CLIP ALL ERRING COUNCILS GOVERNMENT must extend investigations into illegal land deals to all councils to adequately address rampant land maladministration in financially beleaguered local authorities. The revelation by Lands Minister, Jean Kapata, that reports are still streaming into her office about more councils being involved in illegal land allocation is a sad development. Coming on the heels of the ban on Kitwe and Lusaka City Councils, the revelation is testament that there are more unrepentant councillors out there looting state property with impunity. It appears that the councillors are in a hurry to amass wealth before the expiry of their term next year, going by the rising cases of civic leaders desecrating reserve and protected state land. The country is now stuck with fully developed structures on reserve land with owners flaunting offer letters and approved house plans from councils. Yes, they have developed structures on land reserved for service lines but at the same time are in possession of legal documents - a jigsaw puzzle for the state. Even with numerous warnings from Ms Kapata and her Local Government counterpart Charles Banda, some councillors are still on rampage laying their hands on any piece of land, including reserve pieces near grave yards. Civic leaders have gone on a wanton scramble for land including tracts under electricity pylons, railway lines and school football pitches – yes, it is that bad. Therefore, Government must extend investigations to all councils including those in the countryside before the situation becomes unmanageable. Erring councillors must not only be weeded out of the local authorities, but also ejected from the political parties which sponsored them to represent wards. It has been explained time and again that councillors are there for policy guidance and oversight functions on part-time basis on the similar model as board members in companies. Thus they are not supposed to get involved in the dayto-day operations and more specifically, they must not at any one time get on site with surveyors to demarcate land. If they remain unrestrained, the councillors and their illegal allies will deplete the land resource in the country. In fact, Government must not end on suspending and dissolving councils, but should also hand culprits over to law enforcement agencies for prosecution. If a number of them start shuttling between their homes and the courts of law and eventually get convicted, it will serve as a lesson to others. Additionally, residents acquiring land in areas that are clearly reserved must also get a fair share of punishment. Of course, some residents settle for reserved land it out of ignorance but most of them are fully aware that it is illegal to build a house on the river beds that are clearly defined as water sources such as the Kafubu River which runs through Ndola, Luanshya and Masaiti. In Ndola, structures are sprouting out at Minsundu water plant that accommodates underground water source managed by the Kafubu Water and Sanitation Company. Residents building houses around the water plant are certainly not developers but destroyers because they are distorting the ecological outlay and flow of water. Certainly, such residents cannot be said to be ignorant of the requirement to stay clear of the underground water source. Therefore, both erring residents and corrupt councillors must be dealt with sternly so that this cancer can be brought to an immediate halt. Sanity must thus prevail!

RESCIND SUSPENSION OF LUSAKA, KITWE COUNCILS, DEMANDS LGAZ T By KETRA KALUNGA

he Local Government Association of Zambia (LGAZ) has threatened to sue Local Government Minister, Charles Banda, over the suspension of the Lusaka and Kitwe city councils, saying the decision is illegal. Last week, Dr Banda suspended the two city councils for three months following illegalities in land allocation. But an associating member, James Ntalasha who is council chairperson for Chibombo District Council under UPND, said the move was unlawful and has since given Dr. Banda

a seven-day ultimatum to reverse the decision. Mr Ntalasha said yesterday during a live phone-in radio programme on Power FM in Kabwe that the Minister’s decision would be challenged in the courts of law if not reversed within the given period. He said the suspension of the two city councils was unlawful because that the minister was basing his decision on the Local Government Act and not the constitution. He argued that the Act does not supersede the supreme law of the land. “What has happened to Lusaka and Kitwe should not be tolerated, the suspension is unlawful, if in the next seven

days he does not withdraw that decision, will not hesitant to take him to court, not Lusaka City Council, not as Kitwe City Council but as Local Government. Let the courts of law clear the matter,” he said. Mr Ntalasha explained that article 154 of the constitution clearly stated that mayors and council chairpersons were elected by the people not an individual and therefore a minister had no authority to suspect them. He added that the only aspect which puts the minister slightly above the mayors and council chairpersons was the appointment by the Head of State to a ministerial position. “The constitution is very

