SJPD Ends Partnership with ICE Gang Unit

an Jose Police Chief Chris Moor e has announced that the San Jose Police Department is concluding its partnership with Homeland Security Investigations as part of Operation Community Shield (OCS). The San Jose Police Departments involvement in OCS began on June 24th as part of Chief Moores plan to halt an alarming increase in gang violence in the city. Other components to the plan inv olved r edirecting the 38 member METRO Unit to focus on all gangs, all the time. The METRO Unit has since made o ver 315 arrests. Approximately 70% of the arr ests hav e been gang-r elated. Chief Moore also directed the Patrol Division to deploy additional officers as daily gang suppr ession cars to fur ther decrease gang violence. he unemployed rate has been on the rise since 2006. That was five years ago and since then people have yet to see a thriving economy. Currently it surpasses the nation ’s average u nemployment r ate i n California. The surrounding states are suffering as well. Concerned r esidents o f San Jose attended a town hall that allo wed them to talk about the situation. While many hav e been jobless fo r m onths o r ev en years, some feel that Congress is busy playing politics instead o f getting people back to work. Representative Zoe Lofgren heard the stories of struggling working families and pr omised to help them stand u p to the R epublican Tea Party’s attack on working people a nd v ital p ublic p rograms such as medical and

social security entitlements. “When they work they pay tax es, when they work they pay social securities, when they work they pay state income taxes,” said Jim E. Kelly, director OF the Labor Studies P rogram, San Jose City College. Kelly was one of the 29 people who spoke about his concerns wi th t oday’s e conomy. H e ta lked a bout t rade agreements and explained how NAFTA had a negative impact on the working people of Mexico and the United States. Another speaker believed that immigr ants w ere to blame for some of today’ s economic problems. However another speaker brought up the issue of having driver’s license legally issued to the undocumented. “In our curr ent emplo yment situation we need to be better than average and that’s what w e try to instill in our students,” said Hermelinda

Sapien, Chief Executive Officer, Ce nter f or Em ployment Training (CET). Student speakers explained how they are trying to support their family by going back t o sc hool t o u pgrade their knowledge and skill levels. They are taking whatever

steps necessary to achiev e that personal goal. Ov erall they are hopeful that they will find a job but would like to see and feel the cr eation of jobs. The majority of the speakers have struggled all their life and while CE T pr ovides the training and preparation, they

Por Carlos Ponce Cónsul General de México l hablar de los derechos laborales, podríamos empezar con informar a la gente en primer lugar que el estatus migratorio de una persona e s i ndependiente a l a situación laboral en la que se encuentre. Un gran porcentaje de abusos laborales se sigue dando por la abstención del trabajador a denunciarlos, debido al temor fundado por los empleador es a tener consecuencias migratorias si denuncian estas injusticias. Así, independientemente de la característica migratoria en que se encuentre, todo trabajador tiene el derecho a recibir por lo menos el salario mínimo como pago por su trabajo, siendo éste de $8.00 dls por hora en Ca lifornia, y $7.25 dls por hora a nivel Federal. Pero el pago, no es el único der echo laboral, es de importancia también considerar que aunado a lo anterior, toda persona tiene derecho a trabajar en un am biente libre de acoso y discriminación, ya sea por su nacionalidad, raza o sexo o aspecto. De igual manera, derecho a tomar un descanso de diez minutos por cada 4 horas de trabajo, y a ingerir sus alimentos, después de 5 hrs de trabajo. Dependiendo del área de trabajo, usted tiene derecho a hidratarse, contar con sombra, higiene, ventilación, capacitación, herramientas, uniformes, mascarillas, guantes, casco, lentes protectores, y un plan de emergencia. Asimismo, es impor tante destacar que dos de los principales derechos laborales violados son el pago de horas extras y el pago por pr opinas; a continuación, compartimos información útil sobr e estos conceptos para que nuestros paisanos puedan estar bien informados y evitar abusos: Pago por tiempo extra: después de 40 horas trabajadas a la semana se considera tiempo extra, y se pagará a tiempo y medio las primer as 8 hrs (posterior es a las 40 hrs semanales), y después de las 8hrs extras laboradas, se pagará doble. Pago por propinas: Los empleados que estén co ntratados bajo la condición de propina como pago de salario, en v ez de salario mínimo, deberán r ecibir un salario en efectivo de por lo menos $2.13 dls por hor a por parte de su empleador. Si las propinas del empleado combinadas con el salario de $2.13 dls por hor a no equivalen al salario mínimo por hor a, el empleador pagará la diferencia. Otro tema laboral del que nuestr a comunidad de-

