By: JORDAN B. DARLING ATLIT, ISRAEL— A diver off the Carmel Coast in Israel made a historical find, a 900-year-old sword covered in organisms and buried in the sand. Shlomi Katzin, a resident of Atlit, Israel, was diving off the coast on Oct. 16 when he discovered several ancient artifacts on the seabed. Katzin found pieces of pottery, stone anchors, and an impressive three-and-a-half-foot sword that appeared to be uncovered by waves shifting the sand. Katzin, fearing the sword would be stolen or buried underneath shifting sands, brought it up to shore and contacted the inspector for the Israel Antiquities Authority Northern District’s Robbery Prevention Unit to report the find. The sword was handed over to the National Treasures Department, where it was identified as an iron sword dating back 900 years during the time of the Crusades. “The sword, which has been preserved in perfect condition, is a beautiful and rare find and evidently belonged to a Crusader knight,” said Nir Distelfeld, Inspector for the Israel An-

tiquities Authority’s Robbery Prevention Unit, in an Oct. 18 press release from the Israel Ministry of Foreign Affairs. “It was found encrusted with marine organisms but is apparently made of iron. It is exciting to encounter such a personal object, taking you 900 years back in time to a different era, with knights, armor, and swords.” The Carmel Coast is dotted with natural coves that experts believe provided shelter for ancient ships and larger coves that allowed cities and settlements to develop around the water. “These conditions have attracted merchant ships down the ages, leaving behind rich archaeological finds,” said Kobi Sharvit, director of the Israel Antiquities Authority’s Marine Archaeology Unit. “The recently recovered sword is just one such find.” The site where the sword was found has been monitored by the Israel Antiquities Authority since June, when another discovery was made in the area. Artifacts found at the sight show that the anchorage was used as early as 4,000 years ago during the late Bronze Age. Once the sword has been cleaned and researched, it will go on display for the public.

A commissioner was then appointed to every major port, and Colonel John B. Weber became the first Commissioner of Immigration on Ellis Island.

Over 12 million immigrants passed through Ellis Island between 1892 to 1954 coming from all corners of the world.

1954, The Immigration and Naturalization Service removed the la st detained immigrants from Ellis Island, effectively closing the “gateway to America.” Ellis Island processed more than 12 million immigrants from when the island was formally opened as a U.S. Immigration Station in 1892 until the last immigrant, a Norwegian merchant seaman named Arne Peterssen, was released from

the island in 1954, according to the Statue of Liberty website. Ellis Island went through a few phases before it was known as a gateway. The island didn’t receive the name Ellis until Samuel Ellis purchased it on Nov. 18, 1774, and then built a tavern on the island. Ellis died in 1794 and bequeathed the land to his unborn grandson, who died as an infant. The land went back into the control of New York City who then gave the deed for the island to the state of New York to construct fortifications by the U.S. War Department, accord-

LOCAL Dana Point Starts Holiday Season Nov. 17 DANA POINT— The Dana Point Harbor

Partners will start the holiday season on Nov. 17 by kicking off the annual harbor light display. Over 700,000 lights will illuminate the harbor with themed light displays for onlookers. On Nov. 19, Dana Wharf Sportfishing and Whale Watching will add Holiday Light Cruises on select nights throughout the holiday season. Holiday onlookers can take a 60-minute boat ride around the harbor while enjoying holiday music and light displays. On Dec. 4 and 5, from 10 a.m. to 2 p.m., Santa and his helpers will be making 20-minute harbor cruises. The Santa Harbor Cruise is $5 per person, and proceeds will benefit the Soroptimist of Capistrano Bay, a volunteer service organization looking to improve the lives of women and girls throughout local communities and the world. The United States Coast Guard Honors Captain and Crew for Rescuing 25 Migrants Adrift at Sea SAN DIEGO— At the San Diego Port

Tenants Association 32nd Anniversary Dinner, the captain and crew of the

sportfishing vessel, the New Lo-an, were honored by the United States Coast Guard for coming to the rescue of 25 migrants adrift at sea. On Oct. 22, the San Diego-based commercial sportfishing boat, the New Lo-an, was out for bluefin tuna fishing when Captain Markus Medak spotted 25 people adrift on a panga boat intended for two to four people. Medak and his crew placed a distress call for help and tossed the small boat a line and basic provisions while they waited for help. The panga had been adrift for three days without food, water, or life jackets. The USCG responded to the rescue with a C-27 aircraft and the cutter Tern. USCG Captain Tim Barelli, sector commander for the San Diego sector, presented a Certificate of Appreciation from the Commandant of the USCG to Medak at the dinner. “We are grateful we were in the right place at the right time with the right experience to be able to help,” Medak said in a press release from SDPTA. “Sportfishing is our livelihood, and our passion teaches us all respect for the ocean. We appreciate the U. S. Coast Guard for this recognition and for the work they do to keep us all safe in the ocean.”

European Citizen’s Initiative Pushes to Stop the Shark Finning Trade in the EU EUROPE— A European Citizen’s Initiative is circulating a petition to end the shark fin trade in the European Union, which includes the import, export, and transit of fins that are not naturally attached to the animal’s body. Although removal of fins on board EU vessels and in EU waters is prohibited, the EU is one of the biggest exporters of fins and is a major transit hub for the global fin trade. The petition put forward by Stop FinningStop the Trade, a citizen’s initiative, is looking toward ending that shark fin trade in the EU and extending the “Fins Naturally Attached” regulation to include the export, import, and transit of sharks and rays. The petition began circulating in March 2020 and will continue to collect signatures until Jan. 31, 2022.

Am I entitled to full compensation for my damaged boat?

