hile today’s recession is devastating to America’s poor and working people, it is also an opportunity. As presidential aide Rahm Emmanuel famously said, “A crisis is a terrible thing to waste.” Now is the time to fight for systemic solutions that meet our most urgent needs and reflect our most fundamental val-

ues. CHAM Deliverance Ministry and the Affordable Housing Network, in San Jose, California, have launched a “Letters to Obama” campaign to urge the President to take bold action to solve America’s historic housing problem. Real economic recovery begins with providing for the least of our brothers and sisters. The stimulus plan recently signed by President Obama provides some welcome emergency shelter and homelessness prevention assistance. However, it fails to address America’s larger housing problem. It provides little if any support for new public housing,

funding for the National Affordable Housing Trust Fund, or new Section 8 vouchers. The $1 billion for the Trust Fund initially proposed is still far short of the need, and even of the original projections by Trust Fund proponents. In addition, the President’s anti-foreclosure plan leaves many details yet to be worked out, and may have limited applicability in Santa Clara County because so many local loans exceed Freddie Mac guidelines. Some people are hesitant to make demands on Obama. This is because many feel that people on all sides are already besieging Obama. But the President himself has repeatedly called on us to fight for what we need. Over and over during his campaign, he told us that change is not about what he or anyone else does in Washington, but rather what we do to organize the people in our communities. Furthermore, the more active, well-organized, and demanding we are, the better Obama will be able to defeat the obstructionists who are determined to make him fail. Pow-

Just last week, America’s bankers pressured Obama to give them a trillion-dollar investment guarantee. If we fail to speak out for what we need now, before the nation’s treasury is completely looted by corporate thieves, both Obama and our hopes for a better America will go down in defeat. The Presiding Judge, after the fact, said that all involved are re-writing their protocols to prevent this from ever happening again. The challenge of having different service groups coordinating their actions does not seem to have been met in this case. A phone call to the offices of Supervisor David Cortese and George Shirakawa, Jr. reveals that both reacted to knowledge about this case by asking for a report about this unique happening. Does anyone really think that what actually happened will be reported accurately? Not when we consider that several individuals from different service agencies were involved. How does one document the lack of using common sense and good judgement in this case? Did existing protocols give staff guidelines on what to do in a case such as this one? Regardless, the report will be feared because it will reveal that someone made a very poor decision or used very poor judgement which any investigation may document after the fact. The community is both very

amazed and very concerned. How could something like this happen to three children who are in the protective custody of a local government agency? My suggestion is that several letters to the Presiding Judge need to be sent. The subject needs to be this case. The recommendation needs to be that this case needs to be fully examined by the Civil Grand Jury as soon as possible, before those who made the decision can write new protocols to protect their backsides. The Civil Grand Jury is the correct group to do this full investigation because it has the power to subpoena those involved and may receive/examine privileged and confidential information. All others have a conflict of interest. Consider that perspective when asking for a full investigation by the Civil Grand Jury. This case is about three kids who ended up being abused by the existing system. Let’s see if improvements can be made. The story of those three kids (a brother and two sisters, I’m told) was like reading one of Aesop’s fables. Three foster kids were placed under the protection of the foster care program only to end up in Juvenile Hall where they stayed ƒor five days. Their ages are 10, 11, and 12, yet some public servant made a decision that it was all right to place three related Latino siblings into Juvenile Hall. The lower age limit of those detained in Juvenile Hall is 12, so what are the 10, 11, and 12 year olds doing there? And there they stayed for five days without the benefit of a court order or having committed a crime of some sort. It was only after this improper incarceration of three siblings was rediscovered that a criminal base was divulged. Who was involved? Well there is the County Executive’s Office who is responsible for the administration of Juvenile Hall after a decision by the voters a few years ago. Juvenile Hall is operated and supervised by staff under the direct guidance of the Probation Department. These three foster kids were to be under the protective custody of the Family and Children’s Protective Serv-

