Irregularities cost Kambwili bail By CHARLES MUSONDA IN a momentous irregularity, Chishimba Kambwili has appealed against an offence for which he was acquitted. And this is after Deputy High Court Registrar David Simusamba, sitting as Principal Resident Magistrate discovered and exposed more irregularities yesterday. Magistrate Simusamba confessed that in his 13 years on the bench he had never come across a defendant who appealed against his acquittal. The blunder, he said, was indicative of the grave irregularities in the application which was prepared long before judgment was delivered. This, he said was irregular and therefore unacceptable and that he shall not entertain any application for bail pending appeal by Kambwili until he fully complies with appeal procedure enshrined in the Criminal Procedure Code (CPC). Making a ruling on irregularities in Kambwili’s notice of appeal yesterday, Mr. Simusamba, who sits as Principal Resident Magistrate in the matter, said the convict will continue serving his sentence until further court order or completion of the sentence. “The notice being irregular, I therefore hold that there was no notice of appeal at all. Consequently the convict cannot invoke Section 332 of the CPC by applying for bail pending appeal without complying with Sections 321 and 323 of the CPC,” Mr. Simusamba said. He said Kambwili’s notice of appeal was filed way before

he could finish delivery of judgment and sentence, a position which is contrary to the demands of Section 321 of the CPC. He said evidence of this fact can be seen in the grounds of appeal contained in the notice of appeal and the affidavit in support of summons for admission to bail pending appeal both filed on October 14, 2020. Mr. Simusamba said in the grounds of appeal Kambwili said, “more grounds to follow upon perusal of judgment,” meaning that at the time he was making the grounds of appeal he had not perused the judgment or he was simply not paying attention when it was being read out to him. He said it is a requirement that the appellant signs the notice of appeal and one wonders at what point he signed the notice of appeal as it purports to have been signed by him when he clearly had no such opportunity as he was listening to his judgment from the dock. He said what is even more shocking is the evidence in the affidavit in support of summons for admission to bail pending appeal in which Kambwili says he was convicted for forgery, uttering false documents, and giving false information to a public officer on October 12, 2020, the date which was initially set for judgment before it was postponed to October 14, 2020. Mr. Simusamba said the most shocking is that Kambwili has appealed against his acquittal on the charge of giving false information to a public officer despite having denied the charge at the time he took plea and throughout his trial.

LUSAKA PROPERTY VALUATION SHOCKS, ANNOYS RESIDENTS By NATION REPORTER

HERE is a huge uproar in Lusaka over highly inflated property valuations which are beyond the means of domestic and commercial property owners. The hardest hit are former civil servants and council tenants who bought properties at modest prices and now are being asked to pay rates several times more than the cost of the houses. “These figures the council has conjured are totally impossible and any budget made with this wild expectation is bound to fail,” said a property owner. Property owners fear that valuing the

properties at their current rate would attract unreasonable ground rates as they increase with the surge in value. Another leaseholder wondered how a residential property bought at about K30 million (30, 000 rebased) in the 1990s could now be valued at over K3 billion. “This is unreasonable, how do they expect us to pay such exorbitant ground rates for properties that were acquired at a lower value,” he said.Lusaka Town Clerk, Alex Mwansa however said in an interview that the valuation notices that were being served should not cause panic as they were not final. Mr Mwansa said property owners who had objections were free to lodge in their complaints before November 6, this year

and that their cases would be heard by the Rating Valuation Tribunal. He said the tribunal would appoint independent valuators who would assess the value of properties of those who would have objections and advise accordingly. Mr Mwansa said the valuations were done by the Government Valuation Department for checks and balances purposes and that set guidelines and calculations were followed. “Those who have objections will have an opportunity to appear before the tribunal and engage them. The property owner can object if they feel the value is higher or lower,” he said. The Lusaka City Council Main Valuation Roll of 2019 is now open for inspection by leaseholders and notices are being served.