sconoce s u r egulación, e s e l t rabajo r ealizado p or menores de edad. Debido a la situación económica actual, esta labor se ha venido incrementando, así que es importante considerar la siguiente información: Todo menor deberá tener por lo menos 16 años de edad para trabajar en la may oría de l os trabajos excluyendo el del campo, y por lo menos tener 18 años para trabajar en trabajos considerados de riesgo por la Secretaría de Trabajo. Jóvenes de 14 y 15 años de edad pueden trabajar fuera de horas escolares en diversos trabajos, siempre y cuando no sea en fabricas, minería, o de riesgo, bajo las siguientes condiciones: No más de3 horas de trabajo en un día escolar, ó 18 hrs en una semana escolar. No más de 8 horas de trabajo en un día no escolar, ó 40 hrs en una semana no escolar. El trabajo en menores de edad no puede empezar antes de las 7 de la mañana o terminar después de las 7 de la tarde, a menos que el tr abajo se desempeñe del primero de junio y hasta el Día del Trabajo, cuando las horas de la tarde se extienden hasta las 9 de la noche. Se aplican reglas distintas al empleo en el campo. El derecho a recibir un comprobante de pago, es importante también, aun y cuando le hayan pagado en efectivo. Si recibe pago con cheque, éste deberá contener datos como: nombr e y dirección de la empr esa, nombre del trabajador, días de trabajo que cubren el cheque, el rango de pago por hora, día o pieza y la especificación de cualquier deducción al salario. Paralelo a esto, es importante que de manera individual cada trabajador lleve un registro en papel de los días y horas trabajados, a fin de compararlo con su cheque, y si fuera el caso, usarlo como fundamento par a algún posible reclamo laboral en el futuro. Si desafortunadamente usted es despedido, tiene derecho a recibir de inmediato el pago de su salario por el trabajo desempeñado hasta ese día. Si usted renuncia, el empleador debe pagarle su salario dentro de las 72 hrs siguientes. De no ser así, usted tiene derecho a recibir un día de salario por cada día de demora de este pago, hasta un máximo de 30 días. Por último, considere el derecho a inscribirse en un sindicato para así estar más informado de sus derechos laborales. Create Jobs For Americans Commission Now! By Hilbert Morales

