you decide to end COBRA coverage early, however, remember that your timing counts. Under those circumstances, you’ll be allowed to purchase insurance over the marketplace only during the open enrollment period. Enroll in Medicare at 65 If You’re Retired Medicare is the primary health insurance provider for most Americans 65 and older. You should visit your local Social Security office three months before your 65th birthday to enroll in Medicare. • Medicare Part A helps cover inpatient care in hospitals. Most people don’t have to pay premiums

for Medicare Part A. • Medicare Part B covers doctors’ visits. However, you will have to pay monthly premiums and copayments. You should enroll in Part B when you enroll in Part A unless you or your spouse work beyond age 65 and you have health insurance from your employer. Otherwise, don’t wait. •

Medicare Part D is the prescription drug coverage, which requires a monthly premium, which varies by plan, and a yearly deductible for this coverage. You also have to pay part of the cost of your prescriptions, including copayment or coinsurance. Costs will vary depending on which drug plan you choose.

Free Tax Prep Campaign As the year ends, tax season is just around the corner. Often, filing for taxes stirs up a lot of emotion for individuals and families who may feel overwhelmed by the process and how to prepare their returns accurately and on time. At Orange County United Way, we are proud to help lead the way for hard working families by connecting people to our Free Tax Prep program. Each year thousands of filers discover this great service and many more come back year after year. During the process, many discover that they may also be eligible for the Earned Income Tax Credit (EITC), an anti-poverty tax credit designed to bridge the wage gap for our community’s low-income workers. Each year, in conjunction with the IRS and nonprofit organizations across Orange County, United Way educates residents about this valuable credit. You may be surprised to learn that one in four Orange County residents live in poverty. While that number is alarming, the more surprising and little known fact is that the majority of these households have at least one member working full-time.* The EITC is designed specifically for the working poor and provides up to a $6,143 credit for eligible families. Best of all, these dollars go right back into the local economy, as families use the funds to pay for critical expenses including food, shelter, health care and clothing. Surprisingly, one in five eligible families do not claim this tax credit, leaving millions of unclaimed dollars in Orange County alone. A major barrier keeping families from accessing this credit is that either they do not file their taxes or private tax preparers miss the credit or charge extra for the family to claim it. Do you know a family that is struggling to make ends meet? Perhaps they are often short on rent or cannot pay at all. The EITC could go a long way in helping ease this financial burden and by helping your tenants access this credit, everyone can benefit from this tax season. Please share with your residents about how the Orange County United Way, the IRS and community based organizations all over the county are teaming up to provide FREE tax assistance to ensure residents are taking advantage of the EITC. Even if your tenants do not qualify for the EITC, they can still have their taxes prepared for free at one of the community sites if they make under $60,000. Tenants can call 1.888.434.8248 to find a site nearest to them, or go online and file for free at MyFreeTaxes.com.
