PRESIDENT’S MESSAGE B y F rank A lvarez P resident
Decisions, Decisions
T
he final quarter of the year is fast upon us and I cannot wait for 2020 to be over and done with. Thankfully, the days and months this year have flown by quickly. For some reason, however, my “To Do” list has grown instead of shrunk as the year has worn on, and everything seems to be a priority these days. As professional housing providers and business owners, we do not have the luxury of living life day-by-day or moment-to--moment, and we very rarely have time to stop and smell the roses. On top of that, we need to focus on year-end planning and the first and second quarter of 2021. Regardless of how mentally, physically, and emotionally exhausted we feel, there will be many decisions needing to be made that will affect ourselves, our business, and our industry. Also having decisions to make is Governor Gavin Newsom. By the time you read this message, all remaining state legislative bills affecting our industry will have either passed the Legislature and been sent to the governor for consideration or died in the Assembly or Senate. For those bills that now rest with the governor, it is his duty to weigh the impact of each one and either sign it into law or veto it. His decisions will directly affect our hardworking industry and the communities that we own and operate. The governor will have until September 30 to act on the bills that have reached his desk. Instead of biting our nails out of worry for the future of our industry, we

have the power to get involved. First, by contacting the governor’s office and asking for vetoes on the bills that will negatively impact our industry. Second, as we look ahead to the General Election on November 3rd, now is the time to endorse and support candidates who support our industry. Keep your eyes open next month, as the October issue of Apartment News will feature AAOC’s General Election Voters’ Guide and the endorsement list of candidates that your association recommends we support during these tumultuous times. I recently spoke with AAOC Vice President of Government Affairs Bill Christiansen to get briefed on his work and that of our unmatched, hardworking, and dedicated legislative committee. Here’s an excerpt from our conversation: Frank: How long will Governor Newsom have to weigh his decisions either in favor or opposition to the current bills on his desk? Bill: The governor has until September 30th to decide whether to sign or veto all the bills passed by the Legislature. Frank: What should we do in the meantime? Bill: We still have time to influence the governor’s decisions and AAOC will continue sending “Red Alerts” calling upon our members to contact the governor on the bills that affect our industry. Frank: Looking ahead to the election this fall, can you explain how we are voting this year? Bill: Since the governor and the State

Legislature decided that California would have a universal vote-by-mail election this fall, every member of AAOC should have already received their ballot in the mail. Frank: Our members and I have always been extremely impressed with how active and diligent you and our legislative committee are. Where are we at right now in getting the word out to our members about the issues and candidates that we should get behind? Bill: AAOC will be endorsing candidates who support the multifamily housing industry and creating a list that will be emailed to all members, published on the AAOC website, and featured in the October issue of Apartment News. Each candidate will have been vetted by our Legislative Committee to determine where they stand on the issues that matter most to our industry. Frank: Bill, what can our members do to help our efforts to elect pro-rentalhousing candidates to office? Bill: First, they need to vote. Second, they need to encourage their friends and family members to vote I support of the AAOC-endorsed candidates in their area. Frank: What’s new with AAOC’s efforts to defeat Proposition 21? Light at the End of the Tunnel
O
range County was officially removed from the state’s COVID-19 watch list on August 23 after gaining control over the resurgence in COVID-19 cases and hospitalizations that occurred earlier this summer. The county was placed on the watch list in June and then had a second wave of restrictions and business closures imposed to protect public health in mid-July. The watch list removal comes as welcomed news as it signals a major step toward more normalized conditions in Orange County. And for those of us with school-aged children, this includes schools being allowed to reopen for in-person student instruction. If the county can consistently meet certain state mandates through the beginning of September, students may be able to return to their classrooms shortly after Labor Day. If Orange County can keep itself from backsliding in the coming weeks and months, and a second wave of COVID-19 infections fails to materialize this fall, AAOC is even cautiously optimistic that it will be able to present at least a few smaller, in-person events

during the final months of the year, including its four-week Apartment & Maintenance Repair Series in October and its Reverse Trade Show in November. Perhaps we are finally seeing some light at the end of the tunnel. Speaking of light at the end of the tunnel, one year ago, AAOC announced its formal partnership with Orange County United Way and United to End Homelessness and introduced its membership to the Welcome Home OC program. For rental property owners and operators who wish to be part of the solution to end homelessness in Orange County, Welcome Home OC seeks to pair them with qualified homeless individuals and families with Section 8 vouchers who have been unable to find housing that falls within the HUD payment standard. Along with the partnership announcement being made at the General Membership Meeting last September, AAOC also recognized its members who had already signed up as inaugural program participants earlier in the summer. At our upcoming General Membership Meeting on September 15, we will welcome back Orange County United Way CEO Sue Parks to provide a progress report on the Welcome Home OC program and discuss the positive impact that AAOC members have had during the first year of the partnership. Thanks to our members’ participation — and that of the greater Orange County rental-housing industry — a meaningful step has been taken toward changing

