Troop Signup for Care Packages We appreciate the service of the members of our country’s military as they deploy to serve missions in difficult and dangerous environments. Our care packages show the care and support of a grateful nation. They contain snacks, toiletries, and recreation items. Troops are welcome to ask for specific items that they may be missing or needing. Special requests often are items like coffee, certain snacks, socks, favorite magazines and books. We send packages that are large enough for several members of a troop to share. Chaplains are a good point of contact for our organization so they can distribute items in chapel, recreation items, or along their visits to outlying areas. Troops who wish to receive packages are asked to email us at ncp4p@yahoo.com or private message us on the facebook page.

We Say Good Bye
Samuel D. Major Samuel D. Major, age 69, of Lawrenceville, VA passed away February 4, 2019. He is the son of the late Samuel and Marjorie Major. He is survived by his wife, Marion King Major; his children, Christopher Allen Major of South Hill, Robert Allen Major of Emporia and Shannon Major Oster of Prince George; eight grandchildren; his sister, Susie Ross of Jacksonville, FL; his brother, Ronald Major of Lawrenceville; and two uncles, Donald Finch of Mechanicsville and Gerald Finch of Chase City. A memorial service was conducted at Lawrenceville Baptist Church. There was a memorial run in his honor. Many bikers came out to show their respect to Samuel and his family. Samuel was a biker and instilled in his children the love for riding and the fellowship and brotherhood that goes along with it. Thanks Daddy! Tattoos have become a deep-rooted part of bike culture and I’d like to introduce you to a very special “ink therapist.” Tattoo Artist, Angela McConnell Wolfe, has been leaving her unique mark on the people who visit her private studio in Wake Forest, North Carolina for over 8 years. A decade ago, Angela had experienced more than her fill of working in a government office and all of the frustrations that job entailed, and decided that she’d retire early and use her God-given artistry to make a living, make a life and bless others. Angela takes her role as a tattoo artist very seriously. When you put an indelible symbol on someone’s body, it’s a very personal and significant thing. Angela says tattoos become a part of who someone is, and she always wants the experience to be relaxing, enjoyable and powerful. Whether she is creating a client’s dream tattoo, or a piece of body art that memorializes a loved one, or when she’s covering up an old tattoo from the past that needs to evolve into something new and meaningful, Angela is one artist who loves her work. Many ancient cultures believed that tattoos were healing, protective and sacred. Wolfe still believes that is the case. She says she has found that tattoos are therapy to many of the people she encounters in her work, thus the sign she has hanging outside that says “Ink Therapist”. But a special part of Angela’s studio time that feels particularly therapeutic is the time she spends helping women on their healing journeys after fighting breast cancer.

Angela has an extraordinary talent for the creative eye and steady hand needed to help a woman as she recovers from breast cancer. She tattoos areolas (the nipple and surrounding area) on the reconstructed breast; the shading and contouring that Angela does as she visually reconstructs the areola of the breast takes on a 3-D quality that is many times described as miraculous. “Very often women feel like they’ve lost a part of themselves after breast cancer. I love being a part of making them feel like themselves again. Often women, and their significant others, are very emotional after this final part of their reconstruction. I’ve had several clients tell me that I changed their life,” says Angela. “I’m honored to be a part of their healing process”. And Wolfe does areola re-creation for free. She has never charged anything but hugs and smiles for this unique ink therapy that she does. “Many times this is the last step in a woman’s recovery and feeling like she’s actually beat cancer. Because many insurances don’t cover areola tattooing,
I don’t believe women should have to fight with insurance companies after already having fought cancer.” When Angela found her path as a tattoo artist, she asked the Almighty to help her and prayed that her ink would be a medicine to people. She is thankful that she sees that prayer answered all of the time. In addition to art, Angela has many passions: singing, songwriting, guitar, piano, spending time with her horses, and she has always been passionate about her Harley. She says after getting her first motorcycle on her 11th birthday, she was hooked for life. She loves participating and helping sponsor charity rides, and says she can’t think of anything better than the sound of a Harley, except for the laughter of a child. We had our annual Lobby Day on 2/6/19 and the turnout was almost double that of last year. We had at least 45 people there, and they visited with about 25 legislators. We were giving them information on legislation that we support and want to see introduced. The personal time and monies spent by these dedicated individuals to come to Raleigh is much appreciated. We had several individuals that were not CBA members attend to see what it was all about, and they were impressed with the actions taken that day. This is one of the most important actions that we take each year, and staying active during the entire session and supporting the bills that we have introduced is vital to their success. At this point, there have been 4 bills introduced that we support. HB 144, The Hands Free NC Act, was introduced on 2/25/19 and has been assigned to the House Transportation Comm. If found favorable, it will go to Judiciary, if favorable, Insurance, if favorable, Finance, if favorable, Rules. So there are many steps to follow to have this bill passed, and many in the legislature feel that it takes away individual liberties. CBA has voted to support this bill. HB267 has was introduced on 3/6/19 to allow Freedom of Choice concerning the mandatory use of helmets while riding a motorcycle. The bill, if passed, would allow anyone over the age of 21 to go helmetless as long as they have held a motorcycle endorsement for at least 12 months or has completed the approved motorcycle safety class. If approved, it would go into effect on 10/1/19. Ref to the Comm. on Transportation, if favorable, Health, if favorable, Rules. It is scheduled to be heard in committee on 4/9/19.

