Zazueta Family honored at the Hispanic Charity Ball By Monica Amador El Observador

he 22nd annual Hispanic Charity Ball was held on Saturday, October 8, at the Fairmont Hotel in San Jose. Co-Chairs Camille and Joe Coto welcomed a full house of leaders of corporations, businesses, and community members to another successful signature event. They thanked the Hispanic

Foundation for their ongoing commitment and leadership in raising awareness and helping address the issues affecting the Latino community. Under the visionary leadership of Board Chair Carmen Sigler and President and CEO Ron Gonzales, recognition was given to them for providing leadership in creating a first-ever portrait of Latinos in Silicon Valley through the publication of the “The Silicon Valley

Latino Report Card”. The compelling study was created by an extensive weaving together of data from a variety of sources to measure how Silicon Valley Latinos are faring in the quality of life areas: Education, Health, Financial Stability, Housing and Environmental Sustainability. La Familia Award was presented to Fernando and Cecily Zazueta and their family for their deep-rooted commitment and involvement in the community. Fernando, born in Mexico, came as an infant and grew up as a migrant farm worker child, attended 16 schools and graduated from San Jose State. He became a Naturalized Citizen and served as an officer in the USAF Reserve. He is a personal injury attorney in San José and served on local, state, and national mainstream and Hispanic bar organizations and held numerous seats in the community including Chair of the Mexican Heritage Corporation board. His wife, Cecily worked as a public health nurse and mental health counselor until she retired from Gardner Family Care Corporation. She currently mentors at-risk youth, was past president of the local American Lung Association (Breathe California), member

of the Junior League of San Jose. Their children include Tom Zazueta, CEO of Coakley Heagerty, a Silicon Valley based strategic marketing firm. He is involved with the Silicon Valley Education Foundation as chair of its Advisory Board for Science, Technology, Engineering and Math (STEM), that helps underachieving students gain proficiency in those academic areas. Dr. Antonia Charles, is their daughter who works as a pediatrician to mostly Spanish-speaking population at Valley Medical Center’s East Valley Clinic in San Jose and also serves as a board member for the Valley Medical Center Foundation. The third son is Daniel Zazueta, who works as an attorney in the Office of the General Counsel for the US Dept. of Energy in Washington, D.C. We are vey fortunate to have the Zazueta family as a part of our community and are honored to be able to highlight their dedication and zest for community involvement. We hope that their dedication to civic and community duty will inspire many others to follow in their footsteps and give back to the Hispanic community in Silicon Valley.

ssemblyman Rich Gordon (Menlo Park) alongside County Supervisors Dave Cortese (Santa Clara County) and Adrienne Tissier (San Mateo County) announced the passage of Assembly Bill (AB) 1288. AB 1288 addresses financial abuses with the senior population. At times, seniors find it easy to trust their children or longtime friends to help with their finances, but in the long run they only lose. Some present themselves as financial advisors only to steal the money of their clients. “Financial fraud of dependent adults is one of the most common forms of financial abuse,” said Assemblyman Gordon. “Protecting this vulnerable population is of the utmost importance for providing future care and wellbeing.” AB 1288 closes a loophole in the current probate code by expanding the scope of the Public Guardian to include assets that are held in financial trusts. Additionally, this bill extends

the number of days in which the Public Guardian can take temporary possession of property from 15 to 30 days. The additional 15 days will allow time for Public Guardians to locate and secure assets, as well as obtain a hearing date for the conservatorship petition. The financial abuse of seniors is likely to rise because more and more people are reaching that age. “AB 1288 enhances current safeguards to stop financial predators from taking the house and life savings from vulnerable people who suffer from dementia and are unable to help themselves,” said Lee Pullen, Director of Aging and Adult Services in Santa Clara County. Pullen further explained that financial abuse affects all ethnicities and help is offered in several different languages. AB 1288 was co-sponsored by San Mateo and Santa Clara Counties and supported by counties and local municipalities throughout California. This was reflected in the bill’s unanimous support in the both State Assembly and Senate.