Last month my boat was struck by another boat while at anchor at Catalina Island. The damage was substantial, and the repair estimate prepared by a local boat yard came in at around $50,000. The other boat’s insurance company sent someone to evaluate the damage and they came back with a proposal to pay $11,000 for the repairs. They wanted to repair many of the items that the yard said needed to be replaced, and they listed depreciated values for some of the items like the swim step. This amounts to extremely small compensation that won’t come close to restoring the boat to its original condition. What are my rights against the insurance company? Am I entitled to compensation for my loss of use of the boat?

ANSWER: The first thing to understand when dealing with someone else’s insurance company is that it is someone else’s insurance company. You have certain rights with your own insurance company, based upon various provisions of state law and upon the language of your policy (which is basically your contract with them). protect their client from a lawsuit. This is usually accomplished by working with the damaged or injured party to cover expenses that their client is likely to be responsible for. This means that we need to evaluate the obligations of the other boat owner, not their insurance company. With that in mind, let’s look at the rules for assessing property damage in a maritime incident. The goal in such a case is always to return the damaged party as nearly as possible to the position he or she was in immediately prior to the incident. This sounds simple enough but it is rarely a simple equation and it often leads to disputes. The disputes are often over the question of “betterment,” which may occur when the injured party or their property end up in much better shape after the incident as a result of the repairs. Our reader actually raised this point when he complained that his boat may not be returned to its “original” condition. We may differ on the definition of “original” but he is not entitled to a better boat than he had prior to the incident. In our reader’s case, the insurance representative disagreed with the yard’s recommendations. This is not unusual the insurance company and the yard will each consider their own economic interests, and the fact that one disagrees with the other says nothing about who may be right. For example, the first issue raised by our reader is that the insurance company wants to pay for repairs to items that the yard would like to replace. The insurance company may feel that replacing the damaged components with new parts would actually put our reader in a better position. But the yard may believe that the damaged component cannot realistically be repaired. The solution to these disputes is typically for the damaged party to hire his or her own marine surveyor who is experienced in insurance claim investigation. We actually recommend this approach, which will lead to the hiring of a marine surveyor by the boat owner before he or she retains an attorney. The surveyor / investigator will act as an on-site expert on behalf of the boat owner, and if disputes arise that can’t be resolved through ne-

gotiations between the experts, the boat owner will then need to hire an attorney, who would need to bring an expert witness into the case anyway. Our reader had two other questions. The first involved the assignment of a “depreciated value” to the swim platform. A damaged swim platform may be difficult or impractical to repair. As such, it may need to be replaced with a newly fabricated swim platform. If the old structure was already worn and damaged, a new platform would improve our reader’s boat, which as noted above may be viewed as “betterment.” This would probably reduce the amount paid to the boat owner if he were making a claim under his own policy, because the contractual terms of a marine insurance policy typically require a depreciation factor to be applied to a claim such as this. But our reader in this case is not making a claim under his own insurance policy. He is making a claim against the other boat owner, and our reader is not bound to the terms of the other boat owner’s insurance policy. Under these circumstances he may be able to collect for a new swim step. Finally, our reader asks about compensation for his loss of use of the boat. Unfortunately, the U.S. Supreme Court has ruled that no compensation is owed for loss of use of a recreational vessel. Recreational vessels do not generate income for their owners, and since leisure time has no measurable value, a damaged party may not recover for the loss of use of a leisure asset. As usual, the best advice I can give in a case like this is to contact an attorney experienced in representing boat owners in marine insurance claims. Port of San Diego Revolutionizes Maritime Clean Air Strategy The Port of San Diego has approved a policy document that aims to balance community health improvements through cleaner air while also supporting efficient and modern maritime businesses and jobs. By: KATHERINE CLEMENTS

SAN DIEGO — The Port of San Diego Board

of Port Commissioners has accepted a policy document to help the Port establish future projects and initiatives to improve health through a cleaner air strategy. This policy will benefit all who live, work, and play on and around San Diego Bay while supporting efficient and modern maritime operations. The Maritime Clean Air Strategy (MCAS) will uphold its mission of “Health Equity for All” and is an example of the Port’s commitment to environmental justice. Nearly all the MCAS goals and objectives that are surpassing what is currently required by California. The Board of Port Commissions initiated the development of the MCAS in June 2019. As an update to the Port’s 2007 Clean Air Program, the Port began developing the goals and objectives of the MCAS in March 2020 in close consultation and collaboration with a broad range of stakeholders – community residents, industry, businesses, public agencies, and non-government organizations. The Port of San Diego is not required to have a Maritime Clean Air Strategy, and has developed this document to demonstrate their commitment to clean, modern, and sustainable maritime and goods movement operations, said Gabriella Rodriguez, public relations representative at the Port of San Diego. The MCAS highlights an objective centered on health equity, with high anticipation for their 2030 goals. These goals will contribute to improved air quality as an update to the Port’s 2007 Clean Air Program. In support of the 2030 goals, the MCAS establishes more specific, nearterm emissions reduction goals and objectives to be accomplished within the next five-year period between 2021 and June 30, 2026. In addition, the MCAS identifies approximately 34 potential projects,

