The Dating Game: Section 8 Edition
I
f you were to google “pseudocompassionate breakup lines”, one that would likely register high near the top of the first page of search results is “it’s not you, it’s me”. While most definitely a cop out, it’s a nice albeit insincere and cliché way of excusing oneself from a relationship. Nowhere do I see this more relevant than in describing today’s housing climate and the relationship between landlord, housing authority and Section 8

voucher holder. Only in this case, it’s more like “it’s not you, it’s them”. With many glitches in a program fraught with inefficiency and funding shortfalls, it’s no surprise that the Section 8 voucher program is not widely accepted across conventional/market rate apartment communities and ultimately has a negative impact on the very people it was put in place to assist.

Innovation, Not Legislation
While funded federally, regulated and governed through HUD, the Section 8 program is administered and monitored locally by housing authorities across the US. Just like in dating, some are better than others (housing authorities, that is). Locally, Anaheim has taken an entrepreneurial approach in recent years and rather than fund more vouchers, they aim to fully fund those vouchers they have committed. Santa Ana is moving toward an online platform that puts iPads in its employees’ hands and allows them to complete

Fortunately for apartment owners and operators across the State, AAOC and other groups vehemently opposed what was known as Senate Bill 1053 and it died in committee. more work in the field. Anaheim, Garden Grove and Santa Ana tend to inspect units within 5 to 7 days of notification and the first check or payment would be about another 30 days after that. The Orange County Housing Authority aims to inspect units within 1 to 5 days of notification and payment tends to arrive in the 15 to 30 day range.
A Step in the Right Direction
Even with these improved inspection times, the delay of payment in a market like todays is a deterrent to property owners who are faced with rising operating expenses and a loss of

revenue by letting a unit sit vacant. The City of Los Angeles through its housing authority (HACLA) has gotten a bit more serious by providing immediate holding deposits, security deposits and access to a fund that covers damages caused by Section 8 voucher holders. The City of Santa Monica has gotten even more aggressive by offering landlords a $5,000 signing bonus for signing up and renting to a voucher holder. Needless to say, we are not seeing this sort of incentive in Orange County where the need is just as real. Historically, our industry has been shortsighted when it comes to change.

Rather than think about and propose solutions, we tend to wait and fight back against adverse legislation, regulation or policy. But with the improvements in Los Angeles, Santa Monica, Anaheim, Santa Ana and Orange County, it’s time for us to put it all together, create and propose the working model for public and private partnership with regard to Section 8 housing. In doing so, we have the opportunity to create a win-win for our industry and for would be residents. If not, well, history will just continue to repeat itself and we will see another bill next session seeking to accomplish the same thing. Folks, it’s time to get off of the dating carousel and get serious with regard to Section 8 housing. After all, it’s here to stay.

y now we have all settled into what we know was coming for a long time. Without question the payoff of all the trial and tribulations of Southern California living: Summer in the Southland. With my three boys constantly giddy with excitement of the start of each day of summer vacation, at Camp Penrose there is pool water on the floor in the kitchen, beach towels in the dryer, sand in the car, the sweet smell of 50 SPF in the air. California Senator
John Moorlach often reminds that we Californians “pay a hefty premium for that sunshine.” While he fights to level out that unfairness to the taxpayer, I will be taking full advantage for my premium payment. UD case where a habitability defense was raised, was defeated in the Assembly Judiciary Committee. AB 2312, which would have required posting with the court of future rent as it would otherwise have become due during the pendency of a UD case, died in the Assembly Judiciary Committee. SB 7, a comprehensive measure dealing with water submeters in rental housing, remains on the Assembly File pending its possible reconsideration following last year’s narrow defeat. SB 269, dealing with minor missteps in ADA access compliance, was approved by the Governor as Chapter 13 of the Statutes of 2016. SB 879, which would authorize issuance of $3 Billion in bond money for various housing projects, is pending in the Assembly. AB 2760, which would have established specific conditions and standards for support animals in rental properties, was held in the Assembly Judiciary Committee. SB 1340, which would require the Department of Water Resources to include specified conservation landscaping provisions in any updated model ordinance, has moved to the Assembly. AB 2299, dealing with construction and limited parking requirements for second units in residential areas located within one-half mile of public transit, has moved to the Senate. AB 2392, dealing with tax credits for certain earthquake retrofits, is pending in the Senate. AB 2501, which would impose limited time lines for the local entity approval process when rental housing owners apply for a density bonus, has moved to the Senate. AB 2300, which expressly permits a prohibition on the smoking of Marijuana in rental housing, has moved to the Senate. AB 2584, which modifies the list of persons able to challenge a local government’s denial of a housing project in violation of state housing law, has moved

