Help Make This Year’s General Election Successful for AAOC

S

ummer is the perfect time to get away and relax, so you can come back refreshed and ready for the rest of the year. Most of us probably have a particular activity or outlet that provides us with that much desired relaxation. I like to fish, and while most people think fishing is little more than dropping a line, that’s not the whole picture. With fishing, you will not be successful in landing the big one unless you are prepared: • Getting the right lures and bait ready • Spooling the right line — on the right reel — on the right pole • Scouting where the fish have been biting, mapping the spots, and planning your time • Gathering all the supplies you’re going to need for a successful day • Being ready to jump into action as soon as the time and opportunity is right While thinking about how to have a successful day fishing, I saw parallels with what we can do to protect our industry in the general election this fall. Believe it or not, we are already in the middle of election season, and now is the time when we have an opportunity to really make a difference. With that in mind, I sat down with AAOC’s Vice President of External Affairs, Chip Ahlswede, to see what we

can do to make sure we have a successful election day for our industry — and just maybe land a big one for multifamily housing. Frankie: So, Chip, the sun’s shining, the waves are calling, and the BBQ is going. Are we really in the middle of election season? Chip: Believe it or not, we are. In fact, by the time our members read this, we will be in the midst of what we call the “filing period” This is when candidates formally signal their candidacy for city council or other local elected office by pulling nomination papers, completing them, and then filing the paperwork by the deadline — which this year is August 12. After that, their campaign officially begins and they’re off to the races. Frankie: Well, that leads perfectly into my next question. What can we in the rental-housing industry do to get ready for this election? What can we do to be part of the process? Chip: Sure, that’s a great place to start. And to tell you the truth, there is a lot that we can do now and moving forward during the campaign season, such as: 1. Let me start with the shameless plug — Be sure you contribute to AAOC’s Political Action Committee. You can contribute online via your member account and the AAOC website. We are ready to fight for you and support the candidates who share our values on rental housing issues, but our political

firepower is limited to the financial ammunition you provide us to invest in those candidates. 2. Before August 12th, consider running for office — or encouraging like-minded leaders in your community to run. No one can better represent our industry than ourselves. 3. Next, AAOC PAC trustees are going to be evaluating the candidates and determining who to support in which races. However, your guidance and input is extremely valuable. You know your communities best, so please share us with the information and insight that we need to know to make the best-informed decisions. 4. Along those lines, please also coordinate with us on which areas, messages, and candidates we really need to focus on — and which strategies we’re looking to implement that will drive success for our issues. 5. Finally, help us Communicate, Inform, and Advocate our issues and our supported candidates with your peers, your personal and professional networks, and others in your community. It takes money to get the message out to the masses, but it takes votes to win elections. Word of mouth from enough people at the President’s Message — continued on page 34

Mid-Year State Legislative Update

L

ast month, several bills in the legislature died. AAOC was opposed to many of the landlord-tenant bills. Some of the bills that were opposed sought to ratchet down on just cause for eviction, establish a statewide rent registry program that would have required rental housing providers to report rent levels, evictions, reasons for evictions, and information about each rental household, and make it totally impractical to purchase rental housing with the intent of improving it, and “Ellis-ing” (is this a word?) a building if a new owner wanted to wait for several years following acquisition. There were other bills that AAOC continued to oppose that passed out of their “house of origin” and over to the other chamber for action. This article will feature one extremely problematic and costly bill. It will also focus on a success story regarding a bill for which the AAOC