Hay una ley que dice que un viudo/a puede aplicar para la residencia si estaba casado con un ciudadano/a si aplica en menos que 2 anos de la muerte. Antes el viudo tenia que estar casado por 2 anos o mas pero la ley fue cambiado en 2009 y ahora ese requisito fue terminado entonces no importa si estaba casado por mas de 2 anos o menos que 2 años pero el viudo tiene que aplicar en menos de 2 años desde la fecha de muerte. Ahorita hay un periodo de transicion que va a terminar el 28 de octubre de 2011 y esto es lo importante: todos los viudos de ciudadanos pueden aplicar para la residencia si su esposo/a se murio antes del 28 de 2009 y estaban casados por menos que 2 anos No importa cuando. Entonces, si una mujer perdio su marido ciudadano en 1985 y ellos estaban casado por menos que 2 anos cuando el fallecio, esa mujer puede aplicar para la residencia usando el formulario I-360. Pero tiene que aplicar antes del 28 de octubre de 2011.

Despues del 28 de octubre 2011 solo los viudos quien perdieron sus esposos despues del 28 de 2009 pueden aplicar para la residencia y tienen que hacerlo en menos que 2 anos de la muerte. Let’s Use Only Core Values By Hilbert Morales

Hmorales@el-observador.com any of today’s issues have their basis in the lack of trust and integrity in communications used at all levels of business and government. The lack of ‘checks and balances’, which are transparent and evident, assists those who exaggerate the truth and facts pertinent to any issue one wants to examine or discuss. A key skill that more of us need to know is that of asking questions, which expose the truth and facts of the matter. The scientific method of inquiry is used to establish the truth and facts. Many persons have beliefs, which are not necessarily based on facts and truths. What is also required is a bit of common sense coupled with discipline. Often all is for naught because our selfinterest intervenes in ways that undermine ‘good efforts’. Let us not neglect the impact of culture and religious dogma. Democracy is a core value in America as a nation. What this means is that each individual will possess a stakeholder’s interest equal to all the others in the guidance of the community’s governance. This boils down to the concept of one citizen: one vote. Capitalism is another core value of business in America. In fact, capitalism drives most enterprises, which seek and use systems, which maximize profits. These profits are used to reward those who own a stake in the enterprise. Shareholders are stakeholders who are rewarded with dividends, defined as a return on money invested when ownership of the stocks (or shares) involves a risk. For both capitalism and democracy to operate successfully in society certain intangible core values are required. These include honesty, integrity, fair practices and truthful communications. Today many do not believe that these ‘intangible core values’ are practiced by corporations which use advertisements to gain advantage in generating revenues. Money may be defined as the license to perform, produce and consume. Each individual requires enough for the purchase of the essentials such as shelter, food, clothing, education, medical care, civic engagement, and entertainment. Today, the system of governance has been tilted to favor the acquisition of great wealth by the few who already are privileged, well positioned and have advantages.

The challenges being faced by society today are manifold in that individuals can no longer perform or operate in our developed socio-economic climate without a source of reliable funding. In addition, governmental agencies are formed to produce, provide, and maintain infrastructural services which facilitate transportation, delivery of potable water, educational services, protective services, utilities and maintenance of a fairly secure peaceful environment. Taxes, licenses, and fees are the sources of money, which permit various districts, and jurisdictions to pay for the goods and services produced and made available to the public. Today all this is in danger of collapse because a few strategically placed dogmatic individuals insist that they pay no taxes, have very little or no governance, and that their beliefs be imposed on all. This is the basis of the gridlock in the U.S. Congress whose elected officials have been unduly influenced by special interests with too much money donated to campaign funds without any fear of having to be publicly accountable. What is required today is that all these elements of the American society begin to operate with the full use of core values, especially honesty and integrity. Full accountability is a requirement, which enables responsibility. Too many today have just a bit of ‘advantage’, which spoils the ‘level competitive playing field’ needed by all enterprises. For our economy to produce “a greater good for the greatest number , many privileged individuals need to begin practicing the golden rule: “Do unto others as you would have them do unto you with truthfulness, accountability, and integrity. As a consequence of ‘dishonesty’ practiced at all levels of our society and governance, the people are today cynical and non-believers who lack the hope that things will become better. Until all of us are subjected fairly to appropriate levels of “checks and balances which are supported and based on core values, the present state of greed, corruption, and mismanagement will continue. What a shame, because all it takes is for all of us to decide to deal with each other with truthfulness, honesty, and integrity .all these are core values. Let’s get back to ‘core values’ for the sake of all by doing what is difficult but very possible: Re-establish trust, truthfulness, and integrity in all transactions.