partnerships, initiatives, and studies in conjunction with the near-term goals and objectives. The components of the MACS goals that surpass the state’s requirements include a goal of 100 percent of cargo trucks calling on the Port of San Diego cargo maritime terminals being zero-emission vehicles by 2030. This goal will exceed State requirements by five years, and in some cases, even more. Port staff are in the process of putting together a truck transition plan which will be presented at the next board meeting on Nov. 9, according to Rodriguez. In addition, an interim goal of 40 percent of the Port’s annual cargo truck trips will be performed by zero-emission trucks by June 30, 2026; a goal of 100 percent of cargo handling equipment being zero-emission by 2030; to facilitate implementation of the first all-electric tugboat in the United States by June 30, 2026, and to contribute Port Maritime Industrial Impact Fund dollars for the San Diego Air Pollution Control District’s (SDAPCD) purchase and installation of new portable air filtration devices at participating Portside Community residences. “Our Portside Community neighbors, as well as our Working Waterfront and our visitors, deserve to breathe clean air,” said Chairman Michael Zucchet, Port of San Diego Board of Port Commissioners, in a press release sent out by the Port on Oct. 14. The Maritime Clean Air Strategy clearly lays out what our goals, aspirations, and expectations are for ourselves and for the people who do and want to do business with the Port of San Diego.” “The MCAS positions us and our tenants to attract grants and investment from the State for clean air equipment and electrified heavy-duty trucks,” said Zucchet. “The Port of San Diego has already proven to be a leader in this area with shore power and other clean air equipment and infrastructure, and the MCAS is our roadmap as to how we can finish that job in the coming years.’ A generous amount of community and stakeholder involvement has become the foundation of the MCAS, according to a press release put out by the Port of San Diego. The Port began developing the goals and objectives of the MCAS in March 2020. As a result, the Port was in close communication and collaboration with many stakeholders, including community residents, industry, businesses, public agencies, and non-government organizations.

42 Days After the O.C. Oil Spill After losing nearly 25,000 gallons of oil due to the spill, here is where California is at in addressing the impacts and consequences of the Oct. 1 spill. By: KATHERINE CLEMENTS

the City of Huntington Beach, in coordination with Federal, State, and other local agencies, continues to assess and contribute towards mitigation efforts for the Oct. 1 Orange County Oil Spill (Pipeline P00547 Incident), according to Huntington Beach’s city website. In addition, cleanup efforts and shoreline assessments continue in both Orange and San Diego counties. “Based on data and reports from trained observers and cleanup crews who are on Orange County beaches every day, we are seeing decreasing amounts of oil and are assessing segments of beach for no further treatment,” said Capt. Rebecca Ore, federal on-scene coordinator for the spill response team. On Oct. 1, the major, toxic oil spill in Huntington Beach created a severe threat to marine life, the environment, birds, and residencies as the oil took over and infected areas. The spill happened the same weekend as the annual Pacific Airshow, an event that draws large crowds to the beach to watch jets perform and celebrate military participation. As of October 16, oil cleanup crews have removed all booms in Orange and San Diego counties except for the Talbert Marsh after the unfortunate oil spill that began leaking oil on Oct. 1, and all public beaches in Orange County and San Diego County have reopened. After the coastal ocean and wetlands water quality testing results showed non-detectable amounts of oil-associated toxins in the ocean water, the joint decision to reopen beaches was reached. Water quality testing continued twice a week until October 25 to monitor potential toxins. Water quality results have been made public on the Huntington Beach City website. In addition, South Coast Air Quality Management District (AQMD) monitors air quality conditions in Orange County and advises residents if there are air quality concerns. Those results are shared on the same website.

Huntington Beach is also working with water quality experts to take regular water samples along the coastline and inlets to determine the total level of contaminants that was caused by the oil spill. Onshore seafood sampling has been conducted, and offshore testing began on Oct. 24, according to Lt. Christian Corbo, state on-scene coordinator for the response. “Data collected and subsequent analysis of those samples will be used to evaluate seafood safety for fisheries in the areas affected by the Southern California spill. The Director of California’s Department of Fish and Wildlife will reopen them upon recommendation by the CalEPA’s Office of Environmental Health Hazard Assessment,” Corbo told California’s spill response team. The oil spill has significantly affected the city, with substantial ecological impacts occurring at the beach and the Huntington Beach Wetlands. In response, Huntington Beach Fire and Marine Safety personnel had been deployed to implement oil containment efforts. The US Coast Guard took the lead and formed an Incident Management Team (made up of federal, state, and regional agencies) to respond to the oil spill incident and coordinate a cleanup resolution. A Unified Command Team that includes the US Coast Guard, California Department of Fish and Wildlife, and Amplify Energy Corporation has also been initiated to investigate the oil spill incident. Based on the most current information available, the leak originated from a broken pipeline connected to Oil Platform Elly, an oil rig located off the coast of Huntington Beach and owned by Amplify Energy Corporation based in Long Beach. Amplify is working with the IMT to relieve the oil spill and repair the leak, which was stopped. As additional details are made available by the US Coast Guard, Huntington Beach will post them on its website and social media platforms. Updates can be found through the Huntington Beach website. In addition, regular updates regarding mitigation efforts, environmental issues, and all other updates are posted on the same website. Concerns Arise for Proposed Commercial Passenger Boat Engine Technology Updates

tions representing marinas and harbors has raised safety concerns associated with the untested technology that will be enforced for commercial passenger boats, specifically sportfishing, whale watching, eco-tourism, and dive boats several weeks before the California Air Resources Board (CARB) is expected to rule on the controversial harbor craft engine emission regulations. Jaime Diamond and her husband have owned Stardust for 25 years and Coral Sea Sportfishing for six years, in Santa Barbara, California. “We’re a small business. It’s just my husband and I and our three kids,” said Diamond. “My husband has had Stardust here since 1996, we bought the Coral Sea in 2015. To say we have to scrap our vessels- which means if this goes through our vessels will have no resale value and then we would have to go out and spend a minimum of $4 million per vessel to build new boats to accommodate the proposed equipment it’s just not possible. We

will be out on the streets.” Diamond and her husband have vessels made of wood and fiberglass, which would not be accommodating for CARB’s new engines seeing as they run too hot and pose a fire hazard. The new mandate would require the Diamonds to rebuild their vessels to be made entirely of steel. “CARB has admitted that the diesel particulate filter (DPF) unit that will have to be mounted in the boat runs too hot and it is not safe to operate on a wood or fiberglass vessel,” said Diamond. “So that’s why we would have to build steel vessels to accommodate this. The problem also is the Coast Guard has not approved this equipment and because I carry passengers, I cannot do something to my boat that Coast Guard has not approved and especially being where I am in Santa Barbara, we are very sensitive to anything safety related after the Conception incident.”

