Grow with AAOC Education

F

or decades now, AAOC has prided itself in pioneering and offering great education classes, courses, meetings and workshops! It’s up to us as owners and managers, however, to educate ourselves by taking advantage of the myriad programs that our association offers. In the 80’s I was at a seminar when the speaker related how an elderly gentleman attended almost every course he offered. When he asked him why, the gentleman replied, “If I’m ripe I’m afraid I can only rot, but if I’m green I’ll grow!” Isn’t that true with us in general as well as pertaining to the industry we’re in? However, there are other incentives for us to stay current: like lawsuits and fair housing problems. Nicholas Dunlap and I were members of the OC Fair Housing Board for several years and it was obvious to us that most of their litigations were due to an owner or manager not being up to date with current law. How many times have we heard

Attorney Steve Duringer say and write that good screening procedures and forms could eliminate 90% or more of our tenant problems? Do you know the four primary criteria in order to select the best and most qualified tenant for your property? In May, AAOC held a seminar titled “Rental Housing Process”. This is important and will be offered again. Future events include the following: RUBS — (June 20) RUBS stands for Ratio Utility Billing System. Have you ever thought passing through unmetered utility costs to residents might make them more concerned with water and power usage? This will be a 45-minute discussion of pros, cons, and how-to’s. At the April Membership meeting Richard Albrecht, an estate-planning attorney, spoke about many topics related to trust and estate planning. offer a two-hour limited-attendance panel workshop on preparing to pass properties to a new generation. Harassment — (August 22) learn how to avoid the growing number of expensive workplace harassment suits. Don’t think you’re an “employer”? If you reimburse a manager, maintenance tech, “representative”, or even a contractor, you are an employer at risk of a suit and, even if you act in good faith, failure to educate yourself about your responsibilities will be used against you should you be sued. This class also meets California’s requirement that employers of 50 or more people (in any capacity, including contractors) put all supervisors through an anti-harassment course every two years. Of course there are many more chances to educate ourselves but I’ll let you see for yourself. Every edition of the Apartment News lists a calendar of events listing educational and other events. eaders of my monthly missive here in Apartment News Magazine may notice that I have been writing much on the topic of affordable housing needs in Orange County and throughout California. It is the subject of much public policy debate in city halls across the state as well in our State Capitol. While the discussion is an important and healthy one, some proposed solutions just don’t cut the mustard.

Price controls in rental housing have historically only served to worsen the housing market. Recently our own local newspaper, the Orange County Register, offered an editorial on this exact topic. Here is an excerpt of what the Register’s Editorial Board had to say: “Lower rents sound great if you’re a current renter, but price controls make it that much more difficult for future renters to find housing. Reducing the

profit developers and landlords receive, compared to market rates, diminishes or eliminates the incentive to build additional housing developments in the first place. Moreover, since competition for rent-controlled units is so fierce, landlords have a much diminished incentive to maintain them well. As Pepperdine University economics professor Gary Galles noted in a recent column for the Mises Institute, rent control is a classic example of a case where


“bad economics makes good politics.” “One of the most universally accepted propositions among economists is that rent control produces a host of adverse social consequences with its large, involuntary redistribution of wealth and suppression of market prices as communicators of information and incentives,” he wrote. Galles observes that while rent control is typically sold as a housing solution tailored especially to the poor, oftentimes they are not the ones who benefit from it. “[R]ent controlled areas, rather than helping those of low and moderate means, become increasingly populated by higher-income tenants with few children,” he asserts. The poor “populate rent control rhetoric but far less of the housing available under it.” We appreciate the Editorial Boards point of view as well as the summation from Pepperdine University’s Dr. Galles. We look forward to working with policy makers and opinion shapers in Orange County and across the state to facilitate

private sector solutions to create more housing options at lower costs. Government cannot create affordable housing. Government can create conditions in which housing will remain affordable. Overview

Rental property owners and developers are easy targets to blame for California newest round of housing affordability issues and shortages. It is unfortunate because the misguided blame may lead to significantly harsher regulations over the industry in the coming years—regulations that will likely serve to perpetuate and exacerbate the problem in the long run.