Groundwork has been laid this year for greater attention to and awareness of the many deficiencies evident in the unlawful detainer process. Alleged inequities asserted by tenant groups brought to light by measures like AB 2819 have been countered by evidence of abusive and unnecessary litigation approaches and tactics that promote delays, and meritless and frivolous claims. The absence of balance has bubbled over into the budget process. The Sargent Shriver Civil Counsel Act (“Shriver Act”), enacted by the California Legislature in 2009, in large part generates funding for tenant representation in unlawful detainer matters. Supported by filing fees, grants and other state allocations to the Judicial Council, almost three-quarters of the funds go to support legal aid services providing unlawful detainer representation for ten-

ants. The program’s intent is commendable, and its goals are laudable: to ensure low-income individuals and families have meaningful access to justice without regard to income. We support the Shriver Act to the extent that it supports fair, balanced, ethical, transparent, and accountable legal representation for lowincome individuals and families in civil matters, including in unlawful detainers. Unfortunately, the Judicial Council’s latest draft report on the Shriver Act grant funding demonstrates that the program is not currently conditioned on fair, balanced, ethical, transparent or accountable behavior by the organizations and attorneys receiving funding. Instead, funding supports abusive and unnecessary litigation approaches and tactics that promote delays, and meritless and frivolous claims. Moreover, the data collected and analyzed through Shriver Act funding fails to address and analyze the means by which legal aid organizations are obtaining favorable decision for their clients before the

matter is heard before a court. For these reasons, there is substantial need for an independent audit of the program before continuing support by public funding of unlawful detainer representation without stronger transparency, accountability, and ethical responsibility requirements, and data collection efforts that ensure that the systems that promote and increase frivolous and meritless claims and defenses are meaningfully analyzed and addressed. A detailed letter to that effect was delivered to both the Senate and Assembly Budget Committees.

ost of my residents pay on time and their checks are honored by their banks. Lately, it seems that I’ve been getting many checks from small banks, even some internet banks with no real offices, many I’ve never even heard of. I recently had one returned insufficient funds over three weeks after the check was deposited! Do I have to accept these types of checks? Should I require that all my tenants pay by cash or cashier’s check? What about direct deposit?

Many owners allow residents to make direct deposits or transfers to the owner’s bank account. There are many benefits to this arrangement, but many drawbacks as well. If you do allow the resident to make direct deposits, then establish an account separate from your personal general account, and establish clear guidelines instructing the resident when and how to make deposits. Suggested guidelines would state that you will not accept a partial payment without prior consent; that the resident is not authorized to make a direct deposit after service of a three day notice to pay rent or quit or a notice of breach of a covenant of the lease, or for any period of time

