Who is Rent Controlling? Rent Control…Really?
M
y first experience with rent control was back in the spring of 1987. I was a student at the University of California— Berkeley, and one of my fraternity brothers had a small studio in closeproximity to the campus. We had class together multiple times a week, and on one particularly cold February day I remember stopping by his studio. It was quite cold in his apartment that morning and I asked him to fire-up his heater to take off the chill of my brisk morning walk. He sheepishly informed me that his heater was not working. “Why haven’t you asked your landlord to fix it?” I asked. It was that exact moment when the twisted reality of living accommodations under rent control were fully explained to me. My friend was actually the subtenant of one of our fraternity brothers who had graduated years prior. He divulged to me that he was paying $500 a month for his studio, and our friend

and fraternity brother was only paying $250 to the landlord for the studio. Turns out, our mutual friend was using the extra $250 to subsidize his apartment in a nearby community called Blackhawk, a community not subject to rental control or rental stabilization ordinances. “What a sham!” was my immediate reaction as a rental property owner. Over the next couple of days, I pondered what was really happening and how the landlord was getting the shortend of the stick, thereby limiting their ability to effectively manage the longterm stability of the investment. (Just for reference, at that particular time, I was living in Albany, a community several miles away from campus and was paying $400 a month for my 1-bedroom apartment.) In my opinion, any form of price control damages the ability of commodity or service providers to competitively offer the best product to the community (at a reasonable risk and rate of return.) My micro and macroeconomic classes (at the same university and in the same city where rent control was prevalent), taught me that production and use of resources would be optimized in the free market. Why would you risk your future and your family’s future on a regulatory agency or other governmental entity that thinks they know your business better than you do? If we wanted to do that, we would put our money in the bank and earn meager interest payments.

We built this nation on the freedom of choice and our ability to prosper and make a living with “reasonable” governmental oversight based on law and order. “The greater risk the better the return!” One final question: If we as risktakers and providers of quality rental housing leave the market because the return is no better than investing in bonds or CD’s, who will provide housing for our nation? This experiment was undertaken in the former failed experiment of the USSR. This past summer, I had the opportunity to tour Latvia and Estonia and learned that housing provided for and built by the Communist/Socialist government was almost completely abandoned and disparaged by local residents. These former Soviet Union countries learned their lesson and almost overwhelmingly agreed that price controls are not conducive to a higher standard of living. When I inquired about the abandonment of Soviet era constructed housing, the most frequent response was…a lack of heating and substandard construction! This is the same conclusion I had reached back in 1987, in a rent-controlled jurisdiction, where one of my best friends rented a studio and was afraid to contact the landlord about the lack of heating in his studio. Bottom line: Rent control and rent stabilization ordinances are counterproductive to our ability as investors and believers in a market driven economy as envisioned by our founding forefathers.

CRAIG'S CORNER B y C raig K irkpatrick E xecutive D irector
It’s Been a Great Year of Many Accomplishments—
T
his will be my last column since my role as Interim Executive Director is coming to an end. It’s been an honor and privilege serving you in this capacity for just over a year. Having been on the Board of Directors for many years and Board President, I certainly thought I knew what transpired at the office of AAOC. Boy was I wrong — little did I really know! Be that as it may, it’s been a year of many accomplishments and milestones. The first item I embarked on was to elevate the professionalism, class, integrity and respect at AAOC. West Point and the Army taught me that without these tenets, no organization could truly be successful. AAOC had an inordinate amount of personnel turnover, but with the help of a very dedicated staff, AAOC hardly missed a beat. Some of the accomplishments that may be more apparent included the following: Apartment News was redesigned to free up 4.5 pages for additional content and advertising. We also started the “Rental Housing Retrospective” which appears on the last page. We modernized our social media campaign and established intent to its purpose. We communicate a lot of information through social media. We also established the Rental Housing Industry Newsletter that we e-blast midmonth. This is the information age and things change quickly and this is our way of keeping you informed and current.

Our Product Service Council (PSC) membership is our fastest growing membership component. We expanded opportunities for members to sponsor events, which allows us to offer our membership more programs. Through planning and budgeting, most every event now makes a profit, which wasn’t always the case. All staff members understand the fiduciary obligation we have to manage association funds wisely. Lastly, we had our first PSC round up in September to allow members to sign up for sponsorships before their companies establish budgets. This was a huge success and it allows for better planning of our events. You probably realize that most of our events, and all General Membership Meetings, are currently held at the Great Wolf Lodge. We think this is a great partnership and brought our overall costs way down allowing those great cookies and coffee to be served. Our outreach on the legislative front grew tremendously. We solidified our advocacy at the state level and our local involvement has exploded. We are in contact with our local elected officials on a daily basis and continue to engage cities on issues such as parking, just cause eviction and rent control. AAOC and our members were vital in turning back the Santa Ana rent control efforts as well as the proposed state legislation known as Prop 10 that would have overturned Costa-Hawkins. Our members stepped up and donated money to our PAC’s that allowed us to