s the Chief E xecutive Officer of the United S tates of America, President Barack Obama needs to establish a “CREATE JOBS FOR AMERICANS COMMISSION” (JFAC) right now. The reality is that all analysis reveals that jobs are the outcome of having a pr oduct or service which is ‘in demand’ in a market place. Talking about jobs without this contextual inclusion makes no sense. It would be very good to have Ms. Hilda Solis, Secretary, Department of Labor as the “Chairperson” because the purpose of JFAC is to perform the r esearch inv estigation concerning all the facto rs and influences which go into the creation of ‘jobs’. What i s a r equirement f or rectifying the American consumer economy is for all to understand what happens when ‘American l abor’ i s t reated as a c ommodity which can be pur chased offshore at very reduced rates. In addition, the current phenomenon being validated by business and economic statistics is that pr oduction is reaching higher levels while employment continues to diminish. This indicates that corporations are investing their resources (money) into the establishment of assembly lines which maximize the use of robots while minimizing the use of human labor. Because of the impact of IT (information technology) certain types of work can be sent ‘ offshore’ to locations wher e skilled labor may be pur chased for much less than the very same skill set in a member of the American labor force. All of this results in fewer available job opportunities for members of the American labor force. The mission of the JFAC would be to propose public policy which would permit Americans to r etain t heir e mployment while b ecoming i nformed a bout tr ends which would make certain types of employment obsolete and unav ailable. And, it could define the tr aining requirements of new jobs which evolve from innovative and creative businesses. During the past fifty years, jobs such as programming specialists, computer har dware engineers, renal dialysis technologists, car diovascular d evice m anufacturing, I T s pecialists, etc. have been created and provide good incomes to those who meet the standards of knowledge and skills needed. None of these ‘futur e’ jobs w ere effectiv ely p romoted to those who liv ed in disadv antaged communities. Both commer cial interests and the education system were both reactive to the needs of evolving new business enterprises. To meet their immediate needs businesses w ere required to ‘import’ trained brainpower from foreign nations. This was done by issuing prefer-

ential H-1-B visas to those with the training and skill set needed by American business enterprises. Today, t he p ublic p olicy d ebated b y Congress and the Obam a Administration is totally ignoring the needs of ordinary individuals who have family responsibilities. Today’s public policy deals with ‘unemployment compensation pr ogram’ and other w elfare safety nets. The altruistic non-profit community does its best to provide food, clothing and shelter to those who become destitute when unemployed. A prospective approach to public policy about employment is a requirement of the American consumer based domestic economy. We all need to ‘make a living’ which requires earnings that exceed the expenses for ‘middle c lass’ l evels o f l iving ( which means ‘middle class levels’ of consumer capability. America very much needs this “Create Jobs for Americans Commission” because in the end it will deal with the many issues which have caused 14,000,000 to be unemployed and possibly 7,000,000 more who have stopped ‘looking for work’. The current approach of providing unemployment benefits does not addr ess the core issues o f e mployment c oupled w ith r elated he alth i nsurances a nd r etirement standards. The Department of Commerce should not lead this commission because it is responsible for current policy which administers tax credits and subsidies. Likewise the Department of Education should not have the lead in this stu dy because most professional educators have never operated a ‘ for pr ofit’ enterprise. Ms. Hilda Solis, Secr etary, Depar tment of Labor , would be responsible in having this JFAC commission look into those issues and new dev elopements which impact employment. This needs to be done from the perspective of the American workers. No one is addr essing the changes science, technology, engineering and math hav e imposed upon the ability of the masses to earn their way in this economy . Administration of current labor laws (all r eactive) is not enough. The Department of Labor must create and manage a proactive view of what will happen to American labor as an outcome of new knowledge. America can and will look out for American labor by implementation of this new “Cr eate Jobs for Americans Commission” which looks at things now and into the futur e from the perspective of those who have to work for a living.∆

n Tuesday, August 23, the first day of instruction, Somos Mayfair and friends gav e Cesar Chav ez Elementary st udents a wa rm a nd e nthusiastic welcome. They lined the sidewalks of the school, holding up signs of encouragement and applauded the kids, parents and staff. Somos Mayfair is a local or ganization dedicated to cultiv ating the dr eams and power of the people of the Mayfair neighborhood in San Jose. They work collectively and in solidarity towards making their area a place of beauty and dignity. “We just wanted to let the kid s and the parents at Cesar Chavez Elementary school to know that the community suppor ts them, said Jaime Alv arado, E xecutive Dir ector, Somos Mayfair. “We’re ex cited for the kids that it’s their first day back at their school.We are proud of our kids, and were proud of our parents.”