after expiration of a notice of termination of tenancy. Once your payment terms are established, stick to them and require the residents do the same. It’s always something with one particular tenant of mine. When he first moved in three months ago, he deducted one hundred ten dollars from the rent because he said he had to fix a few things in the unit. Q&A — continued from 12 says he can “repair and deduct” for anything wrong in his apartment. Is this true?
California law, specifically California Civil Code Section 1941.2, provides that a residential tenant may make repairs and deduct the cost from the rent only under certain circumstances. These limited circumstances require the tenant to give the landlord notice of the dilapidation before using the repair and deduct remedy. After giving notice, the landlord has a “reasonable time” to make the repairs, before undertaking to repair and deduct. Thirty days is considered reasonable. A shorter time frame would apply to a non-operative heater, plumbing leakage, water penetration, or defects that place the resident’s safety in jeopardy. Only defects that render the premises uninhabitable and are not tenant caused will qualify for this remedy. Tenants may only invoke this remedy twice in any twelve-month period, and each time the
remedy is utilized, the cost of repair cannot exceed one month’s rent. In your situation, it appears that the tenant is abusing a privilege only available to tenants with serious dilapidations in their apartments. Without providing notice to you of the defect, and an opportunity for you to correct any serious defect, the tenant is not entitled to deduct anything from his rent. Provided you haven’t condoned his conduct, or waived your rights to accept the full amount of rent, you may demand that the tenant pay all amounts previously deducted, and become current.
Crime, unfortunately, is a fact of life in many communities throughout Southern California. When asked by the prospective resident about crime in the area, refer them to the local police department for statistics. Be careful not to portray your building as a “security” building or advertise it in any way that may create a false sense of security or safety. If your property provides an increased risk of harm, or has had a recent rash of criminal conduct, you may have a duty to disclose this fact to the prospective resident, even if not asked.
I recently bought a building in a pretty rough neighborhood. Seems like a day doesn’t go by without some sort of violent crime nearby. Just the other night, there was a shooting just down the street. I buy paint by the truckload to cover all of the graffiti and tagging on the building. I have a couple of vacancies now, and I don’t know if I have to tell them about all the stuff going on. Your community rules and regulations should specify your parking rules, specifically stating that only one vehicle may be parked on the premises, and that all parking is assigned. Ensure that you have the proper signage at the entrances to the parking area. Most cities require the sign to contain certain restrictive parking language, plus the local police department telephone number, and the California Vehicle Code section that provides for towing of unauthorized vehicles. Contact your local police department for their specific requirements, as they vary from city to city. Next if you know the offender, then provide a written warning of the violation. Attempt to serve it at his residence, post it on his door if he’s not in, and also put the warning on the windshield of his car.
If practical, take and save a photograph of the warning on the vehicle windshield, because the offender will always claim that you did not give prior notice before towing. If he fails to remove the offending vehicle, the car may be towed.

Overtime Rule Shows President’s Power Without Congressional Action
O
ne of the episodes on the old children’s TV program, Schoolhouse Rock, tells us that our nation’s laws are made through the roughand-tumble legislative process within the U.S. Congress where ideas are posed, debated and if all goes well, a bill emerges that goes to the President. If all goes really, really well, the President signs it. Or, as has been the case a lot in the past seven years, he vetoes the legislation and Congress goes back to the drawing board. What you do not hear in “I’m Just a Bill” is that other process by which rules are made that govern our lives — federal regulations from Executive Branch agencies. Last month we were once again reminded of the immense power of a President in affecting policy without the influence of Congress. The Department of Labor (DOL) released in May its final rule regarding workers who are eligible for overtime pay. The rule lifts the threshold under which an employee must be paid over-
time from $23,660 to $47,476 — impacting an estimated 4.2 million workers nationwide. The wage threshold is tied to the 40th percentile for salaried workers in the lowest-wage region of the Labor Department’s five established wage regions: Northeast, Southeast, Midwest, Southwest and West. This threshold will be updated every three years at the 40th percentile for salaried workers in the lowest-wage region, which is currently the Southeast and is likely to remain so in the future. Rules like these which make significant changes to existing laws feel like they should be addressed via Congressional action. However, what the DOL did is an extension of the Fair Labor Standards Act (FLSA) which establishes wage and hour rules for workers, including overtime pay. The FLSA says nothing about the degree to which the Department can change wage and hour rules so more than doubling the overtime pay threshold while
aggressive is not outside of DOL’s authority. What is frustrating for us — and for anyone who lobbies on federal issues — is that the options to influence regulatory proposals do not favor advocates who want to limit their impact. Going back to Schoolhouse Rock for a moment, the legislative process has a number of points of entry for advocacy — working with the original bill sponsor, testifying at a hearing on the bill, whipping votes in a committee markup or during floor consideration and even making small changes in House/Senate conference committees. The regulatory process has far fewer access points. There is a specific, mandatory comment period where federal agencies must listen to the concerns of the public. These can be extended for more difficult issues but ultimately the clock ticks down to zero. At some time, comments stop and the regulatory body moves forward with its rule with no requirement to accept any of the suggested changes.