was opposed until the author of the bill committed to amend it to address the association’s primary concern. First, the problematic and costly bill. SB 1335 (Eggman) proposes to prohibit the use of any form of a person’s credit history as part of application and screening process for a residential unit if the applicant provides alternatives of financial responsibility in instances where there is any form of government subsidy. The bill was approved by the Democratic majority in the Senate and is now awaiting a hearing in the Assembly Housing and Community Development Committee. Why does AAOC continue to oppose SB 1335? • The use of credit reports by ALL creditors serves a legitimate purpose. Creditors review overall debt load and the performance to repay debt. If the theory behind SB 1335 is to supplant the lawful and purposeful use of credit reports, it should apply to all creditors. • Credit reports demonstrate how a person manages debt and the level risk that an owner can lawfully apply. • Our credit reporting and discrimination laws highly favor and protect consumers. They are not predatory. Our discrimination laws are among, if not the best in the nation. Our credit reporting statutes assure that consumers have every right to access, dispute, and correct inaccurate

credit reports. • Allowing an applicant to provide alternatives of financial responsibility leaves too much to the imagination and therefore leads to litigation. • The bill does not identify lawful and sustainable alternative financial sources. Nor does the bill require the financial alternatives to perform and pay all the tenant’s debt in the event of default. • In the event of the “alternative” financial source’s failure to perform, the bill poses a substantial legal conundrum: can the owner/manager seek an eviction due to the nonpayment of rent? • The California legislature has made substantial progress over the past few years: – Section 8 rent vouchers are considered lawful; – Tenants can bundle their income to lawfully qualify for rentals; – Guarantors that can pay during the entire duration of tenancy are fully recognized, defined, and accepted; – Our discrimination laws protecting tenants have vastly improved; and – The Newsom Administration has identified billions of dollars


to help tenants meet their rental debt obligations. AAOC believes that the focus of the Legislature should be on helping tenants meet their existing rental debt obligations. Should SB 1335 become law, selection of tenants who are financially challenged will suffer. Most of the applicants will not be able to demonstrate or show that they have a financial backer. Today, thousands of owners do rent to those who have experienced a temporary inability to meet debt obligation. The unfortunate result of this bill will be to adversely affect rental of residential rental property. Second, the bill that AAOC succeeded in having amended. AB 1738 (Boerner-Horvath), which proposed the mandatory retrofit in all multifamily parking lots for the installation of electrical vehicle charging stations, was approved by the Democratic majority in the Assembly and is now pending

before the Senate Housing Committee. From the time of its introduction, AAOC was opposed to AB 1738. We are pleased to report that the association secured key amendments and, as a result, the requirement will not apply to multifamily properties unless a building permit is required to improve an existing parking lot, which rarely happens! Here is a summation of AAOC’s arguments that helped the author of the bill decide to amend it to address our specific concerns. The bill would have: • Adversely affected housing affordability. • Lay at issue, the need to mandate a costly building retrofit where there are few rental households that will use the charging stations. • Begged the question of how the initial and ongoing costs will be financed and maintained and paid for.

• Ignored the necessity for the legislature to define: the affect in rent controlled properties, the involvement of the electrical utility companies’ data that will show where and when the EV stations can be used. • Ignored a social justice argument that the bill is not tied to state and federal financial incentives to pay for the mandate. • Disregard alternative fuel sources that are not reliant on electricity. Next month we will feature other bills of key importance to association members. Stay tuned. ORANGE COUNTY LEGISLATIVE WATCH B y C hip A hlswede

Elections Have Consequences The Problem

9% — That was the voter turnout on Friday going into Orange County’s allmail-in Primary Election. This put us on par to have the lowest turnout ever for any election. A week following election day and that number crept up to 28%. Less than 1-in-3 voters played a role in determining the outcome of our elections.

The Impact • One assembly race within Orange County went uncontested. • One assembly race will feature two Republicans facing off in the general election. • One county supervisorial race will feature two progressive Democrats facing off in the general election • One county supervisorial race will feature two Democrats facing off in the general election, with the incumbent coming in second. • Orange County’s two largest cities will have vacancies in their Mayors’ offices this November. • The next two largest Orange County cities have corruption inquiries happening. • Four cities are believed to considering potential rent control related initiatives. • One city is proposing an initiative to tax each rental unit $1,400 per year.