fter a trillion tax-dollar bailout for Wall Street, our economy is still in the toilet, plugged up with toxic paper worth a fraction of what workers saved from earnings for a home, a child’s college education, or a comfortable retirement. The joke about how everyone’s 401(k) retirement fund is now a 201(k) is no joke as most investments have lost half their value since 2008. The home purchase will have to wait, the college student must settle for trade school and a lifetime of low wages, and the retirement plan becomes a “work til you’re dead and hope it happens before uninsured long-term care is required.” But not to worry: Treasury Secretary Geithner is planning a second trillion dollar giveaway, but this time with a string attached: a request the largess be lent out rather than used for buying other banks or paying off old debt to foreign banks. Yes, that is what Wall Street did with our first trillion, they went on bank shopping sprees, paid billions in bonus gifts to themselves, and reduced their own corporate debt. The public outrage over the bonus payments was met with consternation by President Obama, Geithner, and Congress. However, as the president’s economists stated, “The bonuses are binding contracts, we are a nation of laws, so we cannot tell Wall Street what to do (with our money).” Yet days later, everyone in the Washington DC Beltway stated with equal consternation, “Those autoworker union contracts must to be set aside if the industry is to be granted any multibillion dollar loan.” Are these two statements spoken by the same individuals contradictory? Or is there a logic that escapes us outside the beltway? George Orwell stated it richly simple in his Animal Farm satire, “All pigs are equal, but some pigs are more equal than others!” Similarly, all contracts must be honored in a nation of laws, but some contracts can be shredded when they apply to wage workers rather than billionaires. Wall Street and the Washington Beltway are connected in an insidious manner, where they see eye-to-eye, feel each other’s pain, think with the same mind: “Above all, we must protect our financial system!” But what is this “great system” that must be protected, sustained, if it has broken down so often and has thrown 10 million out of work, 2.5 million homes into foreclosure, fails to provide health insurance for 45 million? The system is called Free Market Capitalism, which means: barely regulated robber baron capitalism. The wealthy ruling class designed the economic system to benefit their ownership class, and now that the system has failed even them, they will determine how to fix the meltdown. It is high time that American workers woke up to the reality many already suspect: Our socalled Democracy is in reality a Pluto-Oligarchy, defined as government by the wealthy fewwhere an elite class of families with great wealth are interconnected to control every aspect of the society. The children of the powerful are prepared, conditioned and mentored to inherit all the important levers of the nation to continue their “rightful elite rule.” This explains why George Bush, Jr. became president. But this time, the oligarchs at the casino called Wall Street drove the financial system into meltdown, and the Congress and President, in panic, bail out billionaires to whom they are beholden for their election. The claim that the financial system is so complicated that only Wall Street CEOs can fix the system is but an ever more sophisticated manipulation by the oligarchs. How can we set our financial system in order without putting another trillion into the banks? Put that trillion into wages by employing everyone, including the 10 million who just lost their jobs. Workers pay taxes and consume goods, taxed once again-this is economic stimulus! There is so much valuable work that must be done to rebuild America: our cities are all in decay, we need flood control, road repair, high speed rail, schools for the 21st century, health care for everyone. No American family should be homeless, so home foreclosures must be transformed into housing opportunities for working families. At the end of World War II President Roosevelt realized that a devastated Europe would once again be fertile ground for fascism, so he initiated the Marshall Plan to rebuild Europe, and it worked. Today our own nation needs an American Marshall Plan. There is so much work to be done that every man and woman who can work, who wants to work, who needs a job can join in the most worthy goal of our generation: to rebuild America! We must all shout: NO MORE BAILOUTS for BILLIONAIRES! Bail out the American worker with a job, a home, health care and education! Δ