In Sept. 2019, the Conception, a 75foot commercial vessel based in Santa Barbara Harbor caught fire killing one crew member and 33 passengers. Ultimately, the cause of the fire was due to failure to provide oversight of the vessel and poor maintenance. CARB’s recommended engine regulations require commercial passenger boat engines to be rigged with new engines and DPFs, which have not been tested on passenger vessels. These engines are classified in Tier 4. They do exist; however, they have never existed in a marine environment. The technology has also not been certified by the United States Coast Guard, which regulates passenger vessels. DPFs found on trucks and farm equipment have been known to create robust heat and severe back pressure on engines, according to a press release put out by River City Communications President Marko Mlikotin. Boat captains and harbormasters are worried that blocked exhaust systems may not be as manageable on the sea as they are on land. Before, the CARB fishing vessel sector included both commercial (boats that sell their fish to the public for food) and commercial passenger fishing vessels (CPFV) (boats that carry passengers who catch their own fish for food) in the same category. Both vessel types are licensed as commercial fishing vessels by the California Department of Fish and Wildlife. This new mandate would separate these similar vessel types into two separate categories and require much stricter emissions guidelines for CPFV’s. There are 1,199 commercial fishing vessels according to CARB in contrast to approximately 174 passenger fishing vessels. “Trucks are currently operating with this engine but in a truck if the filter clogs, it can pull off to the side of the

road get out and call for a tow,” said Diamond. “For a boat there are passengers whose lives and safety rely on the boat owner. We are out at sea and if that filter gets clogged, we are a disabled vessel out in the water. You can’t just say ‘okay everybody hop off and wait on the side for help.’ The possibility of the engine catching fire opens the possibility for boats to crash into other vessels or jetties.” Frank Ursetti owns H&M Landing, a Sportfishing and eco-tourism company in San Diego. “We don’t see a path towards compliance with the way the vast majority of the fleet is constructed,” said Ursetti. “With CARB’s aspirational rule making, the technology doesn’t exist. In a nutshell, it means the engines that CARB is requesting our boats to retrofit with, we have a problem. Number one, that size of engine doesn’t exist. It’s a smaller engine that is rated tier four that we would need and that doesn’t exist yet for the marine market. Tier four engines do exist for the marine market but their larger horsepower engines, so we find those in tugboats, but not for what we need for our passenger carrying vessels.” “CARB has developed engine emission technology that is untested and not proven to be safe at sea, and perhaps what is most concerning is that CARB has proposed regulations without consulting the United State Coast Guard, the authority on safety-at-sea issues,” said Eric Endersby, Harbor Director for the City of Morro Bay and a board member of the California Association of Harbor Master and Port Captains in the press release. “If a tractor-trailer stalls or catches fire, a truck driver can pull to [the] side of the road and call 911. This, however, is not a safe option for passenger vessels in the dynamic offshore environment. A likely sce-

It is easy to imagine a host of life-threatening circumstances at sea caused by this untested and unproven technology, especially in high winds and seas.” CARB’s regulations call for engines to be modified and or replaced with technology that has not yet been developed for commercial passenger fishing vessels. In most cases, the modifications will be too large to fit into existing engine rooms. This issue will lead to the loss of jobs, community whale watching, and access to fishing boats for those looking to sport fish with a cheaper budget. This prompted the California State University Maritime Academy to conclude that the suggested standards for existing engines do not exist. In the alternative, “… treatment equipment (modifications) alone significantly impacts the vessel’s stability.” CARB concluded that vessels constructed of wood and fiberglass would probably be removed from service. Over 80 percent of commercial passenger boats are built of wood and fiberglass, according to the press release put out by Mlikotin. This would require boat owners to purchase new metal boats beginning in 2023 or go out of business as extensions expire, Mlikotin continued. California is one of America’s premier fishing destinations. California has over half a million people a year fishing from sportfishing boats, supporting coastal communities, marinas, and small businesses dependent on outdoor tourism for economic activity, jobs, and tax revenue. Before the COVID-19 pandemic, California’s over 2 million anglers contributed $5.6 billion a year in economic activity and supported nearly 40,000 jobs for our State. The mandate will induce other consequences as well. “During the traditional school year, schools will participate in marine science education programs,” said Ursetti. “During whale watching season we take those programs and apply that to

the eco-tourism sector and those are affordable fieldtrips for school districts. We can’t do that if we have to go out and build a $5 million boat. We would no longer be able to offer those programs to schools or certain economic demographics. Those programs will now be three to four times more expensive than they currently are if not more.” Ursetti worked on projections for fishing trips that would support a new build for his boats that would follow CARB’s current iteration of this rule. The projection was anywhere from a 150 to 250 percent increase in fairs as a starting minimum. Currently, a half day fishing trip costs $65, the increase would bring the fare up to $163. “Basically, what we have to do per this rule is build a boat around the machinery, and also if there were to be a new build it needs to be future proof meaning able to accommodate technology that doesn’t exist,” said Ursetti. Diamond is rooted in Santa Barbara, and if the mandate is followed through with, that could mean relocation for her and her family. “For long term, we really don’t know what our options are,” said Diamond. We don’t know what technology is going to come out; all we can do is hope that something better will come out quicker than they are anticipating. We are not in a position to scrap our boats and build steel vessels. We would probably be closing and then moving. We have lives established here… we have three kids. I’m an elected member of our school board; we’re really community involved people. All our roots are here.” On Nov. 19, the California Air Resources Board (CARB) will conduct a public hearing to consider the proposed amendments to the Commercial Harbor Craft Regulation in effect on Jan. 2023. Currently, CARB is listening to public comment, until Nov. 15. Cause and Effects of Southern California’s Congested Ports