Sometimes, federal agencies take comments to heart and alter their proposal. This actually happened with the DOL overtime rule where the final salary threshold was actually lower than originally stated. Many times, however, agencies move ahead with their proposal despite comments. Case in point is the Waters of the United States rule from the Environmental Protection Agency (EPA) where there were literally hundreds of thousands of comments submitted, but EPA made few substantive changes to its final rule. Congress also faces limitations of its own in responding to regulations. There is the Congressional Review Act (CRA) which grants an expedited process for Congress to review and invalidate a federal regulation. However, like standard legislation, this requires either the support of the President or a veto-proof Congressional majority in support of the resolution. Neither are easy to come by in this Congress.
These hurdles to advocacy certainly did not stop NAA, our partners at the National Multifamily Housing Council (NMHC) or the legion of other advocacy organizations from working to stop the change when it was first proposed by DOL in 2015. NAA and NMHC joined with the Partnership to Protect Workplace Opportunity (PPOW) coalition to fight the proposal from DOL. We were part of the original submission of detailed comments on the impacts of the proposal to workers and employers in September 2015. In 2016, we have supported legislative efforts to stop the rule via the “Protecting Workplace Advancement and Opportunity Act,” introduced in the Senate and House by Senator Tim Scott (R-S.C.) and Representative Tim Walberg (R-Mich.), respectively. We will roll out a grassroots alert later this month to build support for the legislation and increase pressure on the Administration to respond to our concerns about the
rule. As with a CRA resolution, these bills will need a veto-proof majority to get past an almost certain Presidential veto if they make it to the President’s desk. To get that we will need the voice of every NAA member. Regulations have always been a difficult challenge for advocates; however, this Administration has proven especially challenging because of the sheer volume of them. Looking to the future, the experience of the past seven years will either empower future administrations to advance their policy agenda in this way or chasten the Congress and Executive Branch to focus on the legislative process for dealing with the most significant issues. be traced to the refrigerator. There might be two issues you can look at. First check that the drain line for the defrost cycle is not clogged and two if the refrigerator has an icemaker, that the line is not leaking. Chances are the icemaker line has a hole or the drain line is leaking and the walls are sucking up the water. That is why you don’t see any standing water. Look under the fridge or pull out the fridge and look at the water line. It should be a small quarter inch nylon or polyethylene line; often they are white or translucent in color. If the water line goes though the cabinets to the kitchen sink; follow the line and look for rough spots or kinks in the line. Because these small water lines often leak for a long time before they are discovered, your walls may very well be saturated. The swelling baseboards are an indication they are full of moisture. The repair for this leak goes far beyond repairing the pinhole leak in the icemaker line. You will have to remove the drywall in order

You replaced all the easy ones!! When all else fails on a toilet leak down issue; it is time to put on your rubber gloves and get an adjustable wrench. Chances are the problem lies with the Flush Valve Seat. The rubber flapper valve seals against the flush valve seat (the big hole at the bottom of the tank.) to either keep the water in the tank or let the water out of the tank. The seat may have a burr, crack or calcium deposits that allow a small amount of water to seep past the rubber flush valve. Sanding the seat to remove the burr or calcium deposit is a short-term solution, but rarely solves the problem for long. A permanent solution is to replace the flush valve. Turn the tank upside down and remove the large nylon or brass nut that holds the flush valve to the tank. Install the new flush valve. Be sure the tank bottom is clean and no debris gets between the new valve’s rubber gasket and the tank. Tighten the large nut on the outside of
the tank and you are ready to reassemble the tank and bowl and put the toilet back into action. When reassembling the tank to the bowl, install new rubber washers and bolts.