t a press conference held at the Marriott Hotel on Friday, March 20, officials for the National Association of Latino Arts & Culture announced their 2010 conference was being held in San Jose. Distinguished local philanthropists, Alcario and Carmen Castellano of the Castellano Family Foundation, Saratoga, will be one of the sponsoring organizations, in accord to their interest in the preservation and practice of Latino arts and culture. This year’s NALAC conference will draw participants from California and throughout the U.S. and Latin America. A coalition of established San Jose organizations will serve as hosts. The San Jose NALAC Conference Host Committee includes MACLA-Movimiento de Arte y Cultura Latino-Americana, 1stAct Silicon Valley, Teatro Vision and the Hispanic Foundation of Silicon Valley (Teresa Alvarado, Director). Un tribunal estatal autorizó este aviso. No es un anuncio publicitario. No es una acción legal en su contra, y usted no está siendo demandado. Independientemente de que inicie alguna acción, sus derechos legales se verán afectados. El 23 de septiembre de 2005, la demandante Emma Meneses presentó una demanda colectiva en el Tribunal Superior del condado de Orange, caso N.º 05CC00212, en contra de los demandados Simply Right y Century Theatres (la “demanda Meneses”). El 23 de septiembre de 2005, el demandante Andrés Navarrete presentó una demanda colectiva relacionada en el Tribunal Superior del condado de Orange, caso N.º 05CC00211, en contra de los demandados Simply Right y Edwards Theatres (la “demanda Navarrete”). Las primeras demandas colectivas enmendadas (alegatos vigentes) en la demanda Meneses y en la demanda Navarrete (en conjunto, las “Demandas”) sostuvieron las causas de acción por: (1) salarios mínimos no pagados, (2) salarios no pagados, (3) compensación por horas extraordinarias no pagada, (4) incumplimiento para proporcionar períodos de descanso y de comidas, (5) incumplimiento para proporcionar recibos de pago detallados, y (6) competencia desleal en contravención a las disposiciones de la sección 17200 y siguientes del Código de Negocios y Profesiones. Community Hopes to End Negative Cycle By Osvaldo Castillo- El Observador ife has not been easy for Priscilla Camacho, who is from East San Jose. She joined a gang at the age of 14, sold drugs to pay bills and became addicted to crystal methane. “I never got to be kid,” Camacho said. She was told by her teachers that she was a piece of garbage and will never get anywhere in life. “One of them told me that he didn’t care if I completed my homework because he was going to be getting paid anyway.” Camacho was one of several community members who attended a community meeting on Friday, April 3rd, to ask elected officials to take action to stop East Side Union High Schools’ dropout and crime crisis, and economic decline. The elected officials were East Side Union High School District Trustees Manuel Herrera and Eddie Garcia, and Santa Clara County Supervisor Dave Cortese. The community asked the officials to make an effort to reduce the drop out rate in East San Jose high schools by ten percent each year and approve funds to provide one additional mental health worker for each high school in the district. “In East San Jose, 1,311 students dropped out of high school last year,” reported community member Amelida Castillo. “That is enough to fill an entire school. The students need counselors to guide them through the difficult times in their lives.” According to People Acting in Community Together

(PACT), San Jose lost $34 million in funds due to students who drop out of high school and end up living a life of crime. Each dropout costs society itself $2.1 million throughout his or her lifetime. The community also asked the officials to support charter schools as an alternative to low-performing large schools in the district. However, East Side Trustee Eddie Garcia said that though charter schools perform better than other schools in the district, they are not the answer to solving the drop out crisis in the district. “Charter schools are small,” Garcia said. “We need to find ways to meet the needs of 26,000 students.” As for Priscilla Camacho, she is currently attending Apollo High School and plans on attending college to become an electrician. She also plans on going back to visit the teachers that told her she would not succeed in life. “I want to show them that I succeeded against all odds,” Camacho said. The People Acting in Community Together organization is a multi-ethnic, inter-faith grassroots organization that empowers everyday people to create a more just community. Ella parada en la acera se encontraba hablando por su celular y un policía le iluminó los zapatos, le pidió licencia de conducir y le dijo que la arrestaba. Entonces ella preguntó ¿Por qué me arresta?, el oficial de razgos asiáticos la esposó y la metió a la patrulla. Resendéz recibió una citación para la corte. El cargo que enfrentaba era obstrucción al trabajo policial, luego de 7 cortes se bajó la condena a “desorden público” y Resendez tenía que cumplir con 52 horas de servicio comunitario. El 27 de febrero de 2009 el Departamento de Servicio Social notificó a su empleador que tiene historial criminal y por esa razón la despidieron del Comedor de ancianos al cual ella trabajaba como cocinera. “No solo tengo un cargo de criminal sino que perdí mi empleo por haber estado cerca a un retén policial. ¿Nos protege la policía? ¿A quién tengo que acudir si las personas que creemos no nos van ayudar?. Este problema ha afectado a la familia Reséndez. Aarón, esposo de Lucy está enfrentando una dura situación y ahora está encargado de mantener a su familia. “Necesitamos sacar el jefe de la policía. Mi esposa no es una criminal y mi familia no merece esto”, dijo a EO.