the homelessness dynamic in our backyard. I hope you will join us online for a special presentation during the AAOC General Membership Meeting as we recognize our members who have joined the Welcome Home OC network over the past year and thank them for stepping up and helping us end the homelessness crisis in Orange County. Finally, I want to thank our members who have stepped up in recent months and contributed to AAOC’s effort to defeat Proposition 21, the statewide rent control initiative that will appear on the General Election ballot this fall. Since the association’s fundraising effort began in mid-June, our members have contributed more than a halfmillion dollars to AAOC’s MultiCounty Property Rights PAC. This is a strong start but there is considerable fundraising to be done. We are halfway toward matching what AAOC members contributed two years ago to defeat Proposition 10, and our goal is to break $600,000 in fundraising to defeat Proposition 21. If you have not yet contributed, now is the time to do so. SB 1410: Too Costly, Too Complex, and Too Constricting
$
1.4 billion dollars a month is the estimate that the state Franchise Tax Board estimates will not be paid to rental property owners during the COVID-19 state of emergency that began in March if SB 1410 (Caballero) becomes law. Now that I have your undivided attention, let’s look at what the bill proposes. SB 1410 proposes to void any demand for the payment of unpaid rent, or any notice to terminate tenancy served, that has accrued during the State of Emergency due to COVID-19. Any rental property owner who desires to serve an unlawful detainer on a tenant who has failed to pay rent during this period, will be forced to sign and offer that tenant a COVID-19 Eviction Relief Agreement, in order to exercise the use of unlawful detainer. This agreement is unilaterally optional for tenants only but is mandatory for any rental property owner who wishes to file an action for unlawful

detainer due to non-payment of rent during the State of Emergency. It allows a tenant to defer unpaid rent and would prohibit the owner from serving a notice terminating the tenancy or filing a complaint for unlawful detainer for that unpaid rent during and for an additional period of up to an unspecified number of days following the State of Emergency. Repayment of the unpaid rent would be made to the state of California beginning in 2024 and ending in 2034. Rental property owners would be eligible to receive any reimbursement in the form of a state tax credit from 2024–2034. SB 1410 does not address consideration of costs associated with the operation of any rental unit/development until an owner files their income tax return for 2024. Then and only then an owner may recover 10% of the unpaid rent per year. Many experts believe that owners will be foreclosed of the opportunity to

receive any additional compensation for uncollected rent accrued during this period unless they sell the state tax credit at extreme discounts. This would lead to greater diminution of value of the property and sums that property owners require for efficient operations. Should SB 1410 be signed into law, the impact will be severe and immediate. Owners, not unlike any business, will not be able wait 14 years to be repaid for debt owed (rent) today. The bill would result in a strong likelihood of bankruptcy, foreclosure, lack of maintenance, and a general inability to deliver quality rental housing. Here is what the Assembly Judiciary Committee analysis states as the reason for the bill: “The main strength of the bill is that it would protect against widespread evictions during a pandemic, while providing future compensation (starting in 2024) to landlords for their present losses (the payment of today’s rent)…SB 1410 also
keeps landlords (particularly small landlords) from falling into foreclosure by providing them with refundable tax credits in exchange for missed rent. These tax credits can be redeemed in annual increments during the 2024– 2034 tax years or can be sold by the landlord (and can only be sold once) at any given time.� Admittedly many property owners that are going to be forced into the SB 1410 tax credit program cannot afford to hold onto the tax credit for 14-years to be fully repaid by the state of California. To be repaid the state has devised a tax repayment scheme that will last 14-years and during that time the first owner may sell the rental balance that was not paid to the owner to ONE tax payer. That subsequent owner is forbidden to resell the credit. Selling your earned tax credit comes with riskthe first of which is selling the credit at a steep discount. Federal government low-income housing tax credits experts observe
there is no market for a state run tax credit program. It would take well over a year to create a state tax credit program. Small rental property owners will have no idea of who to approach, how and when to sell the tax credit, and most important should expect a 40-60 % discount. Those same experts don’t understand why SB 1410 prohibits the tax credit from being sold more than once. The federal tax credit program optimizes selling the federal tax credits until they become the right financial fit for all concerned. It appears that the state legislature knows more than the federal government. The proposed plan for rental property owner reimbursement is impractical and does not make reasonable provisions for the realities of operation and maintenance of a rental property. Without a subsidy provided that will act to supplement the loss of vital income, a rental property owner who experiences default by multiple tenants will be ill suited to sustain the hard-

ships of continuous operations. The ability to economically withstand a loss of income from multiple tenants will be an onerous burden, and few rentalhousing providers will be situated to withstand the strain for the four year period, until the time in which the tax credit may be recovered. If SB 1410 truly existed as a lawful mechanism, it would allow low- and moderate-income households to remain in possession when they have provided verification to owners that they have been adversely affected by COVID-19 and provide an effective financial repayment mechanism that would not crush owners. As of the date of this article, the bill is one of two measures that seek to bar evictions due to the non-payment of rent during the entire time of the state of emergency. Do we know what day, month and year will the Governor and local governments determine that it is safe to lift the state of emergency? Of course not!