State defends presidential appointments in court

By GRACE CHAILE-LESOETSA ATTORNEY General Likando Kalaluka has asked the Constitutional Court to dismiss a petition by three non- governmental grganisations (NGOs) seeking a declaration that the current composition of Cabinet and the provincial ministers is unconstitutional as it does not include the marginalised. Mr Kalaluka states that President Edgar Lungu acted within the confines of the constitution in exercise of his executive function. Chapter One Foundation Limited, the NonGovernmental Organisations’ Coordinating Committee for Gender and Development Registered Trustees and Ms Harriet Chibuta suing in her capacity as executive director of Young Women in Action have cited the Attorney General as the respondent in the matter. They contend that the actions of President Lungu in nominating the MPs and appointing the cabinet and provincial ministers, neither reflect the gender parity considerations nor the equitable representation of youths nor disabled persons as contemplated by the constitution. According to the NGOs, the Head of State

acted in an unconstitutional manner. The three stated that despite Parliament comprising 29 women, two youths and one person with disabilities, none of the 10 appointed provincial ministers is a woman, youth or person with disabilities. They stated in the petition that of the 30 appointed cabinet ministers, only nine are female and none are either youths or persons with disabilities. They want the court to make an order of mandamus directing President Lungu to use his power under Article 72(3) (f) to revoke the nomination of all or some of the Members of Parliament he nominated and appoint new members to comply with the provisions of Article 259 of the Constitution. But in response to the petition, the Attorney General argued that article 259(i) of the Constitution makes it the prerogative of the President to nominate or appoint any person to a public office. He stated that the proviso to article 259 (1)(b) which reads “unless it is not practicable to do so” connotes that for a 50 percent gender split on nominations and appointments as Cabinet ministers and provincial ministers to be done, these appointments must be “practicable” to the appointment.

Cancel public external debt …100 NGOs petition lenders By NATION REPORTER THERE is need for unconditional “cancellation” of public external debt payments by all lenders for at least four years for countries to navigate the hardships caused by Covid-19, over 100 international non-governmental organisations have said. According to a letter addressed to governments, international institutions and lender institutions, the organisations stated that borrowing governments have it within their power to stop making debt payments but should not suffer any form of penalties for doing so. They indicated that the Covid-19 had severely impacted on the health, safety and survival of hundreds of millions of people. Communities worldwide, they said, were being pushed deeper into poverty, precarious existence and inequality with the massive loss of paid and self-employment. They stated that livelihoods and further limiting of access to food, water and sanitation, adequate housing, education, health service and other basic needs had now become the order of the day. “It is estimated that 500 million more people could be pushed into poverty as a result of the pandemic and the economic downturn that it has exceedingly exacerbated. In all the regions of the world, violence against women, girls

and LGTBI people has escalated in number and severity,” they indicated. The organisations, which include ActionAid, stated that there was a strong light on the continuing debt problem that was in the way of people’s survival, the fight against inequality, the realisation of their human rights, sovereignty and the self determination of people. According to the organisations, over $300 billion was being spent annually by the global south for Public External Debt payment to bilateral and multilateral lendwers such as the World Bank and IMF, private banks, speculators and investors in government bonds and securities. The organisations from different countries said the debt problem was compounded by illicit financial flows also in the billions of dollars. “This is money that is vitally needed for public investment on vital healthcare to fight Covid-19, economic and structural assistance to affected, vulnerable and marginalised individuals, families and communities, and building Economies towards more just, equitable, climate resilient and sustainable systems,” the letter read in party. They complained that the responses to the debt problem had been severely insufficient in the best case, and in many occasions counterproductive given the urgency and severity of the crisis being faced.

company’s legal team was studying the matter and appropriate action shall be taken to redress the situation accordingly.