“Llamé al 911 y me arrestaron” El jueves 2 de agosto Carlos (Nombre no disponible porque el caso está en proceso) accidentalmente golpeó otro auto en la avenida Sender en San José y las personas afectadas tuvieron reacciones negativas amenazándole hasta de muerte. El joven intentó arreglar con ellos el incidente pero fue envano. Ante estas circunstancias tuvo que retirarse y de inmediato llamó al 911. Cuando llegó a la casa la policía lo esposó y le metió a la patrulla sin preguntar los sucedido. El joven recibió cargo de “choque y fuga” y otro por estar “bebido”. “Me tiraron los documentos por no estar ebrio” Juan Mejía salía de las esquinas de Capitol y McKee para tomar la salida a la carretera. La Patrulla siguió a Mejía y lo detuvo. Cuando pidió documentos y luego de no encontrar algo ílicito el policía le tiró los papeles y le dijo “ahora largate”. Información a la prensa latina La policía de San José emitía comunicados de prensa sobre los retenes y El Observador los cubría para saber de primera fuente lo que pasaba en estos operativos. A partir de julio de 2008 los comunicados de prensa se divulgan sin lugar, ocasionando un gran problema a la prensa para cubrirlo. SJPD debe proveer la información bajo estricto orden de embargo.

Mientras el SJPD trata mal a los latinos arrestando a un gran número de ellos por delitos menores el jefe pide por otro lado ayuda de ellos para resolver investigaciones de homicidio.¿Cómo es que pide ayuda a la comunidad cuando muchos de ellos le temen al departamento policial?. En una encuesta hecha por EO 6 hablaron a favoar del SJPD y 45 hicieron comentarios nada favorables. Campos expresa diferencias La Concejal Nora Campos dijo que no iba a permitir otras excusas. Por esta razón ella ha apoyado una revisión independiente. “El alcalde se ha enfocado en crímenes menores mientras que el cuerpo policial está carente de oficiales, obligando a la ciudad a pagar millones en tiempo extra. Por su parte el analista Miguel Chacon dijo que esta clase de arrestos no crea una ciudad segura mientras arrestan a gente inocente. Las personas tienen que pagar consecuencias mayores por delitos menores como el despido en sus centros de trabajo, aunque eso depende del empleador. Aunque no se sabe las condiciones migratorias de otros arrestados, delitos menores pueden hacer que personas no consigan su tarjeta verde o residentes no se hagan ciudadanos o potencialmente pueder perder la elegibilidad para una futura legalización de algún programa federal incluyendo una deportación. El número de casas en proceso de embargo en la ciudad de San José durante el 2008 fue de 14 mil viviendas. Desde Enero de 2009 se ha incrementado a 3,700 el número solicitudes de embargo. hen the San Jose Police Department (SJPD) announced the presence of the Consortium for Police Leadership in Equity, Chief Rob Davis asked, “We need to know how we are doing.” Below are some answers from the community. Some rough public relations issues exist. Examples of rough edges follow: “Fired because of the police” On May 9th 2008, Lucy Resendez was observing the DUI checkpoint at the corner of Story Road and White Road. She was on the sidewalk talking on the phone when a policeman lit her shoes with a flashlight, asked her for her driver’s license, and said she was under arrest. When she asked, “Why are you arresting me?” the officer handcuffed her and put her into a police car. Resendez received a court citation. She was charged with California Penal Code Section 140 for obstructing police work. After seven court dates over 11 months her charge was reduced to Section 415, “Disturbing the Peace” sentenced to 52 hours of community service. Other charges were dropped. On February 2009 the California Department of Social Services sent an alert regarding the “additional criminal history” of Lucy Resendez to her employer, BLC Regency in San Jose. Resendez was fired. “I guess they think I looked like a criminal and now I lost my job because I was walking around a DUI checkpoint. Is the SJPD protecting us? Who can I count on to help me if the people we believe in aren’t going to help?” said Resendez, who has lived in San Jose for 30 years without problems. This problem has affected the Resendez family. Aaron Resendez, Lucy’s husband, is now maintaining his family by himself. Aaron stated: “ We need to throw out the Police Chief. My wife is not a criminal and my family doesn’t deserve this.” “I called 911 for help and the police arrested me instead.” On August 2nd, Carlos (name undisclosed because his case is pending) accidentally hit a car on Senter Road and the people in the other car reacted very negatively and aggressively, threatening him with death. Carlos’ attempts to solve the problem were in vain. Given the circumstances he left and because he was so fearful and feeling