62 truck drivers test positive …as Zambia records 213 new cases By SANFROSSA MANYINDA SIXTY-TWO truck drivers who entered the country through the Nakonde border have tested positive for Covid-19 in the last 24 hours. Meanwhile, two more Covid19 related deaths have been recorded, bringing the cumulative number of deaths to 173 as the country recorded 213 new cases out of the 1091 tests done. The cumulative cases recorded in the country stands at 6,793 with 5109 recoveries. Among the 213 cases, two are health workers from the health facilities in Lusaka while 41 patients are on oxygen

support with five cases in the Intensive Care Unit (ICU). Giving the latest update in Lusaka yesterday, Ministry of Health spokesperson, Abel Kabalo, attributed the increasing numbers of cases to poor adherence to preventive measures. Dr Kabalo observed that the fight was far from being won as members of the public continued disregarding the preventing measures. ''We need to make it a personal desire to comply with the preventive measures and see to it that we report suspected cases to health care workers for early diagnosis and treatment. This will also stop the further spread of the virus," he said.

Mapatizya ‘terrorist’ nabbed By NOEL IYOMBWA POLICE in Southern Province are holding a man who has been terrorising people of Mapatizya in Zimba. Police spokesperson Esther Katongo confirmed the arrest of Lucky Kaluwe, who is popularly known as Chulobwana. Ms Katongo said the suspect was apprehended by the public in Chilobe area in Chief Sipatunyana’s chiefdom. She said Kaluwe has been on the police wanted list. He was handed over to police on Tuesday at about 0530 hours by the Member of Parliament for Mapatizya, Mr Clive Miyanda. “We are holding a suspect identified as Lucky Kaluwe aged 19 years commonly known as Chilombwana alleged to be behind a spate

PF cadre caged 2 years for assaulting Lubinda By OLIVER SAMBOKO A PF cadre who assaulted Justice Minister Given Lubinda has been jailed two years with hard labour by the Lusaka Magistrate’s Court. Martin Mambwe, a 38-year-old driver of Kalingalinga was charged with assault occasioning actual bodily harm contrary to the laws of Zambia. Mambwe was initialyy jointly charged with businessmen, Patrick Mubanga, 40, of Zambia Railways area, Major Chansa 35, of Misisi, Moses Mulenga 35, and Goodson Mwange, 45, of John Laing, with proposing violence or breaches of the law to assemblies but the other four were discharged during trial. In the first count, it was alleged that Mambwe on July 12, this year, assaulted Mr Lubinda, thereby occasioning him actual bodily harm while in count two, it is alleged that on the same date, Mambwe proposed violence to Mr Lubinda by saying “we will beat you next time you step your foot in Kabwata Market.” When passing judgement, Mr Mwale described the conduct by Mambwe to Mr Lubinda as barbaric. He said the state had proved the case of assault against Mambwe beyond any reasonable doubt. Mr Mwale said it was not in dispute that Mr Lubinda was at Kabwata Market on the day he was assaulted performing his duties as a member of Parliament and that it was a fact that he was assaulted at the said place as confirmed by the witnesses and the medical report that was issued to him. Magistrate Mwale also said the court was satisfied that Mambwe was at Kabwata market and slapped the minister contrary to his claim that he was not at the said premises at the time the crime was committed.

UPND Western Province chairperson, said Mr Hichilema had helped UPND to be where it is now and it can be difficult for the party to stand without him. "There are so many political parties that were there before UPND was formed but there are they now? Where is United Liberal Party?" Mr Njamba asked. He said UPND could have been long gone if it were not for Mr Hichilema. And Mr Njamba said UPND in Western Province was still intact. Mr Njamba attributed the loss in the just ended by-elections to distribution of relief food by Disaster Management and Mitigation Unit. He said the party in Western Province was stronger than how it was in 2016 and that the recent results were not a reflection of the situation on the ground.