RUBBISH CLAIMS IT is lies, lies and more lies. But we are not surprised over the change in tactics adopted by the anti-Bill 10 grouping seeing that they might not succeed in Parliament, by planting lies. The anti-Bill 10 campaigners have resorted to try and question the conscience and integrity of those Members of Parliament from the opposition who support the bill. They are now claiming that the Patriotic Front government has hired a privately-owned company, YengaTech, to try and bribe opposition MPs. Their motive is to show the public that the PF government is desperate to have Bill 10 passed and will resort even to bribery to succeed. But we have no doubt that this smear campaign is directed at Professor Geoffrey Lungwangwa, the UPND Nalikwanda MP. Prof Lungwangwa, with his Solwezi West counterpart Teddy Kasonso earned the UPND’s wrath when they refused to walk out of the National Assembly when Bill 10 was introduced in the House. Another MP who defied his party was Mr Joseph Chishala, who represents Roan constituency on the National Democratic Congress ticket. For the UPND, the action by Prof Lungwangwa and Mr Kasonso was open rebellion having defied express orders from their leader, Mr Hakainde Hichilema to have nothing to do with Bill 10. For all its opposition, the UPND has not pointed out any clauses in Bill 10 on which it is uncomfortable. It is this stance that majority of Zambians have found wanting, especially that they are not prepared to debate and argue their points in Parliament. We have no doubt the smear campaign alleging bribery is coming with the blessings of the UPND. Prof Lungwangwa has described the bribery claims as rubbish. Prof Lungwangwa, who was part of the Parliamentary Select Committee on Constitutional Amendment Bill Number 10, said he could not comment more as he had on several occasions justified his support for Bill 10. He said it is rubbish to suggest that he and others have been bought to support the constitution amendment number bill 10 of 2019. The Nalikwanda MP said no one could buy him to support Bill 10 and that every decision he had made was out of his conviction. With the full blessings of the UPND, the Law Association of Zambia (LAZ), Chapter One Foundation Limited, a non-governmental organisation, unsuccessfully petitioned the Constitutional Court to declare that the Constitution Amendment Bill 10 of 2019 violated national values and principles in the Constitution. The Constitutional Court ruled otherwise but it seems for some groupings, the “war” is far from over, hence the changing of tactics. The bottom line though is for Zambians to rubbish such claims.

AMBIA and Democratic Republic of Congo (DRC) must take advantage of the proximity in market for various products that can be sold between the two countries. Felix Siame, the Consul General in Lubumbashi, implored the business sector in both countries to maximise business opportunities. He was speaking during a luncheon hosted by Katanga Province Governor Jack Kyabula Kitwa at his home for the delegation of business houses from Zambia which is on a two-day trade mission. Mr Siame stated that there were various products and services that could be traded between the two countries. He said business opportunities should be exploited to

the fullest for the benefit of both countries. "That is why this trade mission was facilitated to allow companies from both countries to exchange notes on how they can go about business in either of the two countries," he said. Mr Siame said that last week, the ministers of Commerce Trade and Industry of Zambia and DRC met in Ndola to look at the trade agreements between the two countries that were signed in 2012. "And all this is being done to enhance formalise trade between the two countries," he said. And Mr Kitwa, applauded the two heads of state of both Zambia and DRC for the efforts they are making in ensuring that the people in both countries were living in harmony. Mr Kitwa said Katanga province has potential in

agriculture but that it has not been fully exploited. He said that most of the people have concentrated much in the mining sector thereby rendering agriculture almost irrelevant. He stated that as long as agro processing companies are not set up in Katanga province, they will continue knocking on the Zambian doors for agro products. Katanga province Chamber of Commerce president Eric Monga Mumba said the business sector in the province was ready to partner with the Zambian entrepreneurs in various sectors of the economy. Earlier, North-Western Chamber of Commerce president Mukumbi Kafuta said the Zambian business sector was also ready to partner with their colleagues in Katanga and the entire DRC for the benefit of the two countries.

UPND preparing for national convention - Kakoma By AARON CHIYANZO UPND says it will announce the date for its national convention once intra party elections at provincial level are concluded. Party spokesperson, Charles Kakoma, said all positions including that of the party president would be up for grabs at the national convention. Mr Kakoma said the party had already held intra party elections from ward level and that it also concluded in five provinces. He said once the elections were concluded in the remaining five provinces, the UPND would then go for the national convention for the 2021 general elections. Mr Kakoma said once UPND holds its national convention as required by the party constitution, the Patriotic Front (PF) would have nothing to use to de-campaign its rival. He said that PF had been

Mr Kakoma said members would be free to contest any position at the convention. The UPND has been under fire from political opponents and continuously branded dictatorial for not holding its convention.

Boost mining to save economy, advises Musokotwane By SILUMESI MALUMO LOW output in the mining sector has massively contributed to the slow growth of the economy, former Finance Minister Situmbeko Musokotwane has said. He said there was urgent need to boost the mining sector for the Zambian economy to grow. Dr Musokotwane, who is also UPND Liuwa Member of Parliament said mining operations had not expanded for the past years, negatively affecting the economic growth. He was speaking in Parliament when Mines Minister Richard Musukwa presented the budget allocated to his ministry. Dr Musokotwane indicated that the mining sector was the foundation of the country’s economy, therefore, if it remained static then the economy would be affected. “The mining sector is the foundation of Zambia’s economy so if it is not handled well the economy will collapse. Previous governments encouraged mining output to expand but it is not happening under this government. “In 2011 the mining output was about two million metric tonnes but from that time to date it has dropped to 800, 000 metric tonnes. This is where the problem is,” he said. Dr Musokotwane said “every year the mining taxes are increasing, this cannot allow investment in the sector.” He appealed to Government to address the issues which were negatively affecting the mining operations to revive the dwindling economy.