R
unning a statewide vote-by-mail election will be complicated and there will be plenty of room for things to go wrong. Validating and counting a flood of mailed-in ballots will be a major effort. Only 15 out of California’s 58 counties had opted for an all voteby-mail election before the COVID-19 outbreak. Orange County had a successful and smooth experience in the Primary Election earlier this year, but will California’s 57 other counties be able to mirror Orange County’s success come the General Election in November? There were ultimately 100,000 Orange County Primary Election ballots rejected for multiple reasons including arriving too late to be counted. Neal Kelley, the Orange County Registrar of Voters, has implemented transparency measures for ballot counting, which include live video streaming and mandatory audits of the voting system. 80% of Orange County’s residents voted absentee in the March Primary Elections. That number is up from 60% in 2018. Kelley has developed a ballot-tracking system to handle such a large capacity and ensure voter confidence in the all vote-by-mail system. Every Orange County voter will be able to track their ballot from the Registrar’s website. In June, the State Legislature passed a special provision for the General Election, allowing ballots postmarked by Election Day to be counted even if they arrive 17 days late. The slower count of mailed ballots will prevent a clear Election Night winner in many

races, including statewide ballot measures. It could take days or even weeks after the polls close for all of the votes to be counted. The U.S. Postal Service has already had trouble with the processing and delivering of regular mail. Will they be able to handle an election-eve flood of millions of ballots in California? The Orange County voting data showed that voters’ habits did not change much in the Primary Election. Most voters wait until the weekend before the election to mail or drop off their ballots, or vote in-person, at a local voting center. In Orange County, the in-person voting centers will be open for five days, including Election Day. Election workers at vote centers will be required to follow strict public health rules. They will wear gloves and other protective equipment and will sanitize voting equipment at each site. The Orange County Registrar of Voters has ordered 300,000 masks for voting locations and election workers will be required to watch training videos with detailed instructions on how to keep the vote centers COVID-free. There is a concern that election workers might contract COVID-19 either right before or after the election, leading to a slowdown in work or the need for additional, well-trained backup employees. The vote-by-mail General Election will be very different from anything previously experienced. There will be plenty of room for things to go wrong statewide, but Orange County is fortu-

nate to have already demonstrated its ability to run an election smoothly under the new system. AAOC members will need to make sure they encourage their family, friends, and coworkers to vote for pro-property rights candidates in the General Election this November. Questions & Answers I am about to enter a five-year term lease for an industrial unit in Southern California. The unit has been vacant several months and I do not want to lose this deal, seems like good tenants are kind of few and far between lately. We have agreed on just about all of the deal points except a couple. At the last minute, the tenant requested the lease be prepared with a subsidiary of his company rather than the parent company, saying it is for ‘tax reasons.’ Additionally, he wants to make the use provision extremely broad rather than specific, allowing him to do just about anything in the premises without having to get my permission. He knows I need to lease the space, but I am not sure I want to give in on these points, what are my options?
Negotiating commercial leases involves a bit of horse trading. Often, terms that are very important to your tenant may not be so important to you, and vice versa. Knowing the pros and cons of each deal point allow you to knowingly accept or reject certain risks when considering certain requests. Generally, parties meet somewhere in the middle of a request, allowing certain concessions, but protecting the interests of the Lessor. The tenant’s last-minute request to substitute a subsidiary in its stead is an attempt to shift the risk away from the financially stable parent company, and obligate a less financially qualified entity, often times a mere shell, with relatively few assets. Screen the proposed replacement tenant as you would any proposed tenant to determine if it

meets your rental criteria. Is it an existing concern or a new entity recently formed solely for the purpose of signing this lease? Is it an independent business concern, generating its own revenue stream? With its own assets? Or merely a subsidiary of the parent with no independent means of sustainability. There are many options to offer that would allow the tenant to satisfy his ‘tax reason’ while still protecting the Lessor’s interests. You may allow the replacement tenant but require the parent company to guaranty the lease. The Guaranty can range from an unconditional full-term guaranty to a limited guaranty based either on a certain period of time, or a certain maximum exposure. An increased security deposit adds protection as well. Options such as an irrevocable declining letter of credit issued by a reputable financial institution allow parties to salvage deals that might otherwise fail. Use provisions are important for a number of reasons. It is important that the tenant’s use does not overburden the facility or interfere with the neighbors. Certain unacceptable tenant uses may involve high levels of noise, or the use of corrosive or carcinogenic materials, or other toxic byproducts. As your facility is an industrial complex, parking is no doubt limited. It is important that the approved uses do not overburden the limited available parking. Rather than approving a very broad undefined use, it is better to identify the allowed use, but allow the tenant to request approval