There are more than 1,000 cargo ships off the coast of California and dozens in southern California that are not allowed to dock or unload; the backlog is claimed to be due to import demands surging amid the easing pandemic restrictions. By: KATHERINE CLEMENTS LOS ANGELES — As of Nov. 2021, the backlogged cargo ships remain at an alltime high in Southern California as the supply chain crisis continues to overwhelm two of America’s busiest port complexes, Long Beach and Los Angeles. The two ports take in 40 percent of the nation’s imported goods. As of Oct. 19, more than 100 ships stay stuck waiting to unload thousands of containers outside the Port of Los Angeles and Long Beach, the backlog has left ships idling in the waters outside the ports for weeks, and the jam is expected to last into next year. “Major port gateways around the

A cargo ship crowded Los Angeles Port may lead to difficulties for the upcoming holiday season. world have been experiencing unprecedented levels of congestion,” said Director of Media Relations for the Port of Los Angeles, Phillip Sanfield. “At the Port of Los Angeles, one of the most visible indicators of this congestion is the number of ships at anchor. Under normal operations, cargo ships do not have to wait at anchor; however, the backlog of ships started rising a year ago and is nearing an all-time high due to the current holiday surge.” The COVID-19 pandemic shutdowns caused an increase in goods consumption that was further buoyed by stimulus funding, according to Sanfield. “As a result, the Port [of Los Angeles] has seen extraordinary volumes throughout 2021 and has averaged 900,000 containers per month since summer 2020,” said Sanfield. “In spite of the best efforts of terminal operators and longshore workers, terminals remain beyond full capacity, as evidenced by tall container stacks crowding the tarmacs and the backlog of ships at anchor. The situation will likely persist until the import surge subsides and the flow of containers out of the terminals to inland locations and store shelves improves.” Short-term solutions include convening with supply chain stakeholders to enhance system capacity, move towards a 24/7 operation, promote and share information, and closely monitor real-time system performance indicators through the Port Optimizer to assess the situation and develop policy and operational responses. The traditional models of forecasting freight volumes are inadequate to keep up with the past few years’ erratic trade flows (tariff or pandemic induced). A mid-to-long-term solution is to leverage real-time data spreads across the end-toend supply chain to hold the potential for more powerful predictive capability and help prepare for future volume surges. The Port is modeling this with the Port Optimizer Horizon module, according to

Sanfield. The Biden administration has vowed to expand port operations to address the problems accumulating amid an overwhelming demand for imported consumer products and a shortage of trucks, drivers, and warehouse workers, according to The Guardian on Oct. 20. On Oct. 13, President Joe Biden warned companies that he would “call them out” if they failed to “step up” to ease supply chain bottlenecks ahead of the holiday season. The U.S. president is facing uninviting opinion polls and a stalling legislative agenda. Biden is ambitious to preclude fresh political damage from choked ports, highways, and railways, resulting in higher prices and empty shelves. “I know you’re hearing a lot about something called supply chains and how hard it is to get a range of things from a toaster to sneakers to bicycles to bedroom furniture,” Biden said in an address at the White House on Oct. 13. “With the holidays coming up, you might be wondering if the gifts you plan to buy will arrive on time.” Biden also announced that the Port of Los Angeles will follow Long Beach in expanding operations to 24/7, a system that most leading countries in the world operate by, except the U.S., until now. Prior to this change, the ports ran five days a week, closing at night and on weekends. This change will add 60 hours of operation a week. The nighttime operations are significant because it allows access to a less-trafficked time frame. Biden says these changes will have the potential to be a “gamechanger.” “I say “potential” because all of these goods won’t move themselves,” said Biden. “For the positive impact to be felt all across the country of goods – Walmart, FedEx, and UPS – plan to intensify their roundthe-clock operations to speed the shipment of goods across the country. Target, Home Depot, and Samsung are also

increasing their work in off-peak hours.” On Oct. 13, Walmart, the U.S.’s largest retailer, committed to going all-in on helping move their products 24/7 from the ports to their stores nationwide. In addition, Walmart has specifically committed as much as a 50 percent increase by utilizing off-peak hours over the next several weeks. In addition, FedEx, and UPS, two of the U.S.’s biggest freight movers, have committed to significantly increase the number of goods they are moving at night. Their commitment to transition to 24/7 operations will help businesses of all sizes fill their shelves with goods faster and more reliably. “This is not called a supply chain for nothing,” said Biden. “This means the terminal operators, railways, trucking companies, shippers, and other retailers as well.” The COVID-19 pandemic has induced the supply chain issue as the rise in sales of durable goods spiked while a shortage of workers and transportation increased as well. Thousands of shipping containers sit on cargo ships offshore, waiting to be unloaded at Los Angeles and Long Beach ports. Biden met with executives from the Ports of Los Angeles and Long Beach on Oct. 13 as well as from companies, trade unions, the National Retail Federation, The American Trucking Association, and the Pacific Maritime Association. The Biden administration cannot promise that there will be no holiday disruption because of the backlog, said White House press secretary Jen Psaki to reporters. NOAA Addresses Harmful Algal Blooms That Are Consuming the U.S. The National Oceanic and Atmospheric Administration has allotted funding to manage harmful algal blooms (HABs) which occur when algae — simple photosynthetic organisms that live in the sea and freshwater — grow out of control while producing toxic or harmful effects on people, fish, shellfish, marine mammals, and birds.

