cross the country, housing affordability is making headlines. Whether the concern is building more housing, imposing rent control or figuring out how to expand the Section 8 voucher program, there are many options for advocates, legislators and municipalities to consider. Tenant advocates often push for rent control and 2018 is no exception. The threat of rent control has popped up in Long Beach, Inglewood, Glendale, Pasadena, Anaheim, Santa Ana, Sacramento and more. But in a state like California where we have ample firsthand examples of rent control and its many consequences (intended/un-intended), it doesn’t take much to realize how rent control makes a local issue a regional problem.

In 1979, the City of San Francisco enacted rent control and it took less than 6 years for the cost of housing to become so unaffordable that many residents began searching for a more cost-effective rental housing alternative elsewhere. Surprising, since the intent was to make housing more affordable, but as nearby Oakland was impacted by this increasing demand for housing, they too opted to enact rent control in 1985. With sample terms of 39 years and 33 years respectively, we have a pretty good look

So while it took rent control just six years to travel the 10 minute BART ride or 30 minute drive from San Francisco to Oakland, it has taken 33 years to make the 1.5 hour, 90 mile trip from the Bay Area to Sacramento. But through constricted development, continued economic and population growth along with rising costs in San Francisco and Oakland, an influx of Bay Area ex-pats has helped Sacramento emerge as one of the strongest performing rental markets in the United States.
Above or Below Average?
For some perspective, Sacramento’s average rent did not surpass $1,000 until 2014. Though not to discount the growth, larger percentage rates are often associated with smaller dollar amounts as we see in Sacramento. And since 2014, rents are up about 40% which puts the average rent in Sacramento at about $1,393. Year over year growth was around 8.1% which was the country’s highest reported growth rate for 2017. Of course, this is still more than $1,200 below the San Francisco average rent of $2,545. All of this growth has unions backing a measure to impose rent control and create an elected board to deal with rental disputes. It didn’t help in San Francisco and

didn’t help in Oakland, but it’s supposed to work in Sacramento? It’s time for advocates on both sides of the issue to work together to help make housing more affordable by making more affordable housing. Rental Market Sensationalism and Misrepresentation
I
t’s an honor to write from this post as Executive Director. We thank Lou Penrose for his tenure and wish him good luck in his future endeavors. Many recent articles addressing the local rental market are citing metrics that I believe totally misrepresent reality. For instance, a February 15 article in the Orange County Register referenced average Southern California rents of $1,900, and cases of $300 rent increases followed the next year with $160 increases. These rent increases probably occurred, but under what circumstances? Had the rents previously been hundreds of dollars below market? and for how long? Did the owner spend thousands or even tens of thousands of dollars per unit on modernizing the units and improving the property along with the surrounding area? Another statement heralded the following — “The Consumer Price Index shows Southern California rent has virtually doubled since 2000, with rents increasing 5.1 percent in 2017 alone.” This got me thinking about a 20-unit property I’m familiar with and after
wondering how it compared to those aforementioned sizzling numbers, I dug into the numbers. Here’s what actually transpired at this building from 2001 through 2017: While the Scheduled Income was up 68%, what happened with expenses I asked? Property taxes—up 63.6%, Insurance—106%, Electricity—16%, Gas—48.5%, Trash—61%, Water—96% and Maintenance was up 60%, from 2001, but these amounts are dependent on rehab expenses those years, number of units turned etc. That 60% also doesn’t take into consideration the reroofing expense I incurred during this period, nor exterior painting, replacement of windows, and a lengthy list of other improvements throughout this period. My point is that even though rents have risen, so has everything else! Why aren’t we seeing this side of the story? Let’s take a look at a larger portfolio and its actual data. At the February Santa Ana City Council hearing, longtime AAOC member Richard Julian of ARES addressed the council about a potential rent control initiative. ARES

owns nearly 1400 units in Santa Ana. They have spent tens of millions in renovations over the years improving these properties. During the last 5 years their rent increases averaged about 5.5%, which computes to $80–85/year increases. Moreover, Rick cites “We are spending tens of thousands per unit. We are upgrading some old eyesores into pride of ownership homes with great improvements to the communities. We have happy residents who appreciate the improvements and therefore don’t move.” This scenario is really more the rule than not. I think there is a strong story to tell that long-term holders are very responsible and are not raising rents above a fair threshold. I will not argue that there are some unscrupulous landlords and owners, but my experience is that the majority are good and fair people. Rent control is certainly the hot issue these days and I believe most articles use crazy anecdotal rent figures to sensationalize and promote the author’s thesis that rent control is a good solution and landlords are bad. Obviously, rent control is not the solution and most landlords are good people who are doing a great job of providing quality housing for those who need it. So how do we change the commentary that landlords are not bad, rich, greedy and unscrupulous? Instead that we are entrepreneurs, business owners, teachers, nurses and mostly just ordinary people providing a basic need while expecting an equitable return for our risk…