HB104/SB81 were introduced at our request on 2/20/19. These are companion bills that were to redefine the definition of litter to include yard waste. The term "yard waste" includes grass clippings, leaves, shrubbery trimmings, and any other plant material resulting from lawn maintenance and other horticultural gardening and landscaping activities. The House bill was passed by the Com on State and Local Government and by Transportation. It is currently in Rules. The bill has now changed in that it does not change the definition of litter, but it makes it an offense to leave grass clippings on the paved area of a public street or highway. The Senate bill remains in the Rules Comm. and will probably stay there until they see what the House does with it. We hope that this bill will pass so that riders can take action when people blow grass into the road when mowing. Did you know that it is illegal to wear a mask that conceals your identity while on any highway in NC? Well, it is and HB257/S321 has been introduced that would exempt persons riding a motorcycle. The law originally was passed to address terroristic actions, but there have recently been tickets written to motorcyclists wearing face coverings to stay warm. This bill has passed the House and is now in the Senate Rules Committee awaiting action. Another bill that we wanted to see introduced concerning our interests is the equal access language. This was introduced in the 2017 session (HB28). It passed through committee and received unanimous support on the House floor. The Senate never took up the measure though, so it did not become law. We tried to have it introduced in the Senate this year but were unable to secure a sponsor. Updates will regularly be sent out through email, CBA Facebook page and other media to keep you informed of the progress of all of these legislative issues. Please pay heed to these updates and respond with emails and phone calls to your legislators when asked to do so. Be involved. Even if you are not interested in politics, politics is interested in you and political actions affect you in many ways every day.

You Never Know My year started off by making a few resolutions…you know, those things we want to do or change, but mostly wish to do but never seem to stick with. Quit smoking, lose weight…the list can get long. I made one that I felt I could easily accomplish: Take more road trips and get back to putting 20,000 plus miles this year Behind Barz on a motorcycle. Sounds easy and like a lot of fun, right? Reality check—life happens. You never know what’s beyond the next curve in the road. For me it was my big cruiser bike needed a motor overhaul…Beast needs a new timing chain, guides, and well, might as well bore the cylinders while the motor is out of the bike to get rid of that oil usage. With 200,000 miles on the clock it wasn’t totally unexpected. The problem was, my backup bike couldn’t handle the cargo while the work was done. I wasn’t ready for a new bike (Beast fits me like a good old pair of jeans, and if you’ve read my first novel, The Lone Wolf Murders, you’ll understand). So, I turned my light cruiser into a bike that would temporarily do the job of taking cases of books to rallies I had scheduled. I added a batwing fairing, music, a better seat, and two large bags strapped behind me. It was like having a large passenger with a high center of gravity (if you know what I mean), but on an 1100cc Honda Shadow, it seemed a bit overloaded. I practiced some maneuvering and braking with the load and the bike did well except at slow speeds like in a parking lot where there are lots of observers that ride. And my first rally/book signing was near Orlando at a Gold Wing (GWRRA) rally. That group is certainly safety-conscious! Concerned is a word that almost describes how I felt—but with the cool weather I was following a GWRRA basic philosophy—ATGATT (all the gear all the time). Well, I made it to Altamonte Springs, the site of the Florida district rally, with no problem. I even got 45 mpg but was I ever happy to get rid of that cargo. The Shadow was like a different bike, nimble and spirited in its riding characteristics. I was tempted to get rid of some riding gear for the ride across Orlando—I was staying across town with my son—but with the abundant traffic and cool temps I was comfortable with ATGATT. Those that know me well know I avoid interstates like the plague they can be for us on motorcycles. We are often not seen by those in cages on four or more wheels. Using the ‘avoid highways’ function on my GPS keeps me off the interstates and on two-lanes much of the time. We know that avoiding high-speed, crowded interstates does not necessarily keep us safe, but defensive riding tactics improve our chances substantially. “You never know” and thinking “What if…?” when encountering traffic does. Being highly visible helps us avoid having to use emergency defensive actions that we have hopefully practiced often.