HE mystery surrounding the privatisation of state-owned companies needs to be probed so that any wrong dealings can be exposed, Chinsali Member of Parliament Kalalwe Mukosa has said. And a PF official and former Mandevu constituency secretary, Lemmy Bwalya has urged the Anti- Corruption Commission (ACC) and Drug Enforcement Commission (DEC) to stop applying the law selectively. According to the MP, benefits illegally earned from the privatisation exercise should be given back to Zambians. Mr Mukosa said suspicion of illegal dealing by individuals who were entrusted to dispose of national assets cannot wither without an investigation. He said in an interview that it was imperative to ascertain whether some people illegally benefitted or not so that the issue could be closed once and

HE gaming and betting industry in Zambia must be marred by corruption for the country to be losing colossal sums of money in taxes, Citizens Democratic Party (CDP) president Robert Mwanza has said. Mr Mwanza advised authorities to seriously implement regulations for the gaming and betting industry in the country to ensure that they seal all loopholes in the collection of taxes for Zambians to benefit. This follows revelations that the country was losing over £37 million (K888 million) annually in revenue due to some casinos and game betting outlets operating illegally. Mr Mwanza however said there was something fishy happening between regulators and industry players for the country to lose such a lot of

money while authorities were giving the situation a blind eye. He said in an interview that from the time Government abolished the 20 percent casino levy and introduced a new tax regime on casino, lottery, betting and gaming which was aimed at boosting revenue collection from the gambling industry, tax collection had been poor. Mr Mwanza said the regulation and taxation system needs to be strengthened so that Zambia benefitted from the industry as other countries were doing. In this case, Sergeant Jason Musonda Chipepo who announced his resignation through social media is charged with one count of inciting mutiny. The offence relates to openly inciting officers to oppose lawful authority in the security

GOVERNMENT should revisit the implementation model and financing of all road infrastructure projects to influence private sector participation rather than delaying or suspending them. Delaying or suspending infrastructure development will interrupt development and disadvantage Zambia in the Africa Continental Free Trade Area (AfCFTA) era. This is according to the Zambia Chamber of Commerce and Industry (ZACCI), president Chabuka Kawesha. Dr Kawesha said in the ACFTA era, construction of road and railway networks as well as telecommunication networks would dramatically open and expand markets and grow business. “If we have a cost-efficient and easy way of moving goods to all eight neighbouring countries and Lake Tanganyika that will be a market of more than 210 – 280 million people over the next 10 years for ourselves and those in Southern Africa,” he said in a statement yesterday. Dr Kawesha stressed the importance of allowing private sector finance lead road infrastructure development models take root in the country now. He said it was important for Government to draw up a plan for the coun-

Dr Kawesha said Government must enhance the process of transferring capability of road developments to the private sector and focus on compliance and performance standards, maintenance and road tax among others.

7 children die in inferno By JOHN KOMBE

SEVEN members of the same family have been burnt to death after the house in which they were sleeping caught fire. The incident occurred on Monday around 20:00 hours at Shisholeka village, Chief Nkomensha in Chongwe. According to neighbours and police, the deceased are three girls and four boys, who included a set of twins. The fire was ignited as the occupants of the house were draining petrol from the generators. Zambia Police spokesperson, Esther Katongo, confirmed that the matter was reported by 74-year-old Misheck Njovu, who is the grandfather of the victims. Chongwe Member of Parlia-

ment, Japhen Mwakalombe, also confirmed the development in an interview. Mr Mwakalombe, who rushed to the scene, described the incident as unfortunate and advised the public to be careful in the way they store flammable substances such as petrol. He however assured the family of Government support during the time of mourning. They burnt to death in the house belonging to a man identified as Lawrence Muzolewa, whose wife was at the market for business and only came after the incident. Mr Muzowela and his 12-year-old son were draining petrol from an electricity generator into a container to use in a car while 14 other children were sleeping. It was at this moment that

fuel dripped to the floor and was ignited by a brazier that was nearby. The father tried to rescue some children, but only eight of the children escaped unhurt. According to witnesses, the neighbours and the fire brigade managed to put off the fire, but the seven children were already dead. The charred bodies were retrieved and deposited at Chongwe District Hospital mortuary awaiting post-mortem and burial. The deceased are three girls and four boys who included a set of twins. The family has agreed to bury today in view of Covid-19. A check by the Daily Nation found police inspecting the area. House property was burnt to ashes in the brick house.