with the Ministry of Information in order to create a conducive environment for media practitioners. “We want to make sure that we create an environment where the media practitioners are protected from these unruly people,” he said. The minister said in Parliament yesterday, “To

those who have been attacking radio stations, we will ensure that no one will be let scot free. It is too much that people have a tendency of attacking people who are in these media houses,” the minister said. And Minister of Information and Broadcasting Dora Siliya said it is very important to correct some misinformation,

stating that media management in Zambia was supported by laws and these laws were enacted in Parliament. “So for some section of society to accuse the minister of closing a media house is very unfortunate because laws are applied when a media house goes against them,” Ms Siliya said.

Chief Kizela welcomes new mine investors By KALOBWE BWALYA

HIEF Kizela of the Kaonde people in Mufumbwe has said only the rightful owners that have been issued with a licence by the Ministry of Mines would be allowed to operate in his area. The chief has also cautioned Kalengwa Copper and Gold Mining to exercise caution and vigilance in its mining activities as mining harms communities if not properly handled. Chief Kizela has asked Government to assess how much damage has been caused to the environment and ensure that communities are properly informed about the potential benefits they will derive from the investor that has been issued with the mining rights. Chief Kizela said the chiefdom would work with the government to effectively regulate the investor to be responsible to the community as it conducts its mining activities. The chief said this in Lusaka yesterday at a media briefing. He however stated that his chiefdom would carry out due diligence on the investor to avoid a violation on the rights of the people during the mining operation and ensure that they put mitigating steps in place. He is hoping that the investors would also carry out its social corporate responsibility by constructing some schools, health centres and also sinking of boreholes as well as to create employment opportunities for the Mufumbwe community. He called on Minister of Mines Richard Musukwa to ensure that preventive measures are taken care of and all mining activities are planned and carried out in a way that did not violate the rights of the local community and to avoid displacements and disruption of livelihoods. Chief Chizela also thanked Government for providing a lasting solution over Kalengwa mine ownership wrangle that has deprived the district of development for two decades. Speaking at press briefing held at Chrismar hotel, the chief’s representative said they will work with the investor who has mining rights at the mine and cautioned the investor to protect the rights of the local community. Kalengwa Mineral Processing Limited has mining rights for the Mufumbwe mine which was contested in court by Euro Africa Kalengwa Mine in partnership with Moxico Resources Limited. The mining licence for Euro Africa Kalengwe Mine expired though they continued to operate for three years.

New company registrations online are surging in SA, says FNB JOHANNESBURG - Online business registrations are surging in South Africa, says First National Bank, as South Africans change course to adapt to the impact of the coronavirus pandemic on traditional businesses. The impact on the hospitality sector was also devastating, resulting in job losses for many South Africans and a sharp economic decline. The dire financial consequences for many have forced business owners to change their strategies and business plans in order to survive, with many using the lockdown period to either open their own personal services, or to formalise existing business for relief funding and operating permits, the bank believes. OHANNESBURG - President Cyril Ramaphosa took exception to Members of Parliament from opposition parties blaming South Africa's economic troubles on decades of African National Congress leadership instead of the Covid-19 outbreak. Ramaphosa was responding to a debate on the Economic Reconstruction and Recovery Plan, which he tabled in Parliament last week Thursday. The plan seeks to guide South Africa's recovery from the pandemic. The pandemic and the subsequent national lockdown aimed at curbing its spread through the country has seen over twomillion jobs lost in the second quarter of this year, and a 16.4 percent contraction in the economy. During the debate, Democratic Alliance MP and leader of the opposition John Steenhuisen said the ANC and the "longest, hardest and most unscientific lockdown" in the era of the Covid-19 world were to blame for South Africa's economic troubles. HARARE - For the second week running, the Zimbabwe dollar was virtually unchanged against the US dollar at the weekly auction, shifting just one two hundreth of one percent to $81.3499 from last week’s $81.3458, a shift of just 0,41 of a Zimbabwean cent. Since the middle of August, when the price discovery process of the early auctions reached a stable plateau, the weekly movement of the weighted average, which is now the official rate, has been trivial, exceeding one percent just once and that was a firming of the local currency. The stable auction rate has been reflected in similar stability in the black market although recently the premium has been falling for cash-to-cash transactions as Zimbabweans and Zimbabwean businesses accept that the auction system has not only achieved a stable rate, but that all productive sectors can now access their foreign currency on the auctions at that stable rate. The stable exchange rate has seen major stability in prices, effectively reducing monthly inflation to very low figures that are expected to drop even further. Big corporations were allocated a total of US$27.05 million, all they asked for and the third highest allotment, while smaller businesses received a total of US$1.74 million, again all they asked for and the second highest on record. The number of rejected bids is also dropping weekly as almost all importers now routinely get their paperwork sorted out properly. Central PF embarks on skills training By SILUMESI MALUMO THE Patriotic Front (PF) in Central Province has engaged in imparting skills to various women cooperatives which will play a critical role in improving their welfare. PF Central Province vice chairperson for mobilization, Charity Kapona has taken it up on herself to train women with various skills in order for them to be able to acquire available empowerment schemes which are being provided by government. PRESS RELEASE