donate $500,000 to CalRHA’s effort to defeat Prop 10. This amount combined with other monies raised far surpassed our past fundraising efforts which allows us to support property rights and candidates. We streamlined our accounting department and now pay bills online which saves hours and money in the process with a quicker turnaround and more punctual bill payments. This year’s Trade Show was one of our best and biggest in recent memory. Not only did we hold four seminars but we also introduced informative maintenance demos throughout the day. Lastly, we sold out of trade booths and increased our sponsorship opportunities. One of the accomplishments I’m most proud and hopeful of is the partnership between AAOC and the Untied Way to End Homelessness that I’ve been involved in. We have a seat at the table on the Rental Housing Committee as well as the Leadership Committee in order to ensure any program introduced is successful. Homelessness is a real hot button these days and the United Way is following the lead of other cities such as Orlando, Florida by engaging rentalhousing providers to be part of the solution. I’ve had the opportunity to talk to a lot of you about Santa Ana Rent Control, Prop 10, Prop 65, as well as many other Craig’s Corner — continued on page 9

Don’t Poke the Bear Learned Lessons from Pharma
I
n 2015, the Assemblymember Chiu introduced legislation that would have required pharmaceutical companies to file an annual report on how they develop their drug pricing for new and existing products. Much of the language in the bill was already public information, but it was not easily accessible for the general consumer. It’s important to note the political landscape at that time was still generally positive to the Pharmaceutical Industry

(Pharma). Seen as a necessary force, Pharma had positioned itself for the longest time as a white hat in the proverbial health care arena. So, when Assemblymember Chiu wanted to increase transparency to their industry, they drew a hard line in the sand. How hard? Well, the lobbying efforts to the committee were so strong that the author canceled his request for a hearing. No transparency bills were passed, and the Legislature was put on notice that these types of transparency bills would not be supported by the industry. While one can argue that Pharma made the smart move, we would contend they set themselves up for longterm failure. Pharma was not reading the tea leaves. Drug pricing was continuously increasing, and changes from the Affordable Care Act meant solely blaming health insurers was no longer a viable option. Health advocates knew public pressure was beginning to shift towards drug costs, and so they wisely

tried again the following year. In 2016, health advocates asked the Chair of Senate Health, Dr. Ed Hernandez, to introduce a drug transparency bill. The Senator agreed to carry the bill (SB 1010) but was adamant that compromises and agreements to provide increased transparency be made on all sides (including insurers). Pharma, perhaps feeling emboldened by the previous year’s success, continued to oppose the legislation at every stop in the legislative process. Their opposition was also a stark contrast to the public’s opinion of them, as the EpiPen scandal had been on every news station from California to New York. For reference, Mylan raised the EpiPen cost from $100 a 2-pack to $600. The bill would eventually die on the Assembly Floor, but it cost the industry greatly. And, it was an unnecessary utilization of said political capital. A simple assessment of the public’s perception should have been sufficient to demonstrate to the pharmaceutical industry that changes were coming. Changes that involved reporting information that was already public were minor compared to what could come down the road. Yet, they fought because they believed too much in their own talking points. The result was SB 17, a substantially similar version of SB 1010 that had the full weight and resources of Senator Hernandez behind its passage. That bill is now law. Senator Hernandez’s tenure in the State Legislature may be over, but the memo-
ries of those battles are still ripe in people’s minds and new bills are being introduced that go far beyond reporting requirements. If you’re not seeing how this all relates to our apartment association, google California housing crisis and read the top hits…they all discuss the crisis as an issue of affordability and try to make justifications for rent control. The public perception of the housing
issue is at an apex, and Legislators are going to want every relevant stakeholder to offer compromises. How much effort should the industry put behind stopping an inevitable tide? What are the long-term implications of the public’s demands and beliefs? Based on SB 17, the best approach is one that realizes the status quo is closer to becoming historical context than continuing precedence.