Caltrain to Install New Rail Bridge

S

hortly after midnight, Saturday, Oct. 15, Caltrain will remove the railroad bridge that spans Jerrold Avenue in San Francisco and replace it with a modern single-span steel bridge. The “big move” will be accomplished in one night, before train service begins Saturday morning. The only impact to passengers will be at the Bayshore station, where all trains will operate on a single

track and north- and southbound passengers will board from a single platform all weekend. In addition to the new bridge, the project also includes new steel structures and columns to support the bridge, new tracks through the area, new pavement on the street under the bridge and new sidewalks. This week, neighbors will notice work being done to prepare for the move. The crossing gates and lights on

the adjacent freight train tracks will be temporarily removed, support frames will be constructed and the cranes that will be used to move the bridge will be mo-

last until Nov. 5. The closed street is being used to assemble the new bridge and dismantle the old one. The project is necessary because the existing bridge

is more than 100 years old and has reached the end of its useful life.

Governor Brown Signs Multiple Legislation in Support of Latinas

Taking action to expand educational and health opportunities, Governor Brown signed important legislative bills that are valuable in strengthening and advancing the Latina community. A good example is AB 131, authored by Assemblymember Gil Cedillo, which allows top students who are on the path to citizenship to apply for college financial aid. Under current law, undocumented students pay resident tuition rates if they

have graduated from a California high school and affirmed that they are in the process of applying to legalize their immigration status. Effective January 1, 2013, AB 131 will make this limited pool of students eligible to apply for Cal Grants and other State aid. This legislation builds on AB 130, also authored by Assemblymember Cedillo and signed into law by Governor Brown earlier this year, which makes financial aid from private sources available to the same pool of students. The two laws are collectively known as the “California Dream Act.” SB 299, authored by Senator Noreen Evans, prohibits employers from refusing to maintain and pay for insurance cover-

age for the duration of maternity leave for up to four months. The bill also authorizes employers to recover insurance premiums from the employee if the employee fails to return from maternity leave that is not due to a health condition that requires absence from the work environment or for circumstances beyond the control of the employee. Another bill, SB 753, authored by Senator Alex Padilla, requires that the California English Language Development Test (CELDT) be administered annually once 55% of the instructional year is completed. The bill also prohibits a student from retaking portions of the CELDT that measures English language skills that they have

passed. SB 753 will require the California Department of Education (CDE) to report test results to parents. These bills highlight examples of Governor Brown’s commitment to ensuring the support of all communities and the status of women. More importantly, AB 130, AB 131, SB 299, and SB 753 offer Latinas support in their pursuit of higher education and the planning for a family without the worry of losing her employment. Dream Act Now California Law

G

overnor Jerry Brown signed California Dream Act, AB 131, on October 8, 2011. This ‘Dream Act’ will take effect in 2013 when an estimated 5,462 undocumented students can apply for, and be awarded, Cal-Grants and other financial aid (estimated by California Student Aid Commission). Currently, tuition is $12,192 at U.C. campuses; $5,472 at CSU campuses. To be eligible the undocumented student must meet the following conditions: * Sign an affidavit saying he/she is in process of acquiring legal status. * Have attended a California High School for at least 3 years.

* Have maintained a grade point average (GPA) of B if applying to a CSU campus or have a C average if applying to a community college. This controversial AB131 (Cedillo, D-LA) measure, which passed the Democratcontrolled legislature on a party-line vote in September, represents a victory for immigrant-rights activists ahead of the 2012 presidential election. California is the nation’s most populous state. It remains a challenge to pass comprehensive immigration legislation at the federal level, which would have the effect of applying a single standard to the nation. Only two other states, Texas and New Mexico, allow

illegal immigrants to qualify for state financial aid for college, according to the National Conference of State Legislatures. “Going to college is a dream that promises intellectual excitement and creative thinking,” Brown said in a written statement issued by the California Governor’s office. “The Dream Act benefits us all by giving top students a chance to improve their lives and the lives of all of us,” he said. Brown in July fulfilled a campaign promise by signing into law a companion bill to allow illegal immigrants to receive privately funded college scholarships. Together the two bills have been dubbed

the “California Dream Act.” Under these new laws those same undocumented immigrant students would be eligible for aid from the Uni-

versity of California, California State university system and the state’s 112 community colleges. They could also apply for Cal Grants, which

are cash awards based on academic performance.

