PROSECUTE LAND FRAUDSTERS THE suspension of the Lusaka and Kitwe City Councils has unmasked lurid illegalities in land administration perpetrated mostly by councillors.

Civic leaders had gone on rampage, selling any piece of land which appears idle in their distorted lenses.

All this is now being uncovered.

In Lusaka, a Chinese developer bought a piece of land under Zesco poles in the PHI area, daringly defying safety rules.

Had it not been for the determined residents, the Chinese could have started putting up a shopping mall in an area not designated for such infrastructure.

Earlier, the country was treated to drama when a cantankerous councillor in Matero took on the Member of Parliament, who uncovered a glaring illegality on land allocation.

The councillor, darting back and forth, defended the allocation of land to a “developer” on reserve land which was clearly not meant for construction of any structure.

Lawlessness of the highest order!

In Kitwe, another defiant developer had started construction at the foot of a very volatile tailing dam, which requires utmost preservation and protection.

The tailing dam, a formation from early mining dumping, could cause a disaster but free-wheeling councillors and their allies allocated a piece of land for a “development” project in a highly risky state of affairs.

Councillors went full throttle in Kitwe, sharing land near the Presidential Lodge at the edge of Ndeke Township, with full knowledge that the area was a state protected property to house the Head of State.

Surely, how could policy-makers go on a wanton scramble for land in undesignated areas?

The discovery of such illegalities is a pointer that there is more of the rot not only in the two councils, but also in other local authorities, particularly in the urban areas.

Government must thus intensify the probe in Lusaka and Kitwe and thereafter extend the exercise to other councils in the country.

This must be done to save the country from having unplanned and haphazard structures everywhere, what with people opting to build houses in grave yards!

Political cadres have also been illegally allocating land in Ndola and other towns as if there will be no tomorrow.

Just last week, Ndola City Council demolished structures erected at the periphery of Kawama cemetery, allocated by cadres who were identified.

As Lands Minister Jean Kapata indicated, there is an urgent need to get to the root-cause of such land malaise and bring all culprits to book.

If menacing councillors were left loose for five years, they could end up looting all the land.

Nothing can stop them as they have already demonstrated unfettered greed by allocating plots on road reserves, grave yards and under Zesco poles.

They have not spared land under high-voltage Copperbelt Energy Corporation pylons in Kitwe.

To serve as a deterrent, all cases of illegal land allocation must be reported to police so that culprits are prosecuted in the courts of law.

All perpetrators should be exposed and prosecuted.

Zambia cannot afford to have greedy policy-makers in local authorities at the time the country is baying for much more development.

All land fraudsters must be dealt with squarely!

The unit, according to Green Party President, Peter Sinkamba should be established within the Ministry of Mines to ensure that every ounce of mineral resource produce was accounted for he said.

Mr. Sinkamba, said the mineral accountability unit would curtail fake data from mining firms, which were now failing to reconcile contradictory figures between value of mineral produced as declared to the Zambia Revenue Authority and the actual market value as

declared in the global market.

“We have situations where mining firms record data that is actually not on the ground because there is no one from the government’s side to ensure there was real time recording of production details,” he said. He said that this had been the issue over the years and that it was also discussed several times. Mr Sinkamba said that the need for setting up of such a department and providing manpower for monitoring could not be overemphasised.

However, the two sought to retake plea and admitted the charge.

Particulars of the offence are that on July 16, 2020 tresspassed in the wildlife national park number 19 named as Lower Zambezi National Park. The two were arrested by ZAWA officers in Rufunsa during patrol. The accused told the court that they were mining gold in the national park.

They were both sentenced to one month imprisonment with hard labour from the date of arrest.

Cleanse ACC- Nakacinda

THE Anti-Corruption Commission (ACC) should decisively stamp out any form of infiltration by the opposition to offer diligent service, nominated Member of Parliament, Raphael Nakacinda has said.

Mr Nakacinda advised ACC to take stock of how it had been conducting its operations and the concerns that the public were raising.

Mr Nakacinda said if there was any form of infiltration in the ACC, the leadership should take decisive action to avoid putting the name of the institution into disrepute.