by Wayne Littrell Spending three days around Wingers who are dedicated to “Friends, Fun, Safety, and Knowledge”, the safety awareness and knowledge will rub off on you. Along with guided rides, they have classes devoted to improving riding skills. Vendors are there to add accessories to your bike, and some of the most popular were those dealing in safety gear and lights. Having fun and making friends just comes naturally with that group. I was particularly impressed with the ATA’s (American Trucking Association) ‘Share the Road’ program with its display of a big truck’s blind spots. They even had you sit in the driver’s seat while dispensing their words of wisdom. At another rally, there was an accident reenactment, complete with actual first responders and their gear. I was so impressed I got a new ¾ helmet and some Kevlar ‘Defender’ jeans made by Diamond Gusset. Both are extremely comfortable and make me a bit more at ease when thinking about a blacktop slide at 60 mph. While researching this article, I was reminded that May is Motorcycle Safety Month. It is also: National Bike Month Healthy Vision Month Better Hearing Month Mental Health Month They all seem to go together. The only way to practice is perfectly. There are abundant videos and learning material on the internet that will help. One of the most effective ways is to take an intermediate or advanced riding course where feedback is immediate and given by trained and certified instructors while you’re riding your own bike. I am particularly impressed with a program in North Carolina that is FREE, and not only to NC residents. Here’s an excerpt from their webpage at http://www.bikesafenc.com “BikeSafe-NC and the NC State Highway Patrol invite motorcyclists to participate in Rider Skills Days that offer assessment on present driving skills and advice to help make their experience as a motorcyclist safer and more enjoyable. As well as professional riding techniques, topics covered include the system of motorcycle control, collision causation factors and security. The Rider Skills Days are run during the week and at weekends, by highly qualified police motorcyclists passing on their wealth of knowledge and experience in a friendly and informal manner. Held at various location around the state, the pre-booked days include both classroom-based advice and on-road ride-outs.” ....continued on page 20

You Never Know ....continued from page 19 With safety on my mind and a riding course in my sights, I found an excuse to put some more miles on my bike, this time without the heavy load. Living in Savannah, it was a great change of scenery complete with curves and hills to travel some backroads to attend a First Aid/CPR/AED class put on by the GWRRA in Winder, GA. I was very pleased with the road manners of my ‘light cruiser’, as I’m calling it now. Here’s where a ‘you never know’ comes in. Riding a lightly-traveled road not far from Midville, I came across a wood fire advancing toward a residence. Not seeing anyone tending the rather extensive fire, I turned around and headed up the driveway to notify the resident. This was in rural Georgia, where riding up to a secluded house in the country can be hazardous to a biker’s health. Not seeing anyone, I put my kickstand down and prepared to go knock on the door. Before I could get off my bike, a man with a shotgun appeared. After telling him why I was there, Steve Bunn, a farmer/forest service worker relaxed, put away his gun, and began to tell me about his uncle, the biker. His uncle had been a WWII Canadian fighter pilot before returning and becoming a motorcycle racer. One day he was doing some highway racing and took a curve too fast, ended up in a ditch with a severely mangled and broken leg and other injuries. After lying there for two hours, an ambulance came and went speeding to the hospital. It collided with another vehicle and he went flying through the windshield. He survived, but he remembered being told once that a fellow should be sure he dies right, because if he dies wrong, he can’t come back for a ‘do-over’. He thought about how carelessly we live, knowing that death lurks around every corner and in every shadow. He thought that death had caught up with him and he would die wrong, without God and hope. Allan McHardy became a chaplain traveling the country and spreading God’s message to other bikers. He was an inspiration to many of today’s CMAs. Like my readers know after reading one of my novels, “Ride as if you’re invisible to others (except the law) and be prepared with an escape plan”. Think: “What if…?” and “you never know what may happen”. Hedge your bets with practice and knowledge. Most importantly, enjoy your rides— defensively.

