President Obama, the Community Seeks Just and Humane Immigration Reform Now By Richard Hobbs, Immigration Attorney t numerous public events during his presidential campaign, Senator Obama committed to making comprehensive immigration reform a priority in his first year in office. Now as President of the United States, as he holds forth the promise of remaking America, we must hold President Obama to his promise for just and humane immigration reform, with deliberation and due haste. While jobs, economic reforms, and health care may capture the attention of many in these United States, they will be meaningless to undocumented immigrants unless accompanied by comprehensive immigration reform. During his campaign and in his book The Audacity of Hope Barack Obama points out the importance of national public health care. But what good is public health care if eligibility is permanently blocked for 12 million residents of the United States, undocumented immigrants who are not even

eligible for Medicaid, Medi-Cal, or our nation’s human services? On inauguration day our new President stated that “the question we ask today is not whether or government is too big or too small, but whether it works—whether it helps families find jobs at a decent wage…” What good are jobs for 12 million people who are statutorily ineligible to work. who do not have the right to employment authorization? Our new President in word and deed understands that family forms the bedrock of our nation. Yet what about 12 million people in these United States of America, an estimated 200,000 in Santa Clara County, who are denied family reunification and denied the option of visiting a dying parent abroad because of their immigration status? President Obama, you have called for deep reforms in our educational system. But what about millions of energetic and motivated Americans, who cannot even legally receive loans to continue their higher education?

We know that immigrants are a critical component of the U.S. workforce. We know that immigrants, especially in Silicon Valley, contribute mightily to all aspects of the local economy, in particular to productivity growth and technological advancements. We know that immigration reform is good for the economy because immigrants will become full tax payers. We also know that two-thirds of American voters support a path to citizenship for undocumented immigrants, and by a 57% to 28% margin, Americans prefer a comprehensive approach to legalization instead of an enforcement-only approach. And we know that immigrant voters themselves and their families turned out to vote in 2008 in unprecedented numbers to set the stage for change in our broken immigration system. President Obama, the failure to update our immigration system has left us with a growing number of undocumented

workers, and no strategy to integrate them into America. It has left us with an embarrassing under-class, not dissimilar from the slave system that tainted our Nation’s beginnings. We call upon the President and our federal legislators to act now to create a path to permanent residence and citizenship. It is time for all residents of the United States to access health care and a safety net. It is time for all residents of the United States to be able to work legally, with dignity and pride. It is time for all members of this nation to be able to live with their other family members. It is time for all residents of the United States to have full access to education. U.S. Senators, Congresspersons, and President Obama, we call upon you to meet your promises and the promise of America: let tens of thousands of families in Santa Clara County and millions of families across America not only breathe and survive, but also pursue the full measure of their happiness. Budget Crisis Impacts Everything

Hilbert Morales, EL OBSERVADOR the need to build more prison capacity would be mitigated. Another suggestion is to treat the growing of marijuana as an agricultural business so that it may be licensed and taxed. Currently, California is the largest grower of marijuana. Some of it is destroyed by the mitigation efforts of the Drug Enforcement Agency and local law enforcement. The production, distribution and retailing of marijuana need to be treated like a business that legally conducts its activities ‘on the table’ rather than ‘under the table’. As a business its operators will be required to pay license fees and all other taxes (social security, sales, income taxes) just like any enterprise. The categorization of all business will enable the measurement of economic activity and societal collateral costs, which currently are totally borne by ‘legal’ enterprises and the tax paying public. Has it occurred to anyone that legalizing many presently illegal activities would enable the measurement of their business activity? This same logic may be applied to all other illegal business activities that currently operate as enormous cartels that do not pay their fair share of taxes. The tax revenues which these enterprises do not currently pay are needed to support the infrastructural elements (health care, social services, transportation (roads, harbors and airports), water distribution systems) being used in their production, distribution, and retailing activities. It is the injection of religious values, morals and ethics that prevent treating these activities as businesses required to pay their fair share of taxes, espe-