BY BICON ZAMBIA LIMITED ON THE STATUS OF THE COLUMN STRENGHENING WORKS TO THE OFFICE BLOCK ON SOCIETY BUSINESS PARK – 21ST OCTOBER 2020 This Press Release has been prepared by the Management of BICON Zambia Limited in order to provide the General Public and all the Stakeholders with the relevant background and information with respect to the ongoing Column Strengthening Works at the Office Block at the Society Business Park following the various statements and reports that have appeared in both the print and electronic Media with respect to this subject. BACKGROUND The contract for the Re-Development of Society House and Central Arcades was executed in 2011 between the National Pension Scheme Authority (NAPSA) and Yangts Jiang Enterprises Limited (YJL) who in turn engaged a Team of Consultants in order to deliver the project as a “Design and Build” Turnkey Project. YJL was responsible for the construction of the works whilst the Consultants were responsible for the Design and Supervision of the Works. BICON Zambia Limited was responsible for the Design and Supervision of the Structural Engineering Works. The scope of the project involved the conversion of the then existing 18-storey office block which was formerly occupied by the Zambia National Building Society into a 148-room hotel as well as the demolition of Central Arcades and the construction of a Retail Mall, Parkade and an Office Block on top of the parkade. QUALITY CONTROL MEASURES DURING CONSTRUCTION As part of the various quality control measures adopted during the implementation of the project, YJL engaged the University of Zambia (UNZA) and Wade Adams as an independent laboratory responsible for the testing of the concrete works on the project. All the results made available by YJL from Wade Adams to the Structural Engineers during the implementation of the project were found to be satisfactory. FAILURE OF COLUMN T5 ON THE 1ST FLOOR OF THE OFFICE BLOCK AND SUBSEQUENT INTERVENTIONS The entire Society Business Park Project was completed on a sectional basis starting with the Retail Mall and Parkade in 2016, followed by the Office Block in 2017 and then the Hilton Garden Inn in 2018. It must be noted that the 18-storey hotel block structure is totally independent from the rest of the development which was constructed in the 1978. On the 13th of October 2019, one column on the 1st floor failed by way of crushing at the intersection of the column and slab which also and as a result of the failure stressed the three neighbouring columns on the 1st floor level. As a precautionary measure, the Owners of the Building NAPSA ordered an evacuation of the Tenants of the office block in order to facilitate a detailed examination of the office block structure. In-Situ tests on the failed columns found that the actual concrete strength of the columns were lower than the specified concrete strength on the Structural Engineering

Drawings. A detailed examination of the rest of the columns at Society Business Park Office Block found that the other columns were not showing any signs of stress following the failure of the column at the 1st floor. The columns affected at 1st floor were thereafter strengthened by casing them in steel columns in order to significantly enhance their load bearing capacity. The repairs to the failed and stressed columns on the 1st floor were inspected by all the stakeholders including the Independent Engineer, the Engineering Institution of Zambia (EIZ), the Association of Consulting Engineers (ACEZ), the National Council for Construction (NCC), NAPSA as well as all the relevant stakeholders including the print and electronic Media. NAPSA subsequently engaged the services of an Independent Consultant to undertake a detailed investigation in order to determine the structural integrity of the entire office block and the supporting parkade structure below. The summary of the Independent Engineers findings are as follows:1. 2.