He said there should not be any sacred cows for an effective mass cleansing of the institution. Mr Nakacinda said in an interview that the ACC should create a platform of interaction with the other Government institutions for effective service delivery. “If

there is any form of infiltration in the ACC, there is leadership in place, they should be able to take decisive decision and possibly the ACC must be able to interact properly with the other Government wings so that some of the embarrassing occurrences that are emitting from the ACC can be avoided,” he said.

Mr Nakacinda said ACC should work closely with the Drug Enforcement Commission, National Prosecutions Authority and the Zambia Police Service.

“It is high time those involved in illegal land dealings are dealt with sternly.

This cannot be allowed to become the norm. We call on Government to expedite these

investigations and ensure that those involved are punished,” said Mr Mwanza.

They have told the court that there is no provision of removal of a sitting president through a vote of no confidence other than what is indicated under article 37 of the NAREP constitution.

Mubambwe (national chairperson) have cited acting party president Charles Maboshe, Ezra Ngulube, Maybin Kabwe, Frank Sichone, Evelyn Malongo, Susan Chipeta and Thomas Kayola as defendants in the matter.

According to a statement of claim filed yesterday in the Lusaka High Court, the plaintiffs want a confirmation and declaration that Mr Nyirenda herein was duly elected as NAREP president.

They want a declaration that the decision purportedly passed by Mr Maboshe and six others that Mr Nyirenda is no longer NAREP president be declared null and void.

Mr Nyirenda and the trio want the court to order an interim injunction restraining the defendants or their agents from interfering with the party’s administration and governance.

They also want an order of injunction restraining the defendants or their agents from using the party secretariat premises situated at Plot 2386 Tuleteka Road, Lusaka.

The plaintiffs are also claiming for damages for breach of party constitution and costs.

By SILUMESI MALUMO SOME millers are reluctant to buy maize thinking the Food Reserve Agency (FRA) will come to their rescue when they run out of maize but they should know that the agency is not a marketing wing for them, Minister of Agriculture Michael Katambo has said.

He said Government had noticed that some millers were reluctant to go on the market to buy maize.

Mr Katambo said yesterday the FRA was meant for national strategic reserves and was not a marketing wing for millers.

The minister told the Daily Nation yesterday, millers must stop thinking that the FRA would come to their rescue for their failure to buy maize during this marketing season.

Mr Katambo said the maize the FRA holds can only be released when there was a shortfall in the country.

The release of maize, Mr Katambo said, was only acceptable when there was need for relief distribution and when the price of maize and mealie meal were noticeably high.

"Government is happy to note that a number of millers are active on the market and are buying maize for their own use until the next harvest.

On the other hand, Government has also noticed that there are some milers that are reluctant to buy maize hoping that they will access maize from the FRA.

APPLICANTS FILL UP K10BN STIMULUS PACKAGE

A

PPLICATIONS worth over K10 billion have been filed in by both banks and non-banks under the Targeted Medium-Term Refinancing Facility meant to provide financial relief to businesses during the Covid-19 period.

The Bank of Zambia (BoZ) in April this year put in place a K10bn stimulus

package to assist with liquidity to businesses during the Covid-19 period.

The central bank has so far received full applications worth K10, 083.26.

According to an update report from BoZ, 13 non-banks had so far filed in applications worth K5, 169.00, while 11 commercial banks had requested for K4, 914.26.

The report indicated that out of the requested amount from both banks and non-banks, the BoZ had so far approved over K5bn.

“Disbursed Advances: over K1.1bn has been disbursed to both banks and non-banks with K924 million disbursed to banks and K176 million to nonbanks,” the report said.

Last month, BoZ Deputy Governor for Operations, Francis Chipimo, indicated that the central bank had the flexibility to provide more funding beyond the K10bn facility should there be more demand from Financial Service Providers.

Dr Chipimo said this during the

last episode of the BoZ radio show programme in Lusaka.

“Well off course we set this thing (facility) up to help the economy, I think if that situation does arise, we have the flexibility to look at whether we can provide more funding in that we have the flexibility to do that.

“In our presentations on the facility we have indicated that this is an initial amount, so if there is demand that can be done,” he said.

PRESIDENT Edgar Lungu yesterday attended the 40th Ordinary Southern Africa Development Community (SADC) heads of State and government virtual meeting hosted by Mozambique.

And outgoing SADC chairman and Tanzanian President Dr John Magufuli has called for the cancellation of debt to developing countries to cushion the impact caused by the Coronavirus pandemic.