LOCAL LEGISLATURE B y B ill C hristiansen
The Local Political Scene
O
ur Apartment Association of Orange County Legislative Committee has had an active year. We have been meeting with new city council members and recently reelected state and county legislators. Newly elected officials provide an opportunity for a fresh education with new people regarding the issues that affect the rental housing industry. We had the chance recently to meet with several elected officials regarding the increasingly lengthy eviction lockout process experienced by our AAOC members. One of the major frustrations in the past year has been the lengthening time between an eviction notice and scheduling a sheriff ’s deputy for the eviction lock-out procedure. This has resulted in lost rental income and in some cases an increase in crime on several properties. Recent cuts in court fees by the State of California and a budget reduction at the County of Orange had reduced the number of
deputies assigned to the Sheriff ’s Civil Unit for eviction lock-outs. This has been a problem industry-wide. We brought the situation to the attention of newly elected Sheriff Don Barnes and his staff as well as the Orange County Board of Supervisors. With our efforts and the help of Board Chairwoman Lisa Bartlett, the Sheriff ’s Department was able to reassign six deputies to the civil unit to help decrease the time needed to schedule an eviction lock-out. Our AAOC Legislative Committee continues to monitor and maintain our relationships with city council members. Many of our cities in Orange County have collective anxiety regarding the large number of over-reaching bills that have been introduced in Sacramento this year. A few of these bills would take away the local authority of cities to decide how dense they allow development in “major transit” areas. Under proposed legislation our cities would
have their state transportation dollars taken away if they don’t increase the density of inexpensive and subsidized housing in certain city neighborhoods. Over-building local neighborhoods and underfunding local transportation would severely affect the rental housing industry and Orange County’s quality of life. More than 2,700 bills have been introduced this year in our state legislature and much of the legislation allegedly tries to help lessen the affordable housing crisis in California. It is a very active legislative year and our Legislative Committee will stay on top of it. Ronald Reagan always warned of the dangers of those who say “I’m from the government and I’m here to help.”

Questions & Answers I encourage my tenants to pay rent by electronic funds transfer. I use the apartment association’s lease, which states “If Resident fails to pay the rent in full by the end of the 3rd day after it is due, Resident shall pay a late charge of $100.00 as additional rent…” One tenant seems to initiate the EFT later than the 1st day of the month, but I can’t be certain of what day it is, and if that day is a week-end or holiday, I see no sign of her payment in my bank until the following bank business day. That can mean I see the payment on the 5th or 6th day of the month. Is her rent late? When is rent legally considered paid? If my tenant gives me a check on the 3rd day of the month, and that day is a Saturday and I deposit it that day, I can see a pending transaction immediately, but the funds are not available to use until the next bank business day. With a check, I know when the transaction is initiated and completed. With an EFT, I only know when the transaction is completed.
When rent is paid by ETF, it is consid-
ered received by you when it is credited to your account. It is immaterial when the tenant initiated the transfer, the date which the funds actually are credited to your account is controlling. In the case of a check or draft delivered to you, it is the date which you actually receive the actual check or draft. You have control over the funds/payment instrument upon deposit of funds or receipt of the actual check. Of course, the specific terms of your lease control. Most leases require that the resident ‘deliver’ the rent to you on or before the first. This eliminates the old ‘check is in the mail’ excuse. However, some ‘creative’ landlords insist on writing their own ‘special’ terms on their leases, and if those special terms require the tenant to ‘mail the check to a PO Box’ or put it in a ‘drop box,’ then these terms may alter the date of payment, and in some cases may shift the risk of loss in the mail to you the landlord rather than the resident. Additionally, if the account number provided for the resident to make his ETF to is incorrect and the delay is caused by the landlord’s incorrect instructions, then the resident will be provided additional time. For these and many other reasons, it is very important not to alter the language provided to you in your apartment association forms, they typically anticipate these types of situations. I recently had the pleasure of spending my entire morning watching small claims cases

come and go, while waiting for my own. The more I watched, the more I realized that it is a highly “subjective” area, and prone to a lot of “creative” testimony. Needless to say, by the time my case was called my confidence level had been reduced several notches. I guess I did ok, at least better than most, but I’m not sure what I could have done that would have helped. Can you give me some pointers that will help me out next time?
If landlords and tenants are meeting in small claims court, it usually is because the tenant is suing the landlord over a security deposit, or the landlord is suing the tenant over damages done to the unit over and above the security deposit, or some combination of the two. Whatever the underlying cause of action, there are many things a landlord should do that would greatly reduce the chances of being brought into a suit, or if a suit is brought, will greatly increase the landlord’s chance of prevailing. Proper tenant screening at the inception of the tenancy will effectively weed out the “habitual” litigant. By verifying past tenancies, many former landlords will volunteer past disputes, and their outcome, with you. Using the proper rental agreement will also aid you in a future lawsuit, by clearly identifying rights and duties of all parties during the tenancy. A properly completed move-in inspection form, signed by the tenant establishes a baseline in which to determine future damage. Proper Legal Q&A — continued on page 14