for a change of use in the event its operations change in the future. I just received the most curious letter. Seems my local police department has identified one of my residents as an undesirable, they say he is suspected of being in a gang and is dealing drugs. They say that if I do not evict him, the police will prosecute me for allowing a criminal to operate on my property. I may even lose the property! The family has been there for several years, other than a couple bounced checks they have been model tenants. Help, I cannot afford a vacancy right now, what do I do?
In this upside-down world we live in today, this actually is a growing trend in law enforcement. Rather than prosecute the criminal, many law enforcement agencies are taking the lazy way out and threatening the law-abiding landlord, forcing them to evict the resident. Rather than locking up the bad guys, just shuffle them off to another community. If the police are certain he is dealing drugs, why isn’t he in the “gray bar hotel”? If the letter you received is inconsistent with your experience with your resident, follow up with the police department by asking for documentation supporting their claim. Have there been arrests on the property? Have illegal drugs been found there? Ask other residents in the building, gather independent information. If the information you gather supports your resident’s involvement in criminal activity,
take action immediately. Consult your attorney to determine if you have enough facts to support a three-day nuisance notice, or if a thirty-day or a sixty-day notice is appropriate. Remember, a letter from the police department is not sufficient evidence in court to base a nuisance notice on, testimony from percipient witnesses will be required. My apartments have experienced some roof leaks. Most of the leaks are minor, but there is a pretty big leak in one apartment. This is of great concern to me, because the roof is less than five years old, and has never leaked before. I even had it inspected prior to the rainy season by a competent roof inspector. The trouble is that the water leaked into one of my resident’s unit, and apparently caused a substantial amount of damage. The resident claimed that his stereo equipment, television, computer, furniture, and clothing were ruined. He even has pictures of the water dripping from the ceiling onto his stereo and television set. The resident is threatening to sue me if I do not reimburse him for his losses. What should I do? Am I responsible for the resident’s personal property losses?
An owner is not generally liable for damage caused to the personal property of a tenant, absent negligence on the part of the owner or his agents. Provided a licensed roofing contractor performed the roof installation, you maintained the roof adequately, had it inspected on a regular basis, and were not on notice of any prior problems, you should not be responsible for damage to the resident’s personal property. Additionally, the tenant has an obligation to mitigate his damages when faced with a leaking roof. This basically means that if the leak was coming slowly through the roof, and the tenant knew about it, then he should have taken some measures to minimize the damage to his personal property. In simple terms, the tenant should have moved his stuff, and grabbed a bucket, rather than watch it drip. I am getting conflicting advice about whether or not I must rent to some one that does not have a valid social security number, nor an official picture ID. Seems like most of the attorneys and the Fair Housing guys say I ‘cannot discriminate’ and that I must rent to all, regardless of whether or not the prospect can prove who he is, or verify his tenancy history, or his ability to pay the rent. I have been following that advice for years and now have a building full of undocumented people that I could never find in a million years if I ever had to collect from them. The rent usually gets paid, but the building, and the neighborhood, look like hell. I want to take my building back and only rent to persons that qualify, that have verifiable identities and credit, and are good credit risks. What are my rights?
The dirty little secret is that our industry has passively allowed this erosion to occur over many years. Many landlords have looked the other way in favor of the quick rental, the cash payments, the
full building and the reduced confrontation. We have taken the easy way out. Landlords have been wary of lawsuits claiming discrimination and have believed the bullying taunts and threats from the tenant and immigrant rights activists, that we have just taken the easier and less confrontational course of allowing it to happen. We blame our government for not addressing the illegal immigration issue; one side of the aisle wanting cheap labor, the other wanting cheap votes. We blame employers for hiring, and our ‘welfare state’ for creating the magnet that keeps drawing. Landlords are part of the problem as well. By succumbing to the shortterm temptation of the quick rental to the unverified and undocumented, we are contributing to the problem. Many landlords are realizing that rather than just complaining, they can be a part of the solution. Landlords have absolutely no obligation whatsoever to rent to an individual who is unable to independently verify his identity, his past tenant history, and his ability to comply with the terms of the rental agreement, including his financial ability to pay the rent. Our system of society is built around a numeric social security or tax ID number. Our life history, good and bad, is reported more often than not, into a data base that is organized by, and sorted by the social security number. Names are common, but social security numbers are unique. No two people should share the same number.