Kyle Wyman wins 78th running of the Daytona 200 MotoAmerica AMA Superbike rider scores first career Daytona 200 victory in dramatic fashion. PICKERINGTON, OHIO -Association congratulates rider Kyle Wyman on winning the 78th edition of the Daytona 200. The Walworth, N.Y., resident and MotoAmerica AMA Superbike Class competitor rode a Yamaha YZF-R6 to his first career Daytona 200 victory. The event took place Saturday on the 3.51-mile road course at Daytona International Speedway in Daytona Beach, Fla. The American Sportbike Racing Association event is also sanctioned by the AMA. “Kyle Wyman put in a strong performance in the 2019 Daytona 200, and the AMA congratulates Kyle on his accomplishment,” AMA Track Racing Manager Ken Saillant said. “This year’s Daytona 200 featured great road racing at one of the most iconic race tracks in the world. Our sanctioning partner, ASRA, did a great job operating the event.”
Wyman credited the red flag period that occurred on Lap 53 with giving him the opportunity to take the win. He worked his way to the front of the field after the restart on Lap 54. “To win it like this, Daytona, in a four-lap sprint race, it’s just unreal,” he said. “I’m speechless -- what a race.”

story by Richard St. Peter It was starting to get chilly, the sun had begun to set. Time to take a break, stretch the back on the road. As the 45 slowed down people stopped and stared. Two big fellows walked up smiling, they looked like they were still in high school. One acting like an idiot as the rider put her kickstand down. Comments “Ain’t that a big bike for a little lady?” Hazel thought, how original this guy is. How many times have I heard this in the past years? You couldn’t blame them though, Hazel wasn’t your run of the mill motorcycle rider. A full 5’ 5” at 105 pounds, shoulder length red hair with green eyes. At her age she was a seasoned rider. starting her sixth year of riding. She had met a lot of people and seen a lot of places.
“Get off my motorcycle NOW!” It came out with such force the idiot was off before she was finished. A few years ago a big guy did the same thing to her old Scout starting it up, and then in an amazing attempt at riding he went through a picket fence. It stranded her in Provincetown three days. That idiot paid for the repair, it still cost 3 days pay and the cost of the motel.
“No thank you. I just want to stretch and get back on the road.” With him off of her bike her mood returned to the perfect day she was experiencing. Reaching in her bags reminded her of her trip to Provincetown again. She had cut the lining in her jacket and put some clothes in there.
“I’m sorry. I didn’t mean to get you mad.” The idiot was blushing now that everybody was looking at him. “My name’s Bill, can I but you dinner?”
Dressed and back on the road, Hazel thought about her trip to D.C. No short weekend trip from Rhode Island. Next trip I’m going to Florida, maybe some Motor Maids will go with me.
Bill reminded Hazel of her brother who had just gone to Europe six months ago. This Bill would probably go, too. The war was going strong. With two brothers fighting she wondered if her two younger brothers would have to go.
Then the idiot did something she didn’t like! He threw his leg over the 45. “Want me to show you how to ride this motorcycle pretty lady?”

The two lane Connecticut highway had just been paved making the last hundred or so miles perfect.
Hazel needed this freedom. The world had gone crazy with war and futures were uncertain. But, on her bike, everything was alright. Just then, a car pulled into her lane forcing her to squeeze between a box truck in the second lane and the car. They passed the car together but she couldn’t steer. Reaching up with her left leg she kicked the truck pushing her bike away. The bike slid across the highway. As it hit the curb it sent rider and motorcycle end over end. Hazel felt pain, people were talking, then she saw stars.
“Totaled! It’s bent in five directions.” John told her. The doctor said their time was up. He then sat down to explain her injuries. “You broke three toes, you have a bad cut on your hip the size of a six inch J, and you have eighteen stitches on a cut from your forehead to your cheek. Hazel immediately grabbed the bandage. Reading her mind he said, “The surgeon did a great job and nobody will even see a scar in a year.”
Feeling better, she asked, “You didn’t cut off my new boots, did you???” Looking at her sideways he said, “We had to! You won’t be needing them anymore. Consider this a warning to stop riding.” “Stop riding!” She exclaimed. “Don’t tell me how to live.” “Take it easy. You also have a concussion. Lets try to get along. You are going to be here for a while.”
“What’s that smell? Oh, my head hurts. Where am I?” As Hazel became conscious she realized she was in the hospital. Don’t move. We’re lucky you’re still with us young lady.” A doctor was holding her shoulders lightly so she wouldn’t move and cause more injury. “ There’s some friends here who will be glad to see you...but only for a few minutes.” Linda came walking in, her eyes were red and she was shaking a little. “You scared the hell out of us! John wants to see you. He’s been here 10 hours.” John came in. “How’s my bike?” Helen asked without even knowing her own injuries.