Legal Q&A — continued from 12 documentation recording requests for repairs, actual repairs made, defining the cause of the needed repair, and correspondence documenting any alleged breach by the tenant, such as overcrowding, failure to clean or maintain, or other misuse of the premises. Upon the tenants moving out of the unit, it is important to carefully prepare a moveout checklist detailing any and all damage to the unit. Excessive damage to walls, or carpet covered with pet stains or ground in dirt and oil. Remember that you are required to properly account for the security deposit within twentyone days of receiving possession, charging the tenant only for damages and cleaning in excess of ordinary wear and tear. Stay away from any “standard cleaning fee”, only pass on proper deductions. If the tenant damaged it, don’t be afraid to charge him for it, conversely, if the tenant left the premises in the same condition as when he got it, then refund the deposit. One last thing, if you go to court, be prepared, be organized, and be truthful. Seems like I’m always clearing out a clogged drain, or fixing some other minor problem generally caused by my tenant. Trouble is, I don’t live near the units, and calling a plumber out for such routine repairs is way too expensive. Is there a way to pass this responsibility on to the resident?
Yes, the responsibility for minor maintenance and repair items can be negotiated as part of the rental agreement. You cannot require your tenant to waive his right to live in a habitable unit, but you can require the resident to take responsibility for minor repairs and maintenance that may be required during the course of the tenancy. A provision requiring the resident to maintain the drainage lines, the toilets and the garbage disposal will require the resident to either perform the repairs and maintenance or hire a pro-

fessional to do it for him. Stoppages in the main line caused by root or other causes will typically be an obligation reserved to the owner, while clogged drains, toilets and garbage disposals may be delegated to the resident to repair. A prospective resident recently applied for one of my rentals. He seems nice and all, but when he filled out the application, he left a blank where his social security number should go; he said he didn’t have one. He had a California driver’s license, and something called a Matricular Consular card. He seemed a bit combative when we discussed this issue, said that his attorney said I had to rent to him, that I couldn’t discriminate against him, as long as he could afford the rent. Must I rent to him? How do I verify any of his information?
Proper tenant screening results from the proper use of a variety of tools. Credit reports and eviction reports are two of the best tools available to predict the ability of the prospective tenant to perform his obligations. Qualification of a resident goes far beyond ensuring that “he makes enough money” to pay the rent. Verification of past rental history, tenant stability, and verification of his ability to honor his credit obligations, as well as determining the likelihood of his continued employment are all fair game in evaluating a prospect. Like it or not, our country’s system of storing information on each of its citizens, uses one’s social security or taxpayer identification number as the primary identifier. A Matricular Consular card is merely an identification card issued by a foreign country and is not valid for identification in the United States. In order to work in the United States legally, one must have a social security number or a taxpayer identification number. It is illegal for an employer to hire an individual without a valid social security or tax identification number. Identity theft is rampant in California, and it is incumbent upon all credit pro-

viders, including landlords, to ensure that the person that fills out the credit application truly is who he says he is. Many tenant’s rights advocates, and that is exactly what they are, advocates, advancing the rights of tenants at the expense of landlords, insist that it is discriminatory to require a social security or taxpayer identification number when evaluating a prospect. You as a housing provider have a legitimate business purpose in determining the credit worthiness of a proposed resident, and not only to predict his ability to timely meet his rental obligations, but you must determine his ability to continue to meet those in the future. Further, in the event you had to pursue this individual in the future due to a breach of the agreement, you must assess the risk in searching for and locating this individual should you need to collect a past due amount. A consistently enforced policy of requiring a social security or a taxpayer identification number in order to screen your prospective residents does not violate Fair Housing laws and does not constitute illegal discrimination. Dear Maintenance Men,
WATER HEATER LONGEVITY: Having replaced about five water heaters in the last five years, it is my subjective impression that water heaters manufactured in recent years do not last as long as those purchased prior to that time. For example, I have replaced several failed water heaters that were about 15 years old. This contrasts with some water heaters (same size) manufactured in the 80’s which are still in service. Consequently, I have been seeking ways to prolong the life
of water heaters. I have been told that replacing the sacrificial anode rod will help accomplish this. Is it worth the time and cost to replace an anode rod? Is there a way to determine the condition of an anode rod short of removing it? What tools would be needed to accomplish this? Gerard
Hi Gerard:
You are not alone! Unfortunately, many of our clients, including us, have had the same experience as you. It has been very frustrating to replace a water heater with a six year warranty the day after it expires! Most information available is purely anecdotal as the manufactures do not wish to share the actual reasons why. It appears that manufactures have moved to the model of disposable water heaters much the same as all other large appliances for residential use. However, the following is what we know by dissecting a few duds: 1. The tanks appear to be thinner and made of lesser quality metals, possibly a weaker blend. (This is true for Residential, Big Box store purchased water heaters of any brand.) 2. The anode rods (sacrificial rod) is also thinner. (Replace often using a 14" to 20" Crescent wrench or Pipe wrench.) I prefer a socket wrench and extension but it can be a pricey tool for a job you will do once every two yrs. (dependent upon how bad your water is in your city). Replacement of the rods is absolutely worth the time and effort, they are relatively inexpensive and