OME politicians are against the Constitutional Amendment Bill number 10 without pointing out the items they are not comfortable with and thereby misleading Zambians, the Anti-Voter Apathy Project (AVAP) has observed. AVAP Copperbelt Provincial Coordinator, Poster Jumbe, challenged such politicians to specifically point out issues they feel would work against the masses if Bill 10 was enacted into law. Mr Jumbe said in Kitwe in an interview that in most cases those who were against Bill 10 have no genuine reasons to reject the document. He charged that they were rejecting the docu-

ment for the sake of political antagonism and to be seen that they were a relevant opposition party. He said in an interview that those who had genuine concerns about the Bill 10 should point out their concerns as opposed to rejecting the entire document “They have their own personal and political reasons and have resorted to misleading Zambians about the document so that they can get their support,'' Mr Jumbe said Mr Jumbe said, as member of the Civil Society Organisation (CSO), AVAP had conducted some survey to find out how much people knew the Bill 10. He said the survey had established that very few people had read the document "You find that those from UPND had

told their members to reject the Bill 10 without explaining it to them, while those from PF had also told their members to accept it without explaining to them. It is actually more of a political issue than a constitutional issue,'' he said Mr Jumbe advised Zambians to read public documents which concern their welfare instead of allowing politicians to mislead them into making wrong decisions. "For myself, I think the Bill 10 is a good document which Zambians should read through and make decisions independent from political affiliations. This is an opportunity to produce a better constitution. We missed an opportunity when he voted against the Referendum,'' he said

Private equity prepares to step up as Africa looks to fund its recovery JOHANNESBURG - The private equity industry is confident that it will be able to continue closing deals and raising the capital needed to fund businesses and infrastructure. This comes as African companies look for funds to keep them afloat and governments pin their hopes on infrastructure to recover from the Covid-19 slump. According to the Southern African Venture Capital and Private Equity Association (SAVCA) 2020 Private Equity Industry Survey report just released, Covid-19 travel restrictions have caused delays in fundraising and deal origination, but alternative asset managers and investors say this will not impact future strategies. In fact, the private equity industry is positioning itself to play a bigger role in injecting life into southern African economies. Dinao Leruta, managing partner at impact investing company, Maia Capital, said now that commercial banks have become more restrictive in their lending, this has directed most intervention towards private markets. “(We have to ask) what is it now that we are going to do as a collective to support this ecosystem going through this crunch,” she said. ZIM BILLIONAIRE STRUGGLES TO SELL TELECOM ASSET

ARARE - The coronavirus pandemic is hampering efforts by Zimbabwean billionaire Strive Masiyiwa to sell a stake in Africa’s largest fibre company. Masiyiwa is seeking buyers for 20 percent to 34 percent of Liquid Telecommunications for as much as $600 million, according to four people with direct knowledge of the matter. He needs the money to repay a $375-million loan that was backed by the Public Investment Corp, the continent’s largest money manager, they said. The PIC, which oversees the equivalent of $135

billion mainly on behalf of South African government workers, is demanding the issue be resolved by the end of August after granting an extension on the payment earlier this year, the people said. The loan it backed was used to fund a pay-TV venture, which failed last year because Zimbabwe’s economic woes and currency shortages meant the company couldn’t pay suppliers. The 59-year-old tycoon had pledged shares in Liquid Telecom to the PIC as security for the loan, which had been taken out with Deutsche Bank. Masiyiwa was planning to repay the debt