race, with two progressive Democrats squaring off against each other, rental property owners will have to decide whether to vote for the mayor of Santa Ana, who voted last fall to impose rent control and just cause eviction in his city, or his opponent, a Garden Grove city councilmember, who may or may not share similar views on these key issues. • In the 4th Supervisorial District race, the two Democratic candidates will need to clarify exactly what their positions are on rent control and Watch — continued on page 10

• The 38th Senatorial district will need more Orange County turn out if we want to protect that seat. • The 67th, 68th, 70th, and 73rd Assembly Districts feature candidates who need a better understanding of our industry. • All 34 city councils will have at least 2 council seats up for election. • There is a fiercely progressive, antiapartment owner activist group engaging our communities. We will have to work extremely hard in the coming months to make up ground in several areas of our county, and we will have to find new ways to engage pro-property rights voters if we expect to maintain ground in protecting the interests of rental housing providers over the next two years.

The Solution

The candidate filing period to run for local office (city councils, special districts, school boards, etc.) in the General Election will open on July 18th and will close on August 12th. During the filing period, we are asking you to get involved. Consider running for office, find out who is running in your community, identify those candidates who would be favorable to the rental-housing industry, and — most importantly — let AAOC know what you find out. From the close of filing to October 10th, the candidates’ campaigns are getting into full swing.

Attend candidate meet-andgreets and fundraisers; be sure to communicate with AAOC on what you’re learning and let us know which candidates you think we should be looking to support in your community. The final period, from late-September through Election Day, is the most critical time for candidates: • September 29th — Voter Information Guides are mailed to registered voters. • October 10th — Vote-by-mail ballots begin arriving in registered voters’ mailboxes. • October 29th — Voting Centers open and will remain open through Election Day. • November 8th — Election Day. Your involvement during this period is also critical. We need you to not just vote, but think about how you can sup-

• Volunteer some time to contact voters on behalf of the candidate and/or walk some precincts to help get the word out. • Promote the social media posts that AAOC puts out for candidates. • Think of new ways to get the message out for our industry. We have an opportunity to shape the legislative landscape for the next few years, and the path is really very simple — should we choose to take it. Or we can settle for low turn-out elections, mixed success, and accept loses in key races that will hurt our industry and could negatively impact your business. This is what it means when it said, “elections have consequences.” Now is the time for each of us to get involved.

Questions & Answers When serving notices, our policy is to “post-and-mail” whenever possible to avoid confrontation. Now, my attorney is telling me that the law requires that I try personal service first before posting and mailing. Is she correct?

Yes. Under California Code of Civil Procedure section 1162, a 3-Day Notice may be served by the following methods: (1) A copy of the notice may be delivered to the tenant personally; (2) If the tenant is absent from his or her place of residence and usual place of business, a copy may be left with a person of suitable age and discretion at either place, and a copy mailed to the tenant at his or her place of residence; or (3) If the places of residence and business cannot be ascertained, or a person of suitable age or discretion cannot be found, a copy of the notice may be affixed in a conspicuous place on the property, a copy delivered to a resident (if one can be found), and a copy mailed to the tenant at the location of the property.

Note that method (2) may be used only if method (1) was tried, but failed to reach the tenant. Method (3) may be used only if methods (1) and (2) were tried, but failed. In practice, this issue may appear at the unlawful detainer trial. A judge or opposing counsel, may ask if you were aware of tenant’s place of employment. If your answer is yes, and you did not attempt to serve the notice at the tenant’s place of employment, service of the notice will be found invalid, and you will lose your case. Thus, “post-and-mail” should not be your standard policy for service of a 3-Day Notice when personal and substitute and mail service were not attempted. I have a tenant who did not pay rent and I filed an unlawful detainer case. When I received the tenant’s answer to the unlawful detainer complaint, the tenant claimed the property was not habitable. What does the term “habitable” mean?