The weeks went by and Hazel had improved. The insurance was paying all her doctor bills and for her bike. The shop had a nice 61 she just didn’t like it being called a Knuckle Head. “Well young lady, how does it feel to be going home?” The doctor had learned to avoid crossing Hazel. Linda showed up to bring her home. “Do you want to stop and get your bike?” “Of course!” she couldn’t wait to get back on the bike! After getting her bike they went home to Hazel and Linda’s house. In the house Hazel starts packing. “Where are you going?” says Linda. “Florida. The doctor said to relax a couple of weeks. Just following the doctors orders. Want to go?” Without hesitation, ”Sure.” Linda was always game.

I grew up with riding stories of the Maids and have many pictures from the beginning. The part that amazes me is how young they were, my mom was 20 in 1940. Mom taught me how to start my first panhead when I was 16 in 1970.”

I was at work. I’m learning the new routine. New job came with different ways of going about things than what I’m used to. So, I’ve been kinda stressed about it. Plus, I was stressed about the family ride and a bunch of other things that’s kept my mind stirring. It was getting harder and harder to relax. I kept feeling like I was being tugged in many directions. I was starting to feel overwhelmed. I was getting frustrated a lot and feeling beat down when I would take a minute to breath. Colleen could tell I was irritated, frustrated and things where deeply getting out of my control. She, being the good wife she is, was trying to help me, but I was just blind to it. My brothers at the club could read it on my face one night at church. I couldn’t control it.

Have you seen it? Can you feel its presence? POLLEN!!!! Nothing like cruisin’ the backroads on your bike and feeling spring’s evil buddy sucker punch you in the face. You can feel it in your eyes and the sweet burn, and there is no better hair gel then a 60mph sneeze with a open face helmet!!! It’s like you can see the goo coming back at you as soon as you sneeze. And oh man, there’s nothing more attractive then when you stop at a red light and and your nose looks like drool from a bulldog’s mouth as you turn to look at the car next to you.....nice. I was going to let this slide by ‘cause family life and work life were kinda having me preoccupied. So, getting up and sharing my spill with you guys has been a little hectic. But with this new job comes with it new freedoms. I was about to go to sleep but I needed my fan on and I woke up and plugged it in and thought before I crash out again that I want to share with you something that happened to me. God sent me a message...I know, I got a few friends up here that will roll their eyes to this post. But you can either read it or turn the page. I feel this was a message from God and no one will change my mind.

Anyway, I was at work and I went to grab a bit of water to drink. I decided to stop at the bathroom, as well. On the way into the rest room I saw a fellow washing his hands. He asked how my night was going. I told him I was looking forward to getting off work and stuff. I just figured he could answer a question that I was pondering about our insurance so, I asked my question. That’s when he told me he was a temp and he doesn’t have insurance yet. I asked, how long he had been there and he answered it’s been a year. I felt sorry for him and kinda irritated with the company. He has shown me a lot about the things going on out there and was really knowledgeable about the operations. I felt he deserved better and I told him he did. He could see that I was concerned. (God’s message) This gentleman. A 6 ft. 4 inches tall black man. Looked me in the eyes and told me that he felt no grief. That God has led him here and that God has blessed him with a job. That a little more then a year ago. He was living on the streets. He had no work. No real way to eat. He was down and he started looking to God. He said he just followed the feeling he was getting in his heart and now he’s got a home. He has food. He has a job he can come to. He said, “I’m blessed.” He said that with a smile and a very positive attitude. And just before he walked out of the room he lifted his shirt and he said you need to live like this. The shirt under his overshirt read...(God loves you / Stay humble).