G U L F O F M E X I C O — The National Oceanic and Atmospheric Administration (NOAA) has announced $15.2 million in funding for harmful algal bloom (HAB) research projects throughout the U.S. coast and Great Lake waters. HABs contain organisms that can severely lower oxygen levels in natural waters killing organisms in marine or freshwaters. As a result, they can destroy ecosystems, disrupt consumer seafood supply, impact economies, and threaten human health. NOAA’s National Centers for Coastal Ocean Science (NCCOS) is assigning $12.4 million for HAB research, including $834,000 for three new research awards and $11.6 million for 25 ongoing awards. Funded projects will improve early warning of shellfish-killing algae; optimize detection of HAB toxins; assess the use of HAB control methods in marine and freshwater; enhance HAB forecasts and study the social and economic impact of HABs. HABs have caused an annual economic loss of up to $100 million on average, and costs from a single major HAB event can reach tens of millions of dollars, according to the NOAA website. Investments in these projects offer a coordinated effort within the National Ocean Service to advance the U.S.’s capacity to observe, monitor, forecast, and manage the blooms. “Harmful algal blooms are a national problem, and we are trying to work to address them collectively,” said Marc Suddleson of NOAA. “There are multiple issues throughout the U.S. coast, and Great Lake waters, and there are several different types of species of marine and freshwater algae. They grow exponentially out of control. A number of the species can produce toxins or otherwise cause harmful effects that have negative impacts on ecosystems. Some species release toxins and some just grow so rapidly and so large that they cause ecosystem damage. In some estuaries, they may suck up all

“Each state is dealing with their different cast of characters and species, and so there are some [species] that impact ecosystems and some that impact our seafood; some can affect beach tourism, and some of them are health concerns,”

said Suddleson. According to the NOAA, the new projects began on Sept. 1 in Florida, Louisiana, Ohio, and Washington to thoroughly check the effectiveness of clay dispersal as technical knowledge of how to control Karenia brevis blooms, a microscopic, single-celled photosynthetic organism, in the coastal environment of Southwest Florida that is the most dominant; commonly known as red tide. “For Karenia brevis, there are two concerns for the toxins that it can produce,” said Suddleson. “One, it can get into the food through shellfish. They do a good job of monitoring these toxins [in shellfisheries], but if there is a problem, they will shut down that shellfishery so that people aren’t harvesting and then consuming the shellfish. That’s good from a public health standpoint. It’s challenging when that happens to the shellfish industry.” “In the gulf, there is a second concern with this particular species [Karenia brevis] getting into the surf zone and then the action of the waves breaks open the cells [of the algae] and aerosolize the toxins Suddleson continued. “The toxin particles can become airborne in the spray [of the waves], so if there is a red tide, algal bloom, and it’s in the surf zone, it can cause the toxins to be airborne, and you can inhale that, and that can have some health problems, especially for people with compromised pulmonary problems like asthma.” The new projects will improve freshwater HAB toxin detection capabilities of autonomous underwater vehicles and optimize an early warning system to reduce shellfish killing HAB toxins in the Pacific Northwest. NOAA, along with NCCOS, continues to fund the most relevant scientific research to assist managers and coastal communities all over the country trying to cope with developing and recurring toxic algae that continue to affect environmental and human health. So far, projects this year have attended to most of the U.S. continental coast, inclusive of the Great Lakes and Alaska. The IOOS Regional Associations have established these projects in association with local communities and research institutions to address recognized requirements and coverage gaps in their region. The Gulf of Mexico testbed is a first of its kind effort to develop a capacity to advance detection and anticipation of harmful algal bloom species such as Karenia brevis and possible unidentified HAB species in the gulf. Through the whole of this three-year inaugural project, researchers will distribute a small collection of autonomous apparatuses to test their sustainability in the opaque waters of the gulf and build the instruments and personnel capacity to conduct, maintain, and translate data from the systems. Aquatic Invasive Species (AIS) prevention workshop for California waterway users will be held from 9 a.m. to 12 p.m. The event will benefit everyone accessing California’s waterways and is an opportunity to learn how to prevent the further spread of AIS into uninfected waterways. In addition, this virtual workshop will help the public understand how to recognize freshwater AIS in their region and how to take action to prevent them from spreading. The event is hosted by the California State Parks Division of Boating and Waterways, the California Coastal Commission, the California Department of Fish and Wildlife, and the U.S. Fish and Wildlife Service. Workshop participants will gain an understanding of the impacts that freshwater AIS have on the environment; learn to recognize them in their region; and learn how to take action and prevent spreading freshwater invasive species by inspecting and cleaning equipment and watercrafts. The History and Hauntings of the Queen Mary By: KATHERINE CLEMENTS

transatlantic liner, the Queen Mary. The ship remains moored in Long Beach Harbor and functions as a maritime museum, meeting center, hotel, and a haunted attraction. The Queen Mary was built in 1930 in Clydebank, Scotland, by Cunard Line, a British cruise line based at Carnival House in Southampton, England. The project was initially known as job #534, and due to the economic setback induced by the Great Depression, the ship’s construction was finished in three and a half years and cost 3.5 million pounds sterling which is equivalent to $4.8 million in today’s USD. Cunard decided to name the ship after Queen Victoria, but as legend has it, Cunard directors went to ask King George for his blessing of the ship’s proposed name, according to the Queen Mary website. “We have decided to name our new ship after England’s greatest Queen,” says the article. “But King George’s reported response was, “My wife [Queen Mary] will be delighted that you are naming the ship after her.” On May 27, 1936, the Queen Mary set sail on her maiden voyage, departing from Southampton, England. The ship was constructed with five dining halls and lounges, two cocktail bars, two pools, a grand ballroom, a squash court, and even a small hospital. The Queen Mary had set the bar for transatlantic travel, catering to the rich and famous, who were typically the only people who traveled at that time. The Queen Mary retired in 1967 when she became a Southern California attraction after she found her current home in the Long Beach Harbor. In her heyday, The Queen Mary carried 2.2 million passengers during peacetime and 810,000 military personnel in the Second World War. Since her retirement in Long Beach, the ship has seen an estimated 50 million visitors.