By 7:15am volunteers lined up across the street, helped students cross the streets and were complete cheerleaders for a day. It was a simple and fun way of getti ng kids excited about being back in school. Some of the students were a little scared or m aybe t hey w ere s till i n t he p rocess o f waking up. The parents waved and smiled. They really appreciated the encouragement gestures. “We want the childr en to feel that this is their school They’re happy to be back. They want to be back and stay her e with us,” said Dolores M arquez, p resident, B oard o f Trustees, A lum R ock U nion E lementary School District. The group didn’t get to cheer ev ery student because there are other ways to get on campus. But they w ere made awar e of this happening again at the beginning of the next school year.

altrain has been selected b y the Federal Transit Administration to receive $750,000 to dev elop a compr ehensive program to manage the maintenance of the railroad. The commuter railroad was one of six in the country selected to participate in the $3 million pilot program. The funds will be used to develop an all-inclusive program to track the condition and maintenance of the railroad’s physical assets, which includes everything from railroad ties and signals to benches on station platforms. Caltrain has 55 miles of track, 31 stations and more than 50 crossings. Although Caltrain has a computer softwar e

program to track condition and maintenance, the funding will allow the agency to upgrade its current program, which will make it easer touse. In addition, the new program will allow data entry in the field, which will help save time and ensure that the information is up-to-date. By having a record of the railroad’s condition and maintenance repairs done over time, Caltrain will be better able to plan for the future. The program also will highlight areas that need to be addressed and help prioritize capital projects. The pilot is expected to last 15 months. After that, the results will be analyzed and shared with transit agencies across the country.

n Wednesday, August 17, over 200 people filled the auditorium of the Mayfair Community Center to express their feeli ngs about the potential sal e of the 31-acre property of Rancho Del Pueblo Golf Course. On June 2011, the City Council instructed the staff to “ complete outreach, accelerate the sale process and bring the decision to the City Council as soon as possible” for the sale of 3 1-acre R ancho d el P ueblo G olf C ourse property. Councilmember Xavier Campos was one of the first speakers at the podium and started b y saying, “Selling off 31 acr es of open land for development of up to 570 units will only benefit the dev eloper and not my constituents of East San José. There is no guarantee that the estimated 20 million of r evenue from the R ancho Golf course will be put back into city services. Bottom line is that Rancho del Pueblo can not be used as another scapegoat to our city’s budget deficit”.

Many people in the audience stood in a long line to speak about their disappointment in the council considering the sale of this golf course. One woman said her son had asthma with the smog congestion and that King Road had so much traffic that it took 30 minutes to drive several blocks. To add more housing would increase traffic to a danger point for the residents. Many asked the council not to take away some of the only gr een area that helped the neighborhood. Others spoke about gathering golf balls that were missed on the golf course and using them to learn to play gol f. This helped keep them fr om getting into tr ouble. The g olf course had a posi tive impact on many families, schools, chur ches and leaders of the community. The city will hold a number of community meetings on the potential sale, including a meeting at the Mexican Heritage Plaza on September 7 at 6 pm, a planning commission meeting tentatively scheduled for September 28, and a City Hall Council meeting on October 25. Creating safety and fairness for students with diabetes (ARA) chool is supposed to be a safe hav en for children - a healthy place where they can learn and gr ow. Unfortunately, that’s not always the case for the nearly 200,000 American children with diabetes who may place their health at risk when they boar d the schoo l bus each day. Diabetes is a disease that must be managed 24/7, 365 days a year. At home, these children have par ents, bab y sitters and others to assist them. Similarly , there needs to be someone available t o h elp d uring t he m any

hours s tudents s pend a t s chool and school-sponsored activities. For s ome s tudents, t hat m eans having trained school personnel to help with the insulin they need to survive; for all students, it means someone who knows how to help in an emergency. And although diabetes experts agree that school personnel can be easily trained to help a child with diabetes in need, there are many examples wher e students are left on their own and often aren’t welcome at school because of their diabetes. The American Diabetes Association’s Safe at School Campaign has worked for years to make sure