threatened he called 911 asking for help. When he arrived at home the police arrested him and put him in a police car without even asking what had happened. He was charged with “Hit and Run” as well as being “Drunk”. “They threw my papers down because I wasn’t drunk” “My friends and I went for dinner. We left a restaurant between Capitol & McKee and we took the exit to the freeway,” said Juan Mejia. “A police car followed me and stopped me. When the policeman asked for my car registration and insurance and didn’t find anything illegal, he threw my papers down and told me ‘Get out of here’.” About informing the Latino Press The SJPD used to distribute press releases for every checkpoint that it conducts. Prior to July 2008. El Observador received information that permitted the assignment of staff to do media coverage. Since July 2008 the content of information has changed and the location of checkpoints is no longer disclosed until 2 hours before checkpoint is activated. SJPD needs to disclose complete information under embargo. The purpose of the media is to disseminate accurate information concerning activities by police and the community related to the DUI/vehicular checkpoints. EO Survey A brief EO survey of 51 individuals at random conducted on the street resulted in the majority saying “I don’t trust the SJPD”. While the SJPD allegedly treats the Latino community poorly, arresting a large number of people for misdemeanors, Chief Davis asks Latinos to help solve homicide investigations. How does Chief Davis expect the help of the Latino community when most Latinos fear the SJPD? Six had good things to say; 45 were not favorable comments. Campos expresses concern District 5 Councilmember Nora Campos also expressed concern. “I’m not going to allow others to excuse the discrepancy as a socioeconomic problem. This is why I have called for independent oversight of Police practices and I expect that process to reveal solutions that will protect the public from wrongful arrests while ensuring the safety of our officers.” Campos added that she is troubled by the policing philosophy held by Mayor Reed that targets minor crimes at a time when the Police Department is dangerously understaffed, forcing the city to pay millions in overtime patrol costs. According to community analyst Miguel Chacon, these types of conduct arrests don’t create a safe city when innocent people are being arrested. People suffer grave consequences when they are fired from their jobs due to questionable misdemeanor convictions. Trust is lost in working with the police on crime detection. Despite the fact that the immigration status of Latino victims is not known, even misdemeanor convictions of noncitizens can lead to denial of a green card or citizenship, potential loss of eligibility for a future federal legalization program, and even deportation. By Osvaldo Castillo crowd of enthusiastic Oakland A’s fans gathered at San Jose’s City Hall to encourage Mayor Chuck Reed and the city council to work hard on bringing the Oakland A’s to San Jose. They wore hats, jerseys, held signs, told stories and read poems about the Oakland A’s and how the team’s move to San Jose would benefit everyone involved.Former San Jose mayor Janet Gray Hayes was one of these fans. “Bring the A’s to San Jose is a great idea because it will create jobs, which will boost our economy,” Hayes said. Mayor Chuck Reed is behind the idea and said he and the city council will do their best to bring the A’s to San Jose. He has made some recommendations, which include building support with local neighborhoods, business and labor. Analyzing opportunities and challenges of developing a stadium at the Park Avenue and Montgomery/Autumn site, and adopting a resolution authorizing the mayor to send a letter to Major League Baseball indicating that San Jose is ready to welcome and work with Major League Baseball. According to the San Jose Redevelopment Agency, the location will use up 14,000 parking spaces that already exist in the location, with room to build more parking. The location will also be near CalTrain, light rail and a soon to be built BART station. But not all San Jose residents are thrilled about the idea of bringing the Oakland A’s to San Jose. One of these residents is Yolanda Reynolds. Reynolds wrote a letter to Mayor Reed and the city council expressing her concerns. One of her concern is how the noise coming from the stadium will affect nearby neighborhood and businesses. Another concern was the traffic impact that the stadium would have on San Jose highways 87,880, 101 and 680. For now, Major League Baseball will make the final decision on whether or not the A’s move to San Jose. “We will be ready if Major League Baseball decides to look at San Jose for a possible home for the A’s,” said Mayor Reed.