European Championships wrapped up on Oct. 28 with three U.S. athletes competing against racers from Europe, Asia, the Middle East, and the Americas. The U.S. may not have placed high this championship, but the athletes are in good spirits and continuing to look forward to the next events for the team. This was the first international event for the USA iQFoil athletes since the

equipment’s official Olympic designation earlier this year. “The European Championships were great fun and a great learning experience,” said Alex Temko, the U.S. male representative at the inaugural Junior Pan Am Games set for Cali, Colombia Nov. 26Dec. 5 in an Oct. 29 press release from US Sailing. “I learned a lot about the Olympic venue and got to see the level of the fleet.” Temko placed 94 out of 140 athletes in the overall rankings for the event. Temko told US Sailing that he took

several lessons from the event and will use them in the upcoming Pan-Am Games. “I worked on switching from a racing mode to a relax-and-recovery mode,” said Temko in the press release. “I practiced my high-performance tactics and had plenty of opportunities to lock in my full speed on the reaches.” Fiona Wylde is a recent addition to the iQFoil team and placed 59th out of 68 competitors in the women’s open division. This is Wylde’s first international iQFoil event. Wylde is a three-time Stand-Up

BRISTOL, R.I.— US Sailing has released an outline for the 2022 selection season. The International Selection Committee will choose one athlete in each of the single-handed classes and one team of two for each of the double-handed classes to represent their country at the 51st Youth Sailing World Championship to be held in The Hauge, Netherlands, July 8-15, 2022. The selection of athletes will be based on a two-event qualification system with the first event for ILCA 6, Nacra15, iQ-

Foil, and Formula Kite at the US Open Sailing Series- Clearwater Feb. 4-6, 2022. The event will be hosted at the Clearwater Yacht Club. The first event for 29er and i420 will be at the Midwinters East Feb. 19-21, 2022, at Miami Yacht Club in Miami, Florida. The second event for ILCA 6 will be March 25-27, 2022, at the California Yacht Club in Marina del Rey, while all other classes will have their second event at the ODP Midwinters West March 25-27, 2022, at Alamitos Bay Yacht Club in Long Beach. US Sailing said if any of the events were postponed or canceled, the one event would count as

the sole qualifier for the class. The final finishing position, not net points, will determine the team’s points for the event, with 10th place equaling out to 10 points. Athletes have to compete in both events to qualify for their class. The championship set for July 8-15, 2022, in the Netherlands will be held in the North Sea. World Sailing said that the sea has varying conditions that will provide a “true test” of athletes’ ability on the water with varied wind conditions and challenging tidal patterns.

Sportfishing is up and running at Dana Point Wharf Sportfishing, and the fish are biting. “Clemente rockfish biting!” said Brian Wooley in an Oct. 24 email. “The Fury fished SCI on Wednesday, and regular Paul Snider jigged himself up a solid red on the drift!” State closures are still in effect as fisheries from Huntington Beach down to San Clemente are closed, to compensate sportfishing trips are traveling a little further down the coast to open fisheries. Half-day and three quarter-day trips are fishing below the harbor, so anglers can expect a longer trip but the same great fishing.

Recreational Dungeness Crab Season has Temporary Restrictions to Prevent Whale Entanglement CALIFORNIA — The recreational take of Dungeness crab using crab traps in Fishing Zones 3 and 4, from the Sonoma/ Mendocino line near Point Arena to Lopez Point below Monterey, is temporarily restricted due to the presence of humpback whales and leatherback sea turtles. The restriction is to limit the potential for entanglement for the two endangered species. The season was due to open statewide on Nov. 6, but after a risk assessment was completed by the CDFW and a team of scientific partners, it was decided to limit the use of crab traps in the area. “This is the first time the recreational Dungeness crab fishery is subject to similar measures as commercial crabbers to help protect whales and sea turtles,” said CDFW Director Charlton H. Bonham in a Nov. 1 press release. “We recognize that change takes time but thank all Californians who treasure these recreational fishing opportunities. We continue to value and appreciate the work put in by the fleet and the California Dungeness Crab Fishing Gear Working Group. This year, while the start of the recreational season may look different, the process allowed us to open some parts of the coast to recreational crab traps and all the coast to recreational crabbing with other fishing methods. C A L I F O R N I A — The California Department of Fish and Wildlife and the U.S. Bureau of Reclamation announced a joint effort to increase the production of fall-run Chinook salmon at the Nimbus Fish Hatchery in Sacramento County by 500,000 smolts to help combat the effects of drought. The hatchery typically produces four million Chinook salmon smolts per year for release into the American River and locations throughout San Francisco and San Pablo bays. The American River saw a significant decline in returning salmon during the last drought, and by increasing the smolts from the hatchery, the CDFW are looking to get ahead of the population decrease. “We’re using those observations and that experience to get ahead of any population declines this time around by increasing production to help sustain this important salmon run,” said Jason Julienne, supervisor for CDFW’s North Central Region fish hatcheries, in a Nov. 2

press release from the CDFW. Most of the additional salmon smolts will be trucked and released at sites in San Pablo and San Francisco bays to improve the smolts survival chances and allow scientists to further evaluate new release points that were utilized last spring. There is a similar measure happening at Feather River Hatchery in Butte County, where there will be a 1,750,000 increase of fall-run Chinook salmon this fall, according to the CDFW website. FEATURED CATCH NEWPORT BEACH— A Newport angler pulled up this star-studded grouper on Oct. 28. This rare fish is often mistaken with the snowy grouper and is found in the eastern Pacific Ocean from Southern California down to Peru. The fish is found on rocky reefs and soft bottoms and is distinguished by a dark reddish-brown coloring with white spots for juveniles and a dark brown coloring that lacks spots for adults. “ RARE FISH pulled up today on the Western Pride today. Any guesses on this species? ,” said an Oct. 28 Facebook post from Davey’s Locker Sportfishing and Whale Watching. “Caught at 46 fathoms, this species is seen only a handful of times during the year for our entire fleet.”