from the proceeds of an initial public offering in Liquid Telecom, which was scrapped because of volatile equity markets, the people said. The founder of Econet Global, which has interests in mobile-phone network operators and digital-banking operations across the continent, would rather sell part of his 66 percent stake in Liquid Telecom to avoid surrendering shares in the company at a discount to the PIC, one of the people said. Masiyiwa hired Goldman Sachs earlier this year to sell the stake, but talks with potential investors started unravelling after the Covid-19 outbreak

intensified in March, the people said. Buyers wanted more time to assess the economic fallout of lockdowns to contain the virus on Africa’s economies, they said. Representatives for the PIC, Goldman Sachs, Deutsche Bank and Econet declined to comment. Liquid Telecom operates in 13 countries in East, Central and southern Africa with data centres in Johannesburg, Cape Town and Nairobi. It also offers cloud-based services from Microsoft, according to its website. Kganyago: Now's not the time to test policies that have 'proved a failure in economic history' JOHANNESBURG - The Governor of the SA Reserve Bank, Lesetja Kganyago, has again defended the importance of the bank's independence, saying now is not the time to try out policies which have "proved a failure in economic history." Kganyago was addressing the banks 100th annual general meeting, the first time the meeting has been held virtually. The governor told the meeting that the bank expects the nationwide lockdown and impact of the Covid-19 pandemic to cause SA's GDP to contract by 7.3 percent in 2020, a larger slump than the 6.2 percent contraction during the Great Depression in 1931. At the same that the governor was concluding his address, the Organisation for Economic Co-operation and

Development (OECD), in a new report on the state of SA economy, said GDP growth could slump by up to 8.2 percent this year. "This is not a time to despair. Neither is it a time to venture into policies or instruments that have proved a failure in economic history," Kganyago said. He did not specify which policies he was referring to. But over the past few years the bank has been locked in a debate between Kganyago and his allies - who view the bank's independence and mandate as sacrosanct - and some within the ruling ANC, who want the bank to play a more activist role in the economy in the belief that this could improve growth. Kganyago said some of the steps the central bank has taken since the start of the pandemic include lowering the

repo rate by 300 basis points, providing regulatory relief to improve credit flow, putting together a R200-billion loan guarantee scheme in conjunction with major banks, and injecting liquidity into the financial system. In an apparent response to those that want the bank to take a more activist approach, Kganyago said improving the potential growth rate of the economy cannot be left to the central bank alone. Rather, the bank can help create the conditions that would allow growth to recover, in line with its mandate. In his concluding remarks, the governor took time out to thank Minister of Finance Tito Mboweni for supporting the bank's independence, saying he understood central banking very well. A Reuters poll of London cocoa futures published on Monday forecast cocoa would cost 10 percent less at the end of the year because of rising production and a

hit to demand from the coronavirus crisis. But chocolate bars will not necessarily get cheaper partly because the price of cocoa is only one ingredient in the mix that makes up the retail price. The impact of coronavirus lockdowns curbed impulse buying of chocolate, as people

focused instead on stocking up on essentials. And a bleak economic outlook is expected to hit demand for luxuries like chocolate in coming months, while sales at celebrations such as Halloween are likely to be weaker than normal. Apart from cocoa, there are

HILD marriage is a crime in Zambia. This means that it is an offence for a child to be married off either by consent or otherwise. The legal age requirement for a person to be married in Zambia is 20 years and above. I don’t know with other countries Any person who enters the matrimonial relationship or getting married below the age limit is deemed to have committed an offence of child marriage.