Tears filled my eyes. ‘Cause although I say, at times, be humble, I’ve not really been “humble”. I’ve been fighting so hard a battle for so long to do better for my family. Fighting to give my family everything they need and I’ve been beating myself up with worry and stress and I have not stopped to be grateful for the gifts I do have. I have beautiful children. I have a beautiful loving wife who works endlessly to keep our babies taken care of. We have a home and food on our plates. I got people around me who want nothing but good for me and my family.

I, too, am blessed. I understand. I feel that God reached out to me. I am humbled. I don’t know if this will help someone else. But I sure feel it was God sending me a message. I am listening. I know I kinda got off of the bike lifestyle a bit for a minute but I felt this was important. I know not everyone has the same faith I have. But also with these new times I feel we have lost a few things like the freedom to say what you feel without having to deal with someone who doesn’t agree with you and making it a personal offensive situation. Can we just simply agree to disagree? I have my faith in God. If you don’t agree with it It’s okay. It’s does not hurt you in any kind of way. But guess what? I’ll pray for you. See...ain’t that nice? Anyways, I felt that God had a message for me and I feel that it’s not just a message only for me but for someone reading this, as well. So, to whomever feels it, Bless you! Y’all be safe out there!

We Say Good Bye
JB Smith I remember meeting J.B. years ago when I worked for FedEx in Roanoke Rapids. I would sometimes see him at Collier HD on my lunch break. He could do a burn out better than anyone I have ever seen before. There is a video of him doing one on Hwy 158 on our Facebook page. For those of you who know the layout of the mall there...I was at the FedEx dropbox one afternoon. J.B. did a burnout from the mall parking lot, across the mall entrance, all the way into the parking lot of the nearby groc. store...over 100 yards! J.B. and his wife, Shirley came to visit me while I was at Duke when I had cancer. I will never forget that. There is no doubt that J.B. loved motorcycles but he loved his friends, too... and his family more. Yep, J.B. Smith was A true legend in the motorcycle community and a dear friend to all who knew him. He always greeted everyone with a smile. He will be missed by so many. Please keep his his wife, Shirley, and his family in your prayers. Godspeed to you, J.B. I am sure you are doing burnouts in Heaven already! November 17, 1935 February 15, 2019

John Beaird “J.B.” Smith 83, of Roanoke Rapids, died Friday February 15, 2019 at home surrounded by his loving family. “J.B.” a native of Halifax County was the son of the late Joe Billy and Cinderella Wood Smith. He was also preceded in death by his brothers, Acey Smith, Lynn Smith, Mack Ray Smith, and an infant brother James Herbert Smith. He served his Country in the National Guard and United States Army Reserves. He was the Owner/Operator of J.B. Smith Trucking for 40 years until his retirement. After retirement he worked part time with MJ Price Construction for several years. He was a member of New Testament Christian Church. He had a love for dirt track racing and drag strip racing with his motorcycle his entire life. His most favorite past time was being surrounded by his family and friends. He is survived by his wife, Shirley Harrison Smith; his daughter, Chris Moseley and her husband, Kevin of Roanoke Rapids; his grandchildren Cole Bullock and Cameron Moseley; his sisters, Josephine Myrick and Virginia Johnston and a sister in law Pauline Smith, all of Littleton. He is also survived by many nieces and nephews.

Courts Rule Sturgis Trademarks Are Not Ow STURGIS, SD Who owns the rights to “Sturgis”? After more than a decade of battling, there is finally a firm answer to this question—we all own it because it is in the public domain. This means that any business planning to use the words “Sturgis,” “Sturgis Rally & Races” or “Sturgis Motorcycle Rally” may do so without any fear of getting themselves into legal hot water. The ruling by the US Eighth Circuit Court of Appeals has brought major vindication to Rushmore Photo & Gifts (RPG) and the Niemann family who have been fighting hard to defend this stance against Sturgis Motorcycle Rally, Inc. (SMRI). Rushmore Photo & Gifts, Inc., owned by the Niemanns, had long produced souvenir items containing the words “Sturgis,” “Sturgis Rally & Races” and “Sturgis Motorcycle Rally.” They had always known these terms were public domain, and they never strayed from that belief, even after SMRI registered the mark “Sturgis” (long after it had been used by others in public domain), began a licensing program for its use and slapped RPG with a trademark infringement lawsuit.
The poster right is an example of the word “Sturgis” being used in the public domain to promote the rally more than two decades prior to the attempted trademark claim. At the time this poster was produced and distributed, the City of Sturgis was actively trying to keep bikers out of town.
According to a press release issued by RPG April 3, 2019, “Until the Niemann’s and Rushmore Photo & Gifts prevailed at the Eighth Circuit, a South Dakota district court had in place a permanent injunction on the use of [Sturgis] marks, which ultimately represented hundreds of thousands of dollars in lost business for Rushmore Photo & Gifts and its owners.”