Heating and air condition or HVAC should be inspected at least twice a year or at the change of the major seasons such as summer and winter. Prior to summer or winter seasons, it is essential to properly inspect and troubleshoot your HVAC (a/c)units whether they are window, wall or central. Most A/C units fail or work improperly due to nonexistent or improper maintenance and not age. Cleaning is your A/C is the most inexpensive and critical maintenance procedure you can perform. Here is our 4-point check list: 1: Turn on the A/C and listen for unusual noises. 2: Inspect/clean or replace filters. Filters should be cleaned or replaced at the beginning of each major season, such as before summer and before winter. 3: Clean & repair damaged or bent fins. (They can constrict proper air flow and decrease the cooling capacity of the A/C unit. 4: Clean out all dust and debris inside of the A/C pan or coils. Another investment-related benefit of consolidation focuses on tax efficiency. Bringing retirement accounts and investment accounts together with one service provider may make it easier to implement a tax-efficient investing strategy. With all your assets in one place, you can be sure the least taxefficient assets are in accounts that offer tax-deferral or exemption. If you’re age 70½ or older, you must take required minimum distributions (RMDs) from Traditional, SEP, and SIMPLE IRAs, as well as from any 401(k) or other retirement plan accounts left with former employers. Failure to take RMDs on time or in the right amount can subject you to a 50% IRS penalty tax. Having all retirement assets in one place can help simplify RMD calculations and payments. Consolidation also can help you keep beneficiary paperwork current. It’s important to always make sure all of your investment and savings accounts have up-to-date beneficiary information. This is especially important for retirement accounts, because beneficiary designations on retirement accounts supersede any instructions in your will
or trust. Having fewer accounts to keep up with can help make it easier to manage this information. If you decide to consolidate your accounts, make sure you consider all of the implications. Consolidating accounts might force you to liquidate certain investments that could result in unintended tax consequences. For instance, if you own appreciated employer stock in a 401(k) or other workplace retirement plan, you may no longer be able to take advantage of favorable tax treatment because of net unrealized appreciation (NUA) if you move those assets into an IRA. Other investments may carry surrender charges or other fees if you liquidate prematurely. Consult with your tax professional and/or Financial Advisor before taking any action. Consolidating assets can offer a number of benefits but should only be done after careful consideration. The potential benefits of greater control, tax efficiency, lower fees, and convenience may make sense for you.

Fire Season — continued from 26 homes in wildlife areas are primary targets for wildfires, you should still be aware if your rental property has a good amount of defensible space. Cal Fire categorizes this defensible space into 2 zones and recommends the following:
Zone 1: 30 ft. away from your rental home • Remove all dead plants, grass, and weeds and clear your yard, roof, and gutters from any dry leaves and pine needles. • Trim your trees so that a minimum of 10 feet is between the other trees and your property’s chimney. • Remove (or relocate to Zone 2) any flammable plants, wood piles, or patio furniture that could catch fire.
Zone 2: 100 ft. away from your rental home • Cut or mow grass down to a maximum height of 4 inches.
• Remove fallen leaves, needles, twigs, bark, cones, and small branches. While the standard defensible space for zone 1 and 2 is 30 ft. and 100 ft., check with your local fire department. San Diego County, for example, requires a 50 ft. clearance in zone 1.
Vertical and Horizontal Space in your Landscaping
In addition to clearing dead and dry plants, while you’re adding to your property’s landscape you should be aware of plant and tree spacing. According to CAL FIRE TV, wildfires generally start from the ground up, using plants as a ladder to go from the grass, to the brush, to the trees, and once it’s in the trees it’s extremely difficult to combat. On a level plane, generally you’ll want at least two times as much space between shrubs and 10 ft. between trees. Depending on the slope of your landscape, the amount of space between plants might double. Because fires travel upward, you should also be
aware of vertical clearance. Trim your tree branches so that there is 6 ft. of space from the ground. If you have shrubs near your trees, multiply that space by 3. As an extra step, you can also start incorporating fire resistant plants into your landscaping plan. Some common fire resistant plants are Sage, French lavender, and Wild Strawberry. Don’t let fire season creep up on you. Start making your rental property fire safe before it’s too late. The sooner you start clearing your property of dead foliage and adding fire resistant plants to the mix, the lighter the work load down the road. evolving and the climate was dismal. We did not have all the tools or resources people have today. Some of us were forced to learn by trial and error which can be quite expensive. What is the biggest challenge you are faced with today regarding the rentalhousing industry? A great challenge is educating my fellow property owners of the difference between being “cost driven” and “value driven” when making
decisions. I truly feel bad when people sacrifice long term gains for short term savings. Where do you see the rental-housing industry going in the future? It is a fact that U.S. rents will continue to rise at a steady pace along with population growth. We will continue to be a much needed and valued resource for housing, beta affordable and luxury for future generations. It is imperative that owners of older housing stock prepare themselves for the competition newer buildings are bringing to the market.