California’s Housing Shortage and Affordability Problems

The problem is well documented. California does not have enough housing to meet demand. In fact, according to a recent independent report by the state’s Legislative Analyst’s Office, the state produces 100,000 fewer housing units than is needed to meet demand.1 Supply and demand economics are therefore in full force here in the state. When everyone is competing for the

same limited supply of housing, costs are going to go up. But supply and demand is not the only driving force creating affordability and shortage problems. Community resistance to housing, stringent environmental policies, lack of fiscal incentives for local governments to approve housing, limited land, lack of incentives for developers to build, burdensome government regulations, long and difficult permitting process, and the high


cost of building all serve to constrain new housing construction.2 And it is not just the popular and dense coastal urban areas of California that are impacted by the current shortage. As people get priced out of major cities, they begin to migrate inland; ultimately creating a supply and demand problem that increases housing costs, rents, and prices in suburban and other inland areas. The shortage and affordability issues create widespread problems for all Californians, and those seeking to move here. Rents become unaffordable for more and more people. People are forced to move further away from where they work, or move out of state completely. It discourages people from living in California, which not only impacts the State’s economy, it keeps California businesses from attracting the most qualified people to work for them. Rental property owners also feel the squeeze because local governments and state lawmakers begin passing laws aimed at regulating the rental and construction industry.

What the Experts Recommend

In 2015, the Legislative Analyst Office (LAO) provided recommendations to the California Legislature about how to begin addressing California’s housing issues. In sum, it told the Legislature that

it needed to pass laws to help facilitate the development of market rate housing in coastal areas. The LAO followed up with a report in 2016 after certain tenant advocacy groups expressed concerns that building market rate housing will not help low-income tenants, and that the Legislature should focus on regulations that help low-income tenants, such as stronger rent controls. The LAO’s response was swift and clear: Many housing programs—vouchers, rent control, and inclusionary housing—attempt to make housing more affordable without increasing the overall supply of housing. This approach does very little to address the underlying cause of California’s high housing costs: a housing shortage. Any approach that does not address the state’s housing shortage faces the following problems.3 The LOA went to state vouchers programs, rent control and inclusionary housing programs only help select few, while doing nothing in terms of addressing the real problems. Forcing rental property owners to provide below market rate does not reduce or eliminate competition, the driving force of supply and demand economics. Moreover, forcing owners and developers to provide below market rate rentals ultimately discourages development and improvement of rental property.

Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the informa-

tion in your files, and gathering any missing information. Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust. This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new month to month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is nonrent control, and a month to month tenancy, the rental rate and term can be set with either a thirty or a sixty-day notice of change of terms, depending on the extent of the change. One of my elderly residents recently fell and broke her hip, and it looks like she won’t be getting around very well ever again. She has been living in our building for many years and I would hate to see her move, everyone loves her. Her daughter asked if I would install grab bars in the shower and in the bathroom, and kind of implied that I must do it at my expense because of the ADA requirements, whatever they are. Now this resident is very sweet, but I just cannot afford to spend the money, my husband and I are barely making it as it is. Do I have to allow my resident to install the grab bars and do I have to pay for the cost?

A landlord must allow a disabled tenant to make reasonable modifications to the rental unit to the extent necessary to allow the tenant full enjoyment of the premises. The tenant, not the landlord, must pay for the modifications. As a condition of making the modifications, you may require the tenant to enter into an agreement to restore the premises to their original condition upon termination of the tenancy. You cannot require an additional security deposit in this situation, but you can require

the tenant to pay a reasonable estimate of the restoration cost into an escrow account to ensure that the property is returned to its original condition. My tenants and I have had a very good relationship. They have been paying the rent on time and they don’t disturb any of their neighbors. In the past, I‘ve hired them to take care of various projects around the

Q&A — continued from 11 complex. The work done has been satisfactory. Until recently, I would either pay them in cash, or simply drop off a check in their mailbox. Now, the tenants are asking me to offset their payment from their rent. I told them I’d think about it and get back to them. If I accept their request to just offset the value of their repair work from the rent, am I asking for trouble?