Fighting Back
T
he residential rental housing industry is under assault. Politically. Economically. Morally. Socially. The wide-spread negative narrative juxtaposed with California’s “housing crisis” has put residential rental property owners in the cross-hairs of complaint akin to the Robber Barons of the Old West. From city council chambers to the legislative halls of the Capitol the chorus of claimed avarice and greed follow in the wake of anecdotal examples of a few outlier’s excessive rent increases. The aberrant actions of a few have unnecessarily tainted the entire rental housing community. It brings to mind a favorite Pogoism: “We have met the enemy and they are us.” A number of very significant legislative proposals have surfaced in the wake of this industry criticism. We will report on these from time to time as the session heats up with committee hearings and floor votes. And we will look to you for grass roots support through active response to appropriate Red Alerts. While important in and of themselves, they pale in comparison with the most significant challenge facing the industry in last 20 years: a proposed ballot initiative coined the “Affordable Housing Act” that would gut the CostaHawkins Rental Housing Act, thereby paving the way for local enactment of strict forms of rent and price control on all rental properties. The proponents organized under the banner “Coalition for Affordable

Housing” have amassed over $1 million and collected the 25% signature threshold as of the end of February. It is expected that they will spend whatever it takes to get the ballot initiative qualified for the November 2018 statewide ballot. They have until June 25 to collect the 365,880 signatures need to qualify for the November General Election. It is past time for individual rental property owners to be complacent about the events and circumstances surrounding this industry. Our association is certainly not taking the important issues of the day lying down. We have and will continue to develop and implement a comprehensive action plan to actively oppose this proposed initiative. Every day we will be initiating or participating in worthwhile activities to inform our members and the public the actual and practical impact of the ballot initiative: • On single family homeowners that could face rent and price control mandates including the necessity to argue before rent boards for fair return. • On renters who unquestionably will find it extremely difficult to find replacement housing. • On property owners and renters when 58 counties and over 482 cities can define and implement a confusing array of rent control ordinances, charter provisions or regulations.

• On businesses, including the financial markets, and government. Notice to owners: Get involved. Support your association’s political activities and educate yourself about the major issues of the day. Join AAOC’s grass roots campaign against the proposed initiative. Talk to your friends and neighbors and local political representatives. Most importantly, talk to your residents. Let them know you are a faithful steward of your property and their wellbeing. Look at their circumstances from their viewpoint. Many if not most tenants are there by choice, not circumstance. Also, but not last, contribute financially to AAOC’s efforts to derail or defeat the proposed initiative. Yes, the issue is one of the biggest we have faced in sometime. s there anything I can do to increase my collection rate after I’ve evicted someone? Seems like after the Sheriff gives them the boot, these characters just disappear into the wind never to be heard from again. I know you see this every day, so I thought you might be able to share some thoughts that will help me get my money back from these deadbeats?
Of course. Start thinking collection before you even create the tenancy. It seems counter intuitive, sure, but your tenant screening process lays the groundwork for firms like ours to go after and collect the monies due you after the tenant vacates. A complete and verified application is the best start. Those crazy questions asking for references and emergency contact information is where a good collector will start to find that former tenant. A legible copy of a valid government issued identification is important as well. Make a photocopy of the first rent check you receive from your brand new tenant, then each month
compare the bank information to see if it changes. Copy any new check he tenders and put it in your file. You should ask your tenants for emergency contact information, i.e. cell phone, email, work phone, etc. on a regular basis, at least once every year. Phone numbers, cell and work change throughout the course of the tenancy, the best information is the most current. Generally, tenants fully co-operate at the inception of the tenancy and during the term prior to any dispute. Rarely do tenants refuse to provide such contact information as most recognize that it is needed in the event it’s necessary to contact the tenant during the tenancy in case of emergency. In the event of an eviction, make sure your attorney proceeds to get the money judgment for rent, costs and attorney fees. If the tenant skips, small claims court is generally the place to go to reduce the amount due to a judgment. A judgment, coupled with the information stated above, in the hands of an aggressive collection attorney will
dramatically increase the likelihood of securing a full recovery. Just opened up the mail, and what do you suppose was in it? A notice from my bank informing me that one of my tenant’s rent check was returned unpaid because he placed a stop payment on it. Imagine that, it’s now mid-month, no warning, no phone call, the deadbeat didn’t even have the courtesy of letting me know he was going to stop payment on his check. It kind of makes sense though, he asked a couple of weeks ago if I’d let him out of his lease early, guess his girlfriend has a nicer place and he wanted to move in with her. I called his phone number, got a recording saying that it had been disconnected. His cell phone works, got his voice mail, and left a message. I’m guessing that when I swing by later today, it’ll be empty. What do I do now? I don’t want to make any mistakes; can I just change the locks if he’s out? Q&A — continued on page 12