Always Ask Residents if Something Needs Fixing
I
remember when I first started in the apartment industry, someone told me to always ask my residents if there was anything in their apartment that needed fixing. Now, at the time, I thought that was kind of odd. Why would we ask if there was something wrong with our product? That seemed…I don’t know…almost as if we had no confidence in our own apartments. But because I was instructed to do it, I did it. And guess what? It worked. Every time a resident either called our leasing office or came in to the office in person, I always said, “Is there anything in your apartment that needs some attention?” or “Are there any outstanding maintenance issues in your apartment that we can take care of?” or

“Do you need us to come in to your apartment to repair anything” or “Is everything working all right in your apartment?” (You see, I got bored with asking the same old question, so I changed it up every single time I asked it.) And almost every single resident had *something* that needed attention. I might have been a leaky faucet. Or a loud blower motor on the furnace. Or maybe even a bi-fold door off the track. But there was almost always something. And they were all very grateful that I had taken the time to ask if there was anything they needed. Yes, it creates work. But it does so much more. Apartment Valuations in a Changing World
I
t can certainly be argued that the metrics on the adjacent Q1 2016 chart make a good case for current pricey apartment values: • Strong occupancy — 95.1% nationwide; • Rents rising handsomely (two bed/ two bath rents up 7.4% the past twelve months, 16.5% over the past twenty-four, across nine western statements, inclusive of California); • Low US inflation rate (.7% past year CPI increase); • Low unemployment rate — 5% nationally, which is the traditional definition of a “full employment” economy; Add to the valuation mix that shifting demographics suggest that the waves of millennials now entering the marketplace will desire rental housing in much higher proportions than have preceding generations. And of course, there’s also the very low long term interest rate environment — the benchmark ten year treasury yield sits at 1.68% as of this writing (6-10-16), just slightly above the modern era low of 1.43% — as an additional price booster (the lower the cost of debt, the more one can pay for an asset). These and other factors add up to what has become a pronounced seller’s market for apartment properties, a reality made clear to all buyers who’ve put a toe in the water these past few years. Specifically, the chart tells us that,
nationwide, buyers purchased apartments in Q1 at an average 6.24 cap rate and a 12.36 gross rent multiplier (3,690 transactions analyzed), while in super desirable Orange County, multifamily properties traded at a 4.57 cap and a 14.25 GRM (48 transactions). These metrics reflect record or near record high sale prices of apartments. And In fact, notwithstanding the published 4.57% cap rate for OC in Q1, my sense is that well located southern California apartment properties in turnkey condition will actually garner cap rates in the low 3’s at this time. Which brings us to the inevitable question of whether the market is reaching an “over sold” position such that today’s investors may be buying into an asset bubble. Proponents of the bubble scenario point to the Federal Reserve’s hugely accommodative post- recession Quantitative Easing policy, instituted in 2009, wherein the Fed Funds rate has been steamrolled to near 0% versus the 6.59% it averaged the thirty years prior, as the key component of the substantial appreciation since 2012 in most US asset classes, including apartments. The implication being that as the Fed eases off the monetary stimulation gas pedal, as it indicates it is in the process of doing, the reduction of “artificial” cheap money will cut into the prices buyers are willing to pay. The mathematics of such interest rate tweaks can be daunting…if the Fed were to increase the Fed Funds rate just two percentage points, and, if long term July 2016