You should never mix your tenancy relationship with the work performed by your tenants. Keep the relationships separate and distinct. Not only is it good business practice, but it also prevents many legal issues from arising. If you mix the issues of services performed in exchange for payment of the rent, you have now expanded your tenant’s potential defenses as to why he or she should not pay the rent. If the rent is a separate transaction, the tenant will have no claim that he is entitled to a reduction or a credit for work performed

but not paid. Also, if you have problems with the tenant’s work product, you can hash out those work-related issues while the tenant continues to pay rent. Be very cautious when allowing your tenants to perform work on your building. The benefits may seem great, but the pitfalls are many. My rental agreement has a provision that provides a discount to my tenants of $50.00 if they pay their rent on time. Specifically, if they pay their rent in full on the first, their rent is $1,175.00, but if they pay on the second or later it is $1,225.00. My question is which amount do I put on the three-day notice to pay rent or quit, the $1,175.00 or the $1,225.00 if they haven’t paid?

A quick list of what should be in your family disaster preparedness kit: Flashlight with batteries, canned goods, a gallon of water per person, a knife, meds and blankets at minimum. Now

this works ok for a family, but may not be appropriate for an apartment building. The residents may very well shelter in place during a disaster and be fine. What may be in danger is your property! Start with a bit of preventive disaster maintenance. 1. Locate the main water shut-off valve and any minor shut-off valves. Make sure the valves are in working order. If they are gate valves, it might be time to upgrade them to ball valves.

Old gate valves are notorious for breaking valve stems at the moment you need them to work. 2. Locate and clearly mark the main electrical panel. 3. Locate and mark the main sewer clean-out. Dear Allen,

When doing a kitchen or bath material selection, cohesive and functional design is important. Kitchen and bath rehabs are some of the most expensive

work you can do in an apartment unit and proper planning is a must. In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly. Don’t let the cabinet fronts fool you. Manufactures designed their cabinets to look good at first glance. Keep in mind, being in a rental environment, the cabinets also need to hold up to abuse. Look at the actual construction of the cabinet box or frame. Keep in mind; you do not need to use custom cabinets to fit your existing layout. The use of prefabricated modular cabinetry can greatly reduce the time and cost to have a finished kitchen or bathroom. Using real wood cabinet fronts with 3/8” plywood sides is essential for durability. The drawer fronts and sides should be connected with a dovetail or other positive lock construction. Drawers that are held together by nails or cabinets built with particle board will not hold up to tenant abuse. On a side note; if you are gutting the kitchen or bathroom, use this time to relocate and add more electrical outlets and under cabinet lighting.

The weather is getting warmer and I have just finished rehabbing my building’s landscaping. When is it the best time to have my automatic sprinklers scheduled to turn-on? David

According to landscape experts, the best time turn on the sprinklers is between 5:00 a.m. and 6:00 a.m. This allows the water time to soak in and then allows the sun to dry out the landscape to avoid rot & disease. That being said…we personally like our sprinklers to activate between 2:30 and 5:00 a.m. This time period is after the bars close and before the early birds leave for work. Instead of wishing and sometimes regretting, attendees were taught the science behind the first impression and how to

Be Wary, Tenants Can Forge Their Own Credit Report

I

n this day and age, most Americans have become extremely critical about the type of information they receive. Whether they’re analyzing the true sugar amount of their favorite Summer-time drinks or the overwhelming number of articles coining the phrase ‘fake news’, unfortunately you can’t stop there. With a simple internet connection, your rental applicants can now forge their own credit reports. While many landlords and real estate agents have a set background screening provider (with credit) that they trust, and request their applicants’ reports for them, there are a few cases where a rental applicant might try to get around this. For starters, your applicant might rationalize bringing in their own report because they simply want to avoid negatively impacting their credit score with another credit inquiry. Or, maybe the applicant simply wants to get around paying an additional fee. Even if the applicant justifies that they already have their copy of their background report from a recent rental application,

in any case, do not let the applicant use a previously pulled credit report. If you’ve been a long-time reader, you’ll know that employment references and paystubs can be forged. With how rapidly technology is advancing, it’s no surprise that credit reports can now be counterfeited as well. PDF files of credit reports that look like they came from Experian®, Equifax® or TransUnion® can be easily taken and altered through a pdf filler or Photoshop to hold whatever information the applicant wants. Even the most unsophisticated criminal can alter the dates on their old, poor scoring credit report. Although the credit report your applicant has given you might look like it’s legitimate and was pulled within a few days, it’s best not to risk it. As the algorithm used to calculate your applicant’s score depends on the purpose of the report (for example, for a car dealership vs. a bank loan), your rental applicant’s final credit score could be distinctly different. Not to mention, while scoring models like FICO™ and