Q&A — continued from 10 You have a couple of issues that you need to resolve, first the issue of return of possession of the premises, and then, of course, getting you paid. If the tenant appears to have vacated when you visit the unit later today, then you must follow certain procedural rules before you simply change the locks. Ideally, you will be able to contact the tenant on his cell or at work. If you make contact, ask that the tenant confirm that he is out by faxing or emailing you written confirmation. If you are able to confirm that he has moved out, you will not have to follow the abandoned real property notice requirements and will be able to retake possession immediately. If when you visit the unit, and find that it is vacant, and if the rent is due and unpaid for fourteen days, and the tenant has not voluntarily surrendered possession, then you must serve a written notice of Belief of Abandonment of Real Property. The notice can be posted
on the premises and mailed by regular mail to the tenant’s last known address, your property. You must wait eighteen days before you retake possession. If the tenant does not reply, in writing, by informing you of his address for service of an unlawful detainer within eighteen days, then you may retake possession, and change the locks. Once you regain possession, prepare the security deposit disposition form. If he skipped mid lease, he will owe the balance of the term, or until you mitigate your damages by reletting the unit, whichever occurs first. Hang on to the tenant’s check that was returned by the bank. Stop payment orders are only effective for six months, unless renewed by the maker, which rarely happens. That means, in six months and a day, you can redeposit the check, and if there are sufficient funds, the check will clear. received the rental agreements, but the tenant information seems incomplete. The applications, the few that I’ve found so far, are old and outdated. I can’t seem to find any telephone numbers for the residents, and I’m not real sure that the names on the agreements are the same people who actually live in the units. I’ve read your articles before and I know the importance of reviewing the files and doing thorough due diligence before closing escrow, but this deal just happened too fast. Now that I’ve closed escrow, what can I do to clean up the records?
First things first, figure out what you know and what you don’t. Establish individual tenancy files, one per unit. Based on the limited information you have, write down the names and ages of the occupants, the terms of the rental agreement, written or oral, lease or month to month, rental rate, deposit on file, date paid through. Compile whatever contact information you have, home phone number, work and cell number.

Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the information in your files and gather any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new month to month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed
term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is not rent control, and a month to month tenancy, the rental rate and term can be set with either a thirty or a sixty-day notice of change of terms, depending on the extent of the change. Some of my leases are coming up for renewal in the next few months. One of these leases is for a resident who has been a thorn in my side since the day he moved in. If I don’t want to renew him, do I need to provide him a reason? Also, do I need to serve any particular type of notice?
Provided your property is not located in a rent or just cause eviction controlled area, then you do not have to provide a ‘reason’ for non-renewal. Provided your desire is not based upon illegal discrimination and is not in retaliation for the resident exercising a protected right, then you are free to ‘not renew’ the lease. Generally, a fixed term lease expires on a certain day. Provided there is no language in the lease that “auto-

matically” converts the lease to a month to month tenancy, then the resident is required to vacate on or before the lease expiration date. Neither the tenant nor the landlord is required to serve any prior notice. However, most industry lease agreements used by landlords include an automatic conversion provision that states that the tenancy automatically converts to a month to month tenancy unless a written notice of termination was served by either the landlord or the tenant. In this event, a written notice of termination would have to be served to terminate the resident’s tenancy. You replaced all the easy ones!! When all else fails on a toilet leak down issue;
it is time to put on your rubber gloves and get an adjustable wrench. Chances are the problem lies with the Flush Valve Seat. The rubber flapper valve seals against the flush valve seat (the big hole at the bottom of the tank). to either keep the water in the tank or let the water out of the tank. The seat may have a burr, crack or calcium deposits that allow a small amount of water to seep past the rubber flush valve. Sanding the seat to remove the burr or
calcium deposit is a short-term solution and rarely solves the problem for long. A permanent solution is to replace the flush valve. Start by turning off the water supply, completely empty the tank and remove the water line. Remove the two or three bolts holding the tank to the toilet bowl. Turn the tank upside down and remove the large nylon or brass nut that holds the flush valve to the tank. Install the new flush valve. Be sure the tank bottom is clean and no

Dear Maintenance Men:
I have a number of buildings that have old sliding windows and glass doors where the track is ground down to the point where the slider drops and barely maintains its position in the frame. Is there an insert or rollers that attach to the slider that elevates it and maybe even makes it easier to open and close? With the age of these buildings, I’m finding this is becoming a common problem. Craig