irst graders, also known as the Golden Bears, recited their creed and performed a special dance to dozens of people that attended a ribbon-cutting event for Rocketship Education. Rocketship Education, a nationally known model is the leading charter school network, combines traditional classroom learning with online technology and tutors. Vice Mayor Madison Nguyen was on campus and talked about the importance

of education regardless of where a student is born, especially if born impoverished. She believes that’s just something people are born into and all that matters is how they follow through with education. Rocketship will do just that for hundreds of students, it will help them have a better chance of graduating high school and persuing college. It is a free public school with open enrollment and their budget is equivalent to public school funding. Currently there are 428 students enrolled, 90% qualify for free/reduced meals and 75% of the students are Eng-

lish language learners. 40% of Latino student aren’t at performing levels. Classes are named after the Universities their teachers last graduated from, making it easier to encourage them to stay in school. Parents are also being encouraged to take special leadership workshops that cater to their needs. Some of the parents present want to make a difference in their community and are encouraged to do so. The school is also part of the city’s plan to eliminate the achievement gap by 2020. It is a collaborate effort that is too important to leave to teachers.

he San Jose Fire Department is participating in a TV show pilot called “Plates on Fire,” produced by a Los Angeles-based production company. Alum Rock’s Fire Station 2, is where the pilot was recently filmed. Two teams of offduty San Jose firefighters, Robert Herrera and Mike Tapia versus Joel Phelan and Mario Cuestas, will compete in front of celebrity judges. All the firefighters have experience cooking, some have worked in restaurants in New York, Los Angeles and in San Francisco. “I am excited to have the opportunity to showcase the connection between our community and the Alum Rock Station firefighters who together will shine a very positive light on the City organization,” said Fire Chief William McDonald. The show is based on a popular Food Network show called “Chopped” but with a few twists and turns. Like in Chopped, but slightly different, the teams will be given a

basket with mystery ingredients to prepare three meals, breakfast, lunch, and dinner. Celebrity judges Vincent Pastore from “The Sopranos”, actor Stephen Baldwin and Bay Area award-winning food and wine writer, Carolyn Jung, will judge the final dishes. The pilot will also spotlight the variety of emergency and non-emergency services that the Fire Department provides to the community. The winning team will be awarded a donation to the charity of their choice. One team will donate the money to the Susan G. Komen for the Cure while the other team will donate it to the Brain Tumor Research Center at UCSF. The competitive cooking show, developed by retired Santa Clara County Fire Captain Joe Viramontez, is staged in active fire stations where firefighters demonstrate their cooking skills. Viramontez is the host of “Plates on Fire” and has been a San José resident for more than 40 years. The pilot is the first of what may become a full-blown series if a television network picks up “Plates on Fire.”