not hard to replace. If your water heater is more than 3yrs old it’s probably time to replace them. Unless you remove them you cannot tell what condition they are in. If you remove them be prepared to install new ones. 3. Water quality. Consider a water softening system or filter between your water heater and the city supply. A water softening system will also prolong the life of your dishwashers, faucets and shower heads. 4. Sediment. Clean out or drain your water heater once a year. Severe build up can cause premature failure due to tank expansion, prolonged burner operation, encapsulation of the anode rod, and damage to your fixtures. 5. Residential vs Commercial quality water heaters. Do not purchase any brand of water heater at a big box store. They are all manufactured for residential use no matter what the packaging says. For the past 10 yrs or so we have been purchasing our 40 to 100 gallon water heaters from a commercial source. Research where in your areas the commercial plumbers buy their water heaters. A commercial plumbing house deal with warranty issues directly with the manufactures and vet their suppliers rigorously. (They do not want to deal with a rash of returns). 6. Temperature settings. If at all possible keep the temperature as low as you can without causing issues with your tenants. Install a protective
cover to eliminate the chances of your residents raising or decreasing the temperature at will. 7. Check you vent sizing as many people have replaced their old water heater and have not resized the vent stack accordingly.

Interesting. Currently, there is no IRC Rule (not codified) regarding in-swing or out-swing doors on interior residential dwellings. However, it may be a good idea to consider the following: Most individuals are accustomed to opening doors inward and the years of that action has made it second nature which can cause some frustration, accidents, disrupt flow and unintentional damage. Depending on where the door is located in respect to the general layout, an out-swinging door can be opened in the direct path of another occupant. Blocking the door from the outside and trapping someone inside the bathroom during an emergency, or earthquake. Since we usually walk up to a door and knock, there is now a risk the door will be opened inadvertently causing you to knock with your nose. A slightly more costly alternative would be to install a pocket door, or frame for a 24" to 28" in-swing door. Lastly, installing a bi-fold door may be an alternative, although not a very secure door. WE NEED Maintenance Questions!!! I’ve heard it said that, “cooperation is working together ‘agreeably’, but collaboration is working together ‘aggressively’. Love that. It is so true. But, to truly be collaborative we must be able to connect and influence other people to succeed today. The resistance we experience daily comes down to leadership, connecting, and influence. And, everything I’m talking about is unquestionably 100% a teachable skill, as well as an attitude to possess. Which means we can learn to connect! We can learn to lead. We can learn to improve our ability to influence people — if we want to!
Everyone speaks, some communicate — but the best connect. If we want to get our message across, we must learn how to communicate in someone else’s world. During our time together we will cover proven connecting principles and connecting practices that will help you become a more effective communicator in everything you do. Protecting Your Family With Estate Planning
E
state planning—the process that forces people to focus on two things most people do not want to talk about in life: death and taxes. But estate planning should not just be another item at the bottom of a “to do” list. Estate planning is really an opportunity—it is an opportunity to take care of your family in a way that will help them when you can no longer do it yourself. Thought of that way, doing your estate plan is practically a gift to your loved ones. There is a common misconception that only “rich” people need an estate plan. It is true that most people will not be subject to estate taxes since the current Federal estate tax exemption is so high. Every individual can currently pass $11.4 Million to their beneficiaries estate-tax free; a married couple can pass $22.8 Million, free of estate taxes. However, a proper estate plan does far more than just avoid estate taxes. An estate plan saves you and your family time, money, and headache upon your incapacity and eventual passing. An estate plan can also be designed to save capital gains tax and property tax reassessment upon your passing, and to help shield your beneficiaries from future potential creditors. Probate. Probate is a proceeding in which the court supervises distribution of an estate. This supervision comes with mandatory costs, numerous hoops to jump through, and constant delays. All of the assets you own in your own name that do not have a beneficiary

designation, and that in total exceed $150,000 in gross value, are subject to probate in California. This basically means that if you have California real property that is not owned by a trust or another legal entity, your estate will be subject to probate upon your death and California’s default distribution rules. Use a Trust to Avoid Probate. Wills do not avoid probate, they simply instruct the judge to whom and how you want your estate distributed. Trusts, on the other hand, avoid probate. A living trust can be thought of as a Will that avoids probate. The document still states to whom and how you want your estate distributed, but without having to go through the oversight, costs, and time delays associated with probate. Trusts can also create protection for your surviving loved ones. This protection can come in the way of creditor protection, divorce protection, and protection from receiving money and responsibility at too young of an age. Other Basic Estate Planning Documents are Important. While the trust is arguably your main estate planning document, it is still important to have a Pour-Over Will, a Power of Attorney for Asset Management, and an Advance Health Care Directive. A Pour-Over Will is important as it deals with any assets you may have forgotten to title in the name of the trust during your lifetime and instructs the judge to place those assets in the name of your trust, to be distributed in accordance with the trust terms. Additionally, the