First thing to check would be sprinkler locations and if the spray hits the wall, relocate the sprinkler. Another problem is moisture wicking up into the stucco from the ground. Older buildings built before 1974 probably do not have a “weep screed” at the bottom of the wall. A weep screed is a metal flashing designed to act as a vapor barrier and transition between the concrete slab or
stem wall and wood framing. Installing a weep screed after the fact is not feasible. A solution would be to locate the transition between the slab or stem wall and the wood framing. Saw cut through the stucco to the base plate. Now fill the saw cut with a bead of silicone sealant. The silicone will act as a vapor barrier, effectively stopping the moisture from wicking up into the stucco. Refinish your stucco and paint to suit. Maintenance — continued on page 22

The best solution would be to replace the window assembly, but that can be costly. What we do is install a nylon or vinyl track insert or rail cap (Brand name: EZ-Slide) and replace the wheels to match the new insert. The inserts can be found at local hardware stores or at a company called Prime-Line Products. (www.primeline.net) or Blaine Window Hardware Inc. (www.blainewindow. com). These companies carry replacement parts for most windows. It might be best to call the company and tell them what brand windows you have and they might be able to get you exactly what you need.

The Fair Housing Act Turns 50 A Look Back at the Passage of Fair Housing Laws Including an Important Court Case from Orange County

T
he Civil Rights Act of 1968 was signed into law by President Lyndon Johnson on April 11, 1968. The act was the last major piece of legislation of the ‘Civil Rights’ era. The act had eight sections or ‘Titles.’ Title I added enforcement provisions, by way of fines and prison terms, for cases
in which previously enacted federally protected activities, such as voting or seeking employment, were interfered with. Titles II through VII, referred to as the Indian Civil Rights Act of 1968, dealt with various rights and legal procedures for American Indians. However, by far, the most significant and contro-
versial part of the act was Title VIII, now commonly referred to as the Fair Housing Act (FHA). Earlier the Civil Rights Act of 1964 and the Voting Rights Act of 1965 had sought to end discrimination and the denial of many rights based on race, color, religion, or national origin. The

1964 law addressed voter registration requirements, employment, public facilities and accommodations, school segregation and discrimination by governments receiving federal funds. But outlawing discrimination in housing was not included due to vehement opposition from many quarters. A bill to outlaw housing discrimination introduced in 1966 by Senators Brooke and Mondale, at the urging of President Johnson, went nowhere. Even an attempt to revive that bill in 1967 failed, following hearings held by Mondale at which a black Vietnam War veteran testified about the housing discrimination he faced upon his return home. Senator Mondale later commented, after its eventual passage, that fair housing legislation had been the most filibustered of any in history, up to that date. Two things occurred that rekindled the move to outlaw housing discrimination. The first was the February 29, 1968 release of a report from the National Advisory Commission on Civil
Disorders, which came to be known as the Kerner Commission, after its chair, Governor Otto Kerner, Jr. of Illinois. President Johnson had appointed the commission in the summer of 1967 to address the causes and possible prevention of urban rioting that had been occurring with increasing frequency since 1965. The Kerner report berated federal and state governments for failed housing, education and social-service policies. It famously made the statement that “our nation is moving toward two societies, one black, one white — separate and unequal.” In language that, at times, would now be viewed as at best awkward, and more likely patronizing or somewhat inappropriate, the report essentially called for action to end segregation as a means to eliminate areas of severe lack of opportunity, that were primarily inhabited by AfricanAmericans. It called for investing billions in housing programs aimed at breaking up residential segregation. Among its many recommendations the

report stated, at page 263, that “the federal government should enact a comprehensive and enforceable openoccupancy law making it an offense to discriminate in the sale or rental of any housing — including single family homes — on the basis of race, creed, color or national origin.” The second event that got the Civil Rights Act of 1968 into law was the tragic murder of Dr. Martin Luther King, Jr. on April 4, 1968. Dr. King had been a longtime advocate for a fair housing law, and had led a significant year-long campaign begun in 1966 in Chicago to highlight that segregation and housing discrimination were not a problem confined to the South. His killing led to outbreaks of rioting and calls for the passage of civil rights legislation as an honor to his legacy. On April 4th the Civil Rights Act of 1968 was awaiting possible passage in the House, but was bottled up in House

The law had started life in January 1967 as H.R. 2516, a minimal civil rights bill providing protection of civil rights workers in the South and strengthening the Equal Employment Opportunity Commission. The House passed that bill in August 1967. On January 17, 1968, the same date that President Johnson called for fair housing in his State of the Union Address, the Senate took up H.R. 2516. Even this modest civil rights legislation was met with intense opposition from a ‘Southern Bloc’ of Democratic senators, who filibustered it for a month. In response, on February 16th, Senators Brooke and Mondale introduced an amendment to add Title VIII to the bill, following through with Johnson’s call for fair housing legislation. When it appeared that the amendment would also face a filibuster, Senate Majority Leader Mansfield moved to table it, so as to end the roadblock to
Senate business and allow the body to move on to other matters. Surprisingly the motion to table lost 34 to 58, showing there might be more support for fair housing than initially thought. With much effort on the part of Brooke and Mondale, and some likely political deal making between Mansfield and Minority Leader Dirksen, who had been a longtime opponent of fair housing, a coalition of Northern Republicans and Democrats not in the ‘Southern Bloc’ broke the filibuster; the final vote making it possible to end debate and move to a vote was cast on March 4th. The bill, as amended, was passed on March 12th, on a vote of 71 to 20, and returned to the House for their concurrence. There it sat. The bill was referred to the Rules Committee, which would control how and if it ever came to a vote. The committee chair was Howard ‘Judge’ Smith, Democrat from Virginia, who was an avowed segregationist and supporter of ‘states’ rights.’ He had tried to scuttle the