‘Increase import duty on agro products’

By BUUMBA CHIMBULU GOVERNMENT should consider increasing import duty on agricultural products which can locally be produced to create a market for farmers.

Increasing import duty on such products will protect smallholder businesses and their markets, says the Jesuit Centre for Theological Reflection (JCTR).

JCTR observed that many fruits and vegetables were imported and yet they could be grown locally.

It said it was for this reason that Government should consider increasing taxes on imported agricultural products that can be farmed locally.

According to JCTR proposal for the 2021 National Budget submission to the Ministry of Finance, local farmers lack a market for their produce and products go to waste.

This, JCTR said, promoted capital flight, which continued to persist and may lead to a balance of payment deficit for national accounts.

JCTR indicated that the measure would support the growth and development of the Small Medium Enterprises.

“This will result in increased production, employment and Government revenue. In addition this will also go towards achieving Sustainable Development Goals and Seventh National Development Plan,” It indicated.

Deputy Inspector General of Police, Bonny Kapeso, said any cadre from any political party who would want to challenge the police would be punished because such a person would have declared himself a threat to national security.

Mr Kapeso, who is in charge of operations, reminded the political cadres that the Zambia Police Service was the only institution mandated to maintain law and order and in charge of security, including that of the political cadres themselves.

He was speaking on ZNBC television when he featured on the Sunday Interview programme.

He said police were in charge of internal security and would ensure that law and order prevailed.

Mr Kapeso said political cadres had nothing in common with the police service because their job description had been dictated by the law which was ensuring the safety of every citizen.

ZAMBIA has recorded a spike in COVID-19 infections with 496 new positive cases out of 1,549 tests done in the last 24 hours.

Seven patients are in the Intensive Care Unit (ICU) requiring critical care while 93 are in different isolation facilities across the country.

One death was recorded at Levy Mwanawasa Hospital in Lusaka Cumulative cases now stand at 9,839 with 264 total deaths and a total recoveries stand 8,575.

Health Minister, Chitalu Chilufya, has thus warned about the rapid spread of the virus on the Copperbelt, which recorded two Brought In Dead (BIDs) cases in Chililabombwe and one in Ndola.

“We have also observed that late referral from private health facilities is a problem that ought to be stopped.

Government appreciates the role of the private sector in supplementing health care hence the need to ensure that there is urgent collaboration to fight against the pandemic,” he said.

Dr Chilufya emphasized the need for members of the public to avoid crowded places, always masking up and sanitizing to stop the spread of the virus.

Defamatory call was from accused’s number, court told

A WITNESS Kalobo Chilongoshi, a customer relations manager at MTN has testified that after he extracted the information from the CRM portal, he established that 0762553770 was owned by Fred Manya while the 0962870921 was owned by a Mwelwa Kapaso.

This is in a case where a Luanshya man is appearing in the Lusaka Magistrate’s court facing one count of defaming President Edgar Lungu.

In this matter, Fred Manya is charged with defamation of the President contrary to the laws of Zambia.

An arresting officer in the case yesterday testified that he did not conduct a voice analysis on the purported call to conclusively say that Fred Manya was the one who uttered defamatory words during a live phone-in programme on Millennium Radio on March 28 2019.

Chief Inspector, Elias Banda told Chief Resident Magistrate Lameck Mwale that he decided to charge and arrest the accused for defamation of the President after making up his mind that the insulting words which Manya is alleged to have uttered put the name of the President into disrepute.

He said this was after Manya failed to give a satisfactory answer during a warn and caution statement.

Inspector Banda also testified that he extended the investigation to MTN having established that Manya’s

number was MTN. He said according to MTN know your customer (KYC ) which he accessed, the phone number 0762553770 on which he called Millennium Radio belonged to Manya and the simcard was registered under the national registration card number 379415/74/1 on December 18, 2018.

He said Manya was traced through his girlfriend, Tracy Mweemba of Chingola, who later led police to Luanshya where the accused was apprehended.

Inspector Banda also testified that the simcard in question was recovered from the accused together with his Itel phone and an NRC. And in cross examination

by Manya’s lawyer, Mr Mulambo Haimbe, Inspector Banda admitted not having conducted a voice analysis on the purported call to rule out the danger of false implication.