After completing graduate school, Jose worked at the Lawrence Livermore National Laboratory, where he helped develop the first full-field digital mammography imaging system. Jose then went to work for NASA at the Johnson Space Center in Houston, where, in 2004, he was accepted into the astronaut training program. Read the Patient Information that comes with DIOVAN before you take it and each time you get a refill. There may be new information. This leaflet does not take the place of talking with your doctor about your medical condition or treatment. If you have any questions about DIOVAN, ask your doctor or pharmacist. What is the most important information I should know about DIOVAN? Taking DIOVAN during pregnancy can cause injury and even death to your unborn baby. If you get pregnant, stop taking DIOVAN and call your doctor right away. Talk to your doctor about other ways to lower your blood pressure if you plan to become pregnant. What is DIOVAN? DIOVAN is a prescription medicine called an angiotensin receptor blocker (ARB). It is used in adults to: U lower high blood pressure (hypertension) in adults and children, 6 to 16 years of age. U treat heart failure in adults. In these patients, DIOVAN may lower the need for hospitalization that happens from heart failure. U improve the chance of living longer after a heart attack (myocardial infarction) in adults. DIOVAN is not for children under 6 years of age or children with certain kidney problems. High Blood Pressure (Hypertension). Blood pressure is the force in your blood vessels when your heart beats and when your heart rests. You have high blood pressure when the force is too much. DIOVAN can help your blood vessels relax so your blood pressure is lower. High blood pressure makes the heart work harder to pump blood throughout the body and causes damage to the blood vessels. If high blood pressure is not treated, it can lead to stroke, heart attack, heart failure, kidney failure and vision problems. Heart Failure occurs when the heart is weak and cannot pump enough blood to your lungs and the rest of your body. Just walking or moving can make you short of breath, so you may have to rest a lot. Heart Attack (Myocardial Infarction): A heart attack is caused by a blocked artery that results in damage to the heart muscle. What should I tell my doctor before taking DIOVAN? Tell your doctor about all your medical conditions including whether you: U have any allergies. See the end of this leaflet for a complete list of ingredients in DIOVAN. U have a heart condition U have liver problems U have kidney problems U are pregnant or planning to become pregnant. See “What is the most important information I should know about DIOVAN?â€? U are breast-feeding. It is not known if DIOVAN passes into your breast milk. You and your doctor should decide if you will take DIOVAN or breast-feed, but not both. Talk with your doctor about the best way to feed your baby if you take DIOVAN. Your doctor or pharmacist will know what medicines are safe to take together. How should I take DIOVAN? U Take DIOVAN exactly as prescribed by your doctor. U For treatment of high blood pressure, take DIOVAN one time each day, at the same time each day. U If your child cannot swallow tablets, or if tablets are not available in the prescribed strength, your pharmacist will mix DIOVAN as a liquid suspension for your child. If your child switches between taking the tablet and the suspension, your doctor will adjust the dose as needed. Shake the bottle of suspension well for at least 10 seconds before pouring the dose of medicine to give to your child. U For adult patients with heart failure or who have had a heart attack, take DIOVAN two times each day, at the same time each day. Your doctor may start you on a low dose of DIOVAN and may increase the dose during your treatment. U DIOVAN can be taken with or without food.

U If you miss a dose, take it as soon as you remember. If it is close to your next dose, do not take the missed dose. Take the next dose at your regular time. U If you take too much DIOVAN, call your doctor or Poison Control Center, or go to the nearest hospital emergency room. What are the possible side effects of DIOVAN? DIOVAN may cause the following serious side effects: Injury or death to an unborn baby. See “What is the most important information I should know about DIOVAN?â€? Low Blood Pressure (Hypotension). Low blood pressure is most likely to happen if you also take water pills, are on a low-salt diet, get dialysis treatments, have heart problems, or get sick with vomiting or diarrhea. Lie down, if you feel faint or dizzy. Call your doctor right away. Kidney problems. Kidney problems may get worse in people that already have kidney disease. Some people will have changes on blood tests for kidney function and may need a lower dose of DIOVAN. Call your doctor if you get swelling in your feet, ankles, or hands, or unexplained weight gain. If you have heart failure, your doctor should check your kidney function before prescribing DIOVAN. Los cambios son parte de la evolución de nuestra vida, nuestro planeta y el universo. Nuestro idioma el español también está evolucionando, existen nuevas reglas de gramática y cambios ortográficos para algunas palabras, por ejemplo las letras Ll y Ch, ya no forman parte del alfabeto por ser consideradas como dígrafos, signos ortográficos de dos letras. Ahora son solamente 27 las letras que conforman el alfabeto. Desde el 2010 ya no se acentuará la letra “o” cuando vaya en el medio de dos números. Antes se escribía 20 ó 30, ahora solamente 20 o 30, sin acento en la letra “o”. La letra “Y” griega, ya no se llama así, ahora se llama simplemente “ye”. Anteriormente a algunas letras se les designaba por varios nombres, por ejemplo la B, era conocida como B alta, B labial o B grande, ahora con los cambios que está experimentando el español, la B se llama únicamente be; la V, uve y doble uve para la W; por su parte la “I’ latina se llamará únicamente “i”. Es necesario que se tomen en cuenta estas nuevas reglas de la lengua española, pues tanto se habla de nue-