1964 Act and was now determined to not hold hearings on the 1968 Act. A great deal of pressure was brought to bear on the members of the committee by Senators Brooke and Mondale, as well as by President Johnson, to allow the bill to reach the House floor for a vote. The killing of Dr. King, which led to rioting just blocks from the Capitol, proved to be the catalyzing event. On April 9th, under intense pressure to hold a vote on whether to report the Act to the floor, the committee finally moved to a vote. John Anderson, Republican member from Illinois, who died last December, broke ranks with his Republican colleagues and cast the deciding vote, 8 to 7, that brought the bill to the floor. The following day, April 10th, the House, again feeling intense pressure resulting from Dr. King’s death and the spreading civil unrest, voted 250–172 to pass the bill. President Johnson signed the bill the next day. At the signing he stated “we have passed many civil rights pieces of legislation, but none is more
important than this.” Having chronicled the tortuous path for the passage of the Fair Housing Act, it is appropriate to also recall the history of the passage of California’s own fair housing law, which was equally arduous. The story of that journey even involves a court case that originated here in Orange County, which through litigation lasting about 4 years, went all the way to the United States Supreme Court. California was ahead of the nation, as it often is, when it came to enacting meaningful laws protecting civil rights. One such law was the longstanding Unruh Civil Rights Act (Unruh), enacted in 1959, and named for its author Assemblymember Jesse Unruh. The law, found at Civil Code Section 1951, can be enforced by the Department of Fair Employment and Housing (DFEH) or through private court action. In its initial, but since strengthened form it stated “all citizens within the jurisdiction of this State are free and equal, and no matter what

Fair Housing — continued from 19 practices found, and to take one of the following steps: 1. sell or rent the housing accommodation to the aggrieved person, if it was still available; 2. sell or rent a like accommodation, if available, or the next vacancy in a like accommodation; 3. pay damages to the aggrieved person in an amount not to exceed $500. In May 1963, the Rumford Act, which passed the Assembly in April, was bottled up in Senate. That month, a young black couple, Lincoln and Dorothy Mulkey, both Navy veterans, who wanted to move from a segregated neighborhood in Orange County, attempted to rent a vacant apartment in the city of Santa Ana. The landlord, Neil Reitman, refused to rent to them because of their race. The Mulkeys sued in Superior Court, challenging Reitman’s denial based on their race. As their case began to move through the Superior Court, Rumford became law, but just barely. On June 21st, the last
day to pass a bill, it finally passed out of the Senate at 9:50 p.m., but with amendments. Sent back to the Assembly, it passed, as amended, with just 25 minutes to spare. Governor Pat Brown immediately signed it into law. It was essentially a straight party vote. No Democrat voted against it, while only three Republicans voted for it. What came next was an unfortunate and dark part of California’s history. Responding to its passage, and emboldened by the April defeat at the polls of a fair-housing ordinance passed in January by the Berkeley city council, the real-estate industry funded an initiative campaign to overturn Rumford. Proposition 14 set for the November 1964 ballot, sought to amend the California Constitution. It provided that “[n]either the State, nor any subdivision or agency thereof shall deny, limit or abridge, directly or indirectly, the right of any person, who is willing or desires to sell, lease or rent any part or all of his real property, to decline to
sell, lease or rent such property to such person or persons as he, in his absolute discretion, chooses.” It tried to enshrine the right to discriminate in housing in the Constitution. Not only did it undo Rumford it also made Unruh inapplicable to most housing matters. The proposition passed with over 65% of the vote, the margin being more than 2 million votes. It passed in all the state’s major cities. It passed in 56 of the 58 counties; the 2 exceptions being rural counties with a total of 3,626 votes cast. In Orange County the vote was 306,553 to 87,386, garnering 77.8%. It passed in Santa Ana, where the Mulkeys had been discriminated against. In the Orange County Superior Court, Reitman moved for summary judgment, and based on Proposition 14’s constitutional right to discriminate, the court agreed. The Mulkeys appealed directly to the California Supreme Court, which agreed to hear their case.