Residential rental units must be “habitable.” In legal terms, “habitable” means the rental unit is fit for persons to live in and that it substantially complies with state and local building and health codes that materially affect a tenant’s health and safety. The law makes both housing providers and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental agreement can determine who takes care of the minor repairs. California law lists several items that are required to maintain a habitable unit, these are effective water proofing and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facilities, heating, and electrical in good working order; clean and sanitary buildings and grounds; adequate trash receptacles; floors, stairways and railings in good repair. Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, and smoke detectors. A housing provider is also responsible for the installation and maintenance of the inside wiring for one telephone jack. Tenants must take reasonable care of the rental unit and the common areas.


Tenants are responsible for repair of all damage resulting from their neglect, abuse, or acts by their family, guests or pets. Tenants must do all of the following: keep the premises “clean and sanitary,” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly, not destroy, damage or deface the property, not remove any part of the structure, dwelling, facilities or equipment, must use the premises as a place to live, and use the rooms for their intended purpose, and notify the housing provider when dead bolts and window locks don’t operate properly.

In the event of non-compliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. This article is presented in a general nature to address typical landlord tenant legal issues. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, you can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit—Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. July 2022

Dear Maintenance Men:

I have a parking area at my building with concrete bumper stoppers. The problem is that when the cars touch the stopper, they move. How do I attach them to the parking lot? Bill

Dear Bill:

If you have an asphalt parking lot, it is quite easy. Most concrete bumper stoppers have two holes that go through from top to bottom. These holes are just the right size to fit a piece of halfinch rebar rods. Pick up two 12-to18-inch pieces of rebar for each stopper. Place the rebar through the holes in the stopper and then use a sledgehammer and pound the rebar into the asphalt. If your parking area is concrete, use a hammer drill with a ½ inch concrete bit to drill a hole in the concrete. Use your existing parking bumper as a guide. Either drill down through the holes in the bumper stop to the concrete below or use powdered chalk poured down through the bumper stop’s holes to mark the concrete. Then drill all the way through the concrete until you hit dirt. Hammer your rebar into the bumper and concrete. If the fit is loose, pour some concrete into the parking lot holes and then insert the rods.

Dear Maintenance Men:

A resident is complaining that their water heater is knocking and making rumbling noises. What is the problem and how do I fix the rumbling issues? Jane

Dear Jane:

These are what we call tell-tale sign of a looming issue in the making. The tank could start to leak or burst if this issue is left unchecked. Sediment collects in the bottom of the tank and traps water under layers of the minerals such as calcium & lime. When the burner heats the water, the trapped water boils and bubbles up causing the rumbling or knocking noise. The solution is to flush the water heater of any accumulated sediment. We will assume the tank in question is not a commercial unit with a clean out port. Flushing procedure: 1. Turn off the gas or breaker to the heater. 2. Turn off the water supply above the tank. 3. Connect a hose to the drain valve at the bottom of the tank so the water can drain away from the heater. (Leave this valve closed for the moment.) 4. Open a hot water valve in the unit such as a shower valve or kitchen faucet. 5. Open the valve at the bottom of the tank to let the water drain through the hose. Caution: This water will be hot. 6. Allow the tank to drain completely. 7. Once the tank is empty, open and close the cold-water valve above

the water heater. This will help flush any remaining sediment from the tank. Do this until the water runs clear out of the hose connected to the heater drain valve. 8. Close the drain valve and disconnect the hose from the bottom of the tank. 9. Open the cold-water valve above the water heater to fill the tank. When water starts coming out of the shower or kitchen valves, the tank is full. 10. Turn off the shower and kitchen valves. Leave the cold-water valve above the water heater open. 11. Re-light the gas burner pilot and turn on the burner or switch on the breaker for an electric heater. This procedure should be part of your preventive maintenance routine and done once a year, every year. If done every year, this maintenance routine will significantly extend the life of your water heater.