cially sales taxes. It is time to revisit the rationale that permits the sales of goods and services through the Internet without the payment of sales taxes. It is time to develop and use a new paradigm, which is to legalize all transactions that involve the exchange of cash so that sales taxes are collected. It is time to bring all loopholes and special tax exclusions into the light of day to enable their re-evaluation. An effort must be made to close all loopholes. It is time to establish a commission to revisit the purpose of Proposition 13 that was intended to protect retired homeowners having limited fixed incomes from being property taxed out of their homes. Currently, many corporations do not pay their fair share of property taxes because as a special interest, they have prevailed in establishing the view that corporate property ownership is not transferred when shares (or stocks) are sold. The result is that residents bear an inordinate level of providing revenues supporting government by paying license fees, property taxes, sales taxes and income tax revenues to government while special corporate interests do not pay their fair share. This budget crisis impacts everything. Its resolution requires that all sales transactions and transfers be taxed fairly. That means looking at everything in terms of today’s business environment. The Governor and the State Legislature are elected to be decision makers. If they do not make decisions, let’s recall the lot.Δ

he pending dire budget situation where the State of California will run out of money is simply too complex and convoluted to work out using the current partisan posturing and ideological stances taken by individual legislators and the governor. It is time all registered voters consider signing a recall petition which would replace the governor and every legislator in Sacramento for their inability to earn our respect and admiration just for doing what they are all elected to do: Make a decision in the interest of the majority of the people of the State of California. Specifically: Make those decisions which lead to having a balanced budget that allows funding to flow again to those organizations delivering health care, education, social services, mental health services, public safety, environmental protection, public health services, etc. And we must not forget that business activities require monitoring to protect the consumer’s interests. In addition, transportation systems need to continue to operate. Do not cut critical and essential budgets that enable the provision of education (especially at K-12 and community colleges), health care and social services. The Governor and all legislators have ways of balancing the budget. For example, about 70,000 non-violent prisoners could be released from the California Prison system. At the incarceration cost of $40,000 per inmate per year, this amounts to a potential reduction of $2.8 billion per year. In addition,