Fair Housing — continued from 20 In a 5–2 ruling handed down in May 1966, the court held that Proposition 14’s amendment by initiative, violated the U.S. Constitution’s Equal Protection Clause. The majority opined that such an initiative had effectively made the state an agent of discrimination. They rejected the argument that the initiative merely permitted private discrimination. They stated Proposition 14 invoked the power of state action in discriminating
against racial minority groups. The proponents of Proposition 14 appealed to the U.S. Supreme Court, which agreed to hear it in the 1966–67 term. In a 5–4 decision on May 29, 1967, in Reitman v Mulkey, the court affirmed the California Supreme Court decision, thus reinstating Rumford and Unruh’s applicability to housing. California again had a major fair housing law, some 10 months before the enactment of the FHA. Beyond that important result, the case stood for the important

Paying Apartment Managers Does Not Have to Be a Headache BY COLIN P. CALVERT
I
t comes as no surprise to experienced apartment owners that quality and reliable apartment managers can be few and far between. To add to the difficulties, applicable legal requirements often seem to pull apartment owners in
every direction. Continue reading for a walkthrough of the requirements an apartment owner needs to know to avoid later hassle and headache and ensure the apartment building really is home sweet home.
Minimum Wages
Apartment managers must be paid no less than California’s minimum wage, which is set above the federal minimum wage. Beginning on January 1, 2018, the minimum wage is $11.00 per hour for

employers with 26 or more employees and $10.50 per hour for employers with 25 or fewer employees. For the purpose of this article, it is assumed that the apartment owner is the employer.
Rent Credits
One must then ask, how does an apartment owner’s furnishing of a rentfree apartment to the apartment manager affect the minimum wage? California’s Industrial Welfare Commission’s Order No. 5-2001 (“Wage Order 5”) sets forth the applicable regulations specific to the public housekeeping industry. Section 10(C) of Wage Order 5 provides that the apartment owner may not use the value of the lodging made available to the apartment manager as a credit against the minimum wage, unless the apartment owner and manager enter into a voluntary written agreement for such an arrangement. For the agreement to be valid, it only need to be in writing, voluntarily entered into, and indicate that the parties agree to and understand that the value of the lodging is to be credited against the manager’s compensation. In the event the required agreement is in place, the apartment owner can take a credit in the amount of twothirds of the ordinary rental value of an apartment. However, for the year 2018, the amount of the credit cannot exceed $621.29 per month for employers with 26 or more employees or $593.05 per month for employers with 25 or fewer employees. If the apartment manager is married and his/her spouse is also employed by the apartment owner, the maximum credits allowed are $919.04 per month and $877.26 per month for big and small employers, respectively. The rules differ if the apartment owner is required to live on the premises, whether as a condition of employment or by law. Where the apartment owner requires the apartment manager to live on the premises, Section 10(E) of Wage Order 5 instructs that the apartment owner may charge the manager rent up to two-thirds of the rental
value, but not in excess of the amounts listed above. In this situation, the owner cannot take a rent credit against the manager’s minimum wage. A slightly different scenario arises when there are 16 or more apartment units at the premises. In that situation, Title 25, Section 42 of the California Code of Regulations requires that a “manager, janitor, housekeeper, or other responsible person shall reside upon the premises.” While this regulation pro-
vides that the requirement can be satisfied by a person other than the apartment manager residing on the premises, apartment owners should be aware that the size of the apartment building can trigger this requirement. Worthy of mention is the last sentence of Section 42. That sentence reads: “If the owner does not reside upon the premises of any apartment house in

which there are more than four but less than 16 apartments, a notice stating the owner’s name and address, or the name and address of the owner’s agent in charge of the apartment house, shall be posted in a conspicuous place on the premises.” In sum, if there is no agreement in place between the apartment owner and manager, the apartment owner cannot take a credit against the minimum wage. The apartment owner must be paid his/her full compensation in cash wages just as other employees. If the manager is required to live on the premises as a condition of employment, the apartment owner can only charge the manager two-thirds of the ordinary rental value of the apartment, up to the amounts specified in Wage Order 5. But of course, if the apartment manager chooses to live at the premises, the apartment owner can charge the full rental rate for the apartment.
Under California law, non-exempt employees can accrue overtime pay in two ways. First, an employee is entitled to overtime pay for any work in excess of eight hours in a single workday. Second, an employee can accrue overtime for any work in excess of 40 hours in a single workweek. Whether the overtime pays is accrued under either manner, it is to be paid at a rate of one and one-half times the employee’s regular rate of pay. This rate steps up to two times the employee’s regular rate of pay for any work performed in excess of 12 hours in a single workday. For apartment managers required to live on the premises, hours worked toward the accrual of overtime only includes time spent carrying out the assigned duties. In Isner v. Falkenberg/ Gilliam & Associates, Inc. (2008) 160 Cal.App.4th 1393, the California Court of Appeal made clear that time spent attending to personal matters, even if the employee was “on duty,” or in other
words, available to perform the assigned duties when required, is not considered part of an employee’s hours worked. Thus, this time does not count toward overtime.
Tax Implications
The manner in which an apartment owner compensates an apartment manager has state and federal income tax implications. Apartment managers should consult a tax attorney for guidance regarding how to file tax returns based on the particular method in which they are compensated and the living arrangement, if any, between the manager and apartment owner. Mistakes for Landlords to Avoid to Stay on the Right Side of the Law
W
e’re all secretly addicted to those late-night cop shows, or prison-centered television illustrations like Scared Straight. There’s something about them that’s strangely intoxicating, that keeps your eyes glued to the screen and stops you from continuing to channel surf. Despite this, none of us actually wants to end up behind bars. Landlords might be surprised to learn that there are a collection of errors that they can make that could result in a hefty fine, a lawsuit, or even some hard time. However,
with a little guidance, you’ll learn what to avoid and how to stay within the law when dealing with your tenants. No landlord wants to do a bad job. Keeping yourself educated about the law can not only protect yourself, but also the tenants that you rent to. While there will always be legislation that varies by state, here are some laws that all landlords should be aware of: 1. Discrimination It shouldn’t have to be explained that most discrimination is inherently wrong, and the Fair Housing Act is