Girls are the main victims of child marriages. Boys are not exempted in this predicament either. Some boys are coerced by their parents to marry even before attaining the marriage age However, cases of child marriages are more prevalent in rural areas than in urban areas. Some parents and guardians alike marry off school going girl-children for financial and material gain. Of course there could be other reasons for marrying off girls. Government through President Edgar Lungu “Mr. Walk The Talk” initiated the campaign against

child marriages by engaging traditional to stop the evil practice. Chief Madzimawe of the Ngoni people of Eastern Province, Chief Mumena of the Kaonde people of North Western Province among others have been in the forefront of the fight against child marriages. The campaign against child marriage has started bearing fruits as evidenced by the drastic reduction in child marriages. Many school girls who were married off have since been withdrawn from the matrimonial relationships and integrated back into

school. Ultimately, this will enable these girls pursue their education dream. There is an adage which goes: “When you educate a girl, you educate the nation.” As such, there is need to scale up programmes aimed at fighting child marriages in our country, particularly in rural areas. THE relocation of traders from Chamboli clinic to their new place will soon be done, Kitwe City Council Town Clerk Mbulo Seke has confirmed. Some traders encroached the clinic premises making it difficult for expansion projects. Early this year, the traders accepted to be relocated to the place that was secured for them and called on the council to expedite the allocation of trading spaces. Mr Seke said in an interview that the new trading place was ready and that traders would start getting their portions. ‘’We are aware that the traders needed to be quickly moved to allow for the expansion of the clinic and we are only waiting for the Member of Parliament to be ready so that physical allocation can take place,’’ he said. Mr Seke said that an agreement between the council and the traders was reached that they would relocate provided an alternative place was ready for them. He however said that the council regretted that the process was delayed due to certain issues but assured the traders that they would be taken to a conducive environment soon.

THE Electoral Commission of Zambia (ECZ) has expressed deep concern over the low voter turnout in the recently held two local government by-elections in Kasempa. Kasempa district electoral officer, Tryson Chunga, said he had noticed extreme low voter turnout in the two local government by-elections held recently. “For example in Nyoka ward, out of 1,604 registered voters only 720 cast their votes, while in Lubofu ward where there are 1,115 registered voters according to the 2016 voter register, only 522 voters were able to cast their votes,” Mr Chunga said. Mr Chunga lamented that from the statistics, it was clear that the voter turnout was not impressive at all. He added that voter apathy had become a worrying trend and that the electoral body would continue sensitising people on the adverse effects of voter apathy. “We will need to start sensitizing the people early especially for the 2021 general elections so that every voter is reached,” Mr Chunga said. He said that ECZ would use voter facilitators to reach every eligible voter in the district. “We need to use voter facilitators so that every voter is reached and able to register and cast their votes when the time for general elections comes,” Mr Chunga stressed. - ZANIS

Water pipes vandalism in L/Stone rife By ANDREW MUKOMA SOUTHERN Water and Sanitation Company (SWASCO) has raised concern about the high levels of vandalism on its facilities in Livingstone. The company has also called on residents to stop tying plastics and rubbers on leaking water pipes. SWASCO Regional Senior Manager, Nchimunya Habeenzu, said that his firm was spending a lot of money on repairing damaged water pipes as a result of thefts and vandalism. He observed that some people were destroying water pipe lines and engaging in illegal connections. Mr Habeenzu said that there were some, who were tying plastics and

rubbers on leaky pipes. He told the Daily Nation in Livingstone that much as it might seem to be a good gesture, it was however against the law. Mr Habeenzu said residents should always engage the water utility in an event of a water pipe leakage in their area so that qualified plumbers could be dispatched to deal with the problem. He said SWASCO was moving away from the culture of tying plastics and rubbers to replacing couplings on leaky pipes. Meanwhile, the Livingstone City Council (LCC) has urged SWASCO to embark on a leak audit exercise on all water pipes in the tourist city. Council Public Relations Manager, Melvin Mukela said the water utility should send its staff to assess the situation on the ground. Mr Mukela said meter readers should be taking note of leaky water pipes in communities as they carry out their duties in order to give a comprehensive report.

Kasengele said that failure to fulfill league fixtures especially in the highest league in the country cannot be allowed under any circumstances. He said allowing failure by clubs to fulfil fixtures would send wrong signals to institutions and individuals putting money to sponsor teams as well as those who are sponsoring the league or those who may wish to do so in future. Kasengele noted that punishment must be punitive