Pour-Over Will is the proper place to designate guardians for any minor children, though the appointment of a guardian is ultimately overseen by the court. A Power of Attorney for Asset Management allows someone else to sign your name to financial documents in the event you cannot sign for yourself, for example, if you are incapacitated. Without someone having the power to act on your behalf, a court appointed conservatorship could be required — while the time and costs involved in probate are bad, the process for a conservatorship are worse. An Advance Health Care Directive is a document which allows someone to make health care decisions for you if you cannot make those decisions for yourself. Without an Advance Health Care Directive, state law directs that your “family” would have priority to make such decisions. It is unclear which family member has more priority over the others. We can assume that the closest lineal family member would have priority, but think about what would happen if you have a non-traditional relationship (or if you do not get along with your immediate family). These issues can be avoided with an Advance Health Care Directive in place. Advanced Planning is Also Possible. Estate Planning — continued from 32 available to accomplish advanced estate planning goals such as charitable giving planning, gift tax planning, income tax planning, estate tax planning for taxable estates, and asset protection planning. Many techniques require a multitude of trusts, some in California, and others in jurisdictions such as Nevada, South Dakota, or even the Cook Islands. It is important to discuss with your estate planning attorney if such techniques are a good fit for your circumstances and goals. Updates and Reviews of Estate Plans Are Needed. It is important to review your estate plans every couple of years. When the estate plan is drafted, it takes into account all of your assets, and your current spouse, children, family, and other life circumstances as they exist at that time. As time goes on, those facts and circumstances, and your estate plan needs to be updated accordingly. Just as your life circumstances change, state laws and tax laws change as well. For example, in 2013, President
Obama signed the American Taxpayer Relief Act of 2012, which made the concept of “portability” permanent and initiated a monumental shift in the way traditional estate planning has been done. Then, in 2017, President Trump signed the Tax, Cuts and Jobs Act into law which temporarily increased the Federal estate tax exemption from $5 million (indexed for inflation) to $10 million (indexed for inflation). These changes were huge. The combination of those two tax bills has dramatically changed the estate planning world and has opened doors that were not previously possible. It is important that older estate plans are reviewed to make sure they are taking advantage of the opportunities that are now available, which can help reduce income taxes, preserve property tax basis, and allow more assets to be distributed to your loved ones without the payment of taxes. Importance of Proper Trust Funding. Lastly, a trust only works to avoid probate when the trust is properly funded. range County apartment investors should be pinching themselves. Can it get any more positive for multifamily values? As the adjacent chart illustrates, the metrics depict a kind of perfect storm. Start with gross rent multiplier: It’s not a typo…the Q4 2018 number was truly 17.87, trouncing the previous record of 17.16 set the previous quarter. Each of the last six quarters have been GRM record busters. The value climb is stunning. Just four years ago (Q4 2014) CoStar reported the GRM in OC as 12.60. That means $100K in annual gross rent made an apartment worth $1,260,000 then, while the same $100K gross today equates to $1,787,000 in value, a dizzying 42% increase of $527,000. Had rents been raised just 10% to $110K during those four years, today’s value jumps to $1,965,700, a staggering four-year 56% trampoline-esque bounce. Certainly, apartments have exhibited strong performance across the US over this same time period, though few markets have achieved the spike that Orange County has. Nationwide, multifamily properties averaged an 11.89 GRM four years ago before reaching a 14.08 GRM in the quarter just ended, a healthy 18.4% increase. Underlying economic fundamentals displayed on the opposite page explain the super strong environment for apartments: • Wages are on the rise after many stagnant years: up 13% in OC and 9% nationwide compared to two years ago; those wage gains trans