On November 2, 2018, the appellate court ruled that SMRI, in fact, did not own or have valid trademark rights to “Sturgis,” “Sturgis Rally & Races” or “Sturgis Motorcycle Rally.” The summary stated, “SMRI and its witnesses were … not credible as a matter of law when they told the jury that it and its predecessors-in-interest had been the substantially exclusive users of the word.” It went on to state, “…a trademark owner cannot establish that its mark is valid simply by getting its officials and agents to say that it is.” The later ruling on February 14, 2019 from Judge Jeffrey Viken in the US District Court, District of South Dakota, Western Division stated: “The record does not support a finding that SMRI owns, produces, or operates the rally, or does anything else that might allow it to acquire ownership over the rally itself or its intellectual property. The record indicates to the contrary that the rally is a pluralistic endeavor.”

Since its inception, private area businesses throwing events such as races, concerts and rides have made, and continue to make, the Sturgis Rally what it is today.
For the first time in more than a decade, RPG and other businesses will be able to produce goods in 2019 using the now defunct Sturgis trademark. RPG may have been the ones to bring and stick with the lawsuit, but they won’t be the only ones reaping the rewards of their time spent in court.
Despite the appellate court’s ruling, SMRI has continued to claim ownership over the marks and operate its “Sturgis” licensing program. The U.S. District Court for the District of South Dakota, Western Division, issued an order in February 2019 that reaffirmed that:
As Judge Viken stated in his February 14, 2019 ruling, “The terms STURGIS, STURGIS RALLY & RACES, and STURGIS MOTORCYCLE RALLY when used by the defendants, or by anyone else for that matter, do not infringe on SMRI’s marks.”

Anyone who asked to “take it for a spin”, I’d shut the machine down, step back and say, “If you can start it, you can take it for a ride.” Most times I’d just sit back and watch as that 441 kicked them like a mule. I knew only a biker could start that machine, took me a while; I remember, in the shop when I bought it brand new the big bearded mechanic showed me what to do and then stood there smiling for a half-an hour while the bike schooled me. © Marc D. the good news! MAY is Motorcycle Awareness Month The month of May is ”Motorcycle Awareness Month.” By getting the word out in a message “to be watchful of motorcycles” on the roads. During the winter months it is vary rare to see alot of motorcycles on the road. I remember a story my Mom told me about a time she was riding in the passenger seat of of my grandpa’s car. She said her dad asked her if any cars were coming from her direction at an intersection they were stopped at. She answered, no. There were no cars coming, so my grandpa pulled out in front of a TRUCK! And he almost got t-boned! He asked her, “I thought you said there were no cars coming!” She answered, “you only asked about cars you didn’t say anything about trucks. lol. At intersections as drivers and passengers we need to be focused on recognizing what to be looking out for. We also need to be watchful of any signs of a possible event, so as uneventful mishap travel to our destination. Having insight (discernment) to the events happening around us as Christians comes from an abiding relationship with Jesus Christ as our Lord and Savior. Through the Holy Spirit’s as comforter in John 14:26 Jesus says “But the comforter, which is the Holy Ghost, whom

the Father will send in My name, He shall teach you all things, and bring all things to your remembrance, whatsoever I have said unto you.” Be watchful, recognize the growth of more traffic and MOTORCYCLES on the roads as Spring sprouts into warmer weather. Remember to look for oncoming cars , trucks, MOTORCYCLES, scooters, and bicycles and people. One more thing, whatever you do wherever go, and whatever you think, “Think on these things”... “Be watchful and remember Jesus is coming back, and be ready to see Him at the intersection of the four corners of this world. You’ll recognize Him, because you will be like Him! You’ll see Him as He is in Glory with All His Holy Angels and say, “Come ye blessed of My Father, inherit the Kingdom prepared for you from the foundation of the world!” Now let’s ride for Christ and bless God by diying to self just like Jesus.