rates and cap rates were to follow suit by rising two percentage points, here’s what happens: A multifamily property with a $100,000 annual net income that sells at a 3.25 cap rate today and thus produces a $3.077 million purchase price, would plummet to a $1.905 million price on the same $100,000 cash flow in a 5.25 cap rate world. Conventional wisdom might therefore suggest that buyers stay on the sidelines for now to wait out anticipated interest rate changes and the ensuing presumed impact on asset values. On the other hand, some investors envision a “lower return era” taking hold. This concept embraces the notion that globalization, together with technology advances, will somewhat suppress inflation and thus tamp down investor yield requirements. In effect, widespread access to higher quality information, better trained work forces globally, greater competition among businesses as emerging markets and third world economies increase the goods and services they bring to markets, all would combine to enhance efficiencies and improve productivity with a net result of reduced inflationary tendencies. If this latter phenomenon becomes reality, and I believe it is already manifesting, inflation and annual return on investment expectations will downshift, which could make cap rates in the 4–6% range, previously disdained, look like home runs.

Low Turnover and Raising Rents

very owner has that fear of not having sufficient cash flow to pay the mortgage. The smaller the unit count of a building, the greater the dread of losing a resident — particularly if that resident always pays the rent on time, never has a complaint, and basically keeps a low profile. Besides the loss of revenue, getting an apartment rent-ready and then re-rented is a lot of work. And, there can be sig-
nificant costs, especially if the resident lived in the unit for a long time. Carpet may need replacing, repainting may be required, and there may be other deferred or unknown repairs to various appliances and fixtures. So many owners fall into the trap of believing that low turnover is good and that the best way to ensure no one moves out is not to raise rents or to do so only minimally. Yet, the reality is,
not only are those owners losing out on dollars earned every month, they are hurting the value of their property and creating a greater possibility of having to face huge expenses. In my book, Cash In on the Myths of Real Estate, I devote an entire chapter to Day-to-Day Operations. Low turnover is one of the misconceptions that I address:
6-5 Low turnover is good. Popular Belief: Raising rents — either not at all or only a little — minimizes turnover, and that is the most profitable way to operate a property. Bill’s Truth: Keeping rents low to reduce the possibility of turnover seems like a great way to avoid empty apartments and thus maintain a steady stream of cash. However, but it does not maximize the returns you could be making. Turnover is healthy and ultimately profitable. Wise owners use turnovers as a time to make improvements that, in turn, provide a means for maximizing rents. These improvements help the owner to maintain a competitive advantage. More often than not, a prospective resident would much rather rent an upgraded apartment, rather than one in need of repairs.
An added bonus: Upgraded apartments attract a better caliber of residents, who tend to take better care of your property. If you defer various maintenance items in order to keep rents low or simply because of a lack of turnover, when the time comes that repairs are absolutely needed, you may not have the cash available to get those problems resolved. Keeping rents low and deferring repairs can become a vicious cycle that is difficult to break. Cash In: Keep rents at market value; do not be afraid of turnover.

Raising rents is a critical component not just from an operational point of view, but also as a means of ensuring the long-term value of your property and a fair return on both your investment and all of your hard work. Even if you have no plans to sell your property, you need to raise rents every year. The point at which you find resistance to rent increases is a red flag. Perhaps you have not invested sufficiently in making necessary improvements. Or, more importantly, perhaps the neighborhood is deteriorating and it is time to seriously think about selling before values fall too sharply. As discussed in other sections of my book, rents play an important role in determining the value of an income property. This is particularly true when there is the possibility of an increase in interest rates. All of us have worked hard to get where we are today. Although low turnover seems like a great idea, it does not serve your best interests. Executive Director, Lou Penrose opened the meeting with his legislative report on new and upcoming issues
affecting the rental housing industry. He welcomed the evening’s sponsor, Tim Gorman of W.R. Gorman, up to address attendees and promote Bill’s new book, Cash In on the Myths of Real Estate, that has been featured in previous issues of this magazine! A “Notice to Enter Dwelling” will be delivered so we can properly inspect units to address any concerns and complete needed repairs.