VantageScore 3.0 are widely used and trusted, other non-standardized scoring models are risky and unregulated. Regardless of what reason a rental applicant gives you, do not accept a pre-pulled credit report from an applicant. f you’ve been thinking about selling your business, you should put a solid sales plan in place even if you don’t act on it right away. According to Fred S. Steingold, business attorney and author of The Complete Guide to Selling a Business, planning in advance is the idea scenario. “A business owner should start planning for a sale at least four years in advance,” he says. Early planning can enhance the market value of your business while also helping you determine your strategy for life after business ownership. Business owners can become motivated to sell for many reasons — approaching retirement, a lucrative buyout offer, or a desire to try something new. Before entering negotiations for a buyout, Steingold suggests discussing the following questions with your Financial Advisor: • What will I do with my time once I stop working? • How will I replace my paycheck? • Am I interested in staying on as consultant or employee after selling?

To potentially increase the value of your business, examine how expenses balance against revenue. Reducing costs is imperative, even if it means lowering your salary and closing expense accounts. How to be Business Friendly

W

hen you take the “friendly” out of Business Friendly, the only thing you have left is business — business as usual. And we all know that’s just not good enough. You may be asking yourself, “What exactly is Business Friendly customer service?” We define it as the middle ground between being too cold, impersonal and uncaring, and the other extreme of being too familiar. We’ve all experienced both I’m sure. Here are five points to help you deliver Business Friendly customer service.

Every Call is Unique — Don’t Become Desensitized:

The customer interaction you perform at the end of the day needs to be as upbeat and helpful as you were with the first one of the day. What happens is often times we get the same questions over and over and it’s easy to become desensitized. We need to remember that to the customer, his question is new to him. And it’s the first time for him; no matter what time of day it is.

Solve the Problem — Don’t Argue:

You know the old saying “the customer is always right.” Well, the reality is “the customer always thinks they’re right” and that’s the perception we need to deal with. There are indeed times when the customer is wrong and we as service specialists know and realize it. There’s zero value in pointing out to a customer that they’re wrong. So focus on the problem; don’t worry about whose fault it is. There’s simply nothing yo be gained by arguing with your customer. You’ll lose every single round. Focus on solving the problem.

Show Empathy — Don’t Ignore What The Customer Says:

The other day, I called a company and explained that the product they sold me wasn’t operating properly. The answer from the company representative? “Oh, OK.” Agggggg. That drives me crazy. First of all, it’s not OK that the product wasn’t working right. And secondly, where was a little empathy? Where was some sort of acknowledgement that they indeed heard what I was calling about.

None. And you can have empathy in happy and good things too. Empathy isn’t only for disasters and bad times. You can join in when someone mentions a birthday, a vacation, a wedding, or anything that is happy. Point is, just do not ignore what they say. Comment on it.

Smile:

Yes, the customer can hear it. We all know that. And since we all know that, we all need to do it. And by the way, smiling is showing your teeth. If your teeth aren’t showing, you’re only grinning — not smiling. Grins cannot be heard! Let those teeth show!

Avoid Emotional Leakage:

Emotional leakage is the act of ‘getting mad at Peter and taking it out on Paul.’ It’s when we take the negative thought or emotion from one situation and transfer it to another, unrelated situation. 5 Ways to Better Manage Your Time While Managing a Community BY ELAINE SIMPSON, OCCUPANCY SOLUTIONS LLC

M

anaging a community effectively can be difficult and because of this, it is easy to get lost in your own time. Soon, you can find yourself really falling out of your healthy work/life balance. As you are doing community related tasks here and there you don’t allot much time for yourself. The best community management teams are those who take the time they need to refocus. Here are five ways you can better manage your time while managing your community: 1. Make lists — Lists are your best friends, or they should be. The first thing you should do in the morning, or the last thing you should do before going home for the night, is to create a list. Within this list, write all of the expected tasks you will have throughout the day, all the things you would like to get accomplished, and make sure to leave room in your schedule for anything that might pop up without expectation. 2. Prioritize — After you list is written, you will want to prioritize the items.