The slabs for the parkade and the office block were found to have adequate capacity to carry the design load, Although not showing any signs of stress, 153 columns in the parkade and office block out of a total of 258 columns which carry the parkade and office block had column capacities lower than the design capacity due to lower concrete strengths than the specified concrete strength. This entailed that all these columns have been earmarked to be strengthened in order to increase the load bearing capacity and factor of safety of the columns.

In view of the foregoing, BICON Zambia as the Design Structural Engineers were required to submit a proposal for the strengthening of the columns identified by the Independent Engineer. BICON Zambia thereafter engaged the services of a Specialist Concrete Company from South Africa called Mapei in order to design a concrete strengthening solution based on the required column loads. Mapei South Africa design a column strengthening solution using the Mapei Product which is manufactured in Italy to strengthen existing concrete structures and is used extensively in Africa and all over the World. The Independent Engineer requested that Mapei submit calculations for the column strengthening works for their review. In addition to the foregoing, the Independent Engineer also requested that a sample column be strengthened on site using the Mapei Product and that the Mapei Materials be tested by an Independent Laboratory in Zambia in order to confirm that the strength of the materials which were assumed in the Mapei calculations can actually be achieved. Subsequently a sample column was constructed on

site and inspected by all the Stakeholders including the Independent Engineer, EIZ, ACEZ, NCC, including the print and electronic Media. EIZ, ACEZ and NCC were encouraged to conduct their own regular inspections of the column strengthening works in order to kept up todate with progress. The Independent and certified Laboratory at Rankin Engineering Consulting Engineers has todate been used to test all the Mapei Materials. The Independent Engineer granted approval for all the columns strengthening works to be used on the columns which were identified for strengthening using the Mapei Product. Following the approval of the methodology for the column strengthening works, 80% of the columns to be strengthened have since been completed. Site Progress Meetings which are attended by the Independent Engineer, BICON Zambia, NAPSA and the Contractor to review the progress of the column strengthening works as well as the Test Results of the Mapei Materials are held monthly. CONCLUSION In conclusion, EIZ has on three occasions with other stakeholders visited the site and have been kept informed of the column strengthening works. In addition to the foregoing, BICON Zambia has on several occasions shared with EIZ and NCC copies of the reports in connection with the column strengthening works. BICON Zambia has also attended a hearing called for by EIZ in connection with this project. The Contractor who has taken over from YJL who is currently executing the column strengthening works under the full-time supervision of BICON Zambia is working diligently in order to complete the column strengthening works on site as soon as possible. The Independent Engineer contracted by NAPSA is also providing regular oversight and closely monitoring the ongoing works on site. Based on the current programme, the column strengthening works are expected to be completed in December 2020. EIZ as the Regulator of the engineering industry has unfettered access to the site to inspect the ongoing works and to request from us any information, they may wish to obtain with respect to the ongoing works to enable them issue informed statements to the public with respect to this project. PRESIDENTIAL PARDON OR PAROLE? Dear Editor,

THERE is a world of difference between a prisoner being released on Presidential Pardon and Parole. Let me break it down simply as follows; In 1994, prominent lawyer Edward Jack Shamwana, announced his candidature to contest the Mumbwa parliamentary by-election, a few years after he was pardoned for treason by President Kenneth Kaunda. But another lawyer-cum-politician, Levy Patrick Mwanawasa attacked his colleague and called him an ex-convict. Shamwana sued Mwanawasa for defamation of character in the Lusaka High Court. In that case, the court explained the meaning of a presidential “absolute and unconditional pardon” - it simply erases the conviction completely! Your record is discarded as if you never committed the offence and the rights and privileges that you enjoyed are installed. Unless - off course - if the release was conditional. (See Edward Jack Shamwana v Levy Patrick Mwanawasa - 1994/SJ/93). On the other hand, a release on parole is