resident Barack Obama took the Oath of Office to “preserve, protect and defend the Constitution of the United States” before 2-3 million in our capital, and hundreds of millions in homes, offices and factory floors, union halls, places of worship, and more than a few homeless shelters. More than a billion people throughout our interconnected world joined the celebration of our democracy. Why is our celebration shared by so many outside America? The reason is that our United States, the first democratic nation, declared in 1776 “all men are created equal.” America’s political ideals have been a beacon to the world, lighting the rule of law, separation of church and state, the separation of powers, presidential succession without violence, and equal rights. Our democratic ideals, though derived from European philosophers of the Enlightenment, were planted in the New World to harvest a new kind of society-so different from monarchies ruled with tyranny by hereditary inbreeds claiming divine right. Our Constitution and Bill of Rights have been models for other nations’ documents of democracy. But in our celebratory zeal we must fully recognize contradictions and hypocrisies even before the founding of our democracy, including destruction of Native Americans’ villages and culture, forced migration to concentration reservations and near extinction; along with the grotesque and profitable kidnap and enslavement of millions of Africans—to be raped, bred, sold, brutalized and dehumanized. Then came the “manifest destiny” mania that divine will pre-determined our nation “reach from sea to shining sea,” so the nation of Mexico needed to relinquish half its territory, convinced by a war that took future Civil War heroes from both sides to occupy Mexico City. The exclusion of women from full rights continues to this day with unequal pay and persistent efforts to deny them reproductive choice. After two centuries of struggle, civil rights have increased, yet the poverty and imprisonment of African-Americans and other peoples of color is a legacy of our sordid history. Our nation’s ordeal to resolve the hypocrisies of our history haunt us to this day, as new challenges arrive on top of those not yet to be fully acknowledged, let alone resolved. President Obama eloquently stated, “We the People have remained faithful to the ideals of our forebearers and true to our founding documents.” The founding document is the Constitution, but the bitter truth is that rights have been trampled by Bush’s signing statements declaring which laws to obey, which to disregard, and which laws to transmogrify by the President’s Office of Legal Counsel “opinion” claiming waterboarding (pouring vast quantities of water down the throat of a completely restrained person just before the point of death or organ failure) to be merely “enhanced interrogation techniques” rather than torture! The stubborn reality is that too often elected leaders have not kept true to our Constitution. Obama continues, “We are in the midst of crisis...our nation is at war... our economy is badly weakened, a consequence of greed and irresponsibility on the part of some...” Public servants often served private interests, greedily robbing fellow citizens of their hard earned livelihood through graft, manipulation and outright theft. The Wall Street Meltdown was aided and abetted by President, Congress and federal banking agencies beholden to corporate instead of public interests as sworn to in their oaths of office. Gratefully, our new president recognized “the men and women obscure in their labor, who have carried us up the long, rugged path towards prosperity and freedom...who toiled in sweatshops, endured the lash of the whip and plowed the hard earth.” But sweatshops remain; farm workers live in squalor, even minimum wages are not always paid, and healthcare in not affordable for many. President Obama’s promise and challenge: “Starting today, we must...begin the work of remaking America...(so) we can restore the vital trust between the people and their government. We reject the false choice between our safety and our ideals...our fathers drafted a charter to assure the rule of law and the rights of man...our power alone cannot protect us, nor does it entitle us to do as we please. Security emanates from the justness of our cause, the force of our example. As the world grows smaller, our common humanity shall reveal itself, and American must play its role in ushering in a new era of peace!” Δ

he San Jose Conservation Corps and Charter School held its annual graduation ceremony on Friday, January 16, at the Santa Clara County Fairgrounds. One hundred students graduated this year from the charter school. “Today is both a sad day and a happy day,” said graduate Dennis Merrel. “I am happy that I am graduating, but I am also sad that I am leaving the San Jose Conservation Corps.” Merrel credits the charter school for helping him get his life going in the right direction. “Before I entered the program, I was going nowhere fast. Most likely jail or prison,” Merrel said. “Now I am looking for-

ward to a positive future.” Marlen Rodriguez also credits the charter school for getting her life going in the right direction. She is a single mother who said she used to be in an abusive relationship prior to attending the San Jose Conservation Corps. “I wanted to prove to myself that I could do something with my life,” Rodriguez said. “My friends were the ones that told me about the school.” There were many times when she felt like giving up, Rodriguez said. But she stuck with the school’s curriculum and plans to enroll in college. “My dream is to be a nurse,” Rodriguez said. “Thanks to the San Jose Conservation Corps, that dream will come true.” Elected officials Nancy Pyle and Madison Nguyen were also present at the ceremony. “This is one of the joys in life, to see people like you guys succeed,” said Coun-