Particulars of the offence allege that on March 28, 2019 in Lusaka, Manya with intent to bring the name of the President into ridicule, published insulting matter by word of mouth.

Previously, Mr Martin Akende, the station manager at Millennium Radio Station, testified that he was shocked and confused when a man who said he was from Kabwe, called the station during the ‘Meal breakfast show’ and insulted President Lungu.

The matter has since been adjourned to September, 4, 2020, for ruling on case to answer.

POLITICIANS must embrace and emulate the high political and moral standards set by late former UNIP Secretary General Grey Zulu, says veteran politician Vernon Mwaanga.

Mr. Zulu, who was aged 96, died at his Makeni home in Lusaka on Sunday. He was in Zambia’s first cabinet after independence in 1964.

Mr Mwaanga said Mr Zulu was a selfless leader, who dedicated his life to the country and people. Mr Zulu put the country first and served with dedication and high integrity.

“It is my fervent hope, that the new generation of politicians, will embrace and emulate the high political and moral standards, set by Mr Zulu and his generation, who worked tirelessly to put and keep our country peacefully together,” Mr Mwaanga said in a statement.

Mr Mwaanga said Mr Zulu was an icon of the freedom struggle and active participant in the building of Zambia as we know it today.

Mr. Zulu Kavindele has described Mr Zulu as one of the country’s greatest politicians.

Mr. Kavindele said Mr Zulu would be remembered for the role he played in fighting the 1990 coup d’état after making the announcement on television.

programme, The Update, on ZNBC TV. He said Mr. Zulu did justice to the nation in all ministries he served and other portfolios he held.

Mr. Kavindele said Zambia has been robbed of a great leader who served the nation with passion.

Meanwhile, Historian Bizeck Phiri said Mr. Zulu saw himself as a man with a heart to help others without putting his interests first.

Professor Phiri said this is evidenced in the book that Mr. Zulu wrote about his life and contribution in the fight for freedom.

Mr Zulu’s young brother, Anderson has described him as a gallant man who served the country with love.

Mr. Zulu thanked President Edgar Lungu for the long-standing support rendered to the family during his illness.

And UNIP Secretary-General, Alfred Banda described Mr. Zulu as a man who served the country diligently.

In a statement, ECZ public relations manager, Margaret Chimanse said the commission would this year, conduct Voter Registration from October 19 to November 20, 2020 and that all eligible citizens would be required to register in the 2020 Voter Registration exercise.

She said ECZ has also provided for pre-registration of voters, where eligible citizens will start the process by submitting their details online and later be required to physically visit the registration centres to have their biometric data captured and voter’s cards issued to them.

“The 2020 Voter Registration exercise will be based on the 2019 delimitation, which facilitated the creation of new polling stations and wards,” Ms Chimanse said.

She said after the Voter Registration exercise, the ECZ will consolidate all the data captured and produce a Provisional Register of Voters,

which citizens will inspect from March 29 to April 2, 2021.

“The Inspection of the Register of Voters will be followed by the certification of the Register by the Commission on the 9th of May, 2021 in readiness for the Nominations, which will take place from 17th May to 21st May, 2021,” she added.

She also said the campaign period will run from May 24, 2021 to August 11, 2021.

And Ms Chimanse said the ECZ is working tirelessly to ensure that the all the activities are conducted in time for the General Election whose date cannot be changed as it is enshrined in the Constitution.

GOVERNMENT has commended the Zambia Air Force (ZAF) for being innovative and taking an active role in steering national infrastructure development.

Special assistant to the President for Project Implementation and monitoring Andrew Chellah expressed happiness with ZAF for having participated in delivering quality public infrastructure.

He said Government would soon engage ZAF to take over projects that had been abandoned by some contractors because the institution has proved to have the expertise and capacity to deliver quality infrastructure.

Mr Chellah’s remarks came after he inspected the modern departure lounge, advanced school of learning and the dining hall at the ZAF headquarters done by the defence wing.

Meanwhile, ZAF commander, Lt Gen David Muma said with the expansion of the runway and other infrastructure, the ZAF headquaters airport would be open for domestic flights across the country.

He said being centrally located, the facility would enhance economic activities.

Lt General Muma also said the air force had the capacity to undertake any quality construction works.