governed by the Prisons Act, Volume 7 of Chapter 97 of the Laws of Zambia and in particular Statutory Instrument No. 101 of 2008. In there, it empowers prison authorities to place certain prisoners on parole for good behaviour (among other things) and be released to serve the remainder of their prison term outside jail. In this scenario, the conviction remains! And the President does not get involved in making that pardon like in the earlier example given. Parole is used as part of the system of decongesting prisons for good mannered prisoners - this is why the name was changed to “correctional services” as opposed to prison. The aim is to reform. Whether parole and presidential pardon should be available for murder convicts is subject for another discussion suffice to say that Shamwana (and others) who were treason-convicts and on the death row benefitted from the presidential pardon! So, parole is done by the National Parole Board under the Prisons Act while Presidential pardon is done by the Head of State under the Constitution of Zambia with advice from the Prerogative of Mercy Committee. Women and youth representation in Parliament Dear Editor, THE Continental Leadership Research Institute (CLRI) calls on all political parties to ensure that more youths and women are adopted for representation in the 2021 elections at local government and parliamentary elections. The institute has taken time to study the trend of adoption for elections across all political parties. Currently, parliament has less than three MPs who can be considered youths out of the 156 members and 13 percent who are women represented at parliamentary level which is very worrying. We are aware that majority of population of Zambia is composed of youths and women but despite being in the majority youths are not well represented at parliamentary and local government level. The only role that youths have been given is the role of being political cadres that are promoting violence as four women their role has been to sing praise songs for their leaders at ceremonial occasions and nothing meaningful. This trend is retrogressive and has to change in 2021 elections. It recognises that there a number of factors that limit youths and women to participate in political processes who are aspiring for public office. We call on all political parties to ensure that youths and women are considered in their adoption processes by creating deliberate internal policies that promote youths and women representation. Parties should relax some internal processes for adoption for youths just as ECZ as made the fees for youths and women not to be uniform, such deliberate policies should be adopted by political parties and a certain percentage of adopted candidates should be allocated to youths and women. Youths and women should be very conscious of which parties are pro youth and women in their approach to representation and not be used as tools of propaganda and violence but should demand to play more meaningful roles such as representative roles. Youths shouldn’t settle for anything less and should aim at realising their hidden potential and should not allow being used for wrong reasons. The issue of representation is key to development, the calibre of our representative directly affects the kinds of policies and level of development we are to achieve therefore our call is a solidified unity among youths and women to advocate for meaningful representation as a by-partisan issue in Zambia before the 2021 elections and should only support political parties that have clear policies regarding youth and women representation in 2021 elections. Elsewedy Electric recently fired 16 out of 36 employees, among them, nine union branch executive Committee members for what the company termed as an illegal strike. But according to NESAWU, the findings by the Ministry of Labour and Social Security indicated that the company unfairly dismissed the employees without following disciplinary procedures. NESAWU General Secretary, Manson Mtambo, blamed Elsewedy management for failing to address the grievances employees. The firm, he said, had over accrued pension benefits which it had allegedly failed to remit to Buyantanshi Pension Scheme as agreed during negotiations with the

union. Mr Mtambo said in Ndola yesterday that should Elsewedy refuse to reinstate the 19 affected members, NESAWU would go to court to seek redress. "We as NESAWU also protested against the company’s failure to uphold the rules of natural justice by giving the alleged offenders the right to be heard. “During the disciplinary process, the company failed to adhere to the provisions of the disciplinary code, contracts of employment and labour laws," he said. Mr Mtambo labelled the dismissals of the workers as pure victimisation of unionised employees, which amounted to a violation of Section 5 of the Industrial and Labour Relations Act. He complained that company management issued instructions to lock out 36 workers and later termed the act as an illegal strike instead of addressing them over the accrued pension benefits for the period between 2009 and 2014.

And the party has attributed the artificial shortage of the commodity to the deterioration of the Zambian Kwacha. The fuel shortage entered third day yesterday as long queues characterised the few service stations that had the commodity on the Copperbelt. But Mr Nhkuwa said there