It is just good business sense. My duplex has a 40 or 50 gallon water heater. What is the procedure for cleaning out the tank? I’m sure it has sediment as our water is fairly hard. However, I don’t see a clean out for the tank other than a drain valve. Frank
Dear Frank:
To get the most life out a residential water heater, a yearly tank draining and cleaning is recommended. Here is a quick run through on how to clean the sediment out of a tank without a dedicated clean-out port. 1. Turn off the gas or electrical to the tank. 2. Allow the water in the tank to cool for at least two hours or open a hot water valve such as a bath valve and let it run for about ten minutes. If you are in a drought-prone area, just let the tank cool by itself. 3. Turn off the cold water inlet valve
4. Connect a hose to the bottom drain valve at the bottom of the water tank. 5. Open the bottom drain valve to allow the draining of the tank. Be careful the water is not scorching. 6. Once the water is all drained away, it is not a bad idea to remove the drain valve at the bottom of the tank and insert a cleaning brush to remove any debris still loose at the bottom of the tank. It is recommended that you get a refrigerator coil cleaning brush as it is long and skinny and easy to insert through the drain opening at the bottom of the tank. If the bottom drain valve is plastic, we recommend replacing it with a brass ball valve. This will ease future tank cleaning. 7. It is sometimes recommended once
all the water is drained out and before removing the drain hose that you close all hot water faucets and repeatedly open and close the cold water tank valve. Allow about a minute’s worth of water to escape under pressure to help clean out the last of any loose debris in the tank, then close the cold water inlet valve. 8. Remove the drain hose and close the drain valve. 9. Now you are ready to refill the hot water tank. Make sure the bottom drain valve is closed and a hot water faucet is open in the unit. The open faucet will allow air to be purged from the water tank. 10. Open the cold water inlet valve leading to the water heater and allow the tank to fill. You will know it is full when the hot water faucet in the unit stops sputtering air and only water is coming out of the faucet. It is a good idea to open other hot water valves to help clear air of the lines as well.

The issue of the rotting posts lies in the Tree Growth Rings and their location. The rotting posts may have centered growth rings. If you look at the 4x4 post end, the growth rings will be either centered or not centered. A centered growth ring is common in post made from a peeler core. The tight centered growth rings of the peeler core will not accept pressure treatment as well as a post with off-centered growth rings. Chances are the fence you are repairing may have a mixture of peeler core posts and off-center growth ring posts. A Peeler core is the byproduct of plywood manufacturing. A log is turned on a lathe to produce plywood veneer and the center that remains is called a peeler-core. When buying pressure treated post, look for off-center growth rings.

Never Let a Crisis Go to Waste
M
any have uttered these words and while some get credit and others don’t for being original, one thing is for sure; our elected officials are pushing the boundaries of this quotation amidst the COVID-19 pandemic. This quotation is now being commonly applied to current economic and/or public health policies that seemingly are being exploited to advance political agendas at all levels of government. Which brings me to the point of my article this month. Please know that I’m taking a departure from subject matter I normally cover, because our industry is at a serious juncture. As you are well aware, ALL recent COVID-19 legislation and regulations, and orders pertaining to our industry have been problematic and could have adverse long-term consequences as to how successful we can operate our businesses. The tenants’ rights movement is out of control and has been working with elected lawmak-

ers to politicize COVID-19 in order to advance its agenda by assaulting housing providers with more taxes, regulations, and giveaways. Moreover, the complexion of California politics has dramatically changed over the past decade or two. California lawmakers continue leading a hard shift away from free enterprise and private property rights and toward much more progressive, anti-business policies that place tenants’ rights well ahead of owners’ rights. The state has evolved from a businessfriendly, property-rights friendly, entrepreneurial leader of the United States to one of the least businessfriendly states in the Union. But today I just want to talk about property rights and voting. Since COVID-19 broke out and Governor Newsom’s subsequent executive stay-at-home order, both elected and unelected officials have been falling over each other to introduce laws and regulations to “help the resident.” From Newsom’s ongoing eviction moratorium to remaining bills (as of this writing), AB 1410, AB 1436, and SB 1190, not to mention Propositions 15 and 21, never have we seen so many proposed laws antithetical to our industry. Many of them defy logic and common sense. Personally, I don’t believe they give our residents enough credit. Most of our residents are good people. They are hard-working people and they live where they live for good reasons and generally want to continue living there. Moreover, housing providers know that