Make sure your most important tasks are set in solid time frames and keep them at the forefront. With smaller tasks, leave these at the end of the priority list. If they are not accomplished in that day, perhaps put them at a little higher priority tomorrow. 3. Use your team — Your community management team is there to help you. If there are tasks that others can accomplish, allow them to do it. Having trust in your team to help when they are needed, and to do a good job, is important, and it can make a huge difference in how you manage your work and your life. 4. Do one thing at a time — Beginning one task, abandoning it, and starting another task is harmful to your time management. Essentially, you will get into one head space, leave it, and then go on to another, only to have to return later on. In order to use your time most efficiently, stick to one task at a time.

5. Make use of the morning — Several studies have shown that people are most productive in the morning or the span of time before lunch. Use this time to make good on your priorities and get them out of the way with a foc used morning energy burst. Nobody Does It Better from Cash In on the Myths of Real Estate

ound familiar? Many of us began investing when we were much younger and took pride in doing a lot of our own repairs, collecting the rents and getting to know our residents. You may have handled everything 6-2

yourself because you wanted to understand the business. Perhaps the property did not generate a sufficient cash flow. Maybe you did not even realize that a good property management company can often pay for itself. Or, perhaps, you

had the time available and truly enjoyed taking care of your own property. In my book, Cash In on the Myths of Real Estate, I discuss the do-it-yourself approach in my chapter on Day-to-Day Operations.

Nobody can run my property better than I can.

Popular Belief: Owners are the best overseers of their properties. They have a vested interest and are more motivated to ensure that everything gets done correctly. Bill’s Truth: For many owners, the act of providing homes is a rewarding and fulfilling experience. They enjoy the hands-on management of a property. They care about their tenants, listen well, and act quickly to resolve issues. That said, not all owners have the time, experience, or aptitude needed to manage a property at its fullest potential. In these cases, professionals can generally conduct the day-to-day operations more effectively. Professional management companies command both economies of scale and the benefit of daily practice. These attributes more often than not make them better equipped and focused than a hands-on owner/manager. A reliable and experienced management company is often your best resource for ensuring that you make money on your property. The good news is that you can integrate the cost of professional management into your projections. Often, a management company pays for itself in terms of reduced turn-over time, readily available expertise, and early problem intervention. Outside professionals can also serve as a bridge to future ownership for your heirs. By watching how the management company works, family members can gain an important, real world perspective on property operations. Be sure that the next generation is trained enough to manage the managers. Cash In: Be aware of your own strengths and limitations, and be willing to make decisions objectively as to how best to operate your properties.

In additional to increasing the profitability and value of your property, a good property management company gives you the time and opportunity to look at the bigger picture. No longer caught up in the day-to-day details, you can focus on your property as an investment and better direct your property management company as to what you want them to undertake on your behalf. Equally, if not more importantly, with someone else handling the daily chores, you have the time to work on communicating with and training your heirs. Legacy planning is tough. Nobody likes to contemplate, much less talk about, what happens after they die. As I mentioned in last month’s article (May 2017 issue of Apartment News Magazine), my son Tim and I have embarked on another writing project. The title is Legacy Planning and Your Real Estate Assets. The entire focus is that legacy planning starts with you and the type of impact that you want to make during your lifetime. It goes beyond the basic protection and helps you shape the way that you will be remembered. At first we thought we would create just a guide, but as we delved into the material we realized that something more interactive was needed. Recognizing how difficult it is to bridge generational expectations, we have added an heir-toheir component. Each legacy is unique. Each heir is also unique. We are creating the tools to stimulate thinking, ask the questions that need asking and suggest resources that can help you create a truly personalized legacy plan. Just as with my book, when completed, I am going to make this workbook available to my fellow members of the Apartment Association of Orange County. This is part of my legacy to you.