State enters nolle in MTN arson case

By OLIVER SAMBOKO THE state yesterday entered a nolle prosequi in the case where two MTN employees were appearing before the Lusaka Magistrate’s court for arson.

In this matter the two MTN employees, Kamanyanga Kaseele, 35, an accountant of Woodlands, and Chipasha Kamukwamba, 36, a businessman of Lake Road Ibex Hill, were charged with attempted arson but pleaded not guilty to the offence.

It was alleged that between February 12, 2020 and February 13, 2020 in Lusaka, the two with other persons unknown, attempted to set on fire a building, namely the MTN head office.

When the matter came before Lusaka Chief Resident Magistrate Lameck Mwale, yesterday, the state informed court that it had received instructions from the DPP’s office to enter a Nolle prosequi in the matter.

Following the application by the State, Magistrates Mwale accordingly discharged the two accused persons.

And in another case the Lusaka Magistrate’s court has found three Drug Enforcement Commission (DEC) employees with a case to answer and put them on their defense.

The three were charged with theft by public servant contrary to section 277 of the penal code chapter 87 of the laws of Zambia.

Particulars of offence are that Alitson Mulambo 37, of Makeni area, an auto- mechanic, Innocent Chimbeni 29, a driver and Claudias Mumba 32, a security assistant, on dates unknown but between March, 3 and May 9, 2019 and being persons employed by Drug Enforcement Commission, did steal a motor vehicle tyre valued at K1,200 which came into their possession as exhibit by virtue of their employment.

Gold rally a boost for Zim

HARARE - After Covid-19 dampened investor appetite in the majority of assets and investment options globally, Zimbabwe should seize the opportunity and optimise the production of in-demand gold to boost earnings amid record-high prices.

Calls have been made for Zimbabwe, which faces a critical shortage of hard currency that has caused exchange rate volatility and driven up inflation, to ramp up gold output and exports.

Investors tend to buy gold and silver during periods of rising economic uncertainty, such as posed by Covid-19, but switch to riskier assets such as stocks when they see signs of stability and growth.

Gold prices have fallen below the US$1, 900 an ounce level after a recordbreaking rally, as investors reassessed their positions on account of a firming US dollar.

The price of gold first showed good prospects after increasing by an average of 23.8 percent in 2020 compared to the first four months of 2019, owing to increased demand from investors seeking a safe haven to hedge against the impact of Covid-19.

The Bank of America has projected gold to rise

to US$3, 000 an ounce and this could cushion Zimbabwe from dampened demand and prices of its other minerals.

With production across all other sectors already constrained, even before the Covid-19 pandemic set in, Zimbabwe can grow its foreign exchange earnings if it could boost bullion production, which has recently trended down.

UPND WANTS YOUTHS TO OBTAIN NRCs

Pay water bills, clients told INSTITUTIONS and individuals should pay for their water bills to ensure quality water services, Minister of Water Development, Sanitation and Environmental Protection, Jonas Chanda has said.

Dr Chanda expressed concern that some individuals and institutions have taken advantage of the government’s directive to water utility companies not to disconnect water during the Covid-19 outbreak, by not paying their bills.

He said Government directed water utility companies not to disconnect water from clients during the Covid-19 pandemic period to ensure that people had access to adequate water.

Dr Chanda said that following the directives, some institutions and individuals had stopped paying bills, thereby, putting a lot of pressure on water utility firss.

The minister, who is on tour of water and sanitation projects in North-Western Province, said this when he called on provincial minister,

HE UPND in Livingstone has started identifying youths without National Registration Cards (NRCs) and assisting them to acquire the important documents.

UPND district chairman Christopher Siamwenya said this would be done without waitingf for the mobile registration exercise to begin.

Mr Siamwenya observed that each member of the party had a role to play and therefore, must help youths obtain the NRCs so that they could also register as voters and participate in the 2021 general elections.

By NATION REPORTER POLICE involvement in the enforcement of Covid-19 preventive measures will improve compliance among citizens, who have a casual approach to serious matters, a former envoy has observed.

Former Deputy High Commissioner to Namibia, Dorothy Nachilongo, said police should be maintained in public places to enforce masking up and observance of social distancing among other measures to guarantee high compliance levels.

She regretted that many citizens did not want to comply even with increased awareness programmes, but that with police presence, people would start to comply.