there to remind president Obama that they played a significant role in his election, and that it was he who said, “It is not what I do, it is what you guys do.” Sandy Perry, a member Cham Ministry in San Jose, was present to encourage the activists. “Yesterday was a day of unity and hope,” Perry said. “Today we need to exercise that.” The activists marched a total of five miles from the Mi Pueblo supermarket to San Jose’s City Hall. They hoped to draw President Obama’s attention and bring immigration reform to the US. “We want a policy that is just and that does not separate families,” Perry said. “We need the raids to stop.” Education is the issue that concerned most of the students. They asked that Obama, as well as their representatives, including Senators Boxer and Feinstein, and Representative Lofgren, to get involved in passing the Dream Act. If the Dream Act passes, those who entered the US without authorization before the age of 16 will be eligible for a six-year residency upon completion of an associate’s degree or two years of military service. If the individual demonstrates good behavior at the end of the six-year conditional residency, he or she can apply for permanent United States citizenship. s the Mayor, Council members and residents of San Jose packed the Mexican Heritage Plaza and watched Barack Obama take his oath and become our 44th President of the United States, a feeling of excitement and hope projected through the nation. Tears, hugs and a standing ovation for our new President showed the intense happiness brought upon by the new start. “I don’t think I’ve seen that many people, in a small capacity, overwhelmingly happy,” said Guadalupe Trujillo. “I don’t think there were any lingering thoughts other than positivism, which is inspiring.” Alejandra Moreno, who also watched the inauguration through the big screen at the Mexican Heritage Plaza exclaimed, “I have a renewed sense of pride for my country.” Joyce Randolph sang “Oh Beautiful” and about 350 people stood, held hands, swayed and sang along with her. Leon Beachman told the story of when he was young and wondered about the kids who attended a two-story school he was not allowed to attend, that was fenced and paved, that he would pass on the weekends with his grandfather. “The part that I found ironic was that every morning we all did the same thing, we put our right hands over our heart and said, ‘One nation, indivisible, with liberty and justice for all.’ The difference to us was that this was a prayer, and ladies and gentlemen, our prayer was answered today.”Δ

En la ciudad de San José se organizaron eventos para presenciar la juramentación del presidente número 44 de los Estados Unidos. “Ver un momento histórico a lado de amigos ha sido maravilloso. Esto es una fiesta, el sentimiento que vivimos es totalmente diferente al pasado y creo que existen esperanzas por mejorar nuestro país”, dijo Benjamin Berman quien participó en un evento organizado por el movimiento MoveOn en Willow Glen. Por su parte Karen Lee Wald dijo esto es un sueño hecho realidad. “Nunca pensé que este momento llegaría. Yo fui parte de la marcha del año 63 y ahora que veo a un hombre de color convertirse en la maxima autoridad puedo sentir confianza. Existe una sociedad nueva y siento que se hace justicia luego de muchos años de lucha”. “Este momento es maravilloso. Se ha cumplido un sueño que guardaba conmigo. Stroke Care System Provides Best Possible Care, Challenged by Publicʼs Lack of Awareness about Stroke Symptoms

AN JOSE, CALIF. Stroke is the third leading cause of death, and the leading cause of severe, long-term disability in the United States, yet nationally, only 26% of the general public can name one or more of the warning signs of stroke. Nearly two years ago, Santa Clara County became the first County in California to implement a comprehensive stroke care system. While the best possible care can be provided through a stroke care system, the challenge continues to be public awareness about the symptoms of a stroke and immediately calling 911 for assistance. Most patients wait, on average, 22 hours to get help. Approximately one-half of all patients who suffer from a stroke either fail to call 911 quickly, or fail to call 911 at all and end up delaying what can be life saving treatment. “While our stroke care system ensures that every stroke patient who calls 911 will be transported to one of eight stroke centers and will have the best hope for recovery, time is a critical factor,” said Supervisor Liz Kniss, President of the County of Santa Clara Board of Supervisors. “We need to increase public awareness about stroke symptoms and urge quick response - if in doubt, make the phone call.” The only early acute treatment available for stroke needs to be ad-

ministered within three hours of the onset of symptoms, yet less than 5% of stroke patients currently receive the treatment, most often due to passing the three hour window of opportunity. Strokes are caused when a blood vessel in the brain becomes blocked or ruptured, no longer delivering oxygen and nutrients to brain cells. This can lead to symptoms including: • a sudden weakness or numbness of the face, arm and leg, especially on one side of the body; • sudden confusion, trouble speaking or understanding; • sudden trouble seeing in one or both eyes; • sudden trouble walking, dizziness, loss of balance or coordination; and • sudden severe headache with no known cause. “The goal of our stroke care system is to save lives and reduce disability for Santa Clara County EMS patients,” said Bruce H. Lee, Emergency Medical Services Director. “Our pre-hospital policies have had the effect of raising our community’s standard of care for stroke to an unparalleled degree making Santa Clara County the safest place to have a stroke in California.” Inspired by Santa Clara County’s successful trauma care sys-