the rents pay our bills, and since any unit turnover is costly, we’re not in the eviction business! Fortunately or unfortunately, the November election will be here before we know it and it’s incumbent that we vote for pro property-rights candidates. Our voices must be heard! To educate us, AAOC’s legislative team interviews candidates and only endorses those who are strong, property-rights advocates. AAOC publishes a voter’s guide and names candidates and legislation that support our industry. This effort requires a lot of time and is not taken lightly. It’s one of our many benefits of membership and you should see this guide in next month’s Apartment News. It is up to us to spread the word and vote accordingly. Please understand that this is not a Republican or Democrat issue, because one can find pro-property rights advocates on both sides of the aisle striving to advance property and business rights. However, if the left-leaning State Legislature stays in power, this assault by the supermajority will likely continue. Ways to Cope with No Clear Direction
I
t seems like apartment owners and managers are getting hit from all sides and, perhaps, the most disturbing fact is that there is so much uncertainty on so many different levels. Yet even in the midst of not knowing, there is a way to gain clarity. As Bill and Tim Gorman have said so many times, “you have to know where you are to be able to know where you are going.” With all that is happening, not only here in Orange County but throughout the state, the nation and the world, taking stock of your current situation is more important than ever. An easy starting point is a simple cash flow analysis. From a real estate investment standpoint, this should be done both for each property and across an entire portfolio. Equally, if not more helpful, would be a financial planning approach that encompasses all sources of income, including pensions, social security, interest and dividends. Looking at the entire picture may relieve some of the stress or bring into sharper focus a more precise timeline as to what needs to be done when. In many ways, this is simply a real-world application of the old saying, “Can’t see the forest for the trees.” Taking a step back provides an important, broader perspective. On the other side of the ledger are expenses. As we all know, some have gone up and others have disappeared entirely. This is certainly true on a personal level where grocery bills have, for many, more than doubled; while gas

and car repair expenses have dropped dramatically, along with expenditures for dining out, entertainment and travel. Apartment operators need to compare current expenses with those of the previous year. This is not as much a matter of cost controls, but of understanding the impact that the pandemic has had upon physical operations. Related increases are apt to be found as a result of more cleaning and sanitizing of common areas and the need to call more frequently upon outside services. Although this is an evaluation of what is happening right now, consideration should be given to changes that, if they have not already occurred, may be required within the very near future. Perhaps it is implementing new rent payment systems so that those transactions can be handled online through a third party or revamping how package deliveries are handled on larger properties. There may be costs involved with these types of alterations, but they also represent a streamlining of operations. Although hands-on owners may see picking up rents in person as a way to stay connected with their residents, doing so every month ties them to the property even in the best of times. Perhaps a little more freedom might be a silver lining to consider. In many ways, how an owner approaches all of these changes and uncertainties might best be evaluated in terms of his or her needs, wants and desires. Now is probably a very good time to reassess your goals, particularly

in terms of what you want and need from the income properties that you own. The coronavirus pandemic has
pushed apartment managers to prioritize the use of technology as a tool to draw prospective residents. It’s also helped them focus on how to best serve existing residents from afar. In both efforts, companies need to shift their marketing initiatives to create the safest and most effective way to communicate with residents, prospective residents and team members. For example, a large number of management groups (if not all) now appear to offer personalized, one-on-one virtual tours through Zoom

Communicating Effectively
Marketing to current and prospective residents has become important than ever. And with marketing, of course, comes communication. In these unprecedented times, residents can feel anxious about the unknown, and it is our responsibility to answer their questions in a clear and concise manner. So you should always be available, answer questions promptly and continue to reach out to prospective residents in a timely manner. Since conditions have been changing rapidly, it’s important to update residents regularly about such policies as the closure of community amenities, changes in office hours and additional sanitization around the buildings. Make sure employees are in the know and delivering an appropriate and clear message across all of your communities. And ensure that your marketing materials reflect any new policies.
Retaining Current Residents
At first, the industry’s focus during the pandemic was on how to continue to lease; now it has shifted to how we can continue to engage with residents and create a strong sense of community. I have seen some great examples of apartment community managers going above and beyond to ensure that their

residents are being acknowledged and feeling safe at home. It can be as simple as making masks available to residents, writing inspiring messages in chalk or encouraging them to join in socially distant community sing-alongs from their balconies. One great tool for communicating with residents in recent years has been social media. But right now it’s actually one of the only ways to get your message across. Personalized Facebook groups for each community, for instance, not only ensure regular communication with residents, but also provide that close-knit community feel. In a sense, Facebook groups have turned into a modern resident newsletter. The platform can be used to share with residents such activities as tours of local museums and cooking classes; provide additional resources specific to your company; create a space where residents can share opinions and discuss issues with one another; and much more.
The Future of Apartment Marketing
Now fast-forward to when we get back to more normal times. Will traditional marketing return as well? Since we’ve seen success with the use of technology in apartment community management, most of these marketing tools are probably here to stay. Even before the pandemic, the leasing process was already shifting to virtual reality. In the long run, virtual tours and videos should help streamline the leasing process. Now, when prospective residents come in for in-person appointments, we will have a better understanding of their expectations and what they’re searching for. Companies that may not have this technology readily available can certainly go back to the basics, focusing on how to make an impact with simple gestures to engage prospective residents. Who needs technology if you can create a similar experience by walking them through photos and floor plans over the phone? Engaging with them from the start of the relationship is what

matters most. Either way, it seems more important than ever for us to realize that we play an essential role in creating community for our residents, and that our teams must continue to provide the ongoing support people need to feel safe in their homes. The Demand for Flexibility in the Workplace. Overcoming Challenges for Onsite Staffing.