Ms Nachilongo said in Ndola in an interview that even though some sections of society were not comfortable with the idea, it was the most effective as citizens would be very cautious, knowing that they would be locked up if they did not comply.

“Most people will fear because they don’t want to be

locked up in the cells. They also know that if they don’t comply, they will have to pay K750. So police enforcement is the best for now,” she added.

She observed that Government and other stakeholders had done enough in sensitisation, but that the compliance levels were still low.

Ms Nachilongo was however confident that with men and women in uniform enforcing preventive measures and arresting offenders, most citizens would realize the seriousness of the matter.

She said Covid-19 was a serious case and appealed to citizens to mask up, observe social distancing and also to ensure they washed their hands regularly.

Government has invoked the Public Health (Infected Areas) (Coronavirus Disease 2019), regulations 2020 as provided through the Statutory Instrument (SI) number 22.

Under the regulations, a person who fails to comply with restrictions, prohibition or contravenes regulations commits an offence and is liable upon conviction to a fine or imprisonment not exceeding six months or both.

The SIs 21 and 22, were invoked in March this year.

Ms Nachilongo advised members of the public to acquaint themselves with the provisions of the law pertaining to Covid-19 so that they always remain compliant.

ITWE City Council (KCC) Police officers have blocked a defiant developer from continuing with construction on the foot of the tailing dams in Parklands.

The developer had defied the local authority which last week directed that construction works be halted as there were no legal documents authorising any development at the foot of the dam.

The tailing dam was a formation of the structure from early mining dumping in Kitwe, extending from Parklands to Nkana East and part of the town centre.

ARARE Zimbabwe's government has accused the head of a Catholic bishops congress of stoking division and seeking to create a "genocide" after the group spoke out against alleged rights abuses and economic woes this week.

On Friday, the Zimbabwe Catholic Bishops Conference (ZCBC) issued an unusually strong letter deploring the thwarting of anti-government protests on July 31.

But in a statement released at the weekend, Information Minister Monica Mutsvangwa said the letter had been written under the "evil minded" leadership of ZCBC president Archbishop Robert Ndlovu.

Mutsvangwa accused Ndlovu, a member of Zimbabwe's Ndebele minority group, of "fanning the psychosis of tribal victimisation" and sowing "sins of collective guilt" among the Shona majority.

‘Clubs should have decided’

By MUKWIMA CHILALA CLUBS should have been allowed to discuss and decide on how much they would allocate themselves from the US$1.5 million FIFA Covid-19 relief funds, former FAZ executive committee member Blackwell Siwale has said.

And Siwale says had clubs been met before the resumption of the abridged league, the chaotic ending of the season could have been avoided.

Last Saturday, FAZ met National Division One and Super Division teams for a consultative meeting.

During the meeting, FAZ president Andrew Kamanga announced that Super Division clubs will pocket US$15, 000 (K278, 025) each while National Division One sides will receive US$7, 500 (K139, 012) from the US$500, 000 FIFA relief fund to be disbursed at the end of the month.

But Siwale questioned the timing of the stakeholders’ meeting which comprised of all Super Division and National Division One teams when the association was yet to hold its elective general meeting.

CASH BOOST …FIFA Funds boosts Olympic preps, says Kamanga

HE Football Association of Zambia (FAZ) says the US$500, 000 FIFA Funds exclusively for women football will help the association strengthen the structures for the growth of women’s game.

FAZ president Andrew Kamanga said the funds from FIFA will also help the local soccer governing body give the Copper Queens some top grade preparations for the Tokyo Olympic Games and other international engagements.

Kamanga said FAZ remains committed to ensuring that women football continue to improve with more female players trekking to Europe to join players such as Barbara Banda, Rachael Kundananji, Misozi Zulu, Rachael Nachula and Red Arrows’ Hellen Mubanga who recently joined Zaragoza which campaigns in the Spanish Primera Division B. Kamanga is confident that the measures the association is putting in place will see more women trek into Europe and many other attractive destinations across the globe that offer better opportunities for growth. He said FAZ is working to constitute a team of eminent personalities to steer the fundraising efforts for the growth of women’s football.

Kamanga said FAZ is working on having a fullyfledged women’s league that will go beyond the four provinces currently running.

FIFA has allocated US$1.5 million to national federations as Covid-19 relief funds that will have the first batch of US$ 500, 000 disbursed by August month-end.