all children with diabetes have the care they need at school and the same educational opportunities as their classmates. K eeping a child with diabetes safe at school requires a collabor ative effor t among parents, doctors and other diabetes health car e professionals, school nurses, teachers and administrators. A ccordingly, t he Association has developed the resources needed by parents and all members of the school care team. Through the Association’s Safe at School C ampaign, t housands o f families and schools have worked together to develop plans for safe care at school. In many states,

statewide policies were developed specific to diabetes care at school. Recent legislativ e successes include state laws in Florida and Illinois that pr ohibit segr egation based on diabetes, allow students who are able to do so to self-manage their disease, and e nsure school personnel are permitted to provide the car e that students with diabetes need to succeed. “It is vital to ensur e that all children with diabetes hav e the same educational oppor tunities as their peers,” says Linda Siminerio, RN, PhD, CDE, co-chair of the Safe a t S chool Working G roup. “The American Diabetes Association’s Safe at School Campaign trains parents, health care professionals and school personnel to make sure children with diabetes have the care they need, and ar e not being discriminated against or placed in life-thr eatening situations.” But in other states, widespread problems remain. In California, for example, there is only one school nurse for ev ery 2,200 students and a record of students not getting the insulin they need at school. Some students became ill and others were placed at increased risk of long-term complications such as blindness, hear t disease, kidney failure and amputation. Some par ents lost their jobs because of the need to leave the workplace to attend to their

children. I n a l awsuit c urrently pending before the state supreme court, the Association is arguing that under both state and feder al law, school employees should be allowed to volunteer to be trained to help a child with diabetes in need. Supporting the Association is a broad array of agencies and organizations including the United States Departments of Justice and Education, the California Depar tment of Education, diabetes medical exper ts, school boar ds, and civil rights organizations. “The American Diabetes Association is fighting ev ery day, in California and across the country, to Stop Diabetes and make sure that childr en with diabetes ar e never abandoned at school,” says

John W. Griffin, Jr ., chair of the board, American Diabetes Association. “Diabetes experts from parents to doctors to the Centers for Disease C ontrol a nd P revention agree the solution is to train nonmedical p ersonnel t o s afely a dminister diabetes medications in school when a nurse is not av ailable, just as family and friends of children with diabetes are trained every day.” Although the Safe at School Campaign has made significant progress, there is still much wo rk to be done. Fundraiser for American Red Cross

merican Red Cross blood donors and others dedicated to the non-pr ofit’s mission will have a chance to take part in a bit of history this October, when the Northern California Blood Services Region holds its firstever fundraiser. The Out for Blood 5K Fun Run/Walk, a familyoriented community fundr aiser, will be held at Lake Merritt in Oakland on Oct. 22, 2011. The event is open to everyone, and people of all skill levels are encouraged to par ticipate – from serious runners to people looking for a leisurely stroll around the lake. For a $30 registration fee ($25 if they sign up by Sept. 1), participants will receive a race bib, tim-

ing chip, event T-shirt, goodie bag and r efreshments. Prize drawings will be held at the r ace’s conclusion. Registration closes on Oct. 14, and the Red Cross will not be accepting money on the day of the event. All proceeds from this fundraiser will stay in the Northern California Region and be put toward the purchase of a new mobile blood driv e truck. Commitment to an appr oved diabetic diet can be the best inv estment a person with diabetes can make. People with diabetes, both type I and type II, should discuss the condition of their arteries and blood vessels with their doctor. Atherosclerosis is a known side-effect of longterm diabetes that, in the worse-case scenarios, may lead to blockages in the diabetic’ s heart, br ain or leg ar teries. This risk is r e-

duced significantly if diabetics are able to quit smoking, lower their cholester ol, take antiplatelet medications and pursue a hear thealthy diet and exercise program. Many recent studies show that aggressive management of blood glucose immediately following heart or vascular surgery improves outcomes in patients with diabetes. This management frequently includes a car efully monitored intravenous continuous infusion of insulin even if the patient does not typically require insulin to manage their diabetes. This treatment can lower the chances of infections and other adverse events for the diabetic patient in the month following surgery.