o address the need for greater flexibility, employers should consider loosening paid timeoff policies. With the world’s response to the COVID-19 pandemic coronavirus eliciting a host of new behaviors personally and professionally, the need for more flexibility in employee policies and procedures has been a hot topic among companies across all industries. Given the essential societal role the
industry plays through providing housing, employers should consider the unprecedented nature of this crisis and why it necessitates greater workplace flexibility. Requiring an employee to exhaust all paid time off (PTO) at this time is likely not a best practice for resolving this concern, so how do employers meet their workforce more than halfway? Employers must face the reality that employees with school-age children are
going to be faced with tough decisions as the fall approaches. Other than potential ADA and Family Medical Leave Act considerations, this is unchartered territory. Employees certainly should be allowed to use PTO during these school closures, but employers should relax the rules relating to the notice of use of PTO and avoid enforcing the policy in a manner Flexibility — continued on page 30

But the issue remains: How can any company optimally operate with a portion of their staffing unable to work regular hours because of the pandemic? For each company, the idea and execution of workplace flexibility may look different. This may be easier for corporate offices, as there are more shared job responsibilities and most, if not all, employees may have the option for remote work. The more challenging part of flexibility greatly affects those employees working onsite, serving on the front lines. Each property has limited staff in place and with the need to be physically present to assist residents, there is difficulty in continuing to meet resident needs and expectations while working with this limited staff and the limited operating hours. There are many ways to allow for flexibility for all employees, including onsite team members:
• Leveraging technology for virtual leasing, online payments and resident requests should be a primary area of focus. • Retrain residents to understand the difference in services that still provide value. Are you there because your residents demand your physical presence or because technology platforms are nonexistent or minimally used? – This will especially be difficult for long-term residents who expect personnel to be onsite daily, such as maintenance staff walking residents through work orders remotely or providing resources such as resident handbooks and videos on how to complete simple maintenance in their homes. • Create solid relationships with companies you can contract for cleaning and other tasks in the event of absence.
• Job sharing and compressed workweeks are a start.
• Utilizing smart locks, allowing access to areas for residents and contractors.
• Shared staffing, or “floaters,” between multiple properties is encouraged.
• Partnering with a local temp staffing agency to assist with extended absences.

Allowing increased flexibility for all employees will continue to be a significant challenge for companies. The Families First Coronavirus Response Act (FFCRA or Act) allows a parent to take leave to take care of child if they meet the qualifications. Trying to be flexible and allow work from home when possible will be key. If companies do not help employees by making adjustments, they could lose great employees for reasons beyond their control. Earthquake Resilient Buildings Protect People and Communities. Homelessness Could Rise If Older, Affordable Housing Is Destroyed.

4.2-magnitude earthquake last month in L.A. rippled well into Orange County, rousting people from their sleep in the wee hours of the morning. It was a literal wake-up call. During months of barely detectable seismic activity, many had forgotten the threats earthquakes bring to our region. The larger the quake, the more devastating the impact. When buildings are destroyed, people lose their homes, their

jobs, and the economy can abruptly grind to a halt. Leading business and government executive will tell you that we are not prepared for the region’s next major earthquake. If we don’t begin to act soon, the result will likely be widespread damage and displacement of thousands. In 2019, the number of people in this state without homes grew by more than 21,300 people, or 16.4% — more than all other states in the nation combined

Homelessness — continued from 32 Affordable Housing at Risk
Arizona conducted a full-scale earthquake drill in 2018, based on the anticipated scenario that 400,000 Southern California evacuees will go there to seek shelter following the devastation of a massive earthquake. The reason for this wave of nearly a half million refugees would be simple: The majority of structures identified as at risk of failure in an earthquake represent older, more affordable housing stock or commercial buildings that provide much-needed manufacturing, logistics, and service-related jobs in the communities they serve. The loss of these structures would bring serious economic disruption, with thousands of people left without a roof over their heads or a job to provide for their families. We saw this on a small scale when refugees from the 2017 fires in Napa and Sonoma counties were faced with
an out-right housing crisis. Those who were displaced, whether they owned homes or rented, faced an increasingly expensive real estate market that had already been seriously squeezed by a limited housing stock — particularly for affordable housing. Following the fires, many of those who lost their homes fell victim to rent gouging. Families with children doubled-up with neighbors hoping to keep their kids in the same school district. An even more serious example was seen in 2018 when the Camp Fire, the deadliest wildfire in California history, brought near total devastation on the town of Paradise. The fire left 85 people dead in Paradise, 14,000 homes destroyed and tens of thousands of residents displaced. These dire housing situations could become an even more serious concern following a major quake in more densely populated areas, the Association of Bay Area Governments determined. If many of a region’s affordable
housing units are lost in an earthquake, “a constrained market may drive up the cost of housing even further. Loss or damage of housing that results in increased costs…will likely increase the number of permanently displaced Bay Area residents.”