Dear Maintenance Men Readers… We are in mid-summer and, believe it or not, WINTER is COMING! Now is the time to review your pre-winter check list and do your preventive maintenance. Do you have a PreWinter Check List? See below for a good start. Here are a few tips:


1. We like to start at the top and check the roof for any damage. Check the flashing, roof transitions, and fascia boards. Don’t forget to check any downspouts and drain covers. 2. Check all the windows and make sure they well sealed. Clean out the weep holes in any aluminum window frames and caulking on wooden windows. This is a good time to put a drop of grease on the moving parts of the crank out windows. Check screens for holes and replace any missing screens.

6. Check sidewalks, stairs, decks, balconies, and ramps for cracks, lifting, and possible water intrusion. 7. Turn on and check all lawn sprinkler valves and look for broken heads, pipes, and errant concrete watering. 8. Inspect water heaters and boilers for proper operation. 9. Check and adjust any exterior lights and timers.

10. Check on your residents and ask for any feedback on anything that might need repair. They live at the building day in and day out. 3. Check the proper operation of all smoke and carbon monoxide alarms. Keep note of the original install date and the date each alarm was checked thereafter for your records. 4. Pool Maintenance: Are You Ready for Summer?

With spiking chlorine prices, maintenance teams must focus on pool water management.

A

dd chlorine to the list of apartment maintenance products that has seen its price soar in the past year. Just in time for summer, prices for pool chemicals (specifically chlorine tablets) are approximately 50% higher than they were one to two years ago. “If the cost of chlorine has not gone up again yet, it should soon,” experienced apartment maintenance professional and trainer, Mark Cukro, President, Plus One, says. A major fire at the BioLab chemical plant in Louisiana about a year ago has created a chlorine tablet shortage, he says. “However, the new factory is supposed to be bigger, have a higher capacity and is scheduled to open this spring or summer,” Cukro says. BioLab President Jon Viner said in published reports, “We are actively working to rebuild our plant — a $170

million investment slated to be completed in spring 2022 — and it will operate at 30 percent greater production capacity.”

Proper Dosing Goes a Long Way

Cukro recommends that pool operators increase their focus on chlorine consumption and dosing the pool correctly. “In other words, don’t overtreat the water,” he says. “Make sure the chemicals are in the ideal ranges, the circulation is working properly axnd filtration is functioning at its optimal levels. An effective way to stay on top of the readings is to test the water more frequently — three times a day — using a highquality test kit. And be sure to maintain the correct levels of stabilizer, too.” Always take into consideration the difference between liquid chlorine, granular chlorine and chlorine tablets. There are alternatives to chlorine tablets such as liquid chlorine, salt chlorine generators and there is also new technology in the pool industry that may assist in reducing the consumption of chlorine, Cukro says. One new technology is the Clear Comfort AOP system, which uses Hydroxyl-based advanced oxidation (AOP) created naturally by the earth’s atmosphere that can make water cleaner, more breathable and non-toxic. “However, one of the challenges with using alternative methods of sanitation is whether the health department will allow it in public or semi-public swimming pools,” Cukro says. Most pool operators should be able to find chlorine tablets and chemicals to treat their pool but don’t expect the shelves to be as full as usual.

Paul Rhodes, CAMT, Director of Maintenance Operations, The Life Properties, Atlanta, says pool maintenance is a topic “kind of ” floating under the radar right now — even as many communities are taking their pools “public” for the first time in a while, given the pandemic. “After a couple of years of diminished pool use, the expectation this season is that they’ll be back up and running at full speed,” he says. “Not only is the equipment a little rusty, those who are now responsible for the maintenance could be a bit undertrained in the process.”

Earthquakes as Greatest Natural Threat— Is your apartment building ready for The Big One?

range County’s website offers this advice to residents on preparing for emergencies: Although there are no guarantees of safety during an earthquake, identifying potential hazards ahead of time and advanced planning can save lives and significantly reduce injuries and property damage. It’s sage advice. So, what is the county doing to identify risks and to plan ahead to save lives, and reduce injuries and property damage? Since 2010, the county has partnered with Orange County Fire Authority to produce a multi-jurisdiction hazard mitigation plan promoting sound public policy to protect residents, critical facilities, infrastructure, key resources, private property, and the environment from natural hazards such as fire, flood, and earthquakes. Cities, first responder agencies, school districts, and special districts participated in the creation of this regional Emergency Operations Plan. The county’s ReadyOC.com website also offers preparedness tools, tips, and information regarding disaster risks in our region. Visitors to the site can get details on preparing emergency kits at home and sign up for the regional AlertOC emergency notification system.