in place to stop people from discriminating based on race, color, national origin, religion, sex, familial status, and disability. Some states also include things like immigration status and sexual orientation as a discriminatory factor within their own state laws, so it’s a good idea to look up the specific laws in your area. The severity of the case is ultimately what determines whether a landlord could face a fine or jail time, depending on the nature (i.e. violence, harassment, threats, etc.) of the discrimination. To stay in the clear, make sure you have your (like credit score range, deposit, criminal history, etc.) and apply this standard to all your applicants. 2. Failure to Make Disclosures Communication is obviously an important part of the landlordtenant relationship, but it is actually illegal to not disclose certain types of information. Illegal Provisions When drafting up a lease for a tenant, it is illegal to add certain provisions. Anything discriminatory, or that takes away certain tenant rights are not allowed. Each state has different laws that relate to what must be in the lease. The AAOC offers an Agreement to Rent or Lease that covers these requirements.
5. Refusal to Make Repairs Not maintaining your property could land you in hot water. If the lease doesn’t specify that the tenant is responsible for making repairs, the landlord is the one who must get it done. Should it not be completed, the renter can take matters into their own hands and do the repair themselves, and try to subtract the cost from their rent payment. They can also report the violation to the state safety instructor.
4. Failure to Provide a Safe Environment You’re required by law to provide a safe environment for a tenant to live in. This includes things like making sure there’s no mold, having up-to-date and working smoke detectors, properly working electrical

Be honest with your earnings and pay what you owe; it’ll save you a lot of trouble in the long run. Plus, there are tons of property deductions you can utilize. Make sure you’re getting your money’s worth. 8. Disregarding a Tenant’s Right to Privacy Just like everyone else, your tenants have a right to privacy. You must give a renter notice before entering the property, and can enter afterwards

In GRM’s We Trust (?)
C
an markets be dumb? Can prices sometimes not reflect true “value”? Depends on the market. Let’s start with stocks and bonds traded on major US exchanges as a benchmark. Participants there believe that publicly traded securities pricing is rig-resistant and that ticker prices at any given moment are a fair and accurate reflection of the collective knowledge of a vast marketplace. But what about prices for Orange County apartment buildings where transactional volume is a tiny fraction of daily traffic on Wall Street. Can we trust in what some of the metrics seem to be telling us? I refer to the closely watched Gross Rent Multiplier (GRM). The numbers have been in sizzle mode for two years (versus merely “very hot” during the four years prior to that). The adjacent chart shows that the annual GRM on Orange County apartments has averaged well over 15 the past three 4th quarters, with Q4 2017 topping out at 15.66. That means that an OC apartment with $100,000 in gross scheduled income would theoretically sell for $1,566,000 (the data, sourced through CoStar, reflects the average of all 5+ unit sales in the county and includes properties of various ages, conditions and locations). To our knowledge, the 4th quarter 2017 GRM is the highest in OC history, which begs the question: “Will buyers continue to show love for Orange County apartments at 15+