INSPIRE Property Management Webinar Recap — Valerie Sargent Continues to INSPIRE
T
hese are trying and challenging times and emotional intelligence plays an important role as we cope and get through this moment, according to national speaker, trainer and executive consultant Valerie Sargent at the Apartment Association of Orange County’s INSPIRE Property Management Webinar on July 22. In her presentation, entitled “Use Your Emotional Intelligence to Tame Your Brain and Cope During Crisis,” Sargent pointed out that emotional intelligence is all about utilizing your emotions intelligently to gain the performance that you wish to see within yourself and to achieve interpersonal effectiveness in others. More specifically, it entails Self-Awareness, SelfManagement, Social Awareness and Relationship Management. Sargent emphasized that we are not our brains; we create everything about how the world looks and feels. “We are shaping our reality. The more aware you are, the more power you have over reality,” Sargent stated. “It is helpful to name and recognize what you are feel-
ing and take away some of the negative thought processes around it.” She suggested that it is helpful to talk to someone about problems and write down stressors, which helps to eliminate the emotions involved with them, and to simply pay closer attention to what you are feeling. There are many ways to support our brains according to Sargent. This includes multi-vitamins, a healthy diet, exercise and meditation. “It is all about self-care, which includes establishing positive routines, turning off devices, creating daily goals, and generally being kind to yourself.” Regarding working with others, Sargent recommended being empathetic and becoming completely aware and conscious of how someone else views something or a situation, along with how they feel and what drives them. She recommended totally engaging with the other person, engaging them in conversation, and being genuinely curious and interested. Sargent also presented the webinar attendees with a variety of interactive
exercises during her remarks, including online polls regarding workplace physicality patterns, looking at photos of a COVID-19 hospital unit and having them change their perspectives to identify both positive and negative aspects of the same image, and describing what gratefulness entails. At the conclusion of her remarks, Sargent offered some inspirational thoughts and guidance when it comes to using Emotional Intelligence: Think before you speak; note if what you are about to say is true, helpful, important, necessary and kind; realize that you are enough; and remember that you are valuable. Fact Sheet Michael Weinstein and his multi-million dollar special interest group are now backing Prop 21 on the November 3, 2020 statewide ballot that will make the housing crisis worse. These are the same special interests who spent more than $25 million on the flawed rental housing measure, Prop 10 in 2018, which voters rejected overwhelmingly with a 59% NO vote. Don’t be misled. Prop 21 is even more flawed than their last measure. It’s bad for homeowners and renters – and will make California’s housing crisis even worse.
Eliminates Costa-Hawkins Protections •
The Costa-Hawkins Rental Housing Act of 1995 prohibits local governments from enacting certain types of restrictions on property owners. Prop 21 removes most of those protections for property owners, meaning a city or county could: o o o
Enact vacancy control so an owner cannot raise rents to market rate after a tenant moves out. The measure would limit rent increases to 15% of the previous tenant’s rent within the first three years of a new tenancy. Cap rents on single-family homes if the owner owns three or more homes. Cap rents on properties built after 1995 if they are more than 15 years old, bringing more properties under local rent control every year.
Allows Regulation of Single-Family Homes • •
Prop 21 allows local governments to impose rent control on apartments and privately-owned single-family homes without a vote of the people. Prop 21 could even lead to unelected bureaucrats charging homeowners a fee for taking their home off the rental market.
Reduces Housing Supply and Drives Up the Cost of Existing Housing • •
Prop 21 will encourage landlords to take rental properties off the market and convert them into condos and townhomes, further reducing the rental housing supply and making the housing crisis even worse. By creating an inconsistent and unpredictable patchwork of local ordinances, Prop 21 will prevent critical affordable housing development and drive rents and housing costs up even higher.
Places Bureaucrats in Charge of Housing with the Power to Add Additional Fees •
Prop 21 will put as many as 539 rental boards in charge of housing, with bureaucrats deciding what people can or cannot do with their properties, and will give the rent boards unlimited power to add fees on housing, which will ultimately be passed on to tenants in the form of higher rents.
Adds Tens of Millions in New Costs to Local Governments and Increases Pressure to Raise Taxes •
The state’s non-partisan Legislative Analyst says Prop 21 will increase costs for local governments by tens of millions of dollars per year and cost the state millions more in lost revenue, which will mean diverting funds from other vital state services. This will pressure local governments to raise taxes even higher.

Prop 21 will make the housing crisis even worse. Vote NO on November 3! Moreover, this will make the properties far more marketable at the time of a sale or acquisition. FRS is able to reveal any discrepancies that potentially misrepresent the level of flood risk associated with the structure and then identify the available solutions that may result in a reduction of the flood insurance premium or the removal of the requirement to maintain flood insurance completely.