was no need for panic-buying of the commodity, stating that there was adequate supplies. Green Party president Peter Sinkamba said the government was trying to downplay a big problem when it was very apparent that fuel had run out. Mr Sinkamba was speaking to the Daily Nation in Kitwe yesterday. "Government should stop giving excuses but sort out the matter as soon as possible because this is a big problem that requires serious intervention. The fuel crisis is there in the country," he said. Today, with the world crippled by the novel coronavirus (COVID-19), the practice is now considered as the must have tool for the enhancement of corporate governance that should strengthen sound decision-making processes. Firstly, it may be important to draw a distinction between the traditional risk management and enterprise risk management. As obvious as it may appear, it is the word “Enterprise” that makes the difference. Traditional risk management is a bottom-up process that focuses primarily on losses, costs and the negative side of risk; heavy on compliance and specification and mainly reactive. While enterprise risk management, on the other hand, has a much broader scope as it considers all the risk factors faced by the organisation, and it helps the Board and management make informed decisions according to its acknowledged risk appetite. While ERM like the traditional risk management does consider compliance it is a top-down process that prevents and mitigates losses and looks for opportunities in adversity for the organization thereby creating value and ensuring that the organisation’s objectives are met with minimal disruptions. ERM is a bigger picture risk management that adopts a holistic approach to managing risk, placing it within a portfolio of things that need to be managed in order that the organization achieves its objectives. While individual departments

One of the challenges that the change of retirement age from 55 to 60 years entailed was holding back retirement for five years for workers who should otherwise have retired and been paid off and replaced by new workers. This matter has brought a window of opportunity for Zambia to resolve a long standing dilemma of how to pay off retired public servants, create jobs for so many of our youths and in turn revive the economy. A key factor that motivated the state to increase the retirement age was to open a moratorium window during which to mobilise resources to pay off the huge backlog of retirees inherited from the previous administration in 2011. Unfortunately this has not materialised. Instead a mountain of unpaid retirement benefits has accumulated. Remember, a double-edged sword was created by popular acclaim among workers, labour unions and others when the Zambian Parliament, riding on the popularity among workers and labour unions, had accepted a clause in the 2016 Constitution, of retaining retirees on the payroll until their benefits had been paid. This retention on the payroll of unpaid retirees created a resource drain problem. The state

and other employers have to pay two salaries for one job for as long as retirees’ benefits remain unpaid; that is one salary for the retiree and another salary for the job holder! This, coupled with the nation’s mounting external debt obligations, has put the state in a dilemma. The onset of Covid-19 in Zambia in mid-March has left Zambia’s labour landscape in a helpless situation of sorts. Therefore, it is imperative to pose the inevitable questions; what is the way forward? How does Zambia get out of this entanglement? Firstly, it is important to note that the situation is not irredeemable; it can be salvaged. Several permutations can be looked at to create a win-win situation for all – retirees, the government, unemployed youths and the nation at large! How can this be achieved? First and foremost, the government should see paying off retirees from the perspective of killing several birds with a stone, and as a major stimulus package for the retirees to turn their benefits into investible capital to play a pivotal role in reviving the Covid-19-ravaged economy quickly. There are three possible sources to finance the retirement packages: From within the national

ZAMBIA AT 56: budget by sacrificing some capital projects; The government can approach some local pension houses for a loan to finance this; or The government can approach some international cooperating partners for a grant or a soft loan specifically to sort out this problem. Several years ago, Tanzania owed its workers in public institutions colossal sums of money. I’m not part of aggrieved, says Pivoty Simwanza By MUKWIMA CHILALA NDOLA-BASED football administrator Pivoty Simwanza has dispelled suggestions that he was part of the aggrieved parties in the Football Association of Zambia (FAZ) wrangles. Simwanza said contrary to assertions in certain quarters, he has never been a part of the aggrieved parties and it was for that reason that he hasn’t dragged FAZ to court. Simwanza was reacting to an article in which lawyers representing the aggrieved parties in the FAZ wrangles Gilbert Phiri questioned the criteria used to only invite three people to the FIFA meeting FAZ and aggrieved parties are set to meet FIFA on October 31 in a bid to iron out perceived wrangles that have engulfed Zambian football. Simwanza was among the unsuccessful candidates in the FAZ electoral process after his

nomination was not ratified by the association's electoral committee on account of having failed to meet the integrity test requirements. But the former FAZ executive committee member said he still believes in the association's electoral process and it was for that reason that his candidacy was still being looked at following his disqualification based on an administrative misunderstanding. He said that he does not believe in taking football matters to court and hence he is determined to exhaust the whole appeal process. ''I am not an aggrieved party, and I am not part of that arrangement neither is Gilbert Phiri, because I have confidence in our FAZ appeal process, when you are aggrieved you go to the next level and that’s why I never went to court because I want to follow the process to the letter and my case is being given active attention,'' Simwanza said. And Simwanza expressed confidence that his case and that of presidential spirant Ricky Mamfunda whose candidacy was also not approved by the appeals committee were being worked on and would be successful.