late to a more creditworthy class of tenants; • Unemployment is low by historical standards: 4.2% in southern California and 3.9% nationwide; 5% unemployment is considered optimal; the current sub-5% figures produce a disproportionately large crop of workers to fill apartments; • Inflation remains relatively subdued — CPI in Q4 was running at 3.2% annually in southern California, and just 1.9% nationwide (as of January 2019 the national CPI figure is down to 1.6%); low inflation promotes consumer confidence, which in turn spurs young people living with parents to move out and take on their own rental unit; • Building permit issuance for multifamily has plateaued at moderate levels locally and nationwide, suggesting that an oversupply of new units is not in the offing; • Rental housing occupancy is strong — 96.2% in OC and 95.4% nationwide; moreover, demographics depict a growing preference among millennials to rent versus own, providing additional wind at the back of the rental housing industry; What could rain on this parade? A few political hot potatoes come to mind. First would be the possible impeachment of President Trump. What effect on the economy, and by extension, the apartment industry was this to occur? We have two modern era presidential impeachments to look to for insight. April 2019
In the case of Bill Clinton, scandal rocked the White House throughout 1992, with formal impeachment in December, followed by acquittal in February 1993. Notwithstanding the political turmoil, the economy did not skip a beat. GDP robustly grew 4.5% in ’92 and 4.8% in ’93. The Watergate debacle of 1973/1974 led to Richard Nixon’s resignation in August ’74 after impeachment proceedings had begun. GDP actually boomed in 1973 with 5.6% growth, but the nation fell into recession the following two years, declining .5% and .2% in ’74 and ’75, respectively. Hard to draw definitive cause and effect conclusions from these samples considering the varying growth and contraction experiences associated with the Clinton and Nixon impeachments. However, I would foresee a hiccup in the US economy if Mr. Trump is impeached since disruption to business and consumer confidence would likely ensue given the general sense that the current economy has been sparked by the “business friendly” policies of this president. That said, given the bedrock nature of rental housing coupled with greater demand for rental housing than existing and future supply would appear to be able to fully accommodate, the apartment sector would not be expected to suffer dramatically from impeachment fallout. The second concern to possibly destabilize residential income properties is rent control. This is first and

ince 2011, Orange County income properties have experienced record appreciation in value. We are now seeing a growing number of price reductions and longer time-onmarket periods. Could our rocket-ship ride be running low on fuel? In recent months, there has been more and more discussion, both locally and nationally, about a shift. So what should you do? As a buyer, do you wait and see how far prices will drop? As a seller, should you pull your listing, hunker down and wait? In any time of change, there is opportunity.

Whether buying or selling, the trick is to have the courage to act when others might not. When my father and I tackled this topic for his book, Cash In on the Myths of Real Estate, we were thinking primarily about our sellers, but the lessons apply equally to buyers and sellers. Sellers with properties on the market need to be aware of the trends. Astute real estate agents work very hard to stay ahead of the curve. They know and understand that pricing right is critical to a successful and expeditious sale. And, as a buyer, you should never stop looking for opportunities. Even in
the hottest market, a certain property may provide you with just the right value-added position. Remember, the true value of any property is unique to each investor. Knowing how to calculate this value is the key to your success. A market shift is a trigger event that should not be ignored — even if you have no desire to buy or sell. As discussed in a previous article, doing nothing is taking an action in and of itself. So how do you proceed? Take a very honest look at how your property/ properties is/are performing not just in terms of cash flow, but in regards to your financial goals and personal
You need to sell at the top of the market to maximize your return.
Popular Belief: Most owners do not want to leave any money on the table, so they keep waiting for the market to hit its peak. Bill’s Truth: Pinpointing the exact peak of the market is nearly impossible. It is better to sell just short of the top than to be caught in a declining market. Waiting to hit the top of the market also leads to inaction and lost opportunities. You make more money by selling when the market is going up rather than when it is trending on the downside. In fact, if you start soon enough, you may be able to sell, buy, and then sell again – all during the same up-phase of the real estate cycle. Also, if you wait too long, you may be unable to sell and possibly lose the property. Or, at the very best, with the extension of the holding period, you will significantly diminish the effect that compounding has upon maximizing the growth of your wealth potential. Have a financial plan and understand both the 18-Year and the Long Wave Real Estate Cycles. Take action when you have achieved your targeted equity growth point and you have quantified the advantages of your next move. Cash In: Act when the time is right for you, not at some perceived absolute top or bottom of the market.

needs, wants and desires. Do some projections. Maybe, if the market is heading into the downside of a cycle, now would be a better time to sell rather than holding for five to seven more years. Think, too, about your personal situation. If you are self-managing and doing much of the work yourself, is this how you want to spend your next five years? What if something happens to you? Can your spouse or heirs step in and handle everything? Are they even interested and/or prepared? Perhaps there are other opportunities. Look at and quantify all of your options. When the market shifts, property owners need to respond. Your action of buying, selling or holding should be suited to your goals, projections and personal situation. Don’t be afraid to be a contrarian investor and improve your position while others do nothing and find that they end up worse off.