Public involvement in developing the emergency plan included survey results, which ranked earthquakes as the natural disaster posing the greatest threat to their neighborhood. Total

results from the survey included: • Orange County respondents ranked earthquake as the natural disaster posing the greatest threat to their neighborhood, with fire and climate change a distant second and third. • Nearly 45% ranked earthquake as the greatest natural threat. • Almost all respondents (or their families) had experienced a disaster, with 73% impacted by earthquake and 70% impacted by epidemic. • Less than 30% of respondents ranked themselves as prepared for disaster. • 86% were signed up for AlertOC or another emergency mass notification system. Unlike flood or fire, which are contained and somewhat predictable in their nature, earthquakes strike without warning and their impacts are widespread. Large faults that could affect Orange County include the San Andreas Fault, the Newport-Inglewood Fault, the Whittier Fault, the Elsinore Fault, and the San Jacinto Fault. Smaller faults include the Norwalk Fault, and the El Modena and Peralta Hills Faults. In addition, newly studied thrust faults, such as the San Joaquin Hills Fault and the Puente Hills Fault could also have a significant impact on the County. While proximity to a fault produces a higher risk of damage in earthquake, the impacts of seismic shaking can be

widespread — posing a threat of regional concern. We should all heed the county’s advice: identify potential hazards and plan ahead. There are three steps apartment owners and operators can take to fortify their buildings and protect their income and investments. These strategies should be followed by any operation, large or small. • Know your apartment’s vulnerabilities: Soft-story buildings with tuck under parking are extremely vulnerable to earthquake damage. Loss of rental income, costly building repairs, and demolition are all serious risks. Add to that potential liability costs for negligence in operating an unsafe structure, or for environmental cleanup necessitated by the release of asbestos or lead, and you face economic losses that could easily force you into bankruptcy. • Create a plan for earthquake resilience: Evaluate the safety of your buildings to make sure that structural and non-structural issues are secure. • Consider the benefits of a seismic retrofit. Researchers at Caltech indicate every dollar spent in retrofitting soft-story structures can save property owners up to seven dollars, and that study didn’t factor in loss to contents, alternate living Earthquakes — continued on page 34

How Do You Make Luck Happen?

L

ast month my article focused on looking at the big picture. Now, on a more personal level, it is time to apply the possibilities revealed and the insights gained. There are no right or wrong answers. The reality is that not one of us knows exactly what will happen in the future. Even the most renowned economists can’t agree. All you can do is read, review the facts, weigh the different opinions and, then, apply the conclusions that you reach to your own circumstances and properties. So how does this work? Take for example the question: Can I survive and thrive in rising inflation and interest rates? Much depends upon your own situation. We are already seeing the rise in interest rates slow down residential sales. Maybe that does not matter to you. But what happens as costs continue to double or triple? Do you then see yourself in a position of having to sell one of your properties? From a broader perspective, how do you feel about the entire economy and outlook over the next two, three or five years? Last month I mentioned a new book, Fake Money, Real Danger: Protect Yourself and Grow Wealth While You Still Can. Whether you agree with the co-authors, Robert Wiedemer, David Wiedemer, Ph.D., and Cindy Spitzer, they certainly offer some thought-provoking ideas and suggestions. Based upon how you see increases in inflation and interest rates impacting your own investments, now is probably