tem, under the leadership of the County Board of Supervisors, the EMS Agency partnered with eight hospitals in Santa Clara Valley on a landmark effort to create an integrated system for stroke care, from the moment the 911 call is placed to when the patient is discharged from the hospital. As a result, every patient who calls 911 with symptoms of an acute stroke is taken immediately and directly to a certified stroke center where they are evaluated immediately and are treated with specially trained emergency physicians and stroke neurologists. “Strokes need be recognized as early as possible in order to provide stroke victims with the best possible care and reduce their time to treatment,” said Dr. Jeff Fraser, Director of the Stroke Center at Santa Clara Valley Medical Center. “Immediate emergency medical care can make all the difference between life and death and can vastly improve the quality of life for a stroke survivor.” There are eight Primary Stroke Centers certified by the Joint Commission for Accreditation of Healthcare Organizations in Santa Clara County, including Santa Clara Valley Medical Center, Good Samaritan Hospital, Regional Medical Center, Stanford Medical Center, El Camino Hospital, Kaiser San Jose Hospital, Kaiser Santa Clara Hospital, and O’Connor Hospital. This represents about 20% of all 48 Stroke Centers in California and remains the largest concentration in any other county. Five of the eight hospitals attained certification while they were provisionally designated by the EMS agency. In the two years since the implementation of the Stroke System in March 2006 through March 2008, eight stroke centers have taken care of 6,454 stroke patients of which 3,267 (51%) were transported by EMS. Nationwide, statistics show that stroke patients call 911 about 40% of the time thus potentially delaying or making them ineligible for treatment. “County residents are much more likely to arrive at the correct hospital and are much more likely to arrive more quickly,” Daniel Peddycord, Public Health Administrator. “The key now is to increase public awareness about the symptoms of stroke so they call 911 for immediate medical assistance.”

Survey Shows Allergies Taking A Toll On Americaʼs Youth (NAPSA)-Kids are feeling tired, miserable and irritable. They’re underperforming at school. And all because of...allergies? The findings of the landmark Pediatric Allergies in America(tm) Survey report that far too many of our children are putting up with bothersome allergy symptoms like stuffy noses, coughing and sneezing that are getting in the way of daily life. This, the largest, most comprehensive national survey of its kind, is sounding an alarm among experts. It turns out that better management of allergic rhinitis (commonly known as “hay fever”) is just what the doctor ordered. “Our nation’s children are being sidelined by allergies,” said Michael Blaiss, M.D., Clinical Professor of Pediatrics and Medicine at the University of Tennessee and consultant for Sepracor Inc. “This survey is a wake-up call for parents and health care providers that our kids need effective and safe allergy symptom relief so they can get on with the business of being kids.” The survey suggests that allergy symptoms unnecessarily: •Limit children’s activities. Parents of children with allergies are twice as likely to say that allergies limit their children’s activities compared to parents whose chil-

dren did not suffer from allergies. •Interfere with school. Forty percent of children with allergic rhinitis report their condition interferes with their performance at school compared to only 10 percent of children without allergic rhinitis. •Disrupt children’s sleep. Forty percent of parents indicated that their child’s allergies interfere “a lot or somewhat” with their sleep. “This survey shows that kids, just like adults, are not happy with the allergy relief they are currently getting. This is one reason why nasal allergy sufferers sometimes stop or switch medications,” said Dr. Blaiss. “Having a treatment that worksand is safe-is important to children and adults whose nasal allergy symptoms interfere with everyday life.” The Pediatric Allergies in America Survey, conducted by the national public opinion research organization Schulman, Ronca and Bucuvalas, Inc.