GRMs levels”? Answer: Not likely. Not with oncoming higher interest rates taking effect. The nation appears to be in the midst of an interest rate restructuring that could easily leave borrowing rates 1–2 percentage points above the cozy rate levels real estate markets had grown accustomed to. Fed Reserve money spigots are now firmly in the “off ” position following the central bank’s lavish $4 trillion cash infusion into the US economy from 2011 to 2016. That super cheap Fed money has been taken off the table is a healthy thing for long term market equilibrium, but a disrupting factor for now. The bullet points below show how shifting interest rates could impact debt service, depending on the severity of hikes. We’ve used 3.75% as the pre-rate hike “norm” that prevailed through approximately mid-2017 for intermediate term apartment loan rates (5 to 7 year fixed) and juxtaposed that against sample payments in both 1% and 2% higher rate climates: • $1 million @ 3.75%, 30 year amortization: $55,574 annual debt service • $1 million @ 4.75%, 30 year amortization: $62,598 annual debt service • $1 million @ 5.75%, 30 year amortization: $70,229 annual debt service Higher interest rates put upward pressure on cap rates (meaning downward pressure on asset prices), and higher April 2018
cap rates in turn act as a suppressor of GRM’s (the higher the cap rate, the lower the GRM). At a 15+ GRM, the true cap rate for Buyers could be 3-ish (notwithstanding the 4+ caps rates published on the chart). A 3 cap is virtually impossible to sustain if buyers can alternatively capture a 3% yield on triple A rated US Treasuries. We’re not there yet—the five-year Treasury yield is 2.65% as of this writing (3-5-18), but 3% by year end does not appear to be a stretch; the five-year yield was 2% one year ago. However, just because GRMs may now be topping out in Orange County doesn’t mean that apartment prices will fall. As an offset to softening GRM’s, rents will continue to climb given the shortage of rentals relative to demand, AND, prices will tend to be buoyed by (1) low local unemployment (3.9% in Q4 2017) (2) handsome recent wage hikes—up 4.9% from Q4 2016 to Q4 2017 and (3) multifamily construction permitting at stable levels that won’t oversaturate the marketplace any time soon. Moreover, the OC cache is real and ongoing. The county’s published multifamily cap rate of 4.24% in Q4 2017 was a dramatic 1.48 percentage points below the 5.72% nationwide rate. Investors see enhanced quality in OC and consider it a lower risk environment than other US locations, and that brings buyer demand.

10. Handling Abandoned Property Inappropriately There are certain procedures that must be followed when a tenant leaves property behind, although
they do vary slightly by state. Generally, you must treat the items as abandoned property, and notify the owner of where they can pick it up, how long it will be held, etc. If the property is never picked up, then you may be able to sell or keep the items. With legislation ever changing, it is important to keep up-to-date on the laws in your area. This knowledge could protect you from making mistakes that could lead to you being fined, or even sent to prison. As good as you may look in orange, no one wants to spend time behind bars and simply avoiding these simple errors could keep you on the right side of the law. Determining your own wishes and goals is the starting point. Do some serious thinking about what, if any, type of legacy you would like to leave and how you might like to be remembered. Your legacy is the gift that shapes the lasting impression you wish to leave behind. Financial and material aspects are important, but your legacy also encompasses the impact that your support and values can make upon the lives of others. You may decide that now is the time to spend some money creating memories for your family. How long has it been since you have all taken a family trip together? Yes, you may need to cover the costs, but that trip might be an important part of the legacy that you are providing. So, too, might be paying off school loans or helping your children buy a home. Underwriting the costs of a grandchild’s tuition to a special program or college may be more meaningful if done today rather than held in an inheritance trust. Now also is the point at which you should consider whether you want your legacy plan to include philanthropic giving. Is there a particular organization, cause or institution to which you would like to make a special bequest? If yes, do some research and talk to others who know the organization. Check out Charity Navigator and similar nonprofit watchdogs. Do some checking with the entities, themselves. Most universities, colleges
and hospitals have foundations or planned giving departments that can advise you as to all types of ways that charitable gifts or donations may be structured. Non-profit organizations and charities often have information on their websites as well as individuals to contact regarding how to specifically phrase your bequest. And, don’t forget to consult with your tax advisor. As another important part of looking ahead to the future, think about how your heirs will perceive your legacy. What is happening in their lives? Where are their priorities? Will they have the time, ability or desire to assume the responsibilities of income property ownership? What have you done or should you do to get them ready? In terms of your real estate assets, ask yourself these questions: • How well do your family members understand the benefits of property ownership? • Will your heirs appreciate the wealth-building head start that you are providing or will they simply cash out and sell off your assets? • What about equity growth? How important will that be to your heirs? • How do their priorities in terms of wealth building and wealth accumulation differ from yours? • Do your heirs have the ability and/ or the desire to operate your properties at the same level as you have been doing? These are questions which require very honest answers. Talk with your heirs. You may realize that you need to make some adjustments, seek ways to get them more actively involved or initiate a learning process. Bugs? Call Kevin Perhaps you have experienced “bugs” in your computer software. Nearly everyone has at some point and then they have to call an IT specialist to sort it out and get the “bugs” out. The same goes for your insurance coverage. In almost all reviews we’ve conducted, we have found “bugs” in their insurance program. Most are not done intentionally by the agent or insurance company. Usually it is a result of trying to do too much by the insurance agent in an understaffed office.