Taking Your Career to the Next Level
I
hit a dead end in my multifamily career. I knew that I had the potential to advance in my company and make a difference, but the people around me didn’t seem to think so. Opportunities for promotions would come and go and I wasn’t considered for any of them. It wasn’t supposed to be like this! When I entered the property management industry I had been successful in several other industries and was very confident that this success would transfer over. There was a lot of excitement for me from human resources and my supervisors upon joining the company and it seemed clear the arrow was pointing up for me in my new industry and company. Unfortunately I struggled…a lot! I learned that I had a lot to learn. Finally after enough pain I realized that I needed to change. I took the time to find out what I needed to do to get unstuck and take my career to the next level. While things didn’t happen overnight, I can say that my career was completely transformed by applying what I’m about to share with you. So…how did I go from struggling leasing consultant to become a successful entrepreneur, motivational speaker, consultant and member of the famed Apartment All-Stars team? Read on!
Tip #1: Know If Your Jeans Fit
Have you ever been around someone whose clothes didn’t fit—and s/he didn’t know it? That happened to me

not too long ago, except I was the one who didn’t know it! I brought some jeans home from the same store in the same size that I always get and tried them on for my wife. She looked at me and said, “Are you sure those are the right size??” I wanted to say, “I am a grown man, I know my jeans size!” Smartly, I didn’t say anything and (reluctantly) took her advice and exchanged the jeans for a different size. She. Was. Right. Taking your career to the next level means knowing where your jeans don’t fit and where they do fit! In other words you need to be self-aware. Where do the jeans not fit in your career? Do you know what your weaknesses are? The people around you sure do! You might be perfectly suited for the next level leadership position in your company, but until the people stop being blinded by your weaknesses, they may not be able to see your strengths. Pause now and ask yourself: “What are my weaknesses?” “What do I need to do differently?” “What have I been doing (or not doing) that could be holding me back?” Then once you’ve identified the areas you need to shore up, do what you need to do to eliminate those weaknesses in your life. By the way, they don’t need to become your strengths, you just need to work on them enough so they they are no longer glaring weaknesses.

reflect on where your jeans don’t fit— you also want to know where you look amazing! In other words, you need to know what you do well! So pause and think about these things: What do you better than most? Where are you naturally gifted? What do you make look easy that other people struggle in? What are you passionate about? Once you have identified your strengths this will provide you with a frame of reference to help you determine and execute your career strategy. This is what happened for me. Once I knew that I ultimately wanted to be in training and organizational development, I funneled my career decisions through the prism of “what do I need to do to get there?” The clarity and focus I had from knowing my strengths and where I would be able to make the biggest impact was crucial to ultimately getting my foot in the door in organizational development, and over time, making a successful career in it.
Tip #2: Win With People
If you want to succeed you need to win with people. Period. Seems easy enough but the fact is winning with people isn’t easy. If it were easy 50% of marriages would not end in divorce. If it were easy at least some of the 75% of employees that leave their jobs each year because of their bosses wouldn’t leave. Winning with people is crucial to success and it isn’t easy. Career — continued from 40 What can you do?
Ask yourself, “What is my effect on the people around me?” We all walk through life very aware of the impact that other people have on us; the driver that cuts you off on the freeway, or the customer who is holding up the line at your favorite coffee place because she has no idea what to order, or the person in the express lane at the grocery store who definitely has more than 20 items and is paying with a personal check! Ugh!! But how often have you thought about your impact on other people? What do people see when they see you? When do people experience when they’re around you? Do people feel energized when they’re with you or drained? Are people open and honest with you or do they feel the need to tell you what you want to hear? Do people see you as a leader or only as a follower? Once you’re honest with the positive and negative impact you have on the
people around you, you’ll know what you need to do to keep the positive impact going and to change the negative impact. You may need to read some books, attend a conference, watch a TED talk to help you in the area. Whatever you need to do, do it! It’s worth it.
Tip #3: Commit to Growth
If you want to get to the next level commit yourself to growth. John Maxwell says, “Growth is the only guarantee that tomorrow will get better.” What can you do to grow? Start by reading a book on personal/professional development. If you need suggestions you can email me (rommel@rommelanacan.com) or ask your network what books they’d recommend! Then implement at least one thing you learned from the books you’ve read. As you grow the people around you will notice. You will see your influence expanding and your impact increasing. You will see opportunities open for you
and because you’ve been committed to your growth, you’ll be ready for those opportunities. Then impact the people around you by helping them grow. Share the secrets of what you’ve discovered. Share a book or podcast that impacted you. Carve out time with the people you lead to coach, mentor and/or encourage them. Commit to being one of the reasons that someone else succeeds! When you Grow Yourself and Grow Others, this creates the environment where everyone can Grow Together. This is where the magic truly happens! You move forward. The people around you move forward. You all move forward. This is how I took may career to the next level and I know it will work for you too!