continues to keep Southern California offshore anglers busy as there is still good fishing to target for a variety of species. Bluefin tuna continue to steal the spotlight with good numbers of bluefin biting for boats fishing the Cortes Bank. Those wishing to stay closer to San Diego have yellowtail to target along with a chance at scratching out a bluefin or yellowfin while fishing offshore areas within 35 miles or so of Point Loma, and the 9 Mile Bank has steadily been producing a few swordfish and still has a few marlin hanging around.

The bluefin tuna out by the Cortes Bank have been nice sized fish with most in the 30 to 80-pound range and with a few larger fish in the mix that go to 200plus pounds. Boats have been fishing the Cortes Bank on trips that are usually 1.5-day trips or longer. As an example of the recent fishing, Pacific Queen out of Fisherman’s Landing just got back from a 3-day trip that saw 24 anglers catch 96 bluefin tuna up to 200 pounds. Another example was the fish count on El Capitan out of Point Loma Sportfishing that just returned from a 1.5-day trip that saw 18 anglers catch 34 bluefin tuna.

The best area for bluefin in recent days has been between the 50-fathom curve and the 500-fathom curve around the western and the northwestern edges of the Cortes Bank. Most of the bluefin have been caught while drifting over meter marks or sonar marks with occasional spots of breezing or breaking fish also leading to bluefin stops. Best baits for the bluefin have been sardines, kite fished frozen flying fish, flat fall jigs, and knife jigs. At last report, the water temperature at the Cortes Bank was running about 65 degrees.

Boats fishing some of the local offshore banks within 35 miles of Point Loma have been finding yellowtail biting around kelp paddies and have also been scratching out an occasional tuna. Most of the tuna activity has been bluefin tuna but there has also been a slight chance at finding a porpoise school that might be holding some yellowfin tuna. Most of the kelp-paddy yellowtail have been 3 to 10-pound fish. Spots of breaking 20 to 80-pound bluefin tuna are regularly being seen incidental to looking for the kelp-paddy yellowtail but for the most part it has been difficult to get the bluefin to bite.

Productive offshore areas for yellowtail, with the opportunity for tune, have been the back side of the 9 Mile Bank, the Coronado Canyon, the area 5 to 8 miles west of North Island, the 224 Spot, the 302 Spot, the 230 Spot, and the 371 Bank.

In more distant areas, there is also a recent report about some yellowtail, yellowfin tuna, and dorado biting outside of the Butterfly Bank. Additionally, at last report, boats fishing offshore waters outside of Ensenada were also finding biting yellowtail around kelp paddies along with a chance at scratching out a tuna while fishing around the 385 Spot, the 475 Spot, the 238 Spot, and the area to the southwest of the Banda Bank.

Striped marlin have been scarce but Captain Maurice Smith recently reported baiting a sleeper that he located outside of the lower-middle part of the 9 Mile Bank. Smith said the fish spooked before they got to within casting range and that they could not get it to bite their mackerel.

In addition to the 9 Mile Bank, Smith also looked at the Coronado Canyon and reported seeing a few spots of breaking bluefin and lots of bait (sauries and small mackerel.) Before looking around for marlin and tuna they first did some bottom fishing off North Island where they found good fishing for an assortment of reds and rockfish.

Boats that have been deep drop fishing for swordfish continue to pick away at an occasional swordfish while working the back side of the 9 Mile Bank and the 178 Spot. My estimate is that there were three to five swordfish caught over the past weekend. There were also a few heartbreaker reports about fish being lost after hard fought battles. One Skipper reporting losing an estimated 200-plus pound swordfish 10 feet away from the boat when the hook was pulled out after a 2.5-hour struggle. On a high note, Fisherman’s Landing reported that the Bight 28 was fishing a recent swordfish trip where they had two anglers catch two swordfish. A frozen large squid tends to be the best bait for swordfish.

The reports coming from boats fishing around Los Coronado Islands have been about good bottom fishing while working hard bottom to the north and northwest of North Island in the 30 to 50-fathom depths. There has been a nice mix of reds, salmon grouper and assorted rockfish biting along with an occasional bonus lingcod. A private boater also recently reported catching a few lingcod in shallower water at spots in closer to North Island. There has not been much reported in the way of surface fishing activity at Los Coronado Islands since a few bonito were reported to have been biting along the weather side of North Island about 10 days ago.

The highlight of San Diego coastal fishing of the past week has been for a mix of calico bass, bonito, rockfish, and sculpin that have been biting for boats fishing the Jetty Kelp off Mission Bay. The afternoon hours have been best for the calicos and some near limit to limit catches of calico bass have come from this zone. The water in the Jetty Kelp area has been at 67 degrees and the water has been clean.

There is not much new to report on the halibut fishing. Areas where an occasional legal sized halibut has been reported in recent weeks are Imperial Beach, the sandy bottom next to the structure of the Yukon Shipwreck outside of Mission Beach, the sandy bottom next to the structure of the sunken NEL Tower outside of Mission Beach, outside of South Ponto Beach, the sandy bottom next to the Buccaneer Pipeline, and the sandy bottom next to the artificial reefs off Oceanside.

Other productive areas for the mixed bag coastal fishing have been the International Reef, the Imperial Beach Pipeline, hard bottom areas around the Whistler Buoy at Point Loma, the hard