a good time to ask yourself: Do I need more security? Where am I most at risk? What would happen if you faced a loss in cash flow or if the value of your equities dropped by 50%? What if both happened at the within three months of each other? This is probably also not a bad time to ask: Are my properties delivering the maximum rental value?” You may feel very comfortable, at the moment, but what if circumstances change? And, remember, we now have statewide rent control, so there are limitations on raising rents with your existing residents even if your operating costs go up and/ or you need more cash flow to offset other losses. Think, too, about those deferred maintenance items. What will happen if you have to undertake costly repairs or replacements? Will you need to get a loan? Do you have other resources and how secure are those values? Then, there is the question as to how will tax laws or other regulatory changes impact my bottom line? We have already seen evidence of ever-tightening rent control restrictions. What about 1031 exchanges and/or required readjustment to the tax basis when putting your property into trust for your heirs? Which brings up another question: Is my portfolio set up for a smooth transition and a way to build my legacy? Perhaps circumstances are such that hands-on ownership is not going to work for your heirs? Maybe selling or exchanging into some type of partner-

ship or Delaware Statutory Trust (DST) would be a better option. But do you do this now or wait a couple of years? You need to do some projections and run the numbers. All these questions may seem overwhelming. However, if you tackle each concern and possibility, one-by-one, you begin to form a more complete picture of where you are situated and what you need to do. This brings to mind one of my alltime favorite movies, Dirty Harry, with Clint Eastwood playing a tough copy with a cocky edge. As he was confronting a bank robber, he tauntingly issued his famous line: “You’ve got to ask yourself just one question — ‘Do I feel lucky?’” Dirty Harry had the power of being on the right side of the law behind him, and although, at times, he took a risk, he always knew that he made his own luck! Savvy investors, who are willing to ask those tough questions, do the research, evaluate the options, and make changes as needed, make their own luck. Just like Clint Eastwood in his role as Dirty Harry, they take action knowing what they want to accomplish and then understanding and weighing the risks. What’s luck? It is what you make happen.

Recession Lurking?

D

epending on who you listen to, this may be one of those when, not if, situations. Government messaging offers a somewhat sanguine narrative, implying that while a near term recession is possible, it’s certainly not inevitable. By contrast, leading private sector voices seem to suggest that an economic contraction by 2023 is more likely than not. Of course, the atmospherics will likely change in coming months as the Federal Reserve engages its interest rate levers, the war in Ukraine evolves, and the global significance of Covid becomes further defined. A core consideration in all recession prognostications is inflation and the question of whether it has peaked. As of this writing (6-12-22), the Consumer Price Index, the most commonly used metric for measuring inflation, reflects an 8.6% jump from a year ago. The May 2020 figure was the sharpest upward annual increase in forty years. The adjacent chart shows economic data at close of first quarter 2022, at which time annual CPI checked in at 8.5%. It then declined to 8.4% in April engendering hopes that inflation might indeed have peaked. Those hopes were dashed a month later with May’s announced 8.6% spike to a four-decade high. The Federal Reserve and its chair, Jerome Powell, are the first responders in battling high inflation. The Fed, chartered by Congress in 1913, has two primary missions: (1) minimize inflation, and (2) maximize employment. No problem on the employment

front at this point. As the chart indicates, a miniscule 3.6% unemployment rate for the nation prevailed when first quarter ended, which has remained in place through May. In fact, US employment is so strong that there are currently twice as many jobs available as individuals looking for work. As good as those numbers are for the American work force, tight labor markets can facilitate an overheated economy, which in turn can trigger inflation surges. Interest rate hikes are the blunt instrument wielded by the Fed when inflation suppression is called for. It has used said instrument twice so far this year, but markets are now expecting Powell and company to strike another four to five times in 2022. Those actions will likely lift bank prime rate to about 6%. Bank prime rate was 3.25% in January and is 4% at present. Meanwhile Freddie Mac’s 30-year fixed rate home mortgages, which averaged 3.45% in January, have so far risen to 5.54%, and are widely expected to reach 6% by year end. If you hit interest rates hard enough, spending will eventually be inhibited, an outcome fervently desired by the Fed at this time. The foundational concept: Inflation is caused by too much demand chasing too few available goods and services, so by shrinking aggregate demand you counteract inflation. And this is where the recession calculus comes into play. While the U.S. economy is currently projected to grow 3.1% in 2022, raising rates too aggressively could potentially choke off July 2022