stro orgullo hispano, y gran parte de ese orgullo es “nuestro idioma”. Es lamentable observar en algunas publicaciones e incluso en la televisión algunos errores de ortografía o mayúsculas sin el debido acento, las vocales mayúsculas cuando lo necesiten deben ser acentuadas, “esta regla ya data de hace tres décadas”, sin embargo; seguimos observando en la televisión que algunas veces las acentúan y otras veces no. Es un deber y una responsabilidad de los medios impresos y televisivos el mostrar una ortografía y gramática correcta, sin errores ni faltas. La gran mayoría de personas no están al tanto de las reglas gramaticales contemporáneas y es un deber de los medios el informar, mostrar y respetar dichas reglas. Otros cambios que tenemos en el español son los acentos, ya no se acentúan algunas palabras como guion, truhan, fie, riais y Sion. También se elimina la tilde en los demostrativos este y esta. Además algunas palabras que se escribían con Q, como Qatar, y quórum, ahora se escribirán con C, Catar y cuórum. Estos son solamente algunos ejemplos de las nuevas reglas gramaticales, quién desee indagar más en el tema puede hacerlo entrando a la página web de la Real Academia Española. http://www.rae.es/rae.html. his year’s Left Coast Live music festival was two days shorter than the last, but the acts and venues made up for it. Hundreds gathered to see local acts and the more recognized bands. This year, the event incorporated the local business on a friendlier level. People were able to grab some dinner and watch a performance that

gave it that extra intimate feel. The silent disco was also a huge hit, where festivalgoers listened to DJ sets with headphones and danced the night away. The headliners included The Limosines, Orgone, and Mara Hruby. Among the performers were Chico Mann and Los Rakas, EO had the pleasure of interviewing both. Aficionados del América festejan 95 aniversario del equipo

Así, mientras el técnico Alfredo Tena dirigía la práctica de sus pupilos, de cara al partido de la fecha 13 en el cual visitarán a Monterrey, los aficionados entonaron sus cánticos para mostrar su apoyo al equipo. Al final de la práctica los aficionados se retiraron del lugar debido a que los integrantes del club tendrían un festejo íntimo para celebrar este aniversario, que llega en un mal momento para el equipo azulcrema. Para festejar sus 95 años, el equipo estrenará una playera el próximo 23 de octubre, cuando reciban en el estadio Azteca al Guadalajara en el clásico nacional; la misma será presentada esta noche en el inmueble donde las Águilas juegan como local.

Big Break Ireland” is a show featured on the Golf Channel with a lineup that includes San José State graduate Nina Rodriguez. “Big Break” features hopeful professional golfers competing in a variety of head-to-head and team format competitions in a “Survivor”-style format. Contestants are eliminated one by one until an overall winner emerges, receiving a cash prize of $50,000, equipment contracts, and 2 exemptions into one of three major tours (LPGA, European Tour, Ladies European Tour). The show airs for ten weeks, which began on September 20. The show was filmed in May 2011 at the K Club’s two Arnold Palmer-designed championship golf courses, (the Palmer Smurfit Course and the Palmer Ryder Cup Course) in Kildare, Ireland. San José parents Norine and John Rodriguez are proud of their daughter, 27 year old Nina Rodriguez and say “Nina has

worked very hard to get to where she is today. She has the compassion and drive, no pun intended” laughs mom, Norine. Nina is one of 6 women and 6 men who hope to put their careers on the fast track and win on the return series of “Big Break Ireland”. Rodriguez is a graduate of Oak Grove High School and San José State University. Rodriguez took up golf while attending Mt. San Antonio College. She was the winner of the 2005 Southern California Regional Championship while attending Mt. San Antonio College, and was a 2005 Foothill Conference All-Conference First Team selection. She currently plays on the Futures Tour, an LPGA’s development tour. “I feel like I am improving each and every day,” said Rodriguez. “Patience has been key for me in the short time I have been playing golf, and it has worked. The Big Break is all about being patient, being in the moment. If I stick to that mentality, I feel like I will be the one to beat.”