spending so severely that the economy reverses course and downshifts into contraction, i.e. negative growth, and that would trigger substantially higher unemployment rates and disproportionate hardship on the poorest Americans. The end game that the Fed and everyone is hoping and praying for is the proverbial “soft landing” where higher interest rates slow but don’t kill the economy, supply and demand come back to a healthy alignment over time and inflation subsides back to the good old 2–2.5% annual level we enjoyed (and somewhat took for granted) the past quarter century, at which juncture interest rates would decline as well. But anyone who thinks the Fed’s job is easy, or that there’s an algorithm somewhere that can fix everything. is unrealistic. Managing a $25 trillion annual economy is an inexact science and, truth be told, involves some elements of trial and error. My own sense is that the die is cast and that an economic pullback awaits us around the bend. That said, we can take solace in that our banking and financial systems seem on solid ground, unlike the years that preceded the great recession of 2008–2009. This positions the nation, as a whole, to better weather the storm this time round. As to the apartment sector, it’s expected to survive the turbulence as well as any asset class given projected long term housing shortages that make the industry more recession resistant than most.

June General Membership Meeting Recap

I

t is never a bad time to evaluate your landscape, maintenance, and onsite operational practices, but the summer not only provides a convenient, mid-year opportunity to do so, but presents unique seasonal challenges, as well. The Apartment Association of Orange County’s (AAOC) General Membership Meeting on June 21st featured a panel of experts that provided online meeting attendees with valuable guidance aimed at helping them “Avoid the Summertime Blues — Operational Best Practices, Safety Tips & Resources for Housing Providers.” The first panelist of the evening was Liz Juarez, business developer with Mariposa Landscapes, Inc. She started her remarks discussing the dire drought situation affecting the state, and the need for us to limit our watering to twice a week — maximum. Juarez then shared several water-use efficiency tips including keeping the water off while shaving or brushing teeth, limiting showers to five-minute, and installing smart sprin-

On the landscaping front, she discussed the need for healthy soil which equates to hearty plants and the ultimate goal of texture and color in landscaping — creating visual interest. Overall, she suggested complimenting your landscape design layout with the building architecture. Following Juarez was panelist Roger Klump, owner of Pacific Coast Commercial Pool Service. Klump pointed out that maintaining a proper water level is very important, particularly in the summer months. If the water level is too low, it can cause chlorine distribution issues. He also emphasized the importance of maintaining a steady amount of chlorine in pools, as residents are utilizing them with greater frequency during the summer months. Klump also recommended going lower on a human pool capacity to better maintain this good chlorine level. He felt it was imperative that resident managers become familiar with chlorine levels and that they take certified courses to gain this knowledge. The third panelist of the evening was Rosie Rodriguez, Director of Residential Real Estate with Greenwood and McKenzie. Rodriguez shared some of the summer protocols implemented by her onsite property managers, which included completing educational courses in CPR and identifying the signs and dangers of heat stroke. Around the pool areas, there are many safety signs posted, and gates are fully functionable. On the general operational side, she recommended having

extra portable fans and air conditioners stored on site, which helps to avoid scrambling at the last minute to locate those items. Rodriguez also indicated that her property newsletters provide helpful tips to keep units cooler, such as keeping windows and blinds closed during the day, and that Greenwood and McKenzie has installed doublepained windows to help in this regard. Wrapping up the program was AAOC President Frank Alvarez, with Buffalo Maintenance, who shared several maintenance and safety tips and guidelines. Alvarez pointed out that if the air conditioner fails, a common cause is the trip break capacitor. He recommended keeping extras on-hand to better ensure a faster repair time and getting the unit operational. He also offered a reminder about replacing dryer vents, and being mindful of the safety risk and fire hazard posed by residents who use their grills and hibachis on their balcony.